[01:24.880 --> 01:28.520] Margaret Moore, the Travis County District Attorney, announced earlier this month that [01:28.520 --> 01:33.080] she was dismissing 32 felony possession and delivery of marijuana cases because of the [01:33.080 --> 01:34.080] law. [01:34.080 --> 01:37.680] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter [01:37.680 --> 01:42.160] that county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.160 --> 01:48.320] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as [01:48.320 --> 01:54.560] well as other cities, too, like the District Attorney and El Paso, Cayma Esparza, a Democrat [01:54.560 --> 01:59.040] who also stated earlier this month that the law, quote, will not have an effect on the [01:59.040 --> 02:01.760] prosecution of marijuana cases in El Paso. [02:01.760 --> 02:06.840] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.840 --> 02:10.840] in Harris County, who stated that, quote, the law is constantly changing on what makes [02:10.840 --> 02:13.560] something illegal based on its chemical makeup. [02:22.680 --> 02:27.480] A paper by Tulane University identified a five and a half inch American pocket shark. talked about china how [07:30.680 --> 07:40.360] he's thinking that since china has a history of poisoning populations before they invade [07:42.280 --> 07:55.800] he is of the opinion that china is 14:35.800] this third world nation status and they started putting factories up well it's hard for us to [14:36.440 --> 14:43.800] think in terms of a country as big as china they got 7 billion people it's hard to imagine [14:43.800 --> 14:51.960] they would run out of people but it's a big big country if we had no immigrants no people coming [14:51.960 --> 14:59.320] in we wouldn't have enough served but my defendant was [52:19.480 --> 52:29.160] served but he says that my amended complaint superseded the original complaint and i didn't [52:29.160 --> 52:34.520] serve him properly the amended complaint so he wants to dismiss my case without answering it [52:35.240 --> 52:42.280] and i thought he didn't he doesn't get to do that but he's right uh lack of proper service is not [52:42.280 --> 52:49.640] grounds for dismissal lack of proper service is grounds for an order to give proper service [52:50.760 --> 52:56.600] but he's right when you filed an amended it was like the original went in the trash [52:57.720 --> 53:04.920] so he had to be served at second the amended right and i found case law that says if the amended [53:04.920 --> 53:13.080] complaint has new claims then well let me back up i found the rule says that if an amended complaint [53:13.080 --> 53:17.800] states new claims the amended complaint has to be served by rule four rule four says it has to [53:17.800 --> 53:23.400] be done done by somebody not a party to the suit and has to be you know by someone over the age of 18 [53:23.400 --> 53:30.920] or a professional process over blah blah blah okay i also found case law that says if the amended [53:30.920 --> 53:39.400] complaint states new claims but they're based on the same fact then the defendant had noticed so [53:39.400 --> 53:44.360] it's really up in there it's one those i think it's bizarre of course they don't think it's [53:44.360 --> 53:50.680] bizarre they just want to dismiss it so of course he was not served the amended complaint [53:51.400 --> 53:58.840] by rule four he was served the amended complaint by rule five okay so in your amended complaint [53:58.840 --> 54:07.880] did you change did you add facts or simply state different claims i'm refusing to go back and read [54:07.880 --> 54:18.520] them wait a minute say that again i said i i i've been too busy to go back and compare them [54:19.160 --> 54:25.080] because i really care well if the underlying facts didn't change i haven't cared uh because it [54:25.080 --> 54:29.880] doesn't matter to me one way or the other i still make more argument uh i know the advice of uh council i decided to you know let them know that [01:41:15.560 --> 01:41:22.600] yes i did file it i emailed it to you that's enough and uh i actually sent in some paperwork and they [01:41:22.600 --> 01:41:28.040] said they sent it back and said that uh they couldn't accept it that way i had to come down there and [01:41:28.040 --> 01:41:36.120] pay them or something give them some kind of fees or something to to tend to it and uh that's not [01:41:36.120 --> 01:41:42.440] what i understood the case to be that i actually did file it well through a few emails back and
