[01:05.800 --> 01:10.640] Since Governor Greg Abbott signed House Bill 1325 legalizing Hemp into Texas law back in [01:10.640 --> 01:15.280] June, county prosecutors around the state including Houston, Austin, and San Antonio have been [01:15.280 --> 01:19.160] dropping marijuana possession charges and even refusing to file new ones since they [01:19.160 --> 01:23.240] are stipulating that they do not have the time or the laboratory equipment to test the [01:23.240 --> 01:27.840] earth for THC. Margaret Moore, the Travis County District Attorney, announced earlier [01:27.840 --> 01:32.560] this month that she was dismissing 32 felony possession and delivery of marijuana cases [01:32.560 --> 01:33.760] because of the law. [01:33.760 --> 01:37.640] Mr. Abbott and other state officials, including the Attorney General stipulated in a letter [01:37.640 --> 01:42.160] to county district attorneys back on Thursday that marijuana has not been decriminalized [01:42.160 --> 01:48.280] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as [01:48.280 --> 01:54.560] well as other cities too like the District Attorney in El Paso, Kyma Esparza, a Democrat [01:54.560 --> 01:59.040] who also stated earlier this month that the law, quote, will not have an effect on the [01:59.040 --> 02:01.880] prosecution of marijuana cases in El Paso. [02:01.880 --> 02:06.840] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender [02:06.840 --> 02:10.840] in Harris County who stated that, quote, the law is constantly changing on what makes [02:10.840 --> 02:13.520] something illegal based on its chemical makeup. [02:13.520 --> 02:17.440] It's important that if someone is charged with something, the test matches what they're [02:17.440 --> 02:22.640] charged with. [02:22.640 --> 02:27.280] A paper by Tulane University identified a five and a half inch American pocket shark [02:27.280 --> 02:32.400] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket [02:32.400 --> 02:38.080] shark ever captured or recorded with the other one being found way back in 1979 in the East [02:38.080 --> 02:39.240] Pacific Ocean. I didn't propose a single name on this, the 26th day of September 2019. [04:48.940 --> 04:59.940] And to start off with a little report on some stuff I'm doing, I have been struggling with an issue for seven years. [04:59.940 --> 05:12.940] I have a whole different way of presenting webpages so that they're more intuitive and understanding. [05:12.940 --> 05:23.940] And yesterday I solved a seven year problem. It's kind of annoying because it was really right there in front of me all the time and I couldn't see it. [05:23.940 --> 05:32.940] But I got the problem solved and now I'm working out the technology and we're putting together the website for the First Amendment auditors. [05:32.940 --> 05:50.940] I am especially excited about these guys because if you've been listening to my show a long time, you know this show is about giving people the tools they need to fight back against the system. [05:50.940 --> 06:11.940] And every once in a while I would come across some guys like Adam in Texas and we got guys all over the country, Scott Richardson, Brett Fountain, this odd guy, Brett Fountain, who's one of them too, that really took on the system and learned how to do this. [06:11.940 --> 06:21.940] And it's clear that we don't need a portion of the population, we just need a few guys around. [06:21.940 --> 06:30.940] And we spent this whole show all these years looking for those guys and trying to get them energized and empowered. [06:30.940 --> 06:43.940] How I missed these First Amendment auditors all this time, I don't know. And it's frustrating that I missed them because these guys were out there poking to bear. [06:43.940 --> 06:59.940] They just don't have the sophisticated tools that they need. And I'm talking to a few of the larger players right now and we're putting together a set of procedures for them. [06:59.940 --> 07:07.940] And watching what they do, what these auditors are doing is very focused. [07:07.940 --> 07:15.940] They go in with cameras and do one thing. Excuse me, one thing. [07:15.940 --> 07:27.940] They videotape buildings. They videotape the outsides and insides and public officials regularly get all excited about it. [07:27.940 --> 07:46.940] And when they get excited, the auditors know that they're within their law and rights. It's just what they're doing is sensitive because of all of this hype and fear about terrorists. [07:46.940 --> 08:01.940] And we've complained about this for a long time that this, for the most part, are false flags in order to force us into a position of where we will tolerate the militarization of our police departments. [08:01.940 --> 08:03.940] Officer safety and all. [08:03.940 --> 08:05.940] Officer safety, yes. [08:05.940 --> 08:16.940] So these guys are fighting back against it. So I'm developing tools for that. [08:16.940 --> 08:26.940] Since it is very focused, there's just a small list of things that these officers consistently do. [08:26.940 --> 08:30.940] The first one is, can I help you? [08:30.940 --> 08:37.940] I have a video of a guy in California that he's videotaping a police department. [08:37.940 --> 08:43.940] These two police officers come out, a male and a female, and they say, can I help you? [08:43.940 --> 08:48.940] And he said, no. And he goes back to video and they follow him. [08:48.940 --> 08:53.940] Can I help you? Can I help you for 30 minutes? [08:53.940 --> 09:04.940] They follow him. And finally, he winds up inside the office of the police department and they come up and say, can I help you? [09:04.940 --> 09:07.940] Same two officers. Yes, you can. [09:07.940 --> 09:11.940] After 30 minutes, he says, yes, you can. [09:11.940 --> 09:20.940] Well, what can we do for you? You can get me two complaint forms, one with your name on it and he points to the other one with your name on it. [09:20.940 --> 09:29.940] And they said, no, we can't do that. And then a sergeant comes out and he said, what's going on here? [09:29.940 --> 09:36.940] He said to the sergeant, I need a complaint form, one with her name on it and one with his name on it. [09:36.940 --> 09:39.940] And the sergeant said, oh, no problem. We can do that. [09:39.940 --> 09:45.940] And he went to the door and opened it and he said, you and you come with me. [09:45.940 --> 09:47.940] Oh, it was beautiful. [09:47.940 --> 09:57.940] So instead of all of that, because they do this, can I help you? Can I help you? Can I help you? Can I help you all the time? [09:57.940 --> 10:05.940] First, can I help you? Can reasonably be the legitimate question to see if they can be of assistance? [10:05.940 --> 10:12.940] When you say no, when they ask you a second time, that is menacing. [10:12.940 --> 10:24.940] Now, it wouldn't be a menacing for an ordinary citizen, but for these guys bristling with more armament than I carried in combat, that's menacing. [10:24.940 --> 10:34.940] The third time is aggravated assault and it gets a 911 call. So you do the 911 call and ask for an officer to arrest the guy. [10:34.940 --> 10:44.940] And then you reach in your folder and you pull out this complaint and it already has the statement of facts. [10:44.940 --> 10:51.940] You were filming in a public place under authority of First Amendment. You were approached by an officer. [10:51.940 --> 10:59.940] The officer asked if you could help you. You said, no, he asked again. You said, no, he asked a third time and you felt threatened. [10:59.940 --> 11:06.940] Get someone out here to take my complaint and he says, you charge him with aggravated assault. [11:06.940 --> 11:18.940] You take that out and you feel it all in except for where their officer's names go and you ask the officer to write his name in there because you want to make sure you get it right. [11:18.940 --> 11:30.940] And you've got a complaint already written out that already has the facts in it before it ever happened. [11:30.940 --> 11:35.940] And it will be clear to the officer that you set him up. [11:35.940 --> 11:44.940] And then when the 911 operator shows up, you ask the 911 operator to arrest the officer and here's the complaint and you sign it right in front of the officer. [11:44.940 --> 11:56.940] And he'll start doing this little chicken dance where he shifts from one foot to the other and is trying to come up with a reason not to arrest his buddy. [11:56.940 --> 12:11.940] Well, since you have given him a verified criminal affidavit and it is verified if it is signed in front of the