[01:52.480 --> 01:56.460] Federal scientists announced today that this last July was the all-time warmest month ever [01:56.460 --> 02:01.360] recorded since the 1880s, when modern temperature record-keeping first began. [06:54.820 --> 06:55.820] Alrighty [06:55.820 --> 06:56.820] Alright, thanks Nathan [06:56.820 --> 06:57.820] Thank you [06:57.820 --> 06:58.820] Alright, bye bye [06:58.820 --> 07:01.820] Alright, here we go folks [07:01.820 --> 07:05.820] And of course, even after telling everybody heads up, I'm still getting people calling into the caller board [07:05.820 --> 07:07.820] Alright, let me try this again [07:07.820 --> 07:16.820] Now, right now in Texas, we have this problem with the higher courts constantly ruling that the lower courts, [07:16.820 --> 07:25.820] meaning Justice and Municipal and Class C fine-onlys, require only a complaint to invest that court with jurisdiction of the case [07:25.820 --> 07:29.820] There are several due process issues with that determination [07:29.820 --> 07:40.820] Not the least of which is the fact that a complaint is not required to meet all of the other requirements of a charging instrument [07:40.820 --> 07:50.820] For instance, an indictment or information by statutory decree are required to state all of the factual elements that are required to be proven at trial [07:50.820 --> 07:54.820] No such requirement exists for a complaint [07:54.820 --> 08:00.820] The second problem with the complaint is that a complaint is a hearsay instrument [08:00.820 --> 08:09.820] The person swearing out the complaint does not have to have competent first-hand knowledge of the facts being asserted in the complaint [08:09.820 --> 08:15.820] In fact, the language of the complaint, even if the person does have first-hand knowledge, [08:15.820 --> 08:22.820] is not sufficient to grant jurisdiction because it's not an actual sworn affidavit [08:22.820 --> 08:31.820] It contains qualifying language, which the courts themselves have ruled doesn't constitute a sworn statement [08:31.820 --> 08:36.820] That's one thing that somebody can say, yeah, I'm verifying somebody signed this [08:36.820 --> 08:46.820] But when the complaint itself is hearsay, and hearsay is inadmissible in a court except under very specific situations, [08:46.820 --> 08:58.820] how can a hearsay instrument of hearsay be the basis for a court's jurisdiction that is not part of those hearsay exceptions? [08:58.820 --> 09:01.820] That's the second problem [09:01.820 --> 09:09.820] The third problem is you're not necessarily being allowed to face the person making the allegations against you, [09:09.820 --> 09:12.820] which is whoever is the affiant on that complaint [09:12.820 --> 09:23.820] An affiant there has to be defined very loosely because, again, it's not actually sworn under penalty of perjury as to be true and correct [09:23.820 --> 09:30.820] See, the difference here is what they are calling a sworn complaint versus a sworn statement [09:30.820 --> 09:35.820] A criminal complaint is not a sworn statement [09:35.820 --> 09:43.820] because the statement can only be done by someone with competent first-hand knowledge of the facts being asserted [09:43.820 --> 09:46.820] A complaint does not have that requirement [09:46.820 --> 09:52.820] Therefore, a sworn statement as the instrument investing a court with jurisdiction, [09:52.820 --> 10:01.820] even if the indictment or information are quashed at the county or local level, [10:01.820 --> 10:10.820] the sworn statement would still remain because it only exists in relation to the information or indictment [10:10.820 --> 10:13.820] See, the sworn statement was there [10:13.820 --> 10:19.820] The information or indictment is based upon the facts asserted in the sworn statement [10:19.820 --> 10:29.820] Thus, the creation and submission of the information or indictment invests the court with jurisdiction from the original get-go [10:29.820 --> 10:44.820] But even if they're quashed later, the sworn statement will still stand up for the purpose of having the accused answer to the allegations made in it [10:44.820 --> 10:59.820] That is exactly why a sworn statement and a sworn complaint cannot be the same thing for the purpose of providing the court with jurisdiction of the action [10:59.820 --> 11:01.820] Can't be [11:01.820 --> 11:14.820] All right, there's no requirement that it has all of the necessary elements required to be proven, there is no requirement that it be made by a person with competent first-hand knowledge [11:14.820 --> 11:23.820] We also have the issue of them attempting to use the citation as a sworn complaint, and there's two very big problems with that, both of them statutory [11:23.820 --> 11:31.820] Well, three, if you also count the fact that it deprives you of the right of due process by failing to provide you sufficient notice of the allegation [11:31.820 --> 11:40.820] It cannot give you sufficient notice if all of the things the prosecutor has to prove aren't listed there for you to understand [11:40.820 --> 11:44.820] It's not sufficient notice [11:44.820 --> 11:59.820] Now, 27.14D of the Code of Criminal Procedure says that they can use the complaint or the citation as a complaint [11:59.820 --> 12:23.820] But, and this is a big but here, all right, in order to do so, there must be a signed waiver by both the prosecution and the accused that has already been filed with the court, waiving the need for an actual sworn complaint [12:23.820 --> 12:38.820] But this creates another jurisdictional quandary, and that is as if the courts themselves have set the minimum bar to jurisdiction in these courts is a valid