[04:29.440 --> 04:37.000] Generally in Texas, we have a cold spell November, December, then it warms up a bit, and then [04:37.000 --> 04:43.000] we get a cold spell at the end of January, beginning of February. [04:43.000 --> 04:49.280] That's the coldest, generally, and then around March, we get a little cold spell and boom, [04:49.280 --> 04:51.440] it's over. [04:57.520 --> 05:02.720] Okay, I'm going to start out talking about another epiphany I had. [05:02.720 --> 05:08.880] Have I talked about this on the air about 17.024, Brett? [05:11.880 --> 05:20.800] You know, we've all had this question, if this count and Brett are right, and they're [05:20.800 --> 05:26.760] coming on here telling us that all of these public officials in the whole state of Texas [05:26.760 --> 05:34.840] are all doing it wrong, and we're right, how does that happen? [05:34.840 --> 05:49.760] Well, I figured out how it happened, Texas Code of Criminal Procedure Chapter 17.024 [05:49.760 --> 05:58.240] directs the Texas Court of Criminal Appeals, the highest criminal court in Texas, to work [05:58.240 --> 06:12.240] in conjunction with the Office of Court Administration and develop a curriculum for magistrates concerning [06:12.240 --> 06:17.240] bail and other duties. [06:17.240 --> 06:25.080] And they did that, and they gave that to Texas State University, and Texas State University [06:25.080 --> 06:30.560] taught that course, problem. [06:30.560 --> 06:33.240] It's all wrong. [06:33.240 --> 06:38.440] All of these public officials all over Texas are doing it wrong because they're being taught [06:38.440 --> 06:40.720] to do it wrong. [06:40.720 --> 06:47.520] My son-in-law is a justice of the peace, but when he got elected, I walked him through [06:47.520 --> 06:48.520] the codes. [06:48.520 --> 06:51.400] Here's what the code says you are supposed to do. [06:51.400 --> 06:53.880] He's now been a justice of the peace for two years. [06:53.880 --> 06:55.200] He just got reelected. [06:55.200 --> 07:00.200] What do you think he's doing? [07:00.200 --> 07:02.920] He's doing what the others are doing. [07:02.920 --> 07:08.680] I've got three people that I know that they want to do the right thing, and they're following [07:08.680 --> 07:15.240] their training to the T, which is exactly what the law prohibits them from doing. [07:15.240 --> 07:23.420] So it is the Texas Court of Criminal Appeals and the Texas Office of Court Administration [07:23.420 --> 07:26.440] that developed this training. [07:26.440 --> 07:34.000] And Brett, what kind of function is the development of this training? [07:34.000 --> 07:35.000] Is it a judicial function? [07:35.000 --> 07:37.000] I mean, they're all judges. [07:37.000 --> 07:38.000] Nope. [07:38.000 --> 07:39.000] It's administrative. [07:39.000 --> 07:40.000] It's administrative. [07:40.000 --> 07:41.000] Achtoliva! [07:41.000 --> 07:52.920] Administrative, that means they don't have any immunity whatsoever. [07:52.920 --> 08:00.280] So I am suing the Chief Justice of the Texas Supreme, Nathan Hatch. [08:00.280 --> 08:10.120] I'm suing all the judges of the Court of Criminal Appeals, the director of the Office of Court [08:10.120 --> 08:11.120] Administration. [08:11.120 --> 08:17.760] And if I find out who helped develop this course, I'll sue all them too. [08:17.760 --> 08:24.560] And I'm suing the Texas State University for teaching the courses. [08:24.560 --> 08:27.600] Texas State University has culpability. [08:27.600 --> 08:28.600] Why? [08:28.600 --> 08:29.600] Why? [08:29.600 --> 08:37.000] They're a law school. [08:37.000 --> 08:40.480] Why didn't they know better? [08:40.480 --> 08:42.480] Why didn't one... [08:42.480 --> 08:49.400] You have to assume they know or should have known. [08:49.400 --> 08:52.400] Not one of them stood up and said, hey, guys. [08:52.400 --> 08:58.720] Insane or intentionally criminally, acting criminally. [08:58.720 --> 09:07.400] Let me speak to what, I'll tell you what Brett just spoke to in case he didn't get it. [09:07.400 --> 09:09.800] Screws VUS. [09:09.800 --> 09:15.000] It is the case, it is a seminal case that's taught in law schools. [09:15.000 --> 09:18.720] It is the case that reinvigorated the Ku Klux