[00:00.000 --> 00:07.000] The following news flash is brought to you by the Lone Star Lowdown. [00:07.000 --> 00:14.000] Markets for Monday the 22nd of July 2019 open with Precious Metals, Gold $1,429 an ounce, [00:14.000 --> 00:22.000] Silver $16.45 an ounce, Copper $2.75 an ounce, Oil, Texas Crude $55.63 a barrel, Brent Crude [00:22.000 --> 00:29.960] $62.47 a barrel, and Cryptos in order of Market Cap, Bitcoin Core $10,566.52, Ethereum [00:29.960 --> 00:45.960] $227.26, XRP Ripple $0.33, Litecoin $100.31, and Bitcoin Cash is at $324.10 a crypto coin. [00:45.960 --> 00:52.720] In history, the year 1916, the Preparedness Day bombing, a Thai suitcase bomb, was detonated [00:52.720 --> 00:58.040] on Market Street in San Francisco during the World War I Preparedness Day Parade, killing [00:58.040 --> 01:05.040] the 10 and entering 40 today in history. [01:05.040 --> 01:06.040] And recent news. [01:06.040 --> 01:10.880] Since Governor Greg Abbott signed House Bill 1325 legalizing heaven to Texas law back in [01:10.880 --> 01:15.400] June, county prosecutors around the state, including Houston, Austin, and San Antonio, [01:15.400 --> 01:19.400] have been dropping marijuana possession charges and even refusing to file new ones since they [01:19.400 --> 01:23.520] are stipulating that they do not have the time or the laboratory equipment to test the [01:23.520 --> 01:28.240] ear for THC. Margaret Moore, the Travis County District Attorney, announced earlier this [01:28.240 --> 01:33.200] month that she was dismissing 32 felony possession and delivery of marijuana cases because of [01:33.200 --> 01:34.200] the law. [01:34.200 --> 01:37.920] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.920 --> 01:42.400] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.400 --> 01:48.560] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.560 --> 01:54.800] well as other cities, too, like the District Attorney in El Paso, Kymah Esparza, a Democrat [01:54.800 --> 01:59.280] who also stated earlier this month that the law, quote, will not have an effect on the [01:59.280 --> 02:02.080] prosecution of marijuana cases in El Paso. [02:02.080 --> 02:07.080] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:07.080 --> 02:11.040] in Harris County, who stated that, quote, the law is constantly changing on what makes [02:11.040 --> 02:13.760] something illegal based on its chemical makeup. [02:13.760 --> 02:17.680] It's important that if someone is charged with something, the test matches what they're [02:17.680 --> 02:22.880] charged with. [02:22.880 --> 02:27.520] A paper by Tulane University identified a five and a half inch American pocket shark [02:27.520 --> 02:32.640] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [02:32.640 --> 02:38.320] shark ever captured or recorded with the other one being found way back in 1979 in the East [02:38.320 --> 02:39.320] Pacific Ocean. [02:39.320 --> 02:44.080] According to the university paper, the shark secretes a luminous fluid from a gland near [02:44.080 --> 02:50.360] its front fins for the purposes hypothesized to lure and prey who may be drawn into the [02:50.360 --> 03:15.920] glow. [03:15.920 --> 03:25.760] Okay, we are back, Randy Kelton, Brett Fountain. [03:25.760 --> 03:35.280] Brett Fountain is actually with us at Logos Radio Network and we are talking to Tina in [03:35.280 --> 03:36.280] California. [03:36.280 --> 03:45.880] If I sound like I'm a little up and frisky, I put too much of that ginger tea in my mouth. [03:45.880 --> 03:46.880] Mix. [03:46.880 --> 03:50.480] I probably won't go to sleep for two days. [03:50.480 --> 03:51.480] Okay. [03:51.480 --> 03:52.480] Tina? [03:52.480 --> 03:56.080] You're not frisky because you've had a little whiskey then. [03:56.080 --> 04:00.280] I've got a little bit of whiskey. [04:00.280 --> 04:01.280] One shot. [04:01.280 --> 04:02.280] One shot of whiskey. [04:02.280 --> 04:03.280] Okay. [04:03.280 --> 04:12.080] So we were talking about what to do with the CEO, so I got part of that. [04:12.080 --> 04:13.080] What I want to ask... [04:13.080 --> 04:14.080] Wait, wait. [04:14.080 --> 04:15.080] Hold on. [04:15.080 --> 04:21.080] I mean, Brett, she was talking about my great idea that I had about not talking to the [04:21.080 --> 04:22.080] lawyer. [04:22.080 --> 04:23.080] Yeah. [04:23.080 --> 04:28.080] Isn't it cool that I thought of that? [04:28.080 --> 04:33.080] Yeah, you probably did at some point. [04:33.080 --> 04:38.080] You know, Brett, mine's Think-A-Like, I guess, let's say. [04:38.080 --> 04:46.080] Tina was saying that she's helping this guy with a foreclosure-type issue, and we were [04:46.080 --> 04:53.080] discussing communicating with the CEO of... [04:53.080 --> 04:55.080] Was it Fannie Mae or Freddie Mac? [04:55.080 --> 04:56.080] Freddie Mac. [04:56.080 --> 04:57.080] Yes. [04:57.080 --> 04:58.080] Freddie Mac. [04:58.080 --> 05:00.080] Instead of the lawyer. [05:00.080 --> 05:02.880] There you go. [05:02.880 --> 05:10.680] Because she gave an offer, it was a measly five million, and they didn't get a proper [05:10.680 --> 05:14.880] counter offer, so she doesn't think the lawyer actually even gave it to the CEO. [05:14.880 --> 05:18.880] That's a perfectly reasonable thing to think. [05:18.880 --> 05:28.880] Yeah, and since she didn't hire that lawyer, she's going to have to deal with him. [05:28.880 --> 05:31.880] So this is another question then. [05:31.880 --> 05:36.880] I send the next offer, which now we're up into 12 million, which is only one million [05:36.880 --> 05:42.880] for each year of the life they've tortured him by and destroyed him financially. [05:42.880 --> 05:49.880] I put all this in when they've made 7.8 billion just last year alone. [05:49.880 --> 05:55.880] And what I would like to do, there's a series of chain of emails with the attorney where [05:55.880 --> 06:01.880] they made an offer, and then he said, oh, it's too convoluted. [06:01.880 --> 06:06.880] And so I spelled it out and said, please explain who your client was. [06:06.880 --> 06:11.880] Just put a yes or no answer, and then I was a little bit sarcastic, I'm afraid. [06:11.880 --> 06:19.880] I listed all the parties that has been against him, A through F, or G, whatever it was. [06:19.880 --> 06:25.880] He said, you know, One West Bank, Fifth Bank, ARK One, please say yes or no against [06:25.880 --> 06:30.880] which one this is, and Jay, I know, but I'm not going to tell you at the bottom. [06:30.880 --> 06:33.880] And they said, you're playing games. [06:33.880 --> 06:40.880] So I wanted to put that chain of emails in along with the offer just to let them know [06:40.880 --> 06:42.880] we've been trying in good faith. [06:42.880 --> 06:47.880] What do you think? [06:47.880 --> 06:50.880] Wait, I missed what you said the last sentence. [06:50.880 --> 07:01.880] I wanted to put a copy of the chain of emails between my friend and the attorney making these [07:01.880 --> 07:04.880] offers and explaining why they are. [07:04.880 --> 07:12.880] Should I put that copy in with the offer to the CEO so he sees that maybe he's getting this? [07:12.880 --> 07:16.880] Absolutely, absolutely. [07:16.880 --> 07:21.880] Okay, good then, I will get that done. [07:21.880 --> 07:28.880] Now, lastly, in their motion for omnibus objection, and I don't know if I should put this, a copy [07:28.880 --> 07:35.880] of this in the letter or wait for another week or two till we file it, because the last thing, [07:35.880 --> 07:43.880] and this goes to when you talk about churning, the last question on here that James has said [07:43.880 --> 07:49.880] he wants to submit as evidence in the trial is any and all correspondence documents, [07:49.880 --> 07:54.880] exhibits, depositions, filings and pleadings by both defendant and plaintiff. [07:54.880 --> 08:01.880] They came back and said they object to this exhibit on the grounds that it's not relevant to the claim, [08:01.880 --> 08:03.880] but it's all these things. [08:03.880 --> 08:10.880] All defenses is immaterial, vague, overbroad, ambiguous on Julie Burdinson and constitutes [08:10.880 --> 08:12.880] inadmissible hearsay. [08:12.880 --> 08:17.880] So they're basically saying that everything the plaintiffs have submitted in court is [08:17.880 --> 08:20.880] inadmissible hearsay. [08:20.880 --> 08:23.880] Oh, that's wonderful. [08:23.880 --> 08:24.880] I know. [08:24.880 --> 08:30.880] My response so far is the sheer disrespect to this court is beyond comprehension with [08:30.880 --> 08:33.880] its final frivolous objection by plaintiff. [08:33.880 --> 08:38.880] How can they even consider such a meaningless and legally insufficient response? [08:38.880 --> 08:42.880] Wait, wait, hold on. [08:42.880 --> 08:48.880] You have judicial admission that all of the, his evidence is hearsay. [08:48.880 --> 08:50.880] His and yours. [08:50.880 --> 08:51.880] Yeah. [08:51.880 --> 08:54.880] He says his own is inadmissible too. [08:54.880 --> 08:58.880] Yeah, he can't admit that yours are hearsay. [08:58.880 --> 09:03.880] He can claim it, but he can admit that his is hearsay. [09:03.880 --> 09:05.880] Correct. [09:05.880 --> 09:08.880] So he's gave that judicial admission. [09:08.880 --> 09:17.880] You might ask the court to take judicial notice of counsel's judicial admission. [09:17.880 --> 09:23.880] What I've put is here, it's tantamount to admitting that plaintiff's attorneys are completely [09:23.880 --> 09:28.880] incompetent and simply guilty of churning the case by deliberately submitting fraud or [09:28.880 --> 09:35.880] dream or to the court, not withstanding that this self-admission by the plaintiff, their [09:35.880 --> 09:40.880] agents and attorneys automatically disqualifies and dismisses all the cases against defendants [09:40.880 --> 09:45.880] because by their own words, they have admitted that all of their pleadings, correspondence, [09:45.880 --> 09:50.880] witness depositions, et cetera, in all of Mr. Beatman's cases constitutes inadmissible [09:50.880 --> 09:56.880] hearsay and are immaterial to the very cases the plaintiff submitted them into. [09:56.880 --> 09:58.880] Wonderful. [09:58.880 --> 10:00.880] Bam. [10:00.880 --> 10:04.880] Mic drop. [10:04.880 --> 10:12.880] So would I, what I'm thinking is, would I say and highlight these things to the CEO [10:12.880 --> 10:18.880] with the offer or wait till later to submit these things? [10:18.880 --> 10:25.880] You might submit a petition for judicial admission. [10:25.880 --> 10:34.880] Since the lawyer made that unequivocal statement, then you asked the court to take judicial [10:34.880 --> 10:41.880] notice of the judicial admission by counsel. [10:41.880 --> 10:43.880] Okay. [10:43.880 --> 10:46.880] I think it's pretty good. [10:46.880 --> 10:49.880] They've done it three times in this whole document. [10:49.880 --> 10:57.880] They've said all their documents in their cases are inadmissible hearsay. [10:57.880 --> 11:01.880] Take him to task on it. [11:01.880 --> 11:03.880] How's he going to ask the judge? [11:03.880 --> 11:05.880] Oh, I was just kidding when I said that. [11:05.880 --> 11:07.880] I didn't really mean what I said. [11:07.880 --> 11:09.880] Good luck, guy. [11:09.880 --> 11:13.880] And you ought to look at the law firm and bar grieve every one of those partners. [11:13.880 --> 11:18.880] This is back to you were saying about respondent superior bar grieve every one of the partners [11:18.880 --> 11:24.880] for allowing them to turn the case and do all of this for that was going to be inadmissible. [11:24.880 --> 11:28.880] Anyway, I like that one. [11:28.880 --> 11:29.880] Yes. [11:29.880 --> 11:36.880] Now that, you know, when I said before that the client respondent superior doesn't go [11:36.880 --> 11:41.880] to the between the lawyer and the client, that's, that's a separate situation. [11:41.880 --> 11:46.880] If somebody was working for the client other than the lawyer, then he would be respondent [11:46.880 --> 11:54.880] superior, but here where the lawyer has partners or higher level people in the law firm, they [11:54.880 --> 12:02.880] are responding at superior to this lawyer and should be taking, should be the standards [12:02.880 --> 12:08.880] require them to make sure this guy doesn't do what he's doing. [12:08.880 --> 12:10.880] So that's perfect. [12:10.880 --> 12:14.880] They obviously haven't read what they submitted. [12:14.880 --> 12:18.880] Apparently they'll just throw it in there and they just put these wrote, you know, [12:18.880 --> 12:23.880] legally, you know, ridiculous answers. [12:23.880 --> 12:26.880] And that goes to collateral estoppel. [12:26.880 --> 12:32.880] Every time they bring up any evidence, you should object hearsay. [12:32.880 --> 12:38.880] Oh, that's what I like about that. [12:38.880 --> 12:43.880] Well, I ended here with their self-admission of everything being inadmissible. [12:43.880 --> 12:49.880] They say entitles the defendant to compensate and punitive damages for the 12 years of torture [12:49.880 --> 12:51.880] that he has been subject to. [12:51.880 --> 12:53.880] It also entitles him to his bedside. [12:53.880 --> 12:54.880] Wait a minute. [12:54.880 --> 12:59.880] That should get a petition for summary judgment. [12:59.880 --> 13:02.880] That's right. [13:02.880 --> 13:07.880] Maybe a countersuit for malicious prosecution. [13:07.880 --> 13:10.880] That would be fine, wouldn't it? [13:10.880 --> 13:14.880] It would sure muddy the waters for him. [13:14.880 --> 13:25.880] It might incline the CEO to tell them to make some kind of deal and get these people out of here. [13:25.880 --> 13:31.880] Somebody else might hear what they're saying and do the same things. [13:31.880 --> 13:34.880] His trial is due in early June. [13:34.880 --> 13:38.880] Can he file some of these right now before the trial hearings? [13:38.880 --> 13:40.880] Oh, yeah. [13:40.880 --> 13:44.880] As long as it's, I think, a federal court. [13:44.880 --> 13:50.880] I don't know in the state, it's 10 days, but I'm not sure what it is in the Fed. [13:50.880 --> 13:54.880] But in June, you've got plenty of time. [13:54.880 --> 13:57.880] Okay, so I'll get into both. [13:57.880 --> 14:04.880] And you can be relatively sure this is not going to come before the court in June. [14:04.880 --> 14:07.880] Everything shut down. [14:07.880 --> 14:08.880] Well, it was delayed. [14:08.880 --> 14:11.880] It was supposed to be in April and it was delayed till June. [14:11.880 --> 14:16.880] Now they're talking over in Florida about reopening them, but who knows? [14:16.880 --> 14:17.880] It could change. [14:17.880 --> 14:23.880] Good luck if it gets before the court before the end of the year. [14:23.880 --> 14:24.880] Okay. [14:24.880 --> 14:25.880] Well, that's good. [14:25.880 --> 14:27.880] That gives us more time. [14:27.880 --> 14:34.880] Yeah, this is going to, this shutdown is going to really clog everything up. [14:34.880 --> 14:37.880] It doesn't just stop them moving ahead. [14:37.880 --> 14:44.880] It creates all kinds of new issues that are created because of the delays. [14:44.880 --> 14:49.880] It's going to get the logarithmically more complex. [14:49.880 --> 14:57.880] So don't look for, and something as minor as this, the court's not going to want to mess with it until they get caught up on everything else. [14:57.880 --> 15:00.880] If they ever do. [15:00.880 --> 15:02.880] Yeah. [15:02.880 --> 15:04.880] Okay. [15:04.880 --> 