Margaret Moore, the Travis County District Attorney, [01:27.160 --> 01:31.800] announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana [01:31.800 --> 01:36.600] cases because of the law. Mr. Abbott and other state officials, including the Attorney General, [01:36.600 --> 01:40.760] stipulated in a letter to county district attorneys back on Thursday that marijuana [01:40.760 --> 01:45.640] has not been decriminalized in Texas and that these actions demonstrate a misunderstanding [01:45.640 --> 01:52.360] of how HB 1325 works, as well as other cities too, like the district attorney in El Paso, [01:52.360 --> 01:57.240] Caima Esparza, a Democrat who also stated earlier this month that the law, quote, [01:57.240 --> 02:02.680] will not have an effect on the prosecution of marijuana cases in El Paso. However, the issue [02:02.680 --> 02:07.480] was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County, [02:07.480 --> 02:11.880] who stated that, quote, the law is constantly changing on what makes something illegal based [02:11.880 --> 02:15.880] on its chemical makeup. It's important that if someone is charged with something, [02:15.880 --> 02:24.920] the test matches what they're charged with. A paper by Tulane University identified a five [02:24.920 --> 02:29.880] and a half inch American pocket shark. As the first of its kind in the Gulf of Mexico, [02:29.880 --> 02:35.400] the specimen being only the second pocket shark ever captured or recorded with the other one [02:35.400 --> 02:40.680] being found way back in 1979 in the East Pacific Ocean. According to the university paper, the [02:40.680 --> 02:47.400] shark secretes a lumus fluid from a gland near its front fins for the purposes hypothesized [02:47.400 --> 03:11.400] to lure and prey may be drawn into the glow. This is Rule of Law Radio with your host Eddie Craig. [03:31.080 --> 03:39.640] It is August 9, 2021. Yes, we are live tonight. We would have been live last week except we had [03:39.640 --> 03:45.720] a little network issue and I was not able to get on the air. But that said, tonight we've got [03:45.720 --> 03:50.520] something we're going to go into kind of hot and heavy here dealing with once again the transportation [03:50.520 --> 03:55.720] code. But the thing you all need to remember about me going to the transportation code is that [03:55.720 --> 04:01.000] there is a lot of this stuff that has far more reaching effects than just the transportation [04:01.000 --> 04:06.440] code. One of the things we're talking about tonight, the definition of person as it pertains [04:06.440 --> 04:16.600] to the penal code and the transportation code specifically, is that the fact is a person [04:16.600 --> 04:25.880] is used throughout Texas law. It is imperative that you look up the specific statute and the [04:25.880 --> 04:32.760] section of definitions governing that specific statute in order to know exactly what it means [04:32.760 --> 04:38.040] if you're getting hauled in the court over something within that code. Now, tonight I'm [04:38.040 --> 04:46.600] going to show you exactly why that is mandatory. You cannot do what you need to do without doing [04:46.600 --> 04:52.280] that. If you fail to do that, then you are you're letting yourself get hurt for no good reason. [04:54.360 --> 05:02.280] Now, we know that in the Texas Transportation Code that subtitle C contains the definition [05:02.280 --> 05:11.400] of person in chapter 541, which we will get to here shortly. But in that definition of person, [05:11.400 --> 05:22.200] it has pretty much a similar definition to that that is found in 1.07 sub-item 38 of the Texas [05:22.200 --> 05:38.360] Penal Code defines person in this way, means an individual or a corporation, association, [05:38.360 --> 05:43.880] limited liability company, or other entity or organization governed by the business organization's [05:43.880 --> 05:52.680] code. Now, the question there is what does business organization's code govern in that definition? [05:53.400 --> 05:57.160] But that's something we don't really have to get into for the purpose of the night. So [05:57.720 --> 06:01.400] just let them all that over in the back of your mind and see what you come up with. [06:01.400 --> 06:09.880] But in the meantime, let's see what person means to us here. Now, the courts tell us that they can [06:09.880 --> 06:17.880] use penal code definitions across any other code where that same term is used. However, [06:18.600 --> 06:26.520] there's a limit to their ability to do that. The court cannot use a penal code definition [06:26.520 --> 06:32.120] within a statute where that statute contains the definition of its own for the same term. [06:32.120 --> 06:40.920] Okay? So wherever a definition for the term in question exists within the statutes, [06:42.360 --> 06:51.160] the one from the penal code cannot be used if the one defined by the code itself applies. [06:52.600 --> 07:01.160] Now, where a code has an application via a general definition found in a different code, [07:01.160 --> 07:07.560] that definition will be the one that is controlling. And we have three points of authority [07:07.560 --> 07:14.360] in reference to the transportation code to prove that point. Okay? The first one is the Texas [07:14.360 --> 07:22.680] Transportation Code itself, where it tells us right in the very first chapter in section 1.002 [07:22.680 --> 07:31.080] construction of code, chapter 311 government code, the Code Construction Act applies to the construction [07:31.080 --> 07:39.880] of each provision in this code, except as otherwise expressly provided by this code. Okay? This code [07:39.880 --> 07:47.400] being the transportation code. All right? So right here, this tells us that chapter 311 [07:47.400 --> 07:55.880] has control over this code. Then we go to chapter 311 of the government code itself, [07:56.760 --> 08:06.040] where it says this chapter applies to in 311.002 each code enacted by the 60th or a subsequent [08:06.040 --> 08:12.120] legislature as part of the state's continuing statutory revision program, which definitely [08:12.120 --> 08:20.280] applies to the Texas Transportation Code because it was recodified in 1995 by a legislator that is [08:20.280 --> 08:29.480] after the 