I were having a discussion the other day about [04:19.920 --> 04:26.240] the things that he's got stated in his lawsuit and the discussion came around to the fact that [04:26.240 --> 04:34.400] the original Texas Constitution the 1836 Constitution all the way up until the 1845 [04:34.400 --> 04:42.320] all stated in the Bill of Rights that no person know this is exactly what it said [04:43.040 --> 04:50.400] no free man shall be holding to answer for any criminal charge but on presentment or indictment [04:50.400 --> 04:59.040] by a grand jury except in the land of naval forces and this or in the militia and I think [04:59.040 --> 05:04.080] that should be in the land or naval forces or in the militia when an actual service [05:04.080 --> 05:10.800] in time of war or public danger or in cases of impeachment now the thing about the but on [05:10.800 --> 05:17.840] presentment or indictment by a grand jury there is no punctuation in that that separates [05:17.840 --> 05:27.920] presentment from indictment okay it's once it's one segment that has to be read as a whole [05:27.920 --> 05:38.720] so presentments only occur to a grand jury okay they don't occur anywhere else [05:40.720 --> 05:47.840] so someone is being made to answer for a crime because they were presented to a grand jury [05:47.840 --> 05:55.280] what does that mean that means that the grand jury can actually investigate and call them in [05:55.280 --> 06:01.440] to testify before the grand jury they can call in witnesses and they can subpoena evidence [06:02.000 --> 06:11.520] to see whether or not they should indict okay the the presentment and indictment of a grand jury [06:12.480 --> 06:17.520] basically amount to wanting the same thing except one is the preliminary investigator step [06:18.240 --> 06:23.360] that that gives the grand jury the necessary information to know whether or not they should [06:23.360 --> 06:27.840] actually indict or give them good cause to believe they should indict [06:29.680 --> 06:36.560] now the thing about it is they've amended the texas constitution and by the way this [06:36.560 --> 06:44.240] is in the bill of rights this is in the bill of rights okay where this clause exists [06:46.080 --> 06:51.840] now he and i were having this discussion because of their failure to get a grand jury [06:51.840 --> 06:57.600] indictment or to make a sworn complaint that gets forwarded to a grand jury which makes every [06:57.600 --> 07:05.280] criminal prosecution in the state of texas for at least the past 30 years illegal every single one [07:06.320 --> 07:15.760] no exceptions because 99.9 of them were not done with a proper examining trial [07:15.760 --> 07:23.840] now finding probable cause to then present the case to a grand jury and there is an [07:23.840 --> 07:29.840] entire process for that in the code of criminal procedure as to exactly how it is to be done [07:29.840 --> 07:37.280] and they are not doing it but that conversation got me to think in about some other things [07:37.280 --> 07:43.920] because randy raised the question when i informed him that they had changed this to read differently [07:43.920 --> 07:51.520] in the bill of rights starting in 1845 till it culminated with this in the 1876 version [07:52.480 --> 07:59.520] it went from no free man to no person shall be held to answer for a criminal offense [07:59.520 --> 08:07.200] unless on indictment of a grand jury except in cases in which the punishment is by fine [08:07.200 --> 08:15.600] or imprisonment otherwise that in the penitentiary in cases of impeachment and in cases of rising [08:15.600 --> 08:21.360] in the army or navy or in the militia when an actual service in time of war or public danger [08:22.800 --> 08:28.080] well here's the problem that reddy's christ had raised which was basically of the essence [08:29.040 --> 08:35.600] so they've amended the bill of rights to change a right that it originally protected [08:35.600 --> 08:44.480] into something else i'm going well essentially yeah that's right but it got me to think it [08:46.160 --> 08:54.800] how did they amend the bill of rights where did they get the authority to amend the bill of rights [08:55.760 --> 09:01.440] and let me ask uh tell you why i think that's an important question to ask [09:01.440 --> 09:09.360] again going back to the 1836 constitution the declaration of rights is what it was [09:09.360 --> 09:15.360] called instead of the bill of rights and this is how the very first paragraph of the declaration [09:15.360 --> 09:22.480] of rights read this declaration of rights is declared to be a part of this constitution [09:22.480 --> 09:31.040] and shall never be violated on any pretense whatsoever that's the first sentence and the [09:31.040 --> 09:36.480] first sentence right there would throw qualified immunity by the united states supreme court under [09:36.480 --> 09:47.360] the bus forever second sentence and in order to guard against the transgression of the high powers [09:47.360 --> 09:55.360] which we have delegated we declare that everything in this bill of rights contained and every other [09:55.360 --> 10:07.360] right not hereby delegated is reserved to the people as you and me folks any right we did not [10:07.360 --> 10:17.360] by specific statement in this constitution give to our state government they do not have as a right [10:17.360 --> 10:28.240] to do period but the key to this argument that i've