[01:33.680 --> 01:37.840] Judge ruled that the government's lawyers suppressed footage from several cameras that [01:37.840 --> 01:42.080] were set up by the FBI around the Bundy's family home that would have been favorable [01:42.080 --> 01:46.880] in the defendant's case when Mr. Bundy was released today Monday after leaving the courthouse. [01:46.880 --> 01:50.840] He told reporters that I've been a political prisoner for 700 days. [01:50.840 --> 01:54.880] He hadn't seen his wife for nearly two years due to the fact that he had refused any conditional [01:54.880 --> 02:01.200] release, which required him to forfeit his trial by jury rights. [02:01.200 --> 02:05.520] Former Google engineer James D'Amore filed a class action lawsuit against the Alphabet [02:05.520 --> 02:10.280] Corporation on Monday, claiming that it discriminates against white men and those with conservative [02:10.280 --> 02:11.920] leaning views. [02:11.920 --> 02:15.440] D'Amore was terminated for dismantling a memo, essentially questioning the company's [02:15.440 --> 02:17.120] diversity policies. [04:27.880 --> 04:37.000] I am developing a presentation to the State Bar Association, and I probably shouldn't [04:37.000 --> 04:44.520] give away my strategy because I hope that they don't get it. [04:44.520 --> 04:53.480] I have all these questionnaires, and I'm having some issues or some final issues with implementing [04:53.480 --> 04:59.760] my software or my content on the software. [04:59.760 --> 05:05.720] I'm having to struggle to actually learn how to use the software because there are some [05:05.720 --> 05:13.080] subtle issues, underlying issues in the coding that's giving me a little bit of a problem [05:13.080 --> 05:14.080] right now. [05:14.080 --> 05:23.600] I've got the basic content ready, they're almost ready. [05:23.600 --> 05:29.160] Everything from arrest, no matter what it's for, up to the point where you go to a first [05:29.160 --> 05:36.760] meeting, excuse me, hearing, I couldn't reach my mute button. [06:19.640 --> 06:25.760] It turned out the president of the bar wasn't in Austin, the president of the bar is in [06:25.760 --> 06:30.480] Wetherford, Texas, that's about 30 miles from where I live. [06:30.480 --> 06:38.800] It's nice that he's close, however he used to be the mayor of Wetherford, Texas. [06:38.800 --> 06:46.840] That probably means he's going to know my name, which may not be such a good thing because [06:46.840 --> 06:53.960] I've hammered Wetherford, Texas a time or two, so I'm going to try to get the prosecutor [06:53.960 --> 07:04.320] from the county I live in, and his ADA, his ADA is sharp, and she has a good presentation, [07:04.320 --> 07:11.240] so I think I've gotten them convinced of the value of the process, so I'm going to try [07:11.240 --> 07:13.640] to get them to pitch it to the state bar. [07:13.640 --> 07:18.400] I'm going to give the state bar all these questions for free. [07:18.400 --> 07:31.680] I want them to make it available, I want them to license this from me for all of their bar [07:31.680 --> 07:34.680] card carriers. [07:34.680 --> 07:43.400] In the state of Texas there are 256,000 bar card carrying attorneys, and if I can get [07:43.400 --> 07:53.600] them to pay me 25 cents per lawyer per month, I am financed big time, and then I build a [07:53.600 --> 08:04.040] questionnaire and I build the research engine on the back side, and since I'm giving it [08:04.040 --> 08:11.200] to the bar for free, right now lawyers, they use Lexis or Westlaw. [08:11.200 --> 08:15.520] I don't know what Westlaw costs, it's a little bit less than Lexis, but Lexis is about three [08:15.520 --> 08:24.120] grand a month for a lawyer, that's serious bucks, so we're going to give them this backside [08:24.120 --> 08:32.440] database essentially for free on the condition that they help populate it, instead of having [08:32.440 --> 08:38.840] to go out and do research for case law, and I've heard lawyers say they would read up [08:38.840 --> 08:43.680] to 100 cases to find that first case on point. [08:43.680 --> 08:52.080] Well we have all the points, and what I'm doing case law, I just talked to the head [08:52.080 --> 09:00.200] of the library for A&M University of Fort Worth a couple days ago, and talked to her [09:00.200 --> 09:07.080] about this, and she said yes, that's a big problem, and she tells her students, I told [09:07.080 --> 09:14.840] her that when I'm doing research, I come across a lot of great cases, and I have a 16 gig [09:14.840 --> 09:21.840] reservoir of case law that I've saved over the years by title as close as I can get it, [09:21.840 --> 09:26.760] so that when I went back to these issues I could find that case law, and she said yes, [09:26.760 --> 09:31.600] she tries to instruct the students there to develop a way to do that, so they can keep [09:31.600 --> 09:40.800] track of this case law, well this tool we're building is suited exactly for that, because [09:40.800 --> 09:46.800] when I'm reading case law, trying to find case on point, I come across a lot of case [09:46.800 --> 09:53.600] law close to the point, but not exactly on point, well a lot of it I want to be able [09:53.600 --> 10:01.920] to keep, but I don't have an effective way of storing