[03:53.280 --> 04:03.440] Under this, and enjoy, a discharge in a case under this title voids any judgment at any [04:03.440 --> 04:10.960] time obtained to the extent that such judgment is a determination of the personal liability [04:10.960 --> 04:18.480] of the debtor with respect to any death discharged under 727, 944, 1141, 12. [04:18.480 --> 04:26.000] I looked up all those the other day and they applied to different things. [04:26.000 --> 04:38.280] 11 USC 524, A2, A, a discharge in a case under this title, 2, operates as an injunction against [04:38.280 --> 04:46.480] the commencement or continuation of an action, the employment of a process or an act to [04:46.480 --> 04:53.760] collect, recover or offset any such debt as a personal liability of the debtor, whether [04:53.760 --> 04:58.800] or not discharge of set death is waived. [04:58.800 --> 05:00.720] That is very clear. [05:00.720 --> 05:07.960] You need to petition the bankruptcy court for sanctions against the trustee, the bank, [05:07.960 --> 05:12.480] the lawyers and the purchaser of the property. [05:12.480 --> 05:14.840] Okay. [05:14.840 --> 05:19.320] So look that one up, you will like what you find. [05:19.320 --> 05:28.080] I did a search on that one when we first talked about it on the air and I found a document, [05:28.080 --> 05:34.880] a rather extensive PDF and if you'll send me an email, I'll send it to you and it is [05:34.880 --> 05:50.040] arguing that 11 US Code 524 effectively preempt state law and they were showing that the states [05:50.040 --> 05:59.080] had argued that this preempt state law, it prevents the state from acting and that was [05:59.080 --> 06:10.600] an improper preemption of their state law and effectively the feds told them to go scrap. [06:10.600 --> 06:17.560] If we discharge the debt, then the holder can no longer pursue collection. [06:17.560 --> 06:20.520] It was very definitive. [06:20.520 --> 06:26.520] So now we need to back up and consider what's going on here. [06:26.520 --> 06:35.480] Now you have a trustee who had knowledge of the discharge. [06:35.480 --> 06:42.920] He either had actual knowledge or he had imputed knowledge and it does not matter a hoot which [06:42.920 --> 06:54.720] it is because it is in the public record which the federal bankruptcy court records are public. [06:54.720 --> 06:59.400] It's in the public record that the debt has been discharged. [06:59.400 --> 07:08.240] The trustee pursued foreclosure or prosecuted the foreclosure after the underlying debt [07:08.240 --> 07:18.240] had been discharged in direct contravention of 11 USC 524. [07:18.240 --> 07:23.680] First you move for sanctions from the bankruptcy court and in order from the bankruptcy court [07:23.680 --> 07:33.840] overturning the foreclosure and then you sue the trustee. [07:33.840 --> 07:42.560] When I filed that notice in the deed records, I immediately turned around and asked the guy [07:42.560 --> 07:49.480] at the county clerk's office, you better give me a certified copy of what I just filed. [07:49.480 --> 07:57.480] I gave the trustee a copy of that certified copy. [07:57.480 --> 08:05.400] I have a rule, never interfere with someone when they're screwing up. [08:05.400 --> 08:09.760] You follow that rule very well. [08:09.760 --> 08:13.440] You have them in a very good position. [08:13.440 --> 08:20.160] There's a good chance that the bankruptcy court trustee is not going to be a happy camber [08:20.160 --> 08:30.160] and you might look at filing the action against these guys in the bankruptcy case as an adversarial [08:30.160 --> 08:38.880] proceeding and that will cement the reopening of the bankruptcy. [08:38.880 --> 08:52.440] When I filed the reopening, here's what I said, motion to reopen, also reinstate the [08:52.440 --> 09:00.400] automatic stay and for adversity filing to be filed. [09:00.400 --> 09:11.480] So you've already noticed an adversarial proceeding, wonderful. [09:11.480 --> 09:18.360] Now get the proceeding together and you can base it directly on this statute and these [09:18.360 --> 09:20.640] guys got a problem. [09:20.640 --> 09:27.280] Their biggest problem is this bell has been rung and you're still in possession of the [09:27.280 --> 09:33.520] property but this purchaser calling you and asking you when you're going to leave the [09:33.520 --> 09:42.240] property, you're a real sensitive guy and this caused you tremendous emotional distress. [09:42.240 --> 09:48.120] Yeah, I had sleep with my dog so nobody bothered me. [09:48.120 --> 09:49.120] Exactly. [09:49.120 --> 09:55.280] You may have, you know, there's a thing here. [09:55.280 --> 09:58.840] It's