sworn complaint [12:38.820 --> 12:54.820] And the citation does not comply with all of the requisites of a sworn complaint under 45.019 of the Code of Criminal Procedure for these types of cases [12:54.820 --> 13:18.820] Then the citation is insufficient to invoke the court's jurisdiction even if there is a waiver because it does not comport itself with the requirements of a complaint and the sufficiency of a complaint [13:18.820 --> 13:30.820] Now, you also have on top of this Article 5, Section 12B of the Texas Constitution which very clearly states that an indictment or information is what invokes the jurisdiction of the court, not a complaint [13:30.820 --> 13:39.820] Nowhere in the Texas Constitution is the legislature authorized to change what is considered a valid charging instrument [13:39.820 --> 13:47.820] In fact, nowhere is the sworn statement ever referred to as a charging instrument within the Constitution [13:47.820 --> 13:57.820] The only thing there in fact charging instrument doesn't exist, it simply states an indictment or information is necessary to invoke the jurisdiction [13:57.820 --> 14:04.820] But neither of those can exist until a sworn statement has been made [14:04.820 --> 14:07.820] You got it? [14:07.820 --> 14:21.820] But once that sworn statement is done and the indictment or information has been filed, the court's jurisdiction has been invoked, and then even if the indictment or information are found wanting, insufficient, or quashed [14:21.820 --> 14:33.820] The sworn statement will still maintain jurisdiction, but it was not sufficient alone to invoke it [14:33.820 --> 14:41.820] And again, the sworn statement is different than the actual complaint that they use [14:41.820 --> 14:51.820] It has to be because a sworn statement can only be done by someone with competent first-hand knowledge of the facts to which they are swearing [14:51.820 --> 14:58.820] And if you swear to certain facts, then you have to do so under penalty of perjury [14:58.820 --> 15:08.820] A complaint does not contain any language referencing a penalty of perjury because no one can be charged with perjury for making a complaint based upon what they believe may be the problem [15:08.820 --> 15:22.820] But you can get charged with perjury, in fact when you sign the sworn statements that the police agencies or that the prosecutors get you to sign before them, at the very bottom it says under penalty of perjury [15:22.820 --> 15:34.820] See, that's a sworn statement. When there is peril attached to swearing falsely, that is a sworn statement [15:34.820 --> 15:38.820] And a complaint simply doesn't have that [15:38.820 --> 15:54.820] Now, on top of all of this, of course, the hearsay issue comes even more clear because there's two things the prosecutor attempts to deny you the ability to do in court [15:54.820 --> 16:11.820] If the person testifying against you is not the affiant of the complaint, they get the court to rule that that person does not have to appear to testify because that person has no relevant factual knowledge of the allegations they made in the complaint [16:11.820 --> 16:18.820] And that's true, but they're still the one making it [16:18.820 --> 16:32.820] What they're attempting to do is to block your ability to prove that the only reason the person had come in contact with those facts was because they were employed by the same court that's presiding over this case [16:32.820 --> 16:43.820] And thus we have an agency problem when the affiant is someone that works in the court, like one of the clerks for instance [16:43.820 --> 16:51.820] All right, folks, we'll pick this up on the other side. [19:45.820 --> 19:51.820] Alright, now to continue on here real quick with this situation where the clerk is the affiant on the complaint [19:51.820 --> 19:57.820] And you're being denied the ability to bring the clerk in to question them as to how they became knowledgeable of the facts [19:57.820 --> 20:04.820] And how the clerk, being an agent of the judge within the court, only has any knowledge of the facts of the case [20:04.820 --> 20:11.820] Due to their job as a clerk in that court acting as an agent for that judge [20:11.820 --> 20:21.820] They don't want that clerk being able to be called so that you can get the facts in the record that we have a due process issue with a clerk [20:21.820 --> 20:29.820] Because not only do we have the person swearing out the complaint against us, working for the same judge presiding over the case [20:29.820 --> 20:36.820] That person is also the custodian of the record in the same court where it's being heard [20:36.820 --> 20:43.820] And has direct access to any and all documents that are part of that record [20:43.820 --> 20:48.820] And that entire record is in that agent's care [20:48.820 --> 21:01.820] See the problem here? The person swearing out the facts against you also controls the information in the record used by the court hearing the case [21:01.820 --> 21:04.820] Ding ding ding, alright [21:04.820 --> 21:14.820] Then we get to the issue of the officer taking the stand, you asking pointed questions about the facts asserted in the complaint [21:14.820 --> 21:24.820] And the prosecutor attempting to block their ability to answer by objecting and saying that the witness is not required to have knowledge of those specific things [21:24.820 --> 21:37.820] Now understand that when you ask them to make legal conclusions or opinions or to recite stuff off the top of their head, that's what you're going to get [21:37.820 --> 21:47.820] But there is a way to force them to answer. If you lay the foundation properly and you get them to answer