it, now with this questionnaire, [10:01.920 --> 10:08.040] we've got all the points, so if I find a good case on a slightly different point, you can [10:08.040 --> 10:14.320] go into the map and say okay that goes right here and drop it in a folder I have for each [10:14.320 --> 10:21.280] question, then when you come across that particular issue you've got your case law right there, [10:21.280 --> 10:30.680] and if I have 256,000 lawyers putting in their case law, this is case law they have to look [10:30.680 --> 10:37.600] up anyway, and if they save it in this database then they save other attorneys the trouble [10:37.600 --> 10:42.680] of having to look that up, and the other attorneys will do the same thing for this attorney, [10:42.680 --> 10:48.120] all the attorneys will benefit, so we're not going to tell them, they're just going to [10:48.120 --> 10:53.000] make this available to the pro se as well, well if they ask us we will, actually we are [10:53.000 --> 10:59.560] going to tell them, but I don't think they'll realize what the consequence of that is, the [10:59.560 --> 11:08.320] consequence of that will be is when a lawyer goes into court using our tool, he can be [11:08.320 --> 11:19.080] confident that he has not missed a single legal point, a legal element point or issue, [11:19.080 --> 11:29.600] also his client will have access to the same depth of information, so instead of you going [11:29.600 --> 11:36.520] in with your lawyer acting like God for you, and we've said on the air the most dangerous [11:36.520 --> 11:42.000] person in the courtroom is your lawyer, he's the one that can throw you under the bus easier [11:42.000 --> 11:56.040] than anybody, once you know what he knows, and as a pro se, as a victim or a litigant, [11:56.040 --> 12:02.200] you don't have to know all of the law, you only need to know that law that applies directly [12:02.200 --> 12:08.040] to you, and that's what this tool will isolate, so you'll have all the law that applies to [12:08.040 --> 12:15.280] you, essentially you know as much as the lawyer does, and then you can hold the lawyer's [12:15.280 --> 12:22.680] feet to the fire, and by doing that you give the lawyer plausible deniability when he goes [12:22.680 --> 12:28.560] before the judge and says, oh your honor, I know this annoys you, you'd rather be out [12:28.560 --> 12:37.000] playing golf this evening, but my client is fixing to kick my behind if I don't present [12:37.000 --> 12:45.840] these issues, so don't blame me, we give the lawyer plausible deniability so he can actually [12:45.840 --> 12:53.000] go into court and do his job, and the reason the judge will have cause to pay attention [12:53.000 --> 13:03.280] is because we're taking some approaches that haven't really been taken before. [13:03.280 --> 13:13.040] With this tool, not only will it isolate all the relevant law, it will also indicate all [13:13.040 --> 13:19.840] of the relevant remedies when the judge fails to form his duty, for instance instead of [13:19.840 --> 13:27.280] appealing to the court of appeals or to the next higher court, we appeal to a grand jury [13:27.280 --> 13:31.560] to indict the judge for failing to determine the facts in accordance with the rules of [13:31.560 --> 13:34.960] evidence that apply the laws that come to him to the facts in the case, and I found [13:34.960 --> 13:39.240] some case law directly on that point. [13:39.240 --> 13:44.800] So now the judge doesn't have to worry about the lawyer, he has to worry about the informed [13:44.800 --> 13:54.080] client, and we'll instruct the client how to use this, don't tell your lawyer, don't [13:54.080 --> 13:58.600] counsel with your lawyer, just file. [13:58.600 --> 14:03.200] The judge doesn't, if you have reason to believe the judge did not apply the law to the facts [14:03.200 --> 14:07.400] just file criminally with him, with the district attorney, and let the district attorney tell [14:07.400 --> 14:10.920] the judge that the client is trying to get you arrested, and then the judge is going [14:10.920 --> 14:15.040] to go to the lawyer, and the lawyer is going to say, I don't know what you're talking about [14:15.040 --> 14:18.680] judge, I don't know anything about it, and when the lawyer comes to you to ask you about [14:18.680 --> 14:24.120] it, you tell him it's none of your business, you go take care of my case, this is my business, [14:24.120 --> 14:27.920] now the lawyer goes back to the judge and says, I don't know anything about this, my [14:27.920 --> 14:35.080] client won't talk to me about it, so we protect our lawyer, put the judge on the dime, and [14:35.080 --> 14:40.880] if we can get people all over the state doing this, we'll get judges in exactly the position [14:40.880 --> 14:46.600] that I've been trying to get judges in for the last ten years, anyone who's been listening [14:46.600 --> 14:54.160] to the show for a long time will remember me saying that it is my ultimate intended [14:54.160 --> 15:02.120] outcome to place every judge in the country in a position such that when they step up [15:02.120 --> 15:08.160] behind the bench and look out across the bar at the gallery, I want them wondering which [15:08.160 --> 15:14.680] one, which one of those scoundrels