[01:22.960 --> 01:29.880] The U.S. District Court Judge Gloria Nambaro dismissed cases against Nevada Rancher Clive [01:29.880 --> 01:34.920] and Bundy, two sons and a Montana militiaman today. Judge ruled that the government's lawyers [01:34.920 --> 01:40.120] suppressed footage from several cameras that were set up by the FBI around the Bundy's [01:40.120 --> 01:44.160] family home that would have been favorable in the defendant's case. When Mr. Bundy was [01:44.160 --> 01:48.520] released today Monday after leaving the courthouse, he told reporters that I've been a political [01:48.520 --> 01:53.320] prisoner for 700 days. He hadn't seen his wife for nearly two years due to the fact [01:53.320 --> 01:57.440] that he had refused any conditional release, which required him to forfeit his trial by [01:57.440 --> 02:01.160] jury rights. [02:01.160 --> 02:05.500] Former Google engineer James D'Amour filed a class action lawsuit against the Alphabet [02:05.500 --> 02:10.240] Corporation on Monday, claiming that it discriminates against white men and those with conservative [02:10.240 --> 02:14.840] leaning views. D'Amour was terminated for dismantling a memo, essentially questioning [02:14.840 --> 02:19.560] the company's diversity policies. The suit is basically arguing that Google employees [02:19.560 --> 02:24.280] who express views deviating from corporate sentiments on politics and practices like [02:24.280 --> 02:31.080] diversity hiring policies by a sensitivity and social justice were singled out, mistreated, [02:31.080 --> 02:35.520] and systematically punished and terminated from Google. Google spokesman Tasha Pard said [02:35.520 --> 03:03.520] in response that we look forward to defending against Mr. D'Amour's lawsuit in court. We are live tonight and we will be live from now on unless [04:05.440 --> 04:10.720] problems arise. But for those of you that have been wondering where I've went and why I've gone, [04:10.720 --> 04:18.480] let me try to enlighten you here just a little bit. Now, I recently assisted a friend of mine [04:18.480 --> 04:24.320] with a hearing at the State Office of Administrative Hearings which is a complete [04:24.320 --> 04:36.720] non-judicial body of any kind. It is entirely administrative. And as far as the actual statutory [04:36.720 --> 04:47.920] side of things, I kicked their butt and they know it. But the administrative law judge chose to ignore [04:47.920 --> 04:55.760] the law to come to the conclusion that he had jurisdiction to proceed in a matter where he [04:55.760 --> 05:07.280] clearly has none. Now, this has to do with an irrigation issue where my friend has been in [05:07.280 --> 05:13.680] this business longer than they've even required licensing for it. He does not and will not get [05:13.680 --> 05:20.640] a state license if at all possible for himself. And he's not required to have one for himself. [05:21.440 --> 05:29.360] Never has had to have one himself. Yet the entire premise of the case that these people are trying [05:29.360 --> 05:36.880] to go after him for is that he does not personally possess an irrigator's license. And the statute [05:36.880 --> 05:44.640] says very clearly he is not required to. Now, the second part of that issue is that the statute says [05:44.640 --> 05:52.800] that the executive director, which we will call ED from here on out through this, the ED only has [05:52.800 --> 06:02.960] the authority to initiate an action administratively by the formulation of a report and notice to [06:02.960 --> 06:16.560] whoever it is they're going after if that person is either licensed or permitted by the TCEQ, [06:17.280 --> 06:23.360] which is the Texas Committee on Environmental Quality. Now, that is written right into the [06:23.360 --> 06:31.040] statutes, which this administrative law jerk, I mean judge, completely ignored. It was in my [06:31.040 --> 06:36.000] arguments from the work from the first sentence on and he's completely ignored it. In fact, [06:36.000 --> 06:40.320] when he made his findings of facts and conclusions of law at the end of this, [06:41.760 --> 06:48.480] he specifically stated the same thing I had stated, which is the court, quote unquote, [06:48.480 --> 06:55.040] is required to take these statutes in paramaterial, which means that you have to take [06:55.040 --> 06:59.920] all of the relevant statutes and read them together. He wrote exactly the same thing in [06:59.920 --> 07:06.480] his findings of facts and conclusions of law, except he did not take all of the statutes [07:06.480 --> 07:12.960] and read them together. He specifically excluded any reference in his findings of facts and [07:12.960 --> 07:20.960] conclusions of law to the three specific statutes that showed they don't have any jurisdiction [07:20.960 --> 07:27.680] whatsoever over this individual. Now, the other problem they have with what they were doing [07:27.680 --> 07:34.400] is they are not going after a business entity, which is the only administrative authority they [07:34.400 --> 07:46.800] have. They are targeting an individual man, not his business, but the man and he is outside of [07:46.800 --> 07:53.120] their administrative authority in that regard, especially considering he is not one of their [07:53.120 --> 08:03.600] license or permit holders. Now, the problem they are going to run into with, I got a notice here [08:03.600 --> 08:10.400] just a few days ago in email of all places, asking me if I would provide a statement to [08:10.400 --> 08:16.480] the State Bar Association because now they want to come after me for unauthorized practice of law [08:16.480 --> 08:23.680] for assisting my friend with this administrative hearing. Now, I told the administrative law judge [08:23.680 --> 08:28.480] that I work with him in this business, so I have an interest in the business just like he does. [08:29.600 --> 08:34.720] And the fact that they are trying to act like they are targeting the business while they are [08:34.720 --> 08:42.400] specifically naming the individual and not the business should not be allowed to deprive me [08:42.400 --> 08:49.120] of my ability to defend my interest in that business because if that business isn't operating, [08:49.120 --> 08:57.040] I don't get paid for digging holes. Simple enough, right? Now, and yes, I do do this. [08:57.920 --> 09:01.680] I mean, I got to get money somewhere, right? But the fact of the matter is [09:01.680 --> 09:13.680] the administrative law judge and the attorneys that were present all agreed after asking my friend [09:13.680 --> 09:21.200] if it was all right with him, if I spoke on his behalf. And he said, yes, giving me at that point [09:21.200 --> 09:30.720] verbal power of attorney to deal with this matter in his stead. And they said, okay, no problem. [09:33.120 --> 09:38.000] Now, right there, State Bar is going to have a really big issue to continue with. [09:39.120 --> 09:44.080] If I was actually doing something wrong, the administrative law judge and the other attorneys [09:44.080 --> 09:51.280] present had a legal duty to not allow it to happen. And they did not. They, in fact, [09:51.280 --> 09:56.240] sought permission from the individual which he gave. And then they said, okay, no problem. [09:56.880 --> 10:04.240] And we proceeded. So right there, there's an issue. However, none of that is the real reason [10:04.240 --> 10:13.920] I want to bring this up. This is what I want to bring up. I am being sought after for providing [10:13.920 --> 10:22.480] a assistance to people to get themselves out of a situation that an attorney would be [10:22.480 --> 10:28.720] of absolute useless in because they won't do their fricking job. Now, understand this, [10:29.280 --> 10:35.440] the whole premise of the Bar Association's tactics is the layman may not know enough or [10:35.440 --> 10:44.400] can't possibly know enough to do the job as well as we do it correctly and do it correctly. [10:44.400 --> 10:48.480] But we know that's a lie, don't we, folks? Because any of you that have had to deal [10:48.480 --> 10:53.680] with these attorneys knows for a fact this attorney's one purpose is to steal your money [10:53.680 --> 10:59.200] and then get themselves excused from the case. And even if they stay on the case, [10:59.200 --> 11:06.480] they refuse to do their job by presenting the proper arguments that show there's no case here [11:06.480 --> 11:14.560] to begin with. Instead, they work against you, their client, to get you to cut a deal. [11:16.560 --> 11:24.560] So everybody gets your money and the only victim out of all this is you while they all profit from [11:24.560 --> 11:31.360] it. Now, these are the people that are trying to say that I can't do the job as well as they can. [11:32.560 --> 11:39.440] And so I, not being one of them, can't possibly provide any assistance or information to other [11:39.440 --> 11:46.320] people and it be correct. So here is what I would like to put out there for you this evening. [11:48.000 --> 11:53.280] There are many of you that listen to this show that listen to it specifically because [11:53.280 --> 12:00.960] the information I provide to you is verifiably true and accurate. Whether it be about the law, [12:00.960 --> 12:04.800] whether it be about the process, whether it be about the rules of that process, [12:05.760 --> 12:13.840] it's verifiably true and accurate. I have never, never to my recollection, [12:14.320 --> 12:19.680] attempted to talk out of my butt on this show about what the facts are when it comes to these, [12:19.680 --> 12:26.080] to the statutes and the situations and the things that are. Now, I may not know the exact process [12:26.080 --> 12:31.280] for every single thing anybody's ever called into the show and asked me about. And I'll tell you [12:31.280 --> 12:37.280] right up front that I don't know every aspect of law. But then again, neither does a bar attorney. [12:37.280 --> 12:42.320] That's why there are specialists in this area of law, in that area of law. And just like doctors, [12:42.320 --> 12:48.480] they don't cross over into areas that they don't practice in daily unless they're a general practitioner. [12:48.480 --> 12:55.280] But then they will never be doing the more serious things most of the time. They will [12:55.280 --> 13:00.720] be doing what's necessary to set that up for someone else to handle the grunt work, so to speak. [13:01.440 --> 13:07.120] Are they, I'm sorry, the in court part of it or the in operating theater part of it. [13:07.840 --> 13:13.120] But the point here being is that they're trying to promote themselves as being the only people [13:13.120 --> 13:22.800] capable of doing this thing that they do. Now, we know from experience that that's just simply [13:22.800 --> 13:29.280] not the case. In the cases where I have helped others and some of those cases have been for [13:29.280 --> 13:38.560] some very serious offenses, the attorneys that actually were there before me tried to throw [13:38.560 --> 13:44.800] the person under the bus. And these are some very big name attorneys in some cases. [13:46.080 --> 13:51.440] Hell, in one of these cases, you've seen the attorney that dumped the individual. [13:52.400 --> 13:57.920] You've seen him on TV. You've seen him on Alex Jones. You've seen him making a big deal about [13:57.920 --> 14:05.920] how good he is. And he still dumped the man rather than make the arguments that were necessary to [14:05.920 --> 14:19.440] defend him and get the charges against him dismissed. So I helped out. Not only did we get [14:20.000 --> 14:25.040] the charges against him dropped, we got them dropped with prejudice. [14:27.040 --> 14:31.200] I made the arguments on behalf of this gentleman in his legal pleadings [14:31.200 --> 14:40.160] that the attorney would not make, knowing that they were right, but would not make them for the [14:40.160 --> 14:49.920] benefit of his client because the judge or judges in this case might not like what he had to do to [14:49.920 --> 14:57.040] get his client vindicated and thus punish his future clients if he ever had to appear in their court. [14:57.040 --> 15:03.760] Now, I want to ask you people, what kind of justice do you think you're going to get in a courtroom [15:03.760 --> 15:12.320] where your attorney is playing footsies with the judge to kiss their butt for somebody in the [15:12.320 --> 15:23.040] future's benefit by throwing you under the bus today? How are you getting fair and equal treatment? [15:23.040 --> 15:29.840] How is that something that makes the Bar Association and its members more capable than [15:29.840 --> 15:39.280] someone like me? What makes them more justified in taking money from people's pockets than for [15:39.280 --> 15:48.160] someone like me to simply help people as much as I can? The whole premise of this show was to bring [15:48.160 --> 15:56.160] to light the sordid underbelly of this system that we have to live in for the moment. [15:58.160 --> 16:05.200] And I want to tell you that that underbelly, when you get through that and into the meat of it, [16:05.200 --> 16:11.520] the meat of the snake is the attorneys. The meat of the snake is the Bar Association's, [16:11.520 --> 16:21.920] both state and national. Nowhere in any legislation that has ever been enacted at any level of [16:21.920 --> 16:30.240] government was an entire branch of the people's republican form of government supposed to be [16:30.240 --> 16:41.760] turned over to an elitist class of persons and their absolute and total control. But that, [16:41.760 --> 16:46.640] ladies and gentlemen, is what has happened to the entire judicial branch of government in every [16:46.640 --> 16:52.080] state of the union. Now, the email that I got said that they wanted to give me an [20:28.000 --> 20:34.160] opportunity