properly, then you can make them answer the rest of it [21:47.820 --> 21:50.820] And the prosecutor's not going to be able to save them [21:50.820 --> 22:01.820] And if he does, then they're tampering with a witness and preventing you from getting exculpatory evidence into the record, which you can raise as an appellate issue [22:01.820 --> 22:16.820] Okay? So, when they object to you asking questions, make sure your questions aren't generic, that they don't require an opinion or a conclusion of the actual law [22:16.820 --> 22:21.820] You simply ask the officer specific facts [22:21.820 --> 22:34.820] Now, after going through these statutes as many times as I have, I have come to the conclusion that if all I wanted to do was to beat any transportation offense on the merits, I can do that [22:34.820 --> 22:42.820] I can do that. Using the statute itself, I can prove that they can't prove any of what they're asserting [22:42.820 --> 22:56.820] I mean, let's look at how this works for them. They prevent you from discussing any of the definitions of the terminology so that the presumption of what they mean remains in the jury's mind as being what they commonly think it means [22:56.820 --> 23:11.820] Thus, unless you take the stand and bring up everything and they don't block you from doing it, you don't get to assert an opinion or a conclusion any more than the officer does even when you're testifying on your own behalf [23:11.820 --> 23:23.820] So, how do you do it? You do it through judicial notice and you do it through asking questions that allows you to raise that judicial notice [23:23.820 --> 23:38.820] What kind of questions are those? They're the kind where the witness, whoever it may be, makes a statement of facts that are inconsistent with the statute he's claiming to have knowledge of [23:38.820 --> 23:47.820] Then, the court has to take judicial notice when you're asserting that the officer has misstated the facts of the statute [23:47.820 --> 23:58.820] And so, you need the court to take judicial notice of the fact that the testimony being provided is not compliant with the requisites of the statute [23:58.820 --> 24:14.820] That's how you get it in. That's how you force them to allow you to get it in, by getting the officer to answer questions in a way that shows what he thinks he knows is not consistent with what the statute actually says or does [24:14.820 --> 24:29.820] That way, you're not forcing him to make a conclusion, nor are you having to make a conclusion. You're simply having them read the statute verbatim and then you're going to ask them specific questions over this [24:29.820 --> 24:46.820] For instance, yesterday in class, we have a case where a young man by the name of Connor is being charged in several issues dealing with what the officer has alleged on the citation to be a motor scooter slash moped [24:46.820 --> 24:54.820] While the allegation in the complaint is actually an allegation of operated a motor vehicle [24:54.820 --> 25:08.820] Well, when you look at the statute, you find out that motor vehicle is four definitions removed from motor scooter and moped [25:08.820 --> 25:25.820] In other words, when you read the definition of motor scooter, motor scooter defines itself or moped as a motor driven cycle. Well, there's a definition of motor driven cycle in 541 right under the definition of moped [25:25.820 --> 25:39.820] When you read motor driven cycle, it says it's defined as a motorcycle, which is also defined in 541. Then when you read motorcycle, motorcycle defines itself as a motor vehicle under 541 [25:39.820 --> 26:03.820] So as you can see, motor vehicle is way down here through all these other definitions away from moped. And then there are very specific elements to the definition of moped itself, such as the vehicle must not be able to achieve a speed greater than 30 miles per hour in less than one mile [26:03.820 --> 26:17.820] It must be 50 cc or less. It must have no more than two brake horsepower. How would you use that against the officer when you get them on the stand in relation to the complaint? [26:17.820 --> 26:39.820] The complaint is saying motor vehicle. The allegation on the citation is that the type of conveyance was a moped. Why the disparity? You get them on that line of questioning so that you can get the connection between moped and motor vehicle by getting them to read through each of these definitions through judicial notice [26:39.820 --> 26:53.820] As long as the witness is testifying to it and it's relevant to how the charge is being made, they don't have a choice but to let you get it in. Anything else would give you an appealable error right away for deprivation of rights [26:53.820 --> 27:04.820] You're not being allowed to put on a vigorous defense. You're not being allowed to introduce exculpatory evidence. They're convicting you based upon a presumption and no facts if that's how they do it [27:04.820 --> 27:19.820] But you need to be able to make it clear in the record that's what they're doing. So you have to be clear in the record about what you're trying to prove and how you're going about doing it so that what they do is very apparent [27:19.820 --> 27:42.820] So by the time we get down through all these definitions, we've got the officer admitting that none of this actually applies to the conveyance because when it's all said and done, we get back at the moped and say, okay, officer, how far from where you initially made contact was it that you actually pulled me over and forced me to stop? [27:42.820 --> 27:59.820] Well, I encountered you at such-and-such intersection. Notice you didn't have a registration sticker