sitting out there watching, it's just a waiting for [15:14.680 --> 15:18.520] me to render a ruling that he doesn't like so he can run down to the grand jury and try [15:18.520 --> 15:28.120] to get me indicted, when we have our judges thinking that way, liberty and justice will [15:28.120 --> 15:36.360] pretty well begin to take care of itself, we won't have to worry about the judges acting [15:36.360 --> 15:45.560] with caprice and doing whatever they're paid to do, because the threat of not following [15:45.560 --> 15:53.000] law will become greater than the value of whatever they get paid to throw a client, [15:53.000 --> 16:01.280] throw a litigant under the bus, and also it will eventually eliminate the need for lawyers [16:01.280 --> 16:09.880] for the most part, unless the case is extremely complex, the vast majority of the cases can [16:09.880 --> 16:16.640] be adjudicated on the facts and law, and we'll have all the facts and the law, and we won't [16:16.640 --> 16:24.640] need the lawyers, well that's the idea, that's my story and I'm sticking to it, and if I [16:24.640 --> 16:34.160] can get the bar to pick this up, then the bar supports it, and we will change everything. couple of rules [22:43.060 --> 22:47.060] And the very rule in flow is [22:47.060 --> 22:53.060] You always try to anticipate any question you will create [22:53.060 --> 22:55.060] In the mind of your reader [22:55.060 --> 22:59.060] If you create a question in your mind of your reader [22:59.060 --> 23:04.060] And don't answer that question, you've lost your reader [23:04.060 --> 23:09.060] I suspect that most everybody here has seen Lord of the Rings [23:09.060 --> 23:11.060] The trilogy [23:11.060 --> 23:15.060] Well, I read Lord of the Rings trilogy [23:15.060 --> 23:19.060] And in the first book [23:19.060 --> 23:23.060] Where Frodo gets stabbed by the ringwraith [23:23.060 --> 23:26.060] And they're trying to get him to Rivendell [23:26.060 --> 23:29.060] And they meet an elf [23:29.060 --> 23:32.060] Well, in the book, it was an arrow in the movie [23:32.060 --> 23:34.060] It was a different elf [23:34.060 --> 23:38.060] And the author spends 50 pages [23:38.060 --> 23:42.060] Giving us this elf's whole life story [23:42.060 --> 23:45.060] I read all three books of the trilogy [23:45.060 --> 23:48.060] Looking for this elf to come back [23:48.060 --> 23:50.060] And he never did [23:50.060 --> 23:53.060] When I finished Return of the King [23:53.060 --> 23:56.060] I was furious [23:56.060 --> 23:58.060] He ruined the whole trilogy [23:58.060 --> 24:00.060] Because I got this question about this elf [24:00.060 --> 24:03.060] He set this elf up and he never came back [24:03.060 --> 24:05.060] Made me nuts [24:05.060 --> 24:07.060] Same thing happens with your legal documents [24:07.060 --> 24:11.060] Same thing happens if you're sitting in a seminar [24:11.060 --> 24:15.060] And the speaker says something and you don't get it [24:15.060 --> 24:19.060] Or you don't hear it well [24:19.060 --> 24:23.060] Because the speaker is moving through subjects too quickly [24:23.060 --> 24:28.060] To give a listener time to do transderivational search [24:28.060 --> 24:31.060] And find internal context [24:31.060 --> 24:34.060] Where he can lay these pieces of information [24:34.060 --> 24:37.060] In a way that makes sense to them [24:37.060 --> 24:40.060] So that they can go inside and re-access them [24:40.060 --> 24:43.060] You have to be careful when you're feeding out information [24:43.060 --> 24:46.060] Because you have to give your reader time to assimilate it [24:46.060 --> 24:48.060] Otherwise, when you're done [24:48.060 --> 24:50.060] You may have sounded great [24:50.060 --> 24:52.060] But when you're done [24:52.060 --> 24:55.060] The listener is sitting there with a blank stare on his face [24:55.060 --> 24:57.060] He don't know what that was going on [24:57.060 --> 25:02.060] So you have to anticipate the questions you're going to bring [25:02.060 --> 25:06.060] And make sure where something you say brings a question [25:06.060 --> 25:08.060] You answer it [25:08.060 --> 25:10.060] You can't always do that [25:10.060 --> 25:13.060] And you've heard me on the air ask people to take my documents [25:13.060 --> 25:15.060] And rip them to shreds [25:15.060 --> 25:18.060] And the reason I want people to rip grammatical error [25:51.060 --> 25:55.060] Sometimes I intentionally put in grammatical errors [25:55.060 --> 25:58.060] But that goes to Ericksonian hypnosis [25:58.060 --> 26:01.060] And you have to be really, really careful when you do that [26:01.060 --> 26:07.060] It gets the reader's attention on a subtle, almost subliminal level [26:07.060 --> 26:09.060] If you do that carefully [26:09.060 --> 26:11.060] But if you make a blunder [26:11.060 --> 26:14.060] Like where Microsoft Word [26:14.060 --> 26:16.060] Decides you're typing no [26:16.060 --> 26:18.060] And it decides you really want not [26:18.060 --> 26:21.060] And it sticks not in there [26:21.060 --> 26:26.060] That doesn't cause a subtle internal panoramic eruption [26:26.060 --> 26:30.060] That drops your reader out of flow [26:30.060 --> 26:33.060] They mentally notice that you made a grammatical error [26:33.060 --> 26:35.060] And then they have