And recent news, since Governor Greg Abbott signed House Bill [01:07.560 --> 01:12.760] 1325 legalizing Hemp and Attacks's law back in June, county prosecutors around the state, [01:12.760 --> 01:17.320] including Houston, Austin, and San Antonio, have been dropping marijuana possession charges and [01:17.320 --> 01:21.560] even refusing to file new ones, since they are stipulating that they do not have the time or [01:21.560 --> 01:26.920] the laboratory equipment to test the herb for THC. Margaret Moore, the Travis County District [01:26.920 --> 01:30.880] Attorney, announced earlier this month that she was dismissing 32 felony possession and [01:30.880 --> 01:35.320] delivery of marijuana cases because of the law. Mr. Abbott and other state officials, [01:35.320 --> 01:39.560] including the Attorney General, stipulated in a letter to county district attorneys back on [01:39.560 --> 01:44.560] Thursday that marijuana has not been decriminalized in Texas, and that these actions demonstrate [01:44.560 --> 01:50.960] a misunderstanding of how HB 1325 works, as well as other cities, too, like the district attorney. [01:50.960 --> 01:57.040] In El Paso, Cayma Esparza, a Democrat, who also stated earlier this month that the law, [01:57.040 --> 02:02.320] quote, will not have an effect on the prosecution of marijuana cases in El Paso. However, [02:02.320 --> 02:06.840] the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender in [02:06.840 --> 02:11.360] Harris County, who stated that, quote, the law is constantly changing on what makes something [02:11.360 --> 02:15.880] illegal based on its chemical makeup. It's important that if someone is charged with something, [02:15.880 --> 02:25.200] the test matches what they're charged with. A paper by Tulane University identified a five [02:25.200 --> 02:30.840] and a half inch American pocket shark. As the first of its kind in the Gulf of Mexico, the specimen [02:30.840 --> 02:36.400] being only the second pocket shark ever captured or recorded with the other one being found way [02:36.400 --> 02:41.800] back in 1979 in the East Pacific Ocean. And then it turns out those who I did talk to directly about it, I said it, [05:42.500 --> 05:49.540] but there's no way that I could feel comfortable about their ability to proofread what I'm [05:49.540 --> 05:54.380] doing. It's kind of different, and I'm sorry that the thing keeps cutting out here. I don't [05:54.380 --> 06:00.620] know why that is. My sound is messed up for some reason, and I'm not sure what's causing [06:00.620 --> 06:06.900] it. One second it's fine, the next second it jumps us down. Now, during my writing today, I went through and I set up some more case law, and [07:30.860 --> 07:36.340] I did some more research on the statutes. And folks, the more I put this together, the [07:36.340 --> 07:44.420] more I realize that there is no way that the Texas courts don't know that they're doing [07:44.420 --> 07:52.020] this wrong. There's no way that they don't know that their intent is to avoid what the [07:52.020 --> 08:00.340] legislature wrote in order to construct a law that they want to operate a particular [08:00.340 --> 08:08.580] way. There's no way for them to disavow knowledge of that. Because when you read the rules of [08:08.580 --> 08:15.020] statutory construction and you read the statutes themselves, there is no way you can legitimately [08:15.020 --> 08:19.500] reach the conclusions reached by the third court of appeals in the county courts at law. [08:19.500 --> 08:27.580] There just isn't. You have to be intentionally avoiding what the chapters 311 and 312 of [08:27.580 --> 08:34.460] the Texas government code requires of you. And then you also have to avoid what the Texas [08:34.460 --> 08:42.220] Constitution requires of the legislature in order to find that the Texas transportation [08:42.220 --> 08:52.740] code is being validly upheld in any form or fashion. It was invalid law the moment the [08:52.740 --> 09:02.620] governor signed it. Why? Because it was not enacted in accordance with the Texas Constitution. [09:02.620 --> 09:11.620] Not in any way, shape, or form was it properly enacted in accordance with the Texas Constitution. [09:11.620 --> 09:18.780] This is the whole reason why I wrote the constitutional challenge motion to SB 971 because it was enacted [09:18.780 --> 09:30.100] in an entirely unconstitutional fashion. Now, let me read to you something that I've [09:30.100 --> 09:38.180] put together in my research today about how this works. Now, this is from the Encyclopedia [09:38.180 --> 09:50.820] of Law, 16th American Jurisprudence 2nd, Section 177, 2D, Section 256. And this is the general [09:50.820 --> 09:59.020] body of law dealing with unconstitutional statutes. This is the category analysis of [09:59.020 --> 10:06.380] this body of law. The general misconception is that any statute passed by the legislators [10:06.380 --> 10:12.740] bearing the appearance of law constitutes the law of the land. The U.S. Constitution [10:12.740 --> 10:22.780] is the supreme law of the land, and any statute to be valid must be in agreement. It is impossible [10:22.780 --> 10:30.740] for both the Constitution and a law violating it to be valid. One must prevail. This is succinctly [10:30.740 --> 10:37.580] stated as follows. The general rule is that an unconstitutional statute, though having [10:37.580 --> 10:45.940] the form and name of law, is in reality no law, but is wholly void and ineffective for [10:45.940 --> 10:53.180] any purpose. Since unconstitutionality dates from the time of its enactment and not merely [10:53.180 --> 11:01.220] from the date of the decision so branding it, an unconstitutional law in legal contemplation [11:01.220 --> 11:09.180] is as inoperative as if it had never been passed. Such a statute leaves the question [11:09.180 --> 11:15.140] that it purports to settle just as it would be had the statute not been enacted. Since [11:15.140 --> 11:22.620] an unconstitutional law is void, the general principles follow that it imposes no duties, [11:22.620 --> 11:30.620] confers no rights, creates no office, bestows no power or authority on anyone, affords no [11:30.620 --> 11:39.260] protection, and justifies no acts performed under it. A void act cannot be legally consistent [11:39.260 --> 11:47.460] with a valid one. An unconstitutional law cannot operate to supersede any existing valid [11:47.460 --> 11:54.940] law. Indeed, insofar as a statute runs counter to the fundamental law of the land, it is [11:54.940 --> 12:03.700] superseded thereby. No one is bound to obey an unconstitutional law and no courts are [12:03.700 --> 12:10.900] bound to enforce it. Strictly speaking, an unconstitutional statute is not a law and [12:10.900 --> 12:17.260] it should not be called a law, even if it is sustained by a court. For a finding that [12:17.260 --> 12:24.780] a statute or other official act is constitutional does not make it so, or confer any authority [12:24.780 --> 12:31.340] to anyone to enforce it. All citizens and legal residents of the United States by their [12:31.340 --> 12:37.500] presence on the territory of the United States are subject to the militia duty. Wait a minute. [12:37.500 --> 12:46.260] I'm sorry, wrong stuff here. All right, I read too far. But that's very important. Even [12:46.260 --> 12:54.700] if it is sustained by a court, an unconstitutional statute does not confer any authority to anyone [12:54.700 --> 13:02.380] to enforce it. That's kind of important, don't you think? So when the third court of appeals [13:02.380 --> 13:09.100] or the court of criminal appeals declares that the Texas Transportation Code is constitutional, [13:09.100 --> 13:16.940] they're dead wrong. And it is very easy to prove they're dead wrong. All you need is [13:16.940 --> 13:22.980] the enrolled bill. All you need is to show that the subject matter of that enrolled [13:22.980 --> 13:29.180] bill is being violated on a daily basis by the courts themselves. Then you show in the [13:29.180 --> 13:33.700] body of the bill where the waiver of the reading on the floor of each house over three [13:33.700 --> 13:41.540] several days was made. And you find out that that waiver does not comply with Article 