15:06.880] Go back to Rip Tonini. [15:06.880 --> 15:13.880] I filed a, helped him file a suit that said, you know, Wells Fargo was the lender. [15:13.880 --> 15:15.880] Wells Fargo was the servicer. [15:15.880 --> 15:19.880] Wells Fargo was doing the foreclosure. [15:19.880 --> 15:22.880] We filed a suit said, who the heck are you? [15:22.880 --> 15:24.880] We don't know who you are. [15:24.880 --> 15:32.880] Never in into contract. Do you never entered a contract with your supposed superior? [15:32.880 --> 15:35.880] Prove up your position. [15:35.880 --> 15:45.880] Six years later, the California Supreme denied our cert. [15:45.880 --> 15:47.880] One page suit. [15:47.880 --> 15:49.880] Six years. [15:49.880 --> 15:51.880] Wow. [15:51.880 --> 15:54.880] We didn't have a shutdown then. [15:54.880 --> 15:55.880] Now we got a shutdown. [15:55.880 --> 16:00.880] So it's really going to slow things down. [16:00.880 --> 16:02.880] I hope so. [16:02.880 --> 16:04.880] Now, one more quick question. [16:04.880 --> 16:06.880] This is for me. [16:06.880 --> 16:20.880] In a bankruptcy adversary proceeding, I filed against this woman and her husband who had a business of a consignment store and they took property in and either sold it [16:20.880 --> 16:25.880] and didn't give us the money or they didn't sell it and they kept it and they shut the business down. [16:25.880 --> 16:26.880] They got evicted. [16:26.880 --> 16:28.880] They've done it before. [16:28.880 --> 16:40.880] So I filed an adversary proceeding because I had some rather expensive art in there that they cannot tell me what they did with it. [16:40.880 --> 16:45.880] And it's not on the, you know, the books that they had. [16:45.880 --> 16:50.880] And then some other people joined, I went to the first status conference hearing. [16:50.880 --> 16:57.880] The judge was very nice, but I hadn't quite properly served her because I hadn't included the court document. [16:57.880 --> 16:58.880] She said you can serve her. [16:58.880 --> 17:00.880] I asked if I could add no. [17:00.880 --> 17:05.880] Are you being harassed by debt collectors with phone calls, letters or even lawsuits? [17:05.880 --> 17:09.880] Stop debt collectors now with the Michael Meares proven method. [17:09.880 --> 17:14.880] Michael Meares has won six cases in federal court against debt collectors and now you can win two. [17:14.880 --> 17:20.880] You'll get step-by-step instructions in plain English on how to win in court using federal civil rights statute. Everything you know you were saying. [19:39.880 --> 19:45.880] Trust is a hardly friend, telling you a problem then. [19:45.880 --> 19:51.880] Calling his name once again. Everything you know you were saying. [19:51.880 --> 19:57.880] Hey I'm making money is everything, is everything to me that I'm gonna call him [19:57.880 --> 20:03.880] I've got me need and me pray to him, because he's the only one could answer him [20:03.880 --> 20:09.880] May not be miss what making man saying, man can you know if there's speed in me [20:09.880 --> 20:15.880] Can I be trusted by me crazy, tell him your problem's dead [20:15.880 --> 20:21.880] I'll have his name once again, tell him you know he won't be here [20:21.880 --> 20:27.880] Trust me, but I'll be crazy, tell him your problem's dead [20:27.880 --> 20:33.880] I'll have his name once again, tell him you know he won't be here [20:33.880 --> 20:37.880] May not be miss what you call him, you call him Buhuda, you call him Antalya [20:37.880 --> 20:41.880] You call him Jeovia, you call him his name and your character [20:41.880 --> 20:47.880] Pray to him and he'll deliver, miracle he work and he work it all over [20:47.880 --> 20:53.880] Let the blind see and the deaf hear me [20:53.880 --> 20:59.880] Okay, we are back to the rule of law radio, Randy Kelton, I'm Brett Fountain [20:59.880 --> 21:03.880] And we're here talking with Tina from California [21:03.880 --> 21:10.880] Tina, we didn't quite get all of that because the sponsors just jumped right in there and took over [21:10.880 --> 21:12.880] Go ahead and continue [21:12.880 --> 21:19.880] So the judge had said at the hearing that she didn't see why I couldn't add other parties [21:19.880 --> 21:24.880] And so I added some other parties and I thought it was pretty good [21:24.880 --> 21:31.880] I used a parallel to help me write it and she answered saying they weren't added right [21:31.880 --> 21:35.880] And her answer was pretty pathetic and she wanted to dismiss [21:35.880 --> 21:40.880] But she failed to calendar a motion for it to be heard [21:40.880 --> 21:43.880] So we filed a really good, really good answer [21:43.880 --> 21:47.880] The judge at the last hearing, she said, I don't... [21:47.880 --> 21:52.880] You might want to all think about, you know, if you really want to go forward with this [21:52.880 --> 21:59.880] Well, we do because she defrauded hundreds of people and stole their money and their property [21:59.880 --> 22:07.880] So we want to see her not have this bankruptcy go through because she's doing it for fraud [22:07.880 --> 22:10.880] And we'd like our property back [22:10.880 --> 22:18.880] But what she said is there are some procedural issues still with adding these parties [22:18.880 --> 22:26.880] And I tried to read the rules and I don't understand what is wrong that I've done or we have done [22:26.880 --> 22:33.880] And I need to find out if you know of anyone who understands the rules [22:33.880 --> 22:42.880] How to properly try to add plaintiffs because I'm just not seeing what's wrong [22:42.880 --> 22:47.880] No, I'm not a bankruptcy guy [22:47.880 --> 22:55.880] And I don't know anyone who is a real technical bankruptcy guy person [22:55.880 --> 22:57.880] Okay [22:57.880 --> 23:00.880] Would that be a joint from the court? [23:00.880 --> 23:07.880] What she's looking for is a jointer? [23:07.880 --> 23:11.880] I'm not sure, this is bankruptcy and... [23:11.880 --> 23:13.880] I'd have to separate [23:13.880 --> 23:20.880] Generally you file a claim with a bankruptcy court against the property [23:20.880 --> 23:28.880] Did all these people that you included make a claim against the estate? [23:28.880 --> 23:32.880] Well, she doesn't pretty much have any [23:32.880 --> 23:36.880] She's filed a Chapter 7 to try to get out of everything [23:36.880 --> 23:42.880] We know she has a storage unit somewhere probably with some of the property in [23:42.880 --> 23:46.880] But what I filed was an adversary proceeding within her bankruptcy [23:46.880 --> 23:50.880] So it's basically a fully fledged lawsuit within the bankruptcy [23:50.880 --> 23:59.880] In order to be a party you have to file a claim with the bankruptcy court [23:59.880 --> 24:05.880] Then you can file an adversarial proceeding to collect the claim [24:05.880 --> 24:09.880] But to have standing in the bankruptcy court you have to say [24:09.880 --> 24:15.880] They're filing bankruptcy, they have an estate and we make this claim against their state [24:15.880 --> 24:19.880] That's what a credit card company would do [24:19.880 --> 24:26.880] So each person who has a claim should file that claim with the court [24:26.880 --> 24:33.880] Okay, so they should file a claim separate to the fact that her former attorney [24:33.880 --> 24:38.880] She then went pro say now she's looking at hiring an attorney because obviously we're bombarding her [24:38.880 --> 24:46.880] The former attorney sent notice to us as creditors that she'd filed bankruptcy [24:46.880 --> 24:52.880] But you're saying we have to actually file a claim against the estate as well [24:52.880 --> 24:53.880] Yes [24:53.880 --> 24:55.880] And one other party did [24:55.880 --> 24:59.880] I don't know if the other two parties filed a claim [24:59.880 --> 25:05.880] Then that party will have standing, I don't know of any other requirement [25:05.880 --> 25:11.880] Generally when you file a claim then the judge will, if the other side opposes the claim [25:11.880 --> 25:16.880] Then the judge will set up a prove-up hearing [25:16.880 --> 25:17.880] Okay [25:17.880 --> 25:25.880] Now if you have a, like here you have a claim of fraud [25:25.880 --> 25:30.880] Then that's different, you don't file that with the bankruptcy court [25:30.880 --> 25:33.880] You do that in an adversarial proceeding [25:33.880 --> 25:36.880] But in order to get standing for the adversarial proceeding [25:36.880 --> 25:40.880] You have to have a claim in the bankruptcy court [25:40.880 --> 25:44.880] Okay, so that might be what the problem is then with this [25:44.880 --> 25:46.880] Because it's hard to understand some of these rules [25:46.880 --> 25:49.880] And she keeps saying, can't you afford an attorney? [25:49.880 --> 25:55.880] And I'm like, no, because she's got our money [25:55.880 --> 25:57.880] And why don't you just dismiss it? [25:57.880 --> 25:59.880] I don't think she wants to hear it [25:59.880 --> 26:03.880] But we want this stopped because this woman has done this before [26:03.880 --> 26:07.880] And many times in a different [26:07.880 --> 26:11.880] So have everybody file a claim with the bankruptcy court [26:11.880 --> 26:15.880] And then if they're, that will give them standing [26:15.880 --> 26:19.880] Even if your suit's already filed, your adversarial [26:19.880 --> 26:26.880] Is the adversarial still before the court or has it been dismissed? [26:26.880 --> 26:29.880] Oh, no, no, it's still before the court, she's given us another [26:29.880 --> 26:32.880] Because of the coronavirus and we all had to pay by phone [26:32.880 --> 26:38.880] She has given us the 60 days before the next [26:38.880 --> 26:43.880] Okay, do you have a status conference? [26:43.880 --> 26:49.880] And she's given the other lady 60 days to fix her filing [26:49.880 --> 26:54.880] Of trying to dismiss our, you know, suit [26:54.880 --> 27:01.880] Okay, so go ahead and make sure everybody has filed a claim with the court [27:01.880 --> 27:03.880] Okay [27:03.880 --> 27:05.880] That'll fix that part [27:05.880 --> 27:08.880] And then you should be, as far as I know, you should be good [27:08.880 --> 27:12.880] I don't know of anything else that requires to get you standing [27:12.880 --> 27:16.880] But if anybody listening on this call knows anything about this [27:16.880 --> 27:19.880] If you could let Randy know that you might have some input [27:19.880 --> 27:23.880] I would certainly appreciate it [27:23.880 --> 27:28.880] Okay, and if anybody sends me an email, I'll forward it to Tina [27:28.880 --> 27:31.880] Okay, do you have anything else for us tonight? [27:31.880 --> 27:33.880] Thank you very much, no, that's it [27:33.880 --> 27:36.880] Thank you for your input as usual [27:36.880 --> 27:38.880] Okay, thank you very much [27:38.880 --> 27:41.880] And now we're going to go to Mark in Wisconsin [27:41.880 --> 27:44.880] Mark, where have you been? [27:44.880 --> 27:49.880] Oh, just trying to create trouble [27:49.880 --> 27:51.880] Make my life more miserable [27:51.880 --> 27:56.880] I'm going to answer questions that two-year-other callers had this evening [27:56.880 --> 28:00.880] Notably Tina and I believe the first caller, Craig [28:00.880 --> 28:02.880] So... [28:02.880 --> 28:04.880] Chris [28:04.880 --> 28:05.880] Chris, yes [28:05.880 --> 28:07.880] I'm Tina with the bankruptcy [28:07.880 --> 28:12.880] I've done the bankruptcy as part of the adversarial group with fraud case [28:12.880 --> 28:17.880] Ultimately, the person who comes into the court, at least in my experience [28:17.880 --> 28:22.880] Was the Department of Justice lawyer who said [28:22.880 --> 28:26.880] I asked the court not to grant the bankruptcy because of fraud [28:26.880 --> 28:30.880] And the judge went ahead and said, yep, you can't bankrupt ever [28:30.880 --> 28:33.880] On any of the stuff you're claiming here [28:33.880 --> 28:36.880] And the case is done [28:36.880 --> 28:41.880] Now, as one of the people who had a claim [28:41.880 --> 28:46.880] And allowed me then to file paperwork, etc. [28:46.880 --> 28:50.880] Step one was going to the court and just saying I have a claim [28:50.880 --> 28:53.880] And there's a standardized form for that [28:53.880 --> 28:58.880] Eventually, they want you to fill out a different form [28:58.880 --> 29:05.880] Which has a penalty of perjury and a bunch of other stuff saying, yep, this debt is 100% legit [29:05.880 --> 29:11.880] Then, at that point, they can have additional hearings about it [29:11.880 --> 29:16.880] Before that form with the penalty of perjury saying kicks in [29:16.880 --> 29:19.880] You have adversarial hearings [29:19.880 --> 29:21.880] And I don't remember the number at this point [29:21.880 --> 29:25.880] The adversarial hearing is held, at least in our case here [29:25.880 --> 29:29.880] It was held by the trustee of the bankruptcy court [29:29.880 --> 29:36.880] Now, in theory, the only person who has the power to talk to the court [29:36.880 --> 29:39.880] Is the trustee [29:39.880 --> 29:43.880] So, you as a creditor are supposed to go to the trustee [29:43.880 --> 29:47.880] But what I did is I just half-danced my way right to the court proper [29:47.880 --> 29:52.880] And I was treated on par, new bankruptcy court [29:52.880 --> 30:00.880] On par with the attorney and sat right up there alongside the... [30:00.880 --> 30:03.880] Everyone knows that walking is great exercise [30:03.880 --> 30:08.880] But you might not know that the way you walk could predict how long you're going to live [30:08.880 --> 30:13.880] And I'll be back to tell you more about walking prognostication in just a moment [30:13.880 --> 30:15.880] Privacy is under attack [30:15.880 --> 30:19.880] When you give up data about yourself, you'll never get it back again [30:19.880 --> 30:24.880] And once your privacy is gone, you'll find your freedoms will start to vanish too [30:24.880 --> 30:29.880] So protect your rights, say no to surveillance and keep your information to yourself [30:29.880 --> 30:31.880] Privacy, it's worth hanging on to [30:31.880 --> 30:35.880] This public service announcement is brought to you by startpage.com [30:35.880 --> 30:39.880] The private search engine alternative to Google, Yahoo and Bing [30:39.880 --> 30:42.880] Start over with startpage [30:42.880 --> 30:47.880] New research shows how fast you walk could predict how long you're going to live [30:47.880 --> 30:53.880] The Journal of the American Medical Association reports that older adults who walk one meter per second or faster [30:53.880 --> 30:55.880] Live longer than expected [30:55.880 --> 30:59.880] In case you're wondering, one meter per second is about two and a quarter miles per hour [30:59.880 --> 31:06.880] A senior's age, gender and walking speed were as good at predicting life expectancy as more traditional statistical measures [31:06.880 --> 31:09.880] Generally speaking, faster walkers live longer [31:09.880 --> 31:12.880] Measuring walking speed is quick and inexpensive [31:12.880 --> 31:15.880] It only takes a stopwatch, some space to walk in a few minutes [31:15.880 --> 31:20.880] Researchers say it could help doctors identify older patients who need special care [31:20.880 --> 31:29.880] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com [31:29.880 --> 31:34.880] I lost my son, my uncle, my uncle on September 11, 2001 [31:34.880 --> 31:38.880] Most people don't know that a third tower fell on September 11 [31:38.880 --> 31:42.880] World Trade Center 7, a 