[09:47.640 --> 09:53.080] They did a mortgage assignment 11 years later, and the judge throwed that out because it [09:53.080 --> 10:01.560] was fraud, and they came back again and they said they tried a summary judgment, and the [10:01.560 --> 10:08.200] judge denied the summary judgment, so they came back and tried to deny me a jury trial [10:08.200 --> 10:16.160] that hasn't been heard yet, so I sent them some questions on some inter-architectories, [10:16.160 --> 10:22.640] 40 questions, and they kept them out for 90 days, and they never responded, but they [10:22.640 --> 10:24.160] did eventually respond. [10:24.160 --> 10:30.000] They objected to all 40 questions because there was too many, so the law required to [10:30.000 --> 10:39.120] have 20, I had 40, so I did another thing to compel them to ask a question, and that's [10:39.120 --> 10:44.480] been held up now for nine months, so it's been a lot of illegal... [24:51.360 --> 25:04.360] If you have a document that is verified by a notary for every document that has a juror at a verification, [25:04.360 --> 25:16.360] send a request to the notary and request a copy of the ledger on the date of this particular verification. [25:16.360 --> 25:26.360] If they can't produce it, it gets real difficult for the court for the plaintiff, whoever's making the claim. [25:26.360 --> 25:34.360] Listen, the judge did strike that assignment. They told me it couldn't be used. That's stricken from the record. [25:34.360 --> 25:37.360] The mortgage assignment was stricken from the record. [25:37.360 --> 25:45.360] But my question is why can they keep going on and the assignment has been stricken from the record? [25:45.360 --> 25:49.360] Did you file suit against them? [25:49.360 --> 25:51.360] No. [25:51.360 --> 25:56.360] Okay. The best, you know, what we do... [25:56.360 --> 25:58.360] No, it's about to get real. [25:58.360 --> 26:04.360] Yeah, we talk about the best defense is a good aggressive offense. [26:04.360 --> 26:14.360] So if I come after you and I try to get you to pay a debt that I claim you owe. [26:14.360 --> 26:27.360] If you owe that debt, but you don't owe it to me, and you pay me because I told you you had to, you do not extinguish the debt. [26:27.360 --> 26:35.360] This is in uniform commercial code. The uniform commercial code is the law of contracts. [26:35.360 --> 26:45.360] Now, we do have a lot of Patriot mythology guys out there who take the law of contracts and apply it, try to apply it to everything else. [26:45.360 --> 26:50.360] The law of contracts, the commercial code only applies to contracts. [26:50.360 --> 26:54.360] But in this case, you're dealing with foreclosure, so it does apply. [26:54.360 --> 27:05.360] Anyone who signs a document must have demonstrable standing to sign that document. [27:05.360 --> 27:23.360] Now, the way the dirty rotten lousy tricky way to do this is you go to the local county clerk and say, look, these guys are filing trash in your records and they're corrupting your records. [27:23.360 --> 27:33.360] This guy signed this document and filed it in the record, but he doesn't have any evidence that he has power of attorney for this entity to sign that document. [27:33.360 --> 27:47.360] So since anyone who files a document in the record must have standing and there is no demonstrated standing, I'm going to ask you to petition the district court to strike this document from the record. [27:47.360 --> 28:00.360] Now, that doesn't harm anyone. If someone has filed a document in error and it gets stricken, they can refile the document. [28:00.360 --> 28:04.360] That's easy enough. Here's the problem. [28:04.360 --> 28:25.360] If they filed the document 10 years ago and you get it stricken from the record and they file it again today, everything they did in those intervening years is void. [28:25.360 --> 28:30.360] They didn't have standing. [28:30.360 --> 28:36.360] So you do this with the