had running through my head is this we declare [10:28.240 --> 10:35.600] that everything in this bill of rights contained and every other right not hereby delegated is [10:35.600 --> 10:41.760] reserved to the people and this again is to guard against the transgression of the high powers which [10:41.760 --> 10:56.320] we have delegated now this is how it read let's see in the 1845 changes it went from the first [10:56.320 --> 11:05.440] paragraph down to section 21 of the bill of rights and this is how it was changed to read [11:06.800 --> 11:13.680] to guard against transgressions of the high powers here in delegated we declare that everything in [11:13.680 --> 11:21.040] this bill of rights is accepted out of the general powers of government and shall forever remain in [11:21.040 --> 11:28.640] violent and all laws contrary thereto or to the following provisions shall be void now ladies [11:28.640 --> 11:42.320] and gentlemen that is verbatim exactly how it reads from 1845 up in the 1845 and in the 1876 [11:42.320 --> 11:54.000] okay but now from the 1845 we look at how it was changed in 1861 again just till the section 21 [11:54.000 --> 11:58.560] to guard against transgressions of the high powers here in delegated we declare that everything in [11:58.560 --> 12:03.200] this bill of rights is accepted out of the general powers of government and shall forever remain [12:03.840 --> 12:07.520] in violent in all laws contrary thereto or to the following provisions shall be void [12:07.520 --> 12:18.720] does it say the same thing in the 1866 why yes it does says exactly the same thing in section [12:18.720 --> 12:31.200] 21 and then from 1866 we go into the 1869 and 1869 though it is now numbered in roman numerals [12:31.200 --> 12:43.280] instead of 1234 it says exactly the same thing all the way from 1845 to 1876 it says the exact [12:43.280 --> 12:57.280] same thing the only thing that changes is it's renumbered in the I'm sorry 1845 or 1845 1861 [12:57.280 --> 13:06.080] and 1866 it's section 21 of the bill of rights and in 1869 it is section 23 of the bill of rights [13:06.080 --> 13:12.640] and in 1876 it's section 29 of the bill of rights otherwise they read exactly the same [13:14.640 --> 13:17.040] so the question becomes this [13:17.040 --> 13:28.160] if the constitution forbids them to use the general powers of government to take away [13:28.800 --> 13:35.920] or change anything that's in the bill of rights because that's what it says we declare that [13:35.920 --> 13:42.720] everything in this bill of rights is accepted out of the general powers of government and shall [13:42.720 --> 13:48.640] forever remain in violent so let me tell you what that means to me when I read that [13:49.600 --> 13:55.920] across all these constitutions that means that the bill of rights can be amended [13:57.200 --> 14:09.040] in only one way and that is to add additional explicit protections but once that protection [14:09.040 --> 14:19.200] is enumerated within our bill of rights it is forbidden for the government to remove it through [14:19.200 --> 14:28.400] any process whatsoever you get that that's what ever being accepted out of the general powers of [14:28.400 --> 14:33.440] government and what are the general powers of government the legislative the executive and [14:33.440 --> 14:44.480] the judicial those are the general powers if you look at article 16 it tells you that we have [14:44.480 --> 14:50.240] our article two we have the separation of powers clause and article 16 is the powers of government [14:50.240 --> 14:57.280] which sends us into all the other specific articles three four and five dealing with the [14:57.280 --> 15:05.200] legislative executive and judicial okay so if we've accepted everything in the bill of rights [15:06.560 --> 15:15.360] from government how can they amend the bill of rights other than to add to its protection [15:16.240 --> 15:22.400] because once it's in there this says they cannot remove it this says they cannot use their general [15:22.400 --> 15:34.640] powers to change it and yet over time the rights that originally appeared have vanished to be replaced [15:34.640 --> 15:45.280] by others that are either lesser or less clear or more arguable on the behalf of the state [15:45.280 --> 15:51.680] now don't get me wrong i'm not arguing that the texas constitution bill of [15:51.680 --> 16:01.680] rights granted us these rights okay i am arguing that since the judiciary wants to constantly [16:01.680 --> 16:11.120] argue it's not a right the constitution doesn't say it's a right well i beg to differ because [16:11.120 --> 16:20.320] right here in 1836 that's exactly what it said every other right not hereby delegated is reserved to [16:20.320 --> 16:32.400] the people why doesn't our constitution still say that because they've changed it why doesn't our [16:32.400 --> 16:40.080] constitution still say that they cannot take our lands or even tax our lands without our explicit [16:40.080 --> 16:45.360] consent because that's in here too but it doesn't say that anymore [16:48.560 --> 16:53.120] we've got an issue with the changing of our bill of rights through legislative [16:53.120 --> 16:58.720] and process and judicial process that we need to start addressing all right i'm supposed to be right [16:58.720 --> 17:06.320] back on through advances in technology our lives have greatly fourth [20:13.520 --> 20:20.480] declaration