47-story skyscraper was not hit by a plane [31:42.880 --> 31:46.880] Although the official explanation is that fire brought down building 7 [31:46.880 --> 31:52.880] Over 1,200 architects and engineers have looked into the evidence and believed there is more to the story [31:52.880 --> 31:57.880] Bring justice to my son, my uncle, my nephew, my son, go to buildingwatch.org [31:57.880 --> 32:00.880] Why it fell, why it matters, is what you can do [32:00.880 --> 32:05.880] Logos Radio Network welcomes a new show to our lineup for the new year [32:05.880 --> 32:11.880] Scripture Talk that they may see your good works [32:18.880 --> 32:21.880] and glorify your Father which is in heaven [32:21.880 --> 32:26.880] We wish to reflect God's light and be a blessing to all those with a hearing ear [32:26.880 --> 32:31.880] Join Nana and guests for both verse by verse Bible studies and topical Bible studies [32:31.880 --> 32:34.880] designed to provoke unto love and good works [32:34.880 --> 32:38.880] Our verse by verse Bible studies will begin in the book of Matthew [32:38.880 --> 32:41.880] where we will discuss one chapter per week [32:41.880 --> 32:45.880] Topical Bible studies will vary each week and will explore sound doctrine [32:45.880 --> 32:48.880] as well as Christian character development [32:48.880 --> 32:53.880] So mark your calendar and join us live on LogosRadioNetwork.com [32:53.880 --> 32:56.880] Wednesdays from 8 to 10 p.m. starting January 8 [32:56.880 --> 33:12.880] for an inspiring and motivating discussion of the Scriptures [33:26.880 --> 33:42.880] Okay we are back [33:42.880 --> 33:45.880] Randy Kelton, Rhett Fountain, Rule of Law Radio [33:45.880 --> 33:47.880] and we're talking to Mark in Wisconsin [33:47.880 --> 33:50.880] Okay, back to bankruptcy [33:50.880 --> 33:56.880] Right, so I don't know exactly when I went flying off the cliff there [33:56.880 --> 34:03.880] So at the point where they want you filling out these forms [34:03.880 --> 34:08.880] for that you get the sign under penalty of perjury [34:08.880 --> 34:13.880] that, you know, my particular instance happened [34:13.880 --> 34:18.880] after we had a couple of hearings with the creditors [34:18.880 --> 34:23.880] and the hearings of the creditors [34:23.880 --> 34:28.880] The thing that worked well for me was having proof [34:28.880 --> 34:33.880] that there was a problem with the gentleman's veracity [34:33.880 --> 34:38.880] I was able to, by having from the bankruptcy court [34:38.880 --> 34:40.880] his old computers [34:40.880 --> 34:49.880] I was able to find fraud in his, say, electronic material [34:49.880 --> 34:53.880] Now in this particular case it sounds like she has fraud [34:53.880 --> 34:57.880] and she has a claim that's being recognized [34:57.880 --> 35:00.880] by the bankruptcy court enough for the filing [35:00.880 --> 35:07.880] So she might be able to play a game with the LexisNexis Corporation [35:07.880 --> 35:10.880] Now one of the things that LexisNexis does [35:10.880 --> 35:16.880] is they have a database of all the property you've ever owned [35:16.880 --> 35:23.880] They use this in the insurance industry to create quotes for you [35:23.880 --> 35:27.880] In addition there's a bunch of other products that are involved [35:27.880 --> 35:31.880] The Fair Debt Collection Practices Act allows you as a person [35:31.880 --> 35:33.880] to get your own file [35:33.880 --> 35:39.880] Now I've pulled my own file, there was over 303 pages of property [35:39.880 --> 35:42.880] and things that they knew about [35:42.880 --> 35:44.880] In this particular case with this woman [35:44.880 --> 35:50.880] since you're attempting to find assets and you have this bankruptcy [35:50.880 --> 35:56.880] you may be able to get LexisNexis to produce her information [35:56.880 --> 36:00.880] but they probably will want a court order [36:00.880 --> 36:05.880] LexisNexis went down that path with this gentleman with the bankruptcy [36:05.880 --> 36:09.880] because at the end of the day with his bankruptcy [36:09.880 --> 36:13.880] the DOJ's attorney said he cannot go bankrupt [36:13.880 --> 36:17.880] on all the debts here in this proceeding [36:17.880 --> 36:23.880] and so my debt with him is still valid [36:23.880 --> 36:27.880] and so thinking about this for the call tonight [36:27.880 --> 36:31.880] I have something now to chase down myself [36:31.880 --> 36:33.880] I'm thinking [36:33.880 --> 36:35.880] And I wanted to mention that LexisNexis [36:35.880 --> 36:40.880] because you're looking for ways of the judges and their assets [36:40.880 --> 36:46.880] I'm just not sure how you go from judges' assets that you're trying to find [36:46.880 --> 36:49.880] to look for fraud or payoffs [36:49.880 --> 36:53.880] and getting access to a private database [36:53.880 --> 36:58.880] but if you know the database is there perhaps you can track it down [36:58.880 --> 37:04.880] The database might be accessible by anybody with a PI license [37:04.880 --> 37:06.880] Interesting [37:06.880 --> 37:08.880] Possible thing there [37:08.880 --> 37:13.880] I'm thinking that in Tina's case [37:13.880 --> 37:17.880] with this woman who had all this property [37:17.880 --> 37:21.880] that she's holding for other people [37:21.880 --> 37:26.880] I wonder if Lexis would have somehow have access to all of that [37:26.880 --> 37:28.880] It may [37:28.880 --> 37:32.880] It depends on how this stuff is registered [37:32.880 --> 37:36.880] The categories that I saw were did you own a boat? [37:36.880 --> 37:38.880] Do you own a car? [37:38.880 --> 37:41.880] Basically any of the ways in which you'd eat green eggs and ham [37:41.880 --> 37:42.880] I would say [37:42.880 --> 37:44.880] the airplanes [37:44.880 --> 37:46.880] all kinds of property [37:46.880 --> 37:52.880] This woman whose filed the bankruptcy would probably be very, very unhappy [37:52.880 --> 37:56.880] to know that that database is out there [37:56.880 --> 38:02.880] It would probably terrify her [38:02.880 --> 38:05.880] So I think Tina may find that really interesting [38:05.880 --> 38:08.880] I suspect she's still listening [38:08.880 --> 38:09.880] Yeah [38:09.880 --> 38:13.880] And if you want to send her my email [38:13.880 --> 38:16.880] I give you my blessing at this moment [38:16.880 --> 38:18.880] Go for it [38:18.880 --> 38:24.880] Should I also include the disclaimer, a weird mark? [38:24.880 --> 38:27.880] Yeah, that's what I mean [38:27.880 --> 38:32.880] I lean into my branding [38:32.880 --> 38:37.880] Okay, you had a comment for Chris [38:37.880 --> 38:41.880] I had a comment for Chris and a comment ultimately for you [38:41.880 --> 38:45.880] So if first off, issues with 5G [38:45.880 --> 38:51.880] that should be a concern for the population [38:51.880 --> 38:54.880] The first is [38:54.880 --> 38:58.880] on one of the bandwidth ends of the 5G [38:58.880 --> 39:02.880] I want to say around 26.5 gigahertz or something [39:02.880 --> 39:08.880] is a magical number that satellites in space use [39:08.880 --> 39:12.880] to see how much water is in the atmosphere [39:12.880 --> 39:17.880] The company that bought that access to that chunk of the bandwidth [39:17.880 --> 39:21.880] of course says, oh, it's not going to be a problem [39:21.880 --> 39:27.880] But as this rolls out, you might find out that part of 5G [39:27.880 --> 39:33.880] will render it harder for us to determine [39:33.880 --> 39:38.880] when it's going to fall, when it's going to happen, et cetera [39:38.880 --> 39:42.880] So a possible thing for activists to be watching [39:42.880 --> 39:46.880] is the government somehow pays that company [39:46.880 --> 39:51.880] for them to not have that bandwidth assigned to them [39:51.880 --> 39:57.880] because I'd be very unhappy that this company paid [39:57.880 --> 40:02.880] a chunk of money with the science being firmly established [40:02.880 --> 40:05.880] could be a problem, saying it's not going to be a problem [40:05.880 --> 40:08.880] And when it turns out to be a problem and the government says [40:08.880 --> 40:13.880] yeah, you need to stop that and then the government pays them [40:13.880 --> 40:18.880] for their losses, that I'm not going to be happy with [40:18.880 --> 40:22.880] But this 5G is still being rolled out [40:22.880 --> 40:25.880] and it's not a known problem yet [40:25.880 --> 40:28.880] But it'd be something for people who are upset [40:28.880 --> 40:32.880] or concerned about 5G to keep an eye on [40:32.880 --> 40:37.880] The second thing on the 5G or the radiation [40:37.880 --> 40:41.880] causing cellular changes and whatever else [40:41.880 --> 40:46.880] A gentleman who goes by the moniker of Thunderfoot [40:46.880 --> 40:50.880] on YouTube pointed this out and righteously so [40:50.880 --> 40:55.880] If these radio frequencies were a problem with cells [40:55.880 --> 40:59.880] it should be noticed with all the various cell culturing [40:59.880 --> 41:03.880] that's being done in laboratories across the planet [41:03.880 --> 41:10.880] And it doesn't seem to be a factor anybody is noticing [41:10.880 --> 41:14.880] at this point in the cell cultures [41:14.880 --> 41:19.880] Now, would it be covered up by everybody? [41:19.880 --> 41:22.880] I don't think the people who do this themselves [41:22.880 --> 41:27.880] or graduate students or master's work [41:27.880 --> 41:31.880] are part of any kind of conspiracy to cover things up [41:31.880 --> 41:36.880] if this radiation is somehow causing problems [41:36.880 --> 41:38.880] So, something to... [41:38.880 --> 41:44.880] Well, on the other hand, if it does turn out to cause problems [41:44.880 --> 41:49.880] these are the very people who are going to raise a red flag [41:49.880 --> 41:54.880] Correct, they're the ones who really have a stake in the game [41:54.880 --> 41:59.880] If I'm a doctoral student and I find this [41:59.880 --> 42:02.880] this could make my career [42:02.880 --> 42:06.880] Exactly, exactly [42:06.880 --> 42:10.880] So, there are things to be concerned about [42:10.880 --> 42:15.880] things like the 5G stuff will allow for ubiquitous data collection [42:15.880 --> 42:18.880] which is going to be a privacy problem [42:18.880 --> 42:22.880] We want to play litigants with 5G [42:22.880 --> 42:26.880] There's a whole burden field [42:26.880 --> 42:33.880] I heard something about where my smartphone [42:33.880 --> 42:37.880] can find all the other smartphones around me [42:37.880 --> 42:41.880] and all the other smart equipment around me [42:41.880 --> 42:42.880] So, if I'm walking... [42:42.880 --> 42:43.880] That's true already [42:43.880 --> 42:46.880] Even without 5G, that's already true [42:46.880 --> 42:51.880] But without 5G that's more poignant, I guess [42:51.880 --> 42:56.880] or acute in this is that it's such a short range [42:56.880 --> 42:59.880] The transmitters don't send very far [42:59.880 --> 43:03.880] It gets attenuated by the oxygen and so it's just a short range [43:03.880 --> 43:06.880] which means your location is pinpoint accuracy [43:06.880 --> 43:10.880] It's not within 30 meters or 100 meters [43:10.880 --> 43:13.880] There's no triangulating, I think we got him [43:13.880 --> 43:18.880] This is right there, pinpoint [43:18.880 --> 43:22.880] In addition to the phones marking on you [43:22.880 --> 43:25.880] by the software that they have [43:25.880 --> 43:29.880] notably Apple and Google are saying [43:29.880 --> 43:32.880] we're pushing updates to the phones [43:32.880 --> 43:37.880] to help track who is breaking quarantine [43:37.880 --> 43:40.880] with the coronavirus [43:40.880 --> 43:45.880] These, those kinds of concerns [43:45.880 --> 43:48.880] they're good valid concerns [43:48.880 --> 43:50.880] that you won't have... [43:50.880 --> 43:53.880] You can't really have people say you're not [43:53.880 --> 43:56.880] because they fist [43:56.880 --> 43:59.880] Okay, hang on, we'll be right back [43:59.880 --> 44:00.880] Okay [44:00.880 --> 44:02.880] Through advances in technology [44:02.880 --> 44:04.880] our lives have greatly improved [44:04.880 --> 44:06.880] except in the area of nutrition [44:06.880 --> 44:09.880] People feed their pets better than they feed themselves [44:09.880 --> 44:11.880] but at the same time we changed all that [44:11.880 --> 44:14.880] Our primary defense against aging and disease [44:14.880 --> 44:17.880] in this toxic environment is good nutrition [44:17.880 --> 44:20.880] In a world where natural foods have been irradiated [44:20.880 --> 44:22.880] adulterated and mutilated [44:22.880 --> 44:25.880] young jevity can provide the nutrients you need [44:25.880 --> 44:27.880] Logo's radio network gets many requests [44:27.880 --> 44:29.880] to endorse all sorts of products [44:29.880 --> 44:31.880] most of which we reject [44:31.880 --> 44:34.880] We have come to trust young jevity so much [44:34.880 --> 44:36.880] We became a marketing distributor [44:36.880 --> 44:39.880] along with Alex Jones, Ben Fuchs and many others [44:39.880 --> 44:42.880] When you order from LogosRadioNetwork.com [44:42.880 --> 44:44.880] your health will improve [44:44.880 --> 44:47.880] as you help support quality radio [44:47.880 --> 44:49.880] As you realize the benefits of young jevity [44:49.880 --> 44:51.880] you may want to join us [44:51.880 --> 44:54.880] As a distributor you can experience improved health [44:54.880 --> 44:56.880] help your friends and family [44:56.880 --> 44:58.880] and increase your income [44:58.880 --> 45:00.880] Order now [45:00.880 --> 45:03.880] Are you the plaintiff or defendant in a lawsuit? [47:14.880 --> 47:18.880] Well, the pride that you can see that with your [47:18.880 --> 47:20.880] old eyes and that [47:20.880 --> 47:23.880] Okay, I got, you know [47:23.880 --> 47:26.880] you just can't get decent glasses [47:26.880 --> 47:28.880] for two dollars anymore [47:28.880 --> 47:30.880] What is the deal? [47:30.880 --> 47:32.880] Yeah, go to the dollar store [47:32.880 --> 47:34.880] and get the decent ones for a dollar [47:34.880 --> 47:37.880] I got these off eBay and they cost me two dollars [47:37.880 --> 47:39.880] and fifty cents [47:39.880 --> 47:42.880] but they got the blue 10 on it for it [47:42.880 --> 47:44.880] The computer stuff [47:44.880 --> 47:46.880] They do look kinda girlish [47:46.880 --> 47:49.880] but I'm on the radio, who can tell? [47:49.880 --> 47:53.880] You know, I believe Eddie said you had the face for radio [47:53.880 --> 47:57.880] No, that was Pastor Massad and he should know [47:57.880 --> 48:01.880] Definitely have a face made for radio [48:01.880 --> 48:05.880] I bought glasses and went to get 500 bucks for glasses [48:05.880 --> 48:08.880] I went to Chicago [48:08.880 --> 48:12.880] Second week I had them, they evaporated [48:12.880 --> 48:14.880] I came back and asked them [48:14.880 --> 48:17.880] are these things guaranteed against evaporation [48:17.880 --> 48:20.880] and she said, what? [48:20.880 --> 48:23.880] I said, yeah, are they guaranteed against evaporation? [48:23.880 --> 48:25.880] She didn't know what I was talking about [48:25.880 --> 48:28.880] I said, I was sitting in this beer joint on Navy beer [48:28.880 --> 48:30.880] at this convention [48:30.880 --> 48:33.880] and I only had six beers [48:33.880 --> 48:37.880] and my glasses, they just evaporated [48:37.880 --> 48:40.880] They wouldn't cover it [48:40.880 --> 48:43.880] Oh well, nothing bad [48:43.880 --> 48:45.880] Imagine that [48:45.880 --> 