local courts and these guys aren't necessarily involved. [28:36.360 --> 28:39.360] You just say the court, look, here are the rules. [28:39.360 --> 28:44.360] In order to sign a document, you must demonstrate power of attorney. [28:44.360 --> 28:48.360] If someone filed this document, they did not demonstrate power of attorney. [28:48.360 --> 28:53.360] Therefore, the document, even if they have power of attorney, they didn't demonstrate it. [28:53.360 --> 29:02.360] So they didn't meet the rules of filing. We asked the court to strike this filing for not meeting the rules. [29:02.360 --> 29:13.360] And what that does, if they look at it and say, you're right, they didn't, and they strike the document and then they contact the other person saying, you really need to refile this. [29:13.360 --> 29:15.360] They refile it. [29:15.360 --> 29:23.360] It becomes active on the day they refiled it. All that time in between, it wasn't active. [29:23.360 --> 29:24.360] Right. [29:24.360 --> 29:26.360] So they're screwed. [29:26.360 --> 29:28.360] What do you think they tried to do in between? [29:28.360 --> 29:30.360] They're screwed. [36:27.360 --> 36:30.360] Bar grievance. [36:30.360 --> 36:36.360] If you file a bar agreement against these lawyers, the state bar is going to get that grievance. [36:36.360 --> 36:40.360] And they're going to throw it in the trash. [36:40.360 --> 36:43.360] And they're going to send you a letter that said be examined into your accusation. [36:43.360 --> 36:46.360] Find it does not rise to the level of misconduct. [36:46.360 --> 36:48.360] Right. Right. That's what they did. [36:48.360 --> 36:51.360] Yeah. And that's a good thing. [36:51.360 --> 36:58.360] The reason it's a good thing is their insurance carrier knows they'll throw it in the trash. [36:58.360 --> 37:04.360] So how does the insurance carrier gauge a level of risk by valid bar grievances? [37:04.360 --> 37:08.360] They throw them all in trash by the numbers. [37:08.360 --> 37:15.360] There are nine carriers of legal errors and emissions policies in the country. [37:15.360 --> 37:18.360] They are all underwritten by Lloyds of London. [37:18.360 --> 37:21.360] They all have the same criteria. [37:21.360 --> 37:24.360] One bar grievance, your first year of practice. [37:24.360 --> 37:27.360] They cancel immediately. [37:27.360 --> 37:28.360] Two bar grievances. [37:28.360 --> 37:32.360] Anyone in your practice, if you've been practicing for 20 years, they cancel. [37:32.360 --> 37:35.360] Three, they cancel your law. [37:35.360 --> 37:37.360] No practice insurance. [37:37.360 --> 37:39.360] Valid, invalid. [37:39.360 --> 37:41.360] They don't care. [37:41.360 --> 37:53.360] And you have an agent who is looking for, his job is to charge his client as much as possible and avoid any claims. [37:53.360 --> 38:01.360] So he says looking for a reason to increase the premiums of his clients. [38:01.360 --> 38:03.360] You file a bar grievance. [38:03.360 --> 38:05.360] You give him a reason. [38:05.360 --> 38:09.360] Make some crazy. [38:09.360 --> 38:13.360] You file two bar grievances against the law firm. [38:13.360 --> 38:18.360] The next communication you get will be from a different law firm. [38:18.360 --> 38:23.360] Because this firm will say, I'm out of here, Bubba. [38:23.360 --> 38:24.360] Right. [38:24.360 --> 38:25.360] They'll have to hire another one. [38:25.360 --> 38:36.360] And when they hire the second one, the second one's going to know why they lost the first one and it's going to charge them a whole lot more. [38:36.360 --> 38:47.360] At the end of the day, they are going to use every stinking, dirty, rotten, low-down trick they can to beat you. [38:47.360 --> 38:51.360] Turnabout is fair play. [38:51.360 --> 38:53.360] Bar grieve them. [38:53.360 --> 38:58.360] If the judge gives you a hard time, file a judicial conduct complaint against him. [38:58.360 --> 39:03.360] But not if he's, it