[01:19.960 --> 01:25.320] This was compiled after an 11-month long investigation by the Office of the Texas Secretary of State [01:25.320 --> 01:30.000] and the Texas Department of Public Safety, which sought to identify non-U.S. citizens [01:30.000 --> 01:33.360] who were registered to vote when obtaining major arbitrage license. [01:33.360 --> 01:37.040] Over half of the 95,000 did indeed vote, it seems. [01:37.040 --> 01:41.080] However, further controversy was raised when it became clear that some of the names were [01:41.080 --> 01:45.240] not in fact belonging to those who were non-citizens and registered. [01:45.240 --> 01:50.880] Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote. [01:50.880 --> 01:55.240] Registered voters who receive letters querying their citizenship have 30 days to respond [01:55.240 --> 01:57.040] with proof of eligibility. [01:57.040 --> 02:01.240] Texas Attorney General Ken Paxton and David Whitley, the Texas Secretary of State, have [02:01.240 --> 02:09.000] yet to officially comment regarding this list and any updates pertaining to it. [08:36.520 --> 08:45.280] What it's saying is that if I don't accept their offer, which isn't a real large offer, [08:45.280 --> 08:53.920] but if I don't accept this offer and it goes to trial, and at trial the jury does not give [08:53.920 --> 09:01.960] me more than what they offered, then I'm stuck paying their attorney fees, all their fees, [09:01.960 --> 09:06.640] from the time they made that offer. [09:06.640 --> 09:09.720] Okay. [09:09.720 --> 09:11.120] Are you familiar with that? [09:11.120 --> 09:17.240] Well, I've heard of that before, I haven't looked at rule 68, but I have heard of that [09:17.240 --> 09:18.240] before. [09:18.240 --> 09:24.120] Let me, I've got it here, making an offer, judgment on an accepted offer, at least 14 [09:24.120 --> 09:29.160] days before the date set for trial, a party defending against a claim may serve on an [09:29.160 --> 09:36.120] opposing party an offer to allow judgment on specified terms with the cost then accrued. [09:36.120 --> 09:42.480] If within 14 days after being served, the opposing party serves written notice accepting [09:42.480 --> 09:49.360] the offer, either party may then file the offer and notice of acceptance plus proof [09:49.360 --> 09:53.400] of service, the clerk must then enter judgment. [09:53.400 --> 10:00.080] Unaccepted offer, it's paragraph B, an unaccepted offer is considered withdrawn, but it does [10:00.080 --> 10:07.320] not preclude a later offer, evidence of an unaccepted offer is not admission except [10:07.320 --> 10:11.640] in a proceeding to determine costs. [10:11.640 --> 10:15.120] Offer after liability is determined. [10:15.120 --> 10:20.320] When one party's liability to another has been determined, but the extent of liability [10:20.320 --> 10:27.840] remains to be determined by further proceedings, the party held liable may make an offer judgment. [10:27.840 --> 10:33.000] It must be served within a reasonable time, but at least 14 days before the date set for [10:33.000 --> 10:37.200] a hearing to determine the extent of liability. [10:37.200 --> 10:44.800] Paying costs after an unaccepted offer, if the judgment that the offeree finally obtains [10:44.800 --> 10:51.880] is not more favorable than the unaccepted offer, the offeree must pay the cost incurred [10:51.880 --> 10:57.000] after the offer was made. [10:59.240 --> 11:07.320] The other side made an offer so that all of this would stop and neither side would incur [11:07.320 --> 11:11.920] any further costs and you didn't accept the offer. [11:11.920 --> 11:19.280] You come back and the jury says that the offer was valid because they don't give you as much [11:19.280 --> 11:22.360] as you asked for. [11:22.360 --> 11:27.640] Then you have to pay their costs from the point of the offer, but that's not going to [11:27.640 --> 11:35.240] be very much or not likely to you, aren't you pretty close to the end of this case? [11:35.240 --> 11:41.400] Well I am, but it's still I've got the cost of it going to trial, so that could very well [11:41.400 --> 11:45.960] be $12,000 or possibly more. [11:45.960 --> 11:57.480] It's your call, what do you think the jury will do? [11:57.480 --> 12:03.360] It's very difficult, the situation I'm in for one, they're pulling the jurors from [12:03.360 --> 12:09.760] my county which is great, I like that, except they've got to travel over a hundred miles [12:09.760 --> 12:17.400] and stay there for two to three days for the trial, which it's not as if they get a great [12:17.400 --> 12:19.200] compensation for this. [12:19.200 --> 12:26.760] First I have possibly disgruntled jurors that are going to hear my story, which it's not [12:26.760 --> 12:30.360] as if I was beat up, I was definitely violated. [12:30.360 --> 12:39.040] They threatened me with arrest if I did not give them my full name and date of birth and [12:39.040 --> 12:52.560] then they, and of course I did not comply and then they arrested me, they cuffed me. [12:52.560 --> 13:01.720] For a jury, you're asking the jury to rule against a policeman? [13:01.720 --> 13:07.440] Exactly, and that's, that is, it's hard. [13:07.440 --> 13:08.440] Pardon me? [13:08.440 --> 13:14.600] It's always hard, they don't want, the jurors want to trust their police, they want to decide [13:14.600 --> 13:18.800] with their police. [13:18.800 --> 13:23.120] My whole reason for bringing this case has never been the money, I really frankly don't [13:23.120 --> 13:29.240] care about it, it was really, you know, my county, there's a lot of shootings in my county, [13:29.240 --> 13:37.200] a lot of officers just running right over the top of people, they really don't care [13:37.200 --> 13:44.800] about rights of people and so, you know, it was really, the purpose was to try and, you [13:44.800 --> 13:52.440] know, stop officers or make them think twice before they violated somebody's rights. [13:52.440 --> 13:58.160] And problem with this, you know, with this over my head, I can never get to that point [13:58.160 --> 14:02.560] unless I'm willing to take that gamble. [14:02.560 --> 14:09.760] I mean, I don't, there's, okay, I'm going to suggest you've already achieved what you [14:09.760 --> 14:18.760] can with this lawsuit, or these guys are, you can be relatively certain it will be in [14:18.760 --> 14:29.400] their training, do not mess with first responders, the skies likely to fall in on you, it certainly [14:29.400 --> 14:41.360] fell in on this officer, it's really not about the money, it's about making a statement [14:41.360 --> 14:44.120] to these guys, you have made that statement. [14:44.120 --> 14:50.040] Yeah, maybe, I mean, I don't know, I mean, it surely doesn't seem to have inconvenienced [14:50.040 --> 14:55.120] them that much, and that's my issue. [14:55.120 --> 15:04.080] Well, they've, they've put out a lot of money, fighting your case probably far more than [15:04.080 --> 15:08.440] you know, these lawyers cost them a lot of money. [15:08.440 --> 15:15.160] Yeah, I think