[01:24.720 --> 01:28.440] Margaret Moore, the Travis County District Attorney, announced earlier this month that [01:28.440 --> 01:33.040] she was dismissing 32 felony possession and delivery of marijuana cases because of the [01:33.040 --> 01:34.040] law. [01:34.040 --> 01:37.600] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.600 --> 01:42.080] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.080 --> 01:48.240] in Texas and that these actions demonstrate a misunderstanding of how HB1325 works, as [01:48.240 --> 01:51.200] well as other cities too like the District Attorney. [01:51.200 --> 01:57.280] In El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law quote [01:57.280 --> 02:01.840] will not have an effect on the prosecution of marijuana cases in El Paso. [02:01.840 --> 02:06.720] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.720 --> 02:11.200] in Harris County who stated that quote, the law is constantly changing on what makes something [02:11.200 --> 02:13.480] illegal based on its chemical makeup. [02:13.480 --> 02:17.320] It's important that if someone is charged with something, the test matches what they're [02:17.320 --> 02:22.560] charged with. talking [04:13.560 --> 04:25.320] about something I'm working on, I'm building a lawsuit against the governor and I'm kind [04:25.320 --> 04:34.480] of following the prescription I have in legal 101, the first thing I did was went and searched [04:34.480 --> 04:50.720] out the causes of action for a claim under 18 U.S. code, I'm sorry, 42 U.S. code 1983, [04:50.720 --> 04:57.440] that's the civil side of the Ku Klux Klan Act, and it was about, I had two of them, each [04:57.440 --> 05:05.040] one of them are 500 pages, and I'm getting them combined and got them broken down to [05:05.040 --> 05:13.760] about 40 pages at this point, but when you file a suit or if you're writing a motion [05:13.760 --> 05:21.520] in a criminal case or any other kind of case, before you do anything, you need to get the [05:21.520 --> 05:32.480] standard jury charge and see what the judge is going to say to the jury, the last thing [05:32.480 --> 05:41.480] before he sends them in to deliberate, and what the jury charge starts with is this is [05:41.480 --> 05:53.080] what you must find, if what you want to argue is not in that list, don't argue it, it doesn't [05:53.080 --> 06:03.600] apply to the case, you only argue what is in the pattern jury charge and you argue everything [06:03.600 --> 06:10.440] that is in the pattern jury charge, you miss one thing, you lose your case, so first thing [06:10.440 --> 06:16.160] to do is pattern jury charge, okay I've got through that and then going through the pattern [06:16.160 --> 06:25.800] jury charge, it told me what issues to go after, and the way to go after the governor [06:25.800 --> 06:32.360] in this case is to go after him in his personal capacity, because that's the only way you [06:32.360 --> 06:37.400] can actually go after him, because you're the governor in his official capacity, because [06:37.400 --> 06:44.880] in that case you're suing the state and the state maintains sovereign immunity, so the [06:44.880 --> 06:52.280] only way to get to him is to go after him personally, but in order to do that we have [06:52.280 --> 07:00.680] to be able to get to him personally, so I backed up and looked at what he's doing and [07:00.680 --> 07:12.640] from the perspective of how can we craft his behavior in terms of criminal acts, well that [07:12.640 --> 07:21.320] was the path of research that I was set on, so I pulled down all of the executive orders [07:21.320 --> 07:32.000] the governor has signed, and during his tenure he has signed 31 executive orders, he signed [07:32.000 --> 07:43.640] one in 2016, I think two in 17, one in 18, and the rest of them have been this year, [07:43.640 --> 07:53.520] and in going through those I found muy muy problems, I am a little bit concerned that [07:53.520 --> 08:04.080] we live in a state with 25 million people in the state of Texas, and the governor starts [08:04.080 --> 08:15.880] issuing these executive orders, the first thing he did, well this was before the Colvoy [08:15.880 --> 08:32.840] issue, the legislature closed signed die on May the 27th of 2016, and the governor found [08:32.840 --> 08:46.400] that, not coming back, yes anything that hasn't been signed dies, so if you want it you have [08:46.400 --> 08:55.800] to come to the next section, well I have my date off, this is 2019 July, this is later [08:55.800 --> 09:07.280] than I thought, okay on the 13th day of July 2019, the governor issued this executive order [09:07.280 --> 09:15.720] relating to necessary assistance from qualified plumbers with disaster recovery and preparedness, [09:15.720 --> 09:25.720] and the spending section 1301.003 Texas Occupations Code to prevent the imminent evolution of [09:25.720 --> 09:32.240] the Texas State Board of Plumbing Examiners and exploration of the plumbing license law [09:32.240 --> 09:40.520] on September 1, 2019, and delaying the abolition and exploration until disaster needs subside [09:40.520 --> 09:50.360] or the 87th legislature addresses the matter, okay that sounds reasonable enough on its [09:50.360 --> 10:00.760] surface, but when you look closer, what he actually did, he stated, by virtue of the [10:00.760 --> 10:13.320] power and authority vested in me by the Constitution and Texas Disaster Act of 1975, I do hereby [10:13.320 --> 10:23.520] suspend