sounds like your judge is working in your favor. [39:03.360 --> 39:15.360] If you bar grieve the law firm and they say anything to the judge about it, you bar grieve them for that. [39:15.360 --> 39:21.360] They are forbidden to mention it to anyone. [39:21.360 --> 39:23.360] You file a bar grievance against the lawyer. [39:23.360 --> 39:33.360] You go into court and you're standing behind your table and the lawyer on the other side is standing behind their table. [39:33.360 --> 39:39.360] And before the court starts, you walk over and kick that lawyer right square in the seat of his parents. [39:39.360 --> 39:45.360] And he's got to stand there and act like you didn't do it. [39:45.360 --> 39:47.360] Run word out of him about that bar grievance. [39:47.360 --> 39:49.360] He gets another one. [39:49.360 --> 40:03.360] That is the most powerful tool you have to make up for the influence these banks have with all their large amounts of money. [40:03.360 --> 40:10.360] Three bar grievances against the lawyer and the lawyer's insurance gets canceled. [40:10.360 --> 40:16.360] The bank doesn't have enough money to overcome that. [40:16.360 --> 40:19.360] That's one dirty trick to use against them. [40:19.360 --> 40:20.360] Okay, go ahead. [40:20.360 --> 40:21.360] I'm going to shut up now. [40:41.360 --> 40:43.360] And I wasn't his buddy. [40:43.360 --> 40:44.360] He was my friend. [40:44.360 --> 40:45.360] I just saw him. [40:45.360 --> 40:47.360] So the law firm. [40:47.360 --> 40:49.360] Okay, that's not true. [40:49.360 --> 40:57.360] If he was had a personal relationship, okay, it's not enough that he just knew you. [40:57.360 --> 41:13.360] If you look at the grounds for recusal, he has to have had a, you have to have been a relation within three degrees of co-sanguinity. [41:13.360 --> 41:18.360] But also he could be just taking it, you know, he could be avoiding the appearance of evil and all that. [41:18.360 --> 41:24.360] He could be trying to just keep it all appearing to be on the up and up. [41:24.360 --> 41:26.360] That's one of his deals too, right? [41:26.360 --> 41:30.360] No, he doesn't just get to. [41:30.360 --> 41:37.360] Just because, you know, I like this guy and I don't want to hear this, don't want to see it in this case. [41:37.360 --> 41:40.360] No, that's not good enough. [41:40.360 --> 41:49.360] Well, if his partiality or impartiality might be reasonably questioned. [41:49.360 --> 41:51.360] So that's kind of a funny line. [41:51.360 --> 41:59.360] Maybe he felt like maybe there's something going on with the school and he feels like, you know, somebody might ask questions. [41:59.360 --> 42:02.360] I know a hundred people. [42:02.360 --> 42:11.360] Can all the people that, am I not able to sit in and as a judge for anyone that I know? [42:11.360 --> 42:13.360] I'm a professional. [42:13.360 --> 42:18.360] You know, I'm a professional here and it's my job to set that aside. [42:18.360 --> 42:25.360] And just because I know this person or had a relationship with him doesn't mean that I can't rule fairly. [42:25.360 --> 42:34.360] If I'm unable to rule fairly, then I need to put the gavel down and go out and pick up dead cats and skunks off the highway. [49:13.360 --> 49:23.360] So the special referee doesn't necessarily have to be a judge, but the special referee can stand in the place of the judge. Am I correct? [49:31.360 --> 49:39.360] Yeah, because him and the bank lawyer was ex-partners. The lawyer that picked him was ex-partners. [49:39.360 --> 49:43.360] So did you bar grieve the special referee? And suing the lawyers on the other side is third. [50:48.360 --> 50:57.360] You send a tort letter to the lawyers on the other side accusing them of malpractice. They'll get apoplexy. [50:57.360 --> 51:03.360] 99% of the public has no clue. [51:03.360 --> 51:12.360] These lawyers spend their whole career screwing one client after another after another and nobody has