it's probably, I was told it was around 300 bucks an hour, which is really [15:15.160 --> 15:16.160] ... [15:16.160 --> 15:24.800] No, no, no, no, nowadays, at law firm, the average starting pay for a lawyer fresh out [15:24.800 --> 15:31.280] of law school, when a law firm picks them up is $260 an hour, that is bottom. [15:31.280 --> 15:37.520] Right, but I think whenever they contract with several different municipalities to defend [15:37.520 --> 15:41.800] their, the Sheriff Department, Police Department, I think they, from what I understand, they [15:41.800 --> 15:49.520] give them a lower rate, but at any rate, you know, I don't know if that matters so much. [15:49.520 --> 15:58.000] I just, you know... If they make a deal with you, they have essentially capitulated. [15:58.000 --> 16:04.880] They've said, you know, we're not going to win this at the end of the day, they're pretty [16:04.880 --> 16:07.760] sure they're not going to win this. [16:07.760 --> 16:11.280] Have you given them a counter offer? [16:11.280 --> 16:15.920] I have not given them a counter offer, I could possibly give them a counter offer, and I did [16:15.920 --> 16:21.840] talk to a disbarred lawyer that is a friend of some of the family, and he seems like a [16:21.840 --> 16:26.920] pretty good guy, and he said when he would do it, he would give them a counter offer, [16:26.920 --> 16:34.600] but just say in the counter offer, you know, we are considering your offer, so it doesn't [16:34.600 --> 16:37.600] come across as we're not accepting your offer. [16:37.600 --> 16:41.920] We're considering your offer, but you know, this is the amount that I would be willing [16:41.920 --> 16:48.200] to settle for, and then give them another, you know, price, another offer, but the problem [16:48.200 --> 17:00.320] is, is any offer at this point, I mean, their offer was under 3,000, which is not an offer. [20:04.640 --> 20:11.960] But $3,000, I would be prone to send them a response back saying this is not a [20:11.960 --> 20:20.880] point from which I will begin to negotiate. Your offer is not a viable [20:20.880 --> 20:27.560] offer. You're merely doing a shister shenanigan to get out of having to pay [20:27.560 --> 20:34.360] the rest of your attorney fees. I ask them to make you a viable offer or give [20:34.360 --> 20:41.880] them a counteroffer. That is as much above what you would want to get as that [20:41.880 --> 20:51.560] is below. This is a negotiation. Right. So, I mean, what this the disbarred [20:51.560 --> 20:59.800] attorney had mentioned is that they consider it a win if it's under if you [20:59.800 --> 21:08.760] if they pay under $10,000, I would think so. No, there's no way they can. This [21:08.760 --> 21:16.120] cannot be a win for them. Period. Their officer did something stupid. And they [21:16.120 --> 21:22.640] have to come into court. At this point, they're relatively certain that you will [21:22.640 --> 21:31.760] get a ruling in your favor. Right. Now, what they're trying to do is convince [21:31.760 --> 21:35.640] you to take as little as possible. This is not about winning or losing. They've [21:35.640 --> 21:44.080] already lost. This is about just how much they're going to lose. But it's also a [21:44.080 --> 21:48.160] gamble whether I want to push them to the point where they're going to run it to [21:48.160 --> 21:52.960] trial. And if it goes to trial, then I'm if I can't convince the jury to give me [21:52.960 --> 21:57.880] more than what they have offered, then I'm stuck paying a bill. And that's what [21:57.880 --> 22:02.680] I'm really, I don't really want to get a win only to pay, you know, $15,000, [22:02.680 --> 22:09.880] $20,000. That just doesn't really fill the win to me. So, make them a [22:09.880 --> 22:14.800] counteroffer. I can always accept this offer if you have to, if you don't want [22:14.800 --> 22:26.520] to take that risk. But right now, you're playing poker. So, you know, they've made [22:26.520 --> 22:31.720] their offer. I would suggest give them a counteroffer and see what they say. [22:31.720 --> 22:40.160] Okay. All right. So, a couple other questions here. I mean, they say further [22:40.160 --> 22:44.080] this offer is not to be used in any other action as evidence of admission or [22:44.080 --> 22:51.560] fault for resduticata. What's this resduticata? Means already been adjudicated. [22:51.560 --> 22:56.760] I don't know why they would put resduticata there because resduticata [22:56.760 --> 23:06.040] would not really apply. What they want to say is down the road, you can't claim [23:06.040 --> 23:12.760] a win. You can't claim this as precedent, because you didn't get a jury [23:12.760 --> 23:21.520] ruling. Okay. So, we never admitted fault, blah, blah, blah, you know, that stuff. [23:21.520 --> 23:29.600] Right. And then it's, so, issue, resduticata, issue, preclusion and slash or [23:29.600 --> 23:37.520] collateral, a stop-all purposes. For any end, yeah. Collateral, collateral, a stop-all [23:37.520 --> 23:44.760] is where you come into the court and you make a statement or a claim. You cannot [23:44.760 --> 23:49.600] come back subsequently and make a different or opposing statement or [23:49.600 --> 23:56.880] claim. We have a, I had a case where Wells Fargo was foreclosing on this guy. [23:56.880 --> 24:04.240] And I filed a petition for declaratory judgment with the court asking the court [24:04.240 --> 24:10.680] to rule on the validity of a particular document at the other side of the file. [24:10.680 --> 24:18.760] Well, the other side filed a motion and filed a 12b6 motion to dismiss [24:18.760 --> 24:25.440] a fair state of claim and asked the court to dismiss the case because Wells Fargo [24:25.440 --> 24:34.120] was not the lender. Well, that was a bonehead move. They were foreclosing and [24:34.120 --> 24:38.920] therefore, they're standing in the shoes of the lender, whether they were [24:38.920 --> 24:48.400] actually the lender or not. So, the guy made a big mistake. So, they're trying to [24:48.400 --> 24:52.560] foreclose on this property and they said they're not the lender. That means [24:52.560 --> 24:58.120] they're not standing in the shoes of the lender. So, what do you do with somebody [24:58.120 --> 25:04.120] who makes a really big blunder? Well, you're running there and non-suited as quickly as you [25:04.120 --> 25:10.480] can. That's exactly what I did. So, if they come back and try to foreclose and [25:10.480 --> 25:15.280] say that we are the lender in this case, we can object as their subject to [25:15.280 --> 25:20.840] collateral estoppel. Because in this prior case, you claimed you were not the [25:20.840 --> 25:25.200] lender. You cannot. And because you claimed you were not the lender, [25:25.200 --> 25:32.320] we non-suited the case. You cannot now come back and make an opposing statement. [25:32.320 --> 25:40.480] That's collateral estoppel. Gotcha. Okay. All right. One last question, I believe, [25:40.480 --> 25:47.920] here. And what they're saying, they're willing to pay me this particular [25:47.920 --> 25:53.880] amount plus taxable cost incurred to date, including reasonable attorney's fees. [25:53.880 --> 26:03.520] Now, is it possible to get attorney's fees or my time? Yes, they've already, if [26:03.520 --> 26:09.440] they're agreeing to attorney fees, that changes everything. How much have you put [26:09.440 --> 26:17.440] out for attorneys? I haven't put anything out for attorneys, so. Well, how much would [26:17.440 --> 26:22.120] your attorneys who helped you have charged you? Well, yeah. Well, that's a whole [26:22.120 --> 26:27.760] another thing, but yeah, that's why I'm asking you, because this particular [26:27.760 --> 26:32.160] lawyer claims that there's no way that they're not going to give me attorney's [26:32.160 --> 26:39.400] fees. That's what they say, but if I, you know, I'm, as pro se, cannot. If you [26:39.400 --> 26:47.240] used an attorney and the attorney didn't bill you yet to have the attorney bill [26:47.240 --> 27:01.040] you, that'll bump it up. But how would I go about that? Yeah, go to the attorney [27:01.040 --> 27:04.080] that you talked to and say, you know, they made me an offer and they've offered [27:04.080 --> 27:19.240] me attorney fees. [48:55.720 --> 49:01.720] No, because it is the insurance carrier [49:01.720 --> 49:09.720] who is liable for any deal or any claim that he receives. [49:09.720 --> 49:14.720] So he can't file another claim on top of that. [49:14.720 --> 49:18.720] Well, I would have gone after the insurance to start with and then go. [49:18.720 --> 49:23.720] You can't go after the insurance directly. They owe no duty to you. [49:23.720 --> 49:29.720] They owe a duty to indemnify their client, but they owe none to you. [49:37.720 --> 49:42.720] You do that when you file a suit, you go after them in directly because they're covered. [49:49.720 --> 50:01.720] In this case, he was a sheriff's deputy and it was arresting people for violations of law was within scope. [50:01.720 --> 50:08.720] In your case, trespassing on your property without cause is not within scope. [50:08.720 --> 50:12.720] Well, in my case, I wasn't on my property. [50:12.720 --> 50:16.720] I was traveling. I was more than 50 miles from the border. [50:16.720 --> 50:25.720] According to the Texas Code of Criminal Procedures only has jurisdiction in certain areas in Texas [50:25.720 --> 50:35.720] and jurisdiction has to be granted by the Texas legislature as in accordance with the U.S. Constitution Article 1 Section 8 Clause 17. [50:35.720 --> 50:44.720] If they were outside that distance, then they were outside of scope. [50:44.720 --> 50:54.720] They were outside their claimed 25 miles that is set up under Title 8 Section 1357 for INS. [50:54.720 --> 50:56.720] They're not INS. [50:56.720 --> 51:11.720] The INS officers are covered under Texas Code of Criminal Procedures 2.112 subparagraph A, Special Investigators. [51:11.720 --> 51:25.720] Subparagraph C of that same section covers Customs and Border Patrol agents as Special Investigators that are not peace officers within the boundaries of Texas. [51:25.720 --> 51:31.720] And it's very, very explicit and has not changed in years. [51:31.720 --> 51:35.720] Then you have a really good claim. [51:35.720 --> 51:48.720] Well, I really do take a front to somebody shoving a Glock in my face that's filled with hollow point ammunition that has no safety on that weapon. [51:48.720 --> 51:54.720] Aggravated assault. You were, what, quarter-financed from having your brains blown out? [51:54.720 --> 51:59.720] Maybe. If that's far away, yeah. He needs to be able to tell you exactly how much it takes. [52:13.720 --> 52:17.720] Well, he should know, depending upon the model. [52:17.720 --> 52:29.720] And we were before sunrise and I wasn't, you know, they're not peace officers. They're not allowed to make traffic stops. That's been adjudicated before in federal court. [52:29.720 --> 52:46.720] And everybody knows that in all 50 states, even if they did have authority to make a traffic stop, a suspicious vehicle is not grounds to make a stop. Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote. [01:03:42.720 --> 01:03:55.720] Well, if you go all the way down to the very last section, all of the criminal, both state and federal, all the criminal actions are listed right there and tied back into the upper part. [01:03:55.720 --> 01:04:02.720] The upper part is just the chronological occurrence, bullet by bullet by bullet by bullet. [01:04:02.720 --> 01:04:14.720] And what really, more than anything else, Randy, this has been going on for 11 years. This is now just the current one. [01:04:14.720 --> 01:04:26.720] But just like the last sheriff who refused to even take criminal complaints, this sheriff told my wife, don't ever call him again, period. [01:04:26.720 --> 01:04:33.720] So my neighbor and I, because of what happened to him in that thing, you can read it. [01:04:33.720 --> 01:04:41.720] We went to the commissioner's court on the 12th. That occurrence that involved me happened on the 2nd of November. [01:04:41.720 --> 01:04:45.720] On the 3rd of November, there was another occurrence. [01:04:45.720 --> 01:04:59.720] On the 8th, I wound up having an interview with the FBI, and the FBI has a mandatory reporting requirement if a federal agent does certain things. [01:04:59.720 --> 01:05:02.720] They did not report anything. [01:05:02.720 --> 01:05:08.720] 28 USC 535, are you familiar with that one? [01:05:08.720 --> 01:05:11.720] That's listed in there. [01:05:11.720 --> 01:05:15.720] Yeah, they don't have a choice. They have to report it. [01:05:15.720 --> 01:05:23.720] But also, the US prosecutor in Del Rio said, I never broke a law. They had to release me. [01:05:23.720 --> 01:05:35.720] They did not release me. They told an attorney, my brother, who had called after my wife called him, that they were going to keep me till Monday [01:05:35.720 --> 01:05:43.720] in a facility that had no betting capability whatsoever. There's not ADA certified or anything else. [01:05:43.720 --> 01:05:50.720] And they could not meet my dietary requirements or my medication requirements. [01:05:50.720 --> 01:06:02.720] And they refused to let me talk to an attorney, make a phone call to anybody for the 10 plus hours I was held there. [01:06:02.720 --> 01:06:08.720] Well, we have a case in Texas. [01:06:08.720 --> 01:06:14.720] I'll get the name of a boy with the guy's name, Boyd B. State. [01:06:14.720 --> 01:06:19.720] He's cutting a road across a piece of property, and the guy that owns the property come out and said, what are you doing? [01:06:19.720 --> 01:06:22.720] I'm cutting this road. He said, we're going to quit cutting that road. That's my property. [01:06:22.720 --> 01:06:25.720] He said, no, my boss told me to cut this road. If I quit, he'll fire me. [01:06:25.720 --> 01:06:29.720] He said, if you don't quit cutting that road, I'm going to call the sheriff and have him arrest you. [01:06:29.720 --> 01:06:32.720] And he said, we're going to have to because I don't want to get fired. [01:06:32.720 --> 01:06:34.720] So the sheriff come out and told him to quit cutting the road. [01:06:34.720 --> 01:06:36.720] He said, I'm going to quit cutting the road. [01:06:36.720 --> 01:06:39.720] The sheriff said, you don't have to cut that road. I'm going to arrest you. [01:06:39.720 --> 01:06:41.720] He said, we're going to have to arrest me. I'm not going to quit. [01:06:41.720 --> 01:06:44.720] So he ordered him get in your car and follow me in my office. [01:06:44.720 --> 01:06:50.720] They left where he was at. They passed a small town 26 miles to Corpus. [01:06:50.720 --> 01:06:56.720] He held him for 45 minutes, talked to the guy's boss, and worked it out. [01:06:56.720 --> 01:06:59.720] And the sheriff told him, you can go. [01:06:59.720 --> 01:07:06.720] He sued him for not taking him to the magistrate who was five miles away [01:07:06.720 --> 01:07:11.720] and took him to his office that was 26 miles away. [01:07:11.720 --> 01:07:15.720] And he won that one. That's still good law. [01:07:15.720 --> 01:07:21.720] They had an absolute duty to take you to a magistrate in the county. [01:07:21.720 --> 01:07:27.720] Now, you're going to get an argument that you don't have a right to a [01:07:27.720 --> 01:07:31.720] examining trial in a felony. [01:07:31.720 --> 01:07:35.720] I'm sorry, in the case of a misdemeanor, only in a felony. [01:07:35.720 --> 01:07:38.720] What a misdemeanor. [01:07:38.720 --> 01:07:43.720] My argument was before a traffic court judge. [01:07:43.720 --> 01:07:49.720] I said, so what? What does that have to do with anything? [01:07:49.720 --> 01:07:53.720] When he asked me for a plea, I told him I'm not here to plea. [01:07:53.720 --> 01:07:56.720] I'm here for an examining trial. [01:07:56.720 --> 01:08:01.720] Well, you don't have a right to one. I said, so what? What's that got to do with anything? [01:08:01.720 --> 01:08:11.720] The code specifically commands your officer to take me directly to the nearest magistrate. [01:08:11.720 --> 01:08:19.720] Whether I have a right to that or to be directly taken to a magistrate or not is irrelevant. [01:08:19.720 --> 01:08:22.720] I do have a right to do process. [01:08:22.720 --> 01:08:24.720] And he violated your process. [01:08:24.720 --> 01:08:30.720] The judge told me after the case, he said, you know, in my day job, I represent criminal clients [01:08:30.720 --> 01:08:36.720] and we've been trying to get magistrates to give our clients examining trials. [01:08:36.720 --> 01:08:41.720] And they've quoted this case. [01:08:41.720 --> 01:08:48.720] He said, I could use that in my practice. [01:08:48.720 --> 01:08:49.720] Clearly. [01:08:49.720 --> 01:08:51.720] They always learn something. [01:08:51.720 --> 01:08:56.720] Yeah, you have a right to do process. [01:08:56.720 --> 01:09:04.720] If do process commands that any certain things be done, that is a right that you have. [01:09:04.720 --> 01:09:11.720] Because it becomes federal immediately because it's constitutional right. [01:09:11.720 --> 01:09:13.720] The border patrol. [01:09:13.720 --> 01:09:18.720] In this case, it would be federal anyway because they are border patrol. [01:09:18.720 --> 01:09:33.720] This may be a good case to get in there right now because Trump is not going to be happy with his border patrol officers acting in a way that the Democrats could use against him. [01:09:33.720 --> 01:09:41.720] Well, that's true, but we've got a dual sword here, part of its state, part of its federal. [01:09:41.720 --> 01:09:43.720] It's all federal. [01:09:43.720 --> 01:09:45.720] The executor said, I never know. [01:09:45.720 --> 01:09:50.720] No, they are federal actors, but they acted out of jurisdiction. [01:09:50.720 --> 01:09:54.720] Okay, so you're saying, okay, yeah, good, okay. [01:09:54.720 --> 01:10:01.720] They were outside their jurisdiction, but even though they took you to a federal enclave. [01:10:01.720 --> 01:10:04.720] That's where they kidnapped me. [01:10:04.720 --> 01:10:07.720] They took me outside the state. [01:10:07.720 --> 01:10:13.720] Yeah, and you can, where do you think you would be better at adjudicating this? [01:10:20.720 --> 01:10:26.720] You can sue them in the county where the infraction occurred. [01:10:26.720 --> 01:10:35.720] Any county between where the infraction occurred, any county in between where the actions occurred. [01:10:39.720 --> 01:10:47.720] You could file into one of those five counties, or you could file into Travis County. [01:10:47.720 --> 01:10:48.720] Yeah. [01:10:48.720 --> 01:10:53.720] Where do you think you would get the best read? [01:10:53.720 --> 01:11:00.720] Probably if we're going to prosecute it somewhere in Texas, it's going to be in Austin. [01:11:09.720 --> 01:11:16.720] So this should give you the ability to file in Austin in the first instance. [01:11:16.720 --> 01:11:21.720] And the government cannot claim non-convenes. [01:11:21.720 --> 01:11:22.720] Nope. [01:11:22.720 --> 01:11:27.720] They can't complain an inconvenient venue. [01:11:27.720 --> 01:11:35.720] Now you can, you know, if a citizen is charged in a venue that's a long way off and hard to get to, [01:11:35.720 --> 01:11:41.720] then you can file a claim of venue non-convenes, an inconvenient venue, [01:11:41.720 --> 01:11:46.720] and ask them to move it to a venue more convenient to you. [01:11:46.720 --> 01:11:48.720] But the government can't do that. [01:11:48.720 --> 01:11:55.720] These guys work for the government and it's not an inconvenience for them because they're on the clock. [01:11:55.720 --> 01:12:05.720] So getting them to Travis County would potentially get you a lot more press. [01:12:05.720 --> 01:12:12.720] And this is not something that the Border Patrol is going to want press over. [01:12:12.720 --> 01:12:21.720] Right now, they're kind of walking on egg shells. They got everybody looking at them because of this border wall thing. [01:12:21.720 --> 01:12:33.720] And Trump is not going to like having some potential issue like this tank his argument about increasing border security. [01:12:33.720 --> 01:12:39.720] We've got another issue that compounded this whole thing with them. [01:12:39.720 --> 01:12:49.720] The jurisdiction of the federal government within the many states, regardless of which one it is, is very, very, very limited. [01:12:49.720 --> 01:13:01.720] And this compounds that imminent domain issue that the Border Patrol DHS is running on all the border landowners. [01:13:01.720 --> 01:13:08.720] They're putting that into federal court. They don't have jurisdiction there. [01:13:08.720 --> 01:13:18.720] There's no federal jurisdiction on that property along the border except for what is already owned by the federal government. [01:13:18.720 --> 01:13:29.720] They've got, what is it, 50 feet from the border? Is the federal government's easement? [01:13:29.720 --> 01:13:35.720] If it is, it is only 50 feet. [01:13:35.720 --> 01:13:43.720] No, the border is from the center of the river to the riparian watermark on the shore. [01:13:43.720 --> 01:13:49.720] The state