[01:24.920 --> 01:28.560] Margaret Moore, the Travis County District Attorney, announced earlier this month that [01:28.560 --> 01:33.080] she was dismissing 32 felony possession and delivery of marijuana cases because of the [01:33.080 --> 01:34.080] law. [01:34.080 --> 01:37.720] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.720 --> 01:42.200] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.200 --> 01:48.400] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.400 --> 01:54.560] well as other cities, too, like the District Attorney in El Paso, Cayma Esparza, a Democrat [01:54.560 --> 01:59.080] who also stated earlier this month that the law, quote, will not have an effect on the [01:59.080 --> 02:01.800] prosecution of marijuana cases in El Paso. [02:01.800 --> 02:06.880] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.880 --> 02:10.880] in Harris County, who stated that, quote, the law is constantly changing on what makes [02:10.880 --> 02:13.600] something illegal based on its chemical makeup. But while [04:47.700 --> 04:50.900] we're waiting for that segment, I'm going to go ahead and go over some stuff I've been [04:50.900 --> 04:56.980] looking at today for what I'm trying to do with the new seminar material. I've been going [04:56.980 --> 05:01.140] further and further into getting more records and things from the state law library that [05:01.140 --> 05:07.220] backtrack these original acts. The one I've been working on here lately deals with vehicle [05:07.220 --> 05:13.580] registration and what its original intended purpose was. And I want to give a little bit [05:13.580 --> 05:19.380] of credit where credit is due into how I got to where I am in questioning this stuff. And [05:19.380 --> 05:25.860] for me, when it came to challenging a lot of the Texas transportation stuff, it all [05:25.860 --> 05:31.540] began with a book by a band by the name of Daniel Shenzig. And he wrote a book called [05:31.540 --> 05:37.540] the state of Texas is a liar. And he went into a lot of different things in the book, [05:37.540 --> 05:44.780] sales tax, the registration and all this other kind of stuff. But the only problem I found [05:44.780 --> 05:50.300] after I took the information he had and started processing it and studying it and researching [05:50.300 --> 05:58.300] it and trying to prove it out to be accurate was that he literally didn't go far enough [05:58.300 --> 06:04.980] down the hole to get everything necessary to prove his perspective. Not saying he was [06:04.980 --> 06:11.660] wrong in what he was saying. What I am saying is he didn't have enough to make it where [06:11.660 --> 06:18.900] it was inarguable. You know how these attorneys and prosecutors and every public servant you [06:18.900 --> 06:23.260] ever talked to about this stuff does. Oh, you're just misunderstanding. Oh, you're just [06:23.260 --> 06:27.220] misreading it. Oh, you don't really think it works that way and it can't work that way [06:27.220 --> 06:32.300] because of blah, blah, blah, et cetera, et cetera, et cetera. The problem I have found [06:32.300 --> 06:37.740] with the arguments from these public servants is that they are the ones basing their presumptions [06:37.740 --> 06:45.060] on their opinion rather than the actual law. And I can say this in complete confidence [06:45.060 --> 06:50.540] because I've sat down face to face with so many of them and had this discussion and it [06:50.540 --> 06:59.620] always comes down to exactly the same thing. They hang their hat on one single statute [06:59.620 --> 07:06.580] without consideration of the entirety of the law we are discussing. They try to make it [07:06.580 --> 07:13.820] look as if various areas of the law are not interrelated when in fact they are inextricably [07:13.820 --> 07:21.620] entangled. They just don't want to see it. This is one of the reasons why I have spent [07:21.620 --> 07:28.820] all the time I spent trying to get these various mind maps done of this way the statutes interrelate [07:28.820 --> 07:33.740] so that we know that any given instance in the process, these are all the statutes from [07:33.740 --> 07:39.580] all the various codes that are in play at that moment right then. Whether it be on the [07:39.580 --> 07:43.820] criminal prosecution side, whether it be on the transportation code side, whether it [07:43.820 --> 07:50.220] be on the government code side, you name it. These mind maps are intended to link them [07:50.220 --> 07:55.980] all together in such a way that when you know to go look at all of these you can learn to [07:55.980 --> 08:03.300] read the law as a whole to understand its purpose. Now some parts of this can't be read [08:03.300 --> 08:09.820] as a whole because it is these jumping off points so to speak. And that is when you look [08:09.820 --> 08:16.580] at the original bill that created the laws you are reading you need to understand what [08:16.580 --> 08:23.940] the constitutional requirements for every bill enacted as a law in the state of Texas requires. [08:23.940 --> 08:30.260] And because it requires these things it must follow a certain set of procedures to get [08:30.260 --> 08:37.820] to the point where it is actual law. So those are our starting points for every law that [08:37.820 --> 08:42.020] we have. We don't have to look at the government code to see what the starting point for the [08:42.020 --> 08:46.180] law of the transportation code is. We don't have to look at the transportation code to [08:46.180 --> 08:50.380] see what it is for that particular part of the government code. You see what I'm saying? [08:50.380 --> 08:54.940] But when you start talking about the subject matter within those laws in those various [08:54.940 --> 09:01.540] codes that is when they start to intertwine. And once they become entangled in that manner [09:01.540 --> 09:08.700] they cannot be read apart from each other. Doing so in fact completely negates a proper [09:08.700 --> 09:15.580] understanding and comprehension of what is going on in that law. What its purpose is, [09:15.580 --> 09:20.540] how it works, what it applies to and what the state is doing right or wrong in relation [09:20.540 --> 09:26.740] with it. Okay? By doing it this way I'm hoping these mind maps make that discussion a whole [09:26.740 --> 09:31.580] lot