[40:34.940 --> 40:40.260] But anyway, I talked to this lawyer out in the hallway, or should I say, I listened to [40:40.260 --> 40:50.460] him, and then when he told me, well, do you authorize me to accept a dismissal, first [40:50.460 --> 40:58.580] off, I was smart enough on my feet to not agree to anything. [40:58.580 --> 41:01.860] The next day after I slept on it, I realized a couple things. [41:01.860 --> 41:06.700] One, he's trying to trick me into agreeing to his representation, which I'm not going [41:06.700 --> 41:12.380] to do, and then I thought further and figured it out that he really has a conflict of interest [41:12.380 --> 41:20.540] because I'm suing the public defender, Molly O'Neill, and she's going to pay him, and the [41:20.540 --> 41:24.060] conflict is any which way you want to look at it there. [41:24.060 --> 41:32.460] The public defender's office has already committed multiple acts of malpractice, and I fought [41:32.460 --> 41:36.320] just 2 years now to get him off my back again. [41:36.320 --> 41:42.820] They were initially on this case for the first 14 months, and I got rid of them, and then [41:42.820 --> 41:49.660] anyway, now they've turned back around, and they're trying to use that old paperwork to [41:49.660 --> 41:53.100] say that they represent me, so that's why I sued them. [41:53.100 --> 41:59.020] It's been 2 years ago that I first sued the public defender, Molly O'Neill, and deputy [41:59.020 --> 42:04.540] public defender, Howard Goldman, so it took 2 years to get him off. [42:04.540 --> 42:10.980] Now all that time, they've interfered with my case, and all this time's gone by, nothing's [42:10.980 --> 42:21.540] gone to help my defense during that time, but this new guy telling me, oh, I'm friends [42:21.540 --> 42:29.340] with the prosecutor, the deputy prosecutor, I know him, and this is a stupid case. So there are three elements that they must prove for this charge of PC [52:51.380 --> 52:58.260] 115 recording a false document. And one of them is the person's intent. Well, if you [52:58.260 --> 53:05.740] look at the face of the document, it shows that the person believes he's entitled. And [53:05.740 --> 53:09.900] what is he doing? He's just transferring it from his name, from his left hand to his right [53:09.900 --> 53:19.060] hand, from his name to his trust. And there's no crime on any level. This is really about [53:19.060 --> 53:26.980] helping this guy, Chinese guy who's at every foreclosure auction, posing as a third party [53:26.980 --> 53:40.940] buyer, when he's really a straw buyer for the bank, and he claims to have had $650,000 [53:40.940 --> 53:55.380] cash in his pocket that he paid for my house. And what this is all about is getting this [53:55.380 --> 54:07.060] foreclosure done. And the county is incentivized because my property taxes were $3,000 a year. [54:07.060 --> 54:17.300] The new property taxes on that house are close to $14,000 a year. So they're collecting an [54:17.300 --> 54:24.720] additional $11,000 a year just off of my home alone. And they've done this over and over [54:24.720 --> 54:35.940] and this goes to what they do to the elderly anyway. They steal their home through BS property [54:35.940 --> 54:44.100] taxes and things. And this is why the counties and everybody, it's all about money. Well, [54:44.100 --> 54:57.020] it always is. And then guys, it's all about money. And they thought that, look, there [54:57.020 --> 55:05.180] are criminals in these courts, hardened criminals, repeat offenders, and they get in there and [55:05.180 --> 55:11.180] they look, crying for their mamas. Okay. They're peeing down their legs and everything else. [55:11.180 --> 55:19.500] Well, that's not me. And it didn't work. I'm sure they had every intention that I would [55:19.500 --> 55:27.200] go do a year in prison for a fake crime when this all started. And remember, they put in [55:27.200 --> 55:34.900] writing that they would reduce it to a misdemeanor if I would agree to drop litigation for my [55:34.900 --> 55:41.260] home and agree to never sue this straw buyer. They put that in writing. [55:41.260 --> 55:48.220] Yeah. That's not obvious at all. Well, it's abuse of his office. The district [55:48.220 --> 55:53.860] attorney is using his office to interfere with the civil action. And the civil action [55:53.860 --> 56:00.960] had been going on for nine months. The straw buyer and I were going at it in civil court [56:00.960 --> 56:07.060] nine months before they decided, oh, wait a minute, I'll go make a complaint to the [56:07.060 --> 56:15.400] DA. Now here's the thing. This straw buyer, Jake Vang, he didn't sign or date the complaint [56:15.400 --> 56:22.820] that he made to the DA's office. So they don't have a signed statement and they don't have [56:22.820 --> 56:27.980] an arrest warrant. And remember, I've been to the fed court with this and I got a nine [56:27.980 --> 56:34.740] page opinion from Lucy Coe, fed court judge, that basically lies out. I think Randy, you [56:34.740 --> 56:43.860] read it and you said, hey, she's telling them they got problems. And she put in her opinion [56:43.860 --> 56:53.180] at the end, dismissed, and then it was typed in all caps without prejudice. It also said [56:53.180 --> 56:59.660] she wasn't going to interfere, but when the lower case resolved to come back and she cited [56:59.660 --> 57:06.820] at least three things that they were in trouble for. So you would think that they would have [57:06.820 --> 57:12.540] after that, you know, made a deal with me, compensated me, and have this whole thing [57:12.540 --> 57:19.740] go away. But this is Santa Clara County. They don't settle with nobody. Their thing is to [57:19.740 --> 57:35.500] litigate, litigate. And even when they're wrong. So it was very interesting and they're definitely [01:35:49.540 --> 01:35:54.980] going to charge her criminally. They think they've got