officer, that is noticed that a crime has been committed. [12:11.940 --> 12:25.940] You as a credible person and a credible person is defined in every state as a person over the age of 18, never convicted of a felony. [12:25.940 --> 12:31.940] When you give notice of crime, you have the same standing as a police officer does. [12:31.940 --> 12:38.940] And when you give notice of crime to a police officer, he is required to give notice to some magistrate. [12:38.940 --> 12:49.940] When the officer decides not to act on the complaint, then he has made his own determination of probable cause. [12:49.940 --> 12:55.940] Problem is, he's not a magistrate, so he is impersonated to public official. [12:55.940 --> 13:05.940] So you pull that complaint already made up out of your case and ask him to put his name on that one and then ask for a supervisor. [13:05.940 --> 13:09.940] And we walk right up the tree. [13:09.940 --> 13:22.940] When the supervisor refuses to act, then we go away and prepare criminal complaints against the supervisor to the head of the department, the chief of police or sheriff. [13:22.940 --> 13:32.940] And when he gives no indication of any intention to act and we have a way to do that, you mail him the complaint. [13:32.940 --> 13:39.940] And what we're suggesting is that you mail it registered and insure it for 500 bucks. [13:39.940 --> 13:42.940] It costs about five hours to do that. [13:42.940 --> 13:45.940] And put a cover letter on it that you want him to send back two years. [13:45.940 --> 13:54.940] Initial and send back in the steps of address develop or put in a postcard so that you will know he actually received the document. [13:54.940 --> 14:03.940] When you don't get it back, then you send the postal inspectors down or actually you go to the post office to collect your 500 bucks. [14:03.940 --> 14:07.940] And then the postal inspectors will go down and investigate what happened to the letter. [14:07.940 --> 14:18.940] And when they tell you that the sheriff got it, now it is confirmed because they're going to tell you that because they don't want to pay the 500 bucks and increase the bond rating. [14:18.940 --> 14:24.940] Then you file against the sheriff with a judge and work and just walk them up the tree. [14:24.940 --> 14:27.940] We have the first one is, can I help you? [14:27.940 --> 14:32.940] The other one is, I need your ID. [14:32.940 --> 14:41.940] And when they threaten to arrest you, if you don't provide your ID, that gets a 911 call saying routine. [14:41.940 --> 14:44.940] You have to stop videotaping. [14:44.940 --> 14:46.940] 911. [14:46.940 --> 14:51.940] You have to erase the videotape 911. [14:51.940 --> 15:03.940] Everything about the audit now becomes a setup to give you reason to call 911 on the. [15:03.940 --> 15:12.940] Whatever person or officer violates law to your discredit. [15:12.940 --> 15:18.940] Have fun, Jeff Brett. [15:18.940 --> 15:21.940] Yeah, I'm sure they will enjoy that. [15:21.940 --> 15:41.940] Yeah, and I'm going to have to go out and do some because I'm telling them about it and it's not clicking or not realizing how powerful this is because they haven't seen these officers doing that little chicken dance. [15:48.940 --> 16:03.940] And then when I asked the officer to arrest the prosecuting attorney and the mayor, the officer started doing the chicken dance and I turned to the mayor and grinned at her and pointed at the officer. [16:03.940 --> 16:10.940] Somehow she did not find that near as funny as I did. [16:10.940 --> 16:17.940] This thing really works. [20:49.940 --> 21:03.940] Anyway, I'm going to try to keep it short tonight and just tell you that I went in yesterday on my motion to vacate the trial date. [21:03.940 --> 21:08.940] I wrote a 26-page motion. It's a masterpiece. [21:08.940 --> 21:23.940] I'm going to have to say that it can be had for a small donation, but I don't think any lawyer would spend the time and write what I did, but it really pinned the judge. [21:23.940 --> 21:33.940] And I got him bound up and she had to grant my motion to vacate trial date. [21:33.940 --> 21:37.940] Wow. [21:37.940 --> 21:43.940] Okay. What was the reason to vacate the trial date? [21:43.940 --> 21:53.940] Well, Randy, like I said, 26 pages long, but ultimately the judge has caused me to be without counsel. [21:53.940 --> 21:58.940] She deprived me of ancillary expenses. [21:58.940 --> 22:17.940] She also deprived me a copy of the court case file, which, depriving me the court case file, sent a signal to a prominent high-power defense attorney that I must be targeted and under malicious prosecution. [22:17.940 --> 22:25.940] So because he has to work down there all the time, he just can't help me. [22:25.940 --> 22:28.940] Wow. [22:28.940 --> 22:29.940] Yeah. [22:29.940 --> 22:31.940] Okay. [22:31.940 --> 22:39.940] So they vacated the trial date. Did she make any reference to counsel? [22:39.940 --> 22:51.940] Yeah. She's perplexed and she doesn't know what to do about it. [22:51.940 --> 23:12.940] The district attorney chimed in and said, well, you know, we had the public defender before and, you know, he tried to elude that I didn't have the money and I said, oh, no, I have sponsors ready to pay. [23:12.940 --> 23:24.940] And then there was some conversation because I did put in there in the pleading that I had contacted 22 defense lawyers and none of them will take my case. [23:24.940 --> 23:43.940] Even if they did, one pointed out to me that, or actually I said two or three pointed out to me that the trial date being next Monday, that they could not have time to prepare for a trial. [23:43.940 --> 23:46.940] Let me make a suggestion. [23:46.940 --> 23:52.940] You have a right to counsel of your choice. [23:52.940 --> 23:56.940] That's what the Constitution says. [23:56.940 --> 24:09.940] So since counsel of your choice, which you had and was frightened away by the judge, and he stepped down, which you can't do without your permission. [24:09.940 --> 24:18.940] And we'll address that another time, ask the court to appoint this lawyer to represent you. [24:18.940 --> 24:23.940] Now the lawyer has plausible deniability. [24:23.940 --> 24:26.940] Exactly. [24:26.940 --> 24:41.940] Well, I don't know if that's that's at the end of the road, but here, you know, come February 11 will mark five years since my arrest and charges. [24:41.940 --> 24:51.940] And both federal and state constitution, say that is unreasonable. [24:51.940 --> 24:57.940] And we may be just time and man damas. [24:57.940 --> 25:01.940] Yes. [25:01.940 --> 25:04.940] Federal man damas. [25:04.940 --> 25:08.940] That's right. [25:08.940 --> 25:12.940] Are you preparing that now? [25:12.940 --> 25:16.940] Okay, for those listening who doesn't know what we're talking about. [25:16.940 --> 25:25.940] If the case is drug on for too long and it's in violation of state and federal statute limitations. [25:25.940 --> 25:34.940] Then and the court is recalcitrant, the state courts recalcitrant to follow to do what the law commands them to do. [25:34.940 --> 25:50.940] File a petition for a writ of man damas and ask a higher court to mandate that a lower court do what the law requires them to do. [25:50.940 --> 25:53.940] Okay, go ahead, Ted. [25:53.940 --> 25:56.940] So no, I haven't started that yet. [25:56.940 --> 25:59.940] That I don't think would be a very long pleading. [25:59.940 --> 26:06.940] But I'm working on, well, I've got five more pleadings to file. [26:06.940 --> 26:13.940] One is disqualification of the district attorney. [26:13.940 --> 26:17.940] And there's about eight items. [26:17.940 --> 26:27.940] Why starting with from in the beginning of this case, they kept calling this guy that thinks he bought my house. [26:27.940 --> 26:33.940] The closure cell, they called him their client. [26:33.940 --> 26:48.940] And they didn't, it wasn't a one time this speak it because it was said a couple of times followed by, you know, I want, you know, Ted Scarlett thrown back in jail because he's doing our client. [26:48.940 --> 26:59.940] He's a terrorist. And this and that, and the judge told him to calm down that I'm Ted Scarlett's not a danger to the community and that it's Ted Scarlett's personal amendment right. [26:59.940 --> 27:02.940] The only problem is I wasn't suing their client. [27:02.940 --> 27:04.940] Their client was suing me. [27:04.940 --> 27:21.940] And but you take you take the culmination of about what I just told you and then followed they followed that up with the extortion offer that said that