[07:50.360 --> 07:55.800]  What Steve and I wanted to talk about tonight was grand juries.
[07:55.800 --> 08:00.760]  A lot of issues with grand juries and around the country there is a tremendous amount of
[08:00.760 --> 08:05.640]  focus on grand juries at the moment.
[08:05.640 --> 08:17.040]  And if ever there was a right time to make some positive changes concerning grand juries
[08:17.040 --> 08:20.320]  now is that time.
[08:20.320 --> 08:23.640]  And it's not enough just to make changes.
[08:23.640 --> 08:29.280]  We need to make changes that will have an effect.
[08:29.280 --> 08:34.080]  And those of you who have been listening to the show for a while, you pretty well know
[08:34.080 --> 08:44.080]  that I've been working on this issue for a very long time trying to figure out first
[08:44.080 --> 08:49.520]  what was wrong with the system because in 1981 I spent the night in jail for driving
[08:49.520 --> 08:54.040]  the headlight out and that didn't seem right.
[08:54.040 --> 08:59.560]  So I got out the penal code and code of criminal procedure and I read them.
[08:59.560 --> 09:07.320]  And then I looked at the practice and I felt as if I had stepped through the looking glass.
[09:07.320 --> 09:16.000]  I could not imagine how the practice of law could be so dramatically different than the
[09:16.000 --> 09:18.000]  code.
[09:18.000 --> 09:25.920]  So I spent the next 15 years or so researching to figure out what it was I had missed.
[09:25.920 --> 09:33.680]  Took a long time, but it finally became clear I hadn't missed anything.
[09:33.680 --> 09:44.480]  That what public officials were doing absolutely was wrong.
[09:44.480 --> 09:51.880]  So then it took another 15 years to figure out what the solution was.
[09:51.880 --> 10:01.360]  And as an engineer, I always look for the simplest adjustment I can make to a system
[10:01.360 --> 10:06.080]  to achieve the intended outcome.
[10:06.080 --> 10:10.120]  Anyone can make a system complex.
[10:10.120 --> 10:16.440]  Anyone can craft a complex and convoluted solution.
[10:16.440 --> 10:19.840]  And for the most part, they don't work well.
[10:19.840 --> 10:31.720]  And over this time, the problem has boiled down to something very, very small and seemingly
[10:31.720 --> 10:35.360]  insignificant.
[10:35.360 --> 10:41.640]  But it's boiled down to the grand juries, and not just grand juries.
[10:41.640 --> 10:45.400]  The grand juries, the way they are, you know, we've got people out there wanting to go back
[10:45.400 --> 10:47.800]  to common law grand juries.
[10:47.800 --> 10:48.800]  Waste of time.
[10:48.800 --> 10:50.360]  We don't need a common law grand jury.
[10:50.360 --> 10:52.200]  The grand juries we've got are just fine.
[10:52.200 --> 10:54.400]  There's nothing wrong with them.
[10:54.400 --> 10:57.400]  Don't need to fix them.
[10:57.400 --> 11:02.640]  We might want to make some minor adjustments in how grand juries are selected, but even
[11:02.640 --> 11:12.440]  that is not so important as the one minor adjustment.
[11:12.440 --> 11:22.080]  What we need to do most of all is make grand juries accessible and available to private
[11:22.080 --> 11:26.120]  citizens.
[11:26.120 --> 11:34.720]  That will change everything, and prosecuting attorneys have really struggled to prevent
[11:34.720 --> 11:39.440]  that, because it makes their job more difficult.
[11:39.440 --> 11:46.960]  They actually have to do their job, and you know, everything is essentially political.
[11:46.960 --> 11:54.680]  And when you have a prosecuting attorney working with people every day, the last thing he wants
[11:54.680 --> 12:03.480]  to have to do is prosecute one of those people, especially if it's a police officer, because
[12:03.480 --> 12:07.720]  the prosecutor wind up like the mayor of New York with all the police turning their back
[12:07.720 --> 12:10.840]  on him.
[12:10.840 --> 12:15.720]  And so prosecutors are very, very reluctant to act on a criminal complaint.
[12:15.720 --> 12:24.440]  Craig Watkins received during his tenure over 900 criminal complaints against public officials,
[12:24.440 --> 12:30.040]  and he did not act on a single one.
[12:30.040 --> 12:36.560]  This is pretty well endemic across the state and across every state I've been to.
[12:36.560 --> 12:43.960]  And the Fed, the federal attorneys really struggle to prevent a citizen from giving
[12:43.960 --> 12:46.960]  notice of crime to a grand jury.
[12:46.960 --> 12:58.400]  So during this next legislative session, we intend to lobby for new law, not so much new
[12:58.400 --> 13:06.200]  law overall, but just a minor adjustment to the existing law.
[13:06.200 --> 13:15.320]  Apologize for the delay, I forgot my book.
[13:15.320 --> 13:21.120]  I'm going to read to you chapter 20 of the Code of Criminal Procedure.
[13:21.120 --> 13:34.320]  I don't see if you take from it what I did, or at least a part of it, 20.09 Texas Code
[13:34.320 --> 13:39.040]  of Criminal Procedure, duties of grand jury.
[13:39.040 --> 13:46.760]  The grand jury shall inquire into all offenses liable to indictment of which any member of
[13:46.760 --> 13:53.600]  any member may have knowledge or of which they shall be informed by the attorney representing
[13:53.600 --> 14:00.160]  the state or any other credible person.
[14:00.160 --> 14:14.920]  Now, what we want to do is adjust Article 2010 to implement the requirements of Article
[14:14.920 --> 14:15.920]  20.09.
[14:15.920 --> 14:21.440]  The attorney representing the state, the foreman in term or on vacation may issue a summons
[14:21.440 --> 14:29.360]  attachment for any witness in the county where they are sitting, which summons or attachment
[14:29.360 --> 14:36.880]  may require the witness to appear before them at a fixed time forthwith without stating
[14:36.880 --> 14:38.760]  the matter of investigations.
[14:38.760 --> 14:48.600]  What we want to do is add to 2010 paragraph A that will require the grand jury to sit
[14:48.600 --> 14:55.480]  at least once a month to hear complaints by private citizens.
[14:55.480 --> 15:04.200]  Now, it seems like a relatively minor adjustment.
[15:04.200 --> 15:15.640]  As concerns a legislator, if you go to a legislator and ask the legislator to propose law, the
[15:15.640 --> 15:21.320]  legislator is going to want a white paper, and what the white paper is, is it explains
[15:21.320 --> 15:29.880]  the law, explains why we need the law, and then it demonstrates how the law will fit
[15:29.880 --> 15:38.920]  into the corpus juris, the body of law, to make sure that the passing of this law doesn't
[15:38.920 --> 15:46.040]  run afoul of any other pre-existing laws, or if it does, then those laws need to be a change
[15:46.040 --> 15:50.600]  to accommodate the new statute that you want passed.
[15:50.600 --> 15:57.840]  And then you have to show the legislator where they'll get the money to pay for the implementation
[15:57.840 --> 15:58.840]  of this law.
[15:58.840 --> 16:08.160]  Well, in this case, it doesn't cost anything because the grand jury is meeting anyway,
[16:08.160 --> 16:16.240]  and since it only requires them to meet in order to do what the statute requires them
[16:16.240 --> 16:23.360]  to do, then it doesn't in any way interfere with the authority of the grand jury.
[16:23.360 --> 16:32.040]  So there's no corpus juris issue, there's no cost issue, but there should be a lot of
[16:32.040 --> 16:45.040]  political gains available to one of our legislators with the whole country up in arms over dissatisfaction
[16:45.040 --> 16:52.800]  of the rulings of grand jurors, and distrust of prosecuting attorneys as they deal with
[16:52.800 --> 16:56.240]  those grand jurors.
[16:56.240 --> 16:59.240]  The legislator...

