[05:10.640 --> 05:21.780] I'm trying to lay the groundwork so that all of us can begin to get action from the courts. [05:21.780 --> 05:28.800] Right now, if you file a criminal complaint against a public official, the public officials [05:28.800 --> 05:31.920] will get it and throw it in the trash. [05:31.920 --> 05:40.800] And I have a suit in that actually has two issues in it, kind of has three. [05:40.800 --> 05:46.360] The first issue is examining trial. [05:46.360 --> 05:55.240] That is the primary issue that has led to this mass incarceration issue and this separation [05:55.240 --> 05:59.120] between the public and the police. [05:59.120 --> 06:00.480] That's the first thing that's in there. [06:00.480 --> 06:02.880] The second thing is in their speedy trial. [06:02.880 --> 06:09.720] In order for this mass incarceration scheme to work, they can't have a speedy trial getting [06:09.720 --> 06:11.920] in the way. [06:11.920 --> 06:17.280] So I'm addressing both of those issues in this suit. [06:17.280 --> 06:29.520] And one more issue I'm addressing, and that is a 15.09 complaint, the requirement under [06:29.520 --> 06:38.880] 15.09 that a magistrate issue a warrant when served with a complaint. [06:38.880 --> 06:45.880] The next one, this one is in order to get us access to the courts for redress and grievance, [06:45.880 --> 06:50.760] which we do not have now at all in Texas. [06:50.760 --> 06:54.000] So this one's to open the door for that. [06:54.000 --> 07:00.240] I have landed right on top of the highest judges in Texas. [07:00.240 --> 07:11.720] And I don't believe they have it in their head that what they've been doing is so wrong. [07:11.720 --> 07:17.040] They're doing things and they've been teaching magistrates to do things the way people have [07:17.040 --> 07:19.680] done things. [07:19.680 --> 07:21.800] And they seem to think it's okay. [07:21.800 --> 07:32.600] Second thing you might be interested in, Brett, is I sent a plea to Combi Court, Combi Municipal [07:32.600 --> 07:33.600] Court. [07:33.600 --> 07:37.440] Oh yeah, our best buds. [07:37.440 --> 07:41.760] Oh, talk about surprise. [07:41.760 --> 07:48.360] I get a call from the judge and I told her, oh, you're the new judge. [07:48.360 --> 07:51.840] I'm going to suit a pants off you guys. [07:51.840 --> 07:57.960] She said, well, that for me is neither here nor there, but I took over this position and [07:57.960 --> 08:00.000] I've got a lot of mess to clean up. [08:00.000 --> 08:08.040] She called me to tell me that she's dismissing my case. [08:08.040 --> 08:10.480] Too old to process. [08:10.480 --> 08:13.880] The one that they had against you and they were trying to give you a hard time with the [08:13.880 --> 08:14.880] state? [08:14.880 --> 08:21.120] Yeah, they wouldn't take my, they wouldn't allow me to file motions and pleadings even [08:21.120 --> 08:25.400] after I called 9-1-1 on them. [08:25.400 --> 08:27.400] And she says too old. [08:27.400 --> 08:33.800] Now just all of a sudden, doesn't have anything to do with the suit, it's just, that's neither [08:33.800 --> 08:36.520] here nor there, but she's going to just dismiss anyway. [08:36.520 --> 08:38.000] Wait a minute, wait a minute. [08:38.000 --> 08:43.720] I talked to her for quite a while and she used to be a JP. [08:43.720 --> 08:48.680] And I told her what my issue was and she agreed with me. [08:48.680 --> 08:52.680] She said, it's always been a problem for me when I was a JP. [08:52.680 --> 08:56.560] They never brought people to me. [08:56.560 --> 09:01.960] And she said that they trained them correctly. [09:01.960 --> 09:05.600] It's just that nobody followed the law. [09:05.600 --> 09:07.200] Wait, trained them? [09:07.200 --> 09:08.200] Who's them? [09:08.200 --> 09:11.840] They trained the Districts correctly, but not the peace officers? [09:11.840 --> 09:12.840] Yeah. [09:12.840 --> 09:16.080] So, but I want to get her on the show. [09:16.080 --> 09:26.840] She's one of us, or if not one of us, she is actually a judge who wants to do it right. [09:26.840 --> 09:32.840] Holy mackerel, a municipal judge who wants to do it right? [09:32.840 --> 09:41.880] And I even asked her