they wouldn't put me in jail if I would drop civil litigation. [27:21.940 --> 27:23.940] Never sue for my home. [27:23.940 --> 27:27.940] Civil litigation against their client. [27:27.940 --> 27:29.940] Exactly. [27:29.940 --> 27:35.940] Sounds like very good grounds for disqualification. [27:35.940 --> 27:37.940] Right. Not not recusal. [27:37.940 --> 27:39.940] This goes to disqualification. [27:39.940 --> 27:41.940] Exactly. [27:41.940 --> 27:53.940] Now, this pleading is only eight, nine pages long, and it has an affidavit sworn off in front of a notary by giraffe. [27:53.940 --> 27:57.940] And then what you were just talking about, Randy. [27:57.940 --> 28:03.940] I got eight criminal complaints behind that as exhibit. [28:03.940 --> 28:20.940] And I explained how each of these registered mail documents that were mailed to the foreman of the criminal grand jury ended up being theft of mail by the district attorney and the deputy DA's. [28:20.940 --> 28:37.940] And they even were so stupid as to send them back to me saying that they had opened this mail and that I didn't have a right to address the grand jury and that they were returning it all to me in California. [28:37.940 --> 28:48.940] The law says the grand jury shall investigate into all crimes subject to indictment that come to their knowledge by whatever means. [28:48.940 --> 28:52.940] Not exclude anything. [28:52.940 --> 29:06.940] So that document, the pleading and the supporting exhibits, which also include one Coral Warrantow against Thomas C. Hastings. [29:06.940 --> 29:08.940] Who is Hastings? [29:08.940 --> 29:19.940] He's the judge that Yalvin screamed at me and demanded my plea, which I didn't give him, and then he entered a plea on my behalf, so he practiced law from the bench. [29:19.940 --> 29:22.940] And then he went on and waved time. [29:22.940 --> 29:26.940] And in the transcript right after, he asked me if I waved time. [29:26.940 --> 29:27.940] I didn't answer. [29:27.940 --> 29:29.940] He continued to scream and yell. [29:29.940 --> 29:32.940] And I finally said, I see the public defender nodding his head. [29:32.940 --> 29:39.940] And he said, time wave. [34:07.940 --> 34:13.940] And I said, objection, objection. [34:13.940 --> 34:15.940] And as I'm saying the third objection, [34:15.940 --> 34:22.940] this is all in the transcript, he yells over me, you can't object. [34:22.940 --> 34:25.940] It's all in the transcript. [34:25.940 --> 34:27.940] You can't object. [34:27.940 --> 34:29.940] You talk through your attorney. [34:29.940 --> 34:31.940] You have an attorney, you talk through your attorney. [34:31.940 --> 34:37.940] Anyway, the culmination of these eight criminal complaints, [34:37.940 --> 34:42.940] again, what happened was the DA decided to secret all of those [34:42.940 --> 34:44.940] from the grand jury. [34:44.940 --> 34:48.940] They committed mail tampering, they've committed wire fraud [34:48.940 --> 34:53.940] by emailing me their extortion offer. [34:53.940 --> 34:59.940] And so this is all going into a document for disqualification [34:59.940 --> 35:01.940] of the district attorney. [35:01.940 --> 35:06.940] We're going to lead with that because, as I told you this motion [35:06.940 --> 35:09.940] that was just granted yesterday to vacate the trial date, [35:09.940 --> 35:14.940] and I do vacate the trial date, I don't do continue the trial date [35:14.940 --> 35:18.940] because when you vacate the trial date, [35:18.940 --> 35:19.940] they don't set another date. [35:19.940 --> 35:22.940] If you put a motion in for continuance, [35:22.940 --> 35:24.940] they usually set another trial date. [35:24.940 --> 35:30.940] And one other thing, a continuance will stop the clock [35:30.940 --> 35:37.940] on the limitations if it's your continuance, not theirs. [35:37.940 --> 35:40.940] I'm not sure how a motion to vacate would. [35:40.940 --> 35:44.940] I don't think that would because you're saying that this hearing [35:44.940 --> 35:48.940] is improper, you're not asking for a continuance. [35:48.940 --> 35:51.940] This should not stop the clock. [35:51.940 --> 35:54.940] Right, and that's what the whole pleading is about, [35:54.940 --> 35:58.940] is all the improper things, and I put Brady in there, [35:58.940 --> 36:03.940] and I show that I filed four Brady motions for discovery, [36:03.940 --> 36:09.940] and that none of them have ever, they've never turned over this stuff. [36:09.940 --> 36:13.940] Now, again, I got a little Randy Kelton that sits on my shoulder, [36:13.940 --> 36:16.940] and he's always telling me politics. [36:16.940 --> 36:20.940] And so I'm leading with disqualifying the district attorney first [36:20.940 --> 36:25.940] because that motion to vacate trial date that was granted yesterday [36:25.940 --> 36:29.940] was really, really blasting this judge. [36:29.940 --> 36:31.940] She is the presiding judge of the criminal court. [36:31.940 --> 36:36.940] She has screwed up royally, and I wrote all about it in there, [36:36.940 --> 36:41.940] and I can tell she's irritated, and she's on the hot seat [36:41.940 --> 36:46.940] because the only thing that this DA said yesterday [36:46.940 --> 36:50.940] really was that she said this to come back on October 9, [36:50.940 --> 36:53.940] and he said, can we do it the following week? [36:53.940 --> 36:54.940] She snapped up. [36:54.940 --> 36:55.940] No, we can't. [36:55.940 --> 37:00.940] And she said something about somebody being there every week [37:00.940 --> 37:01.940] or something like that. [37:01.940 --> 37:06.940] But anyway, now, again, I'm no lawyer, okay, [37:06.940 --> 37:12.940] and procedurally, and as Deborah has talked about, [37:12.940 --> 37:14.940] all the things that go on in the court, [37:14.940 --> 37:19.940] and this is just another instance where that was my opportunity to say, [37:19.940 --> 37:25.940] Your Honor, I don't normally agree with Amir, Deputy DA, [37:25.940 --> 37:28.940] but I do today because I have a medical procedure in the morning, [37:28.940 --> 37:31.940] so I too would like it the following week. [37:31.940 --> 37:37.940] And my dumb, dumb head didn't say it, and what I needed, [37:37.940 --> 37:39.940] I could have taken that extra time to rest, [37:39.940 --> 37:44.940] also go see my mom and give me some more time to write some more papers. [37:44.940 --> 37:51.940] But it's just an example of you have to be really, really ready, sharp, [37:51.940 --> 37:55.940] and ready to talk, and if you have to do something to distract, [37:55.940 --> 38:00.940] if you need a moment, even just a couple seconds can make a big difference. [38:00.940 --> 38:03.940] And so anyway, just a little side thing there. [38:03.940 --> 38:08.940] But the judge snapping at him shows me, everything is on the judge. [38:08.940 --> 38:13.940] She screwed up right now because I'm saying she deprived me of a lawyer. [38:13.940 --> 38:15.940] I'm sitting here without counsel. [38:15.940 --> 38:21.940] She moved and set this trial date when I told the court I don't have counsel, [38:21.940 --> 38:22.940] and I wrote that in there too. [38:22.940 --> 38:27.940] I go, this trial date was set when I told the court I did not have counsel [38:27.940 --> 38:32.940] and they proceeded and set a date when I said I don't have counsel and I want counsel. [38:32.940 --> 38:36.940] And so she's on the hot seat, Randy. [38:36.940 --> 38:43.940] Oh, this is, it sounds like exactly what we talk about that we want. [38:43.940 --> 38:48.940] The judge stepped up behind that thin blue line [38:48.940 --> 38:54.940] and tried to protect the prosecutor from his stupid behavior. [38:54.940 --> 39:00.940] And now it's coming back on the judge and she is not a happy camper. [39:00.940 --> 39:03.940] She is not happy at all, Randy. [39:03.940 --> 39:10.940] I am betting there is some discourse going on between her and the prosecutor. [39:10.940 --> 39:13.940] I mean, it's not happy discourse. [39:13.940 --> 39:16.940] Now, here's the politics. [39:16.940 --> 39:20.940] The next motion I'm submitting is disqualification of the district attorney. [39:20.940 --> 39:25.940] This will give the judge her out. [39:25.940 --> 39:27.940] Exactly. [39:27.940 --> 39:31.940] She can throw everything back on him. [39:31.940 --> 39:33.940] Kick him off the case. [39:33.940 --> 39:37.940] She don't have to protect anybody anymore. [39:37.940 --> 39:38.940] Right. [39:38.940 --> 39:43.940] Now, we did a habeas corpus on the Fourth Amendment arrest warrant, [39:43.940 --> 39:48.940] and I raised hell and, you know, I've