60th legislature. Two, each amendment repeal revision and reenactment of a code or [08:29.480 --> 08:35.640] code provision by the 60th or a subsequent legislature. It also applies to each repeal [08:35.640 --> 08:43.960] of a statute by a code and each rule adopted under a code. Okay? So that's where chapter 311 [08:43.960 --> 08:54.680] tells us it applies. Now, where chapter 311 contains a definition of person, it reads [08:54.680 --> 09:04.840] like this in 311.005. Person includes corporation, organization, government, or governmental [09:04.840 --> 09:13.560] subdivision or agency, business trust, estate trust, partnership, association, and any other [09:13.560 --> 09:22.360] legal entity. Okay? Right there, these are all legal entities, every single one of them. Okay? [09:22.360 --> 09:29.320] Governmental or governmental subdivision or agency, business trust, estate trust, partnership, [09:29.320 --> 09:39.480] association, and any other legal entity. Okay? But remember, again, we have a modifier here, [09:39.480 --> 09:50.440] government or governmental subdivision or agency, business trust, estate, trust, partnership, [09:50.440 --> 09:59.000] association, and any other legal entity. Okay? So nowhere in there with the definition of [09:59.000 --> 10:04.280] individual as it's found in the penal code even come into play, nor with the definition [10:04.280 --> 10:10.840] of person since person under the penal code includes individual. Okay? This definition [10:10.840 --> 10:17.720] under chapter 311.005 of the government code in sub-item two is the controlling definition [10:17.720 --> 10:26.040] over the Texas Transportation Code. So far 1.002 of the Texas Transportation Code tells us that [10:26.040 --> 10:33.720] 311.005 of the Texas Government Code tells us that, and then we have the Texas Legislative [10:33.720 --> 10:40.040] Drafting Manual. If the court is required to determine legislative intent, then the information [10:40.040 --> 10:48.280] in this manual regarding this discussion is imperative. It says right here under the definition [10:48.280 --> 10:55.240] in subsection H of the drafting code where our legislative drafting manual where it gives us [10:55.240 --> 11:03.800] the definition of person, the very last sentence says the definition of person in section 311.005 [11:03.800 --> 11:09.880] government code applies to those codes to which the Code Construction Act applies, [11:09.880 --> 11:20.520] and that do not otherwise define the term. Okay? So we now have three authoritative sources saying [11:20.520 --> 11:28.120] that the Texas Penal Code definition of person absolutely does not apply to the Texas Transportation [11:28.120 --> 11:34.680] Code. Okay? Now we can go to the Texas Transportation Code and find something out here real quick. [11:35.720 --> 11:41.400] Under the Texas Transportation Code we have a general definition section under chapter 541, [11:41.400 --> 11:52.120] and under chapter 541.001 subsection 4 person is defined this way. Person means an individual [11:52.120 --> 11:58.280] firm partnership association or corporation. So right there the appearance that the definition [11:58.280 --> 12:04.200] from the Penal Code is now applicable within the Transportation Code appears to have been made, [12:04.200 --> 12:12.840] right? Except there's a problem. Right here it tells us in the definition for persons under [12:12.840 --> 12:27.240] 541.001 that the definitions that follow only apply to this subtitle. In this case it is subtitle C [12:27.240 --> 12:35.160] of the Texas Transportation Code which is only rules of the road, and that governs chapters 541 [12:36.120 --> 12:42.680] through 600. None of the other chapters of the Transportation Code are inclusive [12:43.720 --> 12:51.480] for these definitions. These definitions apply only in this subtitle. That's their scope. [12:51.480 --> 12:59.800] Section 541.001 tells us that's their scope. They cannot go beyond that. [13:01.240 --> 13:08.200] So the definition of person here is limited to the use of the term person anywhere within chapters [13:08.200 --> 13:19.720] 541 through 600. Okay? So what does that tell us? Well it tells us this. That when we look at things [13:19.720 --> 13:31.880] like, oh I don't know, certificate of registration, driver's licenses, hang on just a second let me [13:31.880 --> 13:39.880] get this in here and I'll make sure you understand how that works, and so on and so forth. We have [13:39.880 --> 13:46.120] to see if there's another definition of person out there somewhere because the one that was given to [13:46.120 --> 14:03.160] us pursuant to chapter 311.005 and 541.002, or I'm sorry, 001 sub 64, specifically says that [14:03.800 --> 14:09.240] it only applies to that subtitle. So we're outside of that subtitle right now, and I'm sorry if I'm [14:09.240 --> 14:16.520] sounding a little confused, I'm trying to do this on the fly. Okay? Now when we look at chapter 521 [14:16.520 --> 14:24.520] as a four instance, okay? If this thing will spread out like I'm trying to get it to do here, [14:24.520 --> 14:36.280] so I can see the whole thing. There we go. All right. 521.001 has its own set of definitions, [14:36.280 --> 14:44.520] and under those definitions, we have correctional facility, department, director, driver's license, [14:45.080 --> 14:51.480] gross, gross combination weight rating, gross vehicle weight rating, license, motorcycle, [14:55.880 --> 15:03.400] non-resident, parole facility, state, state judge, image comparison technology, [15:03.400 --> 15:12.440] but what we don't have is a new definition of person. So what that tells us is that the definition [15:12.440 --> 15:23.000] under 311.005 is actually in play here because the 105.001 cannot apply outside of subtitle C, [15:23.000 --> 15:32.280] and we are in chapter 501 outside of subtitle C, I'm sorry, chapter 521, driver's license, [15:32.280 --> 15:39.560] outside of subtitle C, then the definition here of person is the same as that in 311.005, [15:39.560 --> 15:45.480] which is all governmental entities. So when we look at that, or I'm sorry, all legal entities, [15:46.280 --> 15:52.840] when we look at that, that would mean that every reference to the term person as it is found [15:52.840 --> 