3, [13:41.540 --> 13:50.100] Section 62 of the Texas Constitution. Instead, they tried to use the four-fifths majority [13:50.100 --> 14:01.740] vote rule that applies only to bills dealing with financial law under Section 49 of Article [14:01.740 --> 14:13.020] 3. Everything the legislature did to enact SB 971 was unconstitutional on its face. No [14:13.020 --> 14:24.220] ifs, no ands, no buts. And no enrolled bill doctrine can save it. Why? Article 1 of the [14:24.220 --> 14:32.140] Texas Constitution, Section 29, any law that violates any provision of the Texas Constitution [14:32.140 --> 14:40.500] is void. It doesn't have to be declared void by a court. It is freaking void as a matter [14:40.500 --> 14:49.380] of law. And because Section 29 is in the bill of rights, the courts have no legitimate [14:49.380 --> 14:55.900] authority to declare that the people of Texas in their individual capacities cannot file [14:55.900 --> 15:01.620] a suit to have the transportation code declared unconstitutional. Because according to its [15:01.620 --> 15:07.140] location in the bill of rights, we have the right to challenge any law that violates the [15:07.140 --> 15:19.500] Constitution. And that's exactly what we should be doing. SB 971 was not constitutionally [15:19.500 --> 15:26.940] enacted. Not only was it not constitutionally enacted, it illegally and fraudulently made [15:26.940 --> 15:33.500] substantive changes while telling the public to their face the ball face lie that there [15:33.500 --> 15:41.460] were no substantive changes contained in the recodification and there absolutely were. [15:41.460 --> 15:48.900] That too is very easy to prove using the enrolled bill and the prior version of the existing [15:48.900 --> 16:00.300] statutes before the recodification took place. The Texas courts are engaged in a criminal [16:00.300 --> 16:11.580] enterprise. Period. No yes, no ands, no buts. The courts facilitate this criminal enterprise [16:11.580 --> 16:21.820] with the cooperation and conspiratorial help of the Bar Association. This is the problem [16:21.820 --> 16:27.420] with having attorneys in every department of government. Hell, it's the problem with having [16:27.420 --> 16:37.140] attorneys in any department of government. Talk about letting the snake into the henhouse. [16:37.140 --> 16:46.420] Not just the fox, the snake goes after the eggs, not just the chickens. We got a problem [16:46.420 --> 16:52.620] people and the problem is our own apathy and our own lack of education on the law itself [16:52.620 --> 16:57.540] and what our public servants are doing and we need to change that. All citizens of legal residence of several union states by their presence [21:06.500 --> 21:11.100] in the territory of those states are subject to the militia duty, the duty of the social [21:11.100 --> 21:16.780] compact that creates the society which requires that each alone and in concert with others [21:16.780 --> 21:23.620] not only obey the constitution and constitutional official acts but help enforce them if necessary [21:23.620 --> 21:28.260] at the risk of one's life. That's what being part of a nation is all about. That's why [21:28.260 --> 21:34.580] we have the right to form militias, etc., etc., to defend America against invasion and [21:34.580 --> 21:40.500] attack. It's what the Second Amendment helps support in addition to preventing government [21:40.500 --> 21:49.020] tyranny. Therefore, any unconstitutional act of an official will at least be a violation [21:49.020 --> 21:54.900] of the oath of that official's office to execute the duties of his office and therefore grounds [21:54.900 --> 22:00.860] for his removal from office. No official immunity or privileges of rank or position survive [22:00.860 --> 22:07.020] the commission of unlawful acts. If it violates the rights of individuals, it is also likely [22:07.020 --> 22:13.940] to be a crime and the militia duty obligates anyone aware of such a violation to investigate [22:13.940 --> 22:20.620] it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment [22:20.620 --> 22:26.780] from a grand jury. And if one is obtained, prosecute the offender in a court of law. [22:26.780 --> 22:33.300] This right here goes back to the same general idea I have said before in that the people [22:33.300 --> 22:41.620] did not give government officials sole enforcement authority of constitutional mandates. We couldn't [22:41.620 --> 22:48.020] because it is part of our inherent individual duty to support and defend that constitution, [22:48.020 --> 22:56.580] state, and federal. As able-bodied men capable of participating in the militias, we have [22:56.580 --> 23:04.660] that duty inherent in us. But we have an oligarchy that has taken over every branch of [23:04.660 --> 23:13.140] our government and made their class of elitists all powerful in every aspect of our government. [23:13.140 --> 23:20.820] Therefore our voice no longer matters and is no longer heard. It is no longer recognized. [23:20.820 --> 23:30.220] Therefore we are mute. And who do we have to thank for that? The attorneys. They create [23:30.220 --> 23:36.540] the laws that empower themselves to usurp an authority that does not belong to them, [23:36.540 --> 23:42.420] to prohibit participation in an entire department of our government that does not belong to [23:42.420 --> 23:50.260] them. And yet they are the only ones allowed to occupy any position of authority and power [23:50.260 --> 24:00.780] in it if it sets precedent. Think about that. You want to know what's wrong with America? [24:00.780 --> 24:09.220] It's not just stupid people. It's greedy, evil people being assisted by all the stupid [24:09.220 --> 24:17.100] people and getting their achievements accomplished, which is to take over every point of power [24:17.100 --> 24:21.140] and authority in the government that they possibly can. [24:21.140 --> 24:26.020] Why do you think the young people are being so indoctrinated into socialism in schools? [24:26.020 --> 24:32.580] Why do you think college professors teach it like it is the only way to live? Why do [24:32.580 --> 24:37.940] you think the teaching of law is geared toward the socialist idea that the state is always [24:37.940 --> 24:49.060] right and the individual is always wrong? When did we lose the ability to reason to [24:49.060 --> 25:00.180] such a degree that we would accept that as normal and proper? [25:00.180 --> 25:04.700] Think back to the things that you learned in school if you're my age. And think back [25:04.700 --> 25:09.700] to what your kids are coming back if you have kids from school today and telling you they [25:09.700 --> 25:15.220] learned about. Social studies is the thing of the past. It was one of the things that [25:15.220 --> 25:21.180] I had taught us about other cultures, other countries, and blah, blah, blah. We had American [25:21.180 --> 25:27.140] history which taught us, albeit I would not say absolutely correctly, but at least an [25:27.140 --> 25:32.620] idea of right and wrong in American history. And I got to tell you, despite what the history [25:32.620 --> 25:45.500] books tried to convey as far as the taking over of the country by American whites from [25:45.500 --> 25:50.220] the Indians and so on and so forth, in my heart and soul I've always wanted to be on [25:50.220 --> 25:55.780] the side of the Indians. Why? Not because they lost, but because they were the only [25:55.780 --> 26:03.180] ones fighting the good fight. They were fighting for their very survival, their way of life, [26:03.180 --> 26:14.220] their existence. And yet they were demonized in most of history. They're demonized in [26:14.220 --> 26:20.380] virtually every old movie you could think of. They're always the savage, they're always [26:20.380 --> 26:27.500] the cutthroat, they're always the one that's just seeking to do harm for no valid reason. [26:27.500 --> 26:34.300] And that's just not the way it really was. I guarantee you it wasn't. But people who [26:34.300 --> 26:42.940] are pushed to the very edge of extinction will do almost anything to preserve themselves [26:42.940 --> 26:54.620] from that extinction. Wouldn't you agree? Wouldn't you? When your enemy is being absolutely [26:54.620 --> 27:02.940] ruthless to you, how does it benefit you to not be ruthless in dealing with your enemy? [27:02.940 --> 27:07.700] Especially when your enemy outnumbers you, especially when your enemy is better armed [27:07.700 --> 27:15.140] than you, better trained, better prepared, and always more willing to commit atrocities [27:15.140 --> 27:27.980] than even you are. That's something to think about, don't you think? And here in modern [27:27.980 --> 27:37.300] America we have people telling us how we have to live our life, when we can come and go, [27:37.300 --> 27:43.140] who we can associate with, how we're required to do it, and when and where we can move only [27:43.140 --> 27:56.580] with government permission or by some government-approved methods. That is not America, people. That's [27:56.580 --> 28:05.500] some Stalinist convert well on its way to becoming full-blown communism all over again. [28:05.500 --> 28:11.700] All it's done is switch locations in the world now. That's all. Think about that. Russia [28:11.700 --> 28:21.620] becomes free and open, and America becomes what Russia was. And you can't seem to teach [28:21.620 --> 28:27.660] history to these kinds of people. They can never see the forest for the trees. Their [28:27.660 --> 28:34.140] ideal is all that matters, no matter how much evidence proves their ideal is hopeless. It [28:34.140 --> 28:43.340] doesn't work. It does nothing but destroy. It never builds. It is always destructive. [28:43.340 --> 28:57.540] And yet it just hadn't been done right. Okay. So my plan for folks like that, if I could [28:57.540 --> 29:03.900] get elected absolute dictator of the United States for a year, everybody with that mindset [29:03.900 --> 29:07.580] would be rounded up and placed on an island. They could turn that into their communist [29:07.580 --> 29:14.780] utopia, and the rest of us will sit back and watch. And then when the island bursts into [29:14.780 --> 29:20.540] flames and destroys them all, they don't have anybody to blame but themselves, right? When [29:20.540 --> 29:25.500] they're down to eating each other because their ideals have made it impossible to live [29:25.500 --> 29:31.420] on that island amongst each other, and they're all starving because nobody wants to work, [29:31.420 --> 29:42.860] nobody wants to do anything, nobody's capable of doing anything, then what? Now, in all the things that I have researched and written [34:15.860 --> 34:22.860] about in the years that I've been doing this, the fact that the law is not being complied [34:22.860 --> 34:28.860] with or honestly interpreted by the courts is one of the biggest causes for the body [34:28.860 --> 34:35.860] of case law that exists on this subject. The courts are intentionally deceiving the masses [34:35.860 --> 34:41.860] through the use of legalese and the legal semantics that are inherent in legalese. And [34:41.860 --> 34:49.860] if you didn't know legalese is a specific thing, it's a real thing. It is defined as [34:49.860 --> 34:58.860] a body of language that is intended to be unknown to the layman. Okay. And it's used [34:58.860 --> 35:09.860] exclusively in the area of law. It is used to create statutes, it is used to formulate [35:09.860 --> 35:22.860] and voice legal arguments. Everything about legalese is designed to make it where it [35:22.860 --> 35:33.860] sounds like A and B are both A, when in fact they are two distinctly separate things. But [35:33.860 --> 35:39.860] because they look the same, they sound the same, they're spelled the same in the legal [35:39.860 --> 35:46.860] semantic world, their construed is being the same, when in fact they are not. And the [35:46.860 --> 35:54.860] proof of that is that one belongs under a specific subject matter created by the legislature [35:54.860 --> 36:00.860] in the form of the enrolled bill that enacted the law. Every enrolled bill in Texas must [36:00.860 --> 36:09.860] state the subject matter to which every statute in it is relative in the title of the bill. [36:09.860 --> 36:16.860] And in SB 971 it specifically says that this is a recodification of the body of law relating [36:16.860 --> 36:25.860] to transportation. Doesn't say anything else that it's applicable to because it can't. It [36:25.860 --> 36:37.860] has to be transportation. Because transportation is the governing subject matter of that bill, [36:37.860 --> 36:48.860] every single statute and offense codified in that bill must be shown to relate to an act [36:48.860 --> 36:59.860] of transportation. And if it isn't, then the prosecutor and the court are engaging in [36:59.860 --> 37:08.860] fraud. Okay? They are engaging in fraud. And this goes to something that I posted today [37:08.860 --> 37:14.860] on Facebook. I made a meme out of it, but this is something that's actually in the book. [37:14.860 --> 37:23.860] And it says this, every single offense codified in any state code is directly dependent upon [37:23.860 --> 37:30.860] proving the existence of its governing subject matter before it has any valid legal application [37:30.860 --> 37:40.860] of any kind. Anything else is an illegal conviction achieved via prosecutorial and judicial [37:40.860 --> 37:47.860] misconduct and fraud, cooperatively perpetrated by allowing the direct verbal manipulation [37:47.860 --> 37:55.860] and manufacture of facts and evidence, which itself constitutes the knowing and willful [37:55.860 --> 38:03.860] commission of a multitude of felony crimes. And that, ladies and gentlemen, is exactly [38:03.860 --> 38:11.860] what our courts are doing every single day. Let me explain manipulation and manufacture [38:11.860 --> 38:17.860] of facts and evidence. The criminal complaint in the transportation case says that you were [38:17.860 --> 38:23.860] operating a motor vehicle. Yet, it says absolutely nothing about having been engaged in [38:23.860 --> 38:31.860] transportation at the time you were allegedly operating this motor vehicle. Keep in mind [38:31.860 --> 38:38.860] that because transportation is the single subject matter under which motor vehicle and [38:38.860 --> 38:47.860] operating are defined and thus created and exist, you can't have either of those without [38:47.860 --> 38:54.860] the existence of transportation itself. Yet, the charging instrument does not even mention [38:54.860 --> 39:05.860] transportation at all. And because it fails to mention transportation, they are trying [39:05.860 --> 39:14.860] to create a reverse inference of an existing element, that of transportation. Just by saying [39:14.860 --> 39:19.860] operating a motor vehicle, they're trying to invoke transportation by osmosis. The problem [39:19.860 --> 39:26.860] is in a criminal matter, you cannot assume any element of the offense to be asserted [39:26.860 --> 39:32.860] and proven. It must be directly asserted and directly proven at the evidentiary phase [39:32.860 --> 39:37.860] of the trial. Otherwise, the conviction is completely invalid. And due process was [39:37.860 --> 39:42.860] denied the individual who was accused and prosecuted in the case. Why? Because they [39:42.860 --> 39:47.860] were not given all the necessary information and proper notice by which to put up a proper [39:47.860 --> 39:55.860] and full defense. To fail to allege the existence of transportation, not only denies them in [39:55.860 --> 40:00.860] the right of due process, it denies them in an absolutely affirmative defense against [40:00.860 --> 40:06.860] prosecution. I was not engaged in transportation and you have no evidence that I was engaged [40:06.860 --> 40:12.860] in transportation. You have no logbook, you have no passenger manifest, you have no bill [40:12.860 --> 40:17.860] of lading and you have no confession from me that says I was. In fact, you have an absolute [40:17.860 --> 40:25.860] denial that I was. That, ladies and gentlemen, is the full and proper law. That is how it [40:25.860 --> 40:32.860] is supposed to be used and ruled upon and interpreted, but it's not. Instead, the Third [40:32.860 --> 40:39.860] Court of Appeals decided to ignore Chapter 311 and 312 of the Texas Government Code and [40:39.860 --> 40:45.860] went directly to the prospect of saying that transportation