48:48.880] I said that they grew legs and walked off [48:48.880 --> 48:51.880] but, you know, evaporation [48:51.880 --> 48:53.880] Anyways [48:53.880 --> 48:56.880] So I think that covers the comments I would have [48:56.880 --> 48:59.880] on the other two callers [48:59.880 --> 49:04.880] Do you have anything on the 5G [49:04.880 --> 49:08.880] 25 gigahertz band [49:08.880 --> 49:10.880] and affecting biology? [49:10.880 --> 49:13.880] Do you have anything on that? [49:13.880 --> 49:17.880] Once you get to terahertz radiation [49:17.880 --> 49:19.880] there's an MIT study [49:19.880 --> 49:22.880] showing the low levels of energy [49:22.880 --> 49:25.880] that unzip DNA [49:25.880 --> 49:28.880] So, but in that... [49:28.880 --> 49:30.880] That's kilohertz [49:30.880 --> 49:35.880] No, no, this is the stuff they use in the [49:35.880 --> 49:40.880] the fondler scanners [49:40.880 --> 49:43.880] and the frequencies are used in the fondling scanners [49:43.880 --> 49:46.880] at the airports [49:46.880 --> 49:49.880] Okay, but if it's kilohertz, you know, that's a thousand... [49:49.880 --> 49:53.880] That's way small compared to gigahertz [49:53.880 --> 49:55.880] The... [49:55.880 --> 49:57.880] It's the high gigahertz... [49:57.880 --> 49:59.880] It's the next one up than gigahertz [49:59.880 --> 50:02.880] terahertz, I believe [50:02.880 --> 50:05.880] Terahertz is the next step up from gigahertz [50:05.880 --> 50:07.880] if I remember correctly [50:07.880 --> 50:11.880] Right. The terahertz radiation [50:11.880 --> 50:14.880] or radio frequencies apparently could [50:14.880 --> 50:17.880] unzip DNA based on an MIT study [50:17.880 --> 50:21.880] which was relevant when people were worried about [50:21.880 --> 50:25.880] the fondler scanners or porno scanners in the airports [50:25.880 --> 50:28.880] Can I say porno scanners? [50:28.880 --> 50:34.880] Yeah, I went through all my... [50:34.880 --> 50:37.880] But I heard that, I hadn't... [50:37.880 --> 50:40.880] Obviously, the government says absolutely not [50:40.880 --> 50:44.880] they're perfectly harmless, but you never see these guys getting in them [50:44.880 --> 50:49.880] I generally object to it, I objected to it in Australia [50:49.880 --> 50:52.880] and [50:52.880 --> 50:55.880] they wanted to do a full body search [50:55.880 --> 50:59.880] The guy gets down in front of me on his knees [50:59.880 --> 51:02.880] with rubber gloves on [51:02.880 --> 51:07.880] and I told him that, you know, I have an aversion [51:07.880 --> 51:12.880] to a guy touching certain parts of my anatomy [51:12.880 --> 51:15.880] and he says, I have to do this search [51:15.880 --> 51:19.880] Oh, that's no problem, just get that good looking blonde over there to do it [51:19.880 --> 51:22.880] And the guy looked at her and he looked back at me [51:22.880 --> 51:26.880] and I could tell he's trying to figure out [51:26.880 --> 51:29.880] how do I argue this issue? [51:29.880 --> 51:32.880] He said, you're just Josh and me [51:32.880 --> 51:36.880] I said, yeah, yanks, go ahead [51:36.880 --> 51:39.880] He decided not to search me [51:39.880 --> 51:42.880] Anyway, that's when I got off a plane in Australia [51:42.880 --> 51:44.880] and went to customs [51:44.880 --> 51:48.880] and the woman said, well, Mr. Kelton, is this your first time in Australia? [51:48.880 --> 51:50.880] Yes, it is [51:50.880 --> 51:52.880] Where are you going in Australia? [51:52.880 --> 51:55.880] I said, well, I don't know [51:55.880 --> 51:58.880] You don't know, no, I don't know [51:58.880 --> 52:00.880] Well, is someone picking me up? [52:00.880 --> 52:02.880] Yeah, yeah, someone's picking me up [52:02.880 --> 52:04.880] Well, who's picking you up? [52:04.880 --> 52:07.880] Well, I don't know [52:07.880 --> 52:11.880] You came 12,000 miles and you don't know? [52:11.880 --> 52:13.880] Well, yeah [52:13.880 --> 52:16.880] Stamped my thing, yanks [52:16.880 --> 52:19.880] Sit me through [52:19.880 --> 52:22.880] They picked me up at the airport [52:22.880 --> 52:25.880] and all the way through Sydney [52:25.880 --> 52:29.880] on the wrong side of the road [52:29.880 --> 52:32.880] Crazy people there [52:32.880 --> 52:35.880] Okay, go ahead, I'll stop making jokes [52:35.880 --> 52:37.880] It's that ginger I put in the teeth [52:37.880 --> 52:39.880] making me nuts [52:39.880 --> 52:41.880] That's okay [52:41.880 --> 52:45.880] I'm willing to help enable the industry [52:45.880 --> 52:47.880] Anyway [52:47.880 --> 52:52.880] So the particular frequencies being used by 5G [52:52.880 --> 52:55.880] I am unaware of any studies [52:55.880 --> 53:03.880] but it is telling that the people who make the tablets [53:03.880 --> 53:05.880] and the cell phones [53:05.880 --> 53:08.880] limit their children's exposure to them [53:08.880 --> 53:10.880] I don't know if that's the RS [53:10.880 --> 53:17.880] or the cognitive interactions with the technology [53:17.880 --> 53:21.880] The radio program or radio [53:21.880 --> 53:24.880] a podcast, Jordan Harbinger [53:24.880 --> 53:27.880] had an Australian [53:27.880 --> 53:33.880] who was famed for his ability to sell people things [53:33.880 --> 53:36.880] and he was a salesman, salesman or something [53:36.880 --> 53:38.880] and he made the claim that [53:38.880 --> 53:42.880] autopsies of the youth today [53:42.880 --> 53:48.880] show a 10% change in the section of the brain [53:48.880 --> 53:51.880] involved with the recognition of faces [53:51.880 --> 53:54.880] and interfacing with humans [53:54.880 --> 53:57.880] I don't know if that's true [53:57.880 --> 54:00.880] but it's an interesting claim that was made [54:00.880 --> 54:03.880] on a podcast by a guy [54:03.880 --> 54:06.880] Wait, wait, now if it's on a podcast on the internet [54:06.880 --> 54:08.880] it has to be true [54:08.880 --> 54:11.880] Well, it's the podcast or the new Usenet [54:11.880 --> 54:14.880] I mean, if it was said on Usenet, it must be true [54:14.880 --> 54:17.880] I haven't heard that before [54:17.880 --> 54:20.880] Oh, the Usenet [54:20.880 --> 54:23.880] Usenet is how we used to talk about things [54:23.880 --> 54:25.880] years and years ago [54:25.880 --> 54:27.880] I remember Usenet [54:27.880 --> 54:29.880] Yeah [54:29.880 --> 54:32.880] So if it was said on Usenet, it must be true [54:32.880 --> 54:34.880] Must be true [54:34.880 --> 54:35.880] Must be true [54:35.880 --> 54:37.880] So [54:37.880 --> 54:41.880] I see that covers everything that I had on your two callers [54:41.880 --> 54:45.880] So now we'll go to my particular question [54:45.880 --> 54:50.880] First, on the request for a declaratory judgment [54:50.880 --> 54:52.880] one of your maxims is [54:52.880 --> 54:57.880] try to limit your request for things to one item [54:57.880 --> 55:03.880] But could I have a declaratory judgment suit [55:03.880 --> 55:08.880] and ask for a declaratory judgment on multiple things? [55:08.880 --> 55:12.880] Yes, but the problem with that is [55:12.880 --> 55:18.880] is the judge is likely to answer one and ignore the rest [55:18.880 --> 55:20.880] Now, what... [55:20.880 --> 55:23.880] If I file some of your more obnoxious notices [55:23.880 --> 55:27.880] plus my own obnoxious notices [55:27.880 --> 55:32.880] and, you know, demand a full hearing, blah, blah, blah, blah, blah, blah, blah [55:32.880 --> 55:37.880] might give me enough traction to have them answer all of them [55:37.880 --> 55:39.880] Yes [55:39.880 --> 55:42.880] You can... There's a way to do that [55:42.880 --> 55:46.880] It just makes the suit a lot more complex [55:46.880 --> 55:51.880] Generally, the strategy I like to use for a declaratory judgment [55:51.880 --> 55:57.880] is you pick something that if you get that ruling in your favor [55:57.880 --> 56:04.880] you have a claim on which recovery can be had [56:04.880 --> 56:07.880] That's resjudicata [56:07.880 --> 56:08.880] Right [56:08.880 --> 56:12.880] Now you can go in with a regular suit [56:12.880 --> 56:14.880] and bring up all your other claims [56:14.880 --> 56:18.880] and it can't be kicked out with a 12B6 [56:18.880 --> 56:20.880] Okay [56:20.880 --> 56:26.880] The main thing about the declaratory judgment is avoiding 12B6 [56:26.880 --> 56:31.880] dismissal for failure to stay to claim on which recovery can be had [56:31.880 --> 56:34.880] If you have declaratory judgment [56:34.880 --> 56:40.880] that this wrong was done to you by this party [56:40.880 --> 56:43.880] that's resjudicata, it's a done deal [56:43.880 --> 56:48.880] Now it's all about how much the damages are [56:48.880 --> 56:50.880] So it can't be thrown out [56:50.880 --> 56:55.880] Once that locks it into court, your other claims get to go with it [56:55.880 --> 57:00.880] But if... You know, every suit is different [57:00.880 --> 57:04.880] every situation is different [57:04.880 --> 57:10.880] You can always use findings of fact and conclusions at law [57:10.880 --> 57:15.880] If they give you a ruling that doesn't address everything [57:15.880 --> 57:19.880] or doesn't address everything well [57:19.880 --> 57:21.880] if it just glosses over something [57:21.880 --> 57:25.880] then you come back with a petition for emotion [57:25.880 --> 57:27.880] for findings of fact and conclusions at law [57:27.880 --> 57:30.880] for findings of fact and conclusions [57:30.880 --> 57:35.880] Ask the court to accept yours or provide their own [57:35.880 --> 57:39.880] So now you've put the judge up on the dime [57:39.880 --> 57:45.880] You can't just not accept yours and then not explain [57:45.880 --> 57:47.880] Okay [57:47.880 --> 57:49.880] Now [57:49.880 --> 57:54.880] Normally the dismissal for [57:54.880 --> 58:00.880] and claims of which nothing can be had [58:00.880 --> 58:03.880] 12B, motion 12B [58:03.880 --> 58:06.880] that should not apply at all [58:06.880 --> 58:10.880] if you're going ahead and going after a creditor [58:10.880 --> 58:14.880] for violations of the Fair Debt Collections Practices Act [58:14.880 --> 58:18.880] or the various rules there, correct? [58:18.880 --> 58:22.880] Yeah, no, they'll still get you with a 12B6 [58:22.880 --> 58:23.880] They will [58:23.880 --> 58:28.880] Oh yeah, they'll file a 12B6 on any claim [58:28.880 --> 58:32.880] and the judge uses his discretion to clear his docket [58:32.880 --> 58:36.880] If you're a prosaed, he's going to rule against you [58:36.880 --> 58:37.880] Okay [58:37.880 --> 58:41.880] So you do a declaratory judgment and you hamstring him [58:41.880 --> 58:46.880] Alright, well then I will take the declaratory judgment path [58:46.880 --> 58:49.880] for a Fair Debt [58:49.880 --> 58:53.880] Would you like to make more definite progress in your walk with God? [01:00:59.880 --> 01:01:03.880] Today in History. [01:01:03.880 --> 01:01:07.880] And recent news, since Governor Greg Abbott signed House Bill 1325 [01:01:07.880 --> 01:01:10.880] legalizing heaven attacks his law back in June [01:01:10.880 --> 01:01:13.880] County prosecutors around the state including Houston, Austin [01:01:13.880 --> 01:01:16.880] and San Antonio have been dropping marijuana possession charges [01:01:16.880 --> 01:01:19.880] and even refusing to file new ones since they are stipulating [01:01:19.880 --> 01:01:22.880] that they do not have the time or the laboratory equipment [01:01:22.880 --> 01:01:24.880] to test the herb for THC. [01:01:24.880 --> 01:01:26.880] Margaret Moore, the Travis County District Attorney [01:01:26.880 --> 01:01:28.880] announced earlier this month that she was dismissing [01:01:28.880 --> 01:01:31.880] 32 felony possession and delivery of marijuana cases [01:01:31.880 --> 01:01:33.880] because of the law. [01:01:33.880 --> 01:01:35.880] Mr. Abbott and other state officials including [01:01:35.880 --> 01:01:37.880] the Attorney General stipulated in a letter [01:01:37.880 --> 01:01:40.880] that County District Attorney's back on Thursday that [01:01:40.880 --> 01:01:42.880] marijuana has not been decriminalized in Texas [01:01:42.880 --> 01:01:45.880] and that these actions demonstrate a misunderstanding [01:01:45.880 --> 01:01:49.880] of how HB 1325 works as well as other cities too [01:01:49.880 --> 01:01:52.880] like the District Attorney in El Paso, [01:01:52.880 --> 01:01:55.880] Kyma Esparza, a Democrat who also stated earlier this month [01:01:55.880 --> 01:01:58.880] that the law quote will not have an effect [01:01:58.880 --> 01:02:01.880] on the prosecution of marijuana cases in El Paso. [01:02:01.880 --> 01:02:04.880] However, the issue was succinctly summarized by Mr. Brandon Ball [01:02:04.880 --> 01:02:07.880] an assistant public defender in Harris County [01:02:07.880 --> 01:02:09.880] who stated that quote, the law is constantly changing [01:02:09.880 --> 01:02:12.880] on what makes something illegal based on its chemical makeup. [01:02:12.880 --> 01:02:15.880] It's important that if someone is charged with something [01:02:15.880 --> 01:02:18.880] the test matches what they're charged with. [01:02:18.880 --> 01:02:23.880] A paper by Tulane University [01:02:23.880 --> 01:02:26.880] identified a five and a half inch American pocket shark [01:02:26.880 --> 01:02:29.880] as the first of its kind in the Gulf of Mexico, [01:02:29.880 --> 01:02:32.880] the specimen being only the second pocket shark [01:02:32.880 --> 01:02:35.880] ever captured or recorded with the other one being found [01:02:35.880 --> 01:02:38.880] way back in 1979 in the East Pacific Ocean. [01:02:38.880 --> 01:02:41.880] According to the university paper, the shark secretes [01:02:41.880 --> 01:02:44.880] a luminous fluid from a gland near its front fins [01:02:44.880 --> 01:02:48.880] for the purpose it is hypothesized to lure and prey [01:02:48.880 --> 01:02:50.880] who may be drawn into the glow. [01:02:50.880 --> 01:03:03.880] This is Ruth Rodeo with your loadout for July 22nd, 2019. [01:03:03.880 --> 01:03:23.880] Okay, we are back. [01:03:23.880 --> 01:03:27.880] Randy Kelton, Brett Fountain, Ruth Rodeo [01:03:27.880 --> 01:03:30.880] and my slider's not coming down. [01:03:30.880 --> 01:03:33.880] Okay, got it. I have two sliders. [01:03:33.880 --> 01:03:37.880] I have to tweak them down to get the bumper music to back off. [01:03:37.880 --> 01:03:40.880] It's arguing with me today. [01:03:40.880 --> 01:03:44.880] Okay, Mark, did you have anything else for us? [01:03:44.880 --> 01:03:50.880] Yes, final question on a strategy idea. [01:03:50.880 --> 01:03:55.880] As you are well aware, the bar grievances [01:03:55.880 --> 01:03:58.880] ultimately thrown in trash, they don't care. [01:03:58.880 --> 01:04:02.880] The Supreme Court's position when you want to bring an issue [01:04:02.880 --> 01:04:11.880] to them in any kind of way to bypass the bar grievance, [01:04:11.880 --> 01:04:13.880] they just say, no, we're not even going to look at it, [01:04:13.880 --> 01:04:15.880] go with the bar grievance. [01:04:15.880 --> 01:04:19.880] And then a maxim of a gentleman named Ken White, [01:04:19.880 --> 01:04:24.880] who goes by pull-pass, he always says it's never RECA. [01:04:24.880 --> 01:04:29.880] But I do like this idea. [01:04:29.880 --> 01:04:33.880] What about if you found that lawyers were working with one [01:04:33.880 --> 01:04:38.880] of their clients to fake evidence in a lawsuit? [01:04:38.880 --> 01:04:42.880] That strikes me as crying of some kind. [01:04:42.880 --> 01:04:45.880] Absolutely. [01:04:45.880 --> 01:04:48.880] All right. [01:04:48.880 --> 01:04:51.880] And the