to go inside [26:35.060 --> 26:39.060] And determine what word that should have been [26:39.060 --> 26:41.060] Or how the grammar should have been written [26:41.060 --> 26:45.060] And by that time, they've dropped completely out of flow [26:45.060 --> 26:53.060] So this document was written based on the concept of mental flow [26:53.060 --> 26:59.060] And one other primary rule is [26:59.060 --> 27:04.060] Every paragraph should have its own heading [27:04.060 --> 27:08.060] Indicating what that paragraph is going to be about [27:08.060 --> 27:10.060] So you put the heading in first [27:10.060 --> 27:12.060] And then you type the paragraph [27:12.060 --> 27:14.060] Well, when you're typing in the paragraph [27:14.060 --> 27:20.060] And you come across a reference to an issue that's important [27:20.060 --> 27:25.060] And you have this inclination to stream off [27:25.060 --> 27:29.060] And address that issue before you forget it [27:29.060 --> 27:32.060] Stop, drop down below [27:32.060 --> 27:34.060] Put in a heading that goes to that issue [27:34.060 --> 27:38.060] And then come back and stay on point [27:38.060 --> 27:40.060] With the confidence of knowing [27:40.060 --> 27:43.060] You've put a mental marker there [27:43.060 --> 27:45.060] You will address this issue [27:45.060 --> 27:48.060] But you don't need to address it now [27:48.060 --> 27:50.060] Stay on point with this paragraph [27:50.060 --> 27:52.060] The next paragraph, you can go to that issue [27:52.060 --> 27:55.060] Or if three or four issues come up [27:55.060 --> 27:57.060] Just put a title for each one of them [27:57.060 --> 27:59.060] Now, when you're finished with the documents [27:59.060 --> 28:03.060] A lot of times you'll take a bunch of those headings out [28:03.060 --> 28:07.060] But if you're creating a large legal document [28:07.060 --> 28:11.060] If any of you have read very many large legal documents [28:11.060 --> 28:16.060] You will find that often the lawyer will address the same point [28:16.060 --> 28:20.060] Two or three times from two or three different directions [28:20.060 --> 28:23.060] Because he's letting his mind float around here [28:23.060 --> 28:26.060] And that's really, really dangerous [28:26.060 --> 28:28.060] Because you might wind up with two arguments [28:28.060 --> 28:32.060] That are not exactly in sync with one another [28:32.060 --> 28:34.060] And that will really trash your documentation [28:34.060 --> 28:36.060] So if you use headings [28:36.060 --> 28:40.060] And I use headings in Microsoft Office [28:40.060 --> 28:42.060] They have a style section [28:42.060 --> 28:46.060] You can use the outline headings in the style section [28:46.060 --> 28:50.060] Then you can go to view navigation pane [28:50.060 --> 28:54.060] And it pops you up with little table contents [28:54.060 --> 28:56.060] With each of those headings in it [28:56.060 --> 28:59.060] So you can scan down those headings [28:59.060 --> 29:02.060] And see if you have the same thing come up [29:02.060 --> 29:05.060] A couple of times in different places [29:05.060 --> 29:07.060] That's a big time red flag [29:07.060 --> 29:10.060] Then you go in there and make sure [29:10.060 --> 29:13.060] That if you need to argue this same issue twice [29:13.060 --> 29:16.060] That you make sure both of them are in sync with one another [29:16.060 --> 29:19.060] Most of the time you'll take one of them out [29:19.060 --> 29:21.060] Because they don't need to be there [29:21.060 --> 29:25.060] Then your document becomes very clear and concise [29:25.060 --> 29:28.060] The document I produced the other 29:40.060] But they were in this style with all these headings [29:40.060 --> 29:42.060] And the lawyer told the procé [29:42.060 --> 29:45.060] That he really liked this document [29:45.060 --> 29:46.060] He was impressed [29:46.060 --> 29:49.060] He didn't know how you produce something so well [29:49.060 --> 29:52.060] And it was just using a set of rules [29:52.060 --> 29:54.060] Hang on, [35:21.060 --> 35:27.060] How do you establish that the car insurance companies [35:27.060 --> 35:31.060] Misled the public when there are laws [35:31.060 --> 35:37.060] Statutory laws requiring insurance? [35:37.060 --> 35:42.060] Because the statutes appear to say A, but they actually say F [35:42.060 --> 35:45.060] Because transmission drives in, vehicle operate [35:45.060 --> 35:48.060] Don't mean what anybody who listens to Eddie Craig [35:48.060 --> 35:50.060] Show knows that [35:50.060 --> 35:53.060] Okay, well here's the reason I asked that [35:53.060 --> 35:57.060] Is because the way I see the code [35:57.060 --> 36:02.060] It's not the insurance company that's misrepresenting anything [36:02.060 --> 36:05.060] It is the state that's misrepresenting something [36:05.060 --> 36:11.060] The insurance company is insuring you as a commercial driver [36:11.060 --> 36:13.060] Because you come in with a license [36:13.060 --> 36:17.060] And that license authorizes you to act as a commercial driver [36:17.060 --> 36:21.060] And they're selling you commercial insurance [36:21.060 --> 36:25.060] The fact that you don't always act in commerce [36:25.060 --> 36:32.060] Well, that's not the insurance company's fault [36:32.060 --> 36:35.060] Okay, so there is