is nothing more than a word [40:45.860 --> 40:52.860] in the title of the published version of the code. They didn't even mention that it's a [40:52.860 --> 41:01.860] word signifying the single subject in the title of the enrolled bill SB 971. They didn't [41:01.860 --> 41:11.860] address that at all. They completely ignored it. They chose instead to lie and perpetrate [41:11.860 --> 41:17.860] fraud upon the general public and be accused in the case by saying that transportation [41:17.860 --> 41:27.860] was not relevant to the case. How can the primary subject matter of the legislation you are using [41:27.860 --> 41:38.860] to vomit the prosecution and the facts and evidence and submit them to a court not be [41:38.860 --> 41:54.860] relevant? How is that even possible? You can't do it. It's impossible. And yet, the Third [41:54.860 --> 42:00.860] Court of Appeals and its infinite ignorance, I can't say wisdom because they've demonstrated [42:00.860 --> 42:04.860] time and time again they absolutely have none. This is the most incompetent bunch of [42:04.860 --> 42:13.860] foul-ups you could ever hope to pin a bar card to. There's no way around that. But the [42:13.860 --> 42:21.860] fact of the matter is that it is a corrupt opinion from the word go. Every opinion they [42:21.860 --> 42:28.860] did in Perkins, Leverson, all of them, every one of them that says transportation is irrelevant [42:28.860 --> 42:40.860] is a corrupt opinion. It is absolute proof of judicial incompetence from the word go. [42:40.860 --> 42:44.860] And these are the people that you trust to treat you fairly and properly in a court of [42:44.860 --> 42:49.860] law. These are the people that were sitting in district courts doing exactly the same [42:49.860 --> 43:02.860] kind of stupid crap in every case that came before them. We have a loud incompetence and [43:02.860 --> 43:12.860] elitist take control of our entire government and use it to line their own pockets. I mean, [43:12.860 --> 43:21.860] let's look at some facts here. Now, when the State Bar Act went into completion, we had, I think it was, 89% of [46:52.860 --> 46:57.860] one house was attorneys, 49% of the other house was attorneys, and all of them voted to approve [46:57.860 --> 47:04.860] the State Bar Act. All of them were ineligible to vote, all of them, okay, because they had [47:04.860 --> 47:09.860] a direct personal interest in the outcome of the bill. And the Texas Constitution specifically [47:09.860 --> 47:13.860] prohibits any legislator from voting on any bill in which they have a direct personal interest. [47:13.860 --> 47:22.860] Okay. What did the State Bar Act do? It gave attorneys sole power in the judicial department [47:22.860 --> 47:32.860] of government. Now, how can legislation subordinate to the Texas Constitution take away the right [47:32.860 --> 47:39.860] of the people to participate in an entire department of their own government? [47:39.860 --> 47:47.860] Simple answer is, it can't. Other simple answer is, it did. And then they use the power of [47:47.860 --> 47:53.860] the State to enforce their monopoly control over an entire department of our government. [47:53.860 --> 48:00.860] Okay. These are the types of career criminals you are dealing with. Everything about the State [48:00.860 --> 48:08.860] Bar is absolutely corrupt. It is absolutely unconstitutional. Not only is it an unconstitutional [48:08.860 --> 48:14.860] monopoly, but it disenfranchises the people of Texas for participation in that entire [48:14.860 --> 48:20.860] department of our government. Okay. We have no power and authority as individuals to hold [48:20.860 --> 48:27.860] any office in that side of the, in that particular department that has any actual control over [48:27.860 --> 48:35.860] the outcome of a case. None. And because of the things we know, we can't even sit on the [48:35.860 --> 48:46.860] juries and the grand juries to get these people prosecuted for these crimes because they fix [48:46.860 --> 48:55.860] the juries. It's called jury tampering. When they sit there with the intent of getting rid [48:55.860 --> 49:02.860] of anyone that has an opposing view of how government works to those who are currently [49:02.860 --> 49:07.860] controlling how that particular department of government works, that's tampering with [49:07.860 --> 49:17.860] the jury. They're trying to ensure not a fair trial for the State, but a favored trial for [49:17.860 --> 49:25.860] the State because the only people left to sit on the juries are the sheep who either [49:25.860 --> 49:32.860] don't know or don't want to know any more or any better than they do about what the limits [49:32.860 --> 49:38.860] of the government actually are. What proper power it holds and what illegal power it is [49:38.860 --> 49:51.860] exercising. And that's just a simple fact, people. Your government has betrayed you and the [49:51.860 --> 49:58.860] State bar is one of the biggest pry bars used to make that happen. That's why the attorneys [49:58.860 --> 50:06.860] now sit in every office of power in every department of government. You point at any [50:06.860 --> 50:12.860] office in any part of the Texas government that has the power to make rules and decisions [50:12.860 --> 50:24.860] that can be promulgated statewide and I'll show you an attorney with that job title. [50:24.860 --> 50:36.860] Our governor, our lieutenant governor, our speakers of each house, our attorney general, [50:36.860 --> 50:45.860] I mean, you name it. Pick any of them and you will find that to be the case. And that's [50:45.860 --> 50:53.860] the way it's been for quite a long time now. And the State Bar Act is why. Imagine if you [50:53.860 --> 51:00.860] will what the outcome would be if people like myself who knew what the law says and what [51:00.860 --> 51:07.860] the law requires and what the Constitution forbids was able to directly file charges [51:07.860 --> 51:22.860] and prosecute these individual members of the government for their acts. Can you imagine [51:22.860 --> 51:31.860] the circus that would create? Not because it's wrong but because of the things it would get [51:31.860 --> 51:39.860] them to do to try to avoid being prosecuted. The things they would try to enact, the power [51:39.860 --> 51:45.860] they would try to take, the whole reason they've done that is to prevent exactly that so that [51:45.860 --> 51:51.860] they are insulated and protected from the prosecutions they know would follow if someone [51:51.860 --> 52:02.860] had the power to come after them and someone knew how and why to come after them. [52:02.860 --> 52:07.860] I'm telling you folks, we don't need a president. We don't need a Congress. What we need is [52:07.860 --> 52:12.860] someone with this knowledge and this desire to fix these specific problems running and [52:12.860 --> 52:20.860] holding the office of absolute dictator. Someone willing to do it for only a specific [52:20.860 --> 52:25.860] period of time, long enough, if they want to suspend the Constitution to get their way [52:25.860 --> 52:30.860] right now, I say let the dictator suspend it long enough to gank them out of their homes, [52:30.860 --> 52:35.860] take all their property, convert it back to the people and send every one of these people [52:35.860 --> 52:40.860] to Gitmo for life or airdrop them into the next foreign country they've been bombing [52:40.860 --> 52:46.860] for the last 10 decades. [52:46.860 --> 52:50.860] Personally, I think that would save us all a lot of headaches if we just airdropped them [52:50.860 --> 52:55.860] into every foreign country they've been bombing, exploiting and manipulating for the last few [52:55.860 --> 53:08.860] decades they've been in power. I think that would be justice, real justice. [53:08.860 --> 53:12.860] But of course, here in America we can't do those sort of things because we'd rather just [53:12.860 --> 53:20.860] sit by and let those in power get away with the crap they're pulling. [53:20.860 --> 53:27.860] I got to tell you folks, I would be ashamed to be the one that had to describe our current [53:27.860 --> 53:32.860] predicament to the founding fathers. [53:32.860 --> 53:35.860] Because all I could do is stand there