easier. Not only from the perspective of talking to our public servants about it, [09:31.580 --> 09:39.060] but in talking to each other about it. In fact, I believe they are so helpful to give [09:39.060 --> 09:45.860] you that pictures worth a thousand words perspective on how these laws work that I'm actually [09:45.860 --> 09:53.420] going to talk to my friend Dave Champion and ask him if it's fine with him if I do individual [09:53.420 --> 10:00.500] chapter mind maps of his book, income tax shattering the myths. That way in relation [10:00.500 --> 10:06.620] to reading all of the codes and the opinions and the court cases and everything else that [10:06.620 --> 10:12.460] go with the treasury decisions that go with everything in each of those chapters you can [10:12.460 --> 10:20.620] get a picture overview of how they all link together. That way when you're discussing [10:20.620 --> 10:25.300] it and you like for instance you want to go down and talk to the IRS face to face and [10:25.300 --> 10:30.900] tell them you're done dealing with them and they're now going to have to leave you alone [10:30.900 --> 10:36.060] and you take this down there instead of letting them blow smoke about giving you a statute [10:36.060 --> 10:40.860] that doesn't apply to the current situation they're using you've got this mind map that [10:40.860 --> 10:45.940] shows you that the statute they're referencing has absolutely nothing to do with the section [10:45.940 --> 10:50.700] they're trying to pin you on you. You see how easy that would be? You don't have to [10:50.700 --> 10:57.500] go thumbing through verses and verses of anybody's book or information to see that. Everything's [10:57.500 --> 11:02.460] organized in a map where you can sit here and say okay here's the statute you're trying [11:02.460 --> 11:07.220] to say I'm in violation of here's the statute you're referencing that says it applies to [11:07.220 --> 11:12.700] that violation yet it's nowhere in this mind map. So that statute you're trying to use [11:12.700 --> 11:18.900] to enforce your position doesn't apply here therefore your argument against me is fallacious [11:18.900 --> 11:24.100] we need to figure out what you're really trying to do here because what you're doing is not [11:24.100 --> 11:32.940] compliant with the actual law. It will give us an at your fingertip way of fighting back [11:32.940 --> 11:40.380] in these IRS appearances by having that visual diagram of these statutes. Now believe it [11:40.380 --> 11:46.380] or not I know this is going to sound crazy but Dave's book is a whole lot easier to mind [11:46.380 --> 11:55.740] map than mine and that's because mine covers multiple codes his covers one the only thing [11:55.740 --> 12:01.860] external to that code are court cases and treasury decisions and possibly some other [12:01.860 --> 12:10.380] sort of governmental information that facilitates one of the other as a basis of fact. So his [12:10.380 --> 12:15.580] is a lot easier to mind map and so I'm going to ask him if that's going to be okay because [12:15.580 --> 12:20.540] I think it would give everybody a much clearer way of referencing what they're reading to [12:20.540 --> 12:27.700] see how it is interconnected and then it would also show you which parts stand separate from [12:27.700 --> 12:36.660] other parts when it comes to specific pieces of the tax code and who it applies to. Okay [12:36.660 --> 12:41.220] and that's what I'm hoping to do with the ones for the Texas transportation code is [12:41.220 --> 12:47.220] to get them mapped out and get them done in such a way that they don't take up an entire [12:47.220 --> 12:54.900] 3D ceiling in a movie theater you know what I'm saying it's just it's ridiculous how big [12:54.900 --> 12:59.340] these things can get when you're dealing with a lot of information and so what I want to [12:59.340 --> 13:06.020] be able to do is take the individual subjects relative to I'm sorry the individual objects [13:06.020 --> 13:10.980] within the subject of transportation and show for instance all the statutes that relate [13:10.980 --> 13:17.700] to licensing for the driver or operator all the ones that deal with licensing of the vehicle [13:17.700 --> 13:23.900] registration of the vehicle what the differences in the vehicle classes are whether they're [13:23.900 --> 13:31.420] commercial or non-commercial etc etc etc and that way we can have a picture view of everything [13:31.420 --> 13:37.180] that's going to be in the new seminar book along with the words it'll help make the discussion [13:37.180 --> 13:42.860] a whole lot easier to follow and understand I'm hoping so be looking for that because [13:42.860 --> 13:49.580] I'm working diligently on it I'm losing tons of sleep because of it but the state law library [13:49.580 --> 13:54.660] is frequently sending me the information I've been requesting and I'm compiling more and [13:54.660 --> 14:00.940] more more of it every day and when I go through this stuff and I start interconnecting these [14:00.940 --> 14:09.780] things but the other thing it's showing me is exactly where the courts themselves have [14:09.780 --> 14:20.300] knowingly corrupted the law now understand this what I'm finding proves beyond any reasonable [14:20.300 --> 14:31.340] doubt that what the courts are doing is in it's absolutely intentional it's not a mistake [14:31.340 --> 14:41.380] it's not lack of knowledge it is an absolute totally preconceived thing and once we get [14:41.380 --> 14:45.500] through the discussion on this when the book comes out you'll see exactly how and why that [14:45.500 --> 14:52.820] is because anyone that is calling themselves learned in the law while calling the rest [14:52.820 --> 14:59.540] of us ignorant but that are at the same time doing what these courts are doing in relation [14:59.540 --> 15:07.660] to that law there is no question fraud is afoot and it is it is intentional from the [15:07.660 --> 15:15.820] ground up I was reading a case today that dealt with this Seattle or the Washington [15:15.820 --> 15:23.780] state courts on interpreting their statutes from 1965 and I went to researching this because [15:23.780 --> 15:29.740] someone had posted the info on Facebook and so I went back to verify the statutes and [15:29.740 --> 15:38.020] all