16:04.280] in chapter 521 is limited to the definition given us by 311.005 of just legal entities. [16:04.840 --> 16:19.240] So that means that here where 521.001 definition subsection A6 under license, [16:19.240 --> 16:27.400] the definition of license reads this way, means an authorization to operate a motor vehicle that is [16:27.400 --> 16:35.720] issued under or granted by the laws of this state, the term includes, and we will get right back to [16:35.720 --> 16:42.200] term includes after we get back from this break. I want to be a little bit wild, a little wild, [16:42.200 --> 16:47.160] but I'm going to turn the phones on if you want to get in line and hang on, but I'm going to be at [16:47.160 --> 16:53.560] least the next section and possibly the one after that getting this explained. [21:00.520 --> 21:14.520] The term includes A, a driver's license, and B, the privilege of a person to operate a motor vehicle regardless of whether the person holds a driver's license. [21:14.520 --> 21:26.520] The usage of person right here is by default limited to that that's in 311.005. Why? [21:26.520 --> 21:34.520] Because 541.001 cannot leave the subtitle C meaning that it's applied to. [21:34.520 --> 21:46.520] The penal code definition cannot apply here because chapter 311 and the Texas Transportation Code says that chapter 311.005 definition is applicable here. [21:46.520 --> 22:02.520] Thus, legal entities are the only thing it's talking about when it says the privilege of a person to operate a motor vehicle or to hold a driver's license. [22:02.520 --> 22:12.520] They cannot avoid that definition. They cannot avoid that interpretation. [22:12.520 --> 22:26.520] And the reason is that we've got three authoritative sources that tell us we cannot use anything except for the definition 311.005 in this piece of the transportation code right here. [22:26.520 --> 22:32.520] Yet the courts keep trying to use the one from the penal code. Why? [22:32.520 --> 22:40.520] Well, the why is because nobody's calling them on it. Nobody's forcing them to recognize they're doing it wrong. [22:40.520 --> 22:52.520] Okay? Now, not only is that how it applies here, there are 281 different instances of the term person just in chapter 521 alone. [22:52.520 --> 23:04.520] That doesn't even include chapter 522 commercial driver's licenses, in which case it's still the same definition from 311.005. [23:04.520 --> 23:12.520] Okay? So what kind of problems does this create for the system as it exists? [23:12.520 --> 23:22.520] Well, it pretty much blows out of the water the concept that we're just going into court and arguing the laws don't apply to us. [23:22.520 --> 23:40.520] We have it right here in front of us that the laws do not apply to us because we are not the legal person that the statute defined as being subject to these regulations. [23:40.520 --> 23:52.520] And not every legal person is subject. Every legal person must be engaged in transportation before they could even get to this point. [23:52.520 --> 24:02.520] And yet the courts continue to ignore the obvious as if it doesn't matter. [24:02.520 --> 24:15.520] You bring this up to one of them and what do they say about it? They ignore it. They act like you never mentioned it or they tell you you're reading it wrong, but they don't provide any evidence that you are. [24:15.520 --> 24:27.520] And then of course they ensure that the record that goes up on appeal makes no mention of your objection to the use of the penal code definition. [24:27.520 --> 24:35.520] They are committing fraud every single day. [24:35.520 --> 24:40.520] But wait, there is more. Okay? [24:40.520 --> 24:49.520] Now when we look at chapters 311 and 312 of the Texas government code and we see all the different things it talks about there, okay? [24:49.520 --> 25:03.520] Let's see. We get over here to the other parts of the transportation code. Just for Grins, I checked to see if there was a definition of person. [25:03.520 --> 25:08.520] If this thing would do what I'm telling you to do instead of what it wanted to do. [25:08.520 --> 25:23.520] Okay? Inside of chapter 502, which deals with registration or certificate of title act, and guess what? There is no definition for the term person. [25:23.520 --> 25:35.520] Person is used 162 times, but there is no individual definition of person in chapter 502 dealing with certificates of title. [25:35.520 --> 25:39.520] Okay? [25:39.520 --> 25:54.520] Now for that matter, let's also look at 503, or I'm sorry, 502, which is registration of vehicles. [25:54.520 --> 26:06.520] Let's see if there's a definition in there. And in fact, there is not. Okay? [26:06.520 --> 26:16.520] So once again, 311.005 contains the only definition that applies in chapter 502 dealing with registration. [26:16.520 --> 26:22.520] The term person is used here 184 times. [26:22.520 --> 26:26.520] Okay? 184. [26:26.520 --> 26:32.520] But it's limited to the definition supplied by 311.005. [26:32.520 --> 26:35.520] Okay? [26:35.520 --> 26:44.520] Now we go over here to, let's see, chapter 504, license plates. [26:44.520 --> 26:49.520] Let's see. Is there a definition of person here? [26:49.520 --> 26:55.520] No, there is not. Okay? [26:55.520 --> 27:04.520] Nor is there a person includes, but the term person is used 167 times. [27:04.520 --> 27:17.520] And once again, all of those 167 times, it has to be talking about the definition in chapter 311.005 of the Texas government code. [27:17.520 --> 27:28.520] Okay? The same thing would hold true for any definition dealing with financial responsibility in chapters 601 or 700 or whatever they are. [27:28.520 --> 27:43.520] Okay? Anything outside of chapters 541 through 600 cannot use the definition of person found in chapter 541.001. [27:43.520 --> 27:51.520] Can't do it because it is limited in scope to subtitle C only. [27:51.520 --> 28:00.520] The penal code definition cannot apply because chapter 311 of the government code, chapter 1 of the Texas transportation code, [28:00.520 --> 28:06.520] and the legislative drafting manual on what page is that, by the way, just so we can see it here. [28:06.520 --> 28:10.520] And I'm sorry, Adobe Acrobat spends a whole lot slower. [28:10.520 --> 28:15.520] Page 15 of the Texas