and say, well, you know, and throw my hands up in here [53:35.860 --> 53:39.860] and say this is what they allowed to happen. This is what's currently going on. [53:39.860 --> 53:43.860] This is what I tried to educate people about. This is what I told them. [53:43.860 --> 53:47.860] This is why I told it to them. And by the way, guys, this is where I think you screwed up [53:47.860 --> 53:52.860] in how you did things in the very beginning that could have made this. [53:52.860 --> 53:57.860] I know that in your era you were geniuses and that your language and everything was intended [53:57.860 --> 54:00.860] to be as precise as possible in what you did. [54:00.860 --> 54:06.860] But while you were planning for future events in the way you wrote that Constitution, [54:06.860 --> 54:10.860] you should have been a little bit more adamant about the concrete foundation [54:10.860 --> 54:17.860] upon which all of it was to rest. And that is, is that government can make no law [54:17.860 --> 54:23.860] that governs the people in any form or fashion other than as punishment for a violation [54:23.860 --> 54:29.860] of the rights person or property of another. Had you done that one little thing, [54:29.860 --> 54:36.860] this would be a whole different world today than it is right now. [54:36.860 --> 54:41.860] Because the moment they tried to enact a law that made it where we had to get a license [54:41.860 --> 54:45.860] to get a gun, we could have gone and seized them and prosecuted them [54:45.860 --> 54:49.860] and made damn sure they never were able to do it again. [54:49.860 --> 54:52.860] And we would have had the backing of the Constitution to make that happen. [54:52.860 --> 54:56.860] We wouldn't have had to make a formal declaration of war because no court would have been able [54:56.860 --> 54:59.860] to say we didn't have the right to enforce the Constitution as it's written. [54:59.860 --> 55:03.860] You would have put it in there so that we could. [55:03.860 --> 55:06.860] But because you didn't and the attorneys took over, [55:06.860 --> 55:11.860] they decided to rewrite what you wrote and make it sound completely different [55:11.860 --> 55:19.860] and reasonable according to how they want reality portrayed to the people of today. [55:19.860 --> 55:25.860] And because of that, we all have suffered. [55:25.860 --> 55:30.860] I can't tell you the number of times I have sat down and worked on a constitutional rewrite [55:30.860 --> 55:32.860] of the Texas Constitution. [55:32.860 --> 55:36.860] My version is definitely a whole lot shorter than the existing version. [55:36.860 --> 55:39.860] I got to tell you that. So is the Bill of Rights for that matter. [55:39.860 --> 55:44.860] Because the Bill of Rights is absolutely very simple in my version of the Texas Constitution. [55:44.860 --> 55:49.860] First and foremost, every person in the state of Texas has the absolute power [55:49.860 --> 55:52.860] and authority in standing to enforce any provision of this Constitution [55:52.860 --> 56:01.860] against any public official of any nature whatsoever, regardless of position or title. [56:01.860 --> 56:05.860] That means we are standing to sue any public official to violate the Constitution [56:05.860 --> 56:07.860] and to make sure the courts hear it. [56:07.860 --> 56:13.860] Second, the people shall not be charged any fee of any kind to access the courts of this state [56:13.860 --> 56:19.860] nor any federal court operating within its territorial jurisdiction. [56:19.860 --> 56:24.860] The legislature, the people have the right to refuse to abide by any law enacted by the legislature [56:24.860 --> 56:30.860] that attempts to regulate, abrogate, or derogate any individual right, person, or property [56:30.860 --> 56:37.860] absent an offense against the person, rights, or property of another. [56:37.860 --> 56:39.860] Very short and simple Bill of Rights. [56:39.860 --> 56:48.860] All rights are individual rights and no law or court opinion shall alter this fundamental fact. [56:48.860 --> 56:52.860] No court opinion shall be a substitute for the law. [01:01:04.860 --> 01:01:24.860] In recent news, since Governor Greg Abbott signed House Bill 1325 legalizing heaven attacks his law back in June, county prosecutors around the state, including Houston, Austin, and San Antonio, have been dropping marijuana possession charges and even refusing to file new ones since they are stipulating that they do not have the time or the laboratory equipment to test the earth for THC. [01:01:24.860 --> 01:01:33.860] Margaret Moore, the Travis County District Attorney, announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana cases because of the law. [01:01:33.860 --> 01:02:01.860] Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter that county district attorneys back on Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate a misunderstanding of how HP 1325 works, as well as other cities too, like the district attorney in El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law, quote, will not have an effect on the prosecution of marijuana cases in El Paso. [01:02:01.860 --> 01:02:12.860] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County, who stated that, quote, the law is constantly changing on what makes something illegal based on its chemical makeup. [01:02:12.860 --> 01:02:22.860] It's important that if someone is charged with something, the test matches what they're charged with. [01:02:22.860 --> 01:02:38.860] A paper by Tulane University identified a five and a half inch American pocket shark as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured or recorded with the other one being found way back in 1979 in the East Pacific Ocean. [01:02:38.860 --> 01:02:51.860] According to the university paper, the shark secretes a luminous fluid from a gland near its front fins for the purpose it is hypothesized to lure and prey who may be drawn into the glow. The judges themselves are. [01:07:10.860 --> 01:07:13.860] There's not, the governor don't have nothing to do with the... [01:07:13.860 --> 01:07:20.860] No. The governor's an executive officer. He has no direct authority over the judicial branch. That would be a violation of the separation of powers. [01:07:20.860 --> 01:07:27.860] Well, I was thinking about that, but I did not know for sure who would actually be in charge of that person who's supposed to... [01:07:27.860 --> 01:07:38.860] Well, when your court says that they're doing the opinion they're giving is based upon a government necessity, the courts are telling you that they're not acting free and independent. [01:07:38.860 --> 01:07:42.860] They're acting as an arm of the executive when they do that. [01:07:42.860 --> 01:07:56.860] Whether they want to admit it or not is a whole other story, but the fact is that when the court says it's rendering its opinion based upon a perceived government necessity rather than the law or the rights of the individual, then the court has chosen sides. [01:07:56.860 --> 01:08:01.860] And it has violated its duty to the people when it does that. [01:08:01.860 --> 01:08:08.860] But yeah, the executive does not have the authority to dictate anything as far as the judges and how they do their job. [01:08:08.860 --> 01:08:18.860] Now, what the executive does have the authority to do is to criminally charge a judge who doesn't do their job. [01:08:18.860 --> 01:08:22.860] But they don't do it. Why? Because they're in cahoots together. [01:08:22.860 --> 01:08:27.860] Remember, I told you, attorneys control every office in every department. [01:08:27.860 --> 01:08:34.860] They're not going to bite the hand that basically stuffs money in the other one's pockets. [01:08:34.860 --> 01:08:43.860] So has anybody actually followed the people who would not charge, bring up criminal charges against judges? [01:08:43.860 --> 01:08:49.860] Can't you go after them? The ones who say they did nothing wrong? [01:08:49.860 --> 01:08:51.860] Well, I'm not sure I understand your question. [01:08:51.860 --> 01:09:03.860] We have the right to file charges against them, but you still have to, they still have to be the ones to move forward to prosecute them because we have no power to directly