this kind of stuff and what I saw in the original 1965 acts as it's come forward because [15:38.020 --> 15:44.300] I've currently got a document that contains most of the state laws in Washington relative [15:44.300 --> 15:51.020] to the subjects of registration motor vehicle insurance licensing and all that other stuff [15:51.020 --> 15:56.700] for private automobiles versus commercial use automobiles in the state of Washington [15:56.700 --> 16:04.860] and even the current statutes makes it absolutely clear that it is not meant to be applied to [16:04.860 --> 16:12.620] the private individuals of the public not meant to be applied to them at all in fact [16:12.620 --> 16:21.500] in the 65 statutes it specifically says the privilege of using the highways in the state [16:21.500 --> 16:30.300] of Washington well the people are not using the highways as a matter of privilege we use [16:30.300 --> 16:41.940] them as a matter of right and because of that we know that privilege doesn't apply to us [16:41.940 --> 16:47.820] therefore the statutes that grant and control the privilege cannot and does not apply to [16:47.820 --> 16:53.780] us all right folks that's a short synopsis of what we're getting into but of protecting us we owe it to him to ensure [39:42.340 --> 39:54.820] that the natural consequences of his actions be visited upon him if you make a decision [39:54.820 --> 40:03.860] that has no him he had no power to do what he did but [40:59.820 --> 41:12.940] he took this risk to help us the fact that he may have been misled or his rationale was [41:12.940 --> 41:21.060] faulty that's separate you know my brother the idea of dropping on that grenade or that [41:21.060 --> 41:32.860] bouncing Betty might have been a bad idea but at the time he really felt that it was [41:32.860 --> 41:39.940] the right thing to do acting from the perspective that the governor felt like he was doing the [41:39.940 --> 41:47.820] right thing for the right reasons okay I can accept that but if you do the right things [41:47.820 --> 41:56.180] for the right reasons and they are in violation with standing law you owe it to all of us [41:56.180 --> 42:06.540] to suffer the consequences of the violations of law and in this case the governor had absolutely [42:06.540 --> 42:16.460] zero authority to issue the executive orders that he issued and the consequences of issuing [42:16.460 --> 42:25.340] those orders they will have caused the deaths of a large number of citizens of the state [42:25.340 --> 42:36.940] of Texas everything has consequences I'm a combat veteran I have a injury I suffered [42:36.940 --> 42:46.220] in combat 50 years ago okay it's only my toe I got that part but it hurts you interrupted [42:46.220 --> 42:55.220] recently I have to walk in crutches but I can't go get that fixed because the governor [42:55.220 --> 43:04.380] declared that medical professionals could not accept anyone unless they had a life threatening [43:04.380 --> 43:14.500] injury because were getting chosen for [48:04.900 --> 48:11.540] these grand juries that wouldn't be a problem but because people like us are filtered out [48:11.540 --> 48:17.700] of any sitting grand jury or jury pool for that matter people that actually know and [48:17.700 --> 48:21.900] understand the issues of what these public servants are doing whether it be the governor [48:21.900 --> 48:28.180] or judge or anyone else is never allowed to see the inside of a courtroom to hold them [48:28.180 --> 48:34.460] accountable they want the dumbest lowest common denominator person possible sitting in that [48:34.460 --> 48:41.100] box who basically depends upon the government for their very survival they're never ever [48:41.100 --> 48:47.420] going to bite the hand that feeds them and that's exactly what the system as it's currently [48:47.420 --> 49:03.540] set up provides protection in that form understanding that how would we craft a presentation that [49:03.540 --> 49:20.300] would give them cause to bring a trivial for the purpose of examining an issue that in [49:20.300 --> 49:26.460] other contexts may be more harmful to them than they would otherwise realize and that [49:26.460 --> 49:34.580] that's what I'm trying to bring is that we live in a republic and this republic was is [49:34.580 --> 49:43.780] not a democracy it is a democratic republic but at the end of the day it is a republic [49:43.780 --> 49:57.180] and the republic is designed to have certain rules to protect us from otherwise well-intended [49:57.180 --> 50:06.060] public officials who were wielding unchecked power let's not forget yes yes who were wielding [50:06.060 --> 50:13.540] power in an emergency situation and they they feel like they have to take extreme measures [50:13.540 --> 50:22.820] to protect people but in an emergency they tend not to look down the road well our legislature [50:22.820 --> 50:33.100] our founders looked down the road when they created the Texas Constitution and they understood [50:33.100 --> 50:44.660] that crises occur and put rules and regulations in place to prevent public officials in position [50:44.660 --> 50:53.060] of power and authority from creating a set of precedent that would survive the instant [50:53.060 --> 51:02.980] emergency and have the fact the effect of degrading the republic and in doing that they [51:02.980 --> 51:16.820] assigned specific duties to particular public officials we have article one section 29 of [51:16.820 --> 51:28.100] the Texas Constitution it demonstrates exactly what the ledges what our founders intended [51:28.100 --> 51:40.340] and before I go there let me back up one article one section 28 says that no law shall be [51:40.340 --> 51:52.700] what does it say any abridged or suspended suspended exactly no law shall be expended [51:52.700 --> 52:04.740] suspended except by the legislature and that's pretty clear hard to misunderstand and then [52:04.740 --> 52:17.060] the very next section section 29 demonstrates exactly why the legislature put in section [52:17.060 --> 52:24.620] 28 they said in order well one of the people put in section 28 actually as our founders [52:24.620 --> 52:30.980] should put together the Constitution right as representatives of the people but not [52:30.980 --> 52:41.060] the legs exactly exactly for them for the protection