has never ceded anything other than that because it can't. [01:13:49.720 --> 01:14:01.720] They didn't cede it, but there is legislation that gives the Border Patrol jurisdiction 50 feet from the border. [01:14:01.720 --> 01:14:07.720] They have that reference recently. I don't have the exact statute for it. [01:14:07.720 --> 01:14:17.720] No. Well, they can have a statute all they want to. Land law in Texas is very straightforward, especially when there's a land patent granted on that property. [01:14:17.720 --> 01:14:27.720] And some of the property they're taking has been in property ownership, private property ownership, starting with the Spaniards, brought forward through Mexico, [01:14:27.720 --> 01:14:41.720] and then at the Treaty of Hidalgo brought forward into Texas, Republic of Texas, land patents, and in 1845, that was brought forward into the state. [01:14:41.720 --> 01:14:47.720] Yes. Texas is, for everybody else, Texas is unique in this regard. [01:14:47.720 --> 01:14:57.720] Only Texas has its own land office, and all of those land grants are still valid. [01:14:57.720 --> 01:15:08.720] If you own property in Texas, you can go to the land office and they'll help you find the grant yours is under, and you can bring your patent forward. [01:15:08.720 --> 01:15:14.720] And this eliminates any claim against your property by the state and loyal titles. [01:15:14.720 --> 01:15:22.720] Right now, DHS is running a scam on a lot of property owners down there, and they're upset, and there's a lot of it in court. [01:15:22.720 --> 01:15:30.720] But they're in the wrong court. The federal courts have no jurisdiction on this, and that's where they're at. [01:15:30.720 --> 01:15:49.720] And that's why this is so contentious, but I'm 16 miles from the border, and I've had them try and run scams on me, asking me initially to sign an agreement to let them on the property. [01:15:49.720 --> 01:15:54.720] And we've refused, just like most of the landowners out here have refused. [01:15:54.720 --> 01:15:59.720] They know they don't have jurisdiction on the private property. [01:15:59.720 --> 01:16:06.720] They fence out county. Once that fence is up, don't cross it. You're allowed to get shot. [01:16:06.720 --> 01:16:13.720] There's a lot of guys out here. Are they armed? No, it's how well are they armed? [01:16:13.720 --> 01:16:24.720] Because we've got a lot of predators. We've got mountain lions and bobcats and bears and everything else, and we do get jaguars up out of Mexico when they're burning the fields down there. [01:16:24.720 --> 01:16:29.720] Don't come up. So the livestock has to be protected. [01:16:29.720 --> 01:16:36.720] So if you're running around out there doing stupid stuff, running over fences, you know, you get a problem. [01:16:36.720 --> 01:16:46.720] But there's a lot of issues here, and I just wanted, my main thing was just to double check with you to make sure that you got in that thing and you were reading it. I write the lawsuit I'm going to file. [01:20:31.720 --> 01:20:38.720] And then I take the heading on the court heading off of it and put a letter heading on it. [01:20:38.720 --> 01:20:53.720] And I take the prayer, whatever I'm asking for, and just put a signature section on it, just like it was a letter, [01:20:53.720 --> 01:20:59.720] so that I send them the suit I'm going to file. [01:20:59.720 --> 01:21:02.720] It tends to really get their attention. [01:21:02.720 --> 01:21:11.720] When the lawyers get it, they tell them, this guy's not kidding, because he's already written the suit. [01:21:11.720 --> 01:21:21.720] But there's nothing special about a tort letter. It's just a business letter saying, explaining what has occurred, [01:21:21.720 --> 01:21:26.720] stating that you have been damaged in a certain amount. [01:21:26.720 --> 01:21:33.720] Make me whole to be sued. This is, I take the prayer out, and that's what I put in the, where the prayer was, [01:21:33.720 --> 01:21:38.720] I put a statement that I have been damaged, I've been damaged in this amount. [01:21:38.720 --> 01:21:40.720] Make me whole to be sued. [01:21:40.720 --> 01:21:49.720] And generally you put in, make me whole within, if it's a governmental agency, within 60 days you'll be sued. [01:21:49.720 --> 01:21:56.720] If it's another individual, then you can kind of pick your time, and it's generally 30 days. [01:21:56.720 --> 01:22:06.720] Yeah, if it's individual, you don't have to give him 60 days. [01:22:06.720 --> 01:22:14.720] Most jurisdictions require 60-day notice, and I will always ignore them, but that's what they require. [01:22:14.720 --> 01:22:23.720] Okay, next one. If we purchased it, we could force access, but it's not for what we need. [01:27:38.720 --> 01:27:44.720] As long as there's a parking lot right next to it, so we can drive right off the parking lot onto the property. It's a partitioning suit. You can partition the other person's property and force an easement. [01:28:14.720 --> 01:28:16.720] But we won't need to do that. [01:28:16.720 --> 01:28:18.720] There are a number of landlocked properties. [01:28:18.720 --> 01:28:23.720] I have one guy that used to call it all the time. David has in a long time. [01:28:23.720 --> 01:28:29.720] But what he used to do is look for property that had no owners on it. [01:28:29.720 --> 01:28:39.720] You can go through the, you look at the maps and he can find, he found properties that are appear to be landlocked. [01:28:39.720 --> 01:28:46.720] And then he would go check for the title on it and there's a lot of property in Texas. There's no title. [01:28:46.720 --> 01:28:49.720] No one claims ownership of it. [01:28:49.720 --> 01:28:53.720] And then he would go in and mow it and pay the taxes on it. [01:28:53.720 --> 01:29:05.720] And then after three years, he'd go to the court to take the property under the spotters rights of adverse possession. [01:29:05.720 --> 01:29:15.720] And because the property was, there was some provision if it's unimproved and you've taken care of it and you've paid the tax on it for three years. [01:29:15.720 --> 01:29:21.720] The judge will look out at the court and you have to publish in the newspaper a month ahead. [01:29:21.720 --> 01:29:25.720] And he'll ask, does anybody have an objection? [01:29:25.720 --> 01:29:32.720] Nobody raises their hand. He'll give you the property because the state wants it back on the tax rolls. [01:29:32.720 --> 01:29:33.720] Right. [01:29:33.720 --> 01:29:35.720] So he was picking up properties like this. [01:29:35.720 --> 01:29:41.720] Our difficulty is the property has to be in the right place. [01:29:41.720 --> 01:29:50.720] We never plot the shadow or where the signal will reach from that location. [01:29:50.720 --> 01:29:59.720] And Austin is in a basin. It's like a bowl. And we need to be on the rim of that bowl. [01:35:06.720 --> 01:35:24.720] All right, I've got a little insight for George in Arizona about settlements. About two years ago, I won an out-of-court settlement from my local police department here in southern New Jersey. [01:35:24.720 --> 01:35:37.720] And I sold out a court that it was a $35,000 settlement that was false arrest and false imprisonment, and what happened? [01:35:37.720 --> 01:35:45.720] There's two elements here that are important, and I don't know if George has actually met either one of these. [01:35:45.720 --> 01:35:57.720] So before I even get to that, without a lawyer representing you and getting in between you and the insurance companies, [01:35:57.720 --> 01:36:09.720] I think George stands about a zero chance of getting any kind of a substantial settlement from the police department, the township, or whatever the entity was, [01:36:09.720 --> 01:36:20.720] it took, I battled the township for almost three years before I finally got a lawyer and the right lawyer, [01:36:20.720 --> 01:36:27.720] and what he told me is there's two elements. He says, there's the harm. He said, how are you harmed, [01:36:27.720 --> 01:36:37.720] and what is the precedent for a similar case like yours that we can use to reach a settlement for it? [01:36:37.720 --> 01:36:48.720] Now, fortunately, I'm in New Jersey and my attorney was from Pennsylvania, and he had a similar lawsuit that set the precedent, [01:36:48.720 --> 01:37:00.720] and it was almost an identical situation, and they sold out a court for $35,000, and two weeks before the trial, [01:37:00.720 --> 01:37:10.720] that's when the insurance company, we had, that's when they made their final settlement, and it took almost a better part of a year back and forth. [01:37:10.720 --> 01:37:16.720] It was bluff poker. We dickered back and forth. They made an offer and it was low ball. [01:37:16.720 --> 01:37:22.720] It was like, I think the first one was between $3,000 and $5,000, and I recall that number, [01:37:22.720 --> 01:37:34.720] and it took almost a year to get them up to where the precedent said that this case is worth so much money based on similar cases, [01:37:34.720 --> 01:37:37.720] just like us, that it was settled. [01:37:37.720 --> 01:37:40.720] Well, let me give you some details on John. [01:37:40.720 --> 01:37:47.720] I'm John, I'm George in Arizona. George in Arizona was a volunteer fireman. [01:37:47.720 --> 01:37:55.720] They were called out to a fire, and after the fire was contained, there were a group of them standing around, [01:37:55.720 --> 01:38:02.720] and the officer said something, and George commented about it, and the officer demanded his ID. [01:38:02.720 --> 01:38:07.720] He told them to go scratch. So the officer cuffed him and put him in the car. [01:38:07.720 --> 01:38:21.720] That is almost word for word part of my scenario, too. So I refused to present ID walking down a road to a local college. [01:38:21.720 --> 01:38:32.720] That's a similar situation. I refused to present ID, and I said, I'm not being charged with, and we went back and forth, [01:38:32.720 --> 01:38:39.720] and the young fellow that was the young officer, he was questioning, and he called in for backup. [01:38:39.720 --> 01:38:45.720] I said, you need to get into your supervisor here, and then the supervisor showed up on the scene, [01:38:45.720 --> 01:38:52.720] and we went back and forth, and I video recorded the encounter, and that was pretty much the same. [01:38:52.720 --> 01:38:59.720] I was kind of assaulted by both of them, and I was arrested not on video recording, [01:38:59.720 --> 01:39:10.720] but in my pocket, I had a leather jacket on, and in my pocket was an old piece of a saltine cracker wrapped up in the brown paper that it comes in. [01:39:10.720 --> 01:39:17.720] So these guys, both of them sort of just bum brushed me and threw me up against the guardrail on the road, [01:39:17.720 --> 01:39:23.720] and they did the usual thing. They took my jacket off, and they were risking me down, [01:39:23.720 --> 01:39:29.720] and inside the leather jacket, they found a piece of a saltine cracker, [01:39:29.720 --> 01:39:35.720] and that's when they charged me with the possession of crack cocaine. [01:39:35.720 --> 01:39:37.720] Ooh. [01:39:37.720 --> 01:39:41.720] Oh, wasn't it cracker cocaine? [01:39:41.720 --> 01:39:50.720] Well, you couldn't write a scenario for that, and all the other things that transpired prior to it, [01:39:50.720 --> 01:39:55.720] before the settlement, during this, this went on for almost a year, [01:39:55.720 --> 01:40:03.720] but I'm just kind of getting off track with this, but he's got two hurdles, you know. [01:40:03.720 --> 01:40:15.720] Okay, will you send me a link to your case and the case, the officer, I mean, the lawyer used the one that he got to set? [01:40:15.720 --> 01:40:17.720] I'll send you everything. [01:40:17.720 --> 01:40:24.720] I got my settlement, I'll send you a copy of the settlement, the court case, all of that. [01:40:24.720 --> 01:40:32.720] Some of what the lawyer had to do was just kind of move the parts around a little bit, and it's almost the same case. [01:40:32.720 --> 01:40:41.720] You know, mine was a little more bizarre because I video recorded, and I had the encounter on a digital camera that I had with me that day, [01:40:41.720 --> 01:40:44.720] and they erased it at the police department. [01:40:44.720 --> 01:40:49.720] And when I finally got my camera back and I went home to review it, [01:40:49.720 --> 01:40:57.720] I got an error message that says there was no video there, so I got some video recovery software and recovered the video. [01:40:57.720 --> 01:41:03.720] So the whole thing was, now that was, that clenched everything. [01:41:03.720 --> 01:41:10.720] When I first, one of the lawyers initially in Mississippi Court, I got a local lawyer to defend me, [01:41:10.720 --> 01:41:16.720] and he said, when I showed him the video, he said, well, that's actionable, he said, [01:41:16.720 --> 01:41:20.720] and that's the one word that always stuck in my mind is actionable. [01:41:20.720 --> 01:41:29.720] You've got to get the lawyer to say that this is actionable, and that's kind of the green light, that's a green light. [01:41:29.720 --> 01:41:34.720] He didn't represent me in court, but he just represented me locally in the municipal court. [01:41:34.720 --> 01:41:41.720] So we got the case dismissed before it even, I went into court that day, and I was in and out in five minutes, the case was dismissed. [01:41:41.720 --> 01:41:53.720] Based on the video, but the, it's just like you say, it's the, it's not, it's never the law and the facts and the evidence, [01:41:53.720 --> 01:41:59.720] it's always the politics, and the politics, everything added up to a really embarrassing situation. [01:41:59.720 --> 01:42:08.720] Okay, that's what his is. Here you got a volunteer fireman who comes out as a first responder, [01:42:08.720 --> 01:42:14.720] and a policeman comes along with attitude, and over some nothing situation, [01:42:14.720 --> 01:42:19.720] Cusman puts him in the car in front of all of these other first responders. [01:42:19.720 --> 01:42:26.720] So he's demonstrating to all these first responders that when the police come out here, we take control