to make a statement about my legal blogging, my radio show and all this stuff. [20:34.160 --> 20:38.600] What this really was was an attempt to get me to say or do something that they could [20:38.600 --> 20:45.760] potentially misconstrue and then attempt to use that against me to silence me and take [20:45.760 --> 20:50.220] me off the air or prevent me from writing or any of that stuff. Of course, there are [20:50.220 --> 20:56.320] numerous constitutional issues with that effort. There are numerous religious freedom of association [20:56.320 --> 21:02.240] and many other issues with that attempt if they pursue it. Now, that being said, understand that I absolutely despise attorneys. And I have [21:18.920 --> 21:26.600] good reason to. I have never met an honest one yet. Never. Okay? Now, I'm not saying [21:26.600 --> 21:32.160] there aren't any. I'm just saying that out of the hundreds I've met, I've never met [21:32.160 --> 21:41.240] one. It's just that simple fact. And it's just like the premise of good cop, bad cop. [21:41.240 --> 21:50.480] It is impossible to say that you are a good attorney when what you do is work around the [21:50.480 --> 21:58.920] evils of the system no matter how adversely it affects those that paid you to protect [21:58.920 --> 22:08.120] their interest so that you can protect your own instead of theirs by either cutting deals [22:08.120 --> 22:16.120] or pleasing the judge instead of doing your job. So when you say that you're an honest [22:16.120 --> 22:25.320] and forthright attorney, I'm going to say show me the date on your headstone because [22:25.320 --> 22:36.560] they're the only ones I know because you can't be a living attorney and be honest and straightforward. [22:36.560 --> 22:43.160] Not in the system we have. It is absolutely impossible. It is exactly the reason why those [22:43.160 --> 22:52.160] that have attempted to maintain that relevance to their principles are no longer allowed [22:52.160 --> 23:02.920] to be members of the bar and find themselves disbarred. That's just all there is to it. [23:02.920 --> 23:09.640] Now once again, you can even be so corrupt that they'll disbar you, but you can also [23:09.640 --> 23:18.240] be so honest that they'll disbar you. How's that for a screwed up way of running things? [23:18.240 --> 23:30.200] Okay? Now what I may have to do before this is all said and done is I may have to find [23:30.200 --> 23:36.080] a whole list of testimonials and things of that nature and people to testify to them [23:36.080 --> 23:43.480] should things get that far down the line about how my assistance has helped them where an [23:43.480 --> 23:48.840] attorney would not. If the attorneys want to argue that a layman can't do the job as [23:48.840 --> 23:54.800] well as they have, well then let's put that to the test, shall we? Let's see how many [23:54.800 --> 24:04.320] of the people that I've helped beat these bogus charges went to an actual attorney first. [24:04.320 --> 24:07.960] Then let them get up there and talk about how the attorney took their money and then [24:07.960 --> 24:14.520] immediately demanded that they be excused from the case without providing a single service [24:14.520 --> 24:24.200] to the client. Thus forcing the client to then become either pro se or to have to seek [24:24.200 --> 24:31.880] other counsel that is going to do the exact same thing to them or wind up with a public [24:31.880 --> 24:42.400] defender who is even more incompetent and even more willing to sell you out because he's [24:42.400 --> 24:52.960] not getting paid enough to work for you. Now a while back several years ago in fact I wrote [24:52.960 --> 25:00.560] a legal white paper on the state bar act here in Texas. I have all the official documents, [25:00.560 --> 25:08.160] I have the official roll call, I have the official vote roll, I have every record that is necessary [25:08.160 --> 25:17.520] from 1939 to show the occupation of every legislative member, the actual bill that was put before [25:17.520 --> 25:24.640] them and the votes each one of them cast in support of that bill that was put into play [25:24.640 --> 25:33.560] in 1939 as the state bar act. The state bar act was absolutely unconstitutional on its [25:33.560 --> 25:47.560] face because it granted a private occupation, a monopoly that the Constitution forbids. [25:47.560 --> 25:52.840] And those that were sitting in the legislature that would benefit from the passing of this [25:52.840 --> 26:04.200] bill were constitutionally required to recuse themselves from voting and they did not. Not [26:04.200 --> 26:17.320] a single attorney in either house of the legislature recused themselves from the vote on this bill. [26:17.320 --> 26:23.720] And out of all the people that voted I don't think a single one of the attorneys voted against [26:23.720 --> 26:31.880] it. Now that alone makes the bill unconstitutional. The fact that it grants an unconstitutional [26:31.880 --> 26:40.960] monopoly makes it unconstitutional. The fact that it created the state bar as a governmental [26:40.960 --> 26:51.680] entity, not a private entity, but a governmental entity is unconstitutional. Why? Because it [26:51.680 --> 27:03.000] allowed those in a private occupation to use the power of government to create a racketeering [27:03.000 --> 27:13.760] scheme and monopoly of the practice of law. Think about that. Every person with a bar [27:13.760 --> 27:19.920] card according to the state bar act is a judicial officer. Now the courts have tried to tell [27:19.920 --> 27:26.480] us for decades that attorneys are not judicial officers. That's been a blatant lie from day [27:26.480 --> 27:35.200] to day. A completely blatant lie. Not only are they officers of the court, they are government [27:35.200 --> 27:44.960] employees. Now think about that for a minute. An attorney practices a private occupation [27:44.960 --> 27:56.360] because of a monopoly privilege granted to him by the government which he also occupies [27:56.360 --> 28:08.160] via that occupation. So what this means long term is that the people of Texas have been [28:08.160 --> 28:17.240] totally disenfranchised of an entire department of their own government. Because think about [28:17.240 --> 28:30.720] this from a very logical standpoint. They amended the Constitution in 1984 to add the [28:30.720 --> 28:42.560] requirement that judges have to be licensed to practice law. You get that? Judges and [28:42.560 --> 28:47.840] prosecutors and attorneys in general have to be licensed to practice law and they put [28:47.840 --> 28:54.520] that into the Constitution under the section on the judicial department of government. [28:54.520 --> 29:04.320] So if you are not a state bar member, you cannot occupy any court of record as the judge [29:04.320 --> 29:12.920] which means you cannot participate in any meaningful way in that department as a