of the people they understood the [52:41.060 --> 52:50.420] how things really worked that even the best of the best who are acting in the best interest [52:50.420 --> 53:02.380] for the good of the people in an emergency situation will tend to sometimes act in ways [53:02.380 --> 53:12.380] that over the long term can be detrimental to the public and they put restrictions in [53:12.380 --> 53:24.260] place to guard us against changing the law and changing procedures to play to a particular [53:24.260 --> 53:32.060] emergency this is not the first pandemic we've seen the Spanish flu is much worse than this [53:32.060 --> 53:40.700] but we didn't abandon the Constitution because of the Spanish flu article 28 of the Bill [53:40.700 --> 53:51.820] of Rights of the Texas Constitution forbid the suspension of laws under 28 he says no [53:51.820 --> 54:01.220] power of suspending laws in this state shall be exercised except by the legislature okay [54:01.220 --> 54:07.100] that's not hard to understand that's pretty clear and in section 29 the very next one [54:07.100 --> 54:14.820] they explain exactly why they passed that to guard against transgressions of the high [54:14.820 --> 54:23.420] powers here in delegated we declare that everything in this bill of rights is accepted out of [54:23.420 --> 54:30.820] the general powers of government and shall forever remain in violent and all laws current [54:30.820 --> 54:43.020] terry there to or to the following provisions shall be void they stated exactly why yeah [54:43.020 --> 54:47.820] and you've got article 3 section 62 which specifically prohibits the suspension of the [54:47.820 --> 54:54.940] bill rights under any conditions including enemy evasion and attack exactly and here [54:54.940 --> 55:05.260] they start out with to guard against the transgressions of the high powers here in delegated that [55:05.260 --> 55:14.220] was directed specifically to the governor of the state of Texas he is the high power [55:14.220 --> 55:24.220] he's the highest level public official in the state of Texas and then fully understood [55:24.220 --> 55:30.940] that in a crisis high level public officials will never let a crisis go to a good crisis [55:30.940 --> 55:38.980] go to waste that people in positions of power and influence will consistently attempt to [55:38.980 --> 55:44.980] increase their power and influence it is the nature of the human animal and the highest [55:44.980 --> 55:51.460] power is the most likely to try to increase their power and influence and here they strictly [55:51.460 --> 56:00.940] for that edge and in this covert pandemic comes along with the governor do he abolish [56:00.940 --> 56:11.820] his laws he makes laws of his own just makes them up and then he engages the high the department [56:11.820 --> 56:18.540] of public safety to enforce those laws these are guys with guns on their hips and when they [56:18.540 --> 56:23.100] come into enforce those laws they will enforce those laws and it requires using those guns [56:23.100 --> 56:29.260] on their hips they will use those guns on their hips the way I read the penal code in [56:29.260 --> 56:43.060] the state of Texas under 557.001 that's addition next thing to treason okay assuming that the [56:43.060 --> 56:53.820] governor was acting in the best interest of the people she simply had no power to do what [56:53.820 --> 57:01.060] he did yeah there's not even anything in in 481 or 82 that gives him any such powers he's [57:01.060 --> 57:07.540] given a very specific area over which his authority exists just like the judges were [57:07.540 --> 57:15.540] the judges power is limited to actions based upon a specific quarantine zone absent of [57:15.540 --> 57:21.540] declared quarantine zone a judge has absolutely no power to issue an edict of any kind under [57:21.540 --> 57:27.780] the emergency powers provisions and in the government code and the emergency power provisions [57:27.780 --> 57:38.380] in the government code 418 Texas government code it's absolutely unconstitutional on [57:38.380 --> 57:50.260] its face because it purports to grant the governor authority to abolish law what part [57:50.260 --> 58:04.300] of section 28 is hard to understand no power of suspending laws in the state of in the [58:04.300 --> 58:14.460] state shall be exercised except by the legislature how do you get those two to match together [58:14.460 --> 58:18.580] well I can tell you how the attorneys would try to spend it but it's not gonna fly with [58:18.580 --> 58:24.020] anybody with any reasonable intelligence which leaves the attorneys out but still anybody [58:24.020 --> 58:35.660] who's read the constitution 418 Texas government code is unconstitutional on its face because fire registration driver's license uh was expired been expired [01:07:21.620 --> 01:07:28.020] about six years not for spending the expiry and then he asked for proof of insurance and i said well [01:07:29.140 --> 01:07:32.740] there's no accidents there's no cause of action you don't need to see any insurance [01:07:34.820 --> 01:07:43.140] and uh he wrote me up with the three tickets must appear and i continued it out and i still [01:07:43.140 --> 01:07:51.140] continued to travel but then he got me again about a month later and had already talked to [01:07:51.140 --> 01:07:56.020] brandy about this because i thought it'd be double jeopardy because i hadn't even been to a hearing [01:07:57.060 --> 01:08:02.500] and i thought that something had to go through due process at least that's what they do no it's [01:08:02.500 --> 01:08:10.260] considered a separate offense not the same series of events it is but see if i'm saying that i'm [01:08:10.260 --> 01:08:15.940] just traveling and not in their subject matter wouldn't that have to be adjudicated before [01:08:15.940 --> 01:08:21.700] work well you can make the same argument with i with by rolling the cases together and having [01:08:21.700 --> 01:08:30.020] them heard at the same time but the fact of the matter is is what you're what you're thinking [01:08:30.020 --> 01:08:35.860] of isn't how it actually works if that were true then somebody could go commit one murder and then [01:08:35.860 --> 01:08:40.100] go commit a second murder before they go to trial for the first one and never get charged with the [01:08:40.100 --> 01:08:46.500] first one all right well the second one you see what i'm saying that's what randy said yes and i [01:08:46.500 --> 01:08:54.180] understand that but part of the there was a case law from wyomington says part of the uh double [01:08:54.180 --> 01:09:01.220] jeopardy clause the third one said you could not have multiple punishments for the same [01:09:01.220 --> 01:09:06.660] offense but see i thought it would fall under that because if i'm saying well again same [01:09:06.660 --> 01:09:12.260] series of events we're not talking about the same series of events if they were trying to [01:09:12.260 --> 01:09:20.100] charge you multiple times for the first ticket in the same way that argument would be the case [01:09:20.100 --> 01:09:25.220] but since they're charging you under two separate instances for two separate sets of facts and [01:09:25.220 --> 01:09:34.100] events that's not the same it's not double jeopardy okay and again double jeopardy also [01:09:34.100 --> 01:09:42.340] would come into play had you been already convicted of the first offense or already found not guilty [01:09:42.340 --> 01:09:46.740] of the first offense and then they came back and tried to go after you again with something new [01:09:46.740 --> 01:09:53.700] that too would be double jeopardy but only if it's from that same series of facts and events [01:09:53.700 --> 01:10:02.020] they're trying to charge you under well that answers that question well anyway i did several [01:10:02.020 --> 01:10:09.060] documents to notice of lack of jurisdiction i did a motion for the prosecutor to verify [01:10:09.060 --> 01:10:14.980] jurisdiction and then i mainly did my motion to dismiss for lack of subject matter jurisdiction and [01:10:16.420 --> 01:10:22.500] the judge did deny it he didn't give me enough time and oral arguments to respond to i got [01:10:22.500 --> 01:10:28.660] up to speak he only gave me 25 minutes i wanted more i only got like through a third of it but he [01:10:28.660 --> 01:10:34.100] wouldn't let me continue and then when the prosecutor spoke i just wanted five minutes to [01:10:34.100 --> 01:10:40.740] rebut his argument and he would not allow it so i made an objection on the record that that was a [01:10:40.740 --> 01:10:47.140] violation of due process because i i have a right to rebut the evidence um or so-called evidence [01:10:48.260 --> 01:10:53.540] but anyway he he denied it and he actually used one of my cases [01:10:53.540 --> 01:11:05.700] um to deny the um the motion that i had um given to the court it's like 20 pages i really thoroughly [01:11:06.260 --> 01:11:11.140] studied out like you've talked about you have to study the the statutes i did i studied the motor [01:11:11.140 --> 01:11:18.260] vehicle code i studied case law and one of the cases that he threw right back at me that said [01:11:18.260 --> 01:11:23.460] basically how he he summarized it he said well i don't argue with you that you have a right [01:11:23.460 --> 01:11:31.780] to travel but he said here's what you're not aware of he said because of the because of any he [01:11:31.780 --> 01:11:37.220] he worked it just like this the right to travel is subject to the rights of others and of reasonable [01:11:37.220 --> 01:11:43.940] regulation under law and then he quotes my own case that i quoted of the hundred versus maryland [01:11:43.940 --> 01:11:49.700] from 1950 and if you don't mind i'll read this real quick it says the state may rightfully [01:11:49.700 --> 01:11:56.100] prescribe uniform regulations necessary for public safety and order and respected operations upon [01:11:56.100 --> 01:12:01.940] its highways of all motor vehicles those moving and here's the key and interstate commerce but it [01:12:01.940 --> 01:12:09.060] does say as well as others right but their regulation is not talking about licensing [01:12:09.060 --> 01:12:15.220] registration and things that require permission what he said what regulation means in that instance [01:12:15.220 --> 01:12:23.780] when it comes to others is traffic lights stop signs general rules of the road that would cause [01:12:23.780 --> 01:12:30.340] injury if they're disobeyed like running that red light or that stop sign that's the regulation [01:12:30.340 --> 01:12:37.060] that's in play there not the licensing not the registration those two things have absolutely [01:12:37.060 --> 01:12:44.420] no impact whatsoever on public safety except in a commercial capacity and the reason for that is [01:12:44.420 --> 01:12:52.900] obvious on its face commercial drivers are taking much larger vehicles with much greater weight [01:12:54.020 --> 01:13:00.420] and traveling it on the road with the public if they're not specially trained and skilled [01:13:00.420 --> 01:13:06.500] in that privileged activity they comprise a threat to public health and welfare and to the [01:13:06.500 --> 01:13:12.740] safety of others that's why they have to be licensed that's why their vehicles have to be [01:13:12.740 --> 01:13:20.180] licensed but that regulation is completely different than signs and stop lights and things of that [01:13:20.180 --> 01:13:28.740] nature to direct the flow of traffic because a license in and of itself is permission to engage [01:13:28.740 --> 01:13:35.460] in some activity that's a regulation the state cannot impose upon the people's use of the road [01:13:35.460 --> 01:13:44.420] okay well i i believe that as well from what i've researched but he's twisting the law so he went [01:13:44.420 --> 01:13:49.140] on to well they've always twisted the law but that's something that you should have seen coming [01:13:50.100 --> 01:13:54.900] and addressed it beforehand the way i just did because that's exactly what it's talking about [01:13:55.620 --> 01:14:03.060] reasonable regulation in the context of that opinion which i've read is limited to signage [01:14:03.060 --> 01:14:11.140] for the flow of traffic when it gets to the commercial aspect then it can deal with licensing [01:14:11.140 --> 01:14:18.340] of the car and the driver or the operator what other case could i give that you aren't going [01:14:18.340 --> 01:14:24.740] to find one this is how they have managed to hide the things they've hidden you can find tons of [01:14:24.740 --> 01:14:32.420] cases that say it is the right of