clue. [51:12.360 --> 51:20.360] When they come across a client or a litigant who knows how to go after them. [51:20.360 --> 51:24.360] They are at a horrible disadvantage. [51:24.360 --> 51:31.360] And we tell, we'll tell people the lawyers are low hanging fruit. [51:31.360 --> 51:40.360] The lawyer is, he is the most vulnerable person in the courtroom. [51:40.360 --> 51:44.360] You can screw him big time. [51:44.360 --> 51:48.360] And he can't even complain about it. [51:48.360 --> 51:56.360] If you grieve the lawyer and he tells the judge you grieved him, you immediately ask for a mistrial. [51:56.360 --> 52:06.360] And ask for sanctions against the lawyer because he's forbidden to mention the bar grievance to anyone. [52:06.360 --> 52:10.360] This is their great weakness. [52:10.360 --> 52:20.360] But you're interesting. You've held these guys at bay for a long time. You obviously have done your homework. [52:20.360 --> 52:26.360] How have you managed to keep them at bay all this time? [52:26.360 --> 52:37.360] I did a lot of research and this guy got a lot of information from Frank from fraud stoppers. [52:37.360 --> 52:40.360] Wait a minute. Fraud stoppers? [52:40.360 --> 52:41.360] Yeah. [52:41.360 --> 52:46.360] You know that chump. [52:46.360 --> 52:49.360] Yeah, I picked on him all the time. [53:14.360 --> 53:17.360] He never told me why. [53:17.360 --> 53:24.360] And when I approached him about the special referee, he said he didn't know these two lawyers' friends. [01:05:01.360 --> 01:05:08.360] We was on obstruction of justice, and I just looked that up, and they definitely fall in that category. [01:05:08.360 --> 01:05:13.360] They fall in the category in South Carolina. [01:05:13.360 --> 01:05:18.360] Okay, what do you know about filing criminal complaints? [01:05:18.360 --> 01:05:23.360] Okay, then let me give you the short course. [01:05:23.360 --> 01:05:28.360] South Carolina is a republic. [01:05:28.360 --> 01:05:34.360] You do not live in a democracy. You live in a republic. [01:05:34.360 --> 01:05:38.360] It is a democratic republic, but it is a republic. [01:05:38.360 --> 01:05:43.360] In a democracy, all power flows from the people. [01:05:43.360 --> 01:05:50.360] If the people want your property, they can take your property by vote. If they want your life, they can take your life by vote. [01:05:50.360 --> 01:06:00.360] This is not a democracy. This is a republic, and in a republic, all rights flow from the individual. [01:06:00.360 --> 01:06:10.360] And in a republic, the most powerful person in a republic is the individual citizen. [01:06:10.360 --> 01:06:14.360] All rights flow from you. [01:06:14.360 --> 01:06:29.360] So if someone violates a criminal law, as a citizen in a republic, you have a duty to report crime to the proper authorities. [01:06:29.360 --> 01:06:36.360] And the proper authorities in the United States are magistrates. [01:06:36.360 --> 01:06:40.360] Now, every judge is a magistrate. [01:06:40.360 --> 01:06:55.360] When the judge steps up behind the bench and looks out across the bar at the gallery, he is standing on that position in his constitutional capacity as a judge. [01:06:55.360 --> 01:07:03.360] But when that judge is presented with a criminal accusation from a citizen in a republic, [01:07:03.360 --> 01:07:09.360] that invokes the judge's duty as a magistrate. [01:07:09.360 --> 01:07:17.360] And as I told the judge in Travis County, the head criminal district judge in Travis County, when I dropped criminal complaints on him, [01:07:17.360 --> 01:07:22.360] and he said, well, district judges in Travis County don't take criminal complaints. [01:07:22.360 --> 01:07:29.360] I said, well, I understand your honor, but I'm not invoking your duty as a district judge. [01:07:29.360 --> 01:07:36.360] I'm invoking your duty as a magistrate, and that's a duty for which you may not shield yourself. [01:07:36.360 --> 01:07:42.360] Magistrates are put