around everything she might come [01:35:54.980 --> 01:36:02.820] up as a defense. And a lot of the people on there were seniors and clearly she's taken [01:36:02.820 --> 01:36:10.860] advantage of people in a horrible way. Then I did stay behind and chatted with him a little [01:36:10.860 --> 01:36:20.020] bit and then I sent him a thank you email for, you know, setting the meeting up. And [01:36:20.020 --> 01:36:28.700] I did tell him, I sent him three little snippets from the California Unclaimed Property website [01:36:28.700 --> 01:36:38.700] where it shows that these defense, these people have about $300 owing to them from the state. And I said to the people who've been deported. So yeah, court watching's great. Go ahead, Scott. [01:49:04.500 --> 01:49:10.500] And that's after filing how many bar grievances on those guys and how many criminal complaints. So I would stick a criminal complaint everywhere I could. I put in a whole bunch of motions over in that mesquite court [01:49:43.500 --> 01:49:48.500] and one that was the affectionately labeled, you know, Quisling. [01:49:48.500 --> 01:49:55.500] And when he had to just raffle through all that paperwork and at the very bottom, their [01:49:55.500 --> 01:50:04.500] criminal complaints, the guy went crazy. It just drives them nuts when they see those [01:50:04.500 --> 01:50:08.500] criminal complaints and they don't know what to do. [01:50:08.500 --> 01:50:16.500] Yeah, and I was talking to Pastor Massad about a woman in New Jersey who died of COVID. And [01:50:16.500 --> 01:50:24.500] her husband brought Ivermectin and the doctors refused to allow him to give it to her. And [01:50:24.500 --> 01:50:30.500] I told the pastor, you need to file criminal charges against them for depraved heart murder. [01:50:30.500 --> 01:50:40.500] Now, as much of an activist as Pastor Massad is, when I asked him to file criminal charges, [01:50:40.500 --> 01:50:49.500] he started backing up immediately. I was surprised. He's been in this fight a really long time, [01:50:49.500 --> 01:50:59.500] there is something about filing criminal charges that terrifies people. [01:52:01.500 --> 01:52:08.500] When you call the cops on the cops, you should watch them how they all of a sudden get a [01:52:08.500 --> 01:52:16.500] whole different attitude really, really fast. And I had them where they wouldn't, I was [01:52:16.500 --> 01:52:20.500] over there in Lake Dallas and they wouldn't let me in court cause I was 10 minutes late [01:52:20.500 --> 01:52:26.500] or something. And so they, and I snuck in the courtroom, somehow I got in there, they [01:52:26.500 --> 01:52:30.500] found out I was in there and so they threw me out. Well, as soon as they did, I called [01:52:30.500 --> 01:52:36.500] 911. I told them to come get me a sheriff's deputy over here and arrest that bailiff. [01:52:36.500 --> 01:52:42.500] Oh, they didn't like that. They stalled me out for about an hour, about an hour. I called [01:52:42.500 --> 01:52:48.500] them back. I said, where's my cop? I need a cop here. Oh, the end of about five minutes [01:52:48.500 --> 01:52:55.500] later, they're calling me in the building. You can see the judge now. Oh really? Okay. [01:52:55.500 --> 01:53:01.500] They were walking. It was so funny because I was sitting in there and I was sitting in [01:53:01.500 --> 01:53:06.500] the lobby after they finally let me in. And that bailiff was sitting at the door, guarding [01:53:06.500 --> 01:53:12.500] the door. A mailman comes walking in and the mailman knew the guy pretty well, I guess. [01:53:12.500 --> 01:53:17.500] And she goes, Hey, how's it going? How's your day going? He goes, it was going good. It [01:53:17.500 --> 01:53:30.500] ain't now. And I walked right on in there. Oh, ever since then, they left the court door [01:53:30.500 --> 01:53:36.500] swinging wide open. Every time I walked, every time I had to come back there, they didn't [01:53:36.500 --> 01:53:42.500] have a problem leaving the court doors open and nobody got denied access to that court [01:53:42.500 --> 01:53:48.500] building anymore. So, wonderful. Now, Pastor Madison complains that I don't get people [01:53:48.500 --> 01:53:55.500] indicted. That's not what I'm after. What I'm after is making sure they keep the court [01:53:55.500 --> 01:54:00.500] doors open. That's our win. [01:54:00.500 --> 01:54:09.060] Well, if you don't, they're just like bullies. And if you don't stand up and just punch them [01:54:09.060 --> 01:54:14.540] right square in the damn nose, they're going to keep doing it. And then if they arrest [01:55:46.820 --> 01:55:54.660] me, which is their pattern, then I get to sue Dallas County with a lawsuit like I filed [01:55:54.660 --> 01:56:03.020] in Wise County, another $400 million lawsuit. So we got that plan for next week. [01:56:03.020 --> 01:56:06.900] Yeah, so I'm taking you down there to watch the show. And a 16.17 order in Texas is an order issued by a magistrate after an examining [01:56:59.940 --> 01:57:07.420] trial, stating whether he has released a person at their liberty, found probable cause, bound [01:57:07.420 --> 01:57:12.780] them to the court, set them to bail, or remanded them to jail. [01:57:12.780 --> 01:57:20.380] The statute says if an order is not filed with the clerk within 48 hours, the accused [01:57:20.380 --> 01:57:29.500] has a right to discharge. So that's what I'm going to use when I get to this appellate [01:57:29.500 --> 01:57:38.740] court is that I had a right to discharge because there was no examining trial. The judge refused [01:57:38.740 --> 01:57:41.380] to hold an examining trial. [01:57:41.380 --> 01:57:48.460] And therefore, there was no determination of probable cause, so they had no jurisdiction. [01:57:48.460 --> 01:57:52.660] That is not something they're gonna wanna get to the higher court, so it'll be interesting [01:57:52.660 --> 01:57:58.860] to see what they do about it.