Klan Act. [09:18.720 --> 09:29.240] Ku Klux Klan Act was passed in 1871, but it apparently was never used until 1945. [09:29.240 --> 09:36.000] Sheriff and two deputies, Mississippi, in a bar drinking, upset at this black guy, decide [09:36.000 --> 09:37.000] to go arrest him. [09:37.000 --> 09:41.120] The bartender tries to talk him out of it, they won't be dissuaded. [09:41.120 --> 09:46.400] They arrest him, wind up beating him to death on the courthouse steps. [09:46.400 --> 09:52.960] They're prosecuted in the state, sued in the state, then they were sued in the Fed. [09:52.960 --> 09:56.800] They complained to the federal court that they didn't know they could be sued in the [09:56.800 --> 09:59.520] state and the Fed. [09:59.520 --> 10:12.640] The federal court at 93 USC, I'm sorry, 361 USC 93, I believe is what it is. [10:12.640 --> 10:16.200] Just look up Screws VUS. [10:16.200 --> 10:24.840] At page 109, it says that a private citizen cannot claim ignorance of the law as a defense [10:24.840 --> 10:33.520] of prosecution, a public official is held to a much higher standard. [10:33.520 --> 10:44.220] If a public official violates a ruling of this court, and he be sane, he may not be [10:44.220 --> 10:47.240] heard to say he knows not what he does. [10:47.240 --> 10:52.480] So what are all of the judges of the Court of Criminal Appeals going to say when I sue [10:52.480 --> 10:55.560] them personally for training everybody to do it wrong? [10:55.560 --> 11:05.840] And not just wrong, horrendously wrong. [11:05.840 --> 11:19.880] The primary code they used to eliminate examining trials was a addition to 14.06 that was originally, [11:19.880 --> 11:26.960] apparently was recently put in in 1965, where it said that a person who is arrested for [11:26.960 --> 11:31.360] an on-site offense, the officer shall take and direct from the nearest magistrate. [11:31.360 --> 11:41.040] Or in order to more expeditiously provide the warnings of 15.17, they may be taken to [11:41.040 --> 11:45.000] any other county in Texas. [11:45.000 --> 11:54.680] It says any other county in Texas that should have been read to mean if they were arrested [11:54.680 --> 12:01.760] outside the county of jurisdiction, then they could be there to be taken to the nearest [12:01.760 --> 12:02.760] magistrate. [12:02.760 --> 12:08.600] And if that magistrate happens not to be in the jurisdiction where the arrest occurred, [12:08.600 --> 12:15.640] this gave the magistrate the option of not holding an examining trial immediately, but [12:15.640 --> 12:22.280] could just give the warnings in 15.17, and that's essentially random warnings. [12:22.280 --> 12:26.400] And then once the person gets back to the county of original jurisdiction, they have [12:26.400 --> 12:31.240] a right to an examining trial in the county of jurisdiction. [12:31.240 --> 12:34.120] But they decided to interpret that differently. [12:34.120 --> 12:41.560] Now 15.16 has a similar paragraph that addresses the same issue that says the magistrate shall [12:41.560 --> 12:43.960] give the warnings in 15.17. [12:43.960 --> 12:53.120] Well, what the prosecutors did was said, oh my goodness, all we have to do is have the [12:53.120 --> 12:59.080] magistrate give the warnings in 15.17, problem. [12:59.080 --> 13:04.960] One of the warnings in there is that they have a right to an examining trial. [13:04.960 --> 13:15.080] But the way they interpreted it, it had the effect of nullifying Chapter 16, Texas Code [13:15.080 --> 13:17.120] of Criminal Procedure. [13:17.120 --> 13:24.760] And under the Code Construction Act, Government Code 311, you cannot interpret a statute in [13:24.760 --> 13:30.400] such a way that it nullifies or adversely affects another statute. [13:30.400 --> 13:37.160] That would be an unconstitutional interpretation, and they're forbidden to do it that way. [13:37.160 --> 13:40.440] But they did it that way. [13:40.440 --> 13:46.680] And the Texas Court of Criminal Appeals put that in their curriculum. [13:46.680 --> 13:54.720] They put in their curriculum that you do not have a right to an examining trial in a misdemeanor. [13:54.720 --> 14:01.840] That's not what Gerstein Pugh said, the controlling federal