section 1301.003 of the Texas Occupations Code to prevent the imminent evolution of [10:23.520 --> 10:27.840] the Texas Board of Plumbing and the exploration of the plumbing license law, you see we have [10:27.840 --> 10:35.840] sunset provisions in Texas, offices have to be renewed I believe every five years, if [10:35.840 --> 10:44.320] they're not renewed then they're abolished, well this was about to happen to the plumbers, [10:44.320 --> 10:54.480] and I guess the governor felt like the legislature just missed that part, and he had to fix [10:54.480 --> 11:04.760] their error, well there's a problem with that, Texas Constitution, Bill of Rights section [11:04.760 --> 11:17.720] 28, it's titled suspension of laws, no power of suspending laws in this state shall be [11:17.720 --> 11:30.640] exercised except by the legislature, what part of that is hard to understand, just where [11:30.640 --> 11:37.800] did the governor manage to get this power, he states by virtue of the power and authority [11:37.800 --> 11:44.200] vested in me by the Texas Constitution and the Texas Disaster Act, well in fact the [11:44.200 --> 11:58.040] Texas Disaster Act of 1975 does authorize the governor to suspend laws, well big deal, [11:58.040 --> 12:08.680] we don't care what it says because the Constitution is the supreme law of the state of Texas, [12:08.680 --> 12:16.320] not the Texas Disaster Act, what was this Texas Disaster Act based on at that time when [12:16.320 --> 12:22.120] he said that he had that authority, what was the disaster, the plumbers were about to lose [12:22.120 --> 12:30.000] the licensing authority, I think Hurricane Harvey I believe it was, it flooded Houston, [12:30.000 --> 12:38.840] it was based on that disaster, how is that related to licenses, that's a good point, [12:38.840 --> 12:45.440] I mean he didn't outlaw parakeets or anything, I mean why would he say that they need to [12:45.440 --> 12:52.520] have a licensing authority for them, because the legislature screwed up, they forgot to [12:52.520 --> 13:00.440] renew them and needed the governor to fix it, the problem is is they had, he did this [13:00.440 --> 13:12.320] in September, I'm sorry July 2019, but the legislature had just closed two weeks before, [13:12.320 --> 13:24.560] so he had the option under the Texas Constitution, Article 4, Section 8, 7 through 15 lists the [13:24.560 --> 13:33.360] powers that the governor has, Section 8, convening legislature on extraordinary occasions, [13:33.360 --> 13:38.760] the governor may on extraordinary occasions convene the legislature at the seat of government [13:38.760 --> 13:44.320] or at a different place in case that should be in the possession of a public enemy or [13:44.320 --> 13:53.080] in case of the prevalence of a disease threat, his proclamation therefore shall state specifically [13:53.080 --> 14:02.240] the purpose for which the legislature is convened, now he could have done that, but he didn't, [14:02.240 --> 14:09.280] and he could have done that and then under Section 11, Section 9, he shall from time [14:09.280 --> 14:16.200] to time give the legislature information in writing of the condition of the state and [14:16.200 --> 14:23.080] recommend to their consideration such measures as he may deem expedient, or he could have [14:23.080 --> 14:31.760] recommended that they fix this plumbing issue, that's the only option he had, yeah that [14:31.760 --> 14:37.160] would have been constitutional, it would have been legal, so the question becomes why didn't [14:37.160 --> 14:43.920] he, they'd only been out two weeks, I mean from the most part all of the legislatures [14:43.920 --> 14:50.880] were still relatively available, but he chose not to do that, well here's the problem with [14:50.880 --> 15:08.280] that, back to after Section 28, Texas Constitution, I need to read you the very next provision [15:08.280 --> 15:17.200] in the Texas Constitution, which is Section 29, and I'm scrolling down to find it, where [15:17.200 --> 15:26.000] to go, where to go, where to go, Section 29, bill of rights accepted from powers of government [15:26.000 --> 15:35.320] and in violent, this is one of the best paragraphs I have seen in any constitution anywhere, actually [15:35.320 --> 15:42.480] it's a one sentence paragraph, now if you wonder why they passed 28, no power of suspending [15:42.480 --> 15:48.080] laws in this state shall be exercised except for the legislature, this is why they did [15:48.080 --> 15:57.960] it, to guard against transgressions of the high powers herein delegated, the governor [15:57.960 --> 16:07.200] is that high power, the governor is the highest level official in the states, to guard against [16:07.200 --> 16:14.760] transgressions of the high powers herein delegated, we declare that everything in this bill of [16:14.760 --> 16:22.360] rights is accepted out of the general powers of government and shall forever remain in [16:22.360 --> 16:32.880] violent and all laws contrary there too, or to the following provisions shall be void, [16:32.880 --> 16:41.680] the legislature did not, I'm sorry, our founders did not [20:02.920 --> 20:08.080] If they intended to launch something like this, they launched it too soon. [20:08.080 --> 20:14.760] I'm sure that they never imagined that Trump would get into office. [20:14.760 --> 20:22.360] And in order for this if it was a pandemic to work, they would have had to have had a [20:22.360 --> 20:25.560] president in their