on your motor vehicle and that's when you object a motor vehicle, of course, and I pulled you over within 100 to 200 yards of the intersection [27:59.820 --> 28:21.820] Okay, officer. So just so we're clear, you pulled me over approximately 300 to 600 feet from the intersection. Yes. Officer, that's how many feet is in 100 or 200 yards, right? Either 300 feet or 600 feet. Yes. Well, officer, how many feet are in a mile? [28:21.820 --> 28:43.820] Objection, relevance. Judge, the relevance is the statute giving the definition of moped, which I asked the court to take judicial notice of. It says very clearly in the statute in order to be defined as a moped that it must be able to achieve a speed of not more than 30 miles per hour in a mile or less than a mile [28:43.820 --> 28:57.820] I need to know if this officer ever paced it. If he didn't follow up for a mile, he doesn't know if it can get up higher than 30 miles per hour or not within that mile. [28:57.820 --> 29:15.820] Okay, overruled. All right, officer. How many feet in a mile? 5,280. If he even knows that. Okay, officer. Well, if there's 5,280 feet in a mile and you only paced me from three to 600, it's obvious you didn't go the full mile. Isn't that right? [29:15.820 --> 29:29.820] That would be correct. So you don't actually know if this conveyance is actually capable of getting over 30 miles per hour within a mile, are you? We get the officer on the stand, we get him going through this, we get him saying, okay, what is the proper procedure for measuring brake horsepower? [34:05.820 --> 34:19.820] And when he has to testify that he doesn't know, well, officer, at what point did you manage to measure the brake horsepower of the engine? Well, I didn't. Okay. [34:19.820 --> 34:36.820] Well, let's see. You didn't go over a mile to determine whether it could reach a particular speed. You didn't measure the brake horsepower. At what point did you disassemble the engine and take a measurement of the piston cavity and the piston head to determine that it was 50 cc's or less? [34:36.820 --> 34:51.820] Well, I didn't. It was printed on a metal plate there on the engine. Well, officer, can you please show us what evidence you brought with you that shows that this engine has not in any way been modified from its factory size of 50 cc's? [34:51.820 --> 35:06.820] Presumably, if that's what it ever was, that's marked on this plate. In other words, everything they're doing is based upon a set of presumptions, not evidence and fact. [35:06.820 --> 35:14.820] They're presuming all of this, but they haven't collected any actual evidence to prove any of it. [35:14.820 --> 35:28.820] Well, officer, you said it was a motor vehicle. Could you please tell me, at any point during your alleged investigation, did you in any manner or any way obtain a bill of lading? [35:28.820 --> 35:36.820] Well, no. Well, officer, did you in any way during your alleged investigation obtain a passenger manifest? [35:36.820 --> 35:50.820] Well, no. Well, officer, at any time during this alleged investigation, did you ever obtain a commercial logbook that showed I was on any kind of clock? [35:50.820 --> 36:00.820] No. Okay, well, let's try one more then. Officer, at any point did I ever confess to you that I was engaging in any form of transportation? [36:00.820 --> 36:03.820] No. [36:03.820 --> 36:16.820] Then can you please explain how you came to the legal conclusion that I was in any way, shape or form operating a motor vehicle for the purpose of transportation? [36:16.820 --> 36:31.820] Well, I never said you were using it for transportation, but officer, this allegation and everything associated with it, including the things you have to prove, comes from the transportation code. [36:31.820 --> 36:39.820] In other words, the legislature said we're going to regulate transportation and this is the code we're going to use to do that. [36:39.820 --> 36:52.820] So, at what point did you obtain any evidence that the accused was engaged in transportation and thus was operating a motor vehicle for that purpose? [36:52.820 --> 36:55.820] Well, I didn't. [36:55.820 --> 37:09.820] Okay, so like everything else so far, you're operating entirely on presumptions, not facts or evidence, and your own legal conclusions despite a lack of facts and evidence. Is that correct? [37:09.820 --> 37:12.820] Thank you. That'll be all. [37:12.820 --> 37:24.820] And then when they get done and say that the prosecution rests, it's like, well, excuse me, the defense moves for a directed verdict in favor of the defense, the states fail to prove the necessary elements of the charges. [37:24.820 --> 37:27.820] Of course, they're not going to do it, but guess what? [37:27.820 --> 37:39.820] Appealable error because they are not taking the facts and the law and making a determination based upon the unification of both. [37:39.820 --> 37:59.820] They're being capricious and arbitrary outside of the law, or in this case, the statute, in this case, the code, in this case, the code that was illegally unconstitutionally enacted in 1995, which is another defense I'll get into in greater detail at another time, which I did in fact yesterday in this class. [37:59.820 --> 38:10.820] But in any case, while we're covering that, I would like to bring my guest on here for a short bit. He's only on for a little bit, so don't get your hopes up too high that he'll have a whole lot of time to stay and chat. [38:10.820 --> 38:14.820] But my guest tonight, Mr. Randy Kelton. Randy, are you there? [38:14.820 --> 38:16.820] Howdy, howdy. I am here. [38:16.820 --> 38:19.820] All righty. What do you got for us? [38:19.820 --> 