judge. [29:12.920 --> 29:17.760] Now when it comes to being a prosecutor, same problem. You have to be licensed by the state [29:17.760 --> 29:24.080] bar which itself is an administrative office of the judicial department of government according [29:24.080 --> 29:34.160] to the state bar act. So you can't serve in the judicial department of government as [29:34.160 --> 29:41.480] a prosecutor because you are not a bar member. [34:47.920 --> 34:54.280] Now, the bar is not going to like that. In fact, they're going to say that it reinforces [34:54.280 --> 35:00.240] their case, but it doesn't because once again, the issue here always boils down to bluff [35:00.240 --> 35:07.240] versus fact. The fact is, is the law does not give them a way to come at me at all, [35:10.000 --> 35:15.680] but that doesn't mean they're not going to try to make one up. After all, we're talking [35:15.680 --> 35:22.320] about bar members and bar judges here. They work together to protect their personal interest [35:22.320 --> 35:27.320] over that of the people. Always have, always will. [35:27.320 --> 35:34.320] Now, the utter hypocrisy of the bar, I find galling. Now, let's look at some common sense [35:37.280 --> 35:44.280] logic here about how things work. First off, you have the concept of ignorance of the law [35:45.040 --> 35:50.320] is no excuse. You'll hear it from judges, you'll hear it from prosecutors. They'll tell [35:50.320 --> 35:56.000] you this all day long. You can't claim ignorance of the law as a defense. You can't claim [35:56.000 --> 36:00.440] ignorance of the law as a defense. Yet attorneys, they're completely fricking ignorant of the [36:00.440 --> 36:07.440] law. They never read the law and they don't care that they haven't read the law. They'll [36:09.320 --> 36:15.800] still argue with you about what it is or what it does, even though they've never read it. [36:15.800 --> 36:22.800] They will give out bad information about a law all day long. And guess what? They suffer [36:24.800 --> 36:31.800] no consequences for their misleading of the public or their client. Because the only way [36:34.240 --> 36:41.240] that happens is through bar grievances or malpractice suits, which most of the time, [36:41.240 --> 36:47.240] the bar grievances are thrown in the trash by the bar committee because it is controlled [36:47.240 --> 36:54.240] by the bar. Who will never openly admit that we get more complaints against our members [36:55.240 --> 37:02.240] than any private person doing the same job? They'll never admit that, even though odds [37:04.240 --> 37:09.240] are that if you could actually get the real statistics and facts about it, it would prove [37:09.240 --> 37:16.240] to be true. Okay? So not only do we have the hypocritical [37:17.720 --> 37:24.720] thing of the attorneys can and will do it better, which we know is not true, but if [37:25.000 --> 37:32.000] no man can claim ignorance of the law, how then can the bar say that a layman doesn't [37:32.000 --> 37:37.680] know the law well enough to help somebody else understand it? After all, the concept [37:37.680 --> 37:44.680] of ignorance of the law is no excuse is a proclamation that every man knows the law. [37:47.000 --> 37:54.000] Every man understands the law. He is required to know so that he cannot later claim ignorance [37:57.400 --> 38:04.400] of any duty he may have under that law and for not performing that duty. [38:04.400 --> 38:11.400] So that's hypocrisy number one and two, come think of it. Ignorance of the law is no excuse, [38:16.080 --> 38:19.400] but you can't possibly know and understand the law well enough to tell anybody else [38:19.400 --> 38:24.840] about it or help anybody else with it, including yourself. That's why you need us, but you [38:24.840 --> 38:31.840] can't say you don't know it when we're charging you. Okay? Can't do that. Also, we know the [38:31.840 --> 38:36.840] law better than you. We've never read it. We've never looked at all the relevant statutes [38:36.840 --> 38:41.840] associated with it, but we know it better than you. Why? Because to us, it doesn't matter [38:42.840 --> 38:47.840] what the law says. What matters is what some court wrote an opinion about, whether that [38:47.840 --> 38:52.840] law is the same or it has changed or the court got it right in the first place, which they [38:52.840 --> 38:59.840] don't most of the time. And I can prove all of this with simple logic. I can prove all [39:01.840 --> 39:07.840] of this with simple documentation, but true to form, no attorney will listen to facts [39:08.840 --> 39:15.840] when fiction will suit and they are good at fiction. The other hypocrisy is that attorneys practice [39:15.840 --> 39:22.840] and are learned in the law. This also is a lie. What they are practice and learned in [39:22.840 --> 39:30.840] is someone else's opinion about the law, whether that opinion is still in harmony with the [39:31.840 --> 39:38.840] law it related to or even if it never was in harmony with the law it related to. Case [39:38.840 --> 39:45.840] in point, ex parte Greenwood, 1958. That is the court case where the Texas court of criminal [39:46.840 --> 39:52.840] appeals ruled that municipalities and justice of the peace courts could use complaints alone [39:53.840 --> 40:02.840] as charging instruments. And their entire argument for reasoning that that way was that the Texas [40:02.840 --> 40:07.840] Constitution identified that there was such a thing as a criminal statement which the court [40:07.840 --> 40:13.840] turned around and immediately equivocated to a criminal complaint and they are not at all the [40:13.840 --> 40:20.840] same thing. Not at all, but they equivocated the criminal statement as being the same thing as [40:23.840 --> 40:29.840] an indictment or information when that is not true. In fact, the thing the court completely [40:29.840 --> 40:36.840] ignored in coming to that conclusion was what the Constitution itself said immediately prior [40:36.840 --> 40:45.840] to the mention of the statement, in this case affidavit. And that was that if the information [40:49.840 --> 40:56.840] or indict or if the information be quashed in the county, then the accused shall not be [40:56.840 --> 41:03.840] released from custody but held to answer for the criminal affidavit. Okay, now that right [41:04.840 --> 41:13.840] there tells any sane and logical person that an information had to have existed in the first [41:14.840 --> 41:22.840] place or could not have been quashed and that it existed in harmony with this statement. [41:22.840 --> 41:29.840] The statement did not come without the information and when you read the Code of Criminal Procedure [41:29.840 --> 41:35.840] and you back trace the Code of Criminal Procedure, you will find out that the information could [41:35.840 --> 41:44.840] not have existed without an indictment. So right there, the criminal statement