[04:52.320 --> 04:57.320] The letter state, the statement I received prior to the one in my, in my hand right now, [04:57.320 --> 05:01.320] which is asking for a full amount due, the accelerated amounts. [05:01.320 --> 05:06.320] The one prior to this one that I received last month was a statement that said, hey, [05:06.320 --> 05:09.320] just a thousand bucks, just a little over a thousand is due. [05:09.320 --> 05:12.320] That payment is due December 1, 2014. [05:12.320 --> 05:16.320] They were trying to set you up. [05:16.320 --> 05:19.320] And then, wow, I get another statement. [05:19.320 --> 05:20.320] This is what it says. [05:20.320 --> 05:24.320] Now it's all due, and it's all due the first of this month. [05:24.320 --> 05:31.320] And as of, you know, as of this 16th of September, I'm sorry, this is last month, there's 1538 days. [05:31.320 --> 05:33.320] So they're admitting to the time. [05:33.320 --> 05:34.320] Okay. [05:34.320 --> 05:40.320] Yes, what they were doing, if they could have conned you in to sending them a thousand bucks, [05:40.320 --> 05:47.320] then the clock starts again. [05:47.320 --> 05:53.320] But since they weren't, they tried that and it didn't work, they weren't able to con you into it. [05:53.320 --> 05:56.320] So they went ahead and requested the full amount again. [05:56.320 --> 05:58.320] So this is good. [05:58.320 --> 06:04.320] I think they know they're over the time limit and they're hoping you don't know. [06:04.320 --> 06:05.320] Exactly. [06:05.320 --> 06:06.320] I think so. [06:06.320 --> 06:12.320] That's why I would say, so you're saying they're suggesting that go find legal counsel, go [06:12.320 --> 06:13.320] find a claim. [06:13.320 --> 06:23.320] Go find a lawyer to file a quiet title action against concerning the security instrument. [06:23.320 --> 06:24.320] Okay. [06:24.320 --> 06:25.320] Okay. [06:25.320 --> 06:26.320] I just wanted to be clear. [06:26.320 --> 06:29.320] Now the last question, I'll let you go so you can get other calls. [06:29.320 --> 06:36.320] It's a small question, but when I filed a few years ago, when I filed a document with [06:36.320 --> 06:42.320] the court, this is a little different with regard to the case that I had in the federal [06:42.320 --> 06:47.320] district court at the time, I filed a list pendant with the county clerk's office. [06:47.320 --> 06:49.320] That was about two years ago. [06:49.320 --> 06:53.320] And recently I started looking at the documents from the county records just to see what's [06:53.320 --> 06:54.320] going on, right? [06:54.320 --> 07:04.320] But what I found is that the list pendant that I had filed with the court records office, [07:04.320 --> 07:08.320] they did not file it as a list pendant, they filed it as an other. [07:08.320 --> 07:13.320] The document is categorized as other, not as list pendant. [07:13.320 --> 07:17.320] Well, is it filed in the county recorders office? [07:17.320 --> 07:20.320] It is filed with the county, yes. [07:20.320 --> 07:21.320] Okay. [07:21.320 --> 07:28.320] Then I would go to the clerk and have them reclassify that as list pendants. [07:28.320 --> 07:29.320] Exactly. [07:29.320 --> 07:30.320] Okay. [07:30.320 --> 07:34.320] So whatever you do, do not file another one. [07:34.320 --> 07:35.320] Okay. [07:35.320 --> 07:41.320] Well, okay, I'm sorry, that really doesn't matter. [07:41.320 --> 07:49.320] The list pendants is not critical, so long as the list pendants is properly filed. [07:49.320 --> 07:55.320] And it's important that you get it so in a way that it can be found. [07:55.320 --> 08:02.320] If you go in and search the property records, will you find that list pendants? [08:02.320 --> 08:04.320] Right now, no. [08:04.320 --> 08:05.320] Okay. [08:05.320 --> 08:11.320] Then you need to go down and make sure they fix that part. [08:11.320 --> 08:19.320] Because in this case, if something occurred, then you would sue the clerk. [08:19.320 --> 08:25.320] Because you made the proper filing and the clerk filing in a way that it couldn't be found. [08:25.320 --> 08:31.320] And Tarrant County, Travis County has a listing for less pendants. [08:31.320 --> 08:33.320] Yes, they do. [08:33.320 --> 08:39.320] And so this was that, and that absolutely needs to be fixed. [08:39.320 --> 08:47.320] But it doesn't need to be, it wouldn't matter even if you refiled it