of everything, [01:42:26.720 --> 01:42:32.720] but if you don't do exactly what we say, when and how we say, you're going to jail. [01:42:32.720 --> 01:42:41.720] Well, this guy knew what he was doing, and they wound up releasing him, they didn't take him to jail. [01:42:41.720 --> 01:42:55.720] So, politically, you're the jury, a guy volunteers his time, prepared to risk his life to help his neighbors, [01:42:55.720 --> 01:43:08.720] and for doing that, he gets cuffed and thrown in a car and threatened with potential death by two guys prominently displaying deadly weapons. [01:43:08.720 --> 01:43:11.720] Well, I feel his pain. [01:43:11.720 --> 01:43:18.720] Yeah, this is politically, I would not want to be in front of that jury if I was that cop. [01:43:18.720 --> 01:43:25.720] You know, that's sort of called bad optics. It doesn't look good, you know. [01:43:25.720 --> 01:43:27.720] Exactly. [01:43:27.720 --> 01:43:35.720] But you're just going to have a bit of a problem negotiating because he's never going to get a threshold beyond that chump change that they want to offer him, [01:43:35.720 --> 01:43:39.720] because that's one of the first offers I think was $3,000 or $5,000, [01:43:39.720 --> 01:43:49.720] and then we incrementally just, they would be back and forth, and there would be settlement hearings, and there would be, you know, they would have taken testimony, and they would have taken that to Davidson. [01:48:11.720 --> 01:48:22.720] So when I got into this thing, one of the things that I did, I think I got from you, was just kind of step back [01:48:22.720 --> 01:48:28.720] and do a critical analysis of just what went down, and write it down. [01:48:28.720 --> 01:48:32.720] So it's fresh in your memory. [01:48:32.720 --> 01:48:37.720] You've got to make a point to notice all the things that are going on around you. [01:48:37.720 --> 01:48:44.720] You just have to take, like, a situational awareness, and notice things. [01:48:44.720 --> 01:48:52.720] And try not to get too involved, don't get too carried away with yourself, but take notice of these things. [01:48:52.720 --> 01:48:58.720] Because these things are going to, that's going to be important down the line to convince a lawyer, you know, [01:48:58.720 --> 01:49:02.720] that you know what, you've done your work, you know, you've done your homework, and you've done your due diligence. [01:49:02.720 --> 01:49:10.720] And that's one of the first steps. When I finally got the right lawyer to handle this for me, I had a file. [01:49:10.720 --> 01:49:13.720] It must have been two inches thick. [01:49:13.720 --> 01:49:20.720] The things that I've gotten from you with the internal affairs investigations, I did that. [01:49:20.720 --> 01:49:24.720] I did a color of law complaint with the FBI and the Department of Justice. [01:49:24.720 --> 01:49:34.720] I bar grieved our attorney, our local attorney here, that represented the township. He was giving me a hard time about, you know, about a lawsuit. [01:49:34.720 --> 01:49:38.720] And so I've got a little bit of a track record with them now. [01:49:38.720 --> 01:49:47.720] I get treated, not just, I get treated a lot more preferentially when I have a problem now, because I don't want to deal with me again. [01:49:47.720 --> 01:49:53.720] It's just, you know, nobody's going to stay in the fight for four years like I did and come out of winter. [01:49:53.720 --> 01:49:58.720] The odds are well against anybody ever getting to a settlement. [01:49:58.720 --> 01:50:06.720] That's my impression and my experience is to go from zero to a settlement check, it's like 95% against you. [01:50:06.720 --> 01:50:13.720] Exactly. That's why I'm so proud of George. [01:50:13.720 --> 01:50:16.720] He's done this all himself. [01:50:16.720 --> 01:50:29.720] Well, I want to give him at least encouragement that if he's listening, that the key to this is to have, you know, this is an attorney to attorney fight. [01:50:29.720 --> 01:50:41.720] This bar card member to be out there talking to other bar card members, because they, you know, they will come to a deal faster amongst themselves than they will with you. [01:50:41.720 --> 01:50:51.720] Individually, they wouldn't even talk to me for the longest while until I built up enough, you know, I steamrolled them to the point where they couldn't avoid me anymore. [01:50:51.720 --> 01:50:59.720] But that's, it's important that, you know, I don't know, it's kind of, as a pro saying now, that's a little bit of a disadvantage. [01:50:59.720 --> 01:51:07.720] Like, I don't think that they take the demand very seriously. [01:51:07.720 --> 01:51:14.720] And it doesn't mean anything until you've got that bar card member, and, you know, and he intercedes for you on your behalf. [01:51:14.720 --> 01:51:22.720] That's, that's you have to find is the politics of it is, and that's, that, that took me a little while to really comprehend. [01:51:22.720 --> 01:51:27.720] But now I know at first handed, it's almost always the politics of the, of the case. [01:51:27.720 --> 01:51:33.720] If I can get that one point across. [01:51:33.720 --> 01:51:39.720] If it gets anything out of any of the calls, any that they've been listening to your show, everybody else is the politics. [01:51:39.720 --> 01:51:44.720] And if you understand the politics and you can play the politics, you can prevail. [01:51:44.720 --> 01:51:46.720] But that's not easy. [01:51:46.720 --> 01:51:49.720] It's easier said than done because it takes a lot of discipline. [01:51:49.720 --> 01:51:51.720] You know, you got to discipline yourself. [01:51:51.720 --> 01:51:55.720] You've got, you've got, you have to know them better than they know themselves. [01:51:55.720 --> 01:51:58.720] About the art of war, about knowing your enemy. [01:51:58.720 --> 01:52:05.720] Well, you better know him better than he knows himself and you can prevail, but it's, it's, it's an uphill fight. [01:52:05.720 --> 01:52:08.720] But, you know, the end of, it sets a precedent. [01:52:08.720 --> 01:52:18.720] Now, if, if George is just from my understanding, if he prevails in this, that's one of the big things that's in the back of their mind is, it's a precedent. [01:52:18.720 --> 01:52:24.720] They settle with him, even though there's, they don't admit any guilt or any, you know, any malfeasance. [01:52:24.720 --> 01:52:27.720] That's still a precedent when he gets paid. [01:52:27.720 --> 01:52:32.720] When they reach a settlement for him out of court, that's a precedent. [01:52:32.720 --> 01:52:35.720] And that's more important to them than the money. [01:52:35.720 --> 01:52:36.720] The money's nothing. [01:52:36.720 --> 01:52:39.720] They'll cut you a check, a check for $35,000. [01:52:39.720 --> 01:52:43.720] That, that's chump change in the scheme of things. [01:52:43.720 --> 01:52:45.720] They're dealing with millions of dollars. [01:52:45.720 --> 01:52:47.720] That doesn't mean anything, but it's the precedent. [01:52:47.720 --> 01:52:49.720] And that's what the attorney told me. [01:52:49.720 --> 01:52:50.720] He