been trying to get the arrest warrant, [39:48.940 --> 39:50.940] couldn't find it anywhere. [39:50.940 --> 39:54.940] So I had a motion hearing that jacked it around and stuff. [39:54.940 --> 39:57.940] And I don't want, again, I want to try to keep this short tonight, [39:57.940 --> 40:03.940] but bottom line is a week ago I went for that hearing [40:03.940 --> 40:08.940] and I spent an hour and 20 minutes talking. [40:08.940 --> 40:12.940] I told the judge, you're disqualified, you're biased. [40:12.940 --> 40:17.940] I've done a FOIA request and found that you've received over $300,000 from the county. [40:17.940 --> 40:19.940] I don't want you hearing my case. [40:19.940 --> 40:22.940] And furthermore, last week when it was sent to you, [40:22.940 --> 40:26.940] the district attorney specifically requested you by name, [40:26.940 --> 40:30.940] and that's why you are not hearing this. [40:30.940 --> 40:32.940] And I went on for an hour and 20 minutes, [40:32.940 --> 40:35.940] and a couple of times he tried to rule and stuff, [40:35.940 --> 40:38.940] but you use diversion if you have to. [40:38.940 --> 40:41.940] And they're slick about moving things on. [40:41.940 --> 40:46.940] And so I've learned, and each judge personality is different, [40:46.940 --> 40:49.940] their style is different, so you have to get to know them. [40:49.940 --> 40:55.940] And you have, they routinely do the same thing over and over again. [40:55.940 --> 40:59.940] So if you've watched them, you know how they're going to go ahead [40:59.940 --> 41:03.940] and move the case forward and rule, because that's what it's all about, [41:03.940 --> 41:06.940] is ruling as fast as possible and getting the hell out of there. [41:06.940 --> 41:08.940] Well, I talked for an hour and 20 minutes. [41:08.940 --> 41:11.940] And the bottom line is he did go ahead and rule, [41:11.940 --> 41:15.940] but during that hearing, he tore three quarters of the way through, [41:15.940 --> 41:19.940] he said that he'd also been assigned my writ of habeas corpus, [41:19.940 --> 41:22.940] and that he had an order for me on that, [41:22.940 --> 41:24.940] that he was going to give me at the end. [41:24.940 --> 41:26.940] Well, what the hell? [41:26.940 --> 41:31.940] He hijacked the precipice that I gave to the clerk of the court. [41:31.940 --> 41:33.940] Okay, the clerk of the court's supposed to call the hearing. [41:33.940 --> 41:37.940] Anyway, what it prompted was the district attorney to turn over to me [41:37.940 --> 41:42.940] in an envelope what they're calling the Fourth Amendment arrest warrant. [41:42.940 --> 41:44.940] Now, that's another thing. [41:44.940 --> 41:50.940] I almost didn't do this, which is open the dam envelope right then and there [41:50.940 --> 41:51.940] and inspect it. [41:51.940 --> 41:54.940] I went and talked for another 10 minutes before I did. [41:54.940 --> 41:59.940] When I opened it, I instantly saw that it was not a Fourth Amendment arrest warrant. [41:59.940 --> 42:02.940] It has no court seal on it. [42:02.940 --> 42:08.940] And there's no attachment of a declaration. [42:08.940 --> 42:14.940] And so I said, judge, what the DA had to me that they're saying is a Fourth Amendment warrant, [42:14.940 --> 42:18.940] and by the way, I'm saying all this to get this on the record. [42:18.940 --> 42:20.940] This is not a Fourth Amendment warrant. [42:20.940 --> 42:21.940] I held it up. [42:21.940 --> 42:23.940] This is not a Fourth Amendment warrant. [42:23.940 --> 42:29.940] So I've done a lawful direction abatement of the warrant, [42:29.940 --> 42:34.940] and I'm going to put that in as a motion. [42:34.940 --> 42:37.940] The warrant's not valid. [42:37.940 --> 42:45.940] And then the next motion is to disqualify every judge that's heard my case [42:45.940 --> 42:48.940] because they've all, I've done FOIA requests. [42:48.940 --> 42:51.940] They've all been paid payments. [42:51.940 --> 42:52.940] Wait, wait. [42:52.940 --> 42:54.940] The warrant's not valid. [42:54.940 --> 42:58.940] That is a really, really major big deal. [42:58.940 --> 43:02.940] The prosecutor has put it into the record. [43:02.940 --> 43:06.940] He cannot retrieve it back from the record. [43:06.940 --> 43:07.940] It can't be changed. [43:07.940 --> 43:09.940] It can't be adjusted. [43:09.940 --> 43:13.940] It is what it is, and he's stuck with it. [43:13.940 --> 43:15.940] Well, that's why I got real excited. [43:15.940 --> 43:25.940] I kept telling my team guy, my right-hand man, how incredibly important it was [43:25.940 --> 43:28.940] because now they're stuck in a position. [43:28.940 --> 43:29.940] They've presented this. [43:29.940 --> 43:32.940] The only thing was, remember, he added it to be an envelope. [43:32.940 --> 43:35.940] It actually didn't go in the record of that hearing. [43:35.940 --> 43:37.940] Doesn't matter. [43:37.940 --> 43:41.940] You put it on the record that it wasn't valid. [43:41.940 --> 43:43.940] It went off the cliff. [43:43.940 --> 43:44.940] Yeah. [43:44.940 --> 43:48.940] Perjury because it was discovered, because it was called out for falsity [43:48.940 --> 43:51.940] before that was discovered. [43:51.940 --> 43:52.940] Okay. [47:37.940 --> 47:40.940] Now she becomes a political liability. [47:40.940 --> 47:43.940] So politics. [47:43.940 --> 47:45.940] Go ahead, Ted. [47:45.940 --> 47:52.940] So, back to that pleading that was granted, they came at trial date. [47:52.940 --> 47:57.940] I put in there that she granted and declared me indigent. [47:57.940 --> 48:02.940] However, she denied every ancillary expense I asked for. [48:02.940 --> 48:04.940] And that they're all still required. [48:04.940 --> 48:08.940] And I stated specifically that I needed an investigator. [48:08.940 --> 48:10.940] I needed a document expert. [48:10.940 --> 48:14.940] I needed an expert witness on quit claim deeds. [48:14.940 --> 48:26.940] And I need all the other associated expenses that a winning defense lawyer typically incurs. [48:26.940 --> 48:28.940] So that was all in there. [48:28.940 --> 48:32.940] And the big one is the fact that she declared me indigent, [48:32.940 --> 48:40.940] but she's denied everything I've asked for as even a simple request of a copy of the court case file. [48:40.940 --> 48:45.940] So, back to this warrant issue, we titled it in the caption, [48:45.940 --> 48:52.940] New Found Evidence Discovered on 919 at Hearing. [48:52.940 --> 48:57.940] Okay, so we're telling the court they just turned this over just now. [48:57.940 --> 49:01.940] And then I write in there, it's not a valid Fourth Amendment arrest warrant. [49:01.940 --> 49:09.940] And this must be why the district attorney has been refusing to turn it over for the past two years. [49:09.940 --> 49:11.940] Wait a minute. [49:11.940 --> 49:13.940] Wait a minute. [49:13.940 --> 49:23.940] Back to what pressure was on the prosecutor that forced him to release evidence that could crucify him. [49:23.940 --> 49:26.940] What's going on here? [49:26.940 --> 49:29.940] Well, the habeas that I did. [49:29.940 --> 49:36.940] Did the court grant the habeas? [49:36.940 --> 49:38.940] No. [49:38.940 --> 49:40.940] That's what I'm saying. [49:40.940 --> 49:42.940] Something's going on here. [49:42.940 --> 49:50.940] I'm going to bet you that judge has got her foot on that lawyer's throat. [49:50.940 --> 49:56.940] That's why he gave it up, because the judge made him give it up, [49:56.940 --> 50:00.940] because now you're coming after her, [50:00.940 --> 50:06.940] and she needed him to get her off the dime. [50:06.940 --> 50:11.940] So she made him throw himself under the bus? [50:11.940 --> 50:18.940] Yeah, I think that it's a combination of things that caused him to turn it over, [50:18.940 --> 50:28.940] because I figure he knew even if we went next week to the master trial calendar, [50:28.940 --> 50:32.940] you know, where you go up here and then they send you out to a judge for the trial, [50:32.940 --> 50:40.940] and I think he knew I was going to say to the master calendar judge, [50:40.940 --> 50:44.940] and if they actually sent us to a trial room, I think he knew. [50:44.940 --> 50:47.940] The first thing I was going to say, I don't even have a copy of the warrant. [50:47.940 --> 50:50.940] They won't even give me over the basic discovery. [50:50.940 --> 50:52.940] We can't have a trial. [50:52.940 --> 50:56.940] I think he knew that, and then you have a Rida habeas corpus sit there, [50:56.940 --> 50:59.940] but he didn't know what was going to go down with that. [50:59.940 --> 