about jurisdiction. [09:58.840 --> 10:05.640] Judges don't like people interfering with their jurisdiction. [10:05.640 --> 10:15.480] And here we have the trustee after the bankruptcy trustee has entered or the bankruptcy judge [10:15.480 --> 10:23.200] has entered his ruling, just ignoring the federal court's ruling and acting anyway. [10:23.200 --> 10:33.560] I would suggest you consider filing official oppression charges against the trustee and [10:33.560 --> 10:47.280] I wish I had Steve here because I think it's civil torts and remedies 141. [10:47.280 --> 10:58.280] It used to be that criminal, that conversion of real property was a, was sueable under [10:58.280 --> 10:59.280] conversion. [10:59.280 --> 11:02.600] You can't sue under conversion anymore. [11:02.600 --> 11:13.720] Now you sue under a specific tort, a tort, I believe it's 141 of the civil torts and remedies [11:13.720 --> 11:14.720] code. [11:14.720 --> 11:21.280] I don't multitask well or I could look it up while I'm on here. [11:21.280 --> 11:32.520] But it is specifically passed for this purpose to sue someone for improperly converting your [11:32.520 --> 11:37.240] property to someone else. [11:37.240 --> 11:45.040] And you've done all your steps, you've set everything up for them. [11:45.040 --> 11:55.440] By giving the trustee a certified copy of the bankruptcy proceedings, you can't claim [11:55.440 --> 11:56.440] good faith. [11:56.440 --> 12:00.400] They got a real problem. [12:00.400 --> 12:06.920] You could well get the foreclosure overturned and stick it all together and stop that whole [12:06.920 --> 12:15.000] thing and then get to go back and sue the Crapola out of them. [15:18.240 --> 15:25.080] Now, my question would be to what extent would it be important for me to buy, I mean, it's [15:25.080 --> 15:27.960] quite expensive to get the report. [15:27.960 --> 15:28.960] Okay. [15:28.960 --> 15:29.960] In Texas. [15:29.960 --> 15:30.960] Yes. [15:30.960 --> 15:41.080] If you actively avoid service, that's a felony. [15:41.080 --> 15:42.080] From the judge. [15:42.080 --> 15:49.320] It didn't matter who you avoid service from, avoidance of service in Texas is a felony. [15:49.320 --> 15:57.320] You might check Florida law to make sure you're not stepping into a bear trap. [15:57.320 --> 15:59.320] Fully understood. [15:59.320 --> 16:07.360] Yeah, and service is something that if they don't do it right and they've already foreclosed [16:07.360 --> 16:12.120] that they can harm against them. [20:47.960 --> 20:52.960] This is just showing that they had no objection, that they were telling the court, yeah, they [20:52.960 --> 20:56.200] realized they screwed it up, and they'll have to fix it. [20:56.200 --> 21:06.360] But your concern of the judge serving you, he doesn't have any authority to do that. [21:06.360 --> 21:14.640] It's him entering into it, the other party is required to serve you, not the judge. [21:14.640 --> 21:19.520] When the judge becomes a processer, then you ask for the judge to stand down from the bench, [21:19.520 --> 21:23.800] so you probably didn't have to worry about that part. [21:23.800 --> 21:30.680] I've heard quite a few things in Florida, and that wouldn't be the most strange one. [21:30.680 --> 21:34.400] So Randy, when it comes down to that script, I mean, would it be important for me to have [21:34.400 --> 21:39.360] that script on a hearing that the plaintiff never showed up and I'm here? [21:39.360 --> 21:43.240] No, no, that would be, it's not relevant. [21:43.240 --> 21:50.760] The plaintiff didn't show up, he got a ruling against him, so you can't, everything you [21:50.760 --> 22:00.080] do, always think in terms of how does this harm me, because that's what the judge is [22:00.080 --> 22:01.080] going to say. [22:01.080 --> 22:04.960] You're going to say, but he didn't show up to the hearing, and the judge is going to [22:04.960 --> 22:08.320] say, so what? [22:08.320 --> 22:14.280] Assume that every claim you make, the judge is going to say, so what? [22:14.280 --> 22:21.080] And make sure you have the so what answered before it's ever asked. [23:44.640 --> 23:52.440] I'll give you a brief description, we're going on a little over 10 years in regards [23:52.440 --> 24:03.800] to children being awarded to the abuser, and it's come to a situation where he's now trying [24:03.800 --> 24:10.920] to lead the state of Wisconsin, some affidavits have been filed, we found out that the courts [24:10.920 --> 24:21.560] are not sitting on their ulcer bonds and they never rebutted the affidavit and they do have [24:21.560 --> 24:28.360] me on child support, I've been on child