[20:49.920 --> 20:57.160]  for the public integrity unit, and we are of the opinion that that was the right thing

[21:23.620 --> 21:31.760]  The way I see the public integrity unit is that it's an office that was put in place
[21:31.760 --> 21:39.320]  to shield our public officials from prosecution.
[21:39.320 --> 21:50.680]  And I've got the Texas Tribune from, what is this dated, I'm not seeing a date.
[21:50.680 --> 21:54.480]  Anyway, I don't guess it's of much consequence.
[21:54.480 --> 21:56.040]  Public integrity unit.
[21:56.040 --> 22:02.200]  The public integrity unit is a state-funded division of the Travis County District Attorney's
[22:02.200 --> 22:06.240]  Office.
[22:06.240 --> 22:12.920]  It investigates public corruption, insurance fraud, and motor fuel tax fraud.
[22:12.920 --> 22:23.200]  The Travis County DA holds the chief responsibility for enforcing the government and election
[22:23.200 --> 22:26.200]  codes statewide.
[22:26.200 --> 22:30.880]  The unit was created under the leadership of Ronnie Earl, you've heard that name on
[22:30.880 --> 22:39.720]  this radio show before, who served as Travis County DA for three decades until his retirement
[22:39.720 --> 22:41.520]  in 2008.
[22:41.520 --> 22:50.840]  Earl captured national attention when his investigation into the U.S. Senate Kay Bailey
[22:50.840 --> 23:00.880]  Hutchison and former U.S. Rep Tom DeLay from Sugarland and became the poster child for
[23:00.880 --> 23:08.180]  Republican view as the unit's politically motivated prosecutions.
[23:08.180 --> 23:15.680]  He told the Texas Tribune that he started the unit in the early 80s and in the early
[23:15.680 --> 23:24.840]  80s because, quote, it made no sense to me to see an aggravated robbery case next to
[23:24.840 --> 23:32.720]  a case about a state employee cheating on a travel voucher, end quote.
[23:32.720 --> 23:34.240]  That was his excuse.
[23:34.240 --> 23:40.240]  At the time, Earl says the investigation of the government crimes, the investigation of
[23:40.240 --> 23:48.560]  government crimes was a, quote, mostly left to the newspapers, end quote, and that was
[23:48.560 --> 23:49.560]  correct.
[23:49.560 --> 23:53.200]  That part, I can't agree more with him on that.
[23:53.200 --> 24:00.020]  Because the Travis County DA spent most of its time fighting street crimes, dismantling
[24:00.020 --> 24:07.760]  the unit is a perennial platform plank for the Texas Republican Party and numerous members
[24:07.760 --> 24:18.000]  of the GOP, including DeLay and Hutchison, Hutchison, sorry, no N in the middle.
[24:18.000 --> 24:26.320]  They've criticized what they view as a politically motivated, as politically motivated prosecutions.
[24:26.320 --> 24:36.140]  According to Earl, between 2000, I'm sorry, between 1978 and when he retired in 2008,
[24:36.140 --> 24:42.680]  he prosecuted 19 election officials, just five of whom were Republican.
[24:42.680 --> 24:50.000]  Kathy Adams and former Republican Party of the Texas chair filed an equal protection
[24:50.000 --> 24:59.080]  lawsuit over the issues in federal court last year from, I guess, whenever this is written.
[24:59.080 --> 25:06.720]  Her argument, why should the voters of Travis County get to elect an official who has the
[25:06.720 --> 25:13.960]  power of, of the power to prosecute offenses statewide?
[25:13.960 --> 25:17.320]  That's a good argument.
[25:17.320 --> 25:20.680]  How can one county vote for the whole state?
[25:20.680 --> 25:23.520]  Doesn't the whole state have to vote for the whole state?
[25:23.520 --> 25:29.320]  Yeah, that, that authority should go to the attorney general.
[25:29.320 --> 25:34.640]  I mean the, the authority to prosecute statewide.
[25:34.640 --> 25:35.640]  Yes.
[25:35.640 --> 25:36.640]  Yes.
[25:36.640 --> 25:37.640]  Okay.
[25:37.640 --> 25:49.320]  A frequently, frequently proposed solution and one that state Senator Dan Patrick, Republican
[25:49.320 --> 25:56.120]  from Houston put forth unsuccessfully during the last legislative session would be to put
[25:56.120 --> 26:05.380]  state corruption probes under the statewide election, elected attorney general.
[26:05.380 --> 26:15.880]  So that's how the public integrity unit came into, was, was put in place and who created
[26:15.880 --> 26:18.120]  it, Ronnie Earl.
[26:18.120 --> 26:23.080]  Now you've met Ronnie Earl, haven't you?
[26:23.080 --> 26:26.480]  I haven't actually, I never actually met him.
[26:26.480 --> 26:27.480]  I had a dealings.
[26:27.480 --> 26:28.480]  Very familiar with him.
[26:28.480 --> 26:31.960]  Oh yeah, I had dealings with him, but I never actually met him.
[26:31.960 --> 26:32.960]  Okay.
[26:32.960 --> 26:39.480]  Well, Ronnie Earl was a district attorney in Travis County until January, 2009.
[26:39.480 --> 26:47.800]  He gained national, well, oh, let me just, okay, this is, I'm going to a key wiki now

[27:43.320 --> 27:48.080]  I'm not, that doesn't make any sense and he's not going down that rabbit hole.
[27:48.080 --> 27:54.960]  But anyway, Ronnie Earl's got some ties, boys and girls, he's got some clout.

[28:27.760 --> 28:32.800]  And to this day, that's what it's being used for or I've tried to, I've tried to get to
[28:32.800 --> 28:38.480]  the, to the DA, DA said, I can't, I can't go where you want me to go.

[28:42.480 --> 28:48.480]  APD sends me to the AG, the AG sends me to the bar, the bar sends me back to the, to