required the [41:44.840 --> 41:52.840] pre-existence of an indictment and an information and still does, according to the Constitution [41:52.840 --> 41:58.840] and the Code of Criminal Procedure, in order to invest the court with jurisdiction of the [41:58.840 --> 42:02.840] cause in the first place. The indictment or information according to Article 5 Section 12 [42:02.840 --> 42:10.840] B is the only two instruments that grant the court jurisdiction. Now that's important. [42:10.840 --> 42:17.840] That's an important distinction, granting it jurisdiction versus maintaining its jurisdiction. [42:17.840 --> 42:25.840] There's your distinction. Since the indictment or information is required to invest courts [42:25.840 --> 42:32.840] with jurisdiction and if the information gets quashed, notice it does not, the Constitution [42:32.840 --> 42:37.840] does not say if the indictment gets quashed, it says if the information gets quashed at [42:37.840 --> 42:45.840] the county, then the individual will still be held to answer for the criminal affidavit. [42:45.840 --> 42:55.840] Okay? So that affidavit is not the same as a criminal complaint for the very same reasons [42:55.840 --> 43:00.840] that I've talked about before and that is, is that a sworn criminal statement, the word [43:00.840 --> 43:07.840] sworn means that it must be signed under penalty of perjury. It's not an affidavit if it's not [43:07.840 --> 43:15.840] signed under penalty of perjury. It's a statement but it's not one that would stand up in court [43:15.840 --> 43:22.840] as fact because it's not done under penalty of perjury. Ladies and gentlemen, that is the [43:22.840 --> 43:28.840] criminal complaint. The criminal complaints in Texas are not signed under penalty of perjury. [43:28.840 --> 43:35.840] They are a naked allegation. They are not proof of a crime. They are not an instrument [43:35.840 --> 43:40.840] that invests a court with jurisdiction of a crime because they can be hearsay on their [43:40.840 --> 43:49.840] face. [48:13.840 --> 48:15.840] And that is what the state bar does. [48:15.840 --> 48:22.840] It protects its lining of its own pockets at the expense of the general public. [48:22.840 --> 48:26.840] Now let's get back to the point that I was making about the governmental side of this. [48:26.840 --> 48:35.840] If the state bar, logically speaking, if the state bar is enacted as an administrative office of the judicial department of government, [48:35.840 --> 48:41.840] which is exactly what it says in the act and is now codified in Chapter 8182 and 838 of the government code, [48:41.840 --> 48:45.840] if you read those you will see that's exactly what it says. [48:45.840 --> 48:59.840] Then that means that anyone with a bar card membership to that administrative office of the judicial branch of government is a de facto government employee. [48:59.840 --> 49:00.840] Okay. [49:00.840 --> 49:04.840] There's no way around that, which brings us to a couple of questions. [49:04.840 --> 49:16.840] One, as a government employee, are all these attorneys that appear to be acting in private, quote unquote, practice, have they taken their required oath of office [49:16.840 --> 49:23.840] and anti-bravery statement in order to be practicing law under governmental authority? [49:23.840 --> 49:29.840] Because remember, without that governmental authority, they can't do what they do. [49:29.840 --> 49:42.840] But at the same time, you and I, the people, cannot participate in that branch of our government because we're not one of this private entities, [49:42.840 --> 49:47.840] or this governmental entities, posing as a private entities, members. [49:47.840 --> 49:49.840] We're not one of its members. [49:49.840 --> 49:50.840] Okay. [49:50.840 --> 50:00.840] So we can't be judges in courts of record, the only courts that matter when it comes to setting precedent and controlling how case law works in Texas. [50:00.840 --> 50:03.840] We can't serve in any of those positions as the people. [50:03.840 --> 50:05.840] Can't serve on the Supreme Court. [50:05.840 --> 50:07.840] Can't serve on the courts of appeals. [50:07.840 --> 50:10.840] Can't serve on any of those things. [50:10.840 --> 50:17.840] And all because the state bar act says we cannot and the Constitution was amended to prevent us from doing so. [50:17.840 --> 50:21.840] Now here's the problem. [50:21.840 --> 50:34.840] If only this one private occupation that is really a government occupation, posing as a private occupation, [50:34.840 --> 50:47.840] now has absolute control of an entire department of the people's government that the people can no longer participate meaningfully in, then we have been disenfranchised. [50:47.840 --> 50:57.840] And it has been done in the interest of a single class or collection of individuals called bar members. [50:57.840 --> 51:01.840] You get that? [51:01.840 --> 51:20.840] You've lost an entire branch of your government people to a private conglomerate or at least a conglomerate that uses the power of government to line its private pockets or the private pockets of its members at our expense. [51:20.840 --> 51:22.840] Never forget that. [51:22.840 --> 51:26.840] Always at our expense. [51:26.840 --> 51:27.840] Okay. [51:27.840 --> 51:30.840] Now these facts are irrefutable. [51:30.840 --> 51:36.840] They are written into the state constitution and they are written into state law. [51:36.840 --> 51:41.840] Oh, did I forget to mention, who enacted that state law? [51:41.840 --> 51:54.840] Attorneys that were unconstitutionally sitting in our legislature to vote on a bill that benefited them and their private interest. [51:54.840 --> 51:57.840] Get that? [51:57.840 --> 52:05.840] Now at the time it wasn't unconstitutional because the attorneys were not governmental employees. [52:05.840 --> 52:15.840] When 1939 started, they only became employees after the State Bar Act was passed and took effect. [52:15.840 --> 52:26.840] Then every attorney as a bar member became a government employee, in which case they were required to take the oath that the constitution requires them to take under Article 16, Section 1. [52:26.840 --> 52:33.840] Which I guarantee you none of them have done. [52:33.840 --> 52:34.840] Okay. [52:34.840 --> 52:41.840] Next time you go talk to your private attorney and say, hey, can you show me your oath of office and your anti-bribery statement or tell me where it's filed so I can get a copy of it? [52:41.840 --> 52:42.840] What the hell are you talking about? [52:42.840 --> 52:43.840] I don't work for the government. [52:43.840 --> 52:44.840] You have a bar card? [52:44.840 --> 52:45.840] Well, yeah. [52:45.840 --> 52:46.840] Then you work for the government. [52:46.840 --> 52:47.840] I do not. [52:47.840 --> 52:50.840] How do you think we're having a bar card that says I work for the government? [52:50.840 --> 52:57.840] Because the State