support since 2007 and I've come to learn that I can [24:28.360 --> 24:36.120] do a cease and desist, I did that back in August and in September they did a contempt [24:36.120 --> 24:48.240] to court where I was supposed to show up October 28, but we did a hearing via by phone and [24:48.240 --> 24:58.400] I had sent in a letter requesting the phone hearing versus the general appearance and [24:58.400 --> 25:10.320] it ended up where I, the letter stated something in regards to my status and that I'm not [25:10.320 --> 25:19.360] this surety and I know about the use of frunk and make it more simple, they're going to [25:19.360 --> 25:27.040] bring me in for an evidentiary hearing and I did state on that hearing over the telephone [25:27.040 --> 25:35.720] that I was not the person, Jennifer with my last name, I was the natural person. [25:35.720 --> 25:54.880] They have not serviced me with the hearing date notice for this December 11th and I don't [25:54.880 --> 25:55.880] know what I'm going to do yet. [25:55.880 --> 26:03.080] Okay, be careful here because they don't have to do service on you for that purpose. [26:03.080 --> 26:16.280] You're expected to keep track of the court involved, whoever sets a hearing is required [26:16.280 --> 26:21.480] to give you notice but not service, you don't have to be served. [26:21.480 --> 26:27.640] The only thing that has to be served is the original petition, so when you said they have [26:27.640 --> 26:35.760] not served me, did you mean that they haven't given you notice or that they haven't had [26:35.760 --> 26:39.040] notice served on you? [27:08.800 --> 27:16.200] So if you essentially had sufficient notice, whether they sent it, if they said they sent [27:16.200 --> 27:22.920] it and they didn't, it goes back to what was in the last call, how were you harmed by them [27:22.920 --> 27:30.520] not sending the paper notice when you had been given a verbal notice over the phone. [27:30.520 --> 27:39.600] One of the things we have to be careful about is making arguments that even if you win, [27:39.600 --> 27:44.200] you've gained no ground. [34:27.060 --> 34:31.020] The girls were the age of four, four and five at the time. [34:31.020 --> 34:39.580] He was 11, and the husband was removed for domestic violence. [34:39.580 --> 34:48.140] Once he filed for a divorce, he basically got temporary custody where he had him Tuesday, [34:48.140 --> 34:50.220] Thursday, and every other weekend. [34:50.220 --> 34:54.980] Now, the Tuesday and Thursday would be from six o'clock at night until nine o'clock at [34:54.980 --> 34:55.980] night. [34:55.980 --> 35:01.700] Eventually, I found out through the course of maybe two weeks that there was something [35:01.700 --> 35:05.620] going on which warranted me to bring them to the hospital. [35:05.620 --> 35:10.860] The hospital was found blatant abuse. [35:10.860 --> 35:11.860] The police were called. [35:11.860 --> 35:13.140] They did nothing about it. [35:13.140 --> 35:23.580] It went on for several months up until January 29th approximately in the year of 2004, and [35:23.580 --> 35:30.780] they did an emergency ex parte because the last time that they were in the hospital, which [35:30.780 --> 35:37.380] is a private doctor, the man ordered me to go back to the hospital even though I felt [35:37.380 --> 35:45.900] like they did not believe me, and I felt like I didn't know what to do because the wounds [35:45.900 --> 35:51.860] on them were excruciating, and so were the exams that they had to do. [35:51.860 --> 35:57.340] There's massive evidence of the abuses. [35:57.340 --> 36:03.940] Okay, so you're talking about physical abuse, not sexual abuse? [36:03.940 --> 36:09.140] I didn't want to say that over the phone, yeah. [36:09.140 --> 36:11.620] I've come to the conclusion that I don't. [37:12.500 --> 37:24.380] If I have knowledge that someone say is about to commit suicide, and there is something [37:24.380 --> 37:29.580] I can do to prevent that, and I don't. [37:29.580 --> 37:40.900] I can be charged with depraved heart murder, and hear where the courts have actual documented [37:40.900 --> 37:49.820] evidence of assault against these children, and refuse to take action when they had a [37:49.820 --> 37:58.220] duty to take action, and subsequent assaults occurred, that's depraved heart assault, and [37:58.220 --> 38:04.180] that's a denial of the children's right to do process, and that you can take to the Federal [38:04.180 --> 38:05.180] Court. [38:05.180 --> 38:06.180] Okay. [38:06.180 --> 38:17.020] This situation is so bad that I sometimes have a hard time talking about it. [38:17.020 --> 38:26.100] I