in place to hear criminal complaints. [01:07:42.360 --> 01:07:53.360] And when a complaint is presented to a magistrate, the magistrate has specific duties in statutory law. [01:07:53.360 --> 01:07:59.360] Now, I'm not sure exactly what South Carolina law says. [01:07:59.360 --> 01:08:13.360] In New York law, when a magistrate is presented with a complaint, the magistrate shall investigate into the sufficiency of the complaint. [01:08:13.360 --> 01:08:23.360] And if the magistrate finds that the complaint is sufficient in accordance with law in that it meets all the elements of a criminal accusation, [01:08:23.360 --> 01:08:27.360] then the magistrate must issue a warrant. [01:08:27.360 --> 01:08:35.360] In Texas, it says, when a complaint is presented, is forwarded to a magistrate, [01:08:35.360 --> 01:08:40.360] complete in accordance with 15.05 Texas Code of Criminal Procedure. [01:08:40.360 --> 01:08:46.360] 15.05 specifies the requisites of a complaint. [01:08:46.360 --> 01:08:57.360] If all those requisites are there, the judge, the magistrate, shall issue a warrant for it. [01:08:57.360 --> 01:09:03.360] What does the criminal procedure code in North Carolina say? [01:09:03.360 --> 01:09:10.360] Tommy, I'm telling you this because this is a whole different way of going at them. [01:09:10.360 --> 01:09:16.360] Lawyers can't do it, but you are a citizen in a republic. [01:09:16.360 --> 01:09:21.360] All of these public officials are public servants. [01:09:21.360 --> 01:09:29.360] You, you're the master of those servants, and they forget that at their professional peril. [01:09:29.360 --> 01:09:45.360] So what does the criminal procedure code in South Carolina say that a magistrate must do when the magistrate is presented with a criminal affidavit? [01:09:45.360 --> 01:09:47.360] Okay, that was kind of a rhetorical question. [01:09:47.360 --> 01:09:56.360] I'm sure you haven't read the code to see what that actually says, but I'm going to suggest to you go to that code. [01:09:56.360 --> 01:10:01.360] Find the criminal procedure code for North Carolina and read it. [01:10:01.360 --> 01:10:06.360] Yeah, don't try to understand it. Just read it. Just read through it. [01:10:06.360 --> 01:10:13.360] And when you get through, generally you go about halfway through because then you get into really obscure stuff. [01:10:13.360 --> 01:10:24.360] The normal criminal stuff is all in the front half, and it's outlined so there's a lot of white spaces, not near big as it looks when you open the book. [01:10:24.360 --> 01:10:27.360] So read about halfway through until you get into really weird stuff. [01:10:27.360 --> 01:10:31.360] And then go back and read it again. [01:10:31.360 --> 01:10:40.360] When you read it the second time, you can read it the first time and you will never figure it out. [01:10:40.360 --> 01:10:49.360] When you read it the second time, like in Texas, you read section 2.11. [01:10:49.360 --> 01:10:56.360] When a magistrate sits with a purpose of examining into a criminal accusation, that is an examining court. [01:10:56.360 --> 01:10:59.360] That won't make sense to you the first time you read it. [01:10:59.360 --> 01:11:08.360] When you read it the second time, you'll read that and say, oh, oh, that's what chapter 16 was talking about. [01:11:08.360 --> 01:11:13.360] You'll start stitching these pieces together. [01:11:13.360 --> 01:11:20.360] I talked to my local county attorney and I quoted to him, he said, well, you have to be careful. [01:11:20.360 --> 01:11:22.360] You could be charged with illegal practice. [01:11:22.360 --> 01:11:24.360] And I said, oh, no, no, no, no, no. [01:11:24.360 --> 01:11:42.360] 38.123 says that it is a crime to represent yourself as an attorney and represent someone in court in a personal injury or something else's case. [01:11:42.360 --> 01:11:44.360] And he said, are you sure? [01:11:44.360 --> 01:11:45.360] Of course, I'm sure. [01:11:45.360 --> 01:11:54.360] He looked it up and I said, Greg, you ought to be saying to yourself, when was the last time you read the Code of Criminal Procedure? [01:11:54.360 --> 01:11:58.360] Well, Mr. Calton, I don't know that I've ever read the whole thing. [01:11:58.360 --> 01:12:00.360] That's pitiful. [01:12:00.360 --> 01:12:07.360] He said, well, Mr. Calton, I don't know a single lawyer who's read the whole thing. [01:12:07.360 --> 01:12:10.360] And he was right. [01:12:10.360 --> 01:12:13.360] They don't know the code. [01:12:13.360 --> 01:12:15.360] You think these lawyers know the code? [01:12:15.360 --> 01:12:17.360] They don't. [01:12:17.360 --> 01:12:20.360] They only do what everybody does. [01:12:20.360 --> 01:12:23.360] If you read that code, just read it through quickly. [01:12:23.360 --> 01:12:25.360] Don't try to understand everything. [01:12:25.360 --> 01:12:26.360] Just read it. [01:12:26.360 --> 01:12:31.360] What you're doing is laying down until markers. [01:12:31.360 --> 01:12:37.360] You read it through, go back, read it through a second time and you'll start stitching these pieces together. [01:12:37.360 --> 01:12:48.360] I go into court and I make these people crazy because I've read it twice. [01:12:48.360 --> 01:12:54.360] They start talking code and I stuff their code right down their throat. [01:12:54.360 --> 01:12:56.360] And all it took was reading it twice. [01:12:56.360 --> 01:12:58.360] Read it twice. [01:12:58.360 --> 01:13:08.360] And then compare what you're doing, what's going on with your case to this code, you will be amazed at what you will find. [01:13:08.360 --> 01:13:10.360] Right. [01:13:10.360 --> 01:13:15.360] There are all kinds of criminal accusations you can bring against them. [01:13:15.360 --> 01:13:30.360] You start going after these lawyers criminally and get the standards of professional conduct for lawyers. [01:13:30.360 --> 01:13:34.360] This is disciplinary rules of professional conduct. [01:13:34.360 --> 01:13:35.360] Read those. [01:13:35.360 --> 01:13:42.360] When you read the rules of professional conduct for lawyers, it'll read like a comic book. [01:13:42.360 --> 01:13:49.360] You'll read all the stuff you can hammer them for and you'll get tickled at what you're reading. [01:13:49.360 --> 01:14:01.360] If a lawyer, misery represents a fact to the judge and another lawyer hears him do it, he's supposed to file bar grievance against it. [01:14:01.360 --> 01:14:05.360] If he doesn't, you can grieve him. [01:14:05.360 --> 01:14:10.360] If he fails to speak with candor to the court, you can bar grieve him. [01:14:10.360 --> 01:14:15.360] And a bar grievance is a really, really big deal. [01:14:15.360 --> 01:14:19.360] So get the standards of professional conduct. [01:14:19.360 --> 01:14:27.360] Get the criminal procedure code for South Carolina and the penal code. [01:14:27.360 --> 01:14:30.360] Just go through the first half of them. [01:14:30.360 --> 01:14:31.360] Read them once. [01:14:31.360 --> 01:14:32.360] Go back. [01:14:32.360 --> 01:14:33.360] Read them again. Where are they weak? We got a judge acting and we proved it [01:35:18.360 --> 01:35:25.360] Absent of all jurisdiction. I filed, I did this for my brother [01:35:25.360 --> 01:35:32.360] This is after three attorneys ditched us and we'll get them a little later [01:35:32.360 --> 01:35:41.360] But what had happened is I followed a motion for change of judge and I showed all the criminal stuff this judge had been doing [01:35:41.360 --> 01:35:47.360] And we had a hearing last Monday and this is in Booneville, Missouri [01:35:47.360 --> 01:35:53.360] Judge Kaufman, this whole Fortknocker has been around forever. He's an arrogant little fort [01:35:53.360 --> 01:36:00.360] And when we was watching him, when he got off that elevator on the third floor [01:36:00.360 --> 01:36:06.360] He had his chin hung to the floor. He knew he was in big trouble [01:36:06.360 --> 