pocket. [20:25.560 --> 20:30.920] And for the most part, from what I see going on, it wouldn't have mattered if it was a [20:30.920 --> 20:39.320] Democrat or Republican president so long as it was a Trump. [20:39.320 --> 20:44.000] Because it's my opinion that the Democrats and Republicans at the end of the day have [20:44.000 --> 20:47.680] their snouts in the same troughs. [20:47.680 --> 20:52.680] And Trump may have his snout in somebody's trough, but it's not the ones the Democrats [20:52.680 --> 20:55.840] and Republicans got theirs in. [20:55.840 --> 20:58.240] He's got his own. [20:58.240 --> 20:59.240] Exactly. [20:59.240 --> 21:06.200] So it created a problem for them and they launched it anyway if that's what happened. [21:09.200 --> 21:15.960] And from Trump's perspective, the timing was perfect because they launched this thing [21:15.960 --> 21:23.040] and it's pretty well out there that the big spike in COVID deaths was because in New [21:23.040 --> 21:30.320] York they pushed infected people into old folks homes, the most vulnerable population [21:30.320 --> 21:34.600] and the infection rate exploded there. [21:34.600 --> 21:42.760] And the numbers spiked in March and then after March they dropped down to less than [21:42.760 --> 21:45.360] 10%. [21:45.360 --> 21:49.840] And the number of infections have been varying since then, but the number of deaths had not [21:49.840 --> 21:50.840] increased. [21:50.840 --> 22:00.800] And there's a lot of talk about a second wave, but they already knew that in SARS and in [22:00.800 --> 22:12.280] post-apig virus, the one before, swine flu, they were similar type novel viruses and they [22:12.280 --> 22:15.240] did not have a second wave. [22:15.240 --> 22:17.280] And they're not expecting this. [22:17.280 --> 22:26.040] The ones you know what's going on are not expecting a second wave from COVID-19 either. [22:26.040 --> 22:33.680] But they're touting the number of infections and ignoring the number of deaths so as to [22:33.680 --> 22:38.160] make it look like there's a second wave and it's not happening. [22:38.160 --> 22:42.440] But anyway, they did it too soon, they got the public woke up. [22:42.440 --> 22:47.560] So how do we use this to our advantage? [22:47.560 --> 22:52.640] And the way I'm trying to use it to our advantage is we take all of these people who have been [22:52.640 --> 23:01.960] harmed by these measures that were instituted by FIAT through proclamation and edict by [23:01.960 --> 23:10.520] governors and we cram it right down that governor's throat. [23:10.520 --> 23:21.800] I'm designing a lawsuit, not a class action lawsuit, heck with that, but an individual [23:21.800 --> 23:29.440] lawsuit and I will, once I have the suit crafted, I'll put it online with a questionnaire [23:29.440 --> 23:36.760] that will populate the lawsuit with an individual's particular facts and circumstances and then [23:36.760 --> 23:40.800] spit out the lawsuit, all they got to do is sign it and send it. [23:40.800 --> 23:48.480] And that will include a petition for inability to pay. [23:48.480 --> 23:54.760] And it will soothe the governor personally in the federal courts. [23:54.760 --> 23:55.760] Let's dance. [23:55.760 --> 24:02.680] If we can get several thousand lawsuits against the governor personally, this will tell the [24:02.680 --> 24:05.600] governors around the state, around the country. [24:05.600 --> 24:10.080] You guys want to dance with your authority and play little games with it? [24:10.080 --> 24:13.040] We see how that works out for you. [24:13.040 --> 24:25.920] So as the economy continues to collapse around us, these issues will get even more pertinent. [24:25.920 --> 24:29.400] And so I want to have this thing ready. [24:29.400 --> 24:35.840] I'm hoping to have the criminal complaint ready to bring to Austin next week and I'm [24:35.840 --> 24:41.160] going to file it with the Chief Justice of the Supreme. [24:41.160 --> 24:49.480] The Chief Justice of the Supreme told Woodfill in the Hotsie suit where he got snookered [24:49.480 --> 24:57.320] by the governor, you know, Deborah told us about that and I read the suit. [24:57.320 --> 25:04.880] And the governor complained in the original suit that he didn't file correctly, he should [25:04.880 --> 25:11.120] have filed for a petition for declaratory judgment, I'm sorry, a petition for restraining [25:11.120 --> 25:13.280] order. [25:13.280 --> 25:19.400] And Woodfill bought that story, dropped his suit, petitioned for restraining order because [25:19.400 --> 25:22.240] that would move much quicker, much more quickly. [25:22.240 --> 25:23.240] And he did. [25:23.240 --> 25:28.280] It moved straight to the Supreme Court very quickly and the Supreme Court said, we are [25:28.280 --> 25:36.760] allowed to issue restraining orders against any official in the state of Texas except [25:36.760 --> 25:38.080] the governor. [25:38.080 --> 25:45.080] Didn't you read that, you moron, for crying out loud, what kind of lawyer does something [25:45.080 --> 25:47.320] like that? [25:47.320 --> 25:57.000] But that's what the Supreme told him, that you're white, the governor is overreaching. [25:57.000 --> 26:02.320] But we can't help you because you use the wrong vehicle, essentially telling them bring [26:02.320 --> 26:07.440] us back to us in a vehicle we can use and we will move on it. [26:07.440 --> 26:12.400] So I'm going to take the Supreme Court up on that, I'm going to bring them a vehicle [26:12.400 --> 26:17.480] they can use, I'm going to bring them criminal accusations. [26:17.480 --> 26:21.440] I was hoping I could get to sedition but I can't. [26:21.440 --> 26:31.200] This first criminal accusation over the plumbing thing has nothing to do with this pandemic, [26:31.200 --> 26:37.160] just has to do with the governor assuming that the legislature screwed up and they [26:37.160 --> 26:39.880] needed the governor to fix it. [26:39.880 --> 26:42.640] Well, good luck with that. [26:42.640 --> 26:48.840] The way I read the codes, if you commit an act of abuse of office, abuse of official [26:48.840 --> 26:57.440] capacity 39.02, a public servant commits an offense if with intent to obtain a benefit [26:57.440 --> 27:00.600] or with intent to harm or defraud another. [27:00.600 --> 27:02.800] I maintain that. [27:02.800 --> 27:14.160] The governor issued this order in order to gain good favor with the plumber's unions. [27:14.160 --> 27:27.160] And in doing that, the plumber, by blocking these agencies from being abolished, he costs [27:27.160 --> 27:36.920] the taxpayers an amount in excess of $300,000, so it would clearly take more than that to [27:36.920 --> 27:39.880] support these agencies. [27:39.880 --> 27:58.560] And what 39.02, Section C, an offense under Section A2, is misuses government property [27:58.560 --> 28:04.240] services, Crescendo or any other thing of value, well, he misused government services [28:04.240 --> 28:10.280] by retaining the services when it should be abolished. [28:10.280 --> 28:18.160] And if he does that and the value of the thing misused is over $300,000, that is a felony [28:18.160 --> 28:22.440] of the first degree in the state of Texas. [28:22.440 --> 28:27.320] So good luck, governor, we'll see how this works out for you. [28:27.320 --> 28:32.160] And this is what I'm saying is because we think the governor's a bad guy, he may be [28:32.160 --> 28:36.520] a bad guy, he may be a good guy, that's not relevant. [28:36.520 --> 28:46.280] We're not saying this because we think what he did was a bad idea of maintaining the plumber's [28:46.280 --> 28:52.280] licensing commission, and that might be a good idea, that's not relevant either. [28:52.280 --> 29:02.400] We're saying this because the Constitution specifically forbade him from doing this. [29:02.400 --> 29:08.640] And then when we move on from that one, we get to others that are much uglier. [29:08.640 --> 29:19.480] The next one, see, this is, oh, he did a disaster declaration on the 13th day of March. [29:19.480 --> 29:30.760] On the 13th day of March, he did a disaster declaration, and he said, down to, now therefore [29:30.760 --> 29:36.840] I, Greg Abbott, governor of the state of Texas, do hereby certify the COVID-19 poses a imminent [29:36.840 --> 29:42.200] threat of disaster at an imminent threat of running off the cliff. [34:27.180 --> 34:36.860] But I can find nothing in the enumerated powers of the governor that are in article, [34:36.860 --> 34:43.900] Texas Constitution, Article 4, Section 8. [34:43.900 --> 34:49.860] And it is Section 8 through 15. [34:49.860 --> 34:54.860] Those lists of things the governor can do. [34:54.860 --> 35:09.820] None of those things go to anything that would in any way directly affect a private citizen. [35:09.820 --> 35:19.460] He is the chief executive of the state and he is the executive over state agencies. [35:19.460 --> 35:25.940] He has no power over the public in general, zero. [35:25.940 --> 35:37.140] And for him to attempt to exert power over the individual is an attempt to exert or purport to exert an authority he does not expressly have. [35:37.140 --> 35:42.660] And in the process to not assist in full and free access to or enjoyment of a right. [35:42.660 --> 35:45.820] And that's a crime in every state. [35:45.820 --> 36:01.060] What I'm going to say about this is while other states may not have the exact same provisions written in the exact same way as Texas does. [36:01.060 --> 36:09.300] There is a overriding consideration and one I talk about on occasion and I probably make Christians bristle. [36:09.300 --> 36:14.940] But I don't mean to when I say that if God created man. [36:14.940 --> 36:18.980] He created us horribly flawed. [36:18.980 --> 36:23.580] I think he did that on purpose because if we were perfect, what would be the point? [36:23.580 --> 36:30.500] How would we grow and get closer to God if we were already perfect? [36:30.500 --> 36:33.260] So he made us flawed. [36:33.260 --> 36:38.140] But he made us consistently flawed. [36:38.140 --> 36:43.460] No matter what country you go to, no matter what state you go to. [36:43.460 --> 36:57.580] People have the same flaws and we need essentially the same laws to protect ourselves from ourselves and from our neighbors and from everyone else. [36:57.580 --> 37:02.780] So everyone everywhere is essentially flawed the same. [37:02.780 --> 37:08.140] And what you will find is that no matter where you go on the planet. [37:08.140 --> 37:22.180] You will find there are laws and 95% of those laws are all essentially the same slight variations based on political views. [37:22.180 --> 37:29.820] But those laws that go to civility and the human condition are all the same. [37:29.820 --> 37:39.420] The left turn in the Sudan is the same as the left turn in the United States or anywhere else. [37:39.420 --> 37:51.180] So point is what I'm finding here in Texas is going to be essentially the same