understand, I've done seminars all over the country, and everywhere I go, the family [38:26.100 --> 38:31.460] courts are by far the most corrupt. [38:31.460 --> 38:39.100] I was once, they paid me to go to Australia to do some seminars down there, and when I [38:39.100 --> 38:44.620] got to Australia, they picked me up at the airport, and drove on the wrong side of the [38:44.620 --> 38:53.820] road, all the way to the hotel, but when we got to the Sydney Bay Bridge, there was a [38:53.820 --> 39:06.220] guy up on the bridge with a big banner, decrying the family law courts in Australia. [39:06.220 --> 39:13.500] The primary reason they brought me there was because of the corruption in the family courts. [39:13.500 --> 39:22.020] Everywhere, this is a big problem, and the reason is, is you have two people here who [39:22.020 --> 39:34.460] are in extreme turmoil, and the lawyers, they get together and look at the estate of the [39:34.460 --> 39:43.060] two individuals, and whether they do this directly or not, indirectly, they look at [39:43.060 --> 39:50.260] the case and decide how much they can extract from the estate before they allow the parties [39:50.260 --> 39:53.380] to come together and make a deal. [39:53.380 --> 40:01.740] If one party has all the money and the other party doesn't, then the party with no money [40:01.740 --> 40:09.540] is going to get screwed because the lawyer on your side, if you're the one without money, [40:09.540 --> 40:15.140] doesn't have a lot of money to gain from you, so he's not going to help you, and the other [40:15.140 --> 40:21.140] side is going to do everything he can to extract all the money from the guy with the cash that [40:21.140 --> 40:22.660] he can. [40:22.660 --> 40:26.780] It's like a four-sided chessboard. [40:26.780 --> 40:32.260] You think when you go into court, it's you and the other litigant. [40:32.260 --> 40:34.700] It's not. [40:34.700 --> 40:39.740] It's you on one side of the chessboard. [40:39.740 --> 40:47.260] Your attorney to your right, opposing counsel to your left, and the judge across from you. [40:47.260 --> 40:52.540] Everybody sitting at the board has relationships with one another. [40:52.540 --> 40:56.100] You have a relationship with your lawyer. [40:56.100 --> 41:01.740] Your lawyer has a relationship to the other lawyers. [41:01.740 --> 41:09.860] So that creates a problem. [41:09.860 --> 41:15.660] Once we understand how it really works, it gives us a clue how to make things work more [41:15.660 --> 41:18.340] in our favor. [41:18.340 --> 41:26.220] Because the judge is part of the lawyer group, he was one of those lawyers. [41:26.220 --> 41:35.300] He became the judge, and we don't have evidence that the judges are being paid off, but the [41:35.300 --> 41:45.540] nature of the cases indicate that they are, because the rulings we're seeing are so outrageous. [41:45.540 --> 41:51.220] I was told that through Carol Klein, the one that you did this, I believe it was the last [41:51.220 --> 41:58.140] day, the day before Mother's Day, is the recording that I just got done listening to. [41:58.140 --> 42:04.020] She had told me it's because they're robbing the mother's estate, and with my situation, [42:04.020 --> 42:11.180] I got three girls, they're robbing their estate too. [42:11.180 --> 42:12.180] That's what they do. [42:12.180 --> 42:21.820] Lawyers are in business not to fiercely adjudicate your rights. [42:21.820 --> 42:31.140] They're in business to make money, and money first. [42:31.140 --> 42:36.100] What we have to do is understand that it doesn't do much good to complain about it. [43:10.220 --> 43:17.820] Just now, this really makes the judge look bad, and the feds tend to like to flex their [43:17.820 --> 43:31.180] muscles on the state, and even if they don't, it's not only the judges, it was the court [43:31.180 --> 43:40.700] commissioners that took them away, and then the judge who did the divorce gave them full [43:40.700 --> 43:41.700] custody. [43:41.700 --> 43:46.900] Okay, well in Texas we don't have court commissioners, so I didn't know who addressed them. [46:56.700 --> 47:00.500] They don't want to do anything they haven't done before, and that's part of the reason [47:00.500 --> 47:02.020] they hate pro ses. [47:02.020 --> 47:04.660] Pro ses make them work. [47:04.660 --> 47:12.780] Let me read to you, this is from a Wisconsin lawyer, a female lawyer who works for women's [47:12.780 --> 47:13.780] rights. [47:21.660 --> 47:28.260] This is what I found in a section on premeditated murder, murder with malice or forethought, [47:28.260 --> 47:34.380] and wanton or depraved tariff murder