no point [36:35.060 --> 36:41.060] I don't think you would be able to get a claim against them [36:41.060 --> 36:44.060] Because you can operate in commerce with that license [36:44.060 --> 36:47.060] And you can operate not in commerce [36:47.060 --> 36:49.060] And the insurance companies aren't saying [36:49.060 --> 36:53.060] If you're not operating in commerce, we're not going to insure you [36:53.060 --> 36:56.060] They're saying, we're insuring you under your license [36:56.060 --> 36:59.060] Because they won't insure you without it [36:59.060 --> 37:05.060] Under that license, no matter how you operate, we will insure you [37:05.060 --> 37:11.060] So I don't see how I would have a claim [37:11.060 --> 37:13.060] All right, fair enough [37:13.060 --> 37:18.060] And in general, whenever people do try to file a lien against the system [37:18.060 --> 37:22.060] Try to beat it, that's known as what they're going to call it [37:22.060 --> 37:24.060] Paper Taylorism [37:24.060 --> 37:26.060] And they claim they're filing fraudulent liens [37:26.060 --> 37:29.060] And in fact, the liens aren't fraudulent [37:29.060 --> 37:33.060] It's just that, well, because the system [37:33.060 --> 37:35.060] If they say it's the public, it's the students [37:35.060 --> 37:37.060] They can say it's fraudulent liens [37:37.060 --> 37:39.060] But if you read all the details, no [37:39.060 --> 37:41.060] They have every right to file that lien against the system [37:41.060 --> 37:45.060] Like I think her call you once mentioned [37:45.060 --> 37:47.060] Yeah, I'm familiar with that [37:47.060 --> 37:50.060] But I've been all over the country trying to keep people out of jail [37:50.060 --> 37:53.060] For doing that kind of thing [37:53.060 --> 37:59.060] And I'm suggesting a somewhat different approach [37:59.060 --> 38:02.060] Rather than filing liens [38:02.060 --> 38:06.060] File criminal charges against them [38:06.060 --> 38:11.060] They've got no defense against that one [38:11.060 --> 38:13.060] And they can't come after you either [38:13.060 --> 38:18.060] Because you're protected when you file that criminal complaint [38:18.060 --> 38:20.060] I've been doing this a long time [38:20.060 --> 38:23.060] In the county I live in, everybody knows [38:23.060 --> 38:25.060] That Calvin, you watch that guy, man [38:25.060 --> 38:27.060] He's just looking for a reason [38:27.060 --> 38:29.060] So he can file criminal charges against you [38:29.060 --> 38:31.060] And they're right, I am [38:31.060 --> 38:37.060] And nobody comes to me and says anything [38:37.060 --> 38:40.060] One word, oh, you got to be careful [38:40.060 --> 38:43.060] Or you could get in a lot of trouble [38:43.060 --> 38:47.060] Witness tampering, obstruction of justice [38:47.060 --> 38:49.060] Cues them of threatening me [38:49.060 --> 38:51.060] Oh, what do you mean by threatening me? [38:51.060 --> 38:53.060] It doesn't matter, you meant it [38:53.060 --> 38:56.060] It matters how I took it [38:56.060 --> 38:59.060] So just do one little thing [38:59.060 --> 39:02.060] That I can construe as a criminal act [39:02.060 --> 39:05.060] And I'll nail you quickly [39:05.060 --> 39:07.060] Now, have everybody upset at you [39:07.060 --> 39:12.060] Because they're being forced to try to protect you [39:12.060 --> 39:15.060] If we want to go after them [39:15.060 --> 39:18.060] We need to look at the code that's already there [39:18.060 --> 39:22.060] The ones they're claiming to follow [39:22.060 --> 39:28.060] Take their code and cram it right down their throats [39:28.060 --> 39:31.060] Using this process, when they get finished [39:31.060 --> 39:34.060] And they want to go home and go on to other business [39:34.060 --> 39:38.060] You can still be all over these guys [39:38.060 --> 39:41.060] Because they make such a horrible mess [39:41.060 --> 39:44.060] They have no idea what they should be doing [39:44.060 --> 39:47.060] I'm trying to hire some people right now [39:47.060 --> 39:51.060] That are really knowledgeable in the code [39:51.060 --> 39:55.060] And I had a friend of mine who was a 20-year police officer [39:55.060 --> 39:58.060] He said, well, why don't you see if you can hire a policeman [39:58.060 --> 40:00.060] Part-time [40:00.060 --> 40:05.060] I said, Greg, what police officer do you know [40:05.060 --> 40:08.060] That knows the code? [40:08.060 --> 40:10.060] And he sat there a minute [40:10.060 --> 40:14.060] He said, you have a point there [40:14.060 --> 40:18.060] The police have no idea what the code is [40:18.060 --> 40:20.060] They don't care [40:20.060 --> 40:23.060] They don't need to know what the code is [40:23.060 --> 40:26.060] Nobody comes after them for violating the code [40:26.060 --> 40:30.060] Unless they do something incredibly horrible [40:30.060 --> 40:33.060] And then, when somebody does come after them [40:33.060 --> 40:38.060] Everybody in the system lines up to protect them [40:38.060 --> 40:41.060] So, my position is [40:41.060 --> 40:47.060] I don't care about the guy who perpetrated the initial problem [40:47.060 --> 40:51.060] I want the guys who's protecting him [40:51.060 --> 40:53.060] Or her [40:53.060 --> 40:56.060] I want to put them in a position where they have to [40:56.060 --> 40:59.060] Step