51:02.940] Wait a minute, wait a minute. [51:02.940 --> 51:11.940] He could have given you a stack of documents two feet high with nothing but trash in it. [51:11.940 --> 51:12.940] True. [51:12.940 --> 51:15.940] But he didn't. [51:15.940 --> 51:18.940] He only gave you that warrant. [51:18.940 --> 51:19.940] Why? [51:19.940 --> 51:22.940] Yeah. [51:22.940 --> 51:26.940] Somebody, somebody told him to. [51:26.940 --> 51:29.940] There were all kinds of things he could have done. [51:29.940 --> 51:35.940] He could have flooded you with a bunch of worthless documentation, but he didn't. [51:35.940 --> 51:37.940] Yes. [51:37.940 --> 51:44.940] And I know that the Rida habeas corpus was not correct. [51:44.940 --> 51:51.940] However, this, it caused a lot of pressure. [51:51.940 --> 52:01.940] Also in the habeas, I wrote that I put his letter where he told me to basically pound salt to go look in the court case file or go see the sheriff. [52:01.940 --> 52:09.940] And in my pleading, I put, I did go do those things and they don't have it. [52:09.940 --> 52:14.940] The court clerk doesn't have it and the sheriff doesn't have it. [52:14.940 --> 52:18.940] The court clerk, are you talking about the warrant? [52:18.940 --> 52:20.940] Is that correct? [52:20.940 --> 52:24.940] The court clerk is required to have it. [52:24.940 --> 52:26.940] Well, they didn't have it. [52:26.940 --> 52:31.940] They may have it now, but they haven't had it for four and a half years. [52:31.940 --> 52:33.940] And this is probably why. [52:33.940 --> 52:35.940] So he's been hiding this for four and a half years. [01:01:23.940 --> 01:01:32.940] Margaret Moore, the Travis County District Attorney, announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana cases because of the law. [01:01:32.940 --> 01:01:44.940] Mr. Abbott and other state officials including the Attorney General stipulated in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate a misunderstanding [01:01:44.940 --> 01:02:00.940] of how HB 1325 works as well as other cities too like the District Attorney in El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law, quote, will not have an effect on the prosecution of marijuana cases in El Paso. [01:02:00.940 --> 01:02:12.940] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County who stated that, quote, the law is constantly changing on what makes something illegal based on its chemical makeup. [01:04:08.940 --> 01:04:20.940] So she asked me, well, you know, she had some legitimate things. She was trying to assist me on the time, you know, what date did I want? [01:04:20.940 --> 01:04:30.940] And did I want to do, you know, do this before the hearing today? But then she came to, what judge do you want to have hear this? [01:04:30.940 --> 01:04:40.940] And I said, oh, you read some of my pleading. Yeah, that's a tough question because none of them are qualified to hear it, are they? [01:04:40.940 --> 01:04:54.940] And I go, I'm going to think about that one for a while, but I just want to assure you that Ukrainian president did not give me the information of these brides that judges are receiving. [01:04:54.940 --> 01:05:04.940] And she said I went. Have you considered petitioning for change of venue? [01:05:04.940 --> 01:05:11.940] Well, that I think since all the judges are disqualified. [01:05:11.940 --> 01:05:25.940] Well, what they, what they'll do is they'll bring a judge from another county over if they want to continue to do this dog and pony show anymore. [01:09:26.940 --> 01:09:32.940] So, I highly recommend everybody do this. [01:09:32.940 --> 01:09:36.940] It's paramount to saving your butt. [01:11:01.940 --> 01:11:15.940] Finally, my friend says, he wrote down something, said state bar grievance and it was on some little pamphlet and he gave it to the lawyer. [01:11:15.940 --> 01:11:21.940] The lawyer got all excited and he didn't even threaten that he was going to do this or something. [01:11:21.940 --> 01:11:23.940] He just handed him the pamphlet. [01:11:23.940 --> 01:11:27.940] It happened to be a pamphlet about something that he and the lawyer had already been talking about. [01:11:27.940 --> 01:11:29.940] So it was just handing him that. [01:11:29.940 --> 01:11:34.940] But that was written in the margin and the lawyer started getting real hot under the collar. [01:11:34.940 --> 01:11:49.940] And the next thing you know, the lawyer's going to the judge in open court on the record, complaining that this guy has bar grinsed me and the judge is saying, [01:11:49.940 --> 01:11:51.940] well, are you sure? [01:11:51.940 --> 01:11:53.940] Have you seen something from that? [01:11:53.940 --> 01:11:55.940] Have you looked into this? [01:11:55.940 --> 01:11:57.940] You know he has. [01:11:57.940 --> 01:12:03.940] Well, no, what he's saying and my friend is like, what's going on? [01:12:03.940 --> 01:12:05.940] What is all this about? [01:12:05.940 --> 01:12:13.940] He didn't even click with my friend that number one, the lawyer shouldn't be talking about that even if it did happen. [01:12:13.940 --> 01:12:16.940] He should definitely get a bar grievance for that. [01:12:16.940 --> 01:12:19.940] He's specifically forbidden. [01:12:19.940 --> 01:12:21.940] He's forbidden to talk about it. [01:12:21.940 --> 01:12:22.940] He also spoke. [01:12:22.940 --> 01:12:24.940] He didn't speak with tender before the court. [01:12:48.940 --> 01:12:53.940] And he said, well, I haven't seen any paperwork come from it yet, but I'm just waiting for the other shoe to drop. [01:12:53.940 --> 01:12:55.940] And he said, I can't work like this. [01:12:55.940 --> 01:12:58.940] A little dagger to my throat and a sword hanging over my neck. [01:14:49.940 --> 01:14:53.940] I came back after eating and my car was gone. [01:14:53.940 --> 01:15:05.940] So me, they called 911, thought it was stolen, didn't know what was going on, and they refused to send out a police file report. [01:15:05.940 --> 01:15:06.940] They refused to send out anybody. [01:15:06.940 --> 01:15:09.940] So it turned out just to be this long, long education over the past year and a half. [01:15:09.940 --> 01:15:13.940] It had been towed, but it had been towed privately. [01:15:13.940 --> 01:15:14.940] I looked around. [01:15:14.940 --> 01:15:16.940] There were no signs when I pulled in. [01:15:16.940 --> 01:15:20.940] I finally found them obviously after the car, but they were hiding behind other cars. [01:15:25.940 --> 01:15:26.940] Nobody would help. [01:15:26.940 --> 01:15:36.940] And then anyway, I got a ride over, got a lift ride to the yard where my car was called 911 again. [01:15:50.940 --> 01:15:53.940] It's just the whole situation smelled extremely bad. [01:20:06.940 --> 01:20:13.940] So I hit basically a dead end kind of with the ICC because they were always referred to as the [01:20:13.940 --> 01:20:19.940] the main authority that, you know, enforced and governed all the towing. [01:20:19.940 --> 01:20:24.940] However, I just couldn't believe all the laws I was reading or the statutes and that, [01:20:24.940 --> 01:20:30.940] and they're, that basically were so vague that any tow company could get away with hiding signs behind cars. [01:20:30.940 --> 01:20:31.940] They could do a lot of stuff. [01:20:31.940 --> 01:20:33.940] And that's essentially what they've been doing for decades. [01:20:33.940 --> 01:20:37.940] And the story's got bigger and bigger as I talk more and more with people that, you know, [01:20:37.940 --> 01:20:38.940] this is a real deal. [01:20:38.940 --> 01:20:42.940] People are stealing cars and extorting money and showing up at accidents. [01:20:42.940 --> 01:20:44.940] It's just, it's a crazy scene. [01:20:44.940 --> 01:20:47.940] But I finally kept talking and calling and calling. [01:20:47.940 --> 01:20:50.940] I called probably a dozen times, eight to ten times. [01:20:50.940 --> 01:20:56.940] And this one woman said, you know, a lawyer actually told me about this and she said, [01:20:56.940 --> 01:20:58.940] I'm going to send it to you. [01:20:58.940 --> 01:21:01.940] She said, I don't know why we don't get this information from the state or the city, [01:21:01.940 --> 01:21:04.940] but a lawyer told me about this and she said, I've got it. [01:21:04.940 --> 01:21:05.940] I'm going to email it to you. [01:21:05.940 --> 01:21:11.940] And I get this email and it's a reference to this thing called the towing bill of rights. [01:21:11.940 --> 01:21:18.940] And it was the answer and the, I mean, it is the thing that cleans up everything. [01:21:18.940 --> 01:21:19.940] It's amazing. [01:21:19.940 --> 01:21:24.940] This one alderman and throwing his colleague got so sick and tired of all the stories coming in [01:21:24.940 --> 01:21:29.940] for this company called Lincoln Towing that they drafted a new law into the ordinance. [01:21:29.940 --> 01:21:34.940] It was the municipal code that changed the regulation. [01:21:34.940 --> 01:21:37.940] And this was back in 2016. [01:21:37.940 --> 01:21:42.940] And it basically made it now very clear on both sides and it protected both sides, you know, [01:21:42.940 --> 01:21:47.940] for people trying to fraud, you know, the tow company's damage and also from tow companies [01:21:47.940 --> 01:21:50.940] specifically from frauding the customers, consumers. [01:21:50.940 --> 01:21:52.940] And I had them. [01:21:52.940 --> 01:21:55.940] I knew I had them, but I didn't know how to start enforcing it. [01:21:55.940 --> 01:21:59.940] I went to the police because they were listed on there. [01:21:59.940 --> 01:22:03.940] The police didn't think they kept saying it was civil. [01:22:03.940 --> 01:22:04.940] They didn't think anything was wrong. [01:22:04.940 --> 01:22:05.940] They wouldn't do anything. [01:22:05.940 --> 01:22:09.940] Even though they were actually listed on this, that the people to enforce it along with another department, [01:22:09.940 --> 01:22:14.940] a business of affairs and consumer protection. [01:22:14.940 --> 01:22:18.940] But after months and months, it was about a year into it. [01:22:18.940 --> 01:22:22.940] I finally got an investigation started with that department. [01:22:22.940 --> 01:22:26.940] That was crazy on itself because I walked in, asked the front desk, [01:22:26.940 --> 01:22:27.940] I need to speak to somebody about this. [01:22:27.940 --> 01:22:29.940] She says, we don't enforce any of that. [01:22:29.940 --> 01:22:30.940] I said, is it right here you do? [01:22:30.940 --> 01:22:31.940] No, we don't. [01:22:31.940 --> 01:22:32.940] I mean, like literally it's tug of war. [01:22:32.940 --> 01:22:36.940] And finally the deputy commissioner herself. [01:22:36.940 --> 01:22:42.940] And she's holding this five pages of statutes in her hand. [01:22:42.940 --> 01:22:44.940] And I was like, wow. [01:22:44.940 --> 01:22:45.940] Finally got to you. [01:22:45.940 --> 01:22:47.940] Finally got to the right person. [01:22:47.940 --> 01:22:48.940] She says, yes. [01:22:48.940 --> 01:22:49.940] She says, we have a problem. [01:22:49.940 --> 01:22:51.940] We have a big problem. [01:22:51.940 --> 01:22:54.940] But yes, we enforce this. [01:22:54.940 --> 01:22:59.940] So we sat down, filed a complaint four or five months later. [01:22:59.940 --> 01:23:11.940] They started the investigation and wrote seven violations of those municipal statutes against this company. [01:23:11.940 --> 01:23:16.940] And finally took them to court. [01:23:16.940 --> 01:23:20.940] That was another three months because they kept filing for extensions. [01:23:20.940 --> 01:23:24.940] And they even showed up because they knew they weren't going to get it. [01:23:24.940 --> 01:23:29.940] And they found they convicted them with consumer fraud. [01:23:29.940 --> 01:23:31.940] Wow. [01:23:31.940 --> 01:23:33.940] In Chicago? [01:23:33.940 --> 01:23:39.940] That's the most corrupt place I grew up in Chicago. [01:23:39.940 --> 01:23:43.940] Arm pit of the nation. [01:23:43.940 --> 01:23:49.940] Towing was always a big problem there with corruption. [01:23:49.940 --> 01:23:55.940] The police were always taking bribes from the towing guys. [01:23:55.940 --> 01:23:58.940] So the police were on their side. [01:23:58.940 --> 01:24:02.940] So if you beat them, that is incredible. [01:24:02.940 --> 01:24:06.940] Well, this beautiful man named Alderman Poir. [01:24:06.940 --> 01:24:11.940] And I say that because he just, he refused to take this junk anymore. [01:24:11.940 --> 01:24:15.940] And he actually drafted this incredible piece of paper. [01:24:15.940 --> 01:24:20.940] And now they're actually required to have the towing Bill of Rights at their yard hoaxed it on the fence. [01:24:20.940 --> 01:24:23.940] So if you do get your car, so you can see it. [01:24:23.940 --> 01:24:31.940] And oh, and I have a copy of the pictures and I'd also like a copy of the recording of what you did to my car as you picked it up and dropped it off. [01:24:31.940 --> 01:24:32.940] That's what they're required to have now. [01:24:32.940 --> 01:24:39.940] And that's nothing out of reasonable, you know, but so it was amazing that he did this. [01:24:39.940 --> 01:24:45.940] And but the problem is, is nobody knows and nobody wants to know still. [01:24:45.940 --> 01:24:52.940] And the police, the police strut flat out told me, you know what, we got, we got our police being committed to murder and we got murders going on here all the time. [01:24:52.940 --> 01:24:55.940] This is just not the biggest deal for me to take care of. [01:24:55.940 --> 01:24:59.940] I'll do it, but it's going to go in the back of my list essentially. [01:24:59.940 --> 01:25:03.940] And basically that meant he wasn't going to do anything. [01:25:03.940 --> 01:25:05.940] But it's changed now. [01:25:05.940 --> 01:25:12.940] Now it has to just be educated and I'm going to work with this attorney there at the BSTP to start educating the police. [01:25:12.940 --> 01:25:14.940] I'll probably do it in at least two of the war. [01:25:14.940 --> 01:25:20.940] It's because those are the ones that have been working with them and they got the right people who want to help. [01:25:20.940 --> 01:25:24.940] But again, like you said, it is a super corrupt place. [01:25:24.940 --> 01:25:29.940] Would your alderman be willing to come on the show? [01:25:29.940 --> 01:25:38.940] If this is an issue he would like to talk about, we can build him a good archive of the interview. [01:25:38.940 --> 01:25:45.940] So he would have the archive that he can send to people that he wants to know about this. [01:25:45.940 --> 01:25:47.940] The problem is he's no longer an alderman. [01:25:47.940 --> 01:25:53.940] He stepped down after two terms, but he may, he may, I don't know. [01:25:53.940 --> 01:25:58.940] Is he looking to move up to higher office? [01:26:01.940 --> 01:26:08.940] And if he was the author of this bill, we can get him a good archive. [01:26:08.940 --> 01:26:09.940] Okay. [01:26:28.940 --> 01:26:30.940] He's making my mother-in-law. [01:26:30.940 --> 01:26:37.940] Every time she talks to me, I thought somebody had a whole different nose. [01:26:42.940 --> 01:26:43.940] I'm not fond of that place. [01:26:43.940 --> 01:26:46.940] It's for some reason I'm helping the city out. [01:26:46.940 --> 01:26:53.940] No, Alderman 4R was the first Asian, I think, to ever be voted into office. [01:26:53.940 --> 01:26:54.940] He's Indian, I think. [01:26:54.940 --> 01:26:57.940] I don't know, but he's born there or something born in the area. [01:26:57.940 --> 01:27:00.940] But, you know, a different sort of do it for sure. [01:27:00.940 --> 01:27:01.940] Wonderful. [01:27:01.940 --> 01:27:02.940] He's a guy. [01:27:02.940 --> 01:27:03.940] Yeah. [01:27:03.940 --> 01:27:04.940] Fine. [01:27:04.940 --> 01:27:06.940] And you ought to be proud of yourself. [01:27:06.940 --> 01:27:09.940] Did you get a settlement with these guys? [01:27:09.940 --> 01:27:11.940] Well, here's the problem. [01:27:11.940 --> 01:27:17.940] When the city sues somebody, all they can do is get back what I pay to get my car out. [01:27:17.940 --> 01:27:21.940] If I want money back, I need to actually sue them civilly. [01:27:21.940 --> 01:27:24.940] And they didn't slap them very hard, Randy. [01:27:24.940 --> 01:27:29.940] Even in the statute that they used, which I was really glad they used, because it was [01:27:29.940 --> 01:27:36.940] outside the scope of the towing ordinances, but they convicted them of consumer fraud. [01:27:36.940 --> 01:27:40.940] The minimum for that was $2,000, but they only charged them $1,000. [01:27:40.940 --> 01:27:43.940] So, well, I'll tell you what. [01:27:43.940 --> 01:27:51.940] If you have a conviction, then a civil suit is essentially residue to caught up. [01:27:51.940 --> 01:27:58.940] You file a nice big civil suit because of all of the time it took you an effort to remedy [01:27:58.940 --> 01:28:02.940] this, you sue them for a large amount. [01:28:02.940 --> 01:28:09.940] And first thing you do when you file suit is ask the judge to order mediation. [01:28:09.940 --> 01:28:15.940] You force them to the table safe, you sue them for a couple hundred thousand. [01:28:15.940 --> 