if she would be willing to address this with the state legislature, [09:41.880 --> 09:43.880] right before the legislature on the subject. [09:43.880 --> 09:46.080] She said, yes, she would. [09:46.080 --> 09:49.480] So I would like to get her on the show. [09:49.480 --> 09:54.920] So to demonstrate to everybody that not all these folks are bad guys. [09:54.920 --> 09:57.000] That's amazing. [09:57.000 --> 10:03.560] Some of them are caught inside a system they didn't create and they, because they're inside [10:03.560 --> 10:04.760] it, can't fix it. [10:04.760 --> 10:06.440] It's up to us to fix it. [10:06.440 --> 10:12.120] So anyway, that was a wonderful conversation I had. [10:12.120 --> 10:16.680] So those who are dropped, they still got my license suspended. [10:16.680 --> 10:19.680] It should have been unsuspended. [10:19.680 --> 10:24.240] It may be, but now I'll get on and check that so I can get my license back. [10:24.240 --> 10:27.400] And then I'm going after Rome, Texas. [10:27.400 --> 10:31.400] But that's kind of an aside. [10:31.400 --> 10:41.440] My lawsuit is to, the main thing I'm hoping to get out of the lawsuit is an order that [10:41.440 --> 10:53.280] when a magistrate is presented with a criminal affidavit, they are to either issue a warrant [10:53.280 --> 11:05.000] forthwith or anytime the magistrates authorized to issue a warrant, they can issue a summons. [11:05.000 --> 11:11.320] And I was in some government code and it was talking about summons and it said they could [11:11.320 --> 11:16.880] issue a warrant or a friendly summons. [11:16.880 --> 11:17.880] That was odd. [11:17.880 --> 11:18.880] Friendly? [11:18.880 --> 11:23.880] Yeah, it said friendly summons. [11:23.880 --> 11:29.040] So they could issue a friendly summons, I wouldn't have any problem with that. [11:29.040 --> 11:38.960] Just so the person is called onto the carpet to stand and answer, that'll be, and I would [11:38.960 --> 11:42.240] be satisfied with that. [11:42.240 --> 11:50.960] So that the magistrates know that if they violate Walker v. Packer or they fail to act [11:50.960 --> 12:00.400] in accordance with 15.09, they can be called onto the carpet to stand and answer. [12:00.400 --> 12:03.440] That's the first step. [12:03.440 --> 12:06.080] Second step is speedy trial. [12:06.080 --> 12:15.240] I have a friend who, the police accused him of resisting arrest because he skinned up [12:15.240 --> 12:21.840] their knuckles with his face and they went after him to cover what they did. [12:21.840 --> 12:35.920] It has been over 120 days and I think it's 26.030 something, I forget, or 26.028 I think [12:35.920 --> 12:48.640] it is, that requires that after an arrest, an indictment must be brought within 120 days. [12:48.640 --> 12:51.320] That's in statute. [12:51.320 --> 13:00.480] So I'm going to move for dismissal or failure to timely indict. [13:00.480 --> 13:08.720] The second thing that I want, anyway, that's kind of an aside as well, this speedy trial. [13:08.720 --> 13:16.240] If we get an order on speedy trial, I have included the preamble to House Bill, I think [13:16.240 --> 13:28.040] it's 4028, that created the Speedy Trial Act, which has been ruled unconstitutional. [13:28.040 --> 13:43.840] Another issue I intend to get to, I can see where a court can rule that a statute is unconstitutional, [13:43.840 --> 13:51.440] but I can't find where they can refuse to enforce the statute just because they decided [13:51.440 --> 13:52.440] it's unconstitutional. [13:52.440 --> 13:58.360] Yeah, they have to decide it first. [13:58.360 --> 14:04.600] Well, even if they decide it, they still can't not enforce it because it's still a statute [14:04.600 --> 14:08.960] until the legislature says it's not a statute. [14:08.960 --> 14:18.200] They can petition the legislature to address the issue or they can petition the governor [14:18.200 --> 14:23.600] to convene a special session of the legislature to consider the issue. [14:23.600 --> 14:32.160] But I don't see anything in law that allows judges or the judiciary to ignore statutory [14:32.160 --> 14:35.480] provisions just because they don't agree with them. [14:35.480 --> 14:37.000] Not