[01:24.720 --> 01:28.440] Margaret Moore, the Travis County District Attorney, announced earlier this month that [01:28.440 --> 01:33.000] she was dismissing 32 felony possession and delivery of marijuana cases because of the [01:33.000 --> 01:34.000] law. [01:34.000 --> 01:37.600] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.600 --> 01:42.120] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.120 --> 01:48.280] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.280 --> 01:54.480] well as other cities, too, like the District Attorney in El Paso, Cayma Esparza, a Democrat [01:54.480 --> 01:58.960] who also stated earlier this month that the law, quote, will not have an effect on the [01:58.960 --> 02:01.680] prosecution of marijuana cases in El Paso. [02:01.680 --> 02:06.720] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.720 --> 02:10.760] in Harris County, who stated that, quote, the law is constantly changing on what makes [02:10.760 --> 02:13.480] something illegal based on its chemical makeup. [02:13.480 --> 02:17.360] It's important that if someone is charged with something, the test matches what they're [02:17.360 --> 02:22.600] charged with. [02:22.600 --> 02:27.400] A paper by Tulane University identified a five-and-a-half-inch American pocket shark. I want to see 18 years of research on it. [07:48.340 --> 07:58.340] And acting like this is brand new to just come out recently. It's not COVID-19 was patented in 2003. You sue those, but they're pretty well insulated. If you want to stop these things, you start suing the point of the spear. [08:59.340 --> 09:10.340] At least that's what they believe. And I'm definitely encouraging people to sue the governor. We had a guy in New Jersey who was blocked from a whole food store. [09:10.340 --> 09:23.340] He sued them and the lawyer assured the court that they were only carrying out the orders of the governor. [09:23.340 --> 09:30.340] Wonderful. So the lawyer threw the governor under the bus. [09:30.340 --> 09:43.340] So we're preparing an appellate, I mean, an amended pleading, naming the governor and the director of the CDC personally. [09:43.340 --> 09:54.340] I'm trying to get together a set of generic lawsuits. I'm building some questionnaires that will develop the facts. The facts are almost always the same. [09:54.340 --> 10:02.340] This goes to the mask issue and the mask issue or just one step up to go to the injection issue. [10:02.340 --> 10:15.340] They have not mandated vaccines. What they're trying to do is block your access to public establishments if you don't have it. [10:15.340 --> 10:20.340] Well, that technically amounts to the same thing. [10:20.340 --> 10:27.340] Well, it sounds like it's right around the corner and I'm just curious how far we are from getting a preemptive strike ready for that. [10:27.340 --> 10:37.340] So what we do is we take the business that follows the order of the governor and sue the business. [10:37.340 --> 10:46.340] And he's going to say, well, we're doing what the governor told us to do. Well, tell that to the governor. I'm not impressed. [10:46.340 --> 10:58.340] So if you don't think that coming right around the corner, I can smell it any moment and I just think we need to have that lawsuit drafted and ready to roll out. I got a bundle. I've just sued the state of Texas for 400 million. I'm working on a second associated suit where they got after another guy and it will be in a similar amount. [11:34.340 --> 11:48.340] I have a telegram group called mask law society and a lot of people there and we're keeping it pretty tight on researching documents we can put together. [11:48.340 --> 12:03.340] I want to put together a set of documents that you can go down to your local business that's requiring masks or now vaccines and give them affidavit notice. [12:03.340 --> 12:12.340] Here's the law concerning this matter. This is these are the rights you're violating cease and desist. And when the police get there, you pull out the second document that you have that's a criminal complaint against them. [12:37.340 --> 12:45.340] So I made out exactly what they did because they all do the same thing. You just put their name on the in it and you sign it and give it to the cop. [12:48.340 --> 12:53.700] He refuses to arrest the perpetrator, and you reach in your case and you pull