01:28:21.940] What they do, it's not about who's right or who's wrong or the law or any of that. [01:28:21.940 --> 01:28:23.940] It's all about the money. [01:28:23.940 --> 01:28:31.940] And if you fought through and got them defeated in the criminal side, when you go after them [01:28:31.940 --> 01:28:36.940] on the civil side, they're going to have to do a calculation. [01:28:36.940 --> 01:28:38.940] What is this guy going to cost us? [01:28:38.940 --> 01:28:42.940] You file the suit, the lawyer responds with bull crap. [01:28:42.940 --> 01:28:46.940] You bar grieve the lawyer immediately and he's going to have a fit. [01:28:46.940 --> 01:28:53.940] You heard what Brett was just saying about what the lawyer did just with the threat that he may be, [01:28:53.940 --> 01:28:56.940] a vague threat that he might be bar grieved. [01:28:56.940 --> 01:28:58.940] He freaked out. [01:28:58.940 --> 01:29:02.940] You sting this lawyer and he's going to bail on them. [01:29:02.940 --> 01:29:05.940] They're going to have to hire another one for a lot more money. [01:29:05.940 --> 01:29:08.940] Hey guys, let's make a deal. [01:29:08.940 --> 01:29:11.940] Now calculate what it's going to cost you. [01:29:11.940 --> 01:29:12.940] Let's come to the table. [01:29:12.940 --> 01:29:15.940] I'll go away and leave you alone. [01:29:15.940 --> 01:29:23.940] They get you a pretty decent payday, but you only do the deal if they got the check in their hand. [01:29:23.940 --> 01:29:24.940] Think about it. [01:34:16.940 --> 01:34:18.940] So, the bigger part is that [01:34:18.940 --> 01:34:21.940] when I picked up my car about one o'clock in the morning, [01:34:21.940 --> 01:34:22.940] I was exhausted. [01:34:22.940 --> 01:34:24.940] I was obviously dealing about all this [01:34:24.940 --> 01:34:25.940] and the police got it out. [01:34:25.940 --> 01:34:27.940] Everything was okay, sort of, you know, [01:34:27.940 --> 01:34:29.940] got my car, but I had to say put the money. [01:34:29.940 --> 01:34:31.940] Next morning, I woke up [01:34:31.940 --> 01:34:33.940] and walked out around my car [01:34:33.940 --> 01:34:36.940] and saw that the front right side had just been trashed. [01:34:36.940 --> 01:34:38.940] So, somewhere in the tow [01:34:38.940 --> 01:34:40.940] and that evening they messed up the car. [01:34:40.940 --> 01:34:43.940] So, I did a little research [01:34:43.940 --> 01:34:45.940] and figured out who their insurance company was [01:34:45.940 --> 01:34:47.940] and I filed it immediately with claim with them [01:34:47.940 --> 01:34:50.940] before I even talked to the tow company owner [01:34:50.940 --> 01:34:53.940] who pretended that she was going to look into it [01:34:53.940 --> 01:34:55.940] but never did. [01:34:55.940 --> 01:34:58.940] Anyway, the insurance company started to, [01:34:58.940 --> 01:35:00.940] you know, so they were going to do an investigation, [01:35:00.940 --> 01:35:01.940] which they never did, [01:35:01.940 --> 01:35:04.940] but what they did do was start to act on her behalf, [01:35:04.940 --> 01:35:05.940] speak on her behalf. [01:35:05.940 --> 01:35:06.940] They would no longer, [01:35:06.940 --> 01:35:08.940] she would no longer talk to me, [01:35:08.940 --> 01:35:13.940] but they were the ones who were representing her. [01:35:13.940 --> 01:35:17.940] They did finally put out a third party adjuster [01:35:17.940 --> 01:35:19.940] because I was back in another state at that point [01:35:19.940 --> 01:35:23.940] and she came out and did an evaluation of the damage. [01:35:23.940 --> 01:35:25.940] She says, yeah, it looks like towing damage. [01:35:25.940 --> 01:35:28.940] Anyway, it was about $4,400. [01:35:28.940 --> 01:35:32.940] But I told the tow company, I mean, the insurance company, [01:35:32.940 --> 01:35:35.940] I said, you know, your client is acting illegally [01:35:35.940 --> 01:35:37.940] and I can show it to you in the law. [01:35:37.940 --> 01:35:39.940] I'm not aware of what's going on. [01:35:39.940 --> 01:35:41.940] And they said, you know what, basically, we don't care. [01:35:41.940 --> 01:35:43.940] If you want, just take us to court. [01:35:43.940 --> 01:35:45.940] That's literally what they said to me. [01:35:45.940 --> 01:35:46.940] And I recorded everything. [01:35:46.940 --> 01:35:48.940] I got all the documents. [01:35:48.940 --> 01:35:50.940] Wonderful. [01:35:50.940 --> 01:35:54.940] So I figured, yeah. [01:35:54.940 --> 01:35:58.940] So you accuse the insurance company [01:35:58.940 --> 01:36:00.940] of acting in concert inclusion [01:36:00.940 --> 01:36:02.940] and file a complaint with the, [01:36:02.940 --> 01:36:06.940] every state has an insurance board. [01:36:06.940 --> 01:36:11.940] They really hate complaints filed against them. [01:36:11.940 --> 01:36:14.940] You can accuse the insurance board [01:36:14.940 --> 01:36:17.940] of acting in concert inclusion with a towing company [01:36:17.940 --> 01:36:21.940] knowingly acting in concert inclusion with them, [01:36:21.940 --> 01:36:24.940] acting in violation of law. [01:36:24.940 --> 01:36:27.940] This helps the towing company increase their income [01:36:27.940 --> 01:36:31.940] so they can pay the insurance company more money. [01:36:31.940 --> 01:36:35.940] You build this really ugly, nasty looking suit [01:36:35.940 --> 01:36:40.940] with you, you look for issues [01:36:40.940 --> 01:36:45.940] that could potentially get to the state supreme. [01:36:45.940 --> 01:36:48.940] Or even to the federal supreme, [01:36:48.940 --> 01:36:50.940] but this doesn't sound like one that could, [01:36:50.940 --> 01:36:52.940] well have federal implications. [01:36:52.940 --> 01:36:57.940] You want to find a question on a point of law. [01:36:57.940 --> 01:37:01.940] Where an insurance company acts in concert inclusion [01:37:01.940 --> 01:37:08.940] with a client that they know are acting in violation of law. [01:37:08.940 --> 01:37:10.940] Are they culpable? [01:37:10.940 --> 01:37:14.940] Do they as a highly regulated industry [01:37:14.940 --> 01:37:20.940] have a duty to ensure that their clients [01:37:20.940 --> 01:37:24.940] are not increasing their income by criminal activity? [01:37:24.940 --> 01:37:28.940] Would that be considered acting in concert inclusion? [01:37:28.940 --> 01:37:31.940] And when the lawyer looks at this, he's going to say, [01:37:31.940 --> 01:37:35.940] these guys are going to take this to the supreme. [01:37:35.940 --> 01:37:37.940] That's what you want to find. [01:37:37.940 --> 01:37:40.940] You want to increase the calculation. [01:37:40.940 --> 01:37:43.940] And then the first pleading you get from the, [01:37:43.940 --> 01:37:46.940] if you talk to lawyers from the insurance company [01:37:46.940 --> 01:37:50.940] and they told you to go ahead and sue us, [01:37:50.940 --> 01:37:55.940] a lot of bar grievance against them for churning the case. [01:37:55.940 --> 01:37:59.940] Go to the bar grievance website. [01:37:59.940 --> 01:38:02.940] That's my bar grievance site. [01:38:02.940 --> 01:38:07.940] And go to this section where you get started. [01:38:07.940 --> 01:38:11.940] The only standard you need to look at [01:38:11.940 --> 01:38:17.940] where it's about client lawyer interactions [01:38:17.940 --> 01:38:19.940] is section one, two, three. [01:38:19.940 --> 01:38:22.940] And section two only has three issues, [01:38:22.940 --> 01:38:24.940] three different sections. [01:38:24.940 --> 01:38:28.940] So there's not really much to these grievances, [01:38:28.940 --> 01:38:31.940] but they got cool stuff in there. [01:38:31.940 --> 01:38:34.940] And you'll see how in that site, [01:38:34.940 --> 01:38:42.940] the state bar generally don't want you to include case law. [01:38:42.940 --> 01:38:50.940] Or they don't want you quoting the standards. [01:38:50.940 --> 01:38:58.940] So what I did is I have a box in there, a text area box. [01:38:58.940 --> 01:39:02.940] And it starts with, the grievance says, [01:39:02.940 --> 01:39:04.940] the lawyer shall not do this. [01:39:04.940 --> 01:39:06.940] And in the box it starts with, [01:39:06.940 --> 01:39:09.940] the lawyer did this as follows, [01:39:09.940 --> 01:39:11.940] and then you fill in what he did. [01:39:11.940 --> 01:39:14.940] And you take what you put in that box, [01:39:14.940 --> 01:39:19.940] just copy it out because the bar grievance sites [01:39:19.940 --> 01:39:21.940] want you to use their online grievance form, [01:39:21.940 --> 01:39:24.940] and you just drop that in their grievance form. [01:39:24.940 --> 01:39:27.940] It doesn't matter if it's valid and