legislative drafting manual. [28:15.520 --> 28:30.520] All right? All tell us that the definition of person in chapter 311.005 is the controlling definition over all the other chapters of the Texas transportation code. [28:30.520 --> 28:34.520] So, what does this mean to you and me? [28:34.520 --> 28:43.520] We go to court, we file a motion to dismiss for lack of subject matter jurisdiction and in personum jurisdiction. [28:43.520 --> 28:46.520] The argument goes like this. [28:46.520 --> 28:58.520] The court lacks subject matter jurisdiction because I am not one of the legal entities nor am I acting on the behalf of or for the benefit of any legal entity [28:58.520 --> 29:11.520] as identified by chapter 311.005's definition of person, which is applicable pursuant Texas legislative drafting manual page 15, [29:11.520 --> 29:18.520] definition of person usage of 311.005 to all codes to which the Code Construction Act applies, [29:18.520 --> 29:26.520] chapter 1.02 of the Texas transportation code, and chapter 311 of the Texas government code. [29:26.520 --> 29:37.520] All three authoritative sources say that the definition under the Texas penal code does not apply here and cannot be used. [29:37.520 --> 29:47.520] So, the court lacks personal jurisdiction as I am not one of these legal entities nor acting on behalf of or the benefit of any one of these legal entities. [34:10.520 --> 34:21.520] Okay, so if you're not one of those persons, that gets us into the issue of whether or not you can be subject to the moving violations [34:21.520 --> 34:26.520] despite the definition of person that's in chapter 541. [34:26.520 --> 34:34.520] Okay, now remember, person means an individual, firm, partnership, association or corporation. [34:34.520 --> 34:40.520] Okay, that's what 541 says it means. [34:40.520 --> 34:51.520] But when we look through this and we look at all the other things that are listed, like for instance, [34:51.520 --> 34:58.520] which one of these had the definition of United States in it? [34:58.520 --> 35:06.520] There's a very interesting thing here, okay? [35:06.520 --> 35:26.520] Under chapter 541, let's see, director, director, governments, 541, district, urban districts, does it have? [35:26.520 --> 35:32.520] Okay, it does not have United States in 541. [35:32.520 --> 35:36.520] Okay? [35:36.520 --> 35:44.520] Now, the other thing that we look at when we get under chapter 521, all right? [35:44.520 --> 35:50.520] Not only are we not a person as defined there, but we don't operate within a state as defined there. [35:50.520 --> 36:00.520] Under this state means a state, territory or possession of the United States, the District of Columbia or the Commonwealth of Puerto Rico. [36:00.520 --> 36:06.520] So, what definition of United States is applicable here? [36:06.520 --> 36:18.520] Well, when we look at the Texas government code, we see that state, when referring to a part of the United States, [36:18.520 --> 36:25.520] it includes any state, district, commonwealth, territory, and insular possession of the United States, [36:25.520 --> 36:31.520] and any area subject to the legislative authority of the United States of America. [36:31.520 --> 36:35.520] So, what's the difference between United States and United States of America? [36:35.520 --> 36:41.520] Well, right below the definition of state, chapter 311 defines United States. [36:41.520 --> 36:45.520] This is what it says United States means. [36:45.520 --> 36:58.520] United States includes a department, bureau, or other agency of the United States of America. [36:58.520 --> 37:05.520] Now, if you don't understand how the term includes and includes, including works in law, [37:05.520 --> 37:10.520] I've got an article on my legal blog about that. You need to go read it. [37:10.520 --> 37:20.520] Now, what this is telling us here is that we have an exclusive listing, not an expansive listing, an exclusive listing. Why? [37:20.520 --> 37:29.520] Because in order to have an expansive listing, there has to be something else that matches the things that are already listed, [37:29.520 --> 37:32.520] even though it is not listed. [37:32.520 --> 37:45.520] And by matches, the court says fits within the same general class or classification that the things that are listed created by being listed. [37:45.520 --> 37:56.520] So, for instance, in the case of citrus fruits, and it just says citrus fruits includes lemons and oranges, [37:56.520 --> 38:06.520] that would still be expansive because it could encompass grapefruits, which are also citrus, nectarines, which are citrus, etc., [38:06.520 --> 38:08.520] tangerines, etc., etc., etc. [38:08.520 --> 38:19.520] Other citrus fruit could still be added to the citrus fruit category because they are of the same general class as lemons and oranges. [38:19.520 --> 38:32.520] So here, we have United States includes a department, bureau, or other agency of the United States. [38:32.520 --> 38:37.520] Folks, those are all part of the federal government. [38:37.520 --> 38:49.520] United States, by definition here, in the general definition is applicable to all codes to which Chapter 311 governs is right here. [38:49.520 --> 38:57.520] It's a department, bureau, or other agency of the United States government. [38:57.520 --> 39:03.520] It's a legal entity of a governmental nature. [39:03.520 --> 39:08.520] It is not only that of a federal nature. [39:08.520 --> 39:16.520] It does not at all apply to any part of the transportation code that does not have a separate, or I'm sorry, [39:16.520 --> 39:24.520] it doesn't not apply to any part of the transportation code that does not have a separate definition of United States. [39:24.520 --> 39:31.520] Now, let's look at something here real quick and see if maybe we're all face on that. [39:31.520 --> 39:40.520] Let's do a search on the transportation code and see if it contains an actual definition of United States. [39:40.520 --> 39:47.520] That says United States means. [39:47.520 --> 39:48.520] Okay. [39:48.520 --> 39:52.520] There is no such thing in the Texas Transportation Code. [39:52.520 --> 39:53.520] So let's see. [39:53.520 --> 39:58.520] United States includes. [39:58.520 --> 40:03.520] There is no such thing in the Texas Transportation