was this every citizen shall be at liberty to speak write or publish his opinions [20:20.480 --> 20:28.800] on any subject being responsible for the abuse of that privilege no law shall ever be passed [20:28.800 --> 20:35.440] to curtail the liberty of speech or of the press there goes all the hate speech and hate crime [20:35.440 --> 20:43.600] laws or at least just those relating to speech and in all prosecutions for libels the truth [20:43.600 --> 20:52.160] may be given in evidence and the jury shall have the right to determine the law and fact [20:53.040 --> 21:00.240] under the direction of the court you see how that works people they've taken that out of the [21:00.240 --> 21:09.360] bill of rights as well but the thing about it is we took that ability to amend the constitution to [21:09.360 --> 21:16.080] take the rights that are enumerated in it and discard them entirely or replace them with [21:16.080 --> 21:25.280] something lesser or to reward them to give them fewer teeth and a lesser bite than they originally [21:25.280 --> 21:34.080] had by amending it but we didn't give them the power to amend it because we tell them in every [21:34.080 --> 21:40.240] single one of the bill of rights in every constitution that everything in the bill of [21:40.240 --> 21:47.280] rights is forever removed from the general powers of government that includes the general power [21:48.800 --> 21:55.680] to hold a constitutional amendment to the bill of rights that changes and enumerated right protected [21:55.680 --> 22:06.480] thereby once it's in there it's unchangeable irremovable cannot be taken out ever [22:09.360 --> 22:17.440] it can be added to as far as making it clear or uh enumerating other rights that the state [22:17.440 --> 22:25.600] is forbidden to interfere with in any way but it was very plain when it said every other right [22:25.600 --> 22:30.160] not hereby delegated is reserved to the people [22:36.240 --> 22:41.760] how did we lose our way to the point that we became so ignorant of what our constitution says [22:41.760 --> 22:45.200] and means within this state other than public education of course [22:47.440 --> 22:52.160] that we now allow them to completely ignore the constitution for what it says [22:52.160 --> 23:00.320] and to do things that it specifically prohibits them from doing which they do regularly and as [23:00.320 --> 23:06.640] usual it is the fault of the attorneys it's the attorneys that control every department of government [23:06.640 --> 23:11.680] it's the attorneys that control the courts it's the attorneys that control the executive it's the [23:11.680 --> 23:20.240] attorneys that control the legislature the attorneys have taken over to ensure their [23:20.240 --> 23:30.800] livelihood at our expense and the constitution was not put in place by we the people so that we [23:31.440 --> 23:37.120] didn't get to decide what it meant and we delegated that power to someone else because guess what [23:38.080 --> 23:43.920] nowhere within any of these constitutions is there a delegation given to any department of [23:43.920 --> 23:51.040] government to decide what the constitution means and the first clause here very clear [23:51.680 --> 23:57.680] every other right not hereby delegated is reserved to the people so it is we the people that have [23:57.680 --> 24:06.320] the right the only right to determine what our constitution means the problem is is we're too [24:06.320 --> 24:17.600] damned ignorant of what it even says much less what it means and this is how they've managed to get [24:18.960 --> 24:23.600] the thing ripped apart the way they have so that they can have their fingers in all the [24:23.600 --> 24:28.800] pies and have all the control while we have to sit back and take whatever they decide to serve up to [24:28.800 --> 24:40.400] us i don't like that idea haven't liked that idea for a very change folks or we're going to lose everything if you haven't looked around [26:40.480 --> 26:48.320] lately at what's going on and don't see the writing on the wall for what it is you should not [34:00.240 --> 34:08.720] with okay the last the last message email you sent me you said a proper civil or criminal [34:08.720 --> 34:16.240] complaint um can invoke the court's jurisdiction i you kind of got you lost me a little bit there [34:16.240 --> 34:22.720] when you said a civil or how does a criminal complaint who am i making the criminal complaint [34:22.720 --> 34:31.040] against to invoke the court's jurisdiction well here in texas what it invokes is the jurisdiction [34:31.040 --> 34:38.080] of a magistrate for the purpose of conducting an examining trial and that is called an examining court [34:38.080 --> 34:46.240] that is the court in texas whose jurisdiction is um brought forth simply by a sworn complaint [34:46.240 --> 34:53.200] okay now the difference here is what are we calling a complaint in a civil case it is the [34:53.200 --> 34:59.680] actual lawsuit the lawsuit that you're served with is the complaint that states the causes of [34:59.680 --> 35:06.720] action for the civil case someone has implemented against you right okay i understand that okay [35:06.720 --> 35:11.680] in a criminal case it depends on what the complaint is and what the legal requirements [35:11.680 --> 35:17.680] under the state constitution and the laws of the state are here in texas the state constitution [35:17.680 --> 35:25.280] and