into the line of fire to shield this guy [40:59.060 --> 41:02.060] From the consequences of his bad behavior [41:02.060 --> 41:06.060] These guys are going to be real unhappy [41:06.060 --> 41:08.060] And the higher up you go in the system [41:08.060 --> 41:11.060] The more unhappy they get [41:11.060 --> 41:14.060] And their problem is [41:14.060 --> 41:16.060] They are all servants [41:16.060 --> 41:19.060] You are the master of the servant [41:19.060 --> 41:21.060] You can go as high as you want to [41:21.060 --> 41:23.060] And crawl down their throats [41:23.060 --> 41:25.060] And nothing they can do [41:25.060 --> 41:29.060] That won't get them into more trouble [41:29.060 --> 41:32.060] Does that sound like fun, Andrew? [41:32.060 --> 41:35.060] Yes, I understand that's the one little thing [41:35.060 --> 41:38.060] That you stood out there that you mentioned [41:38.060 --> 41:40.060] You file criminal charges against them [41:40.060 --> 41:42.060] You're protected if you file a lien against them [41:42.060 --> 41:44.060] You're not protected [41:44.060 --> 41:47.060] If someone who files a lien can protect themselves [41:47.060 --> 41:51.060] There's a problem with these liens [41:51.060 --> 41:54.060] They just made up the lien [41:54.060 --> 41:59.060] Filing a lien without a judgment backing the lien [41:59.060 --> 42:02.060] Puts the lien at jeopardy [42:02.060 --> 42:06.060] They're going to claim, and I think with some credence [42:06.060 --> 42:09.060] That the lien is fraudulent [42:09.060 --> 42:11.060] Because you just made it up [42:11.060 --> 42:14.060] I had Robert Fox before he passed away several years ago [42:14.060 --> 42:16.060] I was in North Carolina and he called me [42:16.060 --> 42:19.060] And he had two guys that were being prosecuted [42:19.060 --> 42:21.060] By the U.S. Attorney [42:21.060 --> 42:24.060] They filed some liens against the public official [42:24.060 --> 42:27.060] I said, well, what was the issue? [42:27.060 --> 42:29.060] And they said, traffic [42:29.060 --> 42:35.060] How much were the liens? 11 trillion [42:35.060 --> 42:39.060] I said, what were you thinking? [42:39.060 --> 42:44.060] You have a low-level public official [42:44.060 --> 42:48.060] And you filed an $11 trillion lien against him [42:48.060 --> 42:51.060] How do you justify that lien [42:51.060 --> 42:55.060] And show that the lien is not fraudulent? [42:55.060 --> 42:58.060] Well, he did this, he did that, he did this [42:58.060 --> 43:01.060] How do you get to 11 trillion? [52:50.060 --> 52:56.060] If the suit was still making civil claims [52:56.060 --> 53:01.060] They did not understand the declaratory judgment [53:01.060 --> 53:03.060] Clearly [53:03.060 --> 53:07.060] So all this garbage they've got in their answers [53:07.060 --> 53:11.060] Complaining that you didn't [53:11.060 --> 53:14.060] Stay to claim which cover can be had [53:14.060 --> 53:17.060] Of course not [53:17.060 --> 53:20.060] And all the claims that they complain about [53:20.060 --> 53:22.060] And they're arguing against [53:22.060 --> 53:25.060] They're no longer before the court [53:25.060 --> 53:28.060] And it's like the lawyers haven't seen [53:28.060 --> 53:30.060] Declareatory judgment [53:30.060 --> 53:33.060] They're not familiar with how to deal with it [53:33.060 --> 53:35.060] And that makes this even better [53:35.060 --> 53:41.060] Lawyers hate to go to places they don't always go [53:41.060 --> 53:45.060] And declaratory judgment is a tool that was put out there [53:45.060 --> 53:48.060] That's almost never used [53:48.060 --> 53:53.060] So the lawyers don't have all of these standard motions [53:53.060 --> 53:57.060] And pleadings that they file in civil cases [53:57.060 --> 54:02.060] They gotta search out declaratory judgment [54:02.060 --> 54:05.060] And it's a whole different animal [54:05.060 --> 54:10.060] So I read all of those documents [54:10.060 --> 54:13.060] And they were all trash [54:13.060 --> 54:16.060] Oh my gosh, that one wrote it up [54:16.060 --> 54:20.060] It looked like a third grader had put it together [54:20.060 --> 54:24.060] The way it was structured and everything [54:24.060 --> 54:27.060] It was horrible, I was like holy crap [54:27.060 --> 54:30.060] And then the other one was sitting there saying [54:30.060 --> 54:34.060] Basically I was using shifty maneuvers [54:34.060 --> 54:40.060] Because I was trying to outrun an unfavorable [54:40.060 --> 54:43.060] Disposition on the case or something [54:43.060 --> 54:46.060] I'm like yeah, I'm using sneaky practices [54:46.060 --> 54:50.060] Sharp practices like y'all do [54:50.060 --> 54:56.060] He considered the judge criticized your pleadings [54:56.060 --> 55:01.060] So you can file a response saying [55:01.060 --> 55:03.060] Or even they could criticize your pleadings [55:03.060 --> 55:08.060] You can file a response saying that their criticisms were well taken [55:08.060 --> 55:12.060] And that's why you filed declaratory judgment [55:12.060 --> 55:16.060] And dismissed with all of the claims against them [55:16.060 --> 55:19.060] And now they're complaining about it [55:19.060 --> 55:26.060] The attorney is making all the complaints and stuff [55:26.060 --> 55:32.060] Screw him, yeah, of course I'm using practices