the people to use the roads okay yes there's a difference between [01:14:32.420 --> 01:14:38.340] regulating the exercise of a right for the safety of others and then converting that right into a [01:14:38.340 --> 01:14:44.740] privilege and selling it back to somebody in the form of a license those are completely different [01:14:44.740 --> 01:14:55.700] things so regulating cannot by the very definition of license include licensing because the definition [01:14:55.700 --> 01:15:03.860] of a license is to do that which would otherwise be illegal without the license correct if the [01:15:03.860 --> 01:15:10.420] people have a right to use the roads then their use can never be illegal unless they're using it [01:15:10.420 --> 01:15:16.900] in a way that's intentionally harmful to others and i've brought that up about the licensing [01:15:16.900 --> 01:15:22.900] and also the privilege taxes uh the privilege taxes i did that in oral arguments i proved that [01:15:22.900 --> 01:15:28.580] that the i even had a case that said the the elements of the definition of privilege mean [01:15:28.580 --> 01:15:33.860] occupation and business right so when it says that when you get a license that grants the [01:15:33.860 --> 01:15:39.460] privilege to drive it automatically has to be talking about some occupation or business or [01:15:39.460 --> 01:15:45.940] they can't put that under the privilege tax exactly and every and no one argues that i mean [01:15:45.940 --> 01:15:50.420] but here's what the prosecutors do and the judges rubber stamp it everything that you have that [01:15:50.420 --> 01:15:55.940] works in your favor they ignore and then they'll come up with one little one little case from the [01:15:55.940 --> 01:16:01.140] spring court in this case there's one other one from wyoming that says they have a right to [01:16:01.140 --> 01:16:06.260] you've got it right here the statutes enacted in various states requiring a license to drive or [01:16:06.260 --> 01:16:12.100] operate a motor vehicle upon the public highways are an exercise of the police power police power [01:16:12.900 --> 01:16:18.500] to regulate the use the highways in the interest of public safety and welfare again we're talking [01:16:18.500 --> 01:16:24.740] two different distinct areas of regulation which cannot include licensing [01:16:26.340 --> 01:16:33.940] because licensing is permission to engage in an activity a right is never a permission [01:16:36.260 --> 01:16:43.060] right i hear the music there all yeah so hang on order which he denied all my motions but he [01:20:40.980 --> 01:20:46.740] said this he said the defendants arguments that he is a traveler as opposed to a driver [01:20:46.740 --> 01:20:52.020] owner operator et cetera and that the Wyoming statutes do not apply to him or his activities [01:20:52.020 --> 01:20:57.380] are rejected the Wyoming statutes required to driver's license registration and insurance [01:20:57.380 --> 01:21:02.980] applied to him as a traveler as equal as they applied any other person driver owner operator [01:21:02.980 --> 01:21:09.620] licensee carrier et cetera which is just completely false then that would that would directly [01:21:09.620 --> 01:21:13.380] violate the single subject clause of the constitution of the state would it not [01:21:13.380 --> 01:21:22.100] uh well correct yeah i mean on all the motor vehicle bills but i mean how do you keep them [01:21:22.100 --> 01:21:27.060] how do you keep them accountable for that well you object to that conclusion of law by that [01:21:27.060 --> 01:21:31.780] and you appeal it that's how you have to do it how many times do i have to say this guys [01:21:31.780 --> 01:21:35.780] you're going to lose it trial because they're all incompetent [01:21:35.780 --> 01:21:43.780] no ifs and buts about this the only hope you have is to make a record that shows the judge [01:21:44.340 --> 01:21:50.660] committed judicial error by misinterpreting and misapplying the law and they did it in a way [01:21:50.660 --> 01:21:56.660] that violated both the law itself and the state constitution's prohibition on multiple subjects [01:21:56.660 --> 01:22:07.620] within the same bill so you're saying that he's saying that this is uh by applying to all that [01:22:07.620 --> 01:22:13.940] he's saying that that's violating the the one subject one bill but he can what does the legislative [01:22:13.940 --> 01:22:19.940] bill that originally created the current codification of the motor vehicle code say the [01:22:19.940 --> 01:22:27.380] subject matter is you know it only it only says the motor vehicles petty just it just has the [01:22:27.380 --> 01:22:33.860] title of motor that's what those statutes have what does the legislative bill have in its title [01:22:33.860 --> 01:22:40.420] where it says being enacted by the legislature of the state of what of whatever Wyoming right [01:22:41.700 --> 01:22:46.340] this is a recodification of existing law dealing with the subject of [01:22:46.340 --> 01:22:53.620] love never found that uh codification then you need to find the state law library and ask them [01:22:53.620 --> 01:22:59.620] because our damn sure is one we talked about it but it's all general see here here's part of the [01:22:59.620 --> 01:23:06.340] problem it can't be general if there's a single subject clause requirement in the state constitution [01:23:07.060 --> 01:23:14.900] if it is general then you've got an unconstitutional code argument i hear you but there was a [01:23:14.900 --> 01:23:21.220] supreme court case i think from 1939 to let him off the hook they said that it just has to cover [01:23:21.780 --> 01:23:28.100] the basic uh the basic elements of what's in the bill it don't have to be all clear in the title [01:23:28.100 --> 01:23:32.580] so they basically that was an unconstitutional ruling from the the Wyoming supreme court [01:23:34.260 --> 01:23:38.820] but i actually read that they said you know basically whatever's in the title will suffice [01:23:38.820 --> 01:23:44.260] they weren't concerned about it pretty much to paraphrase uh so they let him off the hook and that's [01:23:44.260 --> 01:23:50.260] why there's no single subjects where it'll say like you know this is the subject of transportation [01:23:50.260 --> 01:23:55.620] it just says the regulation of motor