at all. [14:37.000 --> 14:41.120] So that's another issue I'm going to, but it's not the main issue. [14:41.120 --> 14:51.000] The main issue is Magistrate before Magistrate, Speedy Trial, and issue a warrant upon arrest. [14:51.000 --> 14:56.800] That's in this first suit I have before the feds right now. [14:56.800 --> 15:05.080] I'm working on the next one for Victoria County for Dr. Joe, and on that one, my primary thrust [15:05.080 --> 15:11.240] is going to be access to Grand Jury. [15:11.240 --> 15:17.160] I'm making up a bunch of criminal complaints, and I'll be filing them with Magistrates to [15:17.160 --> 15:22.000] get the Magistrates to refuse to act on them, and then I'll file against the Magistrates [15:22.000 --> 15:25.240] with the Grand Jury. [15:25.240 --> 15:33.880] And when the prosecuting attorney interferes with my access to the Grand Jury, I'll petition [15:33.880 --> 15:45.360] for a declaratory judgment and ask the court to clarify, I don't know the number now, [15:45.360 --> 15:49.720] they changed the numbers, but it used to be 20.13, 28.13. [15:49.720 --> 16:00.720] So that's what it was, Brett, the one that's duties of the Grand Jury. [16:00.720 --> 16:06.960] Duties of Grand Jury shall be the duty of the Grand Jury to investigate into all crimes [16:06.960 --> 16:12.080] that come to their knowledge by way of any member of the Grand Jury, the prosecuting [16:12.080 --> 16:16.200] attorney, or any credible person. [16:16.200 --> 16:22.080] And I'm going to ask for a petition for declaratory judgment to declare that the district attorney [16:22.080 --> 16:30.320] has no standing to block access to the Grand Jury for the purpose of giving notice of crime [16:30.320 --> 16:31.320] by a citizen. [16:31.320 --> 16:32.320] Just like we wouldn't be able to block him. [16:32.320 --> 16:33.320] We can't block the prosecuting attorney either. [16:33.320 --> 16:34.320] He needs to be able to have access to him because they have a duty to do something. [16:34.320 --> 16:35.320] Those three, if I get those in, that'll give us back access to the courts. [16:35.320 --> 16:36.320] Then we can start going after all of these issues that we have. purpose of interfering [27:38.720 --> 27:43.720] With the foreclosure of my home and interfering with the illegal foreclosure [27:43.720 --> 27:48.720] And theft of my home [27:48.720 --> 27:53.720] Those dummies, Rosen's office, the DA put in writing to me [27:53.720 --> 27:58.720] That they would lower the charges, not put me in prison [27:58.720 --> 28:03.720] If I would agree to drop the civil lawsuit for my home [28:03.720 --> 28:08.720] And never to sue this [28:08.720 --> 28:13.720] Vulture that was at the auction [28:13.720 --> 28:18.720] That subsequently, probably he's the guy that cleaned out my house [28:18.720 --> 28:23.720] And he had his name, Jake Zang, you agree to never sue him [28:23.720 --> 28:28.720] And they even listed my property address that you will not have any lawsuits [28:28.720 --> 28:33.720] Involving this home, so I don't think they could have made it much more clear [28:33.720 --> 28:38.720] That they wanted to interfere with a civil lawsuit that I'd been involved in for nine months [28:38.720 --> 28:43.720] And was winning [28:43.720 --> 28:48.720] And again, you got [28:48.720 --> 28:53.720] Purlish with me last week when I started to get into the details of the case [28:53.720 --> 28:58.720] But those are two damning pieces of evidence against the DA [28:58.720 --> 29:03.720] And why I say that they're interfering [29:03.720 --> 29:08.720] He abused his office to interfere with civil litigation [29:08.720 --> 29:13.720] And interfere with my constitutional rights to do so [29:13.720 --> 29:18.720] I had a constitutional right to record a quit claim deed [29:18.720 --> 29:23.720] From my name to my trust [29:23.720 --> 29:28.720] I had a right to do that [29:28.720 --> 29:33.720] He charged me with PC-115 felony recording false documents [29:33.720 --> 29:38.720] And when I wouldn't pay for a deal two years, three years in [29:38.720 --> 29:43.720] He added forgery to that same quit claim deed document [29:43.720 --> [34:09.720 --> 34:15.720] Well, I