[35:24.120 --> 35:31.320]  court having jurisdiction any officer for neglect or failure of any duty enjoined upon
[35:31.320 --> 35:37.000]  such officer when such neglect or failure can be presented by information.
[35:37.000 --> 35:41.840]  Whenever it shall come to the knowledge of said attorney that there has been a neglect
[35:41.840 --> 35:51.720]  or failure of a duty upon the part of said officer, what part of that is hard to understand?
[35:51.720 --> 35:54.920]  It shall be the duty.
[35:54.920 --> 35:59.840]  It doesn't say anything about prosecutorial discretion.
[35:59.840 --> 36:09.960]  Oh, and the government code clearly defines the word shall as imposing a duty.
[36:09.960 --> 36:12.800]  Does not mean may, might, or can if he wants to.
[36:12.800 --> 36:14.840]  No, there's no discretion.
[36:14.840 --> 36:21.960]  If you look in the Code of Criminal Procedure under duties of officers, the very first one,
[36:21.960 --> 36:26.400]  2.01, says it shall be the primary duty of the prosecuting attorney not to secure conviction
[36:26.400 --> 36:31.160]  but to ensure that justice is served shall not seek witnesses or evidence to show the
[36:31.160 --> 36:34.640]  innocence of the accused and mitigate the guilt of the accused.
[36:34.640 --> 36:35.880]  Okay.
[36:35.880 --> 36:44.040]  That's nice high-minded rhetoric, but it really doesn't direct the prosecutor to do a specific
[36:44.040 --> 36:45.040]  thing.
[36:45.040 --> 36:47.040]  It tells him things he shouldn't do.
[36:47.040 --> 36:55.920]  2.02 says the prosecutor will handle suits against the state and felonies.
[36:55.920 --> 36:59.880]  County attorney will handle suits against the county and misdemeanors.
[36:59.880 --> 37:09.000]  2.03, the very first statute that imposes a duty on the prosecuting attorney and they
[37:09.000 --> 37:10.000]  don't do it.
[37:10.000 --> 37:20.520]  On 2.04, 2.05, 2.06, that defines the standard prosecutorial behavior in a case that does
[37:20.520 --> 37:22.800]  not involve a public official.
[37:22.800 --> 37:24.960]  2.03 comes first.
[37:24.960 --> 37:31.960]  It must be construed as a special statute and given special emphasis and they do.
[37:31.960 --> 37:34.960]  They threw it in the trash.
[37:34.960 --> 37:41.080]  I mean, they don't do that with all the others.
[37:41.080 --> 37:43.120]  Emphasis on the circular file.
[37:43.120 --> 37:44.120]  Exactly.
[37:44.120 --> 37:47.040]  And it's real clear.
[37:47.040 --> 37:58.920]  I think we have a prosecuting attorney in Tarrant County that will actually follow the code.
[37:58.920 --> 38:04.360]  And I'm coming down to Austin this weekend, but when I get back, I wanted to give her
[38:04.360 --> 38:08.800]  a week or so in office before I went to her.
[38:08.800 --> 38:20.560]  But I do plan on going down to welcome Sharon Wilson to the deep end of the pool.
[38:20.560 --> 38:24.480]  We're going to test her resolve to follow code because I'm going to take her a set of
[38:24.480 --> 38:31.280]  criminal complaints against Craig Watkins, district attorney for Dallas County.
[38:31.280 --> 38:38.560]  And I'm going to accuse Craig Watkins of exerting or purporting to exert an authority he does
[38:38.560 --> 38:46.720]  not have by denying me access to the grand jury, by having me removed from the building
[38:46.720 --> 38:53.440]  by people with loaded pistols in order to prevent me from giving criminal complaints
[38:53.440 --> 38:58.240]  against the local judge to the grand jury.
[38:58.240 --> 39:05.160]  And I expect her to say, well, you know, you really need to take this to Dallas County.
[39:05.160 --> 39:09.000]  And I'm going to tell her, well, show me that in code.
[39:09.000 --> 39:12.960]  She'll say, I don't have jurisdiction over Dallas County.
[39:12.960 --> 39:16.560]  And I don't care what you have.
[39:16.560 --> 39:21.160]  I care about what the grand jury has.
[39:21.160 --> 39:24.120]  So I'm going to take the complaints to the grand jury.
[39:24.120 --> 39:30.240]  I'm not going to take them to her and I'm going to let her know I'm going to do this.