the code of criminal procedure both say that a complaint an actual complaint that is used to [35:25.280 --> 35:34.160] make a charge must be sworn that is something that is different than a complaint that is verified [35:34.160 --> 35:40.160] in a criminal case here's the distinction between the two a verified criminal complaint [35:40.160 --> 35:48.480] is can be sworn to by anyone authorized to administer an oath of any kind as far as a [35:49.040 --> 35:55.680] jurret on a legal document such as a notary for example okay that is a verified complaint [35:55.680 --> 36:00.800] when it contains a proper under penalty of perjury jurret and it's signed in front of [36:00.800 --> 36:08.480] somebody like a notary like an affidavit is that's a verified complaint okay the only jurisdiction [36:08.480 --> 36:14.160] of verified complaint can invoke is that of an investigating agency such as [36:16.080 --> 36:25.040] guess who law enforcement okay but it cannot invoke the jurisdiction of a court not in texas [36:25.040 --> 36:34.400] anyway why because in texas the court's jurisdiction stems from a grand jury indictment not from the [36:34.400 --> 36:42.000] complaint so when you get a sworn criminal complaint one that where they have the same [36:42.720 --> 36:46.880] jurret i hear about sworn a penalty of perjury the foregoing facts are true and correct and [36:46.880 --> 36:52.000] the best of my knowledge and ability uh and my uh my personal knowledge and ability okay because [36:52.000 --> 36:56.240] it a sworn statement can only be stopped by somebody with competent first-hand knowledge okay [36:56.240 --> 37:05.040] okay the jurisdiction that invokes is the examining court who can then find probable [37:05.040 --> 37:12.640] cause based upon what comes out of the examining court to either no bill which is basically [37:12.640 --> 37:20.240] a a predecessor a predecessor of the grand jury indictment he can either find probable [37:20.240 --> 37:26.960] cause and issue an order stating so or he does not find probable cause and states an order issuing [37:26.960 --> 37:33.200] that he is then required to do the same thing in either case seal up those records and send them [37:33.200 --> 37:40.960] to the clerk of the district court under which the grand jury exists okay now if the examining [37:40.960 --> 37:48.640] court did not find probable cause it doesn't go any uh it can i'm sorry all of that goes to [37:48.640 --> 37:52.400] the grand jury and the grand jury is told up front there was no probable cause for this so [37:52.400 --> 37:57.760] they don't indict they no bill but if the judge found probable cause and the grand jury agrees [37:57.760 --> 38:04.400] with it they can then true bill but it all requires that a sworn complaint invoked the [38:04.400 --> 38:09.920] jurisdiction of that court now in arizona where you're at i don't know what the state [38:09.920 --> 38:17.120] constitution requires and what the law actually requires as is consistent there with here in [38:17.120 --> 38:24.080] texas the laws are consistent with the constitution but the actions that the courts and the prosecutors [38:24.080 --> 38:33.360] and the defense attorneys are doing do not comply with either one you follow okay yes yes you know [38:33.360 --> 38:38.960] i can i can compare that to to my state exactly so that's what you've got to find out what i'm [38:38.960 --> 38:44.800] talking about is how it works in texas according to the actual constitution and law not how they're [38:44.800 --> 38:50.480] doing it because how they're doing it does not comply with the constitution or the law [38:52.480 --> 38:58.400] so when i say it invokes the jurisdiction of a court here in texas it's the the examining court [38:58.400 --> 39:07.360] not a trial court okay okay that's that's what i wanted to clarify now i'm just curious years [39:07.360 --> 39:15.600] ago before i found you on the rule about radio i saw a video where you're talking about removing [39:15.600 --> 39:23.280] your mother's property from the tax roll yeah because i caught the tax assessor uh falsifying [39:23.280 --> 39:32.240] his documentation and i confronted him on it oh really and and what was the procedure you used [39:32.240 --> 39:37.600] to to have it removed from the tax roll i went down there with the law slammed it on his desk and [39:37.600 --> 39:42.480] told him just how much of his house i was going to own when i was through suing him for falsifying [39:42.480 --> 39:53.840] a government document and defrauding my mother okay because uh at the time texas law specifically [39:53.840 --> 40:00.240] stated that every tax assessment had to be signed by the officer making it but before the officer [40:00.240 --> 40:06.960] could make it they had to do an on-site inspection of every building on the property which we know [40:06.960 --> 40:15.600] they cannot do to someone's private home yes yes okay so right there that tells you that they the [40:15.600 --> 40:22.000] tax they were attempting to levy didn't apply to private property because the law would have had [40:22.000 --> 40:26.320] to been declared unconstitutional as a violation of due process had a tax assessor but they were [40:26.320 --> 40:34.240] just to walk in your house without a warrant in order to make out his tax bill okay but what he [40:34.240 --> 40:42.480] was doing was he he was just fabricating numbers out of thin air