says, it's the precedent. [01:52:50.720 --> 01:52:55.720] He said, I have a similar case just like yours in another state. [01:52:55.720 --> 01:52:57.720] This is what we're going for. [01:52:57.720 --> 01:52:59.720] You know, it's the same thing. [01:52:59.720 --> 01:53:02.720] He said, you know, we just took, we just took it from Pennsylvania. [01:53:02.720 --> 01:53:04.720] We're going to relocate it to New Jersey. [01:53:04.720 --> 01:53:05.720] And that's how we win. [01:53:05.720 --> 01:53:08.720] So that's about, that's about it. [01:53:08.720 --> 01:53:13.720] You know, that's just my insight, you know, just a few things that. [01:53:13.720 --> 01:53:28.720] I'm glad to hear that insight because it supports what we believe and what we've been trying to, to promote. [01:53:28.720 --> 01:53:32.720] You'll never win your case simply because you have the law and the facts on your side. [01:53:32.720 --> 01:53:40.720] I had every time I signed in the beginning, it took me two years just to, just to go through, just to weed my way through the muck and the mire of it all. [01:53:40.720 --> 01:53:43.720] It didn't mean a damn thing that I had, I had vinegar recordings. [01:53:43.720 --> 01:53:50.720] I had every, I had them locked in, but it still didn't mean a damn thing until I clued in on the politics of it. [01:53:50.720 --> 01:53:55.720] You know, just what it took to get them to bring them to the, you know, bring them to the plate. [01:53:55.720 --> 01:53:56.720] And it was. [01:53:56.720 --> 01:54:03.720] The one thing I'm trying to get people to do now is start filing criminal complaints and do it early. [01:54:03.720 --> 01:54:04.720] Yeah. [01:54:04.720 --> 01:54:12.720] They're reluctant to file criminal complaints and most everybody I talked to are reluctant to. [01:54:12.720 --> 01:54:13.720] And. [01:54:13.720 --> 01:54:14.720] I'm involved in this. [01:54:14.720 --> 01:54:15.720] Yeah. [01:54:15.720 --> 01:54:18.720] I'm involved in something here that's, that might be potentially interesting. [01:54:18.720 --> 01:54:22.720] It hasn't evolved quite yet, but I got a situation. [01:54:22.720 --> 01:54:24.720] You mentioned the criminal complaints. [01:54:24.720 --> 01:54:32.720] Well, there is something down here that I'm getting a little pushback from, from the, from my local prosecutor. [01:54:32.720 --> 01:54:38.720] And this is a, there's a criminal fraud case going on in Pennsylvania. [01:54:38.720 --> 01:54:48.720] And the defendant in Pennsylvania pretty much duplicated his little crimes beyond crime scene down here in New Jersey. [01:54:48.720 --> 01:54:58.720] But I can't get the individuals that are involved to the point where they want to actually, you know, file a criminal complaint, [01:54:58.720 --> 01:55:05.720] have it investigated, go to court, you know, getting them to do that is the, and they've all been victimized. [01:55:05.720 --> 01:55:12.720] I'm the only one out of a half a dozen that I've spoken to that has really made any progress with any of this. [01:55:12.720 --> 01:55:15.720] And, but I think I'm having a little difficulty. [01:55:15.720 --> 01:55:20.720] I'm getting a little pushback from my local prosecutor. [01:55:20.720 --> 01:55:25.720] They, they want to steer what I, what I want to do in a different direction than I want. [01:55:25.720 --> 01:55:35.720] And so I think that there could be some, I think what there is is there might be an issue of a jurisdictional issue and a, and a due procedure, [01:55:35.720 --> 01:55:39.720] you know, due process issues here with them. [01:55:39.720 --> 01:55:45.720] And I think that they don't, I, for some reason, my guess is they just don't want to deal with me again in any capacity, [01:55:45.720 --> 01:55:48.720] even if I'm right or wrong or just, [01:55:48.720 --> 01:55:58.720] when it, when it comes to filing criminal complaints, prosecutor never wants a criminal complaint from anyone but a police officer, [01:55:58.720 --> 01:56:06.720] because the police officer is a member of the prosecutor team and he can be controlled. [01:56:06.720 --> 01:56:14.720] The last thing he wants is a third party filing criminal complaints and he's going to do everything he can to prevent it. [01:56:14.720 --> 01:56:18.720] Well, our process plays to that. [01:56:18.720 --> 01:56:21.720] That's exactly, that's exactly what I think happened. [01:56:21.720 --> 01:56:28.720] I went in down there with a real detailed account of, but it was just commercial fraud. [01:56:28.720 --> 01:56:33.720] And I went in there with a real detailed account and so I went to the police department and I said, [01:56:33.720 --> 01:56:35.720] what's the procedure for filing and complaining them? [01:56:35.720 --> 01:56:40.720] And they told me, wait, you come, you know, just come on down and so I went down there and I documented everything. [01:56:40.720 --> 01:56:48.720] And when I was interviewed by the officer, instead of taking the complaint to the detective and the crimes, you know, like he should have, [01:56:48.720 --> 01:56:58.720] he just told me to go over to the court and pick up a statement of, I don't remember exactly what it was, [01:56:58.720 --> 01:57:04.720] but a probable cause statement to take the, take it into court as a civil matter. [01:57:04.720 --> 01:57:09.720] And I, and it just finally dawned on me, this is not a civil matter, this is criminal. [01:57:09.720 --> 01:57:15.720] This is the same individual who's, who's facing felony charges in Pennsylvania, [01:57:15.720 --> 01:57:19.720] should be here in New Jersey facing felony charges. [01:57:19.720 --> 01:57:24.720] But like you say, they don't want that, they don't want to take that from a third party. [01:57:24.720 --> 01:57:30.720] And I guess, it didn't dawn on me, it seemed like I was just getting a lot of pushback [01:57:30.720 --> 01:57:35.720] and I couldn't quite get my hands around it, my head around, where was the pushback coming from and why. [01:57:35.720 --> 01:57:41.720] But I think he just pretty much cleared it up. I'm that third party that they don't want to deal with. [01:57:41.720 --> 01:57:46.720] Yeah, and so we have a strategy for that. [01:57:46.720 --> 01:57:56.720] Goes to one of my rules. Never ask a public official to do anything you actually want him to do. [01:57:56.720 --> 01:58:06.720] Because you never ask a public official to do anything that the law does not compel, compel him to do. [01:58:06.720 --> 01:58:16.720] In Texas, the code says that when prosecuting a turn he's made known in any manner that a public official has violated a law relating to this office, [01:58:16.720 --> 01:58:22.720] he shall reduce complaint to an information submitted to the grand jury. [01:58:22.720 --> 01:58:27.720] Does not say made, might, or can if he wants to. It's obligatory. [01:58:27.720 --> 01:58:31.720] It means, in this case, shall, means must. [01:58:31.720 --> 01:58:38.720] So, I take the complaint to the prosecuting attorney and get him to refuse to act on it. [01:58:38.720 --> 01:58:40.720] Okay, that's where...