vehicles or registration of motor vehicles or whatever [01:23:55.620 --> 01:24:02.100] i mean it just has a general term i guarantee you there's something in there that proves that [01:24:02.100 --> 01:24:09.620] that is incorrect well i i haven't found it i mean a you know maybe i'm not looking in the [01:24:09.620 --> 01:24:16.020] right place granted but i studied a lot of the codes trying to look for it and i couldn't find it [01:24:18.820 --> 01:24:24.180] so that's part of my problem eddie but you know i'm not trying to you know sound like a victim [01:24:24.180 --> 01:24:30.180] here but i mean basically they're trying to browbeat me into submission uh judge threatened me with [01:24:30.180 --> 01:24:36.580] he said it could be possible 25 months and or $5,000 fine or i could take the prosecutors deal [01:24:36.580 --> 01:24:42.500] which basically in a nutshell says we'll pretty much drop everything including a six-month probation [01:24:42.500 --> 01:24:47.140] sentence if you go and get your license and show us registration and proof of insurance [01:24:47.700 --> 01:24:52.420] so basically they just want me to comply yeah that's what they always want [01:24:53.780 --> 01:25:01.620] yeah but this is why you have to make an appealable error case now do i do that before the jury [01:25:01.620 --> 01:25:06.660] trial because i i've held them up on that you have to use the trial to make the case for appealable [01:25:06.660 --> 01:25:12.500] error that the trial is all about the appeal it's no longer about your guilt or innocence it's no [01:25:12.500 --> 01:25:18.900] longer even about the law they don't care they're there for the money they're there for the power [01:25:18.900 --> 01:25:26.580] and the control over the people that ruling against you gives them right so you have to make an argument [01:25:26.580 --> 01:25:33.300] that will hold up on appeal where the higher court must do due diligence in researching the law [01:25:33.300 --> 01:25:40.660] above and beyond even what you did in order to disprove your position because they're doing the [01:25:40.660 --> 01:25:46.900] exact same thing in every state they are cherry picking specific pieces of the statute and never [01:25:46.900 --> 01:25:58.020] the law as a whole and everything boils down to what constitutes a single subject a carrier has [01:25:58.020 --> 01:26:05.380] absolutely nothing in common subject wise with a private individual nothing so how can they be [01:26:05.380 --> 01:26:15.620] within the same subject matter agreed i i know tell them that i mean you know i'm not i do tell [01:26:15.620 --> 01:26:22.500] them that that's exactly what i do well i'm glad somebody's having success with it because [01:26:22.500 --> 01:26:27.060] i mean i'm not saying i'm not having some success but i mean i don't think they would offer me that [01:26:27.060 --> 01:26:32.580] good a deal but but they but but they just see they just team they just keep going on no matter [01:26:32.580 --> 01:26:37.620] what you do they just keep bringing that's right and you have to expect that i've told people time [01:26:37.620 --> 01:26:42.420] and time again you're never ever going to short circuit this trial unless you catch them in an [01:26:42.420 --> 01:26:47.620] error that would get them disbarred or kicked off the bench that's the only way you're going to beat [01:26:47.620 --> 01:26:55.540] them at trial yeah well i'm going to keep if i can take it to trial see right now it's held up [01:26:55.540 --> 01:27:01.380] and actually it's the denial of the uh i was going to ask you this we've already gotten to the point [01:27:01.380 --> 01:27:07.380] where it's past the speedy trial because i'm over six months yeah but who's been requesting [01:27:07.380 --> 01:27:15.860] continuances well i have put a few continuances in the record yes okay then you don't have a claim [01:27:15.860 --> 01:27:22.020] with speedy trial unless the last time you asked for a continuance and it expired has been longer [01:27:22.020 --> 01:27:28.340] than the statute of limitations that would violate speedy trial i don't i don't get that so when you [01:27:28.340 --> 01:27:35.380] ask for a genuine let's say you ask for a continuance the first time of 30 days okay you can try to file an appeal of his decision [01:34:41.220 --> 01:34:50.180] yeah that's called an interlockatory appeal yeah and they can be used in criminal cases [01:34:50.180 --> 01:34:59.380] though they're not always accepted right and that will stop the process and no or correct [01:34:59.380 --> 01:35:06.580] no what they'll likely do is pause it while the interlockatory appeal is pending but it's not a [01:35:06.580 --> 01:35:14.420] requirement that it's stopped because even if even if they convicted you in the court above [01:35:14.420 --> 01:35:19.860] that you're doing the appeal with turns around says no the judge got it wrong then the curious [01:35:19.860 --> 01:35:27.940] is they can vacate the findings of the court of the for the trial okay so it may not stop the [01:35:27.940 --> 01:35:34.020] proceedings it may delay them or it may stop them until they get an answer back but it won't [01:35:34.020 --> 01:35:40.020] necessarily stop them at all they could proceed forward until the appeal gets answered or whatever [01:35:40.020 --> 01:35:44.180] usually they stop but that's in civil cases who knows what they're going to do in a criminal case [01:35:45.540 --> 01:35:51.540] the only thing is what if the because we found the appellate courts here to on these traffic [01:35:51.540 --> 01:35:57.540] cases to like the rubber stamp the trial court so what if they well the question here is is can you [01:35:57.540 --> 01:36:03.140] raise an argument that would make them take notice in such a way that rubber stamping is no longer say uh that the department of uh the motor vehicle [01:37:45.780 --> 01:37:53.540] driver's licensing and registration uh were transportation related uh i did find that yeah [01:37:53.540 --> 01:37:59.700] but now you've got to make the argument about what transportation is and most likely no state that [01:37:59.700 --> 01:38:08.260] i've seen short of the ones that actually contain the word transportation uh in the bill uh or in [01:38:08.260 --> 01:38:16.180] the actual statute has ever defined it they all use it