because being a list [08:47.320 --> 08:52.320] pendants, that would only apply to a third party who tried to purchase the property. [08:52.320 --> 08:57.320] Right, and that's in the past now, but I'm just saying that my concern is that if it [08:57.320 --> 09:01.320] ever needs to be relevant again, it's not as filed that way. [09:01.320 --> 09:07.320] It's countered other, which is quite a very, very good point. [09:07.320 --> 09:11.320] It's something that I haven't addressed that I've come across. [09:11.320 --> 09:17.320] If you filed something with the county recorder's office, give it a couple of weeks or a month [09:17.320 --> 09:24.320] and go back and do a search in the records and see if you spied that document. [09:24.320 --> 09:30.320] I have a friend here who I went down, he was being foreclosed on, I went down and checked the record. [09:30.320 --> 09:35.320] I did not find a deed of trust. [09:35.320 --> 09:40.320] So I filed a mechanic's lien. [09:40.320 --> 09:41.320] Okay. [09:41.320 --> 09:46.320] I went back and checked and didn't find my mechanic's lien. [09:46.320 --> 09:47.320] Okay. [09:47.320 --> 09:51.320] And the reason being is they filed a deed of trust under the wife's name. [09:51.320 --> 10:01.320] I filed my mechanic's lien under his name, but I didn't use the middle initial. [10:01.320 --> 10:04.320] So it wouldn't find it. [10:04.320 --> 10:10.320] So if you file something, go back and make sure you find it. [10:10.320 --> 10:19.320] Because what I would tell Chase Bank when they come complaining about my mechanic's lien [10:19.320 --> 10:24.320] and they try to enforce their lien, I tell them that I went and looked in the record [10:24.320 --> 10:26.320] and I did not find it. [10:26.320 --> 10:28.320] And they're going to say, well, we filed it. [10:28.320 --> 10:30.320] The clerk didn't file it right. [10:30.320 --> 10:35.320] And I would say your problem, not my problem. [10:35.320 --> 10:40.320] My problem is I looked in the court record and couldn't find it. [10:40.320 --> 10:45.320] So if we file something in the record, we absolutely need to go back and check [10:45.320 --> 10:49.320] and make sure they've got it where it can be found. [10:49.320 --> 10:51.320] Or you get in a bigger fight. [10:51.320 --> 10:57.320] You wind up in a fight with the clerk and you don't want to have that fight. [10:57.320 --> 11:01.320] If she's part of the good old boy network. [11:01.320 --> 11:02.320] Yeah. [11:02.320 --> 11:06.320] Okay, but make sure the less pendants is filed in the right place [11:06.320 --> 11:14.320] and get a lawyer to do a quiet title on the deed of trust because it's expired. [12:00.320 --> 12:28.320] Well, anyway, I found documents they filed into a court copies of note and the deed of trust and able to see some tampering with the signature pages where apparently the originals were 14-inch length pages and reduced down to fit on 11-inch. [12:28.320 --> 12:42.320] And I'm able to see that the last page is copied at a greater magnification than that of the previous pages. [12:42.320 --> 12:46.320] And by my relation, that'd be a loss. [12:46.320 --> 12:47.320] Okay. [12:47.320 --> 12:49.320] I do have this up. [12:49.320 --> 12:58.320] And has this been presented as a copy or was this presented as an original? [12:58.320 --> 12:59.320] No, the copy. [12:59.320 --> 13:00.320] Okay. [13:00.320 --> 13:01.320] It's a copy? [13:01.320 --> 13:02.320] That's okay. [13:02.320 --> 13:03.320] Judgement act. [13:03.320 --> 13:14.320] Because technically, when they say this is a true and accurate copy of the original, it cannot be an exact copy of the original. [13:14.320 --> 13:20.320] It either needs to be bigger or smaller so that you can tell that it's not an original. [13:20.320 --> 13:32.320] This is a thing about, especially if you copy and make a photocopy of money, it has to be a different size. [13:32.320 --> 13:47.320] Okay, but are you saying that beyond just the magnification of the copy that there are modifications as to substantive content? [13:47.320 --> 13:55.320] Well, there's about two inches off the bottom that's missing that you can't, they can't be seen where there might be stamps and things. [13:55.320 --> 14:02.320] Ah, okay, then that makes this... [14:02.320 --> 14:05.320] And where did they file this? [14:05.320 --> 14:08.320] In the court? [14:08.320 --> 14:16.320] Yeah, the summary judgment is exhibit with an affidavit truth they got from somebody. [14:16.320 --> 14:25.320] Is the portion that's missing from this document relevant? [14:25.320 --> 14:33.320] Well, it could be if there's stamps on there indicating that it had been already turned over to someone else. [14:33.320 --> 14:35.320] Oh, is this a note? [14:35.320 --> 14:38.320] Yeah, the note. [14:38.320 --> 14:40.320] Oh, okay, this is a note. [14:40.320 --> 14:46.320] The third page is a different magnification than the first two pages. [14:46.320 --> 14:52.320] Then this is a great reason to say you've never seen this document. [14:52.320 --> 14:55.320] Oh, you can't do that because you've never seen it anyway. [14:55.320 --> 15:03.320] Okay, that the document is insufficient because it's not a true and accurate copy. [15:03.320 --> 15:04.320] Right. [15:04.320 --> 15:14.320] And so that would definitely lead one to make the claim that this document has been cut and patched and pasted. [15:14.320 --> 15:22.320] They're going to send a document to the court and they send a piece of garbage like this. [15:22.320 --> 15:24.320] Yeah, have you got the document up? [15:24.320 --> 15:28.320] Yeah, I've got it up. I'm looking at it now. [15:28.320 --> 15:34.320] And for those of you who can't see the document on one page, it's wider than the other. [15:34.320 --> 15:46.320] Like the copier they used to copy it somehow changed the magnification by page. [15:46.320 --> 15:50.320] And the likelihood of that happening is somewhere between little and none. [15:50.320 --> 15:58.320] You do have smart copiers that when you put the first page in it, it looks at it and sets a magnification. [15:58.320 --> 16:07.320] Like if it's a eight and a half by 14, then it may shrink it down so it fits on that eight and a half by 11. [16:07.320 --> 16:10.320] But it'll only do that on the first page. [16:10.320 --> 16:15.320] Once it's scanning documents, it won't change the magnification again. [16:15.320 --> 16:21.320] Yeah. Danny, are you sure that the note was on eight and a half by 14? [16:21.320 --> 16:25.320] Because I've never seen a note on eight and a half by 14. [20:32.320 --> 20:38.320] And then the last page with the signature, it's wider. [20:38.320 --> 20:42.320] Well, I'm looking at the last page with the signature. [20:42.320 --> 20:51.320] And unless this has been cut and cropped, the signature is wider than the text. [20:51.320 --> 20:57.320] It looks as though the text has been indented. [20:57.320 --> 21:11.320] This is definitely a reason to request that the other party, I don't know if it's defendant or plaintiff, [21:11.320 --> 21:14.320] produce the original instrument. [21:14.320 --> 21:19.320] Have you made that request in the past? [21:19.320 --> 21:30.320] No, they may claim that they had it in court and, you know, waving a paper around, but... [21:30.320 --> 21:39.320] You might want to ask to see it, because if they claim they had it in court, then they have to still have it. [21:39.320 --> 21:44.320] If they subsequently cannot produce it, now they have a problem. [21:44.320 --> 21:58.320] Well, I didn't think that they really had it then, but now they're supposed to have someone having sworn to this being a true and correct copy. [21:58.320 --> 22:02.320] And it's a trash cop. [22:02.320 --> 22:05.320] The piece is missing? [22:05.320 --> 22:14.320] Yeah, but my calculation is about two inches missing off the bottom of the last page, both of them. [22:14.320 --> 22:27.320] Were those two inches passed in the margins, or did it cut out like I'm seeing footers on these? [22:27.320 --> 22:29.320] Oh, here's one that seems to have... [22:29.320 --> 22:36.320] The next, the last page, that one's okay. It's the last page. [22:36.320 --> 22:47.320] It's under exhibit two. Obligatory loans, writers, and security instruments. [22:47.320 --> 22:51.320] Is that listed as the last page? [22:51.320 --> 22:56.320] Okay, you don't have a complete page of both pages. [22:56.320 --> 23:14.320] If they've sworn under oath that this is a true and correct copy, is it their position that the original note was chopped up like this and had pieces missing? [23:14.320 --> 23:17.320] Oh, no, I didn't say anything like that. [23:17.320 --> 23:32.320] Okay, well, if someone's testified that this is true and accurate