out the [12:53.700 --> 12:59.140] next complaint, the one against the officer, for shielding from prosecution, you ask him [12:59.140 --> 13:04.120] to get his supervisor down here to arrest you. And I only want [23:09.340 --> 23:13.500] to get in a fight when there's no other way to around it unless it's these fights I'd [23:13.500 --> 23:19.940] like to pick. And only pick fights when I'm trying to get something changed. But here [23:19.940 --> 23:24.580] I'm, I'm very pleased that this worked out well and I hope that other people would listen [23:24.580 --> 23:31.580] to this and before you take on your local school board, talk to them. So, because I was making the assumption that [24:00.180 --> 24:03.540] I'm, I'm getting ready to take everybody to court and blah, blah, blah, blah, blah. [24:03.540 --> 24:10.380] I was half-copped. And when I had that conversation with you, you really made me think and you've [24:10.380 --> 24:18.140] really made me calm down and be, you know, the most rational that I could be. And when [24:18.140 --> 24:22.660] I went, when I went to go talk to ladies, you know, I had a heartfelt conversation with [24:22.660 --> 24:28.620] them. You know, there was, it was, it was, it was wonderful. Everything, everything [24:28.620 --> 24:34.700] was wonderful, man. And, you know, and that inspired me, like I said, to create that document. And I set them up and walked them through it. Played them like a cheap fiddle. [27:54.580 --> 28:00.780] They did everything I expected them to and set up everything for themselves. yeah, he had it built 15 years ago and they really did a good job [35:20.540 --> 35:27.540] And since they did such a good job, he sent a letter thanking them for what a great job they did [35:27.540 --> 35:32.540] 15 years later, he had a salesman come out trying to sell him a new house [35:32.540 --> 35:37.540] And showed him a letter from a satisfied customer [35:37.540 --> 35:40.540] It was his letter [35:40.540 --> 35:42.540] Oh wow [35:42.540 --> 35:50.540] The police and the public officials, they only hear complaints [35:50.540 --> 35:55.540] When they do things the way they're supposed to, we just expect that [35:55.540 --> 36:02.540] It is very rare, I make it a point when I talk to people on the phone, especially saleswomen and salesmen [36:02.540 --> 36:12.540] Who handled me with grace, I always make it a point to compliment them and thank them [36:12.540 --> 36:17.540] They do not get that often, it is really powerful [36:17.540 --> 36:25.540] And Tina will tell you, writing, she wrote a letter in her case, the judge that ruled against her [36:25.540 --> 36:33.540] She wrote a letter thanking her for her professionalism and how she treated her with dignity and respect [36:33.540 --> 36:36.540] And how much she appreciated that [36:36.540 --> 36:39.540] The judge mentioned that [36:39.540 --> 36:43.540] The next caller is Olivier in Tennessee [36:43.540 --> 36:50.540] He filed a federal case in Florida and the judge dismissed his case [36:50.540 --> 36:54.540] And he called me upset about it and I said, wait, wait, wait, wait [36:54.540 --> 37:01.540] Especially in the feds, if a judge dismisses your case, he's going to tell you exactly why he did it [37:01.540 --> 37:09.540] What he's really telling you is this is what you did wrong, this is what you got to do to fix it [37:09.540 --> 37:13.540] And it's okay for him to do that because he does it to the other side as well [37:13.540 --> 37:19.540] So he wants the best information, he wants the best decision that he can make [37:19.540 --> 37:23.540] So he tells everybody this is what I need to give you the right decision [37:23.540 --> 37:27.540] He read it and after he read it a second time, he agreed with me [37:27.540 --> 37:38.540] And I told him when you filed your response, put in there that the court's criticisms are well taken [37:38.540 --> 37:44.540] And therefore you're adjusting your response this way [37:44.540 --> 37:47.540] They dismissed his second one [37:47.540 --> 37:55.540] And the judge mentioned in that one twice that Mr. Olivier indicated that our original criticisms were well taken [37:55.540 --> 38:00.540] And we hope these will be taken as well taken as those [38:00.540 --> 38:03.540] That was incredible [38:03.540 --> 38:07.540] They mentioned it twice [38:07.540 --> 38:14.540] And in the second one they told him precisely what was wrong so it sounded like the court was going out of their way [38:14.540 --> 38:21.540] To give him what he needed because this is the kind of thing they don't get often [38:21.540 --> 38:26.540] It was a little showing of appreciation [38:26.540 --> 38:30.540] Well thank you 39:06.540] Give us a brief update so we know how you got to where you're going to go [39:06.540 --> 39:15.540] Brief update, well right now I'm still intrigued about what actually happened about like referring to what you just said [39:15.540 --> 39:23.540] I'm going to start there because as they responded to me [39:23.540 --> 39:30.540] I wrote a whole bunch of rights and everything to make sure that was conclusive I wasn't missing any point [39:30.540 --> 39:41.540] And when they wrote back to me the judge wrote one word he said well he wrote several words that really put everything together for me [39:41.540 --> 39:49.540] But I didn't realize he was actually putting it together until I went and do the secondary research that I've done now [39:49.540 --> 40:03.540] But he wrote and I didn't write this in my complaint he wrote that Mr. Olivier has a conflict with the commercial suspended license statute which Florida has [40:03.540 --> 40:11.540] That means he's already certifying that this statute is a commercial license statute [40:11.540 --> 40:22.540] And then he said that Mr. Olivier is stating that this statute is restricting his personal liberty [40:22.540 --> 40:35.540] I wrote almost two paragraphs of rights which were associated in this realm and personal liberty, I mean personal security, he wrote personal security [40:35.540 --> 40:50.540] Personal security was nowhere written in there so in my head I'm like wait a minute is he trying to send me down a hole where they can play and maneuver the case how they want to? [49:46.540 --> 49:50.540] Well, because I have the right of locomotion, I could go anywhere I want to go [49:50.540 --> 49:59.540] as long as I don't trespass on anybody else or trespass on any crimes, any activities that I'm not privileged to [49:59.540 --> 50:01.540] which I would need a real license [50:01.540 --> 50:05.540] If I'm not doing anything like that, I have the freedom of locomotion [50:05.540 --> 50:09.540] and you're telling me that I can't go down the street [50:09.540 --> 50:15.540] You haven't threatened me, you haven't done anything to me, you haven't... [50:15.540 --> 50:23.540] But you do put my personal liberty in there and I have the right to address you on it [50:23.540 --> 50:30.540] Are you speaking to an action for declaratory judgment? [50:30.540 --> 50:32.540] Right [50:32.540 --> 50:42.540] That's how you have the standing to ask the court to rule on this point of law [50:42.540 --> 50:46.540] without having been harmed [50:46.540 --> 50:54.540] For those of you who are not aware, what we're talking about here is the Declaratory Judgment Act [50:54.540 --> 51:00.540] The feds pass this for judicial economy [51:00.540 --> 51:05.540] I can go to the court and say, Your Honor, I think I've been harmed [51:05.540 --> 51:11.540] I think I've been harmed under a certain statute, but this is essentially a first plus issue [51:11.540 --> 51:18.540] This has not been addressed by the court and before I initiate a full-blown suit [51:18.540 --> 51:26.540] I want to come to you and ask for you to rule on the rights of the parties [51:26.540 --> 51:33.540] I'll give you the facts and the law and you tell me if I have a claim under this particular issue [51:33.540 --> 51:38.540] It's much more efficient for the court to give me that ruling [51:38.540 --> 51:43.540] Because if they say no, you don't have a claim, then they avoid a protracted lawsuit [51:43.540 --> 51:45.540] That's costly for everybody [51:45.540 --> 51:56.540] Okay, so now you get to use that instead of a normal civil action where you make a claim [51:56.540 --> 52:03.540] Anytime you follow a civil action in the federal courts now, you're going to get a 12B6 immediately [52:03.540 --> 52:08.540] No matter what, failure to stay to claim on which you cover can be had [52:08.540 --> 52:16.540] And the Declaratory Judgment cannot suffer that claim [52:16.540 --> 52:18.540] Because there are no claims [52:18.540 --> 52:25.540] When you follow