Bar Act says that the State Bar is created as an administrative office of the judicial department of government. [52:57.840 --> 53:14.840] And you as a member of that office are a government employee posing as a private individual but using the force of government to ensure that you make money. [53:14.840 --> 53:18.840] Am I the only one out there in La La Land that has a problem with this? [53:18.840 --> 53:20.840] I mean, let me be honest, folks. [53:20.840 --> 53:31.840] I love the rides and fantasy land, but every now and then you need to get the hell off and go back out the gate to reality. [53:31.840 --> 53:41.840] Because if you think these people are out here to work in your best interest, you are seriously delusional. [53:41.840 --> 53:48.840] And I would seriously consider joining you if I didn't like having control of my faculties. [53:48.840 --> 53:54.840] Because this at times gets to be just way too much to want to deal with. [53:54.840 --> 53:59.840] But somebody's got to do it. [53:59.840 --> 54:05.840] Now, when you look at how this was set up, you know this was not an accident. [54:05.840 --> 54:07.840] This was by design. [54:07.840 --> 54:10.840] Well, let's look at something else here. [54:10.840 --> 54:29.840] How many of you out there listening remember Senator McCarthy and the cry of McCarthyism because of what he was trying to do with the socialists and communists through the powers of Congress holding congressional hearings about those activities in America? [54:29.840 --> 54:36.840] And it was called the House Committee of Un-American Activities or the House Un-American Activities Commission or something like that. [54:36.840 --> 54:56.840] But their whole goal was to root out the communists and the socialists that were trying to secretly seize control of major businesses, major ports, and major political offices back in the 30s, 40s, and 50s. [54:56.840 --> 55:06.840] In other words, they were attempting to seize control to attempt to destroy America from within and McCarthy was doing his best to go after him for it. [55:06.840 --> 55:19.840] Now, what I find the most ironic about this is that you have these communists being called to testify before Congress about being communist. [55:19.840 --> 55:41.840] The whole purpose of being communist is to destroy the Constitution and everything it stands for, and yet these people are standing there not going to prison for their activities because they invoke the Fifth Amendment to the Constitution of the United States to protect their right to practice those politics. [55:41.840 --> 55:43.840] Okay? [55:43.840 --> 55:47.840] But the fact of the matter is McCarthy was right. [55:47.840 --> 55:49.840] Not in what he was doing. [55:49.840 --> 55:52.840] What he was doing was unconstitutional if he was attempting to force them to do it. [55:52.840 --> 55:57.840] I got no argument against that. [55:57.840 --> 56:07.840] But he was right about what they were doing, and he was right about the consequences of letting them get away with it. [56:07.840 --> 56:13.840] In America, you have let them get away with it. [56:13.840 --> 56:25.840] There is not a state left that is not controlled in every department of government by the Bar Association. [56:25.840 --> 56:27.840] Not one. [56:27.840 --> 56:29.840] Think about it. [56:29.840 --> 56:31.840] Your legislators are bar members. [56:31.840 --> 56:37.840] Your entire judiciary of any power are bar members. [56:37.840 --> 56:42.840] Your highest executive offices are bar members. [56:42.840 --> 57:01.840] Think about that and then understand why everything is going into codification and things that were never allowed to be a law in this country because it violated the concept of individual liberty. [57:01.840 --> 57:10.840] The courts are now ruling isn't really a violation of individual liberty because the courts are run by the bar members. [57:10.840 --> 57:17.840] They can't control society unless society plays along. [57:17.840 --> 57:27.840] And you have been duped into doing that for far longer than you can possibly imagine. [57:27.840 --> 57:35.840] They have gotten away with this because you have failed in your own education. [57:35.840 --> 57:41.840] You did not take common sense and apply it to what you were seeing and hearing every day of your life. [57:41.840 --> 57:47.840] You didn't look at the things going on around you and say, wait a minute, this cannot possibly be right. [57:47.840 --> 57:53.840] I've been told this all my life yet this is what I'm seeing and these two things do not go hand in hand. [57:53.840 --> 57:56.840] It's impossible for them to go hand in hand. [57:56.840 --> 58:10.840] Here we are. How did we get here if it was not by people ignoring what they knew to be a problem but not wanting to be involved with coming up with a solution? [58:10.840 --> 58:22.840] We're here out of apathy. We're here out of laziness. We're here out of fear and we need to change that and we need to change it really, really fast. [01:02:00.840 --> 01:02:11.840] Former Google engineer James D'Amour filed a class action lawsuit against the Alphabet Corporation on Monday, claiming that it discriminates against white men and those with conservative leaning views. [01:03:41.840 --> 01:04:00.840] Now, in the governmental side of things, as I was saying, they have completely disenfranchised us of any meaningful participation in one entire department and control every position of power in every other department, including Governor, Attorney General, [01:04:00.840 --> 01:04:18.840] all these other jobs that aren't supposed to have attorneys in them because they're members of the judicial department, but they're actually sitting in power in other departments exercising a power and authority of a separate department that is absolutely a violation of the Texas Constitution [01:04:18.840 --> 01:04:36.840] separation of powers caused under Article II. No S, no A's, no B's. There is no argument about this, yet you will find court cases and everything else that say this is okay. [01:04:36.840 --> 01:05:02.840] So I will ask you again, what qualifies a bar member to dictate what law is when these people obviously have an agenda that violates every single constitutional principle as well as the Constitution itself in the way that they operate and in the way that they rule in these courts? [01:05:02.840 --> 01:05:10.840] Why would you want someone like that having power over your life and your property? [01:05:10.840 --> 01:05:13.840] I wouldn't and I don't. I will say I'm more experienced than the majority of people that I deal with on this subject and that experience, believe it or not, means a lot compared to not having done it and then just talking about it. You got a 50-50 chance of getting it right and heaven help you if you fall on the wrong side of that meter when it's over. But on top of the experience, I've