case. [14:01.840 --> 14:12.240] It says on every arrest the accused shall be provided a preliminary hearing, and everybody [14:12.240 --> 14:16.880] else calls this a preliminary hearing, Texas calls it an examining trial. [14:16.880 --> 14:26.600] But it is a hearing where a magistrate, a neutral magistrate, sits and hears the claim [14:26.600 --> 14:33.080] from the, starts to say the claim from the policeman, but hears that second. [14:33.080 --> 14:39.440] First thing he hears is the accused's side before any evidence is entered into the court. [14:39.440 --> 14:43.560] The accused shall be given an opportunity to make a statement. [14:43.560 --> 14:49.400] That gives the accused the opportunity to enter exculpatory evidence, because the policeman's [14:49.400 --> 14:51.900] only going to tell his side. [14:51.900 --> 14:57.720] So an examining trial, before the policeman speaks, the accused gets the opportunity to [14:57.720 --> 14:59.000] tell their side. [14:59.000 --> 15:05.000] Then the policeman tells his side, and this neutral magistrate determines whether or not [15:05.000 --> 15:10.880] there's sufficient evidence to warrant a prosecution, and if he does, he's to issue [15:10.880 --> 15:17.320] an order into 16.17 and file it with the clerk of the court. [15:17.320 --> 15:27.440] This brings up a big problem for the Court of Criminal Appeals, who authorized this garbage [15:27.440 --> 15:39.880] procedure because 16.17 says if an order is not filed with the clerk within 48 hours, [15:39.880 --> 15:47.000] the accused shall be discharged. [15:47.000 --> 15:52.320] What part of that is hard to understand? [15:52.320 --> 15:57.680] Well they never do the discharge because they never have the examining hearing. [15:57.680 --> 16:00.200] They don't ever check in to see if there's any probable cause. [16:00.200 --> 16:04.880] They never have any of those proceedings, and so they think they can just skip the part [16:04.880 --> 16:10.920] where you walk after 48 hours of no probable cause. [16:10.920 --> 16:17.200] And their problem is a 16.17 order is not in the record. [16:17.200 --> 16:24.200] And since it's not in the record, if you take that to a judge and say, here is the charging [16:24.200 --> 16:31.040] instrument, here's the date and time of arrest, here is the public record, there is no 16.17 [16:31.040 --> 16:32.040] order. [16:32.040 --> 16:35.680] Therefore, the accused must be discharged. [16:35.680 --> 16:41.920] They're not doing that, but we're going to fix that problem. [16:41.920 --> 16:48.680] It does say 48 hours from when the examining trial was held. [16:48.680 --> 16:54.160] So they think they can skirt around that issue by not even having the examining trial. [21:25.320 --> 21:30.440] Okay we are back, this is the rule of law radio, Randy Kelton, I'm Brett Fountain, when [21:30.440 --> 21:37.160] we went out to sponsor, we were talking about the 1617 order, Texas Code of Criminal Procedure [21:37.160 --> 21:47.000] chapter 16.17, which is what the magistrate is required to write up when he gives an order, [21:47.000 --> 21:52.680] he determines that probable cause exists to commence a criminal case. [21:53.720 --> 21:57.560] So that has to happen before there can be, you know, these other required documents like [21:57.560 --> 22:03.800] an indictment or an information complaint, all that stuff is after the magisterial determination [22:03.800 --> 22:09.560] of probable cause, that's the first one. So when they determine that there's probable cause, [22:09.560 --> 22:18.120] or they don't, then 48 hours after that, if there's no order in the record, then that [22:18.120 --> 22:23.560] operates as a finding of no probable cause, right Randy? [22:23.560 --> 22:28.840] And then we were talking about how the thing that they try to pull is, we never had the [22:28.840 --> 22:38.520] hearing so. Can you hear me? Okay, I'm holding, I'm having a little technical difficulty here [22:38.520 --> 22:44.680] guys and I had to check, I'm having to hold my video camera because that's the only way [22:44.680 --> 22:52.200] I can get my voice out. Okay, the problem, the big problem turned out to be, you know, [22:52.200 --> 22:56.200] all these years we're