but they never define it and that's where [01:38:16.180 --> 01:38:21.380] you're going to have to do your research on other law this is why i keep saying you have to prove a [01:38:21.380 --> 01:38:28.500] relationship between the state law and title 49 of the federal code united states code title 49 [01:38:28.500 --> 01:38:34.340] you prove that the that your state police agency and the code they supervise which will be your [01:38:34.340 --> 01:38:39.380] motor vehicle code uh and that they in the department of transportation or libel for [01:38:40.020 --> 01:38:45.940] falls under the guise of the statutes that are federal law and you've got your link that proves [01:38:45.940 --> 01:38:52.340] it's commercial related and it can't be anything else because that's the only way this the fed [01:38:52.340 --> 01:39:00.980] can reach into the state is through the commerce clause and while the state can create laws of [01:39:00.980 --> 01:39:06.580] its own to do certain things what it cannot do is use those laws to take away an original right [01:39:08.020 --> 01:39:13.780] and our right of property our right to acquire that property our right to use that property [01:39:13.780 --> 01:39:20.020] on our roads that we have every right to be upon cannot be taken away by an edict of the legislature [01:39:20.740 --> 01:39:26.420] it cannot be diminished by an edict of the legislature yeah they can regulate it through [01:39:26.420 --> 01:39:32.260] the use of signs and such but they cannot convert it into a privilege that requires the issuance of [01:39:32.260 --> 01:39:39.860] a license to effectively perform it we cannot engage in the right without state permission [01:39:39.860 --> 01:39:46.500] via the license therefore your interpretation of the statute is completely incorrect the only [01:39:46.500 --> 01:39:52.340] thing i could come up with there was something from the corpus jurist that said that the corpus [01:39:52.340 --> 01:40:00.500] jurist is not authoritative it also contains basically a synopsis of the case it's not the actual [01:40:00.500 --> 01:40:09.140] opinion okay all right it is you cannot cite the corpus jurist or any any other legal encyclopedia [01:40:09.140 --> 01:40:15.780] as the source of authority you're basing this on you've got to cite cases so you can't use those [01:40:16.740 --> 01:40:20.260] you can use them to do the research on the cases that they're talking about [01:40:20.260 --> 01:40:26.340] out to see how you can use that case to make that same argument but you have to cite the case [01:40:26.340 --> 01:40:33.220] not the corpus jurist i see i see well i made that mistake then because i was just citing that as [01:40:33.220 --> 01:40:40.580] a legal authority um i did sometimes mention the case yes but i i mentioned the cj you can cite it [01:40:41.220 --> 01:40:46.500] saying this is how the corpus jury summarized the following cases dealing with the issue of [01:40:46.500 --> 01:40:52.340] love and then you go into the specific parts uh what do i do from here do i put an objection [01:41:11.060 --> 01:41:15.380] to his ruling in the record because i'm always doing written objection you file the interlockupory [01:41:15.380 --> 01:41:20.740] and see if they'll take it that's your first thing but yeah you object to everything but you're going [01:41:20.740 --> 01:41:25.860] to do it in the form of the interlockupory but make sure you've got all your information and [01:41:25.860 --> 01:41:31.220] ducks in a row when you do it because that's going to be extremely important well they're [01:41:31.220 --> 01:41:35.780] waiting there's wait to see if i take this deal and i told the prosecutor i was uh taking that [01:41:35.780 --> 01:41:41.620] under advisement and then i also i got time because the spring court here won't allow them to do [01:41:41.620 --> 01:41:48.340] juries because of the covid so we're kind of at a standstill it it well they can't incarcerate you [01:41:48.340 --> 01:41:53.860] without a jury trial any judgment they get against you that involves incarceration and [01:41:53.860 --> 01:42:00.500] you didn't have a jury that's completely illegal and there is a ton of united states supreme court [01:42:00.500 --> 01:42:06.820] case law that says that well i haven't done that i mean they haven't done that but i am on bond which [01:42:06.820 --> 01:42:12.580] means i i you know i'm not the same thing without getting no i understand but it does [01:42:12.580 --> 01:42:19.860] affect me from getting around uh you know so um uh you know i'm not going to comment on that too [01:42:19.860 --> 01:42:26.820] much but um i do i don't know what to do it says you think the interlockupory appeal is the thing [01:42:26.820 --> 01:42:35.700] to do from here so i think it's a step you don't want to not do just in case okay if they take it [01:42:35.700 --> 01:42:41.780] file like the regular appeal except i'll file on his decision of that order basically right it's [01:48:08.820 --> 01:48:15.460] me well just because he's a retired judge doesn't mean you were in a judicial proceeding if he did [01:48:15.460 --> 01:48:19.940] exactly the same thing in the same way that the commissioner would have done he was acting as a [01:48:19.940 --> 01:48:26.740] commissioner not as a judge well that's what i i read about the commissioners and what they're [01:48:26.740 --> 01:48:33.140] and the retired judges they're limited in their scope they can't even hear a criminal case [01:48:33.140 --> 01:48:38.660] but that commissioner told me when i asked her the question is this civil or criminal [01:48:39.300 --> 01:48:45.380] she he harmed around and finally said it's criminal right which means she's incompetent [01:48:45.380 --> 01:48:53.220] because it's not in state law and the state courts have said it's not there in california [01:48:53.220 --> 01:48:59.700] uh that it's not criminal it's an infraction and they are nowhere near the same thing at all [01:49:00.980 --> 01:49:06.420] so she's incompetent to even sit in that position and do what she's doing and now you've got a [01:49:06.420 --> 01:49:12.580] retired judge doing i put that in the appeal the criminal complaint no you file the [01:50:09.540 --> 01:50:15.220] criminal complaints with whatever committee is responsible for these commissioners and i can