like this [55:32.060 --> 55:41.060] To outrun the typical Rule 91A or 12B6 [55:41.060 --> 55:44.060] So yeah, there's no damages in here [55:44.060 --> 55:48.060] There's no monetary damages in here to be haggled over [55:48.060 --> 55:51.060] All I'm warning is the declaratory judgment [55:51.060 --> 55:54.060] Which decides on the facts and the law of the case [55:54.060 --> 56:01.060] And a judicial argument is before the court [56:01.060 --> 56:07.060] And the only way that this position can come out is the ruling on the argument [56:07.060 --> 56:12.060] And in their answers they didn't address any of those arguments [56:12.060 --> 56:14.060] At all [56:14.060 --> 56:16.060] They never did [56:16.060 --> 56:18.060] They complained about what you filed [56:18.060 --> 56:22.060] This is great, this is exactly what I was hoping to see [56:22.060 --> 56:26.060] You've got the lawyers out of their element [56:26.060 --> 56:30.060] And now they look like the chumps that they really are [56:30.060 --> 56:33.060] You'll send them back to the books [56:33.060 --> 56:37.060] And these are lawyers in municipal courts [56:37.060 --> 56:40.060] They're not the sharpest knife in the drawer [56:40.060 --> 56:44.060] Because if they were they'd be out making the big bucks [56:44.060 --> 56:48.060] They're down here in the municipal courts grubbing for dollars [56:48.060 --> 56:50.060] So now it's doing them good [56:50.060 --> 56:53.060] Now you'll make them look like chumps [56:53.060 --> 57:01.060] And you'll really be good if they get their hats handed to them by a pro say [57:01.060 --> 57:03.060] So I was real pleased with what I saw in those [57:03.060 --> 57:06.060] And most of them were like one or two pages [57:06.060 --> 57:12.060] And how big was the document you filed? [57:12.060 --> 57:17.060] I basically have filed everything as a brief now [57:17.060 --> 57:23.060] So it's put together anywhere between depending on which case [57:23.060 --> 57:27.060] Between a nine and twelve page brief [57:27.060 --> 57:31.060] And that's not including some exhibits which I tie in [57:31.060 --> 57:33.060] Which is only about like two or three pages of exhibits [57:33.060 --> 57:35.060] Maybe four at the most [57:35.060 --> 57:43.060] But everything is around solid ten pages [57:43.060 --> 57:47.060] So on an average [57:47.060 --> 57:51.060] And these guys didn't address any of it? [01:04:30.060 --> 01:04:38.060] Well, I got a complaint in a summons of suits from the magistrate court in the county that I live [01:04:38.060 --> 01:04:47.060] And I showed up at the magistrate's office and they hand me a suit from a collection company [01:04:47.060 --> 01:04:54.060] And it was signed in a attorney, the attorney gave an affidavit [01:04:54.060 --> 01:05:02.060] But he has his statement of claim and has a little box there that you check off the suit on account [01:05:02.060 --> 01:05:10.060] But when he goes to do his affidavit and here's what it says, plaintiff says the defendant is indebted to the plaintiff as follows [01:05:10.060 --> 01:05:14.060] All this guy is like half a senate, it's not a complete senate [01:05:14.060 --> 01:05:25.060] It says like the...not even a whole, it's like Wayne Memorial and then it doesn't spell out the hospital's whole name [01:05:25.060 --> 01:05:34.060] And it got in parentheses O2 and then the amount of the suit, like the parentheses number is like a reference number [01:05:34.060 --> 01:05:38.060] Okay, what was that name again? What memorial? [01:05:38.060 --> 01:05:40.060] Wayne Memorial [01:05:40.060 --> 01:05:43.060] Lane Memorial [01:05:43.060 --> 01:05:46.060] Like somebody...yeah [01:05:46.060 --> 01:06:02.060] Okay, go on the internet and put in that truncated name and see if you come up with any other entity that has that string in their name [01:06:02.060 --> 01:06:04.060] Uh-huh [01:06:04.060 --> 01:06:18.060] That'll...that you could move to strike the pleading as it fails to make the state of claim [01:06:18.060 --> 01:06:22.060] Is it sufficient? [01:06:22.060 --> 01:06:41.060] In this part you do a rule 12 in Texas, it's rule 91 or something in the Fed, it's rule 12B6, every state has a rule on this, a motion to dismiss for failure to state a claim [01:06:41.060 --> 01:06:47.060] So they failed to state the debt with specificity [01:06:47.060 --> 01:06:49.060] Uh-huh [01:06:49.060 --> 01:06:55.060] Also, I like to listen to you because of what you talk about getting on the lawyers [01:06:55.060 --> 01:06:59.060] Well, I found out this lawyer, he's just a one man proud [01:06:59.060 --> 01:07:05.060] Ooh, ooh, one man debt collector [01:07:05.060 --> 01:07:08.060] Sounds like he's in favor of stuff like that [01:07:08.060 --> 01:07:10.060] He will not like it when you greet him [01:07:10.060 --> 01:07:18.060] You need to look at what they have to produce in order to support a claim [01:07:18.060 --> 01:07:34.060] In Tennessee, in Texas, there has to be a...they have to file an affidavit showing the accounting for the mortgage, I mean for the mortgage for the debt [01:07:34.060 --> 01:07:40.060] We had a guy years ago that was sued on a debt this way [01:07:40.060 --> 01:07:54.060] And we filed a challenge of subject matter jurisdiction because he didn't file