38:41.820] Well, we were talking earlier about this issue of primarily, I wanted to talk about a specific claim that I had come up with, and I wanted you to kind of expand on it. [38:41.820 --> 38:56.820] I had a, someone who worked for me got a ticket, and when they got the ticket, they were released on their own recognizance after signing the citation. [38:56.820 --> 39:15.820] Now, as I read the transportation code, police officers authorized to release someone on their own recognizance if they sign the citation, which will contain a promise to appear before our magistrate. [39:15.820 --> 39:29.820] Well, she signed the citation, as I understand the traffic. I used to be able to quote the transportation code that Syde said. But what's the code now? It's not, I keep remembering Burns. [39:29.820 --> 39:39.820] Eddie, what is the code that authorizes the officer to release a person if they sign the citation? [39:39.820 --> 39:43.820] 543.009. [39:43.820 --> 39:57.820] Okay. What that statute says is they must sign this, the citation as an agreement to appear before a magistrate. [39:57.820 --> 40:07.820] So she signed it, and it had to be before a magistrate because that's the only condition under which the officer is authorized to release the person. [40:07.820 --> 40:13.820] So she came to court, and she asked me to stand in as her counsel of choice. [40:13.820 --> 40:23.820] And the judge, to his credit, said, I will allow that for the purpose of this hearing, but if this comes to trial, he won't be able to speak. I said, fair enough. [40:23.820 --> 40:31.820] So she immediately asked the judge to hold an examining trial, and he said that we don't do that. [40:31.820 --> 40:39.820] And I said, Your Honor, are you sitting in the capacity of a magistrate? I said, I'm sorry. I said, Your Honor, are you a magistrate? [40:39.820 --> 40:53.820] He said, Mr. Kelton, all judges are magistrates. Yes, Your Honor, I understand that. But right now, which hat are you wearing? Your magistrate's hat or your judge's hat? [40:53.820 --> 41:00.820] And he refused to answer. But he also refused to hold an examining trial. [41:00.820 --> 41:07.820] So in reading the penal code, that raised an issue. [41:07.820 --> 41:22.820] The officer induced Tony to sign this citation and agree to appear before a magistrate. [41:22.820 --> 41:31.820] Subsequent to the signing of that citation, she appeared at the date and time specified on the citation for the purpose of appearing before a magistrate. [41:31.820 --> 41:39.820] But she was not able to appear before a magistrate. She was forced to appear before a judge. [41:39.820 --> 41:49.820] Now, the way I read the penal code, that is securing and executing a document by deception. [41:49.820 --> 42:06.820] The judge and the police officer conspired with one another to deceive Tony by getting her to agree before a magistrate and then forcing her to appear before a judge. [42:06.820 --> 42:09.820] Eddie, do you find a hole in that? [42:09.820 --> 42:23.820] In the logic, no. And I stand corrected for myself here. It's 543.006. 10 is the failure to appear part. I'm sorry, 9 is the failure to appear, but it's 006. [42:23.820 --> 42:34.820] Yeah, and what I brought up to Randy in relation to that specific allegation was this, that I asked him, had they already served her with a copy of a complaint? [42:34.820 --> 42:44.820] In fact, did they even show that they had a complaint? And he said, no, they were using the citation in lieu of a complaint, which introduced the two problems I discussed earlier. [42:44.820 --> 43:04.820] One, 27.14D authorizes the citation to be used in lieu of a complaint only if there is a signed waiver that is signed by both the accused and the prosecutor that has been filed with the court. [43:04.820 --> 43:13.820] They have to both agree on it. They have to both sign the waiver and that has to be filed with the court before the citation can be used as a complaint. [43:13.820 --> 43:24.820] However, the problem that creates is the citation is not compliant with the requisites of a complaint under 5 or under 45.019 of the Code of Criminal Procedure. [43:24.820 --> 43:32.820] There are four requisites of a complaint a citation does not meet at all. [43:32.820 --> 43:47.820] Okay, now that sets up a jurisdictional problem for the court, which I'll get to when we get back after this break, so y'all hang in there. Randy, if you'll hang on for just a minute, let us discuss that, and then if you need to go, we can do with that afterwards, okay? [43:47.820 --> 43:48.820] Okay. Now, as I was saying about the jurisdictional issue that now exists because of the lack of complaint, since the courts have set the minimum bar to jurisdiction in the justice and municipal courts to be the filing of a sworn complaint, [46:39.820 --> 46:59.820] 27.14D has a jurisdictional violation associated with using the citation in lieu of a complaint because the citation does not meet the statutory requisites of a complaint. It is not sworn in any way, shape, or form as is required on a complaint. [46:59.820 --> 47:11.820] There is no assertion of I have reason to believe and do believe. None of the required language for four of the things required of a complaint are on a citation. [47:11.820 --> 47:28.820] Nowhere is the citation authorized to invest the court with jurisdiction, but then again, neither is a complaint. But since the courts themselves have set the minimum bar to that of a complaint, the citation alone is insufficient to invoke it. [47:28.820 --> 47:30.820] What do you think of that argument? [47:30.820 --> 47:39.820] Okay. The court is going to say that they have been