01:36:14.360] And he didn't say a word. He didn't look at anybody. The phony attorney got off about ten minutes later [01:36:14.360 --> 01:36:18.360] He was shaking. They were both shaking [01:36:18.360 --> 01:36:27.360] And so what had happened here to try to, we've got to be a long time here [01:36:27.360 --> 01:36:33.360] Is that a debt collector and a company filed forgery, forged documents [01:36:33.360 --> 01:36:40.360] Which we knew were forged and I filled out a 90 page criminal complaint [01:36:40.360 --> 01:36:45.360] Gave it to the sheriff and there was obvious probable cause [01:36:45.360 --> 01:36:49.360] And they told us to go get bent. There's the shard of it [01:36:49.360 --> 01:36:57.360] And then we went to the prosecutor's attorney, their slime balls, they did the same thing [01:36:57.360 --> 01:37:04.360] And we had already had a petition filed with these three attorneys and they all three bailed out on us [01:37:04.360 --> 01:37:07.360] Okay, you are wasting your time [01:37:07.360 --> 01:37:17.360] You're going to the sheriff and you're going to the law enforcement officials [01:37:17.360 --> 01:37:20.360] They are not the ones you take criminal complaints to [01:37:20.360 --> 01:37:28.360] They take criminal complaints to magistrates, to judges [01:37:28.360 --> 01:37:35.360] You go in front of a judge and invoke his duty as a magistrate [01:37:35.360 --> 01:37:37.360] This is how I do it [01:37:37.360 --> 01:37:42.360] Say take your district judge and call your district judge's coordinator [01:37:42.360 --> 01:37:46.360] They all have a coordinator who keeps their docket [01:37:46.360 --> 01:37:54.360] And ask the coordinator when does the judge next sit for motion hearings [01:37:54.360 --> 01:38:00.360] Because they set aside a date for motion hearings and these lawyers line up [01:38:00.360 --> 01:38:05.360] And it takes them 30 seconds to hear a motion because they hear the same motions [01:38:05.360 --> 01:38:08.360] Over and over and over and it doesn't take any time at all [01:38:08.360 --> 01:38:14.360] The lawyers line up and they run through their motions very quickly [01:38:14.360 --> 01:38:18.360] So you go into the court and you call the baitiff over [01:38:18.360 --> 01:38:24.360] I did this in Travis County with the head criminal district judge for Travis County [01:38:24.360 --> 01:38:27.360] I walked into the courtroom, I'm in a nice suit [01:38:27.360 --> 01:38:32.360] I walked up to the bar and I pointed at the baitiff, you, come here [01:38:32.360 --> 01:38:35.360] And I motioned for him to come to me [01:38:35.360 --> 01:38:37.360] But he didn't like that a bit [01:38:37.360 --> 01:38:43.360] Because generally lawyers go in there and they're timid, you know, they're terrified of everything [01:38:43.360 --> 01:38:49.360] I wasn't terrified and that put the bailiff on alert [01:38:49.360 --> 01:38:51.360] So he came over and said, can I help you? [01:38:51.360 --> 01:38:52.360] I said, yes you can [01:38:52.360 --> 01:38:54.360] My name is Randall Calton [01:38:54.360 --> 01:38:57.360] I tell him my name because I don't want any questions [01:38:57.360 --> 01:38:58.360] My name is Randall Calton [01:38:58.360 --> 01:39:02.360] Instruct the judge that I have business with the court [01:39:02.360 --> 01:39:06.360] He said, may I tell the judge the nature of the business? [01:39:06.360 --> 01:39:07.360] No, you may not [01:39:07.360 --> 01:39:11.360] I have business with the court and it's none of yours, you're dismissed [01:39:11.360 --> 01:39:13.360] And I flicked my fingers at it [01:39:13.360 --> 01:39:15.360] You know, he is furious now [01:39:15.360 --> 01:39:22.360] He's used to everybody coming in and being timid and begging him for their attention [01:39:22.360 --> 01:39:25.360] And I'm ordering him around like an errand stepped child [01:39:25.360 --> 01:39:27.360] So he's furious [01:39:27.360 --> 01:39:30.360] He runs up to the judge and