are common law terms equivalent to Wisconsin's first [47:34.380 --> 47:37.780] degree attentional homicide statute. [47:37.780 --> 47:43.500] Premeditated murder is murdered with malice or forethought, malice is an intent to kill, [47:43.500 --> 47:49.340] and a forethought is the deliberation upon that intent. [47:49.340 --> 47:56.180] Deliberation only requires a secondary thought and momentary reconsideration. [47:56.180 --> 48:04.740] Wanton disregard for human life is a malice mens rea, mens rea means culpable state of [48:04.740 --> 48:06.700] mind. [48:06.700 --> 48:13.380] A depraved heart is the same as wanton disregard for human life. [48:13.380 --> 48:16.980] It is without regard for another person's life. [48:16.980 --> 48:24.180] So you do have the concept of depraved heart in Wisconsin. [48:24.180 --> 48:27.780] Now this happens to be addressing first degree murder. [48:27.780 --> 48:32.460] It goes on down and addresses the lesser ones. [48:32.460 --> 48:39.940] But if you have a judge here who has clear and convincing evidence, evidence that would [48:39.940 --> 48:49.460] give a reasonable person of ordinary prudence caused to believe that physical harm was coming [48:49.460 --> 48:56.540] to these children, and the judge, who is in a position where it is his duty to protect [48:56.540 --> 49:02.980] the children, fails to protect the children and leaves them in this situation. [49:02.980 --> 49:08.940] He denies the children in their right to do process. [49:08.940 --> 49:13.020] And he does so with a depraved heart. [49:13.020 --> 49:21.180] I'm telling you, if you charge this judge with depraved heart assault and you get that [49:21.180 --> 49:27.940] to the newspapers, this is exactly the kinds of things they would love to pick up because [49:27.940 --> 49:38.860] depraved heart is such an ugly, then juicy sounding word. [49:38.860 --> 49:42.020] Every keep in mind everything is political. [49:42.020 --> 49:46.900] You will never win your case simply because you have the law and the facts on your side [49:46.900 --> 49:49.620] to think so is naive. [49:49.620 --> 49:55.180] You will only win the case if you have the politics on your side and all politics is [49:55.180 --> 49:57.100] local. [49:57.100 --> 50:05.940] This will create you some local politics if you file a federal lawsuit or a federal charges [50:05.940 --> 50:12.540] of depraved heart assault against the judge. [50:12.540 --> 50:15.820] Everybody's going to get real excited. [50:15.820 --> 50:23.260] And you never know, you may actually have a U.S. attorney who would like an opportunity [50:23.260 --> 50:27.340] to make himself look good. [50:27.340 --> 50:35.380] Keep in mind, we have a presidential election coming up in two years. [50:35.380 --> 50:46.500] And the Republicans just won a landslide victory in this last election. [50:46.500 --> 50:52.620] The biggest turnover ever in history. [50:52.620 --> 51:01.500] So the expectation is that the Republican presidential candidate will have a serious [51:01.500 --> 51:07.020] advantage going into the next election. [51:07.020 --> 51:16.740] And when he takes office, every U.S. attorney must turn in his resignation. [51:16.740 --> 51:22.740] And the president decides rather to accept the resignation or not. [51:22.740 --> 51:26.020] Generally, they don't accept most of them. [51:26.020 --> 51:36.900] But this gives the incoming president opportunity to provide appointments for to pay back political [51:36.900 --> 51:39.780] debts. [51:39.780 --> 51:45.540] The problem the U.S. attorney has is they see the freight train coming at them. [51:45.540 --> 51:53.620] They've had a eight-year or so far a six-year free ride, but now the freight train's coming [51:53.620 --> 51:54.620] at them. [51:54.620 --> 51:59.140] They're going to get a new president and he's going to have debts to pay. [51:59.140 --> 52:05.260] Is he going to have a debt to pay from our office? [52:05.260 --> 52:10.380] What can I do to keep him from accepting my resignation? [52:10.380 --> 52:22.260] Well, I can help out these people being mistreated by this no-good rotten state judge who's [52:22.260 --> 52:28.860] committing depraved heart assault against these for helpless children. [52:28.860 --> 52:34.540] That's something that's a good chance now in this political climate they may pick up. [52:42.140 --> 52:49.620] And as you start creating the politics, what do you think this U.S. attorney's going to [52:49.620 --> 52:57.260] think when he's got a district judge crawling down his throat because he protected a local [52:57.260 --> 53:00.340] state judge? [53:04.820 --> 53:09.740] And who do