in every state. [37:51.180 --> 37:58.140] Governors are not intended to rule over the people, not in any state I've ever looked at. [37:58.140 --> 38:05.300] The president of the United States is not empowered to rule over the people. [38:05.300 --> 38:08.700] He rules over state agencies. [38:08.700 --> 38:10.540] They're all essentially the same. [38:10.540 --> 38:14.540] If you're in a different state, you'll find the same conditions. [38:14.540 --> 38:22.580] So I am frustrated that I live in a state with 25 million people. [38:22.580 --> 38:27.740] And no one else has taken the governor to legal task for his criminal behavior. [38:27.740 --> 38:35.780] I listened to Ron Paul on his radio broadcast, he has a radio podcast. [38:35.780 --> 38:43.500] And he's arguing about the reasonableness of these executive orders. [38:43.500 --> 38:45.860] And I'm listening to this and I'm frustrated. [38:45.860 --> 38:50.820] I'm saying, Ron, you're down the rabbit hole. [38:50.820 --> 38:52.940] Yeah, that's beside the point. [38:52.940 --> 38:55.740] Yeah, who cares? [38:55.740 --> 39:01.900] Point is, he can't do them in the first place. [39:01.900 --> 39:05.460] I've been having some voice issues lately. [39:05.460 --> 39:08.900] So I'm going to take them on. [39:08.900 --> 39:18.860] I'm hoping that by the end of this week, by Monday, I will have my complaints ready. [39:18.860 --> 39:25.380] I'm going to file them with the Chief Justice of the Supreme. [39:25.380 --> 39:36.460] And what I'm going to try to do is come to the statehouse and put it in the hand of the Chief Justice or his clerk. [39:36.460 --> 39:40.460] Rather than send it through the mail and do all these other song and dance, [39:40.460 --> 39:44.820] I'll take it to the clerk and put it in the clerk's hand. [39:44.820 --> 39:54.780] So that when I don't get a timely response, then I'll take criminal charges against the Chief Justice to the State Attorney General. [39:54.780 --> 39:59.940] And the State Attorney General is going to do this song and dance and celtic down your pants. [39:59.940 --> 40:03.900] Paxton's going to try to send me to the District Attorney. [40:03.900 --> 40:08.140] And now, at home, he's not going to play that. [40:08.140 --> 40:20.900] Under 39.03, the District Attorney General has concurrent jurisdiction with prosecuting attorneys. [40:20.900 --> 40:26.780] This is a recent addition to the penal code. [40:26.780 --> 40:28.460] So then I go to Paxton. [40:28.460 --> 40:35.820] And when he refuses to petition the grand jury to indict the governor, [40:35.820 --> 40:38.260] then I go to the District Attorney. [40:38.260 --> 40:42.460] And when he refuses, then I go to the fence. [40:42.460 --> 40:50.820] So I have to, I'm going to set it up so I could show that I've exercised all remedy in the state. [40:50.820 --> 40:53.820] Before I take them all to the Fed criminally. [40:53.820 --> 41:00.100] Now, whether or not we get anyone indicted is not so important. [41:00.100 --> 41:05.820] What is important is that we make a whole lot of grand jury noises. [41:05.820 --> 41:09.140] And now we have the governor sitting here. [41:09.140 --> 41:20.020] And I'm doing to the governor what I did to the Court of Criminal Appeals when Ron Earl, 25-year District Attorney, was retiring. [41:20.020 --> 41:30.020] I gave him cannon fodder that he could use to try to take out all nine of those judges with him by filing criminal charges against him. [41:30.020 --> 41:36.140] But the criminal charges I filed against those guys was really nitpicking, minor stuff. [41:36.140 --> 41:43.460] Here I will be charging the governor with depraved heart murder. [41:43.460 --> 41:58.180] In that, a statistic I got on Ron Paul's show was that on the order of 10,000 people have died from diabetes alone, from conditions that were treatable. [41:58.180 --> 42:05.860] But these people didn't go to the hospitals because they weren't, they didn't know their condition was treatable. [42:05.860 --> 42:10.620] Or what they didn't know their condition was life threatening. [42:10.620 --> 42:19.140] And the governor had threatened to have them arrested if they went to the hospital with a condition that wasn't life threatening. [42:19.140 --> 42:20.900] So they wound up dying. [42:20.900 --> 42:27.580] So the governor took it upon himself to decide which group of people died. [42:27.580 --> 42:35.060] Well, COVID-19 is in the news and it potentially affects all of his voters. [42:35.060 --> 42:46.380] So that's the popular item, so he went after that one to give this ordinary citizen reason to vote for him. [42:46.380 --> 42:54.620] And all of these other people with chronic conditions, their lives were not as important. [42:54.620 --> 43:01.420] And he committed criminal acts in denying them access to the hospitals. [43:01.420 --> 43:09.300] According to Ron Paul's show, 5% of the hospital space is being taken up by COVID patients. [43:09.300 --> 43:18.140] But the governor has restricted the hospitals to 25% occupancy. [43:18.140 --> 43:30.940] So the hospitals are 75% interest empty to make room for 5% occupancy of COVID patients and people are dying as a result. [43:30.940 --> 43:33.700] That's to pray a tart murder. [43:33.700 --> 43:38.740] And that I would have charged with at least 10,000 times. [48:38.460 --> 48:54.460] So, what we'll do is we'll raise a large claim, hammer them a while, bar-grieve their lawyers into the Stone Age, reduce or conduct the