[09:40.040 --> 09:45.240] I attached the cover page requesting the foreman to be initial and return in [09:45.240 --> 09:48.760] the self-adjusted envelope that was mailed out the following day the [09:48.760 --> 09:54.000] complaints that were submitted. As of September 13th 2018 I have not received [09:54.000 --> 09:58.680] the request back there for triggering this letter sent to you today. Please respond [09:58.680 --> 10:04.840] as soon as possible by mail or e-mail up so that I can memorialize what has been [10:04.840 --> 10:11.280] taken or if they have been received by the foreman at all. Who is [10:34.520 --> 10:47.960] the custodian of the record for the grand jury? Hmm that is interesting. I wouldn't [10:47.960 --> 10:55.720] think it could be the prosecuting attorney. And if it is the foreman, that's an [10:55.720 --> 11:03.280] issue because the foreman is transitory. He's only there for a term. That could [11:03.280 --> 11:07.600] raise a real interesting question. You'll certainly claim that the foreman is the [11:07.600 --> 11:16.680] custodian of the record for the period of his tenure. And then you get the hold [11:16.680 --> 11:22.600] of foreman responsible for the open records act. And if the prosecuting [11:22.600 --> 11:28.920] attorney gets it and screws it up, then you get to file against the foreman. And [11:28.920 --> 11:37.560] won't that be fun? And that's ultimately where we're going to. The tar baby effect [11:37.560 --> 11:43.640] it gets the foreman into where he has to touch it. And then once he touches it, he's [11:43.640 --> 11:53.000] joined the club of them all there. And I had a prosecutor once, Barry Green, when [11:53.000 --> 11:58.240] I was going to file criminal charges against the grand jury, the foreman of [11:58.240 --> 12:04.200] the grand jury. Oh Mr. Kelton, please don't mess with my grand jury. They're [12:04.200 --> 12:13.760] hard enough to see as it is. And I thought that was very good to hear because [12:13.760 --> 12:20.280] grand jury sit for an extended period. So if you've got some guy that has a [12:20.280 --> 12:27.040] regular job, you can cost him his job forcing him to sit on a grand jury. So [12:27.040 --> 12:32.520] it's difficult to find people who can spend the kind of time that's necessary [12:32.520 --> 12:37.400] to sit on a grand jury in these smaller jurisdictions. They have a six-month term [12:37.400 --> 12:44.200] and they meet generally once a month. So that's not so intrusive. But in Dallas, [12:44.200 --> 12:50.160] Fort Worth, Austin, Houston, they generally sit for three months at a time [12:50.160 --> 12:58.120] and they come in every day or every other day. So if you're putting on a grand [12:58.120 --> 13:06.840] jury, you can't be working somewhere or it'll dramatically impact your work [13:06.840 --> 13:13.400] environment. So it's got to be really hard to see them. And if we start stinging [13:13.400 --> 13:20.200] the grand jury for the shenanigans the prosecutors pulling, they're gonna have [13:20.200 --> 13:26.120] to do something. They're gonna have to make sure we don't have a shot at the [13:26.120 --> 13:32.360] grand jury members themselves. That probably means they're gonna have to [13:32.360 --> 13:39.560] start following the law to the letter. That does kind of put the squeeze on a [13:39.560 --> 13:49.120] real time, it seems like. And okay, have you spoke to the major yet? No, and I wanted [13:49.120 --> 13:54.480] to kind of share this. This is fortunately your friend David, I believe. [13:54.480 --> 14:02.880] Finally gave me the major to just reading his name, or I'll pull it up again. [14:02.880 --> 14:11.240] It's a major area, Casper Company B. And he just happens to be located at 350 [14:11.240 --> 14:20.040] West Interstate 30, Garland, Texas, right down the street from me. So me and Eric [14:20.040 --> 14:26.240] might be on first name basis after a while. And this is good, because the [14:26.240 --> 14:33.840] major is real close to the director. I was just talking to Ken Magnuson and he [14:33.840 --> 14:40.600] was talking about an article he read about Sharon Wilson, the district [14:40.600 --> 