[39:30.240 --> 39:34.560]  And I want you not to interfere.
[39:34.560 --> 39:41.760]  And if she claims they don't have jurisdiction, then if you go before a grand jury and tell
[39:41.760 --> 39:49.760]  them they don't have jurisdiction, I'm going to charge you with jury tampering and then
[39:49.760 --> 39:57.560]  you're going to have to come into the court and show statute verse case law supporting
[39:57.560 --> 40:04.160]  your assertion that the grand jury doesn't have jurisdiction.
[40:04.160 --> 40:05.520]  Good luck if she could find it.
[40:05.520 --> 40:09.280]  I certainly can't.
[40:09.280 --> 40:17.560]  And the librarian for the University of Texas law library couldn't find it either.
[40:17.560 --> 40:20.160]  The courts are silent on that issue.
[40:20.160 --> 40:22.720]  I find nothing.
[40:22.720 --> 40:34.560]  So what I'm going to say is 2.09 says the grand jury shall investigate into all crimes
[40:34.560 --> 40:37.640]  subject to indictment.
[40:37.640 --> 40:43.500]  It does not say all crimes within a specific venue.
[40:43.500 --> 40:51.640]  The implication is, is that because a district judge impanels the grand jury, that the grand
[40:51.640 --> 41:01.560]  jury's jurisdiction or grand jury's venue is limited to the venue of the judge.
[41:01.560 --> 41:03.040]  That's a false assertion.
[41:03.040 --> 41:06.440]  There's nothing in law to indicate such a thing.
[41:06.440 --> 41:15.920]  Now there is something in law that specifically stipulates where a state judge who has subject
[41:15.920 --> 41:20.680]  matter jurisdiction throughout the state.
[41:20.680 --> 41:28.340]  There is law that specifically limits the ability of the judge to exercise that jurisdiction
[41:28.340 --> 41:34.940]  outside a specific physical boundary.
[41:34.940 --> 41:37.280]  It's called venue.
[41:37.280 --> 41:45.760]  While he has jurisdiction everywhere, he only has venue within this local area.
[41:45.760 --> 41:55.240]  Now the legislature made it a point to indicate venue as concerns district courts, district
[41:55.240 --> 41:57.240]  judges.
[41:57.240 --> 42:03.480]  It must be construed that if the legislature intended that the jurisdiction of a grand
[42:03.480 --> 42:12.600]  jury be likewise limited, they would have said so, but they did not.
[42:12.600 --> 42:19.480]  Therefore it's my position that they have jurisdiction throughout the state.
[42:19.480 --> 42:30.200]  Well if it was the intent of the legislature to deny them that, then it would have been
[42:30.200 --> 42:31.200]  written.
[42:31.200 --> 42:35.480]  Yes, so I'm going to ask the prosecutor.
[42:35.480 --> 42:37.160]  Yeah, how else are we?
[42:37.160 --> 42:44.080]  Okay, you're working with let's say the Dallas Good Ol' Boy Club or the Houston Good Ol'
[42:44.080 --> 42:46.720]  Boy Club or the Austin or the Podunk.
[42:46.720 --> 42:47.840]  It doesn't matter.
[42:47.840 --> 42:48.840]  It's a clique.
[42:48.840 --> 42:55.400]  Everybody's in it for their own personal gains and public be damned, okay?
[42:55.400 --> 43:04.600]  But even taking it not quite as cynical as that, no prosecutor should be put in a position
[43:04.600 --> 43:09.600]  to where he has to prosecute somebody he works with every day.
[43:09.600 --> 43:15.280]  And the legislature, they said, that's right, he shouldn't be put in that position or have
[43:15.280 --> 43:21.720]  it put in a position to make a determination as to whether or not to prosecute.
[43:21.720 --> 43:26.280]  So they took that away from him and gave it to the grand jury.
[43:26.280 --> 43:34.040]  He should not be put in that position because even if he wants to, it's almost impossible
[43:34.040 --> 43:38.520]  to be unbiased in those circumstances.
[43:38.520 --> 43:43.000]  The legislature got that, so they said, okay, you get a complaint against a public official,
[43:43.000 --> 43:46.520]  you give it to the grand jury and get away from it.
[43:46.520 --> 43:52.200]  Let the grand jury handle it that way you're not on that die.
[43:52.200 --> 43:53.200]  You hear the music?
[43:53.200 --> 43:54.200]  Nope.