authorized to use the citation in lieu of a complaint. [47:39.820 --> 48:03.820] But based on your argument here, you can claim that, well, perhaps you could use the citation in lieu of a complaint if the citation met the requisites of a complaint. But since the municipality or whatever the county, whoever wrote the citation, [48:03.820 --> 48:11.820] failed to provide a citation that met the requirements of a complaint, then it is still insufficient. [48:11.820 --> 48:31.820] Correct. You can also throw one other thing into this. Not only is this insufficient for the requisites of a complaint, it's insufficient for the requisites of an actual citation as 99.9% of them do not meet the requirements of 708.105 of the transportation code either. [48:31.820 --> 48:33.820] 708.15? [48:33.820 --> 48:35.820] 105. [48:35.820 --> 48:39.820] 105. [48:39.820 --> 49:01.820] I am going to have so much fun with this. My favorite thing to do is file a challenge subject matter jurisdiction. Because you get to come in with a challenge subject matter jurisdiction and push back on them. And for the most part, they tend not to realize that you understand. [49:01.820 --> 49:14.820] But we were helping people with foreclosure issues and trying to stop evictions. And I would come into the court at the last minute with a 30 or 40 page challenge subject matter jurisdiction. [49:14.820 --> 49:25.820] Judge Hayes in Mansfield got into his court and they started to hearing an objection, Your Honor, I'm here at arm's length to the court. I have a challenge subject matter jurisdiction before the court. [49:25.820 --> 49:28.820] Yes, Mr. Colonel, you just filed that 20 minutes ago. [49:28.820 --> 49:32.820] Yes, Your Honor, as a matter of fact, I did. It was 38 pages. [49:32.820 --> 49:36.820] Well, Mr. Colonel, I'm going to dismiss your challenge subject matter jurisdiction. [49:36.820 --> 49:42.820] So, you're going to dismiss that challenge subject matter jurisdiction without even reading it? [49:42.820 --> 49:54.820] Yes, Mr. Colonel, I am. We're done here. I closed my case. My folder got up and got to the bar and pointed at the best way that you come with me and left the courtroom. [49:54.820 --> 50:01.820] That's what you should do when they fail to act on a challenge subject matter jurisdiction. [50:01.820 --> 50:11.820] The hearing stops right there. The judge, as a rule, especially if he's a lawyer, he knows. But they think you don't know. [50:11.820 --> 50:32.820] A challenge subject matter jurisdiction, when you walk in the court, when the officer makes an accusation against you, the court accepts that as valid and sufficient to give the court subject matter jurisdiction on its face. [50:32.820 --> 50:45.820] However, if you raise an objection to the subject matter jurisdiction, and in order to do that, you need to bring some evidence to show that the original pleading was insufficient, [50:45.820 --> 50:57.820] then that original prima facie complaint is no longer sufficient and subject matter jurisdiction is lost. [50:57.820 --> 51:07.820] And the plaintiff doesn't have to prove jurisdiction. The court has to prove jurisdiction. [51:07.820 --> 51:11.820] Jurisdiction may not be presumed. It must be presumed. [51:11.820 --> 51:13.820] Wait, wait, wait. Let me interrupt. Let me interrupt. [51:13.820 --> 51:14.820] Go ahead. [51:14.820 --> 51:24.820] Court has no power to prove jurisdiction. The moving party must prove the court has jurisdiction. That would be the prosecutor. [51:24.820 --> 51:38.820] It is the court's duty to establish jurisdiction. Now, they can ask the moving party to provide evidence to overcome your objection. [51:38.820 --> 51:48.820] And that's what they must do. They may not presume. They cannot move ahead unless subject matter jurisdiction is proven. [51:48.820 --> 52:00.820] And the court has the duty. That was a fine distinction I was making. The court cannot just act on its own. [52:00.820 --> 52:05.820] Yeah. They cannot assume jurisdiction. It has to be invoked by one of the parties. [52:05.820 --> 52:19.820] Jurisdiction must be proven, and it's the court that must ensure that it's proven. So now the court has to go to the plaintiff, who's the only one who can prove it, and the plaintiff must bring evidence to prove jurisdiction. [52:19.820 --> 52:26.820] Well, for the most part, the judges just blow off jurisdiction if they think you don't know any better. [52:26.820 --> 52:39.820] And when they do that, the correct move, because you're there at arm's length to the court. And by that, you're not accepting the jurisdiction of the court. [52:39.820 --> 52:50.820] You're not stipulating to it. So you have no duty to answer to the court. That's why I walked out. [52:50.820 --> 52:58.820] And then the court will rule against you as a matter of course, and then you come back and file criminally against the judge. [52:58.820 --> 53:16.820] We start doing this, especially if you're in Tarrant County, because we have the door open in Tarrant County. In Tarrant County, we actually have a good prosecutor. [53:16.820 --> 53:28.820] You can file criminal complaints against public officials in Tarrant County yourself without any interference from the prosecuting attorney. [53:28.820 --> 53:44.820] I interviewed Sharon Wilson on my show before she got elected. And before the show, I did an interview with her and went through the code, so she realized I knew the code at least as well as she did. [53:44.820 --> 53:53.820] So I went to the Tarrant County District Attorney's Office with criminal charges against the Dallas County District Attorney. [53:53.820 --> 54:02.820] And this was a test. And