all the documentation required by the state law and therefore we maintained he was unable to invoke subject matter jurisdiction of the court [01:07:54.060 --> 01:07:59.060] And that was so much fun [01:07:59.060 --> 01:08:07.060] Because the judge summoned him to court and we sued the judge [01:08:07.060 --> 01:08:13.060] Claiming that the judge didn't have subject matter jurisdiction so we filed a suit against the judge [01:08:13.060 --> 01:08:19.060] And the judge got the county attorney to write an answer [01:08:19.060 --> 01:08:27.060] So we sued the county attorney for misappropriation of public funds because sued the judge in his personal capacity [01:08:27.060 --> 01:08:33.060] Oh, that was so much fun [01:08:33.060 --> 01:08:38.060] Let me ask you a question [01:08:38.060 --> 01:08:40.060] You've always looked at the court rules, you know what I'm saying? [01:08:40.060 --> 01:08:46.060] Well, in Georgia where the magistrate or uniform magistrate court rules, you look them up [01:08:46.060 --> 01:08:51.060] There's no rules with evidence. It's what's quote unquote a fairness court [01:08:51.060 --> 01:08:57.060] So they can basically just say, well, I'm going to take this evidence and not take this evidence, you know what I'm saying? [01:08:57.060 --> 01:09:04.060] And this has happened to many people in my hometown where they go either as a plaintiff or a defendant [01:09:04.060 --> 01:09:10.060] And they show up and the judge just rules out of hand whatever he feels like or whatever he wants to do [01:09:10.060 --> 01:09:16.060] And is there any ways to enforce the rules of evidence in this matter? [01:09:16.060 --> 01:09:24.060] Absolutely. The rules of evidence establish fairness [01:09:24.060 --> 01:09:37.060] So if while the judge may be able to determine what he believes is fair, the legislature has already defined what is fair [01:09:37.060 --> 01:09:47.060] And just because the rules of evidence have not been explicitly expressed to this court, the rules of evidence have been established to ensure due process [01:09:47.060 --> 01:09:56.060] So anytime the judge fails to apply the rules, then you can claim a breach of due process [01:09:56.060 --> 01:10:02.060] Because the legislature has carefully defined what amounts to due process [01:10:02.060 --> 01:10:08.060] That makes perfect sense because I'm not not getting fairness or anything else, but I have to get into the process [01:10:08.060 --> 01:10:23.060] You can argue the issue, and this is in my ebook, I have a section on this where I maintain that I do not want my judge to determine what he believes is fair or just [01:10:23.060 --> 01:10:33.060] Because what is fair or just is going to depend on whether or not the judge has heartburn this morning [01:10:33.060 --> 01:10:41.060] Or his wife chewed him out today, or what he got for Christmas last month [01:10:41.060 --> 01:10:48.060] Depends on his personal prerogative and personal perspective at the moment [01:10:48.060 --> 01:10:59.060] I want my legislature to decide what is just and write laws in order to create a just outcome [01:10:59.060 --> 01:11:07.060] I want my judge to determine the facts in accordance with the rules of evidence, apply the laws, come see them with the facts in the case [01:11:07.060 --> 01:11:15.060] I don't care what his opinion is, I don't care if he's in a bad mood today, and I don't care what he thinks is just [01:11:15.060 --> 01:11:20.060] That's right, that's right, you want to think what's according to the law [01:11:20.060 --> 01:11:30.060] So you think, as I understand it, it's my limited understanding of the law is, you think actually a demure would be a good [01:11:30.060 --> 01:11:40.060] A demure, definitely, but you also may look at what it takes to file a constitutional challenge in Georgia [01:11:40.060 --> 01:11:48.060] In Texas you have to file a cover sheet, if you're making a constitutional challenge it's a cover sheet you have to file [01:11:48.060 --> 01:11:59.060] Check that out in Georgia, they're not going to want a constitutional challenge getting up higher in the courts [01:11:59.060 --> 01:12:14.060] If they have their magistrates where the magistrate can rule on his personal caprice, that asks for due process violations [01:12:14.060 --> 01:12:24.060] You don't have all these guys huffing and puffing about common law, man I do not want common law, because that's what common law is [01:12:24.060 --> 01:12:37.060] Whatever the judge thinks at the moment, I want my judge to rule on statute, apply the law to the facts and let the law bring about justice [01:12:37.060 --> 01:12:45.060] If the law as written does not bring about justice, then go to the legislature and change the law [01:12:45.060 --> 01:12:53.060] This is one of my issues where people are complaining about Trump and his stats on immigration [01:12:53.060 --> 01:13:08.060] Yes, forcing these kids who were brought here by no will of their own and forced to live in this country and grow up knowing only this country, now take them and toss them back into a country they've never been [01:13:08.060 --> 01:13:12.060] It appears to be horribly unjust [01:13:12.060 --> 01:13:19.060] So should we just ignore the law because it looks like it will produce an unjust outcome?