Code. [40:03.520 --> 40:05.520] You get it now? [40:05.520 --> 40:13.520] So over here, what we're looking at, Chapter 521, when it's talking about a state, [40:13.520 --> 40:28.520] means a state territorial possession of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. [40:28.520 --> 40:30.520] Guess what? [40:30.520 --> 40:36.520] State over here means federal. [40:36.520 --> 40:47.520] The driver's license program in the state of Texas, state, means federal, as does United States, [40:47.520 --> 41:00.520] because there is no separate definition or separate inclusion of United States in any part of the code dealing with these things. [41:00.520 --> 41:04.520] There's not one in Chapter 541 either. [41:04.520 --> 41:05.520] Okay. [41:05.520 --> 41:26.520] So anywhere that this code under Chapter 541 says state has the meaning assigned by Section 311.005 government code, [41:26.520 --> 41:35.520] and 311.005 government code defines state as I read it when referring to a part of the United States includes any state, [41:35.520 --> 41:41.520] district, Commonwealth, territory, and insular possession of the United States. [41:41.520 --> 41:42.520] Okay. [41:42.520 --> 41:46.520] And it tells us what United States means right below that definition of state. [41:46.520 --> 41:54.520] State and United States under Chapter 311 are all federal. [41:54.520 --> 42:00.520] They're all federal. [42:00.520 --> 42:08.520] There is no way around it. [42:08.520 --> 42:10.520] You get that? [42:10.520 --> 42:23.520] This is massive fraud, because the people that are supposed to know the law will not read it. [42:23.520 --> 42:29.520] Right here, there is absolutely no way that this can be interpreted any other way. [42:29.520 --> 42:41.520] State, when referring to a part of the United States, United States includes a Department, Bureau, or other agency of the United States of America. [42:41.520 --> 42:42.520] Okay. [42:42.520 --> 42:47.520] Includes any state, district, Commonwealth, territory, and insular possession of the United States. [46:57.520 --> 47:10.520] The very first chapter in the very first or second section of every one of those regulatory codes will tell you that it is subject to chapter 311 of the Texas government code. [47:10.520 --> 47:12.520] Every one of them. [47:12.520 --> 47:22.520] And because they are, every single thing I said tonight about the term person applies equally to every one of those codes. [47:22.520 --> 47:35.520] Unless that code has a local definition of person, state, or United States that would otherwise override the one that's in chapter 311. [47:35.520 --> 47:46.520] But right here, we just saw chapter 541 of the transportation code is the only chapter dealing with the regulation of drivers and operators and all that. [47:46.520 --> 47:58.520] That has a separate definition for state and it immediately tells us that you're going to use the definition that is in 311.005. [47:58.520 --> 48:06.520] Which tells us that it is subject to United States, which is also defined in 311.005. [48:06.520 --> 48:12.520] And everything about United States in that definition is federal. [48:12.520 --> 48:16.520] 100% federal. [48:16.520 --> 48:18.520] It's not expensive. [48:18.520 --> 48:24.520] It cannot be added to that is all there is. [48:24.520 --> 48:40.520] And the Supreme Court themselves have said that is all that can be in that definition because by the way it listed the items, it exhausted the class in relation to how our courts are trying to use it. [48:40.520 --> 48:49.520] They're trying to put people and Texas into that class and they don't belong. [48:49.520 --> 48:52.520] We're not persons under those chapters. [48:52.520 --> 48:55.520] We are not part of the United States under those chapters. [48:55.520 --> 49:03.520] Those statutes do not freaking apply. [49:03.520 --> 49:05.520] Got that? [49:05.520 --> 49:18.520] And that will hold true for every regulatory code in Texas that does not define person, state, or United States any differently than it is in chapter 311. [49:52.520 --> 50:00.520] I've got a family member who's an attorney and he told me he's getting the COVID shot because without it, they won't let him in the courthouse. [50:00.520 --> 50:02.520] It's cetera, et cetera. [50:02.520 --> 50:05.520] They won't let him near people and he won't be able to do his job. [50:05.520 --> 50:06.520] It's for his job. [50:06.520 --> 50:07.520] Now I'm a medical. [50:07.520 --> 50:13.520] It just happened to be a medical journal and I've covered a wide range of illnesses over a 50 year period. [50:13.520 --> 50:22.520] I did it professionally for 40 years and recently I've done 3,700 hours research on COVID alone. [50:22.520 --> 50:26.520] All its medical aspects, its political and social aspects. [50:26.520 --> 50:36.520] Now I told my relative, hey, look, you're an attorney and you've got legal grounds to sue if they fire you or not let you into the courthouse. [50:36.520 --> 50:42.520] First, the actual survival rate of those with COVID-19 is over 99.9%. [50:42.520 --> 50:45.520] So there never was a pandemic and that's a fact. [50:45.520 --> 50:52.520] Now I'm going to run some things by you and then I want you to comment to see if we even have one. [50:52.520 --> 51:04.520] Just an FYI before you jump into all the technical stuff on that, you're forgetting one very easy to prove and very important aspect of what your relation does. [51:04.520 --> 51:09.520] The fact that he is an attorney means he has contracts with clients. [51:09.520 --> 51:19.520] By refusing him entry to the courtroom, the court itself is tortuously interfering with his contracts. [51:19.520 --> 51:23.520] Okay, that's one aspect, interference with contracts. [51:23.520 --> 51:25.520] No, no, no, no, no, no. [51:25.520 --> 51:29.520] Torsious interference with a contract. [51:29.520 --> 51:33.520] Not just interference with a contract, tortuous interference. [51:33.520 --> 51:37.520] Okay, spell that word, spell that word. [51:37.520 --> 51:44.520] T-O-R-T-I-O-U-S, not tortuous, tortuous. [51:44.520 --> 51:56.520] All right, anyway, what it means is that they are interfering with a contract in a manner that can get them sued and they have no protection from being