[01:06:28.400 --> 01:06:36.400]  And it is a vehicle, and I am a licensed driver, but I just don't use that license.
[01:06:36.400 --> 01:06:41.400]  And I don't use the vehicle in the capacity of a vehicle.
[01:06:41.400 --> 01:06:44.400]  I use it in the capacity of a private conveyance.
[01:06:44.400 --> 01:06:54.400]  And I have given them public notice of that fact by displaying the number on the tailgate.
[01:06:54.400 --> 01:07:01.400]  Every time I get stopped, I ask them, did you see that number on the back of my vehicle?
[01:07:01.400 --> 01:07:04.400]  And most of the time they say, well, I didn't notice.
[01:07:04.400 --> 01:07:10.400]  Well, you might want to go notice and look it up.
[01:07:10.400 --> 01:07:13.400]  And that's all the notice they get from me.
[01:07:13.400 --> 01:07:21.400]  What I do not do is get into legal arguments with police officers.
[01:07:21.400 --> 01:07:24.400]  I saved that for the prosecutor and the courts.
[01:07:24.400 --> 01:07:31.400]  Actually, the last time I got a ticket, the first thing I did,
[01:07:31.400 --> 01:07:40.400]  and this probably is the first thing you should do and anyone who gets a ticket who wants to fight this battle.
[01:07:40.400 --> 01:07:43.400]  The real issue is commerce.
[01:07:43.400 --> 01:07:48.400]  So let's back up and start from the beginning.
[01:07:48.400 --> 01:07:55.400]  Who can enforce the commercial traffic code?
[01:07:55.400 --> 01:07:59.400]  Let me explain that question a little bit.
[01:07:59.400 --> 01:08:07.400]  We have municipal police, every policeman, every peace officer,
[01:08:07.400 --> 01:08:12.400]  thinks that he has authority to enforce the traffic code.
[01:08:12.400 --> 01:08:15.400]  But that's not what the statute says.
[01:08:15.400 --> 01:08:25.400]  In Texas, the Texas administrative code is the one that establishes the transportation code
[01:08:25.400 --> 01:08:29.400]  and it stipulates who can enforce it.
[01:08:29.400 --> 01:08:35.400]  In order to enforce the transportation code, you must be a police officer.
[01:08:35.400 --> 01:08:45.400]  In Texas, we have a differentiation between a police officer and a peace officer.
[01:08:45.400 --> 01:08:55.400]  All policemen are peace officers, but not all peace officers are police officers.
[01:08:55.400 --> 01:09:03.400]  A police officer is someone who has went through the registration requirements
[01:09:03.400 --> 01:09:08.400]  and training requirements laid down by the Texas administrative code
[01:09:08.400 --> 01:09:12.400]  that authorizes them to enforce the Texas transportation code.
[01:09:12.400 --> 01:09:19.400]  So the first thing I did was put in a request for this officer's evidence
[01:09:19.400 --> 01:09:24.400]  of his meeting the requirements of the Texas administrative code
[01:09:24.400 --> 01:09:29.400]  so as to authorize him to enforce the transportation code.