the Declaratory Judgment, don't ask for attorney fees, don't ask for harm of any kind [52:25.540 --> 52:31.540] Just ask for a ruling on the court and it's immune from 12B6 [52:31.540 --> 52:37.540] From what I'm from research that I've done, the court has said that the reason that this is done [52:37.540 --> 52:51.540] Is because the fairness in the Constitution mandates that things be that we know for certain [52:51.540 --> 52:56.540] Because if we're going to be charged criminally, the law has to be known for certain [52:56.540 --> 53:07.540] So that's why they restrict the rule 12B6 because they understand that this Declaratory Judgment is for inconsistency or clarity of law [53:07.540 --> 53:16.540] And they say that that is the utmost importance because that clarity of law usually goes to a petition of the Constitution [53:16.540 --> 53:22.540] So this is the right place [53:22.540 --> 53:34.540] Does that give you the impression that if you craft your claim appropriately that they're likely to rule in your favor? It's important that if someone is charged with something, the test matches what they're charged with [01:02:22.540 --> 01:02:50.540] A paper by Tulane University identified a five and a half inch American pocket shark as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured or recorded with the other one being found way back in 1979 in the East Pacific Ocean. So where are you at now in the process? [01:03:46.540 --> 01:04:05.540] Right now, I'm about to finish writing up the document because the more I read, the more solid angles that I'm finding, and I'm really, I'm looking at like, man, I got to rewrite this and then explain it, and like this document looks like almost 50 pages. [01:04:05.540 --> 01:04:14.540] Do they have a page limit on appeals? I know Texas does. [01:04:14.540 --> 01:04:21.540] Page limit on appeals? Well, this is not appeal, this would be civil. [01:04:21.540 --> 01:04:24.540] Oh, this is original, you're still on the original petition? [01:04:24.540 --> 01:04:42.540] Yes, this is the original petition. And then the appeal would pretty much do itself. After I write the original petition, the right way, the way that the courts speak their language, any ruling against me, I don't have to do anything. [01:04:42.540 --> 01:05:01.540] I say that's the final appeal and rewrite it. It's their ruling out of their courts. And the language, you know, I figured out all the language barriers that they try to use, and which makes it overbearing or unconstitutional. [01:05:01.540 --> 01:05:15.540] So, you know, anything they do is a trust. So the best thing, the best thing for that judge to do is to grant it because now his name would be on the document. [01:05:15.540 --> 01:05:27.540] He would be the leading judge that allows, you know, this to go. It's either you go, you grant, you rule with it or rule against it and they make you look bad. [01:05:27.540 --> 01:05:35.540] You rule with it and you win and you keep on with what we did. I'm submitting it regardless. [01:05:35.540 --> 01:05:47.540] And now that I've got reading all these federal cases, I realize that they want me to resubmit it to them. [01:05:47.540 --> 01:05:57.540] They want me to resubmit it to them just to leave out the interference. [01:05:57.540 --> 01:06:04.540] So what I'm going to do is I'm doing all this research. I'm putting all the case together. I'm going to write this up. I'm going to write this through. [01:06:04.540 --> 01:06:12.540] And then I'm just going to change the heading for the federal, you know, put it underneath the makings and then we do it properly for the federal. [01:06:12.540 --> 01:06:20.540] But it would be the same argument because it's the same research, same cases. I'm using the federal cases and the state cases. [01:06:20.540 --> 01:06:26.540] They're saying the same thing. They're all aligning. So I just put them in the proper jurisdiction. [01:06:26.540 --> 01:06:46.540] And then now when the state receives this, they want to get a state declaratory suit plus a federal declaratory suit. So now they understand that I ain't playing. [01:06:46.540 --> 01:06:57.540] I think they got that idea already. Will you tell us about your experience before the trial court? [01:06:57.540 --> 01:07:02.540] The experience before the trial court. [01:07:02.540 --> 01:07:09.540] Tell