based upon property value statements [40:42.480 --> 40:48.880] that were formulated by the texas comptroller's office he wasn't looking at any of the property [40:48.880 --> 40:55.760] he was assessing taxes on he was simply going by the guesstimates that the state comptroller [40:55.760 --> 41:03.200] said about the current land values in certain parts of the state the tax bill he sent my mom [41:03.200 --> 41:11.120] was not signed it had no name on it other than hers and it was some exorbitant number that was [41:11.120 --> 41:15.680] nowhere near even the real value of the property if you sold it on the open market [41:15.680 --> 41:25.920] and so I went by of specifically called on her says can I please get a certified copy of this [41:25.920 --> 41:32.240] and I asked for the tax assessment and for the office and all the paperwork associated with [41:32.240 --> 41:37.840] the tax assessment assessment designating who was responsible for making the assessment and the [41:37.840 --> 41:45.040] processes they used to do that I did all that with discovery and information requests and I got [41:45.040 --> 41:50.000] all that and it proved I was a hundred percent correct that they were defrauding my mother so [41:50.000 --> 41:56.800] I bundled it all up I went down there and I slammed it and and the copies of the law book [41:56.800 --> 42:02.000] stating what the property tax code said at the time and he and I had a long discussion [42:03.200 --> 42:08.560] and next thing I know my mom got in a bill or not a bill she got a letter from the tax [42:08.560 --> 42:13.760] associate's office saying that they had removed her from the tax rolls and that the tax bill was [42:13.760 --> 42:24.400] assessed an error and it had been removed wow okay interesting okay my daughter wants me to ask [42:24.400 --> 42:31.120] your question okay do you personally know anybody that's ever won a land patent case I don't know [42:31.120 --> 42:36.960] anyone that's ever done a land patent case correctly to my knowledge there is not a single person [42:36.960 --> 42:41.600] that has ever gone in and argued the breach of contract that is the land patent issue [42:41.600 --> 42:51.760] no one's done it really okay so we're at the okay the impairment of a contract is the you think is [42:51.760 --> 43:01.520] the key to this well what is a land patent it's an agreement it's an agreement between the person [43:01.520 --> 43:09.600] issuing the patent and the one receiving the benefit of the patent the landowner right yes [43:09.600 --> 43:16.960] yes when the language of the patent says that the original holder through this patent relinquishes [43:16.960 --> 43:27.040] all rights and claims to the property enumer are identified here in forever there's not a lot [43:27.040 --> 43:34.320] of ambiguity about this contract being forever binding and that the state being the issuer no [43:34.320 --> 43:39.600] longer has any authority or rights over that land of any kind because the courts have ruled [43:39.600 --> 43:45.760] numerous times that in order to do so the land patent would have specifically stated the reservation [43:45.760 --> 43:52.960] of rights the state was making for itself and there are none yes let me take this break and [43:52.960 --> 43:58.400] I'll 47:06.320] or whoever the original patent issuer was okay or in yall's case since yall's land patents were [47:06.320 --> 47:13.600] issued under federal authority rather than state authority the state is in tortuous interference [47:14.240 --> 47:24.000] with the contract between you and the federal government see how that works yes so there are two [47:24.000 --> 47:28.240] breach are there's two contract issues here breach and tortuous interference [47:31.920 --> 47:38.880] okay okay my second question is you've also been helping me um on an ordnance situation [47:38.880 --> 47:44.080] there's a young lady here in the valley i've been helping for the last few months a couple weeks ago [47:45.280 --> 47:53.680] she had a two and a half hour trial over her weed burning okay for starters the judge would not [47:53.680 --> 48:00.320] let anyone but the defendant in the courtroom that's illegal orders were allowed there's a state [48:00.320 --> 48:06.880] constitution require that all court proceedings be public yes it does then you need to file judicial [48:06.880 --> 48:11.760] conduct complaints against this judge and demand his removal from the bench and that every decision he [48:11.760 --> 48:20.880] makes doing it that way be overturned and reviewed and overturned okay okay because that is a blatant [48:20.880 --> 48:26.000] constitutional violation depriving the accused of a public trial and that's a rights violation [48:27.920 --> 48:34.880] okay and then okay so obviously she lost the case and so it's up for appeal um [48:35.840 --> 48:41.520] that needs to be well the thing is is here's what you need to make sure of first off here in [48:41.520 --> 48:46.880] texas the procedure is not to go from trial to appeal believe it or not the first thing you [48:46.880 --> 48:55.120] have to do after trial is file a motion demanding a new trial that's that's mandatory if you don't [48:55.120 --> 49:00.480] file that motion for new trial you did not exhaust your remedy to reach appeal and they'll throw your [49:00.480 --> 49:07.520] appeal right out the window make sure you don't have that stumbling block in your state here's [49:07.520 --> 49:14.160] the second thing if you do have it that's your that's your demand for a reason for a new trial [49:14.160 --> 49:20.240] the judge denied you due process in the first one and violated both the state constitution and the [49:20.240 --> 49:27.200] rule and the rules of judicial conduct by doing it okay and if you don't have to file a motion [49:27.200 --> 49:33.040] for a new trial then that's your the issue you raise on appeal lack of jurisdiction for the due [49:33.040 --> 49:37.840] process violations the court had no jurisdiction to move to trial when they were violating the [49:37.840 --> 49:49.680] rights of the accused in a manner in which they conducted that trial okay well i you know eddie [49:49.680 --> 49:55.840] i gotta tell you i'm so glad you're doing what you're doing and helping everybody but i could [49:55.840 --> 50:00.880] do the best i can it's this stuff actually makes sense once you learn how they're supposed to do it [50:01.520 --> 50:07.440] it actually makes sense not all of it but a lot of it and there's a reason why these [50:07.440 --> 50:13.440] processes and procedures are in place the problem is is when the ones responsible for the state government city governments try to put a moratorium on rent [51:03.440 --> 51:09.840] they can't private contract right does the state constitution does the constitution of [51:09.840 --> 51:13.920] the state of california forbid the government from interfering with the with a contract [51:15.600 --> 51:23.280] yes yeah it does doesn't it what is a lease agreement between a tenant and a landlord [51:23.280 --> 51:33.680] contract bingo so how can the state government do something is specifically prohibited from doing [51:34.240 --> 51:38.000] but tortuously interfering with the completion in terms of that contract [51:40.640 --> 51:48.800] they can't so this is i want to ask you your take on this so going forward if you own if you had a [51:48.800 --> 51:54.320] piece of property you're renting or renting out a room can you somehow put in that contract that [51:54.320 --> 52:01.200] either the the renter waived their right to statutory or moratoriums anything that might [52:01.200 --> 52:07.280] protect them renter wise if you do your own private agreement you you can put anything in [52:07.280 --> 52:15.120] any type of contract you want as long as it doesn't do two things well three x violate state law [52:15.120 --> 52:20.960] law or any actual applicable federal law which should there shouldn't be any but that depends [52:20.960 --> 52:28.000] on whether or not you're leasing someplace to to like print counterfeit money you know what i'm [52:28.000 --> 52:35.360] saying right so as long as the terms of the contract do not violate state law and do not [52:35.360 --> 52:43.200] violate federal law where applicable or is an unconscionable contract because it violates the [52:43.200 --> 52:48.480] rights of one of the parties then it can contain anything y'all agreed to [52:50.800 --> 52:54.320] that rights of the parties that's called an unconscionable contract [52:56.560 --> 53:02.400] okay the contract cannot be unconscionable and 53:52.080] other people in texas get off the tax rolls there or in any other state [53:53.520 --> 53:59.680] i've helped them fight what they were being charged but nobody with the the extension of [53:59.680 --> 54:06.160] a couple of people have taken up the battle of fighting the actual tax as a whole because [54:06.160 --> 54:12.480] everybody's afraid of losing their house or whatever land they're fighting over [54:13.840 --> 54:16.720] so the answer to your question straight up is no [54:18.800 --> 54:23.440] because it's not my property i don't get to make the decision and they're afraid if they lose they [54:23.440 --> 54:32.000] lose it have we got them to get the assessments knocked down yeah but all they're doing there is [54:32.000 --> 54:36.560] delaying the loss through time they're still paying out the nose for it they're still going [54:36.560 --> 54:39.920] to basically get to a point where they can't pay it and it's still going to eventually be gone [54:40.960 --> 54:44.880] to me it's always been better to risk losing it by saying you have no right to it in the first [54:44.880 --> 54:51.680] place and fighting it correctly and fully but that's my choice versus everyone else's [54:51.680 --> 55:03.520] where would the where would you recommend the first i don't know the process of going about [55:03.520 --> 55:10.560] the research for this in california well the first thing is is find out how all land in california [55:10.560 --> 55:17.600] was originally issued to the landholder what was the agreement who who was in control of the land [55:17.600 --> 55:22.640] at the time it was issued and what was the agreement if it was a federal territory and the land was [55:23.280 --> 55:29.200] issued out it would have been issued out by the federal patent and that would mean that the [55:29.200 --> 55:34.480] contract is between the federal government and the landholder prior to there even being the [55:34.480 --> 55:42.000] formation of a state so unless there's a specific reservation in the patent that allows the state [55:42.000 --> 55:47.120] to assume responsibility and authority over the land ceded by the federal government after the fact [55:47.120 --> 55:52.800] and that was signed off on by the landholder the state can't