copy, then they're testifying that the original had these kinds of problems with it. [23:32.320 --> 23:36.320] The affidavit would go to aggravated perjury. [23:36.320 --> 23:38.320] Yeah, that's what I'm thinking. [23:38.320 --> 23:48.320] The petition for the original instrument, this gives you reason to ask, the direct reason to ask for the original. [23:48.320 --> 23:57.320] And if they've already stated that they have it, now they're subject to collateral estoppel from coming back and saying they don't have it. [23:57.320 --> 24:19.320] Well, they were saying before, and that's part of the problem with the affidavit, too, is she's off in Washington State and saying that the local attorneys have the original instrument. [24:19.320 --> 24:25.320] Okay, if she's in Washington State, how did she know they had the original instrument? [24:25.320 --> 24:27.320] Yeah, I mean, like... [24:27.320 --> 24:35.320] Have you went to... Jeff Sedgwick has a site, Void Judgements. [24:35.320 --> 24:42.320] Yeah, yeah, he called me last time I was there and I went and got... [24:42.320 --> 24:46.320] Did you look at his section on affidavits? [24:46.320 --> 24:50.320] Yes, I copied it down. [24:50.320 --> 24:54.320] But did you read it so you can quote it back to us so we don't have to read it? [24:54.320 --> 24:56.320] Oh, no. [24:56.320 --> 25:07.320] Okay, but if you look at that, that'll give you what you need to challenge the validity of the affidavit. [25:07.320 --> 25:13.320] Yeah, what I don't use this with was a motion to strike. [25:13.320 --> 25:21.320] Do a motion to strike and you might go to the local grand jury and ask them to indict this chalk who did the affidavit. [25:21.320 --> 25:23.320] Yeah. [25:23.320 --> 25:25.320] Politics. [25:25.320 --> 25:31.320] Yes, yeah, thinking that and the attorneys too, because they're asking them to do this. [26:55.320 --> 26:59.320] There's just no way that the affidavit can be valid. [26:59.320 --> 27:02.320] So it has to be fraudulent. [27:02.320 --> 27:09.320] And if you take that in the criminal case first, you know, present that to a grand jury. [27:09.320 --> 27:14.320] And I think you can approach a grand jury in Tennessee, can't you? [27:14.320 --> 27:16.320] Yeah, I told you about that. [27:16.320 --> 27:18.320] Yeah, that was good to hear. [27:18.320 --> 27:23.320] And so you take that to a grand jury, you don't care what they do with it. [27:23.320 --> 27:29.320] Because you can go to the next grand jury, the next one, the next one, all you want to. [27:29.320 --> 27:36.320] And let them bring it up in court that you filed criminally and then ask for sanctions against them for bringing it up. [27:36.320 --> 27:38.320] No. [27:38.320 --> 27:45.320] Because the fact that you filed criminal has nothing to do with civil case. [27:45.320 --> 27:52.320] And you're forbidden to use criminal to gain advantage in a civil action. [27:52.320 --> 28:04.320] So you never mention it. If they mention it, you accuse them of using the fact that you filed criminally to gain sympathy with the judge in the civil and ask for sanctions against them for it. [28:04.320 --> 28:06.320] Okay. [34:23.320 --> 34:25.320] Yes. [34:25.320 --> 34:33.320] And the house flipper subsequently didn't pay the foundation guy. [34:33.320 --> 34:46.320] And now the foundation guy is threatening to foreclose and the house flipper is trying to use that as a reason to force you to sell the property to him for next to nothing. [34:46.320 --> 34:48.320] Yes. [34:48.320 --> 34:57.320] And the funny thing about it is, is the house flipper's attorney, which is his uncle, is the one that prepared the mechanics lean for the foundation company. [34:57.320 --> 35:02.320] So this looks like illegal conversion. [35:02.320 --> 35:07.320] This looks like a scheme on their part to steal the property. [35:07.320 --> 35:17.320] And I can almost assure you, when you file a petition for quiet title as to the mechanics lean, [35:17.320 --> 35:28.320] and claim that it is part of an illegal conversion scheme, that these guys are going to get real excited. [35:28.320 --> 35:32.320] Have you talked to a lawyer about this? [35:32.320 --> 35:40.320] We have talked to several. We did hire one, and he originally, before we paid him, [35:40.320 --> 35:46.320] because I had already researched all the stuff that they were doing, and he agreed