have those one through 50 listed [34:15.720 --> 34:25.720] Oh, okay. Make sure you sue them in their private capacity for acting outside of scope [34:25.720 --> 34:36.720] Well, we haven't talked strategy, but as you know, if you're suing them in their private capacity, you have more time to do so [34:36.720 --> 34:40.720] When you're suing the government, you have a shortened amount of time [34:40.720 --> 34:46.720] And the process starts with first submitting a claim [34:46.720 --> 34:57.720] They then have, if they don't answer this by rejecting or accepting it within a period of time, I believe it's two months [34:57.720 --> 35:02.720] I can then go ahead and file my lawsuit [35:02.720 --> 35:13.720] If they do answer this and reject it, I have six months to sue them from the rejection date [35:13.720 --> 35:20.720] This is just procedural, and that's in the state, I agree, that does not apply in the federal court [35:20.720 --> 35:27.720] Right, and none of that applies if you sue them in their personal capacity [35:27.720 --> 35:35.720] Right. However, I did consult with a lawyer [35:35.720 --> 35:38.720] I have a legal service and I exercised it [35:38.720 --> 35:50.720] And he talked, this lawyer specializes in this type of case or civil rights violations, and he basically said, I have a winner [35:50.720 --> 35:58.720] And then I talked to him about a week ago, which we had talked three weeks prior [35:58.720 --> 36:02.720] And he was freaking out that I hadn't filled out this form [36:02.720 --> 36:04.720] He's like, you're going to blow it [36:04.720 --> 36:07.720] He says, you have them [36:07.720 --> 36:12.720] He says, you have them, just get this in [36:12.720 --> 36:14.720] Good [36:14.720 --> 36:25.720] So there's also a form I found on the court website, the Superior Court website [36:25.720 --> 36:32.720] And you can fill that out against court employees [36:32.720 --> 36:39.720] And I plan on filling them out on the judges who partook in this RICO action [36:39.720 --> 36:50.720] And I realized, Randy, that I had been arrested a couple of times at the house by San Jose PD [36:50.720 --> 36:59.720] Just prior to the February 11th raid, February 11th of 2015 [36:59.720 --> 37:03.720] Just prior, the two months prior, I'd actually been arrested several times [37:03.720 --> 37:14.720] One of the times, now they were going on the premise that I had been lawfully evicted from the property, which was wrong [37:14.720 --> 37:16.720] But that was their premise [37:16.720 --> 37:21.720] And I remember one time they arrested me, told me they're taking me to jail [37:21.720 --> 37:23.720] Well, they didn't take me to jail [37:23.720 --> 37:27.720] San Jose PD put me in a car, told me they're taking me to jail [37:27.720 --> 37:37.720] They instead drove me to the county hospital and dumped me in the parking lot [37:37.720 --> 37:40.720] What was that about? [37:40.720 --> 37:47.720] As I said, they were operating on the premise, they came to the home, I answered the door [37:47.720 --> 37:48.720] That's super weird [37:48.720 --> 37:51.720] I learned how to answer the door after [37:51.720 --> 37:58.720] Well, yeah, see, this is how it starts, this is the kind of weirdness that was going on in the very beginning [37:58.720 --> 38:05.720] And then when I added Dr. T's Peter Mnuchin, the judge, to the federal lawsuit [38:05.720 --> 38:16.720] I then, this is back in late 2014 or early 2015, January of 2015 [38:16.720 --> 38:26.720] I Googled this judge after I added his name to the federal lawsuit and I was horrified at the claim that this guy's a monster [38:26.720 --> 38:30.720] I went to the FBI, I said I'm afraid for my life [38:30.720 --> 38:38.720] I've added this guy to my lawsuit because he was operating without jurisdiction in the state court when the case was removed to federal court [38:38.720 --> 38:40.720] And that's where the case is now [38:40.720 --> 38:43.720] You need to start watching this judge [38:43.720 --> 38:54.720] And then, like I said, about four or five weeks, four weeks after he was named is when the Army came to my house [38:54.720 --> 38:58.720] And the intent was to kill me that day [38:58.720 --> 