complaints to the judge until they vomit, [48:54.460 --> 48:58.460] and then ask the judge to order mediation. [48:58.460 --> 49:14.460] And in this way, the governor can then make a deal with the individual, and whatever that payment is, won't have to come from a special allocation. [49:14.460 --> 49:20.460] You won't have to get the legislature to approve these funds, they'll come out of the general fund. [49:20.460 --> 49:30.460] So, he can help people recover from the damage he did, pull it out of the general fund without special legislation, [49:30.460 --> 49:46.460] but in the process take the risk of losing everything himself if we can raise an objection to the state indemnifying the governor for his criminal behavior. [49:46.460 --> 49:52.460] Because criminal behavior cannot be construed to be within the scope. [49:52.460 --> 50:00.460] Anything he does within scope, he has the official immunity for. [50:00.460 --> 50:11.460] So, we're going to say it would be improper for the taxpayers to cover the cost of the governor's illegal behavior after we have already forbidden him to do that. [50:11.460 --> 50:14.460] I'm trying to send up a message. [50:14.460 --> 50:17.460] That's very well put. [50:17.460 --> 50:27.460] If you're a public official and you want to play fast and loose with our laws, we'll come straight for your throat. [50:27.460 --> 50:31.460] What do you think, Brett? [50:35.460 --> 50:46.460] He doesn't have the authority to do that, so if he wants to play that game, he's going to have to answer for it. [50:52.460 --> 51:01.460] You and I, the ordinary individual, I have a section in there where one of his executive orders, [51:01.460 --> 51:10.460] I maintain that this executive order, as it applied to a governmental agency, [51:10.460 --> 51:19.460] and created groups within that agency to investigate and do certain things, [51:19.460 --> 51:25.460] was exactly within the scope with the legislative power. [51:25.460 --> 51:33.460] And then I put in that, yeah, I know the question you're thinking, who the heck do I think I am to make that proclamation, [51:33.460 --> 51:37.460] or that determination that this is correct? [51:37.460 --> 51:39.460] Well, this is who I am. [51:39.460 --> 51:41.460] I am a father. [51:41.460 --> 51:43.460] I'm a grandfather. [51:43.460 --> 51:46.460] I'm a husband these last 50 years. [51:46.460 --> 51:49.460] I am a business owner. [51:49.460 --> 51:52.460] I'm a veteran. [51:52.460 --> 52:00.460] And I swore on my oath that I would protect this country from all enemies, foreign and domestic, [52:00.460 --> 52:03.460] when I was mustered out of the military. [52:03.460 --> 52:11.460] I was, had it made known to me that I was not released from that oath, it was a lifetime oath. [52:11.460 --> 52:13.460] I found an enemy. [52:13.460 --> 52:15.460] He is a domestic enemy. [52:15.460 --> 52:17.460] And the fight is on. [52:17.460 --> 52:23.460] Beyond that, I am a citizen in this republic. [52:23.460 --> 52:34.460] And that makes me the last bastion against the abuse of my laws and my constitution. [52:34.460 --> 52:38.460] This is, these are not our laws and our constitutions. [52:38.460 --> 52:47.460] They are my laws and my constitution and your laws and your constitution. If this were a democracy, it would be our laws. [52:47.460 --> 52:49.460] This is not a democracy. [52:49.460 --> 52:51.460] This is a public, a republic. [52:51.460 --> 52:56.460] And all rights in republic belong to the individual. [52:56.460 --> 53:09.460] And that gives us standing to stand up and monitor our, the monitor the governmental instruments that we have created. [53:09.460 --> 53:20.460] So I am the perfect one just as you are in every other citizen use to raise this issue and make these determinations. [53:20.460 --> 53:27.460] And I'm going to do that. I'm going to hope I can get lots and lots of other people to do it. [53:27.460 --> 53:35.460] We start fighting these cases and hammering these lawyers and hammering the judges. [53:35.460 --> 53:42.460] They will find out how truly powerful the general public is. [53:42.460 --> 53:52.460] But I'm going to have to do this in Brett's name because if I do it in my own name, they'll come after me and throw me in jail. [53:52.460 --> 53:57.460] Is that a good idea, Brett? [53:57.460 --> 54:02.460] So you think that they're less scared of one of us than the other? [54:02.460 --> 54:09.460] No, it's just instead of putting me in jail, they'll put you in jail. [54:09.460 --> 54:13.460] They already recognized my name over there at the Texas Supreme Court. [54:13.460 --> 54:19.460] I'm sure they're trying to figure out a way to, to spend something so that I would end up leaving them alone. [54:19.460 --> 54:24.460] Oh, good. [54:36.460 --> 54:42.460] So it won't do me any good to try to hide. [54:42.460 --> 54:45.460] When they see the documentation, they'll know who it is. [55:19.460 --> 55:27.460] I won't talk to the governor's lawyers because they're the governor's lawyers and not my lawyers. [55:27.460 --> 55:32.460] And like Brett said, the governor hired them. I didn't. They don't work for me. [55:32.460 --> 55:36.460] So if you want to talk to somebody, go talk to your boss. Don't talk to me. [55:36.460 --> 55:43.460] And I can't talk to the governor because I've accused him of criminal acts. [55:43.460 --> 55:49.460] It would be inappropriate for him to have any conversation with me. [55:49.460 --> 55:54.460] So I'm a third party