the district attorney there said, well, Mr. Keltner, you should take those to Dallas County. [54:02.820 --> 54:11.820] I said, well, if you read the complaint, the complaint alleges that I took complaints against public officials to the Dallas County District Attorney. [54:11.820 --> 54:21.820] And he had been removed from the courtroom, from the building by people with loaded pistols on their hips to prevent me from filing complaints with the grand jury. [54:21.820 --> 54:28.820] That is the allegation, first degree felony aggravated assault, 2202-B2A, takes spin code. [54:28.820 --> 54:46.820] So it's inappropriate to ask me to go back to Dallas County and risk being removed from the courtroom, I mean, from the courthouse again by people with loaded pistols who has professed their willingness to use those loaded pistols against me. [54:46.820 --> 55:02.820] And besides, while a district judge who impanels a grand jury has a venue restriction, there's nothing in the code that extends that venue restriction to the grand jury. [55:02.820 --> 55:12.820] They looked at the code. They looked for case law. I asked them, find case law. If I'm wrong, find it. Show me. I can't find it. [55:12.820 --> 55:21.820] When I went down with criminal complaints against the Dallas County District Attorney, the Tarrant County District Attorney stood aside. [55:21.820 --> 55:32.820] I got a letter from the grand jury saying we examined into your accusations and find no Tarrant County offenses subject to indictment. [55:32.820 --> 55:52.820] Paragraph before that, he cited 20.09 that says a grand jury shall investigate into all offenses subject to indictment that come by way of the knowledge of any grand jury member by way of the prosecuting attorney or any credible person. [55:52.820 --> 56:03.820] What part of all offenses subject to indictment did the foreman not understand? [56:03.820 --> 56:14.820] So I went back and filed criminal charges against the foreman of the grand jury for shielding from prosecution under 3805 Penal Code. [56:14.820 --> 56:30.820] Now we'll see how that works out. But we're getting the door pried open to the grand jury. So when you go into the challenge subject matter jurisdiction and the judge pulls his standard shenanigan and refuses to rule on it or just rules against it, [56:30.820 --> 56:35.820] you walk out of the courtroom, go straight to the grand jury and file criminal charges against the judge. [56:35.820 --> 56:54.820] So you want to play hardball, bubba? We'll introduce you to the deep end of the pool. And their problem is you can not only go to the Travis County grand jury, you can go to any of the 254 grand juries in the state of Texas. [56:54.820 --> 57:06.820] And not only can you go to them, you can keep going to them until the statute of limitations on the accusation runs. [57:06.820 --> 57:13.820] We start doing that. We'll change everything. That's my story and I'm sticking to it. [57:13.820 --> 57:15.820] As usual. [57:15.820 --> 57:18.820] As usual. [57:18.820 --> 57:28.820] But what I want to do now, the one that just came up recently was this, securing and executing a document by deception. [57:28.820 --> 57:36.820] They have you sign this for one purpose and then coerce you into another purpose. [57:36.820 --> 57:51.820] You sign a degree to appear before a magistrate and they force you to appear before a judge. I call that a conspiracy between the judge and the police officer to secure and execute a document by deception. [57:51.820 --> 57:53.820] That's a valid statement. [57:53.820 --> 57:55.820] Yeah, found reasonable. [57:55.820 --> 58:05.820] That's my story I'm sticking to it. I'm hoping that maybe you'll research that out for me to make sure I haven't missed it. [01:12:16.820 --> 01:12:23.820] And being that California Highway Patrol have statewide jurisdiction, they were classified under that. [01:12:23.820 --> 01:12:32.820] So I contacted the secretary of state, and they told me that that was the right place of contacting to get a copy of the oath of office. [01:12:32.820 --> 01:12:42.820] But they told me that they do not keep any oath of office on file for the CHP, that the CHP headquarters keeps them on file. [01:12:42.820 --> 01:12:53.820] And so my question is, that's not really my problem if they don't have that on file with them because— [01:12:53.820 --> 01:13:04.820] Not if the law specifically requires them to have it, but if it doesn't, then some other custodian of records could have it, and that's who you have to file with to get it. [01:13:04.820 --> 01:13:10.820] Whoever the officially, statutorily defined custodian of records for that information is, is who will have it. [01:13:10.820 --> 01:13:17.820] If it's not the secretary of state, it is in fact the DPS, then that's who you have to get it from. [01:47:01.820 --> 01:47:07.820] That's the only way you can challenge the evidentiary issues that you were discussing in this email [01:47:07.820 --> 01:47:13.820] with the driving record and all that other stuff that was brought in by the prosecuting attorney [01:47:13.820 --> 01:47:17.820] and allowed by the judge even over your hearsay objection. [01:47:17.820 --> 01:47:25.820] Without that appeal of that misapplication or introduction of evidence in that way, [01:47:25.820 --> 01:47:28.820] the evidence issue is out of hand now. [01:47:28.820 --> 01:47:34.820] The only thing that would leave you able to do is challenge original jurisdiction of the court, [01:47:34.820 --> 01:47:40.820] which you would have to show why they never had jurisdiction in the first place. [01:47:40.820 --> 01:47:42.820] That's where your issues are. [01:47:42.820 --> 01:47:51.820] That's why the district court said we can't help you here. [01:47:51.820 --> 01:47:59.820] Okay, so my answer should be just focused on subject matter jurisdiction, anything to do with jurisdiction. [01:47:59.820 --> 01:48:01.820] As far as at this point, yes. [01:48:01.820 --> 01:48:07.820] If you're outside of your time to perfect an appeal, that's going to be your only option, [01:48:07.820 --> 01:48:17.820] unless, of course, you can file and get it remanded for a new trial by seeking a new trial from the higher court. [01:48:17.820 --> 01:48:19.820] But you're going to have to have a good faith basis, [01:48:19.820 --> 01:48:24.820] and you're going to have to show that the evidence that was used to get the conviction was actually inadmissible [01:48:24.820 --> 01:48:30.820] and should have been suppressed, and that's all you can do at this point. [01:48:30.820 --> 01:48:38.820] It's not right, it's not just, but it is just exactly how the lawyers want it. [01:48:38.820 --> 01:48:44.820] Okay, so what you're telling me is even though I went through the public process, through the court of appeals... [01:49:47.820 --> 01:49:52.820] Do you have the transcript that shows that was the case? [01:49:52.820 --> 01:49:54.820] I don't have it, but I can get it. [01:49:55.820 --> 01:49:59.820] How can they tell you in one breath your administrative remedies are done, [01:49:59.820 --> 01:50:04.820] and in the next breath deny you anything because your administrative remedies aren't done? [01:52:41.820 --> 01:52:48.820] Although I do have a question, and the question is, since she was on private property being the mall, [01:52:48.820 --> 01:52:53.820] does the officer have the jurisdiction to give her a parking citation? [01:52:53.820 --> 01:53:03.820] Because the officer was arguing that she was parked in a hydrant zone, when in reality she was just parked in a red zone. [01:53:03.820 --> 01:53:09.820] And he got her driver's license when she was walking to the car. [01:53:09.820 --> 01:53:16.820] Apparently he stopped when she was going to the car, got mad at her, took her license, gave her the citation, [01:53:16.820 --> 01:53:28.820] and then he parked his car there and got down and went into the mall, leaving it in the red zone, kind of adding the insult to the injury. [01:53:28.820 --> 01:53:37.820] But generally my question basically was, did he even have the jurisdiction to give the citation since they were on private property? [01:53:37.820 --> 01:53:41.820] If you wanted it to be an honest answer, that would be no. [01:53:41.820 --> 01:53:45.820] If you want it to be a legal answer, that depends. [01:53:45.820 --> 01:53:48.820] Okay. [01:53:48.820 --> 01:53:50.820] I understand that. [01:53:50.820 --> 01:53:54.820] Now how is the depends on the legal system explained? [01:53:54.820 --> 01:54:05.820] The depends on that aspect of it is, one, was this officer operating within his jurisdiction when he wrote the ticket as far as county, city, and so forth? [01:54:05.820 --> 01:54:18.820] Is this particular parking spot something that the state regulates in accordance with, you know, the Disability Acts or the Fire Safety Act or anything in that regard? [01:54:18.820 --> 01:54:29.820] The fact of the matter is, I personally fail to see how the state or the municipalities can enforce any of those regulations on private property. [01:54:29.820 --> 01:54:39.820] The claim that it's publicly accessible, so what? Anybody can drive up in my yard, that doesn't necessarily make it publicly accessible. [01:54:39.820 --> 01:54:48.820] And even if I do allow people to come through my yard, that still doesn't make it public property. [01:54:48.820 --> 01:54:53.820] But in any case, you're going to lose that argument if you try to make it. [01:54:53.820 --> 01:54:59.820] The question is, is what was he using as the authority to issue the citation? [01:54:59.820 --> 01:55:06.820] If he was using the transportation code, therein lies his problem. [01:55:06.820 --> 01:55:07.820] Correct. [01:55:07.820 --> 01:55:08.820] And your benefit. [01:55:08.820 --> 01:55:13.820] That's why I believe he demanded to see her driver's license. [01:55:24.820 --> 01:55:36.820] There will never be an issue of coercion that will be recognized by a court if there was any volunteering of the information. [01:55:36.820 --> 01:55:44.820] In other words, if he did not forcibly take it, you volunteered it, no matter how much he was threatening you. [01:55:44.820 --> 01:55:47.820] Even if she's fined under the citation... [01:55:47.820 --> 01:55:49.820] That is correct. [01:55:49.820 --> 01:55:56.820] Wow. Okay. Okay. Fair enough. So she basically... [01:55:56.820 --> 01:56:00.820] What did they charge her with? [01:56:00.820 --> 01:56:04.820] It was blocking a fire hydrant. [01:56:52.820 --> 01:57:01.820] Where does it say red is no parking in a way that you can enforce it with the power of the state with a citation? [01:57:01.820 --> 01:57:03.820] Because the citation says, I blocked the hydrant. [01:57:03.820 --> 01:57:07.820] You're admitting there is no hydrant. [01:57:07.820 --> 01:57:08.820] You see? [01:57:12.820 --> 01:57:20.820] Yeah, but in order to get her pictures in, she's either going to have to get the cop to agree that those pictures are of that location, [01:57:20.820 --> 01:57:27.820] or she's going to have to take the stand and submit them herself by testifying as to what the pictures are, [01:57:27.820 --> 01:57:40.820] at which point the prosecutor gets to cross-examine her and tear up any point she tries to make in relation to that if she doesn't know how to keep her head and keep it intact.