evidence that I found was good enough [01:04:51.880 --> 01:04:55.880] that it got put in the federal court system, [01:04:55.880 --> 01:05:00.880] the bankruptcy court system as a sealed record. [01:05:00.880 --> 01:05:05.880] I'm thinking of using Wisconsin's 96801. [01:05:05.880 --> 01:05:08.880] 96801 says, you know, if you come up with, [01:05:08.880 --> 01:05:13.880] or the 96801 series, basically, if you think you've got a crime, [01:05:13.880 --> 01:05:17.880] you can take it to a judge or the DEA, [01:05:17.880 --> 01:05:21.880] and you file your criminal complaint with them. [01:05:21.880 --> 01:05:25.880] What I'm thinking is going ahead and filing [01:05:25.880 --> 01:05:28.880] since everything, and you've also stated, [01:05:28.880 --> 01:05:30.880] one should not do everything remotely [01:05:30.880 --> 01:05:34.880] and never appear in front of these people. [01:05:34.880 --> 01:05:37.880] With coronavirus right now, [01:05:37.880 --> 01:05:42.880] the state is allowing pleadings and swearing [01:05:42.880 --> 01:05:45.880] to be done remotely. [01:05:45.880 --> 01:05:47.880] So I'm entertaining, [01:05:47.880 --> 01:05:50.880] sending to the Supreme Court of Wisconsin [01:05:50.880 --> 01:05:54.880] the criminal charges about what the lawyers did [01:05:54.880 --> 01:05:57.880] and go ahead and list all of the partners [01:05:57.880 --> 01:06:02.880] and claim Wisconsin's version of repo. [01:06:02.880 --> 01:06:05.880] I know damn well nothing's going to happen, [01:06:05.880 --> 01:06:07.880] but what do you think? [01:06:07.880 --> 01:06:13.880] I think it puts a big time mark on their chart. [01:06:13.880 --> 01:06:15.880] Okay, you've already sued them, [01:06:15.880 --> 01:06:18.880] so you don't have that option. [01:06:18.880 --> 01:06:26.880] What duty does the Wisconsin Supreme have as magistrates? [01:06:26.880 --> 01:06:30.880] Well, certainly they have a duty. [01:06:30.880 --> 01:06:33.880] Wisconsin has a duty to be, [01:06:33.880 --> 01:06:37.880] what should happen when you pull this 96801 song and dance [01:06:37.880 --> 01:06:39.880] and pulse it on their pants. [01:06:39.880 --> 01:06:42.880] What should happen is that they decide [01:06:42.880 --> 01:06:50.880] whether or not they are going to send the complaint to the DA. [01:06:50.880 --> 01:06:54.880] The DA then can decide whether they're going to prosecute or not. [01:06:54.880 --> 01:06:56.880] If they decide not to prosecute, [01:06:56.880 --> 01:06:58.880] it goes back to the judge, [01:06:58.880 --> 01:07:00.880] and the judge then can therefore say, [01:07:00.880 --> 01:07:04.880] you know what, we're going to throw it to a grand jury, [01:07:04.880 --> 01:07:05.880] or the judge could say, [01:07:05.880 --> 01:07:07.880] we're throwing it to a grand jury right away. [01:07:07.880 --> 01:07:10.880] And at the point where it comes back, [01:07:10.880 --> 01:07:12.880] if it comes back from the DA, [01:07:12.880 --> 01:07:14.880] the judge goes, [01:07:14.880 --> 01:07:16.880] my duty was to send it to the DA or grand jury. [01:07:16.880 --> 01:07:18.880] I did my duty. [01:07:18.880 --> 01:07:20.880] Bye. [01:07:20.880 --> 01:07:27.880] So you don't have direct access to a grand jury in Wisconsin? [01:07:27.880 --> 01:07:30.880] We have grand juries around the books, [01:07:30.880 --> 01:07:35.880] but I can find evidence of meetings of grand juries. [01:07:35.880 --> 01:07:40.880] So you might want to take them to the feds. [01:07:40.880 --> 01:07:42.880] You can go straight to grand jury in the feds. [01:07:42.880 --> 01:07:45.880] We have to fight your way past the U.S. attorney, [01:07:45.880 --> 01:07:48.880] but you can still go to them. [01:07:48.880 --> 01:07:50.880] Okay. [01:07:50.880 --> 01:07:53.880] The last thing is an observation. [01:07:53.880 --> 01:07:59.880] You had a person on your show three, four years ago [01:07:59.880 --> 01:08:04.880] talk about judges being corrupt with payoffs and mortgages. [01:08:04.880 --> 01:08:09.880] And then in the December timeframe of last year, [01:08:09.880 --> 01:08:14.880] you'd mentioned this and had talked about the whole idea [01:08:14.880 --> 01:08:16.880] of tracking your financials, [01:08:16.880 --> 01:08:20.880] which is part of the reason I mentioned the Lexus Nexus thing, [01:08:20.880 --> 01:08:23.880] but I also wanted to mention this. [01:08:23.880 --> 01:08:30.880] The source code for Muckrock is available on GitHub. [01:08:30.880 --> 01:08:35.880] And Muckrock's purpose is tracking and this would be of interest [01:08:35.880 --> 01:08:39.880] to your co-host this evening. [01:08:39.880 --> 01:08:43.880] Muckrock's purpose is to track and help handle [01:08:43.880 --> 01:08:47.880] public information requests and FOIAs. [01:08:47.880 --> 01:08:55.880] And so what about the idea of setting up Muckrock's version of code [01:08:55.880 --> 01:09:03.880] for tracking the financial requests of all of these judges? [01:09:03.880 --> 01:09:07.880] Can you send me a link to Muckrock? [01:09:07.880 --> 01:09:10.880] I had sent you... [01:09:10.880 --> 01:09:13.880] M-U-C-K-R-O-C-K? [01:09:13.880 --> 01:09:15.880] Yep. [01:09:15.880 --> 01:09:18.880] Okay, nothing on GitHub. [01:09:18.880 --> 01:09:20.880] Mark, you're saying this... [01:09:20.880 --> 01:09:26.880] Why don't we track which requests, financial requests of judges? [01:09:26.880 --> 01:09:28.880] Well, in your particular case, [01:09:28.880 --> 01:09:32.880] since you like filing public information requests and such, [01:09:32.880 --> 01:09:34.880] the software helps you manage it. [01:09:34.880 --> 01:09:37.880] So it would work for you in that regard. [01:09:37.880 --> 01:09:44.880] But in general, what Muckrock does as a societal benefit is [01:09:44.880 --> 01:09:47.880] you pay them a small fee, [01:09:47.880 --> 01:09:51.880] and then what they do is they track and help you [01:09:51.880 --> 01:09:56.880] stand top of the public information request [01:09:56.880 --> 01:09:59.880] and ultimately try to help you hook up with lawyers [01:09:59.880 --> 01:10:02.880] who have an interest, et cetera, et cetera, et cetera. [01:10:02.880 --> 01:10:04.880] So if you're searching Muckrock, [01:10:04.880 --> 01:10:07.880] you can find things that others have gotten with FOIA [01:10:07.880 --> 01:10:09.880] or public information requests. [01:10:09.880 --> 01:10:14.880] Since I'm sure you are a thrifty man in their breath, [01:10:14.880 --> 01:10:18.880] if you set up the source code yourself on your own machines, [01:10:18.880 --> 01:10:21.880] then you can track your own request and you're not paying Muckrock. [01:10:21.880 --> 01:10:23.880] In the particular case, [01:10:23.880 --> 01:10:25.880] it's multiple people who are asking judges, [01:10:25.880 --> 01:10:27.880] hey, what you want? [01:10:27.880 --> 01:10:29.880] Where do you want that? [01:10:29.880 --> 01:10:32.880] And so in version of the Muckrock code, [01:10:32.880 --> 01:10:35.880] making that information available, [01:10:35.880 --> 01:10:38.880] then whatever can be charged or not charged. [01:10:38.880 --> 01:10:41.880] And it's possible you will have individuals [01:10:41.880 --> 01:10:44.880] if that stuff is more publicly available [01:10:44.880 --> 01:10:46.880] via that software stack. [01:10:46.880 --> 01:10:49.880] You'd have people maybe be able to go, [01:10:49.880 --> 01:10:54.880] oh, I know the judge has this other thing. [01:10:54.880 --> 01:10:58.880] Do you have a copy of my motion for that, [01:10:58.880 --> 01:11:02.880] my discovery motion for judges' financial information? [01:11:02.880 --> 01:11:03.880] Yes. [01:11:03.880 --> 01:11:04.880] Yes. [01:11:04.880 --> 01:11:07.880] You sent me that a long time ago. [01:11:07.880 --> 01:11:09.880] So I haven't copied that. [01:11:09.880 --> 01:11:13.880] But I believe I just can't serve that on a judge willy-nilly. [01:11:13.880 --> 01:11:15.880] I've got to have that as part of the case. [01:11:15.880 --> 01:11:17.880] Do I not? [01:11:17.880 --> 01:11:18.880] No. [01:11:18.880 --> 01:11:20.880] Or just send that to any damn judge. [01:11:20.880 --> 01:11:24.880] Well, if he's, yeah, it needs to be in a case. [01:11:24.880 --> 01:11:28.880] You can file it with a judge as an information request. [01:11:28.880 --> 01:11:30.880] But if you're in a case and he's the judge, [01:11:30.880 --> 01:11:32.880] then you can file it with, [01:11:32.880 --> 01:11:35.880] you can just file it in the case itself. [01:11:35.880 --> 01:11:38.880] He's going to ignore it. [01:11:38.880 --> 01:11:41.880] But at least it tells him you're looking behind the curtain. [01:11:41.880 --> 01:11:46.880] If you can find any other ways of laundering hush money, [01:11:46.880 --> 01:11:48.880] stick them in there. [01:11:48.880 --> 01:11:50.880] Okay. [01:11:50.880 --> 01:11:53.880] I'll put in everything I could find. [01:11:53.880 --> 01:11:55.880] Okay, I do need to be along. [01:11:55.880 --> 01:11:58.880] I've got three more callers and I'm running out of time. [01:11:58.880 --> 01:12:00.880] Don't be such a stranger, Mark. [01:12:00.880 --> 01:12:02.880] Thanks for your input. [01:12:02.880 --> 01:12:04.880] The winds of the desert be at your back [01:12:04.880 --> 01:12:06.880] and the sun always leave you in the shade. [01:12:06.880 --> 01:12:09.880] Thank you, Mark. [01:12:09.880 --> 01:12:11.880] Bye-bye. [01:12:11.880 --> 01:12:14.880] Okay, now we're going to Ted Scarlett. [01:12:14.880 --> 01:12:17.880] Ted, what do you have for us today? [01:12:17.880 --> 01:12:21.880] Well, Randy, I just thought I'd call in and say, hey, [01:12:21.880 --> 01:12:24.880] it's been a while. [01:12:24.880 --> 01:12:27.880] So I take it you haven't been back to court. [01:12:27.880 --> 01:12:30.880] What's the latest that happened? [01:12:30.880 --> 01:12:34.880] On April 6th, [01:12:34.880 --> 01:12:40.880] that was supposed to be my trial date, April 6th. [01:12:40.880 --> 01:12:47.880] That trial date was set in a hearing around January 22nd. [01:12:47.880 --> 01:12:52.880] So with the virus thing, I knew the courts were closed, [01:12:52.880 --> 01:12:54.880] but I went down there. [01:12:54.880 --> 01:12:58.880] The deputies weren't letting anybody even in the building, [01:12:58.880 --> 01:13:02.880] but you know me, I got in the building. [01:13:02.880 --> 01:13:07.880] You know, Randy, police law enforcement are taught [01:13:07.880 --> 01:13:11.880] to take the position of authority, [01:13:11.880 --> 01:13:14.880] and I just took a higher position over these deputies [01:13:14.880 --> 01:13:16.880] and told them how it was. [01:13:16.880 --> 01:13:18.880] So they let me in the building. [01:13:18.880 --> 01:13:20.880] I went down to the courtroom, [01:13:20.880 --> 01:13:22.880] and I didn't have to raise my voice. [01:13:22.880 --> 01:13:24.880] I was nice about the whole thing, [01:13:24.880 --> 01:13:27.880] but I went down, of course, verified the doors are closed, [01:13:27.880 --> 01:13:33.880] verified that there's no employees in the court clerk's office, [01:13:33.880 --> 01:13:38.880] so any papers I wanted to file, there's no way to do it. [01:13:38.880 --> 01:13:45.880] I had one witness I wanted to be there just to verify [01:13:45.880 --> 01:13:48.880] that I appeared at the appointed time for trial, [01:13:48.880 --> 01:13:50.880] and it didn't happen. [01:13:50.880 --> 01:13:53.880] So that was April 6th, [01:13:53.880 --> 01:13:57.880] and I also took a photograph in front of the court building there [01:13:57.880 --> 01:14:03.880] and planned on getting an affidavit from the one witness that showed up. [01:14:03.880 --> 01:14:09.880] Now, the public defender is still interfering with my case. [01:14:09.880 --> 01:14:12.880] I'm still suing him in the state court, [01:14:12.880 --> 01:14:19.880] and I'm suing the prosecutor, the deputy prosecutor. [01:14:19.880 --> 01:14:26.880] I'm suing him on a, it's a no-suit right of review in federal court, [01:14:26.880 --> 01:14:29.880] and all I'm asking is a review of the arrest warrant, [01:14:29.880 --> 01:14:32.880] which there is no valid arrest warrant. [01:14:32.880 --> 01:14:36.880] So, of course, the federal judge is looking for a way. [01:14:36.880 --> 01:14:38.880] Lucy Coe, she's a criminal. [01:14:38.880 --> 01:14:40.880] She's the federal judge. [01:14:40.880 --> 01:14:42.880] She's a straight-up criminal, [01:14:42.880 --> 01:14:45.880] and has no fear because her husband, [01:14:45.880 --> 01:14:53.880] who's a green card, is on the California Supreme Court. [01:14:53.880 --> 01:14:56.880] And you wonder why we have problems out here, [01:14:56.880 --> 01:15:03.880] and I just, these, they've got their spouses in positions above them. [01:15:03.880 --> 01:15:05.880] I could go down a whole list of judges. [01:15:05.880 --> 01:15:07.880] That's the case. [01:15:07.880 --> 01:15:09.880] Okay, like Judge Mnuchin in Superior Court, [01:15:09.880 --> 01:15:12.880] his wife sits on the appellate court. [01:15:12.880 --> 01:15:15.880] So, his grew up, go to his wife. [01:15:15.880 --> 01:15:19.880] Anyway, back to my case. [01:15:19.880 --> 01:15:22.880] I've been monitoring the court, [01:15:22.880 --> 01:15:27.880] and one disturbing thing was you're now able to go online [01:15:27.880 --> 01:15:29.880] and look at the docket sheet. [01:15:29.880 --> 01:15:32.880] It's similar to a federal docket sheet, Randy. [01:15:32.880 --> 01:15:34.880] That's how they've laid it out. [01:15:34.880 --> 01:15:41.880] And you, I looked at it prior to the April 6th trial date, [01:15:41.880 --> 01:15:46.880] and of course, it was docketed there, April 6th, 8.30 a.m., [01:15:46.880 --> 01:15:51.880] a master trial calendar. [01:15:51.880 --> 01:15:56.880] The Thursday before April 6th, at the end of the day, [01:15:56.880 --> 01:15:58.880] I got a call from the public defender. [01:15:58.880 --> 01:15:59.880] I don't ever take his calls. [01:15:59.880 --> 01:16:02.880] I let him leave harassing messages. [01:16:02.880 --> 01:16:09.880] And he left another one saying that this case was continued, [01:16:09.880 --> 01:16:13.880] or I'll have to go back to get his exact words. [01:16:13.880 --> 01:16:17.880] Now, I understand there's a pandemic, [01:16:17.880 --> 01:16:21.880] and I understand various things that they've done, [01:16:21.880 --> 01:16:27.880] but I, so I then, after going to court, [01:16:27.880 --> 01:16:30.880] on Monday, April 6th, [01:16:30.880 --> 01:16:33.880] I then came back and looked online again. [01:16:33.880 --> 01:16:40.880] They have completely erased any evidence of a date [01:16:40.880 --> 01:16:43.880] for trial on April 6th. [01:16:43.880 --> 01:16:46.880] And your music's playing. [01:16:46.880 --> 01:16:48.880] Okay, hang on. [01:16:48.880 --> 01:16:52.880] Go to our sponsors, Randy Kelton, Brett Fountain, [01:16:52.880 --> 01:16:54.880] Rula Radio. [01:16:54.880 --> 01:16:59.880] We'll be right back. [01:16:59.880 --> 01:17:02.880] Are you being harassed by debt collectors [01:17:02.880 --> 01:17:05.880] by phone calls, letters, or even lawsuits? [01:18:00.880 --> 01:18:02.880] Without the shows on this network, [01:18:02.880 --> 01:18:04.880] I'd be almost as ignorant as my friends. [01:18:04.880 --> 01:18:07.880] I'm so addicted to the truth now that there's no going back. [01:18:07.880 --> 01:18:08.880] I need my truth pay. [01:18:08.880 --> 01:18:10.880] I'd be lost without logos, [01:18:10.880 --> 01:18:13.880] and I really want to help keep this network on