you think he's, do you think the U.S. attorney's going to be willing to lay [53:09.740 --> 53:17.660] down in front of the bus for a state family court judge? [53:24.620 --> 53:27.140] I loved it when I was listening to that. [53:27.140 --> 53:36.140] Randy, this is not only with the hospitals new, the private doctor new? [53:45.220 --> 53:57.380] This case is a family law case where the individual sued the state of Texas, the child protective [53:57.380 --> 54:06.980] services for the state of Texas, the judge and both lawyers filed a RICO action against [54:06.980 --> 54:17.060] them, accusing them of an ongoing criminal conspiracy whereby they made unfounded claims [54:17.060 --> 54:27.100] against people in divorce cases where a claim of mental instability was made against the [54:27.100 --> 54:36.700] husband and the husband was forced to go through these evaluations by state officials and the [54:36.700 --> 54:44.620] claim was that all of this was intentional simply for the purpose of collecting money [54:44.620 --> 54:53.340] for these investigators and psychiatrists and psychologists and all of these professionals [54:53.340 --> 55:02.260] and involved ran this as a scam to make money at the expense of people in their most vulnerable [55:02.260 --> 55:03.260] time. [55:03.260 --> 55:08.700] This is absolutely the worst kind of betrayal. [01:04:35.820 --> 01:04:43.660] The wins are made in the appellate court, so keep that in mind because in the trial [01:04:43.660 --> 01:04:51.300] court, you tend to get, you tend to feel like if you lose a ruling in the trial court that [01:04:51.300 --> 01:04:55.980] you have lost, not true. [01:04:55.980 --> 01:05:01.940] All you've done is set the record for your appeal in the appellate court. [01:05:01.940 --> 01:05:07.620] The appellate court has a whole different agenda than the trial court does. [01:05:07.620 --> 01:05:13.140] The appellate court gives bad rulings, then the scoundrel lawyers will take those bad [01:05:13.140 --> 01:05:17.580] rulings and disrupt the court's jurist with them. [01:08:53.020 --> 01:08:58.940] I suggest you sit down and think about that and then write it down and then use that as [01:08:58.940 --> 01:09:01.860] a talisman. [01:09:01.860 --> 01:09:08.780] Every time you think about taking an action, every time you think about what they've done [01:09:08.780 --> 01:09:15.100] to you, you look at that ultimate outcome and ask yourself, will what they have just [01:09:15.100 --> 01:09:25.660] done to me as onerous as it was, will it lead me toward or lead me away from my ultimate [01:09:25.660 --> 01:09:28.940] outcome? [01:09:28.940 --> 01:09:37.820] Will what I'm about to do lead me toward or lead me away from my ultimate outcome? [01:09:54.100 --> 01:10:01.860] I had a friend in Pennsylvania who was helping people with IRS issues and she was sent to [01:10:01.860 --> 01:10:08.500] a friend of hers neighbor who had some tax liens and she went and sat down and they showed [01:10:08.500 --> 01:10:11.980] her the liens and she asked them, do you want to get rid of these liens? [01:10:11.980 --> 01:10:15.060] And they said, absolutely, we've been fighting these for years. [01:10:15.060 --> 01:10:19.300] She ripped them up through them in the trash, she said, okay, they're gone. [01:10:19.300 --> 01:10:29.900] The liens had expired a year earlier and when she told them, they were so irate, they made [01:10:29.900 --> 01:10:41.260] up a scathing letter and sent it to the IRS where the IRS drew, they reinstated the liens. [01:10:41.260 --> 01:10:50.060] They lost sight of the prize, they had won the whole enchilada but they lost sight of [01:10:50.060 --> 01:10:56.140] that and it became about the fight and they did what they wanted to do, they did what [01:10:56.140 --> 01:11:03.860] they felt like doing and it started to fight all over again and in family law there's nothing [01:11:03.860 --> 01:11:17.700] that generates more content than family law, be very careful, do not let yourself be led [01:11:17.700 --> 01:11:21.420] by your heart in this instance. [01:12:07.940 --> 01:12:18.540] There was no way I could frame that to where it would lead me toward my intended outcome [01:12:18.540 --> 01:12:27.180] and when I didn't go after the bailiffs, that got me more appreciation than anything I had [01:12:27.180 --> 01:12:28.780] ever done. [01:12:28.780 --> 01:12:35.900] I had the district attorney ask me, why didn't you pursue the bailiff for breaking your [01:12:35.900 --> 01:12:37.100] elbow? [01:12:37.100 --> 01:12:41.620] I said, well, I know he didn't mean to. [01:12:41.620 --> 01:12:44.140] Well, he shouldn't have