them about let's make a deal. [01:07:09.540 --> 01:07:21.540] Okay. When the attorney, when it's a trial court, every time I spoke to the attorney and she was just offering me deals, they didn't show me no discovery. [01:07:21.540 --> 01:07:27.540] They didn't tell me anything. I kept telling her, no, no, we're going to trial. [01:07:27.540 --> 01:07:39.540] She finally brought me up to the judge. Then she tells the judge, no, Ms. Olivia doesn't want the deal. They were trying to get $25 fine and withhold adjudication. [01:07:39.540 --> 01:07:47.540] I'll have points on my license and all this other stuff. I'm like, no. And the judge is sitting there like, Ms. Olivia, this is a wonderful deal. [01:07:47.540 --> 01:07:54.540] I can't believe, like, no one has gotten a deal like this like in here. Do you know the ramifications? [01:07:54.540 --> 01:07:58.540] I said, Your Honor, yes, I do, but no. [01:07:58.540 --> 01:08:03.540] She's like, well, do you mind if I tell you? I said, yeah, you go ahead and tell me. [01:08:03.540 --> 01:08:05.540] I said, no. [01:08:05.540 --> 01:08:14.540] She's like, well, listen, if you go to trial and lose, it might be just her and the DA, like, no, Your Honor. [01:08:14.540 --> 01:08:26.540] The judge is a little bit of a DA, like, no. I'm like, well, he's going to finally get adjudicated and kill me, and then there won't be no adjudication, Your Honor. [01:08:26.540 --> 01:08:31.540] And the judge is looking at me like, there's no adjudication either? Like, no. [01:08:31.540 --> 01:08:46.540] And so now the judge is trying to convince me that I should take this deal of $25 and get points on my license and all this, and then now that I'm rejecting everything and they're going over the rules, she's realizing that, [01:08:46.540 --> 01:09:07.540] number one, this is a civil infraction, which I went to jail for, which is already violate due process. So, yeah. And then if I go to trial and they found me guilty, they can't adjudicate me, they can't put points. [01:09:07.540 --> 01:09:23.540] I'm sitting here like, wait a minute. You are, y'all are confusing these lines to these people, basically a trick and fraud, and presenting like you're giving these people a deal when they're in here for a civil infraction. [01:09:23.540 --> 01:09:38.540] But you're not even allowed to adjudicate and put points on them, but they're pleading now to it to enhance it to a higher criminal charge later on. [01:09:38.540 --> 01:09:55.540] And that's what I called you about when I was trying to figure about the criminal part, the civil and the criminal part of this statute. I went and researched it, and Florida says that it is a criminal charge, but they kind of decriminalize it to give you leeway. [01:09:55.540 --> 01:10:19.540] But the first, they said that the first one, the first conviction, the first conviction is a misdemeanor. Okay? So, and now the way that they're holding, withholding adjudication and stuff like that, and the language that is in the statute, when they hold, withhold adjudication, [01:10:19.540 --> 01:10:34.540] that means that it is not a conviction. So, these cops are arresting people under wrong terms saying that, well, they've been convicted like, no, they weren't convicted because it was withheld adjudication. [01:10:34.540 --> 01:10:49.540] And if you wish they don't read the case law properly, if you read the case law, you will see that the federal court and the higher courts already ruled that because of the way that the statutory construction is made, [01:10:49.540 --> 01:11:02.540] they read the definition and read all the things that are applied. And within the definition, it says that adjudication is not a conviction. [01:11:02.540 --> 01:11:16.540] Adjudication withheld cannot be considered a conviction. So, there's a lot of legal use for people don't, they don't even, I'm sitting here like, I'm tired of reading. I'm so tired of reading, but I can't stop. [01:11:16.540 --> 01:11:30.540] Every time I pick up something, I'm finding things. Now, I understand how this is a criminal charge, but I'm in the civil court room because I've never been found guilty of driving on a suspended license. [01:11:30.540 --> 01:11:45.540] I've never been convicted of it. I've got to, I've got fines which cause my license to get suspended, which I'm also going