tortuously interfere with the agreement [55:52.800 --> 56:00.880] as it originally stood same thing i just told larry about the one in arizona because that's [56:00.880 --> 56:07.200] how there's this issue if it was issued by the state and the verbiage of the patent and it's [56:07.200 --> 56:12.640] issued by patent and the state says basically the same thing it does here in texas as far as the [56:12.640 --> 56:18.640] patent going we relinquish all rights and claims to the property forever then the state can without [56:18.640 --> 56:24.080] any reservation of rights or claims made in that patent whatever's not there the state doesn't have [56:27.040 --> 56:32.080] so that's what you do you find out how all the original land holdings in california once it [56:32.080 --> 56:37.200] became a state or before it became a state were issued to the original landholders [56:37.200 --> 56:51.760] and then you go forward from there do you have a certified copy of the texas land patent i don't [56:51.760 --> 56:57.920] have a certified copy because i don't have land to get a patent on now i've got copies of other [56:57.920 --> 57:02.880] people's land patents or at least the part where the verbiage exists that i'm talking about but [57:02.880 --> 57:10.560] they have the actual full patent and i've know lots of people here in texas that have that [57:10.560 --> 57:16.400] but once they have it they still have to be willing to go to court and fight with it and most of them [57:16.400 --> 57:23.840] so far have not the only person i know for certain that's doing everything possible to fight it [57:24.480 --> 57:30.240] here in texas is a lady by the name of jennifer ruby and that's all she is about is fighting land [57:30.240 --> 57:36.640] patents but up until she and i had the discussion about taking it on as a contract she had not [57:36.640 --> 57:42.240] been considering taking it on in that way is the understanding i've had from the conversations we've [57:42.240 --> 57:48.480] had now jennifer if i'm wrong about that i'm sorry i don't mean to be uh but i definitely [57:48.480 --> 57:52.880] brought it up to her that she should be fighting this as a as a tortuous interference in a breach [57:52.880 --> 58:00.880] issue the state is and and taxes and things like that they they teach them [01:34:39.520 --> 01:34:47.520] obviously and um he's been a broker for what 40 years some 30 years something like that anyway [01:34:47.520 --> 01:35:00.000] he had some properties that the local assessor obviously over taxed him and so he went to [01:35:01.360 --> 01:35:09.760] the tax court whatever you want to call it the kangaroo tax court and he presented the my [01:35:09.760 --> 01:35:18.800] relative represented the case and showed the similar properties that were taxed at a lesser rate [01:35:18.800 --> 01:35:25.920] that were similar to his and he had you know real proof in every case in every property he [01:35:25.920 --> 01:35:34.320] presented he showed that the property was indeed over charging uh or the property tax was over [01:35:34.320 --> 01:35:43.440] charging him well he made a lot of the same comments that i heard that i heard on the show [01:35:43.440 --> 01:35:51.440] tonight where he was just pulling figures out of the air and he was overcharging him and it was [01:35:51.440 --> 01:36:00.000] baseless so in a case like that what would you do uh i want to see this assessor go to jail [01:36:00.000 --> 01:36:07.680] for fraud because that's obviously what it was or some other similar situation so i'll sit back [01:36:07.680 --> 01:36:12.640] now and let you tell me how to deal with the assessor well you're not going to get him for [01:36:12.640 --> 01:36:18.720] fraud unless you paid it and then found out after the fact that it was wrong now attempted fraud [01:36:18.720 --> 01:36:25.520] maybe take it again i said you're not going to give him charged with fraud unless somebody [01:36:25.520 --> 01:36:32.880] actually paid him and then found out after the fact that the assessment was invalid attempted fraud [01:36:32.880 --> 01:36:39.840] if there is such a charge in your state might be a different story however there should be [01:36:39.840 --> 01:36:46.480] laws against falsifying government documents falsifying uh information distributed to the [01:36:46.480 --> 01:36:52.800] public or something along those lines that he very well could be charged with okay tampering [01:36:52.800 --> 01:37:00.000] tampering with a government record something to that effect okay uh you know like here in texas he [01:37:00.000 --> 01:37:05.120] would have been charged not only with tampering with a government record and uh falsification of [01:37:05.120 --> 01:37:09.520] a government record but he would uh which are basically the same thing but he also would have [01:37:09.520 --> 01:37:13.920] been able to be charged with abuse of official capacity and official oppression both of which [01:37:13.920 --> 01:37:23.920] are felonies is there a statute a limitation on that well yeah it'll be whatever the level of [01:37:23.920 --> 01:37:29.520] the offense is and according to what statute limitations within your state are most misdemeanors [01:37:29.520 --> 01:37:35.920] and most states are two years from the date of the occurrence of the misdemeanor uh and then on [01:37:35.920 --> 01:37:42.560] felonies it's anywhere from three to five years except for those that resulted in