sued. [51:56.520 --> 52:05.520] Torsious interference is an illegal interference with a rightful contract. [52:05.520 --> 52:20.520] Let's say for instance you had a contract with somebody to deliver your groceries and then somebody else tried to prevent them from making the delivery and interfere with their ability to make that delivery. [52:20.520 --> 52:31.520] The person doing the interfering is tortuously interfering with your contract with the delivery person and thus can be sued for any damages that result. [52:31.520 --> 52:35.520] That's T-O-R-T-I-U-S, is that how it's spelled? [52:35.520 --> 52:38.520] T-I-O-U-S. [52:38.520 --> 52:41.520] Okay, do it slow one more time. [52:41.520 --> 52:46.520] It may even be without the I, but let me look it real quick. [52:46.520 --> 52:51.520] Torsious interference. [52:51.520 --> 52:52.520] Yeah, I got it right. [52:57.520 --> 53:04.520] Now I'm going to run through these, I'm going to run through these just quickly, very briefly, then you comment. [53:04.520 --> 53:08.520] These are suing points that I was trying to tell him. [53:08.520 --> 53:11.520] Here he's an attorney and I'm telling him. [53:11.520 --> 53:20.520] That's because I do medical journalism and I understand, well anyway, I'll get right to it. [53:20.520 --> 53:29.520] The vaccine manufacturer has obtained not FDA approval, but emergency use authorization only. [53:29.520 --> 53:33.520] Correct, it's an unapproved vaccine. [53:33.520 --> 53:38.520] But it was also obtained under fraud. [53:38.520 --> 53:46.520] One condition to get the emergency use authorization is that there be no viable treatment. [53:46.520 --> 53:54.520] That's not true. Ivermectin plus zinc, hydroxychloroquine plus zinc are two extremely effective treatments. [53:54.520 --> 54:01.520] So much so that sometimes not even the very old guy when treated soon enough. [54:01.520 --> 54:15.520] The World Health Organization, the National Institute of Health, Fauci and the CDC did their best and the vaccine companies did their best to get those drugs banned claiming they were ineffective and dangerous. [54:15.520 --> 54:19.520] This is clearly fault and fraud. [54:19.520 --> 54:22.520] Now they've been used for decades, safely and cheaply. [54:22.520 --> 54:24.520] Okay, next. [54:24.520 --> 54:28.520] Again, the emergency use authorization was obtained under fraud. [54:28.520 --> 54:32.520] There is no emergency with a survival rate of 99.9%. [54:32.520 --> 54:35.520] Those two facts alone. [54:35.520 --> 54:42.520] Okay, this means now they can't force you to take it because there is no emergency. [54:42.520 --> 54:49.520] And now you have legal standing for a lawsuit, especially if you're fired for not getting the vaccine. [54:49.520 --> 54:54.520] Well, he can't be fired, but that's that goes to what I was saying about tortuous interference. [54:54.520 --> 54:59.520] Technically, he does not work for the court, so the court isn't firing him. [54:59.520 --> 55:03.520] What the court is doing is preventing him from representing his clients. [55:03.520 --> 55:10.520] Thus, they are tortuously interfering with the contract he has with those clients. [55:10.520 --> 55:13.520] Right. Got it. Yep. Oh, no, I understand. [55:13.520 --> 55:16.520] See, I like as much ammunition as I can get. [55:16.520 --> 55:20.520] That alone is enough to do it, what you just stated. [55:20.520 --> 55:25.520] But I like to have lots of back-up because there's a lot of liars. [55:25.520 --> 55:29.520] And the same, and I'm starting to get derailed here. [55:29.520 --> 55:37.520] And the same as the COVID shot, aren't FDA approved and no valid emergency use authorization was issued, [55:37.520 --> 55:41.520] you can make you take the VAX or and people don't know this. [55:41.520 --> 55:43.520] They can't make you wear the mask. [55:43.520 --> 55:52.520] They can't make you take the COVID test for the same reason because it's under an emergency use authorization. [55:52.520 --> 55:57.520] It would have to be under full approval and they didn't get that. [55:57.520 --> 56:01.520] Now, the COVID test itself is proven to be useless. [56:01.520 --> 56:10.520] The COVID test is proven useless by the maker himself of the COVID test with 80 to 90% false readings. [56:10.520 --> 56:11.520] And that's a fact. [56:11.520 --> 56:12.520] Now, I'm moving on. [56:12.520 --> 56:17.520] Quickly, Pfizer and Moderna vaccines are not vaccines at all. [56:17.520 --> 56:24.520] So they do not qualify for protection under the no liability status as vaccines. [56:24.520 --> 56:27.520] They are mRNA therapy. [56:27.520 --> 56:29.520] Now, no, God, now consider this. [56:29.520 --> 56:33.520] If you got cancer, you got a bad back and the doctor prescribed some therapy, [56:33.520 --> 56:39.520] you are not under obligation to take it and they can't force it on you even though you're sick. [56:39.520 --> 56:44.520] So how much less authority does anyone have, especially corporate America, [56:44.520 --> 56:49.520] to force you to take a therapy when you're not even sick like they're doing right now? [56:49.520 --> 56:51.520] They tell you, you got to have this vaccine. [56:51.520 --> 56:53.520] Well, it's not a vaccine. [56:53.520 --> 56:58.520] You're not sick when they coerce you to take that quote vaccine for your job. [56:58.520 --> 57:00.520] Next section. [57:00.520 --> 57:08.520] Pfizer and Moderna vaccine makers are committing serious misrepresentation under federal law [57:08.520 --> 57:14.520] and clinics over the years have been shut down, arrested the owners for doing the same thing [57:14.520 --> 57:18.520] the government and corporations are now doing. [57:18.520 --> 57:19.520] Why? [57:19.520 --> 57:22.520] Because the vaccines are not vaccines. [57:22.520 --> 57:24.520] That's misrepresentation. [01:04:24.520 --> 01:04:31.520] That is yet another reason why they're not vaccines because they don't satisfy the medical definition [01:04:31.520 --> 01:04:36.520] or the legal definition and everything I've given you is a fact. Kennedy Jr.'s website and read what he has done. [01:06:17.520 --> 01:06:27.520] He is an environmental lawyer who is on the warpath with the COVID vaccines and vaccines in general. [01:06:37.520 --> 01:06:42.520] He's the president, John