pushed you out the door. [01:12:44.140 --> 01:12:52.460] Yeah, that's right, he shouldn't have pushed me out the door, but after a 20 year career, [01:12:52.460 --> 01:12:59.340] you make one minor little error, he barely pushed me but my foot hit a carpet that was [01:12:59.340 --> 01:13:04.100] laying there to wipe your feet on and it caused my foot to slide out from under me. [01:13:04.100 --> 01:13:11.660] So it wasn't like he threw me out the door, he just gave me a little nudge, should I end [01:13:11.660 --> 01:13:17.980] his career over that and would it lead me toward my intended outcome and I told the [01:13:17.980 --> 01:13:25.340] district attorney no way would lead me toward my outcome so I can't do it and after that, [01:13:25.340 --> 01:13:34.140] at that courthouse, everybody took me serious and I suggest to you that if they figure out [01:13:34.140 --> 01:13:42.940] that you're becoming highly directed, that you're no longer easily led by your emotions, [01:13:42.940 --> 01:13:48.740] now you're going to become dangerous to them and you start shooting back at them and they [01:13:48.740 --> 01:13:57.060] do stupid stuff that doesn't matter and you just ignore it and it's been my experience [01:13:57.060 --> 01:14:04.900] that the more minor things I can attack, the better, the more powerful it is. [01:14:04.900 --> 01:14:09.740] And in your case, if you go after that judge for depraved heart assault, these guys are [01:14:09.740 --> 01:14:17.940] going to get really, really excited and you're going to get a lot of politics on your side. [01:14:27.140 --> 01:14:32.580] On Monday, I planned on going to the federal building, first of all, going to the Secretary [01:14:32.580 --> 01:14:40.740] of State and finding out if they're supposedly, I was told that they're supposed to be sitting [01:14:40.740 --> 01:14:47.580] on their own some bonds in the courthouse and I followed in the affidavits, I followed [01:14:47.580 --> 01:15:00.740] a couple of affidavits, special appeal affidavits of facts and one of them is, because I told [01:15:00.740 --> 01:15:07.060] you David Roach was helping me, he filed this, get this ready, I'm going to read the [01:15:07.060 --> 01:15:14.060] clerk of court and ask them for the county recorder, request their bonds and all to get [01:15:14.060 --> 01:15:21.140] a certified copy of them and they all looked at me and said no, they don't have them here [01:15:21.140 --> 01:15:26.820] and they said, well, we can call, we can call to Madison for the Secretary of State. [01:15:26.820 --> 01:15:34.500] Okay, one thing I'm going to suggest is they are all public servants. [01:15:34.500 --> 01:15:36.380] You are the master. [01:15:36.380 --> 01:15:44.820] You never ask a public official to do anything you actually want him to do because you never [01:15:44.820 --> 01:15:49.700] ask a public official to do anything they are not specifically required to do. [01:47:46.020 --> 01:47:52.020] Why? If they have the right to foreclose, how come they don't show up to file a... [01:47:52.020 --> 01:47:59.020] In the foreclosure, was the property claimed as unsecured? [01:47:59.020 --> 01:48:07.020] I'm not sure about that because it's not in my property, but it was there. [01:48:07.020 --> 01:48:12.020] They did claim that property. I don't know whether it's secured or secured. I can ask, though. [01:48:12.020 --> 01:48:20.020] Okay, yeah. The lawyers normally stipulate to the property being secured. [01:48:20.020 --> 01:48:29.020] They just don't... I don't know. Somehow they don't think about it, and when you mention it to a lawyer, they've never done it that way, so they're reluctant to do it. [01:48:29.020 --> 01:48:36.020] The last lawyer I talked to, I brought this up to him, and he was reluctant. [01:48:36.020 --> 01:48:44.020] And I said, look, he said, well, there is a loan. I said, yeah, there is. And you're not claiming there's not a loan. [01:48:44.020 --> 01:48:50.020] You're simply not stipulating to any facts. [01:48:50.020 --> 01:48:59.020] You don't have to stipulate that these people are the true and proper bona fide holders of the claim. [01:48:59.020 --> 01:49:03.020] They have to prove up that they're the bona fide holders of the claim. [01:49:03.020 --> 01:49:12.020] So in claiming the property is unsecured, you're not saying that a note doesn't exist against it or a claim. [01:49:12.020 --> 01:49:20.020] You're just saying that the particular individuals who are making that claim aren't the... [01:49:20.020 --> 01:49:27.020] You're not sure that they're the proper holders, so you make the claim of holder status. [01:49:27.020 --> 01:49:37.020] I