uh death or [01:37:42.560 --> 01:37:48.800] serious bodily injury which may not have a statute of limitations and then you have fraud which has [01:37:48.800 --> 01:37:55.920] no statute of limitations until the fraud has been discovered then it's depending upon what level of [01:37:55.920 --> 01:38:03.920] fraud two to five years okay that sounds very good thank you you nailed it down um [01:38:03.920 --> 01:38:14.800] um then what can he do to get that corrected if the assessor is he's got either a vendetta [01:38:14.800 --> 01:38:21.280] against him or he can sue the assessor and if he can prove that the assessment was illegal [01:38:21.840 --> 01:38:28.800] then he can both sue and press charges for it at the same time he just has to figure out what [01:38:28.800 --> 01:38:37.280] the proper charge is but he can sue the assessor for a tent for uh if there's a cause of action in [01:38:37.280 --> 01:38:47.040] New York for attempted fraud um okay but if he submitted it into a public record um then there's [01:38:47.040 --> 01:38:53.680] a couple other possibilities for instance if the man suffers because they put down that he [01:38:53.680 --> 01:38:59.440] failed to pay the assessment then it's the same thing as giving a bad a bad credit record falsely [01:39:00.160 --> 01:39:04.880] if you give him a bad credit report if you tamper with their credit report they can sue you for that [01:39:06.160 --> 01:39:12.640] well if his fraud caused him harm in his credit report and his other business dealings then he [01:39:12.640 --> 01:39:20.160] can sue them for that harm okay then it becomes slander and libel and defamation of character [01:39:20.160 --> 01:39:30.960] and things of that nature on top were very quick to stomp out any argument that said it's not in the register [01:49:42.240 --> 01:49:54.720] therefore it's not law what terms would you search google scholar with to find that well you could [01:49:54.720 --> 01:50:07.200] probably do federal register income tax yeah all right well that that might be uh something to [01:50:07.200 --> 01:50:13.760] check but it's pretty specific in there i mean uh fdr made this thing back in 19 what well there's [01:50:13.760 --> 01:50:19.040] lots of federal law that's pretty specific doesn't mean they follow it for instance there's also a [01:50:19.040 --> 01:50:26.560] federal law that says if the form that an agency is requiring you to be filled out is not officially [01:50:26.560 --> 01:50:32.640] registered with and approved by the office of management but uh office of management and budget [01:50:32.640 --> 01:50:39.920] and the printing office then the form cannot be used well guess what 99 percent of the tax forms [01:50:39.920 --> 01:50:52.640] don't comply with especially form 1040 right i thought it had an omb number of it pretty sure [01:50:52.640 --> 01:51:03.040] does no the omb number it's got is not in the uh law for the uh for the omb it's not the approved form [01:51:03.040 --> 01:51:16.640] or the form number very interesting but they don't care exactly so do you see any reasonable [01:51:16.640 --> 01:51:22.320] way to hold the judge's feet to the fire and it's just like that well i don't know what it is you're [01:51:22.320 --> 01:51:27.760] trying to argue and why you want to use it so i don't know an ant how to answer that question [01:51:28.800 --> 01:51:34.080] well like for instance yes i'm taxi you're well i just told you the court they're going to go by [01:51:34.080 --> 01:51:40.400] the precedent that already says we don't care uh how are you going to hold a judge's feet to the [01:51:40.400 --> 01:51:48.160] fire when the people he has to answer to have already said we don't care okay this is true this [01:51:48.160 --> 01:51:54.800] is true yeah i've heard that from a couple of people if you if you would try something like [01:51:54.800 --> 01:52:00.960] that it would uh the courts would just basically ignore it yeah if it goes against something they've [01:52:00.960 --> 01:52:06.240] already decided that they don't care then yeah that's exactly what they're going to do other than try [01:52:06.240 --> 01:52:12.480] to punish you extra for bringing it up again and making a reassert it they'll call it frivolous [01:52:13.120 --> 01:52:14.480] and then they'll come after you for it [01:52:17.760 --> 01:52:22.160] I wonder if there's anything like what the federal register is supposed to be [01:52:23.040 --> 01:52:28.960] to the federal government for like a state like texas well there doesn't have to be a register [01:52:28.960 --> 01:52:35.520] in texas they have to they have to enact a law according to how the state constitution says [01:52:35.520 --> 01:52:42.640] the process and procedure is right now i can show that every law in texas is unconstitutional [01:52:42.640 --> 01:52:50.320] every single one including the texas penal code all of our criminal law why because it's the way [01:52:50.320 --> 01:52:57.520] they codified it the way they enacted the codes that those laws were put into does not comply with [01:52:57.520 --> 01:53:03.840] the texas constitution not a single one of them well now the thing that they have that you can [01:53:03.840 --> 01:53:09.120] deal with is the administrative procedures act have you ever heard of that one yes i have and [01:53:09.120 --> 01:53:14.960] no you can't there's a difference between going through administrative procedures as laid out