F. Kennedy's nephew, Bobby Kennedy's son. [01:06:42.520 --> 01:06:47.520] And they told him there was no autopsy. [01:06:47.520 --> 01:06:52.520] So how could they have a cause of death ruled by a coroner? [01:06:52.520 --> 01:06:55.520] That was a both-faced lie. [01:06:55.520 --> 01:07:02.520] And anybody who's getting their information from the media, the mainstream media, they better look elsewhere [01:07:02.520 --> 01:07:08.520] because there is more misinformation that's put out in one day than Carter's got liver pill. [01:07:16.520 --> 01:07:27.520] Well, at some point, they've been finding out, one doctor said 62% of his patients vaxed with the COVID vaccines. [01:07:36.520 --> 01:07:38.520] Some had them in their brain. [01:07:38.520 --> 01:07:42.520] And what happens is they build up slowly over time. [01:07:42.520 --> 01:07:44.520] Now, there's two time frames. [01:07:44.520 --> 01:07:46.520] And there are too many. [01:07:46.520 --> 01:07:49.520] Now, you know who Dr. Luc Montagnier is. [01:07:49.520 --> 01:07:50.520] I can't pronounce his name. [01:07:50.520 --> 01:07:52.520] It's French. [01:07:52.520 --> 01:07:58.520] He was the man who won the Nobel Prize in medicine for discovering HIV-AIDS. [01:07:58.520 --> 01:08:08.520] He said, and I'm going to quote him exactly, anyone who gets the vaccine can expect to die quite prematurely. [01:08:08.520 --> 01:08:10.520] Now, what are they going to die from? [01:08:10.520 --> 01:08:11.520] Several things. [01:08:11.520 --> 01:08:22.520] With the blood clots in the lungs, many people are going to die from right side, they call it right side heart failure. [01:08:22.520 --> 01:08:33.520] The right side of the heart goes into failure because there are so many clots and it gets in the way of the blood flow and the heart is damaged. [01:08:33.520 --> 01:08:35.520] That's just one of the things. [01:08:35.520 --> 01:08:39.520] They're going to die from blood clots in the brain, in the heart. [01:08:39.520 --> 01:08:49.520] It's going to destroy the lungs, the brain, the heart, the liver, and the kidneys, the major organs. [01:08:49.520 --> 01:08:52.520] It literally eats them away. [01:08:52.520 --> 01:08:58.520] Sometimes the patients bleed out, sometimes they develop clots, sometimes both. [01:08:58.520 --> 01:09:09.520] So 62% of this one doctor's patients that were vaccinated with COVID vaccine, they all had blood clots in their lungs, their brains, and everywhere else. [01:09:09.520 --> 01:09:13.520] And it is not the exception but the rule. [01:09:13.520 --> 01:09:17.520] 20 and 30-year-olds have been dying of heart attacks and strokes. [01:09:17.520 --> 01:09:29.520] 20 and 30-year-olds have been getting myocarditis and pericarditis, which is severe inflammation of the covering on the heart or the muscle inside. [01:09:29.520 --> 01:09:32.520] Myocarditis is the muscle inside. [01:09:32.520 --> 01:09:38.520] A lot of these people are going to die from an embolism. [01:11:14.520 --> 01:11:15.520] Ordinances. [01:11:15.520 --> 01:11:17.520] What you said previously. Ordinances, thank you. [01:11:17.520 --> 01:11:24.520] Their ordinances are international law that they've adopted and Agenda 21 stuff. [01:11:24.520 --> 01:11:27.520] Yeah. International building code. [01:11:27.520 --> 01:11:29.520] Correct. [01:11:29.520 --> 01:11:30.520] Okay. [01:11:30.520 --> 01:11:34.520] So, can I completely ignore that? [01:11:34.520 --> 01:11:43.520] Okay, here's the thing. First and foremost, in no state of the union is a municipal ordinance an actual public law. [01:11:43.520 --> 01:11:56.520] No one is bound by a municipal ordinance except for municipal employees on municipal property, municipal contractors and people that wish to voluntarily comply. [01:11:56.520 --> 01:12:04.520] Otherwise, they have absolutely no applicability whatsoever to the general public in any way, shape or form. [01:12:04.520 --> 01:12:11.520] They are what is known as private law. They cannot apply outside of the context of the municipality. [01:12:11.520 --> 01:12:12.520] Can't do it. [01:12:12.520 --> 01:12:13.520] Why? [01:12:13.520 --> 01:12:18.520] Because the state constitution does not give municipalities the power to make law. [01:12:18.520 --> 01:12:25.520] It only gives that power to the legislature of the state and they can't re-delegate it to anyone else. [01:12:25.520 --> 01:12:27.520] That's number one. [01:12:27.520 --> 01:12:34.520] Number two, difference between occupation of common right and occupation of privilege. [01:12:34.520 --> 01:12:35.520] Okay. [01:12:35.520 --> 01:12:47.520] An occupation of common right is one that anyone can engage in without specialized training and the job itself is not a direct threat to the public health and welfare. [01:12:47.520 --> 01:12:48.520] Okay. [01:12:48.520 --> 01:12:49.520] Okay. [01:12:49.520 --> 01:12:59.520] So that would be any job other than take a wild guess, medical field, electricians, construction. [01:12:59.520 --> 01:13:03.520] Can you guess why? [01:13:03.520 --> 01:13:05.520] Just for public safety. [01:13:05.520 --> 01:13:06.520] Correct. [01:13:06.520 --> 01:13:27.520] Okay. [01:13:27.520 --> 01:13:30.520] Same thing with the electrician that wires it. [01:13:30.520 --> 01:13:38.520] Nobody wants their building or their house burned down because the electrician didn't know how to wire something correctly. [01:13:38.520 --> 01:13:50.520] Each of those occupations along with the medical industry have a direct impact upon the public health and welfare in what they do or do not do correctly. [01:13:50.520 --> 01:13:51.520] Okay. [01:13:51.520 --> 01:14:00.520] Therefore, they are regulable jobs instead of occupations of common right. [01:14:00.520 --> 01:14:06.520] You cannot license or permit an occupation of common right. [01:14:06.520 --> 01:14:09.520] The United States Supreme Court has ruled so. [01:14:09.520 --> 01:14:15.520] They've ruled that a license in connection with an occupation of common right is unconstitutional. [01:14:15.520 --> 01:14:32.520] However, in one that is regulable due to the public interest in overseeing those qualifications necessary to do the job, they can be licensed, they can be permitted, and they can be regulated. [01:14:32.520 --> 01:14:34.520] Now, who