[01:09:46.400 --> 01:09:50.400]  You have to be a city of a certain size and a county of a certain size.
[01:09:50.400 --> 01:09:53.400]  They're just a whole string of requirements.
[01:09:53.400 --> 01:09:57.400]  And I was given a ticket by a little municipality, Azalea, Texas,
[01:09:57.400 --> 01:10:02.400]  and they did not meet the statutory requirements.
[01:10:02.400 --> 01:10:11.400]  So I started peppering them with information requests to show where they had met the requirements.
[01:10:11.400 --> 01:10:17.400]  And they didn't respond to my request, so I hit them with criminal complaints.
[01:10:17.400 --> 01:10:19.400]  Just started working them over.
[01:10:19.400 --> 01:10:22.400]  We take their own code and take it to them.
[01:10:22.400 --> 01:10:29.400]  So first thing you should do is find not the transportation code in Maryland,
[01:10:29.400 --> 01:10:34.400]  but the legislation that enacts and enables the transportation code.
[01:10:34.400 --> 01:10:39.400]  And that's probably going to be either in a government code or an administrative code.
[01:10:39.400 --> 01:10:42.400]  In Texas, it's administrative code.
[01:10:42.400 --> 01:10:45.400]  Find out where the legislature...
[01:10:45.400 --> 01:10:48.400]  Take your police.
[01:10:48.400 --> 01:10:51.400]  Where are they authorized to enforce this code?
[01:10:51.400 --> 01:10:55.400]  It's going to be in there.
[01:10:55.400 --> 01:11:00.400]  And that'll be great fun because these guys are not going to have a clue.
[01:11:00.400 --> 01:11:05.400]  When I did this to Azalea, Texas, they had no clues what I was talking about.
[01:11:05.400 --> 01:11:11.400]  I gave an information request to the custodian of the record for the Sheriff's Department,
[01:11:11.400 --> 01:11:15.400]  and this woman came out with this request, and she said,
[01:11:15.400 --> 01:11:18.400]  Mr. Kelton, I read your request.
[01:11:18.400 --> 01:11:20.400]  I'm not sure what you're asking for.
[01:11:20.400 --> 01:11:21.400]  Can you be a little more specific?
[01:11:21.400 --> 01:11:22.400]  I said, absolutely.
[01:11:22.400 --> 01:11:24.400]  I can be very specific.
[01:11:24.400 --> 01:11:31.400]  What I want to see is exactly what's written in that request.
[01:11:31.400 --> 01:11:35.400]  And she stood there looking at me with this look that said,
[01:11:35.400 --> 01:11:40.400]  I think if I had a pistol, I would shoot you, you smart mouth.
[01:11:40.400 --> 01:11:45.400]  But when I got to court, I was having a great time.
[01:11:45.400 --> 01:11:49.400]  I had requested a jury trial, and I'd filed a challenge subject matter jurisdiction
[01:11:49.400 --> 01:11:54.400]  violating all of these laws against me before they got to court.
[01:11:54.400 --> 01:11:58.400]  I told the prosecutor, I said, you're not going to need my jury.
[01:11:58.400 --> 01:11:59.400]  We're not going to get that far.
[01:11:59.400 --> 01:12:00.400]  He said, oh, we're not.
[01:12:00.400 --> 01:12:01.400]  No, we're not.
[01:12:01.400 --> 01:12:06.400]  I'm here at arm's length to the court with a challenge subject matter jurisdiction,
[01:12:06.400 --> 01:12:08.400]  and you're not going to get past it.
[01:12:08.400 --> 01:12:10.400]  Well, it doesn't really matter.
[01:12:10.400 --> 01:12:11.400]  It won't make any difference.
[01:12:11.400 --> 01:12:13.400]  I'm still at arm's length.
[01:12:13.400 --> 01:12:17.400]  And that's ripe for interlocutory appeal.
[01:12:17.400 --> 01:12:22.400]  We get to the end of court, and they call my case.
[01:12:22.400 --> 01:12:26.400]  And the judge said, is the prosecution ready?
[01:12:26.400 --> 01:12:31.400]  And the prosecutor stood up and said, no, Your Honor, the prosecution is not ready.
[01:12:31.400 --> 01:12:33.400]  The judge said, case dismissed.
[01:12:33.400 --> 01:12:34.400]  I jumped up.
[01:12:34.400 --> 01:12:37.400]  I object.
[01:12:37.400 --> 01:12:40.400]  The judge said, you object to me dismissing the case?
[01:12:40.400 --> 01:12:46.400]  I said, yeah, Judge, we were just about to get to the good part.
[01:12:46.400 --> 01:12:50.400]  When they find out you know their code better than them,
[01:12:50.400 --> 01:12:55.400]  and that you are prepared to use it against them,
[01:12:55.400 --> 01:13:00.400]  if you're going to beat it, that's probably how you're going to beat it.
[01:13:00.400 --> 01:13:01.400]  But it takes a lot of work.
[01:13:01.400 --> 01:13:03.400]  You've got to read the code.
[01:13:03.400 --> 01:13:10.400]  Reading the code is not as bad as it seems, because it's outlined.
[01:13:10.400 --> 01:13:13.400]  So there's a lot of white space in there.
[01:13:13.400 --> 01:13:20.400]  And the only thing, you read the code as it goes to who does what.
[01:13:20.400 --> 01:13:25.400]  And I'm telling you, you read that, it's going to read like a comic book.
[01:13:25.400 --> 01:13:26.400]  Because you will love it.
[01:13:26.400 --> 01:13:27.400]  It's such great fun.
[01:13:27.400 --> 01:13:31.400]  You find all these cool things you can do to them.
[01:13:31.400 --> 01:13:33.400]  And they have no idea.
[01:13:33.400 --> 01:13:35.400]  They've never read the code.
[01:13:35.400 --> 01:13:38.400]  Well, I told them about when I was in court before I told the prosecutor,
[01:13:38.400 --> 01:13:44.400]  I told the court, you know, this act of construction, I notified the NBA back in 1998.
[01:13:44.400 --> 01:13:46.400]  They never responded back.
[01:13:46.400 --> 01:13:51.400]  So I was hitting them on the issue that they didn't respond back in the appropriate time period.
[01:13:51.400 --> 01:13:53.400]  They lost any jurisdictional authority to respond now,
[01:13:53.400 --> 01:13:58.400]  because the appropriate time period has gone beyond penal limitations.
[01:13:58.400 --> 01:14:02.400]  OK, then they're limited out.
[01:14:02.400 --> 01:14:11.400]  Have you bargained with the prosecutor and judicial conduct complain to the judge?
[01:14:11.400 --> 01:14:16.400]  Oh, if you haven't done that, you're missing out on the real fun.
[01:14:16.400 --> 01:14:17.400]  Yeah, yeah.
[01:14:17.400 --> 01:14:22.400]  I mean, the thing about a ticket, they're going to charge you so much,
[01:14:22.400 --> 01:14:24.400]  and they don't charge you as much as they can.