14:46.160] attorney for Tarrant County, and how she was secreting criminal complaints [14:46.160 --> 14:57.440] against, I'm sorry, where she directed the Texas Rangers not to investigate [14:57.440 --> 15:08.200] criminal accusations against the jailers in the Tarrant County jail. And Ken [15:08.200 --> 15:17.120] indicated that by law the Rangers had to get authority, get approval from the [15:17.120 --> 15:26.120] prosecuting attorney to investigate. And I said, no, Ken, that is not true. That's [15:26.120 --> 15:34.080] what was in the article, but it was not true by protocol. When the [15:34.080 --> 15:40.520] public integrity unit was moved to the Texas Rangers, the Texas Rangers were [15:40.520 --> 15:46.680] required to set up a protocol, and the protocol they set was for the Texas [15:46.680 --> 15:51.480] Ranger to ask permission from the prosecuting attorney. And that's because [15:51.480 --> 15:58.920] prior to this, a Texas Ranger could only investigate a public official if he had [15:58.920 --> 16:05.040] personal authorization from the director of the Department of Public [16:05.040 --> 16:13.200] Safety himself. So they had this under political control. Well, then the Texas [16:13.200 --> 16:17.200] Rangers were giving the specific authority to do this investigation, so now [16:17.200 --> 16:21.840] they had to scramble to figure out how to way to keep political control. Thus, the [16:21.840 --> 16:25.600] director couldn't do it anymore, so they shifted it to the prosecuting [16:25.600 --> 16:35.040] attorney. The problem, under article 2.03, prosecuting attorney is forbidden to [16:35.040 --> 16:39.440] have anything to do with a complaint against a public official. So their [16:39.440 --> 16:43.200] protocol amounts to criminal conspiracy to commit, and we're planning on setting [16:43.200 --> 16:47.840] up the major for just exactly that. Hang on. Although it is [20:45.840 --> 20:52.080] our only way to throw him under the bus, technically that's not what I want to do. [20:52.080 --> 20:57.920] I want to, now that we're setting up the district attorney because he's [20:57.920 --> 21:02.960] secreting these complaints from the foreman of the grand jury and just like [21:02.960 --> 21:07.400] you were talking about previous to the break how the Rangers thought we had to [21:07.400 --> 21:12.560] get permission from the district attorney. Now we're creating a third degree of [21:12.560 --> 21:18.920] separation because when we have the DA shielding these complaints from the [21:18.920 --> 21:25.720] foreman of the grand jury, now how can you invoke the district attorney to tell [21:25.720 --> 21:34.520] the ranger what to do when the DA is doing all this criminal act? This is kind of [21:34.520 --> 21:39.640] how we've been setting that up. We get the district attorney to do these [21:39.640 --> 21:45.880] criminal acts, then we we don't give anything to the grand jury, to the Texas [21:45.880 --> 21:53.040] ranger until we have the prosecuting attorney implicated. So we give complaints [21:53.040 --> 21:57.840] to the Texas ranger and they include criminal complaints against the district [21:57.840 --> 22:05.640] attorney. So now he puts the ranger in a spot. Do you go to the district attorney [22:05.640 --> 22:09.720] and ask the district attorney for permission to investigate criminal [22:09.720 --> 22:17.280] accusations against the district attorney? How does that work Bubba? That's what I'm [22:17.280 --> 22:23.280] talking about. Now we can set the Rangers up so they're strictly autonomous, have [22:23.280 --> 22:29.240] that third degree of separation because they have to investigate and they can't [22:29.240 --> 22:33.800] rely on the DA because he's already implicated in a criminal conspiracy. [22:33.800 --> 22:41.440] What I'm really trying to do in that process is put the Rangers in a [22:41.440 --> 22:47.200] position to where they're going to have to strenuously object against [22:47.200 --> 22:52.960] prosecutor involvement in any situation. In Wise County I gave the complaints to [22:52.960 --> 22:59.680] the Texas ranger. He took them to the district attorney. The district attorney [22:59.680 --> 23:06.160] said I'm not having anything to do with those, but I charged the Texas ranger [23:06.160 --> 23:11.880] with criminal conspiracy for taking it to the prosecuting attorney. I didn't charge [23:11.880 --> 23:17.160] prosecutor with anything because he wouldn't touch them and that's because I [23:17.160 --> 23:24.320] knew him and I already gave him fair warning. Touch those, you jump in, you [23:24.320 --> 23:30.320] jump under the bus with the ranger. So he didn't touch them and then the ranger [23:30.320 --> 23:34.040] didn't give them to the grand jury so I made criminal charges against [23:34.040 --> 23:42.240] the ranger and the director. Next time I'll include the captain and the major. [23:42.240 --> 23:48.400] But now we can take the complaints directly to the major and the [23:48.400 --> 23:56.400] major is going to be a lot more political than just a standard ranger. [23:56.400 --> 24:02.720] So the way you did it, I'm doing it the opposite way. So let's try something [24:02.720 --> 24:08.280] different and see what kind of results we get. [24:08.280 --> 24:15.000] Go ahead. Longest we get the rangers stirred up, we want them in a position [24:15.000 --> 24:20.000] to where they've got guys like us filing criminal charges against them for [24:20.000 --> 24:27.120] following protocol. Go ahead, follow your policy, Bubba. We see how that works for [24:27.120 --> 24:37.360] you. So we get the rangers to push to get autonomy. We shouldn't have much blow [24:37.360 --> 24:43.320] back from the rangers because we'll be telling the rangers you should not have [24:43.320 --> 24:48.600] to go suck up to this prosecuting attorney. You should have autonomy in [24:48.600 --> 24:54.640] these matters and our efforts here are to get you that autonomy. The way to do it [24:54.640 --> 25:02.000] is to demonstrate the problem with the protocol. There you go. The protocol [25:02.000 --> 25:10.480] should be, if you have reason to believe, investigate. Well, that's the way I'm [25:10.480 --> 25:15.320] trying to go on edit like this because now the DA is already thrown under the [25:15.320 --> 25:19.800] bus. It's pretty well going to be confirmed here in about a week or so. [25:19.800 --> 25:25.240] And then when I go to the rangers, I'm going to say, look, I don't want to have [25:25.240 --> 25:29.880] to throw you under the bus, but are you going to, are you going to jeopardize [25:29.880 --> 25:37.200] your career over this DA that doesn't give a rest? But I'm not into that, do you? [25:37.560 --> 25:43.520] Let him think about that. Yeah, so we don't come out the bad guy to the [25:43.520 --> 25:51.400] ranger. And in that way, we may get the rangers to look at this, especially now [25:51.400 --> 25:55.800] we're talking to the major. We get him to look at it and he'll have the year of [25:55.800 --> 26:06.800] the director. And if he sees political cannon fodder coming at them, because [26:06.800 --> 26:15.320] you and David and Tyler and we have someone in, I forgive his name at the [26:15.320 --> 26:21.600] moment, a Rick in south of Austin, me, and we'll try to get some other people [26:21.600 --> 26:27.360] filing criminal charges against rangers. They're going to look at the likelihood [26:27.360 --> 26:35.520] that this is going to add up on them. And I don't see Brett on the board. He's [26:35.520 --> 26:41.320] likely to be another one that'll be filing with the rangers as well. We start [26:41.320 --> 26:45.800] stacking these up. They're going to have to do something about it. Brett has got [26:45.800 --> 26:52.640] some, he's got a really apparently stupid judge. He filed criminal charges [26:52.640 --> 26:58.800] against the judge and the judge sent the security, sent the bailiff out of the [26:58.800 --> 27:05.200] room and then threatened Brett for filing the criminal complaint against [27:05.200 --> 27:18.000] himself. When he didn't count on was Brett was recording. So now this judge [27:18.000 --> 27:22.560] could be in big-time hot water and this is what we need. I think maybe some of the stuff that I said to the last judge [29:12.000 --> 29:18.840] I was in front of, he probably took