can regulate them? [01:14:34.520 --> 01:14:37.520] In this case, it's the state. [01:14:37.520 --> 01:14:43.520] So the state law is what matters, not the municipality's ordinances. [01:14:43.520 --> 01:15:05.520] The difference there is is if you become an incorporated business operating within the municipality, then the municipality has oversight because you're a legal entity operating within their territory, not an individual who just has property that is within a territorial boundary they control but have no power over. [01:15:05.520 --> 01:15:06.520] You follow? [01:15:06.520 --> 01:15:17.520] So let's say I sell a job to a homeowner. Do they need to get, I guess they don't need to get the permit, but would we have to get the permit? [01:15:17.520 --> 01:15:18.520] Okay. [01:15:18.520 --> 01:15:25.520] The person who is selling the service is the one required to pay for the permit. [01:15:25.520 --> 01:15:29.520] So technically, no, the homeowner is never the one that has to get the permit. [01:15:29.520 --> 01:15:36.520] The person they hire to do the job for them is the one that has to get the permit. [01:15:36.520 --> 01:15:43.520] If the homeowner did the work themselves, no matter what the work is, they don't have to get a permit from anybody. [01:15:43.520 --> 01:15:45.520] It's their property. [01:15:45.520 --> 01:15:47.520] They wire it wrong and burn it down. [01:15:47.520 --> 01:15:48.520] That's on them. [01:15:48.520 --> 01:15:51.520] They build it where it caves in on their head. [01:15:51.520 --> 01:15:53.520] That's on them. [01:15:53.520 --> 01:15:58.520] But when they pay somebody to do it, that person is the one that becomes liable. [01:16:09.520 --> 01:16:11.520] And there's no way around that. [01:16:11.520 --> 01:16:18.520] The homeowner can't sign some waiver saying he'll be the overseer of it. [01:16:18.520 --> 01:16:21.520] And we don't want to do the permit process. [01:16:21.520 --> 01:16:26.520] No, the homeowner cannot make a waiver for a business that is regulable. [01:16:26.520 --> 01:16:28.520] They don't own the business. [01:16:28.520 --> 01:16:39.520] Even if they did own the business, their waiver does not negate the state's right and ability under the police power to regulate the business. [01:16:39.520 --> 01:16:44.520] What about getting a city license just to have a business? [01:16:44.520 --> 01:16:52.520] Again, if the business is one that's considered an occupation of common right, you don't need the city's license. [01:20:30.520 --> 01:20:39.520] Again, occupation of common right and you're talking about a construction business, which is not an occupation of common right. [01:22:09.520 --> 01:22:13.520] Because they're attempting to enforce their code as law at that point. [01:22:13.520 --> 01:22:15.520] Are they not? [01:22:15.520 --> 01:22:16.520] Yes. [01:22:16.520 --> 01:22:22.520] And it cannot be law if the state constitution doesn't give them municipality lawmaking power. [01:22:22.520 --> 01:22:24.520] Now, can it? [01:22:24.520 --> 01:22:25.520] Nope. [01:22:25.520 --> 01:22:35.520] Then how can they make you as an individual working on your own private property subject to their ordinance? [01:22:47.520 --> 01:22:57.520] See, not only should they be sued, but someone should seek injunctive relief that they can then publish for everyone else to follow. [01:23:36.520 --> 01:23:39.520] They can steal money, hand over fist every single day to pay their bills. [01:23:39.520 --> 01:23:42.520] You can't. [01:23:42.520 --> 01:23:45.520] So this is what they do. [01:23:45.520 --> 01:23:52.520] What about setbacks, like in the front of your property where you might want to put a fence? [01:24:01.520 --> 01:24:10.520] Here, the legal description of your property makes whatever is within that legal description yours, no matter what the city might want to say about it. [01:24:10.520 --> 01:24:19.520] So unless the legal bounds of your property is set back from whatever you're talking about here, that's just the way that's going to work. [01:26:14.520 --> 01:26:20.520] The reason why they can't develop a cold vaccine for the common cold and never have been and maybe never will, [01:26:20.520 --> 01:26:27.520] because the spike protein on a virus on the cold virus, which the vaccine would go after, [01:26:27.520 --> 01:26:36.520] that virus spike protein is so similar to important life-giving proteins located all over the human body. [01:26:37.520 --> 01:26:41.520] When the vaccine goes after those virus spike proteins, [01:26:41.520 --> 01:26:48.520] the vaccine also destroys those life-giving human proteins necessary for life. [01:28:58.520 --> 01:29:05.520] And when Dr. Luke Montagnier, the Nobel Prize-winning virologist [01:29:05.520 --> 01:29:11.520] who discovered HIV AIDS and all these names of other places and people, [01:29:11.520 --> 01:29:14.520] and I quote them, I would listen to them. [01:47:59.520 --> 01:48:04.520] They can give the municipality certain powers to regulate that business as long as it doesn't [01:48:04.520 --> 01:48:08.520] do something against what the state regulations are. [01:48:08.520 --> 01:48:13.520] It doesn't let them make law. [01:48:13.520 --> 01:48:22.520] Okay, now, does that mean that when a municipality has code like building codes and also your [01:48:22.520 --> 01:48:26.520] grass can't be more than six inches tall and your bushes have to be trimmed? [01:48:26.520 --> 01:48:28.520] All of that is controlled by ordinances. [01:48:28.520 --> 01:48:30.520] Those codes are filled with ordinance. [01:48:30.520 --> 01:48:33.520] That code is filled with ordinances. [01:48:33.520 --> 01:48:40.520] Okay, and ordinances are internal to the municipality, not external to the general public. [01:48:40.520 --> 01:48:46.520] So in other words, in other words, when they tell you to cut your lawn, they have no power to tell you that. [01:48:46.520 --> 01:48:50.520] Not legally speaking, no. [01:49:33.520 --> 01:49:37.520] Who has the granted authority, the delegated authority to make law? [01:49:37.520 --> 01:49:39.520] And who does not? [01:49:39.520 --> 01:49:45.520] Because generally they'll say this body does and no one else ever can. [01:49:45.520 --> 01:49:49.520] And that body is generally the legislature.