prosecute, which is something I would change in our Constitution [01:09:03.860 --> 01:09:06.860] if I had the ability to do it and get it enacted. [01:09:06.860 --> 01:09:20.860] I would adamantly insist that the people as individuals have every right to form a citizen's grand jury and a citizen's court to prosecute public officials for violations of their oath of office and the Constitution. [01:09:20.860 --> 01:09:31.860] Right. Well, I get kind of confused about it because they got the common law before when it comes to a lot of cases, and that used to be the situation. [01:09:31.860 --> 01:09:36.860] No, you misunderstand what the situation of common law was. [01:09:36.860 --> 01:09:47.860] The common law was still overseen by a judge that worked for the king, okay, or by a sheriff that worked for the king. [01:09:47.860 --> 01:09:50.860] He was the chief magistrate. [01:09:50.860 --> 01:10:03.860] A body of the people of the villager town or whatever were the offense occurred and the person who was being charged resided were the ones who decided their fate, okay? [01:10:03.860 --> 01:10:12.860] But as far as applying the law, that still fell to someone who worked for the king. [01:10:12.860 --> 01:10:27.860] Okay. All right, anyway, when you had to tap your phone on or tap it the first time when it was griggly, that worked, and then you got griggly when you went off air and came back up. [01:10:27.860 --> 01:10:30.860] Yeah, I don't know why it's doing that, and I've got to figure out why. [01:11:15.860 --> 01:11:21.860] Where would you have to go in order to make the argument that the attorneys were acting unconstitutionally? [01:11:21.860 --> 01:11:25.860] Straight to their attorneys, as well in the patent. [01:11:25.860 --> 01:11:31.860] Yeah, you'd have to go straight to the courts, controlled by the same attorneys that you're accusing of committing high crimes and misdemeanors. [01:11:31.860 --> 01:11:33.860] How do you think that's going to play out? [01:11:33.860 --> 01:11:35.860] I know. [01:11:35.860 --> 01:11:37.860] You see the problem now? [01:11:37.860 --> 01:11:50.860] The people can't get remedy because there is no remedy to be had at the hands of those who are the actual guilty parties that are being accused, who get to decide their own fate and whether or not they're right and wrong. [01:11:50.860 --> 01:11:54.860] Because they're never wrong if you ask one of them. [01:11:54.860 --> 01:11:56.860] Right. [01:11:56.860 --> 01:12:04.860] I mean, this is exactly the reason why there was a First American Revolution. [01:12:04.860 --> 01:12:10.860] Because there was no legitimate way for the people to obtain remedy from the King. [01:12:10.860 --> 01:12:22.860] Well, here we are supposed to be the King, not the subject, and yet that's exactly how we're treated by our own public servants. [01:12:22.860 --> 01:12:28.860] And that needs to stop, even if it means they need to be hung. [01:12:28.860 --> 01:12:37.860] Well, that's what a lot of people are saying, because you don't have no remedy, and a lot of people give up because they say, well, you can't win. [01:12:37.860 --> 01:12:45.860] The thing is, they give up believing they can't win because they also believe they are alone. [01:12:45.860 --> 01:12:49.860] And when you're alone, you're right, you can't win. [01:12:49.860 --> 01:12:51.860] Right. [01:12:51.860 --> 01:12:57.860] It seems like they have more power with the number of people. [01:12:57.860 --> 01:13:06.860] Yeah, and that's exactly the whole reason this show exists, to make that number of people, to get the people educated enough to realize what's happening, [01:13:06.860 --> 01:13:12.860] who's responsible, and what can be done about it, and why it has to be done that way. [01:13:12.860 --> 01:13:17.860] There is no political remedy available. [01:13:17.860 --> 01:13:21.860] There is no judicial remedy available. [01:13:21.860 --> 01:13:30.860] The people are stuck between a rock and a hard place for the private interest of the attorneys. [01:13:30.860 --> 01:13:39.860] Well, I don't know if you can get ever convinced today, calling people with this, is anybody who's even associated with lawyers or anything else in office, [01:13:39.860 --> 01:13:48.860] why don't people just start voting for people who is in common that has nothing to do with government whatsoever, and start voting for them, and put them in. [01:13:48.860 --> 01:13:52.860] Now, let's look at this from a reasonable point of view. [01:13:52.860 --> 01:14:00.860] Why would people vote for people like Feinstein, Pelosi, Clinton, or any of the rest of them? [01:14:00.860 --> 01:14:02.860] But they get votes, don't they? [01:14:02.860 --> 01:14:05.860] And they get a lot of them, don't they? [01:14:05.860 --> 01:14:06.860] Right. [01:14:06.860 --> 01:14:12.860] So the simple answer to your question is because we're still outnumbered by really stupid people. [01:14:12.860 --> 01:14:16.860] Yeah, well, I agree we do there. [01:14:16.860 --> 01:14:26.860] That's why you can't do it the way you're talking about doing it, that's why I said the only way this will ever work is for someone to be appointed absolute dictator. [01:14:28.860 --> 01:14:39.860] Short of a revolutionary war, an outright revolutionary war is for someone to be appointed absolute dictator who can do the things that need to be done to really and truly clean out the swamp from top to bottom. [01:23:47.860 --> 01:23:58.860] They're not going to give up the stranglehold they have on us or on our government if there's no threat to make them do it. [01:23:58.860 --> 01:24:09.860] And right now, they can see no threat because they control every aspect of the government itself in how the process would have to be followed under that government to get to them. [01:24:09.860 --> 01:24:21.860] So they can change the rules, they can redirect them, they can come up with any reason they want and they have numerous times as to why they're untouchable, [01:24:21.860 --> 01:24:32.860] why they can't be held accountable, why they're not wrong even though they are and should be in every respect. [01:24:32.860 --> 01:24:45.860] When a judge decides for himself that he is untouchable under the law, even though he directly violated the law to do the things he's done, that's not a public servant. [01:24:45.860 --> 01:24:50.860] That's a criminal clothed with public authority. [01:24:50.860 --> 01:24:56.860] That's all it is, an outright criminal sitting in our public office. [01:24:56.860 --> 01:25:04.860] And if you think any of these people aren't criminal, then you aren't really paying attention and looking very hard. [01:25:04.860 --> 01:25:13.860] I can go back through the opinions pinned by a lot of these judges and I can show you where they violated their oath of office the moment they put pinned the page. [01:25:13.860 --> 01:25:22.860] The moment they sent this ruling out to the public as a decision in a case, they violated their oath of office. [01:25:22.860 --> 01:25:29.860] Because as we well know, when a law violates the Constitution, that law is invalid. [01:25:29.860 --> 01:25:36.860] And when that law harms an individual for no other purpose than the benefit of the law itself, that law is dead wrong. [01:25:36.860 --> 01:25:50.860] When the only harm suffered by an individual member of the public is brought about by the enforcement of the law itself, the law is wrong. [01:25:50.860 --> 01:26:00.860] And whoever is pushing for its enforcement is equally wrong, responsible and liable. [01:26:00.860 --> 01:26:03.860] And that is exactly how it should be. [01:26:03.860 --> 01:26:09.860] We did not grant any of these people special privileges to Lord over us. [01:26:09.860 --> 01:26:14.860] We did not grant them special exemptions from prosecutions to Lord over us. [01:26:14.860 --> 01:26:21.860] We did not grant them special power to be treated better or differently than any of the rest of us. [01:26:21.860 --> 01:26:27.860] That, ladies and gentlemen, is something they have sought to give themselves. [01:26:27.860 --> 01:26:33.860] That too is not a public servant. [01:26:50.860 --> 01:26:57.860] The county came here, came to the tickets, you know, for weeds, grass, abandoned cars, stuff like