39:15.720] And I found out that this Judge Mnuchin became pretty enraged because the federal judge ordered marshals to go serve this Mnuchin [39:15.720 --> 39:18.720] And they did it at the courthouse [39:18.720 --> 39:27.720] The federal marshals went down, served him, served this judge, my lawsuit against him, at the courthouse [39:27.720 --> 39:29.720] He went ballistic [39:29.720 --> 39:32.720] So he was embarrassed [39:32.720 --> 39:35.720] Yes [39:35.720 --> 39:45.720] But also, I've learned that a lot of deputies, they're confused, I guess they think they work for him [39:45.720 --> 39:49.720] They like him, they'll do anything for him [39:49.720 --> 40:00.720] And I was actually just recently warned again by a retired deputy's husband [40:00.720 --> 40:11.720] She had retired, she likes Mnuchin, and the husband told me, you better watch out, Ted, he's scared for me [40:11.720 --> 40:21.720] And I met this guy because I sold him something I had listed on Craigslist, we ended up talking a little bit and then meeting [40:21.720 --> 40:36.720] And yeah, he literally looked fearful as he was telling me, watch out [40:36.720 --> 40:39.720] So [40:39.720 --> 40:43.720] That is worrisome [40:43.720 --> 40:50.720] Well, that, Randy, has been going on for eight years, I've been in fear for my life for eight years [40:50.720 --> 40:59.720] All kinds of things happen, we don't need to rehash it all here, but some things are obvious, like one of the times my car was stolen [40:59.720 --> 41:11.720] There were court papers in the footwells, front and rear seat, front seat and rear seat, and on the seat, and they were my file stamped copies [41:11.720 --> 41:18.720] Well, why would they take those papers? When I recovered the car, they had taken the time to take all those court papers out of there [41:18.720 --> 41:26.720] That was my filing cabinet, was the car, and they took them all, why would anybody do that? [41:26.720 --> 41:38.720] And here's the kicker, when they stole my motorcycle, they dropped it, they dumped it in a cul-de-sac early morning [41:38.720 --> 41:45.720] And the guy had a video in his truck that captured it, literally the camera was 20 feet from these people [41:45.720 --> 41:52.720] They came in, one of the bikes was mine, the other two bikes, there were three riders, and one of the bikes was mine [41:52.720 --> 42:09.720] They circle in, the guy parks my bike, now when they're coming in, it's just before dawn, one of the bikes had its flashers going [42:09.720 --> 42:12.720] Emergency flashers [42:12.720 --> 42:14.720] Do you have the video? [42:14.720 --> 42:30.720] Yes, I do. Who would do that other than law enforcement? [49:30.720 --> 49:34.720] Yes, I wanted to make sure you could complete [49:34.720 --> 49:41.720] At this point, since that incident of the theft of the car was several years ago [49:41.720 --> 49:50.720] And also that car was dumped in front of a video camera at a townhouse complex [49:50.720 --> 49:57.720] It was very interesting, the police, I don't know, the way they acted [49:57.720 --> 50:04.720] I think they'd seen the video, and it was Sunnyville police [50:04.720 --> 50:07.720] So they may not have recognized the people [50:07.720 --> 50:12.720] What I want people to know is, for those that don't [50:12.720 --> 50:19.720] You know, the district attorney's office has basically police within their office [50:19.720 --> 50:24.720] Or investigators that think they're police, that carry guns and badges and all that [50:24.720 --> 50:30.720] But those people have people on the street [50:30.720 --> 50:35.720] Maybe people they've prosecuted before, you know, they're called NARCs [50:35.720 --> 50:41.720] And they put those people up to doing these things [50:41.720 --> 50:46.720] Most of the time, if that kind of thing is going to be done to you [50:46.720 --> 50:52.720] As far as taking action, yeah, if I hadn't had a heart attack and dead on my back [50:52.720 --> 50:57.720] I was the walking dead for several years after the heart attack [50:57.720 --> 51:02.720] I couldn't do anything, I was crawling to my computer at times [51:02.720 --> 51:08.720] So, you know, Randy, you can appreciate this [51:08.720 --> 51:11.720] There was incoming, I kept my head low [51:11.720 --> 51:19.720] I also, by will and determination, I outlasted them [51:19.720 --> 51:24.720] Because they could have gone ahead and taken me to trial and lied to a jury [51:24.720 --> 51:27.720] And said that this was a crime [51:27.720 --> 51:31.720] Now, a lawyer I had at one point wrote them and said [51:31.720 --> 51:36.720] Hey, you might even get a conviction, but this is going to be overturned on appeal [51:36.720 --> 51:40.720] It's not a crime [51:40.720 --> 51:46.720] So, again, all of this abuse is even documented in the case [51:46.720 --> 51:51.720] Because, you know, folks, again, everybody out there [51:51.720 --> 51:55.720] It's a thousand paper cuts that will win your case [51:55.720 --> 52:02.720] You go to court, whatever you say in court really doesn't matter [52:02.720 --> 52:07.720] I've learned and tried to condition myself to be polite even when I'm telling them [52:07.720 --> 52:11.720] Hey, I fired you, you're taking bribes from the county [52:11.720 --> 52:14.720] You can't hear this case [52:14.720 --> 52:18.720] And, you know, I call them Mr. Giffon instead of judge [52:18.720 --> 52:21.720] And have Mr. Giffon say judge [52:21.720 --> 52:23.720] And then I respond back [52:23.720 --> 52:26.720] You're an administrator [52:26.720 --> 52:28.720] I got away with all of that [52:28.720 --> 52:30.720] I was pissed [52:30.720 --> 52:33.720] But that was towards the end [52:33.720 --> 52:40.720] When the fight got the heaviest, I was dug in [52:40.720 --> 52:41.720] I was dug in [52:41.720 --> 52:43.720] I wasn't going to take a hit [52:43.720 --> 52:51.720] And I can guarantee you there were times they probably were looking for me and wanting to kill me [52:51.720 --> 53:00.720] They damn sure wanted to kill me the day that they came out with their phony raid and arrest [53:00.720 --> 53:04.720] I got 30 people with machine guns pointed at me [53:04.720 --> 53:08.720] They have metal plates as big as refrigerator doors [53:08.720 --> 53:11.720] They're so afraid of me [53:11.720 --> 53:15.720] And believe me, I'm not bragging [53:15.720 --> 53:19.720] I'm not in any shape or form [53:19.720 --> 53:25.720] These people, if they were really worried about me, they would have had me killed [53:25.720 --> 53:29.720] I think it came close, or maybe they even did want to [53:29.720 --> 53:33.720] And because of my tactics, they weren't able to get it done [53:33.720 --> 53:37.720] But you've got to understand, I was dug in deep [53:37.720 --> 53:41.720] I kept out of direct fire [53:41.720 --> 53:45.720] And I'd pop up every once in a while on a file of paper [53:45.720 --> 53:50.720] And if you look in the case, I beat them years ago with some of my violence [53:50.720 --> 53:55.720] Speedy trial violations [53:55.720 --> 53:57.720] And various other things [53:57.720 --> 54:02.720] I want to cut it short because I want other people to be able to get on the show tonight [54:02.720 --> 54:04.720] But that's the update [54:04.720 --> 54:06.720] That's where I'm at [54:06.720 --> 54:09.720] I'm going to keep calling in [54:09.720 --> 54:11.720] Maybe I'll try to call in tomorrow night complaint and ask him to issue a warrant [55:19.720 --> 55:21.720] Which he's going to refuse to do [55:21.720 --> 55:23.720] And then I get to sue him for it [55:23.720 --> 55:27.720] You should have kind of document [01:41:39.640 --> 01:41:47.320] so you tell them i can't let you file this kind of document and the guy calls 911 on you the [01:41:47.320 --> 01:41:53.480] policeman comes down there and you order the policeman to arrest you so you sit in there [01:41:53.480 --> 01:41:57.320] this guy's trying to get me arrested because i did what the judge told me to do [01:41:59.080 --> 01:42:01.560] you're going to have a conversation with the judge [01:42:01.560 --> 01:42:11.400] this is how it's all politics and then when this guy doesn't do the arrest you call his boss [01:42:12.760 --> 01:42:17.400] and ask him to arrest this guy and you're out here jumping up and down railing in righteous [01:42:17.400 --> 01:42:21.880] indignation because they're not arresting