valid, [01:39:27.940 --> 01:39:29.940] heck it don't matter. [01:39:29.940 --> 01:39:33.940] The state bar is going to throw it in a trash. [01:39:33.940 --> 01:39:40.940] And the insurance carrier is likely to be interesting. [01:39:40.940 --> 01:39:44.940] Oh, the lawyers themselves will have their own insurance carriers [01:39:44.940 --> 01:39:47.940] because they all have to have errors in emissions. [01:39:47.940 --> 01:39:51.940] There is an emissions company is not going to care [01:39:51.940 --> 01:39:54.940] if the grievance is valid or invalid. [01:39:54.940 --> 01:39:56.940] They don't care. [01:39:56.940 --> 01:40:00.940] They know that if you file a bar grievance against the lawyer, [01:40:00.940 --> 01:40:03.940] that the bar association will get their grievance [01:40:03.940 --> 01:40:05.940] thrown in the trash. [01:40:05.940 --> 01:40:09.940] It's a good thing because the insurance companies, [01:40:09.940 --> 01:40:12.940] the errors in emissions carriers know that. [01:40:12.940 --> 01:40:15.940] So how do they gauge their level of risk? [01:40:15.940 --> 01:40:17.940] By valid bar grievances? [01:40:17.940 --> 01:40:19.940] Heck, it's all in the trash. [01:40:19.940 --> 01:40:22.940] By the numbers. [01:40:22.940 --> 01:40:24.940] First bar grievance, one bar grievance, [01:40:24.940 --> 01:40:27.940] your first year of practice to cancel immediately. [01:40:27.940 --> 01:40:30.940] Two bar grievances, any one year of practice to cancel. [01:40:30.940 --> 01:40:35.940] Three to cancel your law firms about practice insurance. [01:40:35.940 --> 01:40:43.940] Now, Chris, you understand why that lawyer was so perturbed? [01:40:43.940 --> 01:40:47.940] Chris, can you get off the speakerphone? [01:41:22.940 --> 01:41:25.940] It is not that way now. [01:41:25.940 --> 01:41:30.940] Never has been that way since we've had human beings as judges. [01:41:30.940 --> 01:41:34.940] You will only win your case if you have the politics on your side [01:41:34.940 --> 01:41:37.940] and all politics is local. [01:41:37.940 --> 01:41:41.940] And all politics is driven by the money. [01:41:41.940 --> 01:41:45.940] In your case, where you sue the insurance company, [01:41:45.940 --> 01:41:49.940] the first thing you do is sting the lawyers. [01:41:49.940 --> 01:41:52.940] And the lawyers are going to have a conniption, [01:41:52.940 --> 01:41:56.940] and they're going to want a lot more money to keep representing [01:41:56.940 --> 01:41:59.940] the insurance company on this case. [01:41:59.940 --> 01:42:02.940] You sting them a second time and they're likely to hit the road [01:42:02.940 --> 01:42:04.940] telling them, you got to hit somebody else. [01:42:04.940 --> 01:42:07.940] And then when people start doing bar grievances, [01:42:07.940 --> 01:42:11.940] this is what they find, that all of a sudden the law firm goes away [01:42:11.940 --> 01:42:13.940] and they get another law firm. [01:42:13.940 --> 01:42:17.940] What they're not going to tell you is how much money they're having [01:42:17.940 --> 01:42:22.940] to pay this second law firm. [01:42:22.940 --> 01:42:26.940] And at the end of the day, it's a calculation. [01:42:26.940 --> 01:42:28.940] It's all about money. [01:42:28.940 --> 01:42:31.940] So you let them know early you're going to sting them good [01:42:31.940 --> 01:42:33.940] and then ask for mediation. [01:42:33.940 --> 01:42:36.940] The judge doesn't want to sit through this hearing. [01:42:36.940 --> 01:42:39.940] Judges sit there and they hear the same stories over and over [01:42:39.940 --> 01:42:41.940] and over and over and over. [01:42:41.940 --> 01:42:42.940] Boring. [01:42:42.940 --> 01:42:44.940] We had a district judge in the county. [01:42:44.940 --> 01:42:48.940] The lawyers used to complain that you'd fall asleep [01:42:48.940 --> 01:42:51.940] during the trial because he was so bored. [01:42:51.940 --> 01:42:52.940] Well, they get bored. [01:42:52.940 --> 01:42:54.940] They'd rather be out playing golf. [01:42:54.940 --> 01:42:57.940] So if you ask the judge to order mediation, [01:42:57.940 --> 01:42:59.940] oh, yeah, you bet. [01:42:59.940 --> 01:43:01.940] Boom. [01:43:01.940 --> 01:43:03.940] If you're representing yourself, [01:43:03.940 --> 01:43:07.940] the lawyer will never come to the table to make a deal with you [01:43:07.940 --> 01:43:09.940] because you're prosaic. [01:43:09.940 --> 01:43:11.940] He can't stoop that low. [01:43:11.940 --> 01:43:16.940] Unless the judge orders him to. [01:43:16.940 --> 01:43:18.940] Now he has plausible igniability. [01:43:18.940 --> 01:43:21.940] He can come and make a deal and not lose face. [01:43:21.940 --> 01:43:22.940] Write me a check. [01:43:22.940 --> 01:43:24.940] I'll go away and leave you alone. [01:48:26.940 --> 01:48:31.940] Do you have any old litigation guides? [01:48:31.940 --> 01:48:33.940] And we had someone in Amarillo do that, [01:48:33.940 --> 01:48:37.940] a woman who was trying to do her own case. [01:48:37.940 --> 01:48:41.940] She said that the second lawyer she called said, [01:48:41.940 --> 01:48:46.940] do you have a station wagon or a pickup truck? [01:48:46.940 --> 01:48:51.940] Because every time the litigation guide is republished, [01:48:51.940 --> 01:48:53.940] the lawyers only use the latest ones, [01:48:53.940 --> 01:48:56.940] so they got the old ones sitting around. [01:48:56.940 --> 01:48:58.940] And they're easy to get. [01:48:58.940 --> 01:49:01.940] You look on Craigslist, once you find out what it is, [01:49:01.940 --> 01:49:03.940] and you get the litigation guide. [01:49:03.940 --> 01:49:05.940] The litigation guide will tell you, [01:49:05.940 --> 01:49:12.940] will give you how to build any motion or pleading you want to build. [01:49:12.940 --> 01:49:14.940] It'll give you the case law to put in. [01:49:14.940 --> 01:49:16.940] It'll give you everything. [01:49:16.940 --> 01:49:18.940] Lawyers don't build these things themselves. [01:49:18.940 --> 01:49:20.940] They use the litigation guide. [01:49:20.940 --> 01:49:25.940] I once, a friend of mine was having a foreclosure issue. [01:49:25.940 --> 01:49:27.940] He was a fellow researcher, [01:49:27.940 --> 01:49:31.940] and he sent me this petition for restraining order. [01:49:31.940 --> 01:49:33.940] He had me read it and he said, what do you think? [01:49:33.940 --> 01:49:35.940] I said, it's crap, Ken. [01:49:35.940 --> 01:49:37.940] You think you can do better? [01:49:37.940 --> 01:49:38.940] You bet I can. [01:49:38.940 --> 01:49:39.940] So I sent him one. [01:49:39.940 --> 01:49:41.940] He went to court, filed it. [01:49:41.940 --> 01:49:43.940] They didn't expect the other lawyer to show up, [01:49:43.940 --> 01:49:45.940] they went into court. [01:49:45.940 --> 01:49:51.940] The judge handed the lawyer his hat and gave Ken his restraining order. [01:49:51.940 --> 01:49:54.940] The lawyer come out and he said, are you an attorney? [01:49:54.940 --> 01:49:56.940] He said, no, but my brother is. [01:49:56.940 --> 01:49:58.940] Did you write this? [01:49:58.940 --> 01:50:01.940] He said, well, yeah, I had some help. [01:50:01.940 --> 01:50:06.940] Ken told me that, and the lawyer told him, this is very good. [01:50:06.940 --> 01:50:09.940] And I thought, what the heck? [01:50:09.940 --> 01:50:14.940] I didn't tell Ken that I took that right out of O'Connor's litigation guide, [01:50:14.940 --> 01:50:17.940] the form and filled in the blanks. [01:50:17.940 --> 01:50:23.940] But what happened was, all these lawyers use the same form. [01:50:23.940 --> 01:50:32.940] That way, the judge doesn't have to pay any attention to that portion of the motion that's relevant. The prosecutor stepped up to the judge and dismissed the case out of hand because they knew once they got in front of the jury, everything changes. [01:54:08.940 --> 01:54:16.940] Anybody does anything wrong, you can hammer them and you are the thing they fear the most. Well, no, what I'm saying is when they, when you request a deposition in writing and they send it out, are they required, is the police and the court required to make sure it goes by certified mail or does not make. [01:55:43.940 --> 01:55:50.940] No, no. If you don't get it, you know, and you can say, hey, I didn't get it, and then they will send you another one. [01:55:50.940 --> 01:55:58.940] If you claim you didn't get it, then you can ask them to send one certified so they can prove they got it. [01:55:58.940 --> 01:56:10.940] It is for the benefit of the sender, not the receiver. The recipient, a certified mail, the recipient cannot claim he didn't get it.