dad fly coming at him. [55:54.460 --> 55:58.460] And they can't talk to me. They can't negotiate with me. [55:58.460 --> 56:06.460] And like I told a clerk once when she wanted to have an attitude, I told her, look, I'm not here after you. [56:06.460 --> 56:08.460] I'm here after your boss. [56:08.460 --> 56:12.460] It's not you that have been committing crimes. It's your boss. I will not be reasonable or understanding. [56:26.460 --> 56:38.460] I will seek the outcome I intend and I will not cooperate with these guys to take me somewhere else. [01:01:24.460 --> 01:01:33.460] Margaret Moore, the Travis County District Attorney, announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana cases because of the law. [01:01:33.460 --> 01:01:42.460] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized in Texas, [01:01:42.460 --> 01:01:52.460] and that these actions demonstrate a misunderstanding of how HB 1325 works, as well as other cities too, like the district attorney in El Paso, [01:01:52.460 --> 01:02:01.460] Kyma Esparza, a Democrat who also stated earlier this month that the law, quote, will not have an effect on the prosecution of marijuana cases in El Paso. [01:02:01.460 --> 01:02:08.460] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County, who stated that, quote, [01:02:08.460 --> 01:02:22.460] the law is constantly changing on what makes something illegal based on its chemical makeup. It's important that if someone is charged with something, the test matches what they're charged with. As the first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured or recorded with the other one being found way back in 1979 in the East Pacific Ocean. I went to court this morning about nine hours ago, and the judge entered a plea for me against my objections. [01:04:31.460 --> 01:04:34.460] That's okay. They can do that. [01:04:34.460 --> 01:04:54.460] And handed me a public defender form. And anyway, I was starting to, because I'm going to use the no victim defense, the courtest elect defense, and also supreme court rulings. [01:04:54.460 --> 01:05:01.460] Okay, let's take a step back. What is the nature of the accusation? [01:05:01.460 --> 01:05:04.460] What was I charged with? Is that what you... [01:05:04.460 --> 01:05:06.460] Yeah, what are you charged with? [01:05:06.460 --> 01:05:14.460] I was pulled over. It was either late May or early June, just a while ago. [01:05:14.460 --> 01:05:31.460] And I was charged with no license, I mean, no driver's license, no insurance, no registration, and a turn. I didn't say no, which I actually did, but that's neat to hear now there. [01:05:31.460 --> 01:05:39.460] But I was going to use this no victim defense, and I was asking what's the nature and cause. [01:05:39.460 --> 01:05:46.460] This is a female judge. This is a small town. This is Cortez, Colorado. There's like 2,000 people in this town. [01:05:46.460 --> 01:05:57.460] And so it's like a little sum of small courthouse. I think they made this courthouse to accommodate a lot bigger city. They're anticipating growth or something. [01:05:57.460 --> 01:06:12.460] But I was starting to say now, it says under the Constitution, it says Article 1, Section 8, Clause 17, the Constitution grants this court two different kinds of... [01:06:12.460 --> 01:06:17.460] Hold on. You said the Constitution, state or federal? [01:06:17.460 --> 01:06:19.460] Yeah. [01:06:19.460 --> 01:06:24.460] Not state. It would be just the United States Constitution. [01:06:24.460 --> 01:06:30.460] Okay. Section 8, Clause 17. [01:06:30.460 --> 01:06:42.460] Okay, the only part of the Constitution that would apply directly in court in a state court would be due process. [01:06:42.460 --> 01:06:50.460] The practices and procedures prescribed in the federal Constitution do not necessarily apply to the state. [01:06:50.460 --> 01:07:00.460] The only thing in the federal Constitution that applies to the state are the Bill of Rights. [01:07:00.460 --> 01:07:13.460] And that's where the Constitution forbids public officials from denying you in certain specific enumerated rights. [01:07:13.460 --> 01:07:23.460] Beyond that, the rest of the Constitution sets up the federal government. It doesn't really have anything to do with the state government. [01:07:23.460 --> 01:07:32.460] So where were you going with this Section 8, Clause 17? How does that connect in... [01:07:32.460 --> 01:07:42.460] Article 1, Section 8, Clause 17 says the Constitution grants this court two different kinds of jurisdictions. [01:07:42.460 --> 01:07:50.460] One is criminal. No, one is common law and the other is admiralty law. [01:07:50.460 --> 01:08:01.460] Okay. You read the Constitution grants this court. What did this court need? [01:08:01.460 --> 01:08:05.460] A classic, you know, just small, the lower courts. [01:08:05.460 --> 01:08:15.460] No, no, no. This is a lower state court and you're reading from a federal Constitution. [01:08:15.460 --> 01:08:28.460] The federal Constitution can only grant powers to federal agencies. They can't say anything to the state. [01:08:28.460 --> 01:08:37.460] So you need to be looking... What he's getting at is you need to be looking in the Colorado Constitution for any such grants like this. [01:08:37.460 --> 01:08:45.460] Because this one that you're reading is speaking to the union of the state and the federal... [01:08:45.460 --> 01:08:51.460] Say you're in a federal district court or something, then you would read about this