got the study, I've got the research, I've got the practical application, I've got the practical discussion. I actually know how to take my experiences as a programmer, a business owner, someone who's lived more than five damn minutes and apply a little common sense and logic to my day-to-day way of doing things. [01:06:43.840 --> 01:06:56.840] Now, everybody does dumb and stupid stuff at least once and more often than not way more than once throughout the course of their lifetime, and I've had my fair share of those moments. [01:06:56.840 --> 01:07:20.840] But unlike these people that sit in these bar association positions, it's not a daily occurrence, it's not an hourly occurrence, and yet some of these people, some of these people should be in a fricking asylum because their perspective of reality is so fricking skewed. [01:07:20.840 --> 01:07:30.840] They're either on the most screwed up drug you can imagine or they're fricking insane. [01:07:30.840 --> 01:07:53.840] To argue the things they argue and say that that's just the way we think it ought to be should prove that they have no place in a decent society, much less one that allows them power over anyone else in that society. We have the sycophantic elitist a-hole sitting up here telling us that we cannot possibly know and understand what they do, how they do it, and how it works. [01:08:08.840 --> 01:08:30.840] So when I can demonstrate in one verbal confrontation with one of them that they themselves are completely fricking clueless, completely, and I will do it on their favorite subject of law. [01:08:42.840 --> 01:08:56.840] Now remember that the United States Supreme Court has ruled many times and long ago, beginning long ago, that no court has the power to interpret a statute beyond the language of the statute itself. [01:08:56.840 --> 01:09:04.840] Nor is a court allowed to use interpretation if the language of the statute is clear. [01:09:04.840 --> 01:09:12.840] They must apply it as it is written, yet time and time again here in Texas courts that is never ever the case. [01:09:12.840 --> 01:09:13.840] Never. [01:09:13.840 --> 01:09:16.840] They could care less what the law says. [01:09:16.840 --> 01:09:19.840] Their opinion is all that matters. [01:09:19.840 --> 01:09:29.840] And it doesn't matter whether it's the prosecutor's opinion, whether it's the judge's opinion, as long as it's not the defendant's opinion. [01:09:29.840 --> 01:09:47.840] So let's look at the situation this now leaves the people in, in every state, especially in these little funding operations that they use through these regulatory codes and everything else where they steal your money with these citations and everything else. [01:09:47.840 --> 01:09:56.840] Now, we know that the police officer or whatever other officer issues you a citation of any kind is a government employee. [01:09:56.840 --> 01:10:00.840] Nobody questions that one for some reason. [01:10:00.840 --> 01:10:08.840] We know that the person who prosecutes it is a government employee, whether they be a municipal or a county or a state employee, they're a government employee. [01:10:08.840 --> 01:10:11.840] No one seems to question that. [01:10:11.840 --> 01:10:16.840] We know that the person sitting on the bench is a government employee. [01:10:16.840 --> 01:10:19.840] No one questions that. [01:10:19.840 --> 01:10:31.840] But what no one questions or what everyone should question and doesn't is whether or not your defense attorney is a government employee also. [01:10:31.840 --> 01:10:34.840] And they are. [01:10:34.840 --> 01:10:40.840] They don't have to be a public defender to be a government employee. [01:10:40.840 --> 01:10:47.840] They simply have to be a bar member according to the State Bar Act. [01:10:47.840 --> 01:11:00.840] And because your public defender is a government employee, everything that you're swimming up a waterfall on. [01:11:00.840 --> 01:11:08.840] You're counting on the government to do the right thing, including your own attorney. [01:11:08.840 --> 01:11:10.840] You see a problem here? [01:11:10.840 --> 01:11:12.840] The government is accusing you. [01:11:12.840 --> 01:11:14.840] The government is testifying against you. [01:11:14.840 --> 01:11:16.840] The government is prosecuting you. [01:11:16.840 --> 01:11:20.840] The government is deciding whether or not you're being properly prosecuted. [01:11:20.840 --> 01:11:27.840] And the government is defending you from the actions of itself. [01:11:27.840 --> 01:11:29.840] Hmm. [01:11:29.840 --> 01:11:34.840] I don't see a good outcome here. [01:11:34.840 --> 01:11:43.840] You want to know why the conviction rate in Texas is 99.6 percent? [01:11:43.840 --> 01:11:46.840] Well, there you go. [01:11:46.840 --> 01:11:49.840] Because the game is rigged. [01:11:49.840 --> 01:11:51.840] But you're not supposed to know that. [01:11:51.840 --> 01:12:03.840] See, if you're a non-bar member and you study the law and you realize the deception that is being perpetrated against the people. I don't know if you knew this. The big cog in the wheels, among others, began in 1947 when the American Bar Association sold out to the United Nations. [01:35:19.840 --> 01:35:27.840] And now the UN gets to control the judges, controls what goes on in the courts, and controls what the attorneys do and don't do. [01:35:27.840 --> 01:35:37.840] And now that organization that we were taught were the good guys in school trying to save the world and save lives while they're doing the opposite in all those areas. [01:35:37.840 --> 01:35:43.840] They're working towards one world government, one world religion, one world economy, and one world politics. We don't see anybody else looking or offering a solution or that even understands the problem in a lot of cases. [01:36:37.840 --> 01:36:46.840] Well, that's exactly why you are heroes because you're not trying to be heroes. You're just trying to be good and do good forever for everyone. [01:36:46.840 --> 01:36:55.840] Now, I do have a question and that is, one of my relatives got a traffic ticket just recently for crossing the center line. [01:36:55.840 --> 01:37:04.840] And my relative is like me. He is very analytical and he took pictures of where the alleged incident took place. [01:37:04.840 --> 01:37:15.840] And there was no yellow line. Now, I know what they're going to say in court and they're going to say, well, first of all, you should never argue the merits of the case. [01:37:15.840 --> 01:37:23.840] You should break down the doors without even talking about the merits of the case. I know that that's the real way to win your case. [01:37:23.840 --> 01:37:30.840] But if it comes down to it in court, he's going to say, there was no yellow line. How can you use that as a standard? [01:37:30.840 --> 01:37:37.840] See, what the cop really meant and what the judge is going to say is, well, what he meant was, you were over