the air. [01:18:13.880 --> 01:18:15.880] I'd love to volunteer as a show producer, [01:18:15.880 --> 01:18:16.880] but I'm a bit of a Luddite, [01:18:16.880 --> 01:18:18.880] and I really don't have any money to give [01:18:18.880 --> 01:18:20.880] because I spent it all on supplements. [01:18:20.880 --> 01:18:21.880] How can I help logos? [01:18:21.880 --> 01:18:23.880] Well, I'm glad you asked. [01:18:43.880 --> 01:18:44.880] Do I pay extra? [01:18:44.880 --> 01:18:45.880] No. [01:18:45.880 --> 01:18:47.880] Do you have to do anything different when I order? [01:18:47.880 --> 01:18:48.880] No. [01:18:48.880 --> 01:18:49.880] Can I use my Amazon Prime? [01:18:49.880 --> 01:18:50.880] No. [01:18:50.880 --> 01:18:51.880] I mean, yes. [01:18:51.880 --> 01:18:54.880] Wow, giving without doing anything or spending any money. [01:18:54.880 --> 01:18:55.880] This is perfect. [01:18:55.880 --> 01:18:56.880] Thank you so much. [01:18:56.880 --> 01:18:58.880] We are Logos. [01:18:58.880 --> 01:19:00.880] Happy holidays, Logos. [01:19:00.880 --> 01:19:06.880] This is the Logos Logos Radio Network. [01:19:12.880 --> 01:19:14.880] Oh, come on. [01:19:14.880 --> 01:19:25.880] Okay, we are back. [01:19:25.880 --> 01:19:27.880] Randy Kelton, Brett Fountain, [01:19:27.880 --> 01:19:29.880] Rue de la Radio on this, [01:19:29.880 --> 01:19:34.880] the 17th day of April, 2020. [01:19:34.880 --> 01:19:37.880] And we're talking to Ted in California. [01:19:37.880 --> 01:19:40.880] Okay, Ted, where were we? [01:19:40.880 --> 01:19:44.880] So, as I explained, I had a file on April 6th. [01:19:44.880 --> 01:19:46.880] That was the date the trial was supposed to start. [01:19:46.880 --> 01:19:49.880] The court was closed because of this virus. [01:19:49.880 --> 01:19:54.880] They've purged that record from the court, [01:19:54.880 --> 01:19:56.880] at least the way they were trying to do it. [01:19:56.880 --> 01:20:01.880] Well, they don't have to put everything on the website. [01:20:01.880 --> 01:20:08.880] That doesn't mean they don't still have the records in the file. [01:20:08.880 --> 01:20:13.880] Well, Randy, this is a new system, [01:20:13.880 --> 01:20:18.880] and it's supposed to reflect every other action [01:20:18.880 --> 01:20:21.880] that's happened in this case is there. [01:20:21.880 --> 01:20:24.880] Okay, and this is the only one that's been removed, [01:20:24.880 --> 01:20:29.880] and it's been replaced with this new trial date of May 18th. [01:20:29.880 --> 01:20:34.880] I suspect on May 18th they will not be able to do a trial. [01:20:34.880 --> 01:20:39.880] I believe there's a good chance that California [01:20:39.880 --> 01:20:43.880] is going to keep us at home until the end of May. [01:20:43.880 --> 01:20:46.880] And even as we come out, [01:20:46.880 --> 01:20:48.880] they're not going to allow groups to get together. [01:20:48.880 --> 01:20:51.880] So, how are you going to put 12 people in a jury box? [01:20:51.880 --> 01:20:54.880] Good luck. [01:20:54.880 --> 01:20:56.880] Yeah, it's going to be a while. [01:20:56.880 --> 01:20:57.880] I don't know. [01:20:57.880 --> 01:21:01.880] I feel itch in my chest. [01:21:01.880 --> 01:21:03.880] I might be getting that virus. [01:21:03.880 --> 01:21:07.880] And I want to go cough on that whole jury. [01:21:07.880 --> 01:21:11.880] Yeah, make sure it's a dry cough. [01:21:11.880 --> 01:21:13.880] I'll do my best. [01:21:13.880 --> 01:21:18.880] And take a bar of soap and put it under your armpit. [01:21:18.880 --> 01:21:21.880] That'll give you fever. [01:21:21.880 --> 01:21:23.880] Okay. [01:21:23.880 --> 01:21:26.880] That's a trick we learned in military. [01:21:26.880 --> 01:21:28.880] That's a very good trick. [01:21:28.880 --> 01:21:30.880] And by the way, before I forget, [01:21:30.880 --> 01:21:34.880] I'm going to do about an 18-minute video [01:21:34.880 --> 01:21:38.880] on Wi-Fi and cell phones. [01:21:38.880 --> 01:21:40.880] It was a TED talk. [01:21:40.880 --> 01:21:45.880] And this is an engineer here in Silicon Valley. [01:21:45.880 --> 01:21:48.880] And what your other caller was talking about, [01:21:48.880 --> 01:21:51.880] there is concerns, not just with 5G, [01:21:51.880 --> 01:21:54.880] but 4G and even 3G. [01:21:54.880 --> 01:21:59.880] I have sensitivity to the Wi-Fi stuff. [01:21:59.880 --> 01:22:05.880] I have felt its effect extremely at times. [01:22:05.880 --> 01:22:08.880] I talked it all up to just stress, [01:22:08.880 --> 01:22:11.880] but it turns out no. [01:22:11.880 --> 01:22:14.880] I had an office where I could work, [01:22:14.880 --> 01:22:16.880] and I would go there and within 20 minutes, [01:22:16.880 --> 01:22:19.880] I would have such a brain fog. [01:22:19.880 --> 01:22:22.880] I didn't even know what's ends up. [01:22:22.880 --> 01:22:24.880] And I had an engineer come down there [01:22:24.880 --> 01:22:26.880] to fix the problem with the Wi-Fi, [01:22:26.880 --> 01:22:28.880] which is it kept getting disconnected. [01:22:28.880 --> 01:22:31.880] And the guy goes, Jesus, there's so many Wi-Fis, [01:22:31.880 --> 01:22:34.880] and here they're interfering with each other. [01:22:34.880 --> 01:22:37.880] And basically all the Wi-Fis in the building [01:22:37.880 --> 01:22:39.880] is what he's referring to. [01:22:39.880 --> 01:22:42.880] And then back to Tina. [01:22:42.880 --> 01:22:44.880] Yeah, I think you're on the right track. [01:22:44.880 --> 01:22:49.880] Each party needs to put in a proof of claim. [01:22:49.880 --> 01:22:51.880] If they haven't had the media creditors, [01:22:51.880 --> 01:22:54.880] they all need to go to that. [01:22:54.880 --> 01:22:59.880] And they need to go to the U.S. trustee's office [01:22:59.880 --> 01:23:03.880] and get the U.S. trustee to do something. [01:23:03.880 --> 01:23:07.880] These bankruptcy courts, they don't want to have trials. [01:23:07.880 --> 01:23:10.880] Even these adversary trials, [01:23:10.880 --> 01:23:13.880] they do everything they can not to have them. [01:23:13.880 --> 01:23:16.880] So anyway, that's just some side difference. [01:23:16.880 --> 01:23:19.880] And then I'd really like to get a copy of your motion [01:23:19.880 --> 01:23:22.880] for the information request, [01:23:22.880 --> 01:23:25.880] because I want to put it on all the judges [01:23:25.880 --> 01:23:27.880] that have been on my case, [01:23:27.880 --> 01:23:32.880] which brings me to I filed disqualifications [01:23:32.880 --> 01:23:35.880] on three of these judges. [01:23:35.880 --> 01:23:44.880] And the one judge, he struck my disqualification of them. [01:23:44.880 --> 01:23:48.880] And one, I didn't think he could rule on his own disqualification. [01:23:48.880 --> 01:23:50.880] And remember, I'm disqualifying them [01:23:50.880 --> 01:23:52.880] because they're receiving payments from the county, [01:23:52.880 --> 01:23:54.880] and they didn't disclose that. [01:23:54.880 --> 01:23:56.880] And the county is prosecuting me. [01:23:56.880 --> 01:23:58.880] And I have the goods on them. [01:23:58.880 --> 01:24:00.880] I did the lawyer request. [01:24:00.880 --> 01:24:02.880] I know exactly how much money they've been paid. [01:24:02.880 --> 01:24:05.880] And in the case of this judge, [01:24:05.880 --> 01:24:08.880] it's over $300,000 the counties paid him. [01:24:08.880 --> 01:24:12.880] So he struck my disqualification. [01:24:12.880 --> 01:24:15.880] So I'm going to strike his strike, [01:24:15.880 --> 01:24:19.880] and I'm going to re-enter my disqualification of him. [01:24:19.880 --> 01:24:22.880] The second judge took the position [01:24:22.880 --> 01:24:24.880] that I can't file any papers [01:24:24.880 --> 01:24:28.880] because I'm represented by a public defender, [01:24:28.880 --> 01:24:30.880] which every time I go to court, [01:24:30.880 --> 01:24:31.880] I tell him he's not my lawyer. [01:24:31.880 --> 01:24:33.880] I don't agree to him. [01:24:33.880 --> 01:24:37.880] And I'm suing him. [01:24:37.880 --> 01:24:44.880] But the most interesting one, Randy, is the third judge. [01:24:44.880 --> 01:24:46.880] Now, I want to be clear. [01:24:46.880 --> 01:24:48.880] I first went to her chambers [01:24:48.880 --> 01:24:50.880] because I was directed by the clerk [01:24:50.880 --> 01:24:53.880] to go to the judge's courtroom, actually, [01:24:53.880 --> 01:24:56.880] and give it to her. [01:24:56.880 --> 01:24:58.880] And I said, well, I don't... [01:24:58.880 --> 01:25:00.880] She can't rule on her own recusal. [01:25:00.880 --> 01:25:03.880] Well, that's how we start the process here. [01:25:03.880 --> 01:25:05.880] So, okay, fine. I went up there. [01:25:05.880 --> 01:25:08.880] Luckily, she's in hearing, and she's busy, [01:25:08.880 --> 01:25:10.880] so I sat there and watched her for a while. [01:25:10.880 --> 01:25:12.880] She remembered me. [01:25:12.880 --> 01:25:14.880] She's the one that ordered me to court [01:25:14.880 --> 01:25:16.880] against the cardiologist's orders. [01:25:16.880 --> 01:25:18.880] And as I sat there having a heart attack, [01:25:18.880 --> 01:25:21.880] she was told, and she came out of her office [01:25:21.880 --> 01:25:22.880] and went back on the bench [01:25:22.880 --> 01:25:26.880] and continued to prosecute me until the paramedics got there. [01:25:26.880 --> 01:25:28.880] Okay, so she knows who I am, [01:25:28.880 --> 01:25:30.880] and that's all in my disqualification as well. [01:25:30.880 --> 01:25:34.880] I had a lengthy affidavit of all of her crimes [01:25:34.880 --> 01:25:36.880] as part of the disqualification. [01:25:36.880 --> 01:25:40.880] Now, she took a recess [01:25:40.880 --> 01:25:42.880] and went to her office [01:25:42.880 --> 01:25:45.880] when I'm filing that disqualification on her. [01:25:45.880 --> 01:25:46.880] And I'm sitting there. [01:25:46.880 --> 01:25:48.880] There's other people in the courtroom. [01:25:48.880 --> 01:25:50.880] It was pretty busy. [01:25:50.880 --> 01:25:53.880] And about 10 minutes later, [01:25:53.880 --> 01:25:55.880] the deputy comes out, hands me everything back, [01:25:55.880 --> 01:25:59.880] and says, oh, she says this doesn't get filed here. [01:25:59.880 --> 01:26:01.880] She's not on your case. [01:26:01.880 --> 01:26:05.880] So, I took that back down to the clerk's office, [01:26:05.880 --> 01:26:07.880] and of course, they were closed. [01:26:07.880 --> 01:26:08.880] They closed at 3 p.m. [01:26:08.880 --> 01:26:10.880] So, the next morning, I was there, [01:26:10.880 --> 01:26:13.880] and I filed all three the next morning. [01:26:13.880 --> 01:26:18.880] And they decided to take the other two as a courtesy to me [01:26:18.880 --> 01:26:21.880] that they would get them routed to the other two judges. [01:26:21.880 --> 01:26:26.880] But again, clearly, I took all the steps, [01:26:26.880 --> 01:26:28.880] and she has not responded. [01:26:28.880 --> 01:26:32.880] Now, that means, go ahead. [01:26:32.880 --> 01:26:36.880] Have you filed a mandamus with the Court of Appeals [01:26:36.880 --> 01:26:42.880] for asking them to order her to act on the disqualification [01:26:42.880 --> 01:26:45.880] and to take the filed disqualification [01:26:45.880 --> 01:26:48.880] and then act on it the way she's supposed to? [01:26:48.880 --> 01:26:51.880] With the proper referrals according to, yeah, [01:26:51.880 --> 01:26:53.880] the procedure that's laid out. [01:26:53.880 --> 01:26:56.880] I haven't done that. [01:26:56.880 --> 01:26:58.880] You might also consider filing criminal charges [01:26:58.880 --> 01:27:00.880] against that bailiff who so helpfully [01:27:00.880 --> 01:27:02.880] brought you all that paperwork back [01:27:02.880 --> 01:27:07.880] because he was obviously obstructing [01:27:07.880 --> 01:27:10.880] by not allowing that paperwork to reach the judge. [01:27:10.880 --> 01:27:13.880] The judge would never do such a thing, right? [01:27:13.880 --> 01:27:14.880] No, no, no. [01:27:14.880 --> 01:27:18.880] The deputy said that she looked at it, [01:27:18.880 --> 01:27:20.880] the judge looked at it, [01:27:20.880 --> 01:27:25.880] and told the deputy to tell me. [01:27:25.880 --> 01:27:29.880] Objection, you say. [01:27:29.880 --> 01:27:31.880] I understand what you're saying. [01:27:31.880 --> 01:27:34.880] I'm putting it as sort of being facetious [01:27:34.880 --> 01:27:39.880] because if you blame the innocent deputy, [01:27:39.880 --> 01:27:41.880] all he did was bring the paperwork to you. [01:27:41.880 --> 01:27:43.880] It was really the judge. [01:27:43.880 --> 01:27:44.880] I get that. [01:27:44.880 --> 01:27:48.880] And I'm saying if you blame the deputy, [01:27:48.880 --> 01:27:50.880] then you get the deputy to say [01:27:50.880 --> 01:27:53.880] that the judge is the one who refused. [01:27:53.880 --> 01:27:57.880] Yeah, make him throw the judge under the bus. [01:27:57.880 --> 01:27:59.880] No, I've finally the light went on. [01:27:59.880 --> 01:28:01.880] I get it. [01:28:01.880 --> 01:28:04.880] Yeah, you don't know if the judge actually did that or not. [01:28:04.880 --> 01:28:07.880] You only know that the bailiff said that. [01:28:07.880 --> 01:28:10.880] And when you hammer the bailiff, [01:28:10.880 --> 01:28:14.880] he is not going to be a happy camper. [01:28:14.880 --> 01:28:18.880] Yeah, I'm surprised I didn't ask for his business card, [01:28:18.880 --> 01:28:20.880] but I wanted to get the hell out of that room [01:28:20.880 --> 01:28:25.880] since she was basically avoiding this disqualification [01:28:25.880 --> 01:28:26.880] like the plague. [01:28:26.880 --> 01:28:30.880] I thought I was going the right route. [01:28:30.880 --> 01:28:31.880] So you probably are. [01:28:31.880 --> 01:28:36.880] She's not going to want this to get up into the higher courts. [01:28:36.880 --> 01:28:38.880] Well, it's already been there. [01:28:38.880 --> 01:28:41.880] The appellate court already knows. [01:28:41.880 --> 01:28:44.880] I filed a couple of lists up there already, [01:28:44.880 --> 01:28:46.880] and they just dismissed them. [01:28:46.880 --> 01:28:48.880] And you got, again, remember, [01:28:48.880 --> 01:28:51.880] Judge Minookian's wife sits on this appellate court. [01:28:51.880 --> 01:28:55.880] And so I'm already a marked man up there. [01:28:55.880 --> 01:28:59.880] Well, you're setting the record for the feds. [01:28:59.880 --> 01:29:00.880] True. [01:29:00.880 --> 01:29:02.880] This is Rico. [01:29:02.880 --> 01:29:05.880] All day long. [01:29:05.880 --> 01:29:07.880] Okay, do you have anything else? [01:29:07.880 --> 01:29:08.880] We're kind of running out of time. [01:29:08.880 --> 01:29:09.880] We've got two more callers. [01:29:09.880 --> 01:29:11.880] That's pretty much it, Randy. [01:29:11.880 --> 01:29:12.880] That's pretty much it. [01:29:12.880 --> 01:29:14.880] Okay, thanks a lot, Ted. [01:29:14.880 --> 01:29:19.880] Okay, now we're going to Kerry in Texas. [01:29:19.880 --> 01:29:23.880] And then we've got John and Shane from New York. [01:29:23.880 --> 01:29:25.880] We'll try to get to all of you. [01:29:25.880 --> 01:29:27.880] Hello, Kerry. [01:29:27.880 --> 01:29:29.880] What do you have for us today? [01:29:29.880 --> 01:29:32.880] Well, it was just a follow-up from last night. [01:29:32.880 --> 01:29:37.880] I wanted to finish asking a question on... [01:29:37.880 --> 01:29:42.880] You gave me some good information on how to go about filing [01:29:42.880 --> 01:29:48.880] some federal forms and go to the FBI's website for this judge [01:29:48.880 --> 01:29:52.880] against this very file