[01:14:26.400 --> 01:14:29.400]  Well, let me tell you what they're doing out here in Charle County.
[01:14:29.400 --> 01:14:35.400]  They don't dare cite me under a different name, different date of birth.

[01:14:41.400 --> 01:14:49.400]  Plead to the jurisdiction, double jeopardy, and wrong person.
[01:14:49.400 --> 01:14:53.400]  That goes to a plea, not a motion.
[01:14:53.400 --> 01:14:56.400]  Pleas, pleadings stand before everything.
[01:14:56.400 --> 01:15:02.400]  And that's one of the pleadings in a criminal case, wrong person.
[01:15:02.400 --> 01:15:06.400]  That's in personum jurisdiction, and you're challenging,
[01:15:06.400 --> 01:15:12.400]  or your plea would be a plea to the jurisdiction.
[01:15:12.400 --> 01:15:15.400]  Well, no, not exactly.
[01:15:15.400 --> 01:15:21.400]  A plea to the jurisdiction is saying that the court itself doesn't have jurisdiction.
[01:15:21.400 --> 01:15:27.400]  And an in personum would be saying that the court doesn't have jurisdiction over me.
[01:15:27.400 --> 01:15:32.400]  And technically, the court, if you are within,
[01:15:32.400 --> 01:15:40.400]  if the accusation was made when you were within the venue of the court,
[01:15:40.400 --> 01:15:44.400]  it would have subject matter jurisdiction over the traffic code,
[01:15:44.400 --> 01:15:48.400]  and it would have venue jurisdiction over you.
[01:15:48.400 --> 01:15:52.400]  The problem is, is you've not been accused of a crime
[01:15:52.400 --> 01:16:00.400]  because you're not the person named in the complaint.
[01:16:00.400 --> 01:16:03.400]  So that's a pleading, that's one of the three pleadings.
[01:16:03.400 --> 01:16:08.400]  Subject matter jurisdiction is the first one, double jeopardy is the second one,
[01:16:08.400 --> 01:16:12.400]  and this is the third one, that you got the wrong person.
[01:16:12.400 --> 01:16:15.400]  When we come back over break, I'd like to go over the subject matter jurisdiction.

[01:21:04.400 --> 01:21:17.400]  Provided that nothing takes place to toll that or pause that or extend that statute of limitations, the limitation period runs.
[01:21:17.400 --> 01:21:29.400]  After two years, if you've got a two-year statute of limitations on your issue, after that two-year period, the cause of action expires.
[01:21:29.400 --> 01:21:31.400]  Now, I put this question to my boss.
[01:21:31.400 --> 01:21:47.400]  I said, is it possible that when the time limit expires, and we understand by virtue of the limitation of time expiring, would-be plaintiff's right to sue also expires?
[01:21:47.400 --> 01:21:52.400]  Would it be fair to say that the cause of action itself has expired?
[01:21:52.400 --> 01:21:56.400]  And he nodded his head and said, yeah, that sounds right to me.
[01:21:56.400 --> 01:21:58.400]  Go look it up.
[01:21:58.400 --> 01:21:59.400]  Okay.
[01:21:59.400 --> 01:22:01.400]  I went to Lexis.
[01:22:01.400 --> 01:22:05.400]  Sure enough, I found case after case after case.
[01:22:05.400 --> 01:22:24.400]  Most cases will, in the memorandum opinion of the appellate courts, it will stay quite often and more often that the time limitation ran out.
[01:22:24.400 --> 01:22:39.400]  But there are, there is case after case after case that specifically leaves out the element of time and states specifically that the cause of action expired.
[01:22:39.400 --> 01:22:42.400]  So that makes perfect sense to me.
[01:22:42.400 --> 01:22:48.400]  Now, what happens, how does that relate to the jurisdiction of the subject matter?
[01:22:48.400 --> 01:22:55.400]  Let's take, for example, let's stick with the civil side.
[01:22:55.400 --> 01:22:59.400]  Let's say you've got somebody tore down your fence.
[01:22:59.400 --> 01:23:00.400]  Okay.
[01:23:00.400 --> 01:23:03.400]  That's property damage.
[01:23:03.400 --> 01:23:08.400]  You've got two years to bring that claim to court.
[01:23:08.400 --> 01:23:18.400]  If within the period of two years you fail to bring that claim to court, that's after the day the cause of action accrued, that is the day the damage happened.
[01:23:18.400 --> 01:23:24.400]  You've got two years from that point, in some cases a discovery rule will take place.
[01:23:24.400 --> 01:23:30.400]  A discovery rule means when the damage was discovered.
[01:23:30.400 --> 01:23:39.400]  And in another case there is a specific time that is in wrongful death and that cause of action begins at the time of death.
[01:23:39.400 --> 01:23:46.400]  So you've got a statute of limitations that has ran its course.
[01:23:46.400 --> 01:23:58.400]  The lower court, let's say your justice of the peace or your small claims court, would have jurisdiction over that subject matter.
[01:23:58.400 --> 01:24:01.400]  Okay. That's a small claim.
[01:24:01.400 --> 01:24:03.400]  That's not the question.
[01:24:03.400 --> 01:24:09.400]  Yes, the court, I agree, the court has jurisdiction over the subject matter.
[01:24:09.400 --> 01:24:22.400]  However, due to the passing of time, opposition did not have the authority or the capacity to invoke that jurisdiction.
[01:24:22.400 --> 01:24:29.400]  Oh, Steve, Jeff Sedgwick is on the line on this subject.
[01:24:29.400 --> 01:24:30.400]  Okay.
[01:24:30.400 --> 01:24:34.400]  And he always has sage advice.
[01:24:34.400 --> 01:24:36.400]  Sage advice, okay.
[01:24:36.400 --> 01:24:39.400]  Well, he's old and old people have sage advice.
[01:24:39.400 --> 01:24:44.400]  He is so old, he's even older than me.