dispute your claim. Prove it up. And he got that. He understood the position. [01:49:37.020 --> 01:49:44.020] So look at this. Do you know how old the foreclosure is? [01:49:44.020 --> 01:49:53.020] No, he's been for close years. He hasn't been for close years. He's been for close as we speak. [01:49:53.020 --> 01:49:58.020] Oh, OK. So how long ago was the bankruptcy? [01:49:58.020 --> 01:50:03.020] OK. It's probably about no more than 60 days. [01:50:03.020 --> 01:50:11.020] Oh, wonderful. If the property was not claimed as unsecured, then reopen the bankruptcy. [01:50:11.020 --> 01:50:18.020] And I think it's scheduled to change it to unsecured. [01:50:18.020 --> 01:50:26.020] And then tell the person to go into court. The bank is in an evidence area hearing, a proof of hearing. [01:50:26.020 --> 01:50:31.020] And the bank's going to come in with a lot of documentation. There are going to be photocopies. [01:50:31.020 --> 01:50:37.020] And you simply state to the bank, I have never seen these documents before. [01:50:37.020 --> 01:50:42.020] We had a woman in Fort Worth that followed instructions well. [01:50:42.020 --> 01:50:45.020] She said, Your Honor, I've never seen these documents before. [01:50:45.020 --> 01:50:50.020] And the judge said, well, isn't that your signature? No, Your Honor, I did not sign these documents. [01:50:50.020 --> 01:50:55.020] I've never seen them before. And that's true. [01:50:55.020 --> 01:51:00.020] She had never seen those copies before, and she certainly didn't sign that copy. [01:51:00.020 --> 01:51:12.020] And she had no duty to stipulate that these were actual, true, and accurate copies of original instruments that she did sign. [01:51:12.020 --> 01:51:21.020] So she didn't stipulate to anything. She said the judge ground owner for about 10 minutes, and she would not back up. [01:51:21.020 --> 01:51:33.020] And then the judge sat back and smiled real big and turned to the lawyers and said, Well, counselors, it seems she has never seen these documents before. [01:51:33.020 --> 01:51:39.020] You're going to have to come into my court with the originals. She got 60 days. [01:51:39.020 --> 01:51:44.020] We reset the hearing. The bank didn't show up. They discharged the note. [01:51:44.020 --> 01:51:51.020] Did you hear the statute 11 U.S.C. 524? Then I talked about it. [01:51:51.020 --> 01:51:58.020] Yes. Yes. And you were referring to 8-2 in that statute? [01:51:58.020 --> 01:52:00.020] Wait. Say that again. I didn't understand. [01:52:00.020 --> 01:52:09.020] Which one were you reading? [01:53:49.020 --> 01:54:07.020] Right, because he said it was under Chapter 7, then he has a document which says that all debtors are, all purported creditors are forbidden to try to collect on these items. [01:54:07.020 --> 01:54:14.020] But my real question is why did Walt Spargo show up to file a claim? [01:54:14.020 --> 01:54:30.020] Well, if the property was claimed as secured, they didn't have to show up because you already stipulated that they're the true and proper holder. [01:54:30.020 --> 01:54:32.020] Okay, okay. [01:54:32.020 --> 01:54:42.020] Yeah, that's why they didn't have to. And that's the problem with these lawyers. They're stipulating to something they don't have to stipulate to. [01:54:42.020 --> 01:54:51.020] Yes, I went to see an attorney on my case, not on my case, on my personal situation. [01:54:51.020 --> 01:55:04.020] I went to see an attorney and I told her, I wanted her to help me file a bankruptcy and I wanted to discharge my property taxes in my Francis Taxport Taxes. [01:55:04.020 --> 01:55:17.020] She says, you tell me, you can discharge the taxes? He says, yes. He so told you that. She told me, well, you should know that she calls up somebody else and he says, yeah, yeah. [01:55:17.020 --> 01:55:23.020] And then she says, I guess you're right. So I dropped her because I found out she didn't know what I was talking about. [01:55:23.020 --> 01:55:39.020] So I dropped her. I found another one. I found another one and then they wanted me to do an agreement so that I would pay, they were going to charge me $7,000 plus the agreement with the IRS says, no, no, I don't think so. [01:55:39.020 --> 01:55:56.020] So I went to, and then I finally found the real one, the real good one, and then I paid $1,060 in discharge, $192,000 including hospital bills and everything in Francis Taxport and Federal Act. [01:55:56.020 --> 01:56:05.020] Wonderful, wonderful. It's disheartening how much lawyers don't know. [01:56:05.020 --> 01:56:15.020] Yes. Carlos, did you listen to the first part of the show where we talked about the app and the tools we're designing?