in the other way. [01:37:37.840 --> 01:37:43.840] But that's not what was said. That's not what was put on the ticket. That's not what was put on the ticket. [01:37:43.840 --> 01:37:47.840] It said you crossed the yellow line. You're two tires. [01:37:47.840 --> 01:37:54.840] Well, but here's the thing, in New York, is the ticket considered the charging instrument? [01:37:54.840 --> 01:37:57.840] I would say no. I'm not a legal expert. [01:37:57.840 --> 01:38:07.840] Okay. Well, then here's your problem. If the ticket is not the charging instrument, what it specifically says on the citation is not going to get the resolution you want. [01:38:07.840 --> 01:38:18.840] It's not going to be arguable as a mistake. What matters is what's in the actual complaint, what is called the charging instrument, whatever that may actually be. [01:38:18.840 --> 01:38:31.840] If it is the citation and they're using it as the complaint, then they must prove exactly what it says and the judge is not free nor is the witness free to alter the facts after the fact. [01:38:31.840 --> 01:38:34.840] They can't because that's improper notice. [01:38:34.840 --> 01:38:43.840] If they're telling you you have to defend against the charge of crossing a yellow line and then they're going to say at the moment of trial, oh, we don't have to prove there was a yellow line. [01:38:43.840 --> 01:38:59.840] Right. Wrong. Yes, you do. Otherwise, I have not been given proper notice of the actual charge. I've been given something else and now you're substituting a different charge for a different thing. [01:38:59.840 --> 01:39:04.840] Okay. That's lack of notice. That's a violation of due process. [01:39:04.840 --> 01:39:11.840] Now, the other thing is, is this in New York considered a civil infraction? [01:39:11.840 --> 01:39:19.840] All right, here's the background. I got this right from a prosecuting attorney who prosecutes car cases, traffic cases. [01:39:19.840 --> 01:39:22.840] He says, and there's two parts to this. [01:39:22.840 --> 01:39:32.840] First part is traffic, traffic tickets are violations heard in criminal court. [01:39:32.840 --> 01:39:45.840] And then the second part is traffic tickets and they believe if you tell them that the traffic ticket is not a proper charging instrument and it's not any in any of the 450 states. [01:39:45.840 --> 01:39:55.840] And the reason for that is twice in the Constitution, it builds a retainer and and Ritz of assistance are outlawed. [01:39:55.840 --> 01:40:01.840] Okay, I got I got all that. But here's the thing that is not neither of those is an answer to my question. [01:40:01.840 --> 01:40:05.840] First off, you don't ever get your legal information from the prosecutor. [01:40:05.840 --> 01:40:09.840] He will lie to you to serve his own interests day in and day out. [01:40:09.840 --> 01:40:16.840] Don't ever ask the prosecutor. You need to look at what the courts, huh? [01:40:16.840 --> 01:40:19.840] That's like asking the fox to guard the henna house. [01:40:19.840 --> 01:40:28.840] No, that's like asking your dog to guard your steak dinner that you're going to leave on the coffee table while you go to the John. [01:40:28.840 --> 01:40:33.840] Okay, okay, so all right, so here's the thing. [01:40:33.840 --> 01:40:40.840] Okay, you look at the statutes or you look at the case law, but you don't ask the attorneys. [01:40:40.840 --> 01:40:42.840] They don't freaking know. [01:40:42.840 --> 01:40:44.840] Okay, they don't. [01:40:44.840 --> 01:40:46.840] I know they don't. I know they don't. [01:40:46.840 --> 01:40:56.840] So find out because the information I have is that 95% of the traffic charges in New York are civil infractions. [01:40:56.840 --> 01:41:10.840] Okay, and if that is the case in this instance, then you have a separate issue to go after and that is the false imprisonment by the officer who wrote the ticket because in order to write the ticket, he had to stop the individual. [01:41:10.840 --> 01:41:12.840] Did he not? [01:41:12.840 --> 01:41:13.840] That's true. [01:41:13.840 --> 01:41:16.840] Okay, that's a seizure. [01:41:16.840 --> 01:41:20.840] It's a warrantless seizure to boot. [01:41:20.840 --> 01:41:37.840] If this is a civil infraction under state law, there cannot be any criminal probable cause or reasonable suspicion, which is the only thing that would authorize a warrantless seizure. [01:41:37.840 --> 01:41:40.840] That's like missing apples and oranges, I know. [01:41:40.840 --> 01:41:57.840] Well, obviously you don't know because you're not catching what I'm saying here. What I'm telling you is that the cop himself is now guilty of a much larger crime, the deprivation of liberty without probable cause. [01:41:57.840 --> 01:42:01.840] You know what they're going to say to me, I argue, yes, I had probable cause across the center line. [01:42:01.840 --> 01:42:05.840] He can't have probable cause without a criminal act. [01:42:05.840 --> 01:42:10.840] If this is a civil infraction, it is not a criminal act, is it? [01:42:10.840 --> 01:42:11.840] That's right, no. [01:42:11.840 --> 01:42:14.840] Okay, that is the point. [01:42:14.840 --> 01:42:20.840] Now, when do you go to court on this or he go to court on this? [01:42:20.840 --> 01:42:25.840] It just happened two days ago, so I got about a week or two. [01:42:25.840 --> 01:42:32.840] Okay, then go to my legal blog and pull up the article that says, just do a search for civil infractions. [01:42:32.840 --> 01:42:38.840] And on there you will find an article titled civil infractions and what they mean if your state has them. [01:42:38.840 --> 01:42:40.840] Okay? [01:42:40.840 --> 01:42:49.840] In that article are seven interrogatories that will apply to any state where these are civil infractions. [01:42:49.840 --> 01:42:56.840] Write that motion for interrogatories up as a, it's a motion for discovery using interrogatories. [01:42:56.840 --> 01:43:01.840] You file them with the prosecuting attorney, you file them with the cop. [01:43:01.840 --> 01:43:05.840] You make them provide the discovery answers to both of those. [01:43:05.840 --> 01:43:07.840] Okay? [01:43:07.840 --> 01:43:21.840] Then you use that to prove that there was no probable cause for the seizure because there was no crime upon which the base said probable cause or reasonable suspicion. [01:43:21.840 --> 01:43:28.840] This is why you need to know what the law says about whether or not it's a civil infraction. [01:43:28.840 --> 01:43:33.840] You either need to cite a statute saying that this is considered a civil infraction in New York, [01:43:33.840 --> 01:43:40.840] or this is the case law that says it's a civil infraction in New York and there is no criminal culpability of any kind. [01:43:40.840 --> 01:43:47.840] Therefore, there could be no probable cause of any kind because it requires criminal elements which don't exist here. [01:43:47.840 --> 01:43:49.840] Okay?