to challenge that statute which allows us to suspend the license because, [01:11:45.540 --> 01:12:05.540] you know, they are over-broad in their process, which, if the people do not stand up, now they are being taken advantage of by being, by having something suspended that is not suspendable without due process, if that makes sense. [01:12:05.540 --> 01:12:19.540] Yeah, that makes sense. That's beautiful. I love the way you're pursuing this. You're staying like just a pit bull, won't let go, and now you're getting a better grip. I love it. [01:12:19.540 --> 01:12:44.540] You're a better grip. Now, this criminal part of it is, so basically, if you really understand the way that this law is constructed, you can be brought into court 10 times and never be convicted. [01:12:44.540 --> 01:13:02.540] So, this is a way, I guess, the way the law is constructed, even though it's in black and white, you have to use the understanding of the statutory construction to play chess with them to actually understand how it goes. [01:13:02.540 --> 01:13:20.540] So, is that we shouldn't just take things for just how it looks, and the whole effort says, no, you have to go to the other part of the statute, look at what their definition is saying, what they allow, and what it means, because when that blew my mind, I'm like, wait a minute, adjudication does not mean conviction. [01:13:20.540 --> 01:13:36.540] And then over here, they're talking about conviction, but all of these cases show that there was adjudication withheld. That means that what they did was unlawful, because that was not a true conviction, not by statutory scheme. [01:13:36.540 --> 01:13:37.540] Yeah. [01:13:37.540 --> 01:13:47.540] So, if you didn't catch that, you just took an L, you just went to jail for no reason or anything. I'm saying like, wow, this is crazy. [01:13:47.540 --> 01:13:55.540] And it sounded like the judge absolutely knew that and was afraid that you were figuring it out. [01:13:55.540 --> 01:14:10.540] No, you kind of sort of, it's either that or they've been doing this for so long that the judge doesn't even know what's going on, because I'm the first person who said no to a $10 fine. I think it was $10 or $25. [01:14:10.540 --> 01:14:17.540] Everybody else in the courtroom was staring at me like, what? $25, get out of here. Come on, man, just take that. [01:14:17.540 --> 01:14:31.540] They're like, no. I'm going to spend that money. I'm going to make you spend your money and take me to trial, and I'm going to see the 50CA, because that's my plan. [01:14:31.540 --> 01:14:42.540] And the judge looked at me like, well, she stopped talking to the judge, and she's like, well, we can get a pill. It goes to the section, and no, it goes to the 50CA. [01:14:42.540 --> 01:14:51.540] And I had a big old smile on my face, like, I know what's going on. I know. So, I'm just smiling. She's staring at me like, wow. [01:14:51.540 --> 01:14:59.540] Because most people fight, like, when you fight, it's dirty. I'm fighting. I'm being nicer. She's like, can I explain to you? [01:14:59.540 --> 01:15:08.540] I'm like, yeah, you can explain, but still no. But go ahead. I'm listening. Everybody's looking at me like, what is wrong with you guys? [01:15:08.540 --> 01:15:18.540] I'm like, go ahead. Go ahead, Grandma. Go ahead. I'm listening. But no. I'm going to let you finish. Are you finished, man? But I didn't understand, like, how much power I had at the time, because I didn't understand the difference between the criminality of it, when it turns criminal. And then there's several adjudications before you even become convicted, because the legislatures are trying to decriminalize it to a certain extent. [01:15:51.540 --> 01:16:07.540] So, now it's in because if you're just blatant disrespectful, they're giving them the authority to enhance it. But they understand fines and fees, or, you know, they also said, this is very interesting. [01:16:07.540 --> 01:16:21.540] They said that they cannot take that into account, because people will pay civil fees, they will pay the ticket just because of the inconvenience of getting to court or other things. [01:16:21.540 --> 01:16:36.540] So, they've not allowed a court to use when they pay the ticket and stuff like that to adjudicate them for, because they understand how the system can be overbearing.