that. [01:26:57.860 --> 01:26:59.860] You need about six tickets. [01:26:59.860 --> 01:27:11.860] I filed a civil suit in the United States federal court and they granted me a, you know, the thing on it. [01:27:11.860 --> 01:27:14.860] Summary judgment? [01:27:14.860 --> 01:27:17.860] I think it's just a summary judgment yet, it's still open. [01:27:17.860 --> 01:27:25.860] I went over and had a deposition done and the case is going to come up in May. [01:27:25.860 --> 01:27:38.860] Okay, so the thing was, is that I also filed against like the JP, the municipal judge, also filed against the jail, too, on a civil right. [01:27:38.860 --> 01:27:49.860] And there was another, they sent a help officer over from the, and I filed a civil suit against them. [01:27:49.860 --> 01:28:02.860] Now, the thing was that they wrote me back and told me that I can't file because of an injunction against me. [01:28:02.860 --> 01:28:11.860] Because I tried to file for a declaratory judgment so I could file criminal charges against all these people. [01:28:11.860 --> 01:28:19.860] And so what I did is I looked up the case summary in the federal court. [01:28:19.860 --> 01:28:24.860] Who wrote you saying you couldn't file? [01:28:24.860 --> 01:28:26.860] The judge did. [01:28:26.860 --> 01:28:29.860] The judge of what court? [01:28:29.860 --> 01:28:31.860] Federal court. [01:28:31.860 --> 01:28:35.860] That there was an injunction from who for what? [01:28:35.860 --> 01:28:40.860] It didn't say, it says injunction. [01:28:40.860 --> 01:28:51.860] Now, I don't know what that says for the, it says it cannot file anymore for the injunction. [01:28:51.860 --> 01:28:56.860] Because I think maybe I filed too many lawsuits against everybody. [01:28:56.860 --> 01:28:59.860] Have you been ruled a vexatious litigant? [01:34:35.860 --> 01:34:40.860] Right, they're trying to call you a vexatious litigant. [01:34:40.860 --> 01:34:43.860] I thought they had to write that out. [01:34:43.860 --> 01:34:49.860] Well, apparently they're supposed to have a hearing on the subject, which is what this order is saying they did. [01:34:49.860 --> 01:34:51.860] Were you present for this? [01:34:51.860 --> 01:34:53.860] No. [01:34:53.860 --> 01:35:01.860] Did they send you something saying that you needed to send them a response as to why you should not be considered a vexatious litigant? [01:35:01.860 --> 01:35:05.860] That's what this is saying it's supposed to be doing. [01:35:05.860 --> 01:35:14.860] Yeah, I called you on this once before and I remember you telling me about a vexatious litigant and that's what I was watching for. [01:35:14.860 --> 01:35:20.860] Okay, but that's not how they're wording it, though that's what it's actually called. [01:35:20.860 --> 01:35:23.860] They're saying it just like it is in this notice you're reading. [01:35:23.860 --> 01:35:37.860] Did you get a notice saying they wanted you to send them something in response to the question of why you shouldn't be considered someone with an injunctive filing requirement? [01:35:37.860 --> 01:35:53.860] But it says here also that claimant is enjoined as pursuers to the All Rights Act 28 USC 91651. [01:35:53.860 --> 01:36:00.860] From filing any new civil actions, arising claims based upon the same subject matter raised. [01:36:00.860 --> 01:36:02.860] Yeah, vexatious litigants, David. [01:36:02.860 --> 01:36:12.860] David, vexatious litigants, now go back to the first thing you read on that document. [01:36:12.860 --> 01:36:20.860] The date for the recent stages in the court memorandum entered on docket February 27. [01:36:20.860 --> 01:36:22.860] Continue. [01:36:22.860 --> 01:36:30.860] Oh, the court having given plaintiff an opportunity to show cause as to why he should not see something. [01:36:30.860 --> 01:36:33.860] The court having given plaintiff an opportunity. [01:36:33.860 --> 01:36:37.860] When and where were you given this opportunity? [01:36:37.860 --> 01:36:41.860] Probably on the 27th on that last. [01:36:41.860 --> 01:36:44.860] What do you mean probably? [01:36:44.860 --> 01:36:47.860] I don't know it's laying over there. [01:36:47.860 --> 01:36:51.860] I filed against the jail on the civil action. [01:36:51.860 --> 01:36:54.860] Okay, that's not an answer to my question. [01:36:54.860 --> 01:37:02.860] Filing a new complaint is not a response to why they should not hold you as a vexatious litigant. [01:37:02.860 --> 01:37:07.860] They asked you for a direct response to that question that is stated right there in that document. [01:37:07.860 --> 01:37:13.860] When and where was that notice sent to you? [01:37:13.860 --> 01:37:17.860] Well, on the date there, February 27, 2000. [01:37:17.860 --> 01:37:23.860] No, according to what you just read, that's the date they entered the ruling into the memorandum of the court. [01:37:23.860 --> 01:37:29.860] Not the day that they gave you the opportunity to respond. [01:37:29.860 --> 01:37:33.860] Okay, so it must have been in one of the other cases then. [01:37:33.860 --> 01:37:36.860] It would not have been in one of the other cases. [01:37:36.860 --> 01:37:47.860] It would have been a direct notice relating to any or all of them stating you need to provide us some reason in writing why we should not find you to be a vexatious litigant. [01:37:47.860 --> 01:37:52.860] But it would have been worded like they have it in that document right there. [01:37:52.860 --> 01:38:02.860] So the way the first three sentences are in this document, I have to go back through the other cases and find that particular wording. [01:38:02.860 --> 01:38:09.860] It's not going to be necessarily attached to one of the other cases. [01:38:09.860 --> 01:38:17.860] It could be just a straight notice from the court that doesn't list anything about any of the cases. [01:38:17.860 --> 01:38:21.860] Would that be a notice to a memorandum or an order? [01:38:21.860 --> 01:38:23.860] I don't know how they would have addressed it to you. [01:38:23.860 --> 01:38:26.860] That's the part you're supposed to be keeping up with. [01:38:26.860 --> 01:38:34.860] That's why you're supposed to make a trial notebook so that you can keep up with all the correspondence between you and the court and the other parties. [01:38:34.860 --> 01:38:37.860] I have everything here. It's pretty much an order. [01:38:37.860 --> 01:38:53.860] You should be able to find where the document is that says we're giving you the opportunity to inform us as to why you should not be found a vexatious litigant or have an injunction filed to prevent you from filing future cases. [01:38:53.860 --> 01:38:58.860] Something of that nature is how it's going to be worded. Find it. [01:38:58.860 --> 01:38:59.860] Okay. [01:38:59.860 --> 01:39:05.860] And if they never sent you that, then they've got a problem. [01:39:05.860 --> 01:39:07.860] What do you mean? What's their problem? [01:39:07.860 --> 01:39:13.860] They didn't give you proper notice to respond as to why you shouldn't be found a vexatious litigant. [01:39:13.860 --> 01:39:21.860] They didn't give you any notice they were going to find you as a vexatious litigant. That's a problem. [01:39:21.860 --> 01:39:41.860] Huh. Okay. At the end here, it says it's just a case, claim of May's recentness, the following for docketing, so long as it only rises claim that are not covered by this injunction. [01:39:41.860 --> 01:39:53.860] Yeah. So basically what they're saying is that on all those cases they've marked as settled, you can no longer file any claims using the same set of facts that are in those cases. [01:39:53.860 --> 01:39:57.860] Okay. So on the pacer. [01:39:57.860 --> 01:40:04.860] Or at least you can't make the same claims using those that are found in those cases. [01:40:04.860 --> 01:40:06.860] Right. I can't use this case. [01:40:06.860 --> 01:40:16.860] So when they put this on here on pacer, this must settle the first case that was it to start with. [01:40:16.860 --> 01:40:28.860] I don't know what you mean by that was it to start with. What they did was they retroactively ruled against you in all the other cases as a vexatious litigant finding no merit in the complaint. [01:40:28.860 --> 01:40:34.860] Okay. And therefore they've made it settled by basically