[01:25:40.400 --> 01:25:48.400]  I ran into this one time and I thought a judge was going to come across the bench at me and call him on it.
[01:25:48.400 --> 01:25:50.400]  I challenged for subject matter jurisdiction.
[01:25:50.400 --> 01:25:53.400]  He said, well, the legislature gave me some jurisdiction.
[01:25:53.400 --> 01:25:55.400]  And I said, oh, really?
[01:25:55.400 --> 01:26:07.400]  Then I want you to put my finger on the law that gave you jurisdiction to hear this case.
[01:26:07.400 --> 01:26:18.400]  Okay? Because the jurisdiction of the court to act can only be invoked by sufficient pleadings.
[01:26:18.400 --> 01:26:25.400]  And since they're outside the statute of limitations, the pleadings cannot be sufficient.
[01:26:25.400 --> 01:26:32.400]  It can only be invoked by someone with a true controversy.
[01:26:32.400 --> 01:26:38.400]  And once the cause of action has expired, there is no controversy.
[01:26:38.400 --> 01:26:47.400]  And let's say a justice makes a ruling and comes to a judgment if they have no jurisdiction.
[01:26:47.400 --> 01:26:50.400]  What do you call that, Jeff?

[01:38:24.400 --> 01:38:31.400]  I know from experience, if you grieve an attorney,
[01:38:31.400 --> 01:38:34.400]  you're going to get that template letter back from the bar,

[01:38:39.400 --> 01:38:44.400]  Yeah, the attorney slammed the baby up against the tree, but it doesn't matter.
[01:38:44.400 --> 01:38:48.400]  It doesn't rise to the level of misconduct.
[01:38:48.400 --> 01:38:55.400]  We examined into your accusation and find it does not rise to the level of misconduct,
[01:38:55.400 --> 01:38:58.400]  no matter what you claim.

[01:38:59.400 --> 01:39:02.400]  But that's a good thing.
[01:39:02.400 --> 01:39:04.400]  That doesn't mean it's over.
[01:39:04.400 --> 01:39:10.400]  It's over for you, but that attorney is going to be before the grievance committee
[01:39:10.400 --> 01:39:16.400]  or the state bar or the ABA, depending on who you complain.
[01:39:16.400 --> 01:39:21.400]  He's going to be there for a while, the better part of a year.
[01:39:21.400 --> 01:39:26.400]  And then they're going to double his malpractice insurance, and that's the good part.
[01:39:26.400 --> 01:39:31.400]  Now, if you've got multiple things that you can grieve him on,
[01:39:31.400 --> 01:39:39.400]  would you put them all in one grievance and have them all kicked out the window,
[01:39:39.400 --> 01:39:45.400]  or would you want to space those out and file them separately?
[01:39:45.400 --> 01:39:48.400]  Mm-hmm.
[01:39:48.400 --> 01:39:55.400]  And then what did the judge do that suborned that behavior?
[01:39:55.400 --> 01:39:57.400]  Was it the wolf?
[01:39:57.400 --> 01:40:01.400]  Did she accept what he said?
[01:40:01.400 --> 01:40:07.400]  I don't have an answer for that directly,
[01:40:07.400 --> 01:40:13.400]  but if the attorney violated its code of professional conduct in court,
[01:40:13.400 --> 01:40:16.400]  what did the judge do to suborn that behavior?

[01:41:48.400 --> 01:41:51.400]  In other words, you're about to take a source of money away from them,