whispers something to the judge [01:39:30.360 --> 01:39:33.360] The judge whispers back and looks out at me [01:39:33.360 --> 01:39:38.360] And I'm sitting here with this red folder in my hand [01:39:38.360 --> 01:39:40.360] The judge can't help himself [01:39:40.360 --> 01:39:43.360] He has to know what's in it [01:39:43.360 --> 01:39:45.360] So he finishes his hearing [01:39:45.360 --> 01:39:49.360] And he said, Mr. Calton, I understand you have business with the court [01:39:49.360 --> 01:39:50.360] Yes, your honor, I do [01:39:50.360 --> 01:39:51.360] May I approach? [01:39:51.360 --> 01:39:54.360] And I hold up this folder [01:39:54.360 --> 01:39:58.360] What that means in court parlance is [01:39:58.360 --> 01:40:00.360] Can I give you this document? [01:49:31.360 --> 01:49:33.360] He goes, I don't know [01:49:33.360 --> 01:49:35.360] I don't do orders anyway [01:49:35.360 --> 01:49:38.360] And you'd have to write it [01:49:38.360 --> 01:49:41.360] And I'd take a look at it [01:49:41.360 --> 01:49:44.360] And the court clerk stands up [01:49:44.360 --> 01:49:46.360] Put their hands on her hips and says [01:49:46.360 --> 01:49:49.360] I ain't passin' it for ya [01:49:49.360 --> 01:50:02.360] So I have never seen that in 30 years [01:50:02.360 --> 01:50:04.360] All right, now you told me to move quick [01:50:04.360 --> 01:50:06.360] So let's go on [01:50:06.360 --> 01:50:09.360] So we walk out of the courtroom [01:50:09.360 --> 01:50:12.360] This is another lesson for everyone [01:50:12.360 --> 01:50:17.360] Never leave the field of battle before the other side [01:50:17.360 --> 01:50:20.360] Because what happens is [01:50:20.360 --> 01:50:25.360] This lawyer scribbled out on a pleading paper [01:50:25.360 --> 01:50:28.360] An order and that dummy judge [01:50:28.360 --> 01:50:31.360] Who is actually a [01:50:31.360 --> 01:50:32.360] What is he? [01:50:32.360 --> 01:50:33.360] A commissioner [01:50:33.360 --> 01:50:35.360] And this is limited civil [01:50:35.360 --> 01:50:38.360] And he signed an order for us to come back [01:50:38.360 --> 01:50:39.360] The following Wednesday [01:50:39.360 --> 01:50:41.360] So the case was removed [01:50:41.360 --> 01:50:43.360] Friday morning to Fed court [01:50:43.360 --> 01:50:46.360] I ran over to state court, told them [01:50:46.360 --> 01:50:48.360] Stopped it, but the judge [01:50:48.360 --> 01:50:51.360] Orders us to come back the following Wednesday [01:50:51.360 --> 01:50:53.360] We go in there on Wednesday [01:50:53.360 --> 01:50:54.360] And I told the guys [01:50:54.360 --> 01:50:55.360] Why? [01:50:55.360 --> 01:50:57.360] He wanted to file a [01:50:57.360 --> 01:51:00.360] Well, because he did it without jurisdiction, Brett [01:51:00.360 --> 01:51:03.360] And so what is happening on Wednesday [01:51:03.360 --> 01:51:06.360] Is this lawyer argues [01:51:06.360 --> 01:51:09.360] That the case had been removed once before [01:51:09.360 --> 01:51:10.360] Like a year ago [01:51:10.360 --> 01:51:13.360] And if this removal was improper, blah, blah, blah [01:51:13.360 --> 01:51:15.360] Well, you know, I'm not up there, I can't [01:51:15.360 --> 01:51:17.360] I told the guy over and over again [01:51:17.360 --> 01:51:20.360] You know, that you just tell him it's removed [01:51:20.360 --> 01:51:23.360] You don't have jurisdiction [01:51:23.360 --> 01:51:26.360] And actually I called Randy about this [01:51:26.360 --> 01:51:28.360] But the bottom line is Randy [01:51:28.360 --> 01:51:31.360] On Wednesday, the judge went ahead [01:51:31.360 --> 01:51:32.360] And gave the guy a writ [01:51:32.360 --> 01:51:35.360] To throw my friend off the property [01:51:35.360 --> 01:51:39.360] The judge in state court [01:51:39.360 --> 01:51:40.360] Commissioner [01:51:40.360 --> 01:51:43.360] After it's been removed to the Fed [01:51:43.360 --> 01:51:46.360] Did you file criminal charges against the judge [01:51:46.360 --> 01:51:48.360] For official misconduct?