one. [01:08:51.460 --> 01:09:10.460] So you will find if you look in the Colorado Constitution, it will have a section that addresses the kinds of jurisdictions that are granted to the specific courts. [01:09:10.460 --> 01:09:14.460] How do I find this information? Google... [01:09:14.460 --> 01:09:22.460] Let's just look at the Colorado Constitution. You should go through the whole thing. You don't need to read the whole thing. Just go through it. [01:09:22.460 --> 01:09:29.460] A lot of it doesn't matter. See, today I was working on going after the governor. [01:09:29.460 --> 01:09:42.460] But I didn't really know what all the state constitution said about it, so I did a search for governor authority Texas Constitution. [01:09:42.460 --> 01:09:49.460] And that led me to the section of the Constitution that addresses the governor. It led me to Article 4. [01:09:49.460 --> 01:09:59.460] And so that's... I don't need to see all the rest of it. The Constitution's got a lot of stuff in them about setting up courts, about all kind of different agencies, [01:09:59.460 --> 01:10:05.460] most of which at this point for your immediate issue, you don't really care about. [01:22:50.460 --> 01:23:04.460] And when the prosecutor doesn't tell the judge to rule on all these motions, you file bar grievances against the prosecutor and just make their lives a living hell. [01:34:38.460 --> 01:34:49.460] I was looking at the Colorado Rules of Criminal Procedure and in Rule 11, it's saying about what the different plea that can be entered, [01:34:49.460 --> 01:34:55.460] you can plead guilty, not guilty, guilty by reason of insanity, all those different ones. [01:34:55.460 --> 01:35:06.460] And if you'll scroll down to subsection D of that Rule 11, you'll find it's talking about the failure or refusal to plead. [01:35:06.460 --> 01:35:15.460] If a defendant refuses to plead, and if, or some other stuff, the court shall enter a plea of not guilty. [01:35:15.460 --> 01:35:25.460] So in the absence of you cooperating with them, asking you to give them, hey, what's your plea? [01:35:25.460 --> 01:35:29.460] The court shall enter a plea of not guilty. [01:35:29.460 --> 01:35:33.460] That's almost identical to Texas. [01:35:33.460 --> 01:35:46.460] You might be able to go in there and say, if you haven't already been to this point, you might be able to go in there and say, I don't understand to what I would be entering a plea. [01:35:46.460 --> 01:35:48.460] What is the nature of the charges? [01:35:48.460 --> 01:35:52.460] You might be able to start there, but you've already passed that point. [01:35:52.460 --> 01:36:00.460] You've already got the point where they've entered the plea for you, and you didn't get them to explain the nature of the charges. [01:36:00.460 --> 01:36:03.460] So at this point, I think you just go on into the court. [01:36:03.460 --> 01:36:05.460] What do you think, Randy? [01:36:05.460 --> 01:36:22.460] Well, the other thing you could have done is made a plea to the jurisdiction or a special plea, a special appearance, a plea to the jurisdictions that challenged the subject matter jurisdiction. [01:36:22.460 --> 01:36:31.460] Jurisdiction is presumed until it's challenged. Once it's challenged, then the court must prove up jurisdiction. [01:36:31.460 --> 01:36:48.460] A special appearance has to be done, your first appearance in court, and you claim that while the court may have general jurisdiction over the subject matter, the court does not have jurisdiction over the person. [01:36:48.460 --> 01:36:53.460] And you have to show why. Those are two things you can do. [01:36:53.460 --> 01:37:04.460] And until the court can show it has jurisdiction over the subject matter and jurisdiction over the person, they can't get to a plea. [01:37:04.460 --> 01:37:09.460] Otherwise, just let them in or a plea, don't hurt a thing. [01:37:09.460 --> 01:37:13.460] Okay, we do need to move on. If I lose this case, what I'm going to do is I'm going to go in with a face mask, I mean not a face mask, I'm going to go in without one. [01:52:53.260 --> 01:53:08.260] When he refuses to arrest the guy or take my complaint against the guy, then I take out my second one that accuses him of refusing to take my complaint and ask for a supervisor and give that to the supervisor. [01:56:06.260 --> 01:56:21.260] The commissioner had given me a public defender and when I got there, there was no public defender and he said, you're not entitled to a public defender, you're guilty. [01:56:21.260 --> 01:56:25.260] Did you file criminal charges against him yet? [01:56:25.260 --> 01:56:31.260] Well, I'm in the middle of doing that right now. [01:56:31.260 --> 01:56:38.260] Turner, a not Turner driver, a Walker v. Driver is a Fifth Circuit. [01:56:38.260 --> 01:56:51.260] I'm sorry, it's a Texas case, but you should be able to find a representative California case that if a judge has no discretion in properly applying the law to the facts, [01:56:51.260 --> 01:57:01.260] a failure to do so is an abuse of discretion. If a judge, if a public official abuses his discretion and denies the citizen for free access to enjoyment, right? [01:57:01.260 --> 01:57:05.260] What's that, Frank? [01:57:26.260 --> 01:57:33.260] So now you've got to shot at the judge. They bring in a retired judge to do this kind of garbage. [01:57:33.260 --> 01:57:43.260] So hammer the judge, go after the judge criminally, then the judge will be PO'd at him for sickening you on him.