looking at this and I'm saying, what the heck is going on here? [22:56.200 --> 23:06.680] How are these guys trained to do it so horribly wrong? Give me any arrest, I will give you between [23:06.680 --> 23:16.200] 17 and 19 felony and misdemeanor allegations against all the people involved. It never [23:16.200 --> 23:25.160] made sense that this is a set of procedures that could just evolve. Now, if I would presume [23:25.160 --> 23:33.000] that all my public officials were equally bad guys, and they all wanted to do everything [23:33.000 --> 23:39.720] wrong and screw all of us, I might be able to rationalize this kind of behavior. But [23:41.560 --> 23:47.960] how does everybody get it wrong exactly the same way? [23:47.960 --> 23:58.360] Right, that's a great question. And that's been one of my nemesis is to figure that out. [23:59.400 --> 24:09.720] And recently, I don't remember seeing this in the code years ago. There was 1702 [24:09.720 --> 24:18.040] and now there's 1702, 1, 2, 2, 3, 2, 4, and a bunch of them, 2, 5, and a bunch of them. [24:18.040 --> 24:21.720] So it looks like stuff they've added, so I don't know when they added it. [24:23.960 --> 24:30.360] But they did tell, whenever they told them to, they told the Court of Criminal Appeals [24:30.360 --> 24:38.520] to develop this curricula. And that explained it. When I read that, I said, holy mackerel, [24:38.520 --> 24:46.920] that's the key. That's how everybody wound up doing it wrong precisely the same way. [24:48.440 --> 24:52.280] It looks like they just added that just a little over a year ago. [24:52.280 --> 24:55.240] It's been about 14, 15 months ago they added it. [24:56.040 --> 25:03.560] That's why I didn't see it before. Well, I wonder what was there before that. [25:03.560 --> 25:14.280] Well, I need to go back and check the legislative history. I'm sure that's been in law in some form, [25:14.280 --> 25:23.640] or the Court of Criminal Appeals has been developing the curricula anyway, [25:25.400 --> 25:33.480] not necessarily with a statutory mandate. But that's why I didn't see it. I was surprised [25:33.480 --> 25:37.480] when I saw that. I said, holy mackerel, why didn't I ever see this before? [25:39.000 --> 25:43.960] So that's why. I said, well, I'll have to go back to the legislative history and see [25:43.960 --> 25:52.680] when this was first put in. I'm hoping that it matches. I suspect it's not going to match [25:52.680 --> 26:04.440] the time this practice began. This practice began in 1975 after the Troy decision, [26:05.720 --> 26:14.520] Troy v. State, where they said you don't have a right to an examining trial in a misdemeanor. [26:14.520 --> 26:26.280] And that was technically true. You don't have a specific statutory right to an examining trial. [26:27.480 --> 26:36.760] But all of these things we talk about as constitutional rights are not the kind of [26:36.760 --> 26:41.400] rights, but that's the wrong way to speak to it, the wrong way to think about it. [26:41.400 --> 26:51.960] Because in researching the speedy trial issue, the state courts use Barker Wingo. And one is, was delay caused by the defendant? If you go to the court and ask for [27:11.640 --> 27:23.400] continuances and you exceed the time limit for a speedy trial, that's on you. You get charged with [27:23.400 --> 27:30.440] whatever delay you create, whatever delay is created by the state that's charged to them. [27:31.400 --> 27:38.760] So that's the first one. The second one is that you must demand a speedy trial, [27:38.760 --> 27:45.320] not just demand it. You must affirmatively demand it. You can't simply allude to it or [27:45.320 --> 27:51.480] imply that you should have it. You must demand it. And I read that, finally, [27:51.480 --> 28:00.120] something in my brain said, what? Are you kidding me? In order to enjoy your right to a speedy trial, [28:00.120 --> 28:03.160] you have to demand it? I said, wait a minute, wait a minute, that is not right. [28:05.160 --> 28:13.000] The Constitution did not grant us any rights. The Constitution did not speak to us at all. [28:13.000 --> 28:19.960] We are the sovereigns in a republic. We're the citizens. The Constitution does not speak [28:19.960 --> 