some of the stuff I had to hunger because we [29:18.840 --> 29:24.600] had a really interesting conversation after he found me guilty. I was like wow that's [35:11.800 --> 35:20.880] good. This is I've had a couple of experiences like that and it led me to [35:20.880 --> 35:28.000] realize that there's no bad guys here. I mean there's a few really arrogant guys [35:28.000 --> 35:35.080] but most of these people are in circumstances they didn't create and the [35:35.080 --> 35:39.760] guys who are stuck in the middle of the system are not in a position to fix it [35:39.760 --> 35:45.920] and he was exactly right it's going to take someone outside the system someone [35:45.920 --> 35:54.080] like you you came in there and they could not control you they couldn't make [35:54.080 --> 35:59.920] things work the way they wanted them to work because you were just not compliant [35:59.920 --> 36:06.200] and you demonstrated the problems with the system in a way that everybody would [36:06.200 --> 36:10.520] have to pay attention to them if we're going to change things this is how we're [36:10.520 --> 36:17.520] going to do it and I can almost guarantee you you were not the only one this [36:17.520 --> 36:24.640] judge talked to about you. I can almost assure you he's talked to other judges [36:24.640 --> 36:30.760] about this this is a he's not the only judges that have a problem with the fact [36:30.760 --> 36:37.120] that the system is messed up. I had a prosecuting attorney once that I was in [36:37.120 --> 36:42.040] his office crawling down his throat he was a county attorney in Wise County and [36:42.040 --> 36:47.480] he said one moment Mr. Kelton he got up walked around the desk closed the door [36:47.480 --> 36:56.400] came back sat down he said if you repeat this I'll deny it but don't stop. He said [36:56.400 --> 37:01.320] I was a prosecutor for Tarrant County for five years and I reached the point [37:01.320 --> 37:08.520] that I just couldn't do it anymore. If anybody's going to fix the system it's [37:08.520 --> 37:13.560] going to be you or someone like you so don't stop. He got up went and opened the [37:13.560 --> 37:21.360] door came back sat down started arguing with me again. So when I do cases, when I write the first pleading, I'm writing [49:17.160 --> 49:25.680] the first pleading thinking how will this add to my appellate brief. I try to [49:25.680 --> 49:30.560] write the pleading so that I can take portions of this pleading and then [49:30.560 --> 49:35.840] upgrade them into an appellate brief. And one of the steps is you do the [49:35.840 --> 49:43.600] pleading first. Then you do you get ruled against and you do a motion for [49:43.600 --> 49:48.600] reconsideration. That's a request for a new trial. And in the request for a new [49:48.600 --> 49:53.880] trial you have to tell the judge what you think the judge did wrong. And that [49:53.880 --> 49:59.320] doesn't have to be as complete and detailed with points and authorities as [49:59.320 --> 50:07.280] a brief does. But it should be written in the form of a brief. Just not as [50:07.280 --> 50:13.240] detailed. So I file that and that step gets me half of my brief completed [50:13.240 --> 50:19.920] already. So then when he denies that, then I take that document and upgrade it [50:19.920 --> 50:27.440] into a brief. It makes the whole procedure a lot less complicated. So I'll [50:27.440 --> 50:33.560] have to have one of those next week for a case. But that's about it. Everything [50:33.560 --> 50:40.520] else I'm about caught up on. So tell me Monday and I will get to that. I will do [50:40.520 --> 50:44.000] that. I've had a week of hell because my brother passed away on Monday and I'm [50:44.000 --> 50:48.880] still kind of shell-shocked and numb. Trying to figure out everything to do [50:48.880 --> 50:54.120] with this case and at the same time write a eulogy and I can't go to the funeral [50:54.120 --> 51:00.840] because it seems Tasmania. It's really sad to hear that. My daughter just [51:00.840 --> 51:08.080] lost her father-in-law last week too. He was a great guy. He was out riding his [51:08.080 --> 51:13.200] motorcycle, came in, sat