of an official oppression against this judge [01:29:52.880 --> 01:29:57.880] that I'm dealing with over here in Arlington. [01:29:57.880 --> 01:30:01.880] But my bigger... [01:30:01.880 --> 01:30:04.880] The top cybersecurity expert has a warning for America. [01:30:04.880 --> 01:30:08.880] If you build an electrical smart grid, the hackers will come [01:30:08.880 --> 01:30:11.880] and they could cause a catastrophic blackout. [01:30:11.880 --> 01:30:15.880] I'm Dr. Catherine Albrecht, back with the shocking details in a moment. [01:30:15.880 --> 01:30:17.880] Privacy is under attack. [01:30:17.880 --> 01:30:21.880] When you give up data about yourself, you'll never get it back again. [01:30:21.880 --> 01:30:26.880] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:30:26.880 --> 01:30:31.880] So protect your rights, say no to surveillance and keep your information to yourself. [01:30:31.880 --> 01:30:34.880] Privacy, it's worth hanging on to. [01:30:34.880 --> 01:30:37.880] This message is brought to you by StartPage.com, [01:30:37.880 --> 01:30:41.880] the private search engine alternative to Google, Yahoo, and Bing. [01:30:41.880 --> 01:30:45.880] Start over with StartPage. [01:30:45.880 --> 01:30:49.880] Governments love power, so it's only natural they'd want to control the power [01:30:49.880 --> 01:30:52.880] going into your home too, with a smart grid. [01:30:52.880 --> 01:30:56.880] They're installing a national network of smart meters to remotely monitor [01:30:56.880 --> 01:30:59.880] electric use for efficiency and avoid grid failure. [01:30:59.880 --> 01:31:03.880] But cybersecurity expert David Chalk says, not so fast, [01:31:03.880 --> 01:31:06.880] if we make the national power grid controllable through the web, [01:31:06.880 --> 01:31:08.880] hackers will have a field day. [01:31:08.880 --> 01:31:12.880] Working remotely, they could tap in and black out the entire nation, [01:31:12.880 --> 01:31:15.880] leaving us vulnerable to our enemies. [01:31:15.880 --> 01:31:18.880] I'd want to pose smart meters for privacy and health reasons. [01:31:18.880 --> 01:31:23.880] The catastrophic failures caused by hackers? There's nothing smart about that. [01:31:23.880 --> 01:31:28.880] Like Dr. Catherine Albrecht for StartPage.com, the world's most private search engine. [01:31:30.880 --> 01:31:36.880] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11. [01:31:36.880 --> 01:31:38.880] The government says that fire brought it down. [01:31:38.880 --> 01:31:43.880] However, 1,500 architects and engineers concluded it was a controlled demolition. [01:31:43.880 --> 01:31:48.880] Over 6,000 of my fellow service members have given their lives. [01:31:48.880 --> 01:31:50.880] I'm not a conspiracy theorist. [01:31:50.880 --> 01:31:51.880] I'm a structural engineer. [01:31:51.880 --> 01:31:52.880] I'm a New York City correctional. [01:31:52.880 --> 01:31:53.880] I'm an Air Force pilot. [01:31:53.880 --> 01:31:55.880] I'm a father who lost his son. [01:31:55.880 --> 01:31:57.880] We're Americans, and we deserve the truth. [01:31:57.880 --> 01:32:01.880] Go to RememberBuilding7.org today. [01:32:01.880 --> 01:32:05.880] Rule of Law Radio is proud to offer the Rule of Law Traffic Seminar. [01:32:05.880 --> 01:32:07.880] In today's America, we live in an us-against-them society, [01:32:07.880 --> 01:32:10.880] and if we, the people, are ever going to have a free society, [01:32:10.880 --> 01:32:12.880] then we're going to have to stand and defend our own rights. [01:32:12.880 --> 01:32:15.880] Among those rights are the right to travel freely from place to place, [01:32:15.880 --> 01:32:17.880] the right to act in our own private capacity, [01:32:17.880 --> 01:32:19.880] and most importantly, the right to due process of law. [01:32:19.880 --> 01:32:22.880] Traffic courts afford us the least expensive opportunity [01:32:22.880 --> 01:32:25.880] to learn how to enforce and preserve our rights through due process. [01:32:25.880 --> 01:32:27.880] Former Sheriff's Deputy, Eddie Craig, [01:32:27.880 --> 01:32:28.880] in conjunction with Rule of Law Radio, [01:32:28.880 --> 01:32:31.880] has put together the most comprehensive teaching tool available [01:32:31.880 --> 01:32:33.880] that will help you understand what due process is [01:32:33.880 --> 01:32:35.880] and how to hold courts to the rule of law. [01:32:35.880 --> 01:32:37.880] You can get your own copy of this invaluable material [01:32:37.880 --> 01:32:40.880] by going to RuleofLawRadio.com and ordering your copy today. [01:33:01.880 --> 01:33:04.880] You are listening to the Logos Radio Network. [01:33:04.880 --> 01:33:11.880] LogosRadioNetwork.com [01:33:35.880 --> 01:33:38.880] Okay, we are back. [01:33:38.880 --> 01:33:41.880] Randy Kelton, Brett Fountain, Rule of Law Radio, [01:33:41.880 --> 01:33:45.880] and we're going to Kerry in Texas. [01:33:45.880 --> 01:33:47.880] Hello, Kerry. [01:33:47.880 --> 01:33:49.880] Yes, sir. Can you hear me okay? [01:33:49.880 --> 01:33:51.880] Yes. [01:33:51.880 --> 01:33:56.880] Okay, so just a quick follow-up on the yesterday's call. [01:33:56.880 --> 01:33:58.880] You got that part of, you know, [01:33:58.880 --> 01:34:00.880] I got some good information out of you, [01:34:00.880 --> 01:34:04.880] but my more pressing issue is the actual warrant. [01:34:04.880 --> 01:34:06.880] What do I do about this warrant? [01:34:06.880 --> 01:34:08.880] They've got this out for me. [01:34:08.880 --> 01:34:14.880] I have my permanent address, if you will, in another city, [01:34:14.880 --> 01:34:17.880] but it is at my father-in-law's home. [01:34:17.880 --> 01:34:20.880] And I really don't want the law showing up over there [01:34:20.880 --> 01:34:22.880] looking for me. [01:34:22.880 --> 01:34:25.880] That's not an issue at the moment. [01:34:25.880 --> 01:34:29.880] They're doing everything they can to keep people out of jail right now. [01:34:29.880 --> 01:34:33.880] The warrant will always say, [01:34:33.880 --> 01:34:38.880] arrest this person and bring him before me. [01:34:38.880 --> 01:34:45.880] So the only method is to appear before the judge. [01:34:45.880 --> 01:34:48.880] Now, they might arrest you and take you to jail anyway. [01:34:48.880 --> 01:34:51.880] That gives you a false imprisonment complaint, [01:34:51.880 --> 01:34:54.880] but there's no absolute way of keeping them from arresting [01:34:54.880 --> 01:34:58.880] unless you hire a lawyer to do a walkthrough. [01:34:58.880 --> 01:35:00.880] Okay. [01:35:00.880 --> 01:35:04.880] Once they've issued the warrant, it's best to get arrested. [01:35:04.880 --> 01:35:09.880] Then you get a lawsuit against them. [01:35:09.880 --> 01:35:11.880] Okay. [01:35:11.880 --> 01:35:14.880] So I just have a way to see what happens in the meantime [01:35:14.880 --> 01:35:17.880] and start filing all this stuff that you told me about. [01:35:17.880 --> 01:35:19.880] Yeah, start filing it and get it in there [01:35:19.880 --> 01:35:22.880] and then they're not going to want you arrested [01:35:22.880 --> 01:35:25.880] because then it's clear to them you're going to sue them. [01:35:25.880 --> 01:35:27.880] Okay. [01:35:27.880 --> 01:35:30.880] Well, then that's all I got for you, buddy. [01:35:30.880 --> 01:35:34.880] I appreciate you throwing the information out there for me. [01:35:34.880 --> 01:35:35.880] Okay. [01:35:35.880 --> 01:35:36.880] Thank you much. [01:35:36.880 --> 01:35:42.880] Now we're going to go to John in New York as soon as my page refreshes. [01:35:42.880 --> 01:35:43.880] There you go. [01:35:43.880 --> 01:35:47.880] Okay, John, what do you have for us today? [01:35:47.880 --> 01:35:50.880] Well, I've got for you an explanation. [01:35:50.880 --> 01:35:51.880] You're correct. [01:35:51.880 --> 01:35:56.880] A cell phone call was not possible from an airplane to the ground in 2001. [01:35:56.880 --> 01:36:00.880] Somebody at the 9-11 pinched. [01:36:00.880 --> 01:36:01.880] Bye. [01:36:01.880 --> 01:36:02.880] Oh, dear. [01:36:02.880 --> 01:36:03.880] Oh, my. [01:36:03.880 --> 01:36:04.880] Okay. [01:36:04.880 --> 01:36:06.880] Now by giving you the following information, [01:36:06.880 --> 01:36:08.880] you'll be able to put the pieces together. [01:36:08.880 --> 01:36:11.880] I'm going to go through this really quickly. [01:36:11.880 --> 01:36:14.880] It depends heavily who pays for the research studies. [01:36:14.880 --> 01:36:18.880] And the telecom industry and most colleges and universities [01:36:18.880 --> 01:36:22.880] generally can't be trusted when it comes to analyzing the safety [01:36:22.880 --> 01:36:26.880] of certain phone signals inside 5G. [01:36:26.880 --> 01:36:28.880] And again, you're correct. [01:36:28.880 --> 01:36:32.880] Cell phone calls are not possible from an airplane to the ground in 2001. [01:36:32.880 --> 01:36:36.880] When I heard that in 2001, I said, what? [01:36:36.880 --> 01:36:41.880] Anyway, generally the higher in frequency the radio or TV signal is, [01:36:41.880 --> 01:36:43.880] the more harmful it is. [01:36:43.880 --> 01:36:49.880] Successful lawsuits have been filed by cops because sitting behind the radar guns [01:36:49.880 --> 01:36:53.880] in the power all day cause a definite increase in risk of cancer. [01:36:53.880 --> 01:36:55.880] And that's well known. [01:36:55.880 --> 01:37:01.880] Proximity to 8-1 radio tower, and you'd have to be very close to this thing. [01:37:01.880 --> 01:37:07.880] Within 100 feet or 50 feet or 250 feet, there's an increase. [01:37:07.880 --> 01:37:12.880] If you are too close to an AM radio tower and it's a sufficient power, [01:37:12.880 --> 01:37:17.880] there's an increased risk of cataract in the eye, cataract. [01:37:17.880 --> 01:37:21.880] Children 1 to 2, 1.2 miles, [01:37:21.880 --> 01:37:25.880] children living 1.2 miles away from an AM tower, [01:37:25.880 --> 01:37:28.880] at an increased risk for leukemia. [01:37:28.880 --> 01:37:34.880] Now, I would think it would have to be a tower that's pumping 20,000 watts or more [01:37:34.880 --> 01:37:42.880] because a mile is a long way off and you're usually safe at smaller power output. [01:37:42.880 --> 01:37:50.880] A lawsuit that the cops had for cancer with the radar gun, [01:37:50.880 --> 01:37:55.880] you see radar guns operate anywhere at the X band, K band, a photo radar. [01:37:55.880 --> 01:38:00.880] They all operate somewhere between 10 and 35 gigabyte. [01:38:00.880 --> 01:38:05.880] I know, I used to calibrate radar guns once in a great while with the engineer. [01:38:05.880 --> 01:38:07.880] I used to assist him. [01:38:07.880 --> 01:38:12.880] And photo radar frequency are the highest range of all. [01:38:12.880 --> 01:38:18.880] So the higher the frequency, remember, the more damaging the effect. [01:38:18.880 --> 01:38:25.880] Wi-Fi, smart meters, cell phones and towers are between roughly 2 to 3 gigahertz [01:38:25.880 --> 01:38:28.880] and they affect water. [01:38:28.880 --> 01:38:33.880] 5G, some go to 60 megahertz, some are higher, some are lower. [01:38:33.880 --> 01:38:36.880] That number is 60 megahertz. [01:38:36.880 --> 01:38:39.880] And they affect oxygen. [01:38:39.880 --> 01:38:45.880] And this came up about a year ago and I remember reading it. [01:38:45.880 --> 01:38:51.880] You combine 5G with a virus and you've got problems. [01:38:51.880 --> 01:38:54.880] And I'll get to that in a minute. [01:38:54.880 --> 01:39:01.880] If you examine blood cells before and after a 15 minute exposure to a cell phone, [01:39:01.880 --> 01:39:07.880] so you're on the cell phone 15 minutes and then you examine the blood cells in that person, [01:39:07.880 --> 01:39:10.880] you're going to notice a very noticeable change. [01:39:10.880 --> 01:39:13.880] Those cells are going to start aggregating together. [01:39:13.880 --> 01:39:15.880] They start huddling together. [01:39:15.880 --> 01:39:20.880] Now capillaries are very narrow structures. [01:39:20.880 --> 01:39:26.880] Capillaries are very narrow and cells that start sticking together is not a good thing. [01:39:26.880 --> 01:39:31.880] You should be able to read that in the dystopic blood pressure. [01:39:31.880 --> 01:39:33.880] You could. [01:39:33.880 --> 01:39:35.880] It might increase blood pressure. [01:39:35.880 --> 01:39:36.880] Now it depends. [01:39:36.880 --> 01:39:37.880] It depends. [01:39:37.880 --> 01:39:40.880] I'm talking about the low side. [01:39:40.880 --> 01:39:45.880] The heart pushes blood into the vessels, into the arteries, [01:39:45.880 --> 01:39:49.880] but then it comes back through the vessels and if the vessels are, [01:39:49.880 --> 01:39:55.880] if the blood is coagulating in there or flocculating, that would be the term, [01:39:55.880 --> 01:39:59.880] that if it thickens it up, it won't drain back as quickly. [01:39:59.880 --> 01:40:01.880] You'll hold more residual pressure. [01:40:01.880 --> 01:40:03.880] It's not a good thing. [01:40:03.880 --> 01:40:04.880] Okay? [01:40:04.880 --> 01:40:08.880] A couple more things and you'll begin to see the scattering that I'm studying. [01:40:08.880 --> 01:40:15.880] Tumors have actually formed in a person's body in the size and shape of the cell phone. [01:40:15.880 --> 01:40:18.880] That tells you something right there. [01:40:18.880 --> 01:40:21.880] There's a bad thing coming up now and a good thing. [01:40:21.880 --> 01:40:27.880] First, the bad thing, all RF radiation, cell towers, cell phones, [01:40:27.880 --> 01:40:34.880] Wi-Fi, smart meters, 5G, they all cause inflammation in the body and free radical damage. [01:40:34.880 --> 01:40:39.880] And free radical damage, part of that is a deficit in electrons. [01:40:39.880 --> 01:40:41.880] Those are the bad guys. [01:40:41.880 --> 01:40:48.880] The deficit in electrons are the baddies and the vitamins and minerals are electron donors. [01:40:48.880 --> 01:40:50.880] Those are the good guys. [01:40:50.880 --> 01:41:00.880] When you have free radical damage from environmental toxins, x-rays, smoking, bad living, alcohol, drugs, [01:41:00.880 --> 01:41:03.880] you have a deficit in electrons. [01:41:03.880 --> 01:41:05.880] And that's why you take vitamins and minerals. [01:41:05.880 --> 01:41:12.880] And the more deficit you have in electrons, the fluffier your lifestyle and the poorer in vitamins and minerals [01:41:12.880 --> 01:41:16.880] your fool is because of bad soil all over the world. [01:41:16.880 --> 01:41:17.880] And that's a fact. [01:41:17.880 --> 01:41:19.880] You need more vitamins and minerals. [01:41:19.880 --> 01:41:21.880] Smart meters, and here's the last part. [01:41:21.880 --> 01:41:27.880] Smart meters, cell phones, cell towers, Wi-Fi, they affect everyone. [01:41:27.880 --> 01:41:33.880] It's just that some people are affected much sooner and they get nausea, heart rhythm problems, [01:41:33.880 --> 01:41:36.880] headache, anxiety and insomnia. [01:41:36.880 --> 01:41:38.880] It interferes with pacemakers. [01:41:38.880 --> 01:41:40.880] Let's see what else. [01:41:40.880 --> 01:41:41.880] Worse is diabetes. [01:41:41.880 --> 01:41:45.880] You get brain fog, cause of high blood pressure or aggravates it. [01:41:45.880 --> 01:41:47.880] Cancer, miscarriages. [01:41:47.880 --> 01:41:51.880] And now these are medically recognized cause and effect relationships [01:41:51.880 --> 01:41:56.880] between the Wi-Fi, smart meters, cell phones and disease. [01:41:56.880 --> 01:42:01.880] Then those radio waves heat the temperature in the cells very slightly. [01:42:01.880 --> 01:42:04.880] But over time, it may be very slight. [01:42:04.880 --> 01:42:08.880] But over time, this free radical damage accumulates. [01:42:08.880 --> 01:42:12.880] And the big reason why some react to cell tower RS and smart meters, [01:42:12.880 --> 01:42:17.880] those people that are more sensitive to electro smog, as they call it. [01:42:17.880 --> 01:42:21.880] In other words, electromagnetic radiation, cell towers and so on. [01:42:21.880 --> 01:42:28.880] They've got more mercury and aluminum from vaccines and some other sources in their blood, in their body. [01:42:28.880 --> 01:42:32.880] And now, aluminum and mercury are metal. [01:42:32.880 --> 01:42:39.880] And they act just like a metal antenna inside the body, attracting and kind of concentrating the RS energy. [01:42:39.880 --> 01:42:41.880] That's why they're more susceptible. [01:42:41.880 --> 01:42:43.880] Some people are just, they get sicker fast. [01:42:43.880 --> 01:42:49.880] But all people eventually get sick with 5G and smart meters and so on. [01:42:49.880 --> 01:42:50.880] And there you have it. [01:42:50.880 --> 01:42:55.880] I hope you made the connections to what I'm trying to get to. [01:42:55.880 --> 01:42:57.880] Okay. I was uncomfortable with that. [01:42:57.880 --> 01:43:05.880] You made a lot of assertions without support for them. [01:43:05.880 --> 01:43:12.880] And there are too many of them to keep up with. [01:43:12.880 --> 01:43:16.880] I would need that written down so I could take that apart. [01:43:16.880 --> 01:43:21.880] A few of your assertions as an electrical engineer, I was real uncomfortable with. [01:43:21.880 --> 01:43:33.880] And not that what you're saying is not true, but the way you're saying it didn't fit with what I understand about molecular valence. [01:43:33.880 --> 01:43:39.880] And, well, you're talking about these excess electrons. [01:43:39.880 --> 01:43:43.880] That's a little too general for me to wrap my head around. [01:43:43.880 --> 01:43:47.880] Because you start moving electrons around, you get isotopes. [01:43:47.880 --> 01:43:50.880] And you didn't mention isotopes. [01:43:50.880 --> 01:43:53.880] So there was a lot in there. [01:43:53.880 --> 01:43:54.880] It was a very general. [01:43:54.880 --> 01:43:55.880] Hang on. [01:43:55.880 --> 01:43:57.880] Going to break Randy Kelton, Brett Fountain. [01:43:57.880 --> 01:43:59.880] We'll be right back. [01:43:59.880 --> 01:44:06.880] Through advances in technology, our lives have greatly improved, except in the area of nutrition. [01:44:06.880 --> 01:44:09.880] People feed their pets better than they feed themselves. [01:44:09.880 --> 01:44:11.880] And it's time we changed all that. [01:44:11.880 --> 01:44:17.880] Our primary defense against aging and disease in this toxic environment is good nutrition. [01:44:17.880 --> 01:44:22.880] In a world where natural foods have been irradiated, adulterated, and mutilated, [01:44:22.880 --> 01:44:31.880] young Jevity can provide the nutrients you need. [01:46:23.880 --> 01:46:45.880] We are back. Randy Kelton, Brett Fountain, Rule of Law Radio, and we're talking to John in New York. [01:46:45.880 --> 01:46:56.880] John, I appreciate the information, but you gave us a whole bunch of stuff and drew a lot of conclusions. [01:46:56.880 --> 01:47:03.880] Since that's so, this is so, and since this is so, this is so, and this is so. [01:47:03.880 --> 01:47:11.880] All of a sudden, I'm five or six levels deep in all of these assertions, and I have no idea what you're talking about. [01:47:11.880 --> 01:47:18.880] No way to stitch that together. Can you send me that in an email? [01:47:18.880 --> 01:47:21.880] Well, I suppose I could write it up. [01:47:21.880 --> 01:47:50.880] Long story short, if any nutritional doctor, he or she should be able to answer this once, but that's the nutritional doctor. Is it true that somebody on my show told me that things like environmental causes, radiation, and so forth, x-ray, gamma ray, radiation, certain compounds, [01:47:50.880 --> 01:47:55.880] get to the question. [01:47:55.880 --> 01:48:04.880] Are they not all electron stealers? In other words, they steal electrons. [01:48:04.880 --> 01:48:10.880] That's something that doesn't mean anything. What does stealing electrons mean? [01:48:10.880 --> 01:48:16.880] In other words, where there was electron, now there aren't it. [01:48:16.880 --> 01:48:32.880] No, no, no, no. That don't happen that way. This is part of what I had the problem with. You have to have something to dislodge an electron, and that's not easy to do. [01:48:32.880 --> 01:48:53.880] You have to have a molecule that has a particular valence that will allow for the exchange of electrons. This is really pretty complicated to just wrap it up in stealing electrons. That don't mean anything. [01:48:53.880 --> 01:49:02.880] It doesn't mean anything to you because you haven't got the training that I have, and I don't mean that because that's not an insult. [01:49:02.880 --> 01:49:05.880] I'm an electrical engineer. You cannot steal electrons. [01:49:05.880 --> 01:49:09.880] We're not talking about electronic engineering necessarily. [01:49:09.880 --> 01:49:16.880] We're talking about electrons. It doesn't matter who's talking about them. They're all the same. [01:49:16.880 --> 01:49:29.880] Ask the doctor this question. You've got to get a good naturopathic doctor. The problem is, is the term stealing is not a good enough term for us to understand what it is that's going on here. [01:49:29.880 --> 01:49:53.880] Say it to us. Trust me, trust me. Ask the doctor the following question. I'll get to it quick. Is it true that environmental toxins, X-ray radiation, too much cell tower radiation, they are electron dealers and vitamins and minerals replace both stolen electrons? [01:49:53.880 --> 01:50:01.880] Now, there's no way I'm going to ask a doctor a question like that. He's going to look at me and say, what in the heck are you talking about? [01:50:01.880 --> 01:50:07.880] He's going to say, what have you been smoking because I'm concerned for your health? [01:50:07.880 --> 01:50:20.880] Well, let's put it this way. Let's put it this way. I can answer that question with another example. 5G. You have Wi-Fi, for example. You have cell towers, cell phones. [01:50:20.880 --> 01:50:23.880] You don't have to go through all of it. We got what 5G is. [01:50:23.880 --> 01:50:29.880] Okay. No, no, that's not 5G. I'm talking two different things. Start again. [01:50:29.880 --> 01:50:40.880] Wi-Fi, cell phones, cell towers, smart meters, they operate in the roughly frequency range of two to three gigahertz. [01:50:40.880 --> 01:50:53.880] 5G operates anywhere from higher than that to 60 gigahertz and higher, depending on the system. [01:50:53.880 --> 01:51:01.880] Wi-Fi in the lower frequencies at two to three gigahertz disturbs water in any compound. [01:51:01.880 --> 01:51:04.880] How does it disturb water? [01:51:04.880 --> 01:51:12.880] For example, your microwave, it causes the water to vibrate so fast that it cooks the food and eats it up. [01:51:12.880 --> 01:51:22.880] 5G, on the other hand, let me get to this. 5G is a higher frequency and it affects oxygen. [01:51:22.880 --> 01:51:25.880] Now, do you know how an opera... [01:51:25.880 --> 01:51:35.880] When you dodge that question, the fact that it imparts energy to water, well, a cook stove does the same thing. [01:51:35.880 --> 01:51:43.880] Yes, that's right. But electromagnetic waves will also cause that. [01:51:43.880 --> 01:51:49.880] Doesn't it? It's two different stimulus, two different stimuli, but they both have the same effect. [01:51:49.880 --> 01:51:54.880] 5G operates in that range that affects oxygen. Now, let me get through this next part. [01:51:54.880 --> 01:51:59.880] You know how an opera singer shatters a glass when the opera singer hits 5G? [01:51:59.880 --> 01:52:00.880] Yes. [01:52:00.880 --> 01:52:08.880] It's just like a radio transmitter and you've got that old-fashioned tuner from the radios 30, 40, 50 years ago [01:52:08.880 --> 01:52:10.880] that had those little fingers that come together that... [01:52:10.880 --> 01:52:15.880] You're making... This is a really vague, general assertion. [01:52:15.880 --> 01:52:18.880] Now, I think now we're getting to a rice machine. [01:52:18.880 --> 01:52:22.880] No, no, no. This is how it works. Run with me. Just go with me. [01:52:22.880 --> 01:52:30.880] No, okay. Look, we're going to go all day here with you jumping from one generality to another generality to another. [01:52:30.880 --> 01:52:36.880] I'm going to get nowhere. Write this down for me so I can go through it in detail. [01:52:36.880 --> 01:52:43.880] All right. Now, you've got to remember, I spent 61 years doing this. I've done this ever since I was 10 years old. [01:52:43.880 --> 01:52:48.880] Okay. I got that. I don't doubt that you know the information, [01:52:48.880 --> 01:52:57.880] but you're having a little problem explaining the information in a way that doesn't bump up against my physics. [01:52:57.880 --> 01:52:59.880] Okay. Now, I'm about to do that. Let me go. [01:52:59.880 --> 01:53:08.880] Okay. No, no, no. Look, I've got two more callers. There's no way we can get through this subject matter with so many parts. [01:53:08.880 --> 01:53:09.880] Send me an email. [01:53:09.880 --> 01:53:10.880] Well... [01:53:10.880 --> 01:53:13.880] And I'll go through it part by part. [01:53:13.880 --> 01:53:20.880] Okay. And I'll tell you what, I'll send you the explanation and it'll be like five seconds. That's all I was going to say right now. [01:53:20.880 --> 01:53:25.880] In fact, that had been done if you'd let me go, but I'll let you get to the other call. [01:53:25.880 --> 01:53:27.880] Thank you, Mark. John. [01:53:27.880 --> 01:53:29.880] Oh, same. [01:53:29.880 --> 01:53:34.880] Okay. Now, I'm going to Shane in New York. Hello, Shane. [01:53:34.880 --> 01:53:36.880] Hello, Randy. How are you doing tonight? [01:53:36.880 --> 01:53:40.880] Doing good. What do you have for us today? [01:53:40.880 --> 01:53:46.880] Well, you just had a quick question. I had a case five years ago, traffic stop. [01:53:46.880 --> 01:53:49.880] And by the way, is the signal coming in pretty good? [01:53:49.880 --> 01:53:51.880] Yes. [01:53:51.880 --> 01:54:01.880] Okay. And I got pulled over and never produced my identification. And they bought back up and approximately 20 minutes later, they finally let me go. [01:54:01.880 --> 01:54:13.880] This was back in 2016. And the cops took pictures of me and issued out warrants. And one day I ran into a cop and they arrested me. [01:54:13.880 --> 01:54:21.880] I had a small claims court hearing because I was sued in newspapers stating I was pulled over for a suspended driver's license. [01:54:21.880 --> 01:54:33.880] So make a long story very, very short. I won the case. They dismissed it about a year and a half later. I filed a civil suit against them for being detained for about a day and a half. [01:54:33.880 --> 01:54:41.880] And I got out of a $500 bail and I filed a case and civil suit here in New York. [01:54:41.880 --> 01:54:51.880] And they filed a motion to dismiss all three of the columns as those involved in three different local jurisdictions. And they said my time has told. [01:54:51.880 --> 01:54:58.880] Therefore, the case should be dismissed for lack of statute of limitations because in New York, you have one year to file a civil suit. [01:54:58.880 --> 01:55:00.880] And they're claiming. [01:55:00.880 --> 01:55:06.880] Okay. Generally, it's one year to file a suit for false imprisonment. [01:55:06.880 --> 01:55:09.880] Correct. [01:55:09.880 --> 01:55:17.880] That's what yours was. Generally, with a civil suit, with a regular civil suit is two years. [01:55:17.880 --> 01:55:20.880] In the federal, it's three years, correct? [01:55:20.880 --> 01:55:23.880] No, it depends on what it is. [01:55:23.880 --> 01:55:33.880] Federal claim cause of action. Anyways, here's my question to you. I found one case that states that it does not start. [01:55:33.880 --> 01:55:44.880] The total time does not start until it's been terminated in favor of the defendant. Then I heard, then I read another case. It says it starts from the moment you were released from bail. [01:55:44.880 --> 01:55:46.880] So my question to you. [01:55:46.880 --> 01:55:49.880] Both of those at the same time. [01:55:49.880 --> 01:55:52.880] When is the total time start? [01:55:52.880 --> 01:55:56.880] Total time starts when the case is dismissed. [01:55:56.880 --> 01:55:58.880] Or when you win the case. [01:55:58.880 --> 01:56:06.880] Right. That's when the total. That's when you're released from bail. They're the both at the same time. [01:56:06.880 --> 01:56:11.880] Okay. Now, my case was finally dismissed in 2018. [01:56:11.880 --> 01:56:14.880] That's when the clock started. [01:56:14.880 --> 01:56:18.880] That's right. Okay. We're on the same page on that. [01:56:18.880 --> 01:56:24.880] And Mike, I filed an amended answer. [01:56:24.880 --> 01:56:34.880] And like you were telling us before a long time ago, I remember you said, if you don't have time to get your briefing while it's something, you could always amend it later. [01:56:34.880 --> 01:56:36.880] Yes. [01:56:36.880 --> 01:56:44.880] And that's exactly what I did. I didn't have enough time to respond back to them because I was fighting the bankruptcy case and all the other stuff went on with the foreclosure. [01:56:44.880 --> 01:56:55.880] So I followed as much as I could and then I followed through about a week later and amended my answer back to them for the motion to dismiss it. I found all that very important information that we talked about. [01:56:55.880 --> 01:56:59.880] I'm shrinking the story to two or three minutes here. [01:56:59.880 --> 01:57:09.880] But you answered my question and I was just wondering, is it the same way down there in Texas, the same, all these states basically... [01:57:09.880 --> 01:57:22.880] They're not all the same, but they're close. And surprisingly, false imprisonment is a year everywhere. Everywhere I've looked so far and that's unusual. [01:57:22.880 --> 01:57:35.880] A norm, generally a civil claim, a cause of action, generally is two years unless it's fraud, it's five years after you figure it out. [01:57:35.880 --> 01:57:48.880] There are some variations in there depending on the nature of the claim in the same way in the federal courts, but as a relatively rule of thumb, false imprisonment is one year. [01:57:48.880 --> 01:57:55.880] But you could claim denial of due process, which is two years. [01:57:55.880 --> 01:58:04.880] Right. Well, I found it within the 12 month period. So they came back for a motion to dismiss stating that it was not done within the 12 months. [01:58:04.880 --> 01:58:09.880] But my last question, Randy, is... [01:58:09.880 --> 01:58:12.880] Forty seconds. Forty seconds. [01:58:12.880 --> 01:58:16.880] Okay, what were the damages you'd ask for per day of being detained? [01:58:16.880 --> 01:58:23.880] Oh, look at Travis at a huge number. Let them whittle it down. Million. [01:58:23.880 --> 01:58:27.880] He got 60,000 per hour. [01:58:27.880 --> 01:58:30.880] Double it. [01:58:30.880 --> 01:58:33.880] Gotcha. Okay, thanks a lot, Randy. [01:58:33.880 --> 01:58:37.880] The number there, the jury remembers is the one you came in the door with. [01:58:37.880 --> 01:58:49.880] Thank you all for listening.