28:28.040] to the citizens. The Constitution is a set of prohibitions and commandments to public officials. [28:29.160 --> 28:37.080] The Constitution commanded courts to provide me with a speedy trial. It makes no difference [28:37.080 --> 28:45.160] to provide me with a speedy trial. It makes no difference if I want one or not. They are [28:45.160 --> 28:52.280] commanded to give me one. And that commandment doesn't go away just because I didn't pound on [28:52.280 --> 28:58.920] them and hound them and demand that they do it. So I don't have a right to a speedy trial. [29:00.200 --> 29:03.720] The court has a duty to provide me with a speedy trial. [29:03.720 --> 29:11.720] I don't have a right to be arrested for committing crimes. The police and the courts have a duty [29:12.440 --> 29:20.760] to arrest me and prosecute me for committing crimes. The same way with the Constitution [29:20.760 --> 29:29.560] prohibitions. They're not rights. They don't speak to me. So how all of a sudden [29:29.560 --> 29:35.960] do I have to demand it before it applies? [40:25.240 --> 40:27.240] It never got shut off [40:27.240 --> 40:30.240] I went to pay the bill and I saw a final bill at the top so I called [40:30.240 --> 40:32.240] But you know I've lived in this home for 33 years [40:32.240 --> 40:35.240] It was a home that my husband wanted me to have forever [40:35.240 --> 40:39.240] And so I'm a little bit broken over the whole thing [40:39.240 --> 40:41.240] Of course [40:41.240 --> 40:49.240] So have they been following the law with regards to the foreclosure proceedings? [40:49.240 --> 40:53.240] Or have you been noticing any discrepancies there? [40:53.240 --> 40:57.240] The rule says do this and then they do the other [40:57.240 --> 41:00.240] Do that question one more time please [41:00.240 --> 41:07.240] Well I know in Texas there's rule 736, 735 and 736 [41:07.240 --> 41:11.240] Speak to how the foreclosure proceedings need to happen [41:11.240 --> 41:17.240] And so there was a lady who was scared [41:17.240 --> 41:21.240] She's about to lose her house and we looked at the rules [41:21.240 --> 41:24.240] And we noticed just kind of following down [41:24.240 --> 41:27.240] Okay here it says that this has to happen and then that has to happen [41:27.240 --> 41:31.240] Do you have one of these papers? Oh they never sent you one of those? So he had called the [01:38:21.960 --> 01:38:27.720] sheriff about it and got no response so he bar grieved him and then he didn't [01:38:27.720 --> 01:38:31.380] have any problem with this guy for a couple years then he was in a case in a [01:38:31.380 --> 01:38:36.640] hearing and this guy was the bailiff and the bailiff come up stood right behind [01:38:36.640 --> 01:38:42.600] him in the in the courtroom obviously you know two inches away trying to be [01:38:42.600 --> 01:38:47.120] intimidating. So he called the sheriff again didn't hear from the sheriff so he [01:38:47.120 --> 01:38:54.600] filed a TECO complaint again. The sheriff got in his cruiser in Decatur, Texas and [01:38:54.600 --> 01:39:04.520] drove 20, 30 mile, 25 miles to Newark, Texas a little town to his house to talk [01:39:04.520 --> 01:39:12.080] to him about this issue and he said the last time you had problems why did you [01:39:12.080 --> 01:39:18.920] file a TECO complaint instead of just calling me and he said I did call you [01:39:18.920 --> 01:39:25.000] last time but you didn't respond. The sheriff drove all the way down there to [01:39:25.000 --> 01:39:30.560] spend a half a day to talk to this guy to keep him from filing a TECO [01:39:30.560 --> 01:39:36.160] complaint because he didn't want the bonding agent to raise their bond [01:39:36.160 --> 01:39:42.080] rating. One officer get too many complaints against him they raised the [01:39:42.080 --> 01:39:47.440] bond rating for the whole department and the officers sitting there he gets a [01:39:47.440 --> 01:39:52.680] TECO complaint he knows TECO is not gonna do anything about it but next time [01:39:52.680 --> 01:39:59.120] his contract comes up for renewal if he's the one that raised the bond [01:39:59.120 --> 01:40:04.600] rating for the whole department what do you think is going to happen to him?