throwing it out. [01:40:34.860 --> 01:40:48.860] Oh, okay. But at some point they had to give you notice that they were going to do this to you if you didn't respond with a good legal sound basis for why they shouldn't. [01:40:48.860 --> 01:40:51.860] And if I don't find that then I got a problem. [01:40:51.860 --> 01:41:05.860] Well, assuming that you've organized your paperwork properly and accurately the way you say, yeah. But if they did send it to you and you just ignored it, they win. Well, what about this last thing I asked them for a declaratory judgment on the first. [01:41:17.860 --> 01:41:22.860] How are you going to get a declaratory judgment in a settled case? [01:43:24.860 --> 01:43:31.860] These attorneys, these crooked, corrupt individuals that we're talking about this entire show, [01:43:31.860 --> 01:43:39.860] have rigged the system to make it where they don't have to listen to the people simply by declaring them vexatious litigants. [01:43:39.860 --> 01:43:44.860] It doesn't matter whether the problem the individual is facing is real, whether or not the harassment is real, [01:43:44.860 --> 01:43:53.860] whether or not the claims are valid from a perspective of law that they cannot properly voice in their complaint. [01:47:27.860 --> 01:47:32.860] And give me at least an opportunity to address it on the air before we're off for the night. [01:47:32.860 --> 01:47:38.860] Because I just don't see it. [01:47:38.860 --> 01:47:44.860] You can't go to one member of the same mob who works for another member of the same mob [01:47:44.860 --> 01:47:47.860] to complain about the other member of the same mob [01:47:47.860 --> 01:47:54.860] and expect the member you're complaining to to actually be on your side. [01:47:54.860 --> 01:47:59.860] Not unless he intends to get whacked right along with you, okay? [01:47:59.860 --> 01:48:03.860] There's a problem in America today, folks. [01:48:03.860 --> 01:48:11.860] And it is organized crime, but it is not from entities outside of the government. [01:48:11.860 --> 01:48:22.860] In fact, it is from the government itself and those like the attorneys and the bar associations who propagate it. [01:48:22.860 --> 01:48:34.860] I mean, when you make it legal for yourself to violate the law and not be held accountable, [01:48:34.860 --> 01:48:41.860] while anyone else performing the same act without your specific job title [01:48:41.860 --> 01:48:52.860] would suffer immense threat and harm and forms of punishment for the same act, something is rotten. [01:48:52.860 --> 01:48:56.860] Because that is not the American way of government. [01:48:56.860 --> 01:49:00.860] That is not the American way of anything. [01:49:00.860 --> 01:49:04.860] Our public officials are not superior to us. [01:49:04.860 --> 01:49:07.860] They do not have rights greater than ours. [01:49:07.860 --> 01:49:12.860] They cannot have powers greater than ours at an individual level. [01:49:12.860 --> 01:49:14.860] They can't. [01:49:14.860 --> 01:49:21.860] If it's wrong for me to do something to someone, it is equally wrong for any public official to do that same thing to someone. [01:49:21.860 --> 01:49:25.860] End of discussion. [01:49:25.860 --> 01:49:29.860] And when a public official deems it is his duty to do it anyway, [01:49:29.860 --> 01:49:38.860] that is a public official that needs to be put on trial and prosecuted for his criminal conduct. [01:49:38.860 --> 01:49:40.860] There is no immunity for that. [01:49:40.860 --> 01:49:45.860] There is no protection from responsibility and liability for that. [01:49:45.860 --> 01:49:49.860] Written into any constitution, anywhere. [01:49:49.860 --> 01:49:54.860] And yet we allow them to preach to us as if there is. [01:49:54.860 --> 01:50:08.860] We allow them to cocoon themselves into an area of law that makes them untouchable for their crimes. [01:50:08.860 --> 01:50:16.860] We have a rot at the core of the apple that is America. [01:50:16.860 --> 01:50:22.860] And this is where it comes from. [01:50:22.860 --> 01:50:25.860] It's not just the fact that they're politicians. [01:50:25.860 --> 01:50:28.860] It's not just politicians, therefore. [01:50:28.860 --> 01:50:38.860] It is the attorneys, the bar associations who become the politicians that also seek control of other departments of government. [01:50:38.860 --> 01:50:45.860] It's absolutely unconstitutional in the state of Texas for an attorney to hold a public office outside of the judicial department. [01:50:45.860 --> 01:50:47.860] Absolutely unconstitutional. [01:50:47.860 --> 01:50:48.860] Why? [01:50:48.860 --> 01:50:50.860] Very simple. [01:50:50.860 --> 01:51:01.860] Under the 1939 State Bar Act, the state bar is created as an administrative office of the judicial department of government. [01:51:01.860 --> 01:51:12.860] The Texas Constitution under Article 3 has a strict prohibition against any other entity, or I'm sorry, under our separation of powers doctrine. [01:51:12.860 --> 01:51:14.860] Not Article 3. [01:51:14.860 --> 01:51:24.860] Anyway, it specifically forbids any member of one department from exercising any power and authority belonging to any member of any other department. [01:51:24.860 --> 01:51:35.860] Now by its very definition of being a state administrative office, anyone that has a bar card is an official government officer. [01:51:35.860 --> 01:51:37.860] Okay? [01:51:37.860 --> 01:51:43.860] Every bar card carrying attorney in the state of Texas is a state official. [01:51:43.860 --> 01:51:45.860] Okay? [01:51:45.860 --> 01:51:51.860] But they are using that bar card to line their own pockets in private enterprise. [01:51:51.860 --> 01:52:02.860] They are using the power of government to guarantee a monopoly to themselves, to their own personal enrichment. [01:52:02.860 --> 01:52:06.860] It's a protected racket, don't you get it? [01:52:06.860 --> 01:52:08.860] It's a protected racket. [01:52:08.860 --> 01:52:13.860] Look at chapters 81 and 82 of the Texas Government Code. [01:52:13.860 --> 01:52:18.860] It's written right there. [01:52:18.860 --> 01:52:24.860] The state bar is created as an administrative office of the judicial department of government. [01:52:24.860 --> 01:52:37.860] Thus, anyone with a bar card is a de facto judicial officer, and thus a state officer, who is then using that privileged position within the state [01:52:37.860 --> 01:52:44.860] to enrich themselves at public expense. [01:52:44.860 --> 01:52:52.860] And their racket is protected by the state government, which they control. [01:52:52.860 --> 01:52:57.860] Not only from the bitch, but from the governor's office. [01:52:57.860 --> 01:53:02.860] From the attorney general's office. [01:53:02.860 --> 01:53:08.860] From the legislative offices. [01:53:08.860 --> 01:53:16.860] And the Texas Constitution has a specific provision in the Bill of Rights that says no monopolies are allowed in the state of Texas, [01:53:16.860 --> 01:53:21.860] and it doesn't make any exceptions just because the government owns the monopoly. [01:53:21.860 --> 01:53:26.860] It says no monopoly, period. [01:53:26.860 --> 01:53:35.860] It does not differentiate as to who holds the reins, who constructed it, who controls it in any way, shape, or form. [01:53:35.860 --> 01:53:39.860] And yet we've got a multitude of them in Texas. [01:53:39.860 --> 01:53:40.860] We've got the state bar. [01:53:40.860 --> 01:53:44.860] We've got the TABC when it comes to alcohol and things of that nature. [01:53:44.860 --> 01:53:46.860] We've got the state lottery. [01:53:46.860 --> 01:53:50.860] All of these are state controlled and run monopolies. [01:53:50.860 --> 01:53:55.860] And all of them are unconstitutional on their face for that very reason. [01:53:55.860 --> 01:53:59.860] Don't you get it? [01:53:59.860 --> 01:54:10.860] You are being led to the financial slaughter by the very people that you thought you were putting in power to act as decent shepherds. [01:54:10.860 --> 01:54:11.860] And they're not. [01:54:11.860 --> 01:54:17.860] And they never wanted to be and never have pretended to be from day one. [01:54:17.860 --> 01:54:24.860] They absolutely believe they are better than you and me in every way, shape, and form you can come up with.