out on the couch and died. [51:13.200 --> 51:20.880] My brother went into ICU and the next morning was gone. Okay, thank you. But [51:20.880 --> 51:27.600] anyway, I wanted to share with you something I got today. I had filed an [51:27.600 --> 51:32.680] appeal on my case with the California Supreme Court because the lower court [51:32.680 --> 51:40.080] ignored completely the fact that the banks had violated every aspect of the [51:40.080 --> 51:47.200] homeowners bill of rights and some other things. And so I filed for an appeal, the [51:47.200 --> 51:51.040] appeal just with everything filed by Reggie Ducata and they used some false [51:51.040 --> 51:58.880] statements. And so I filed an appeal and then they sent the other side a copy of [51:58.880 --> 52:03.160] the order but they never sent me the plaintiff one. So I thought, you know, I'm [52:03.160 --> 52:07.560] just going to remind them that they need to do this because it's not available on [52:07.560 --> 52:12.200] the website either. And then I asked them for a finding of facts and conclusion [52:12.200 --> 52:17.120] of law which led to the denial. I knew I wasn't going to get it but I wanted to [52:17.120 --> 52:22.720] get something in writing from them. And they said, in response to your questions [52:22.720 --> 52:28.200] concerning your case in the court's conference when it was denied, the reasons [52:28.200 --> 52:33.120] are confidential. The court does not state reasons for the denial of [52:33.120 --> 52:39.040] petitions brought before it. California law restricts the giving of reasons in [52:39.040 --> 52:46.120] written opinion to the disposition of causes. An order summarily denying a [52:46.120 --> 52:51.320] petition does not determine a cause. A case does not become a cause in the [52:51.320 --> 52:56.880] Supreme Court unless we grant review or issue an order to show cause. For this [52:56.880 --> 53:02.520] reason, the court's conferences are not recorded or transcribed and the court [53:02.520 --> 53:06.600] does not write opinions or otherwise give reasons for its decisions in these [53:06.600 --> 53:12.480] matters. The orders filed after the conference are the only public record [53:12.480 --> 53:18.120] available. Rest assured, however, that the petition and the contention made [53:18.120 --> 53:23.680] therein were considered by the entire court and the denial expresses the [53:23.680 --> 53:28.720] decision of the court on the matter. I regret you did not receive a copy of the [53:28.720 --> 53:33.680] denial order and that we cannot be a further assistant. But please find attached [53:33.680 --> 53:42.720] a copy of the July order denying the petition for review. Well, looks like [53:42.720 --> 53:53.080] it's time to file a federal claim. Well, I think we're about to do that. And is [53:53.080 --> 53:58.400] there anything I can do to go after these people for not applying the facts of [53:58.400 --> 54:08.560] the law to the law to every fact of the case? Well, we have case law in Texas. We [54:08.560 --> 54:13.800] should have similar case law in California. We have Jocelyn v. Chambers in [54:13.800 --> 54:23.920] Texas that states that a judge has no discretion in a properly applying the [54:23.920 --> 54:30.040] law to the facts of failure to do so is a denial of due process. If it is a denial [54:30.040 --> 54:36.600] of due process in Texas, it is a denial of due process everywhere. So you should [54:36.600 --> 54:44.400] be able to take Jocelyn v. Chambers and do a search for Jocelyn v. Chambers [54:44.400 --> 54:50.160] Texas, Space, California. Yeah. See if you can find a California case that [54:50.160 --> 54:55.240] references Jocelyn v. Chambers, and that should get you to cases of this type in [54:55.240 --> 55:05.560] California. And if you can show that the judge wants to have that case law, it'll [55:05.560 --> 55:09.360] be very beneficial, but you probably don't need it because you can get there [55:09.360 --> 55:18.880] from the Fed. Now you take the state of California and the foreclosing the [55:18.880 --> 55:27.640] plaintiffs to the federal court for denial of procedural due process. Okay. [55:27.640 --> 55:32.920] Even though they originally in federal court said everything's bought by [55:32.920 --> 55:37.280] Residue Dakota, and even though the Supreme Court says no, no, no, no, no. Wait, [55:37.280 --> 55:44.600] wait, hold on. You're in state court. You can't be in state court based on [55:44.600 --> 55:50.400] anything that's Residue Dakota. If they're stating something's Residue Dakota, [55:50.400 --> 55:57.120] you didn't make the right claim. [01:06:24.280 --> 01:06:29.080] Asking the judge if he's not going to harm you, if the judge has got any sense, he's [01:06:29.080 --> 01:06:33.200] going to say, not my place to harm or not harm. [01:06:33.200 --> 01:06:39.120] If you're harmed by the law, then I can't help that, so the judge couldn't rightfully [01:06:39.120 --> 01:06:42.000] say I won't harm you. [01:07:09.720 --> 01:07:17.360] When Scott first started out, he was using a lot of the Patriot stuff he had heard on [01:07:17.360 --> 01:07:27.360] different shows and that and in the process of using them, he found they just didn't work [01:07:27.360 --> 01:07:28.360] out. [01:07:28.360 --> 01:07:33.160] It got the courts to come after him worse and do dumber stuff to him. [01:07:33.160 --> 01:07:38.360] But Scott was tenacious and when they did dumb stuff, he came back after him. [01:07:38.360 --> 01:07:46.440] And finally, he figured it out, he began to see how they dealt with him different. [01:07:46.440 --> 01:07:54.880] When he came to the court on point of law, point of code and statute, their code, their [01:07:54.880 --> 01:07:55.880] statute. [01:07:55.880 --> 01:08:03.480] And that's when he saw them getting nervous, instead of them getting angry and aggressive. [01:08:03.480 --> 01:08:05.800] All of a sudden, they started getting nervous. [01:08:05.800 --> 01:08:10.320] When they started getting nervous, he stopped getting nervous. [01:08:10.320 --> 01:08:16.840] And when he, you know, I went to court with him and he was in a T-shirt and jeans. [01:08:16.840 --> 01:08:20.760] And I really dressed him down about that. [01:08:20.760 --> 01:08:26.080] And finally, he started coming in a suit and tie and he recognized the difference. [01:08:26.080 --> 01:08:29.360] A suit and tie shouldn't make a difference. [01:08:29.360 --> 01:08:34.880] I mean, in a perfect world, it wouldn't. [01:08:34.880 --> 01:08:40.280] Presentation shouldn't make a difference, but it does. [01:08:40.280 --> 01:08:42.960] Posture and demeanor shouldn't make a difference. [01:08:42.960 --> 01:08:48.920] The law should be the only thing that matters, but this is not a perfect world. [01:09:12.280 --> 01:09:18.160] I start having big stacks of criminal complaints to file against them, and I don't like that. [01:09:18.160 --> 01:09:20.320] It confuses the issue. [01:09:20.320 --> 01:09:31.520] So I want to be able to state precisely why I do each thing that I do and how the way [01:09:31.520 --> 01:09:37.040] the other side responds will affect the adjudication of my case. Basically, when I sent it to him, he got back to me six days later, but I cc'd it to the mayor and to the mayor pro tem. [01:48:08.820 --> 01:48:17.820] And it was a very civil letter and explained everything and that I was trying to comply with these people across the board with everything. [01:48:17.820 --> 01:48:22.820] And no one ever got back to me except for code enforcement. [01:48:22.820 --> 01:48:26.820] He's the one that said to ask for the hearing. [01:48:26.820 --> 01:48:32.820] So that's basically the only option they gave me was to ask for a hearing. [01:48:32.820 --> 01:48:41.820] And I have proof that every time that I tried that code enforcement has ever done anything with me that we've always tried to comply with them. [01:50:29.820 --> 01:50:36.820] So now we have a permanent injunction against us with an $80,000 judgment. [01:50:36.820 --> 01:50:40.820] Okay, so we need to take this to the federal court. [01:50:40.820 --> 01:50:51.820] Well, I just hope we don't have to sit any time and, you know, anyway, you understand what I'm getting at. [01:56:15.820 --> 01:56:19.820] So, you always have the upper hand when you're the plaintiff.