it was criminal. [35:46.320 --> 35:52.320] And then after we paid him, he came back and he, at the end, he said, just walk away and let him have it. [35:52.320 --> 35:54.320] It's not worth fighting for it. [35:54.320 --> 35:57.320] Did he give you your money back? [35:57.320 --> 36:07.320] No. In fact, he had originally said a price, and we got a bill more than what he said, double. [36:07.320 --> 36:17.320] Well, one thing we know how to do here is how to handle attorneys. [36:17.320 --> 36:33.320] The first thing he gets is a bar grievance, and then you may send him a tort letter notifying him that you're going to sue him for malpractice, [36:33.320 --> 36:40.320] because once you paid him to represent your case, he had a duty to represent your case. [36:40.320 --> 36:48.320] And then he gave you idiot advice so that he didn't have to represent your case, [36:48.320 --> 36:55.320] and now any harm that occurs to you because of that, you hold him responsible for. [36:55.320 --> 37:02.320] When a lawyer takes a suit, the first thing he looks for is deep pockets. [37:02.320 --> 37:11.320] And in this case, the lawyer has to deep pockets because he didn't have to have malpractice insurance in Texas, [37:11.320 --> 37:15.320] but almost all lawyers do. [37:15.320 --> 37:25.320] I started to say he would be out of his mind not to, but then he's a lawyer, so that kind of comes with the territory sometimes. [37:25.320 --> 37:34.320] But I would suggest a bar grievance against the lawyer and a notice of tort against the lawyer. [37:34.320 --> 37:42.320] And then a petition for quiet title as to the mechanics lead. [37:42.320 --> 37:54.320] That would be the remedy of choice and a suit against the house flipper for three times the value of the property. [37:54.320 --> 37:58.320] Okay. [37:58.320 --> 38:07.320] And your timid response was an indication that you don't know how you'll get a lawyer to do this. [38:07.320 --> 38:10.320] That's the way I took that. Is that correct? [38:10.320 --> 38:12.320] No. [38:12.320 --> 38:23.320] No, I was just taking a note, but like the attorney we hired, I asked him why he hasn't filed a quiet title. [38:23.320 --> 38:27.320] And he said, what is that? [38:27.320 --> 38:30.320] What? [38:30.320 --> 38:33.320] Okay, wonderful. [38:33.320 --> 38:38.320] And I have him recording because I recorded all the calls with him and he just paused. [38:38.320 --> 38:41.320] I paused because I was like, seriously? [38:41.320 --> 38:44.320] You don't know what a quiet title is. [38:44.320 --> 38:47.320] I was just shocked. [38:47.320 --> 38:49.320] Okay, that is a big deal. [38:49.320 --> 38:57.320] The biggest deal for lawyers is not knowing what they're doing. [38:57.320 --> 39:02.320] There's a couple of lawyers I'm trying to deal with here in the DFW area. [39:02.320 --> 39:05.320] I will get this to one of them. [39:05.320 --> 39:16.320] But a quiet title here is likely to really jerk everybody's chain because it's so outrageous. [39:16.320 --> 39:25.320] And the best thing to get an attorney to actually do it right is what you've been doing is you do most of the paperwork. [39:25.320 --> 39:29.320] Now, quiet title action is relatively simple. [39:29.320 --> 39:37.320] If you look at quiet title action in Texas law, the... [39:37.320 --> 39:51.320] I think in trespass to try title, trespass to try title is almost the same and trespass to try title statute actually has a standard form that you can dispel out. [39:51.320 --> 40:06.320] The only real difference between trespass to try title and quiet title is trespass to try title is a specific community after someone's made a claim against your title. [40:06.320 --> 40:18.320] If you have a deed of trust or something that you think is bogus, you file a quiet title or if there's a less pendent, you generally do a quiet title. [40:18.320 --> 40:27.320] The only time I do a trespass to try title and that's unique to Texas is after there's been a foreclosure and there is a trustees deed. [40:27.320 --> 40:34.320] The trustees deed makes a claim against the property, a claim of hold or status. [40:34.320 --> 40:38.320] And you have a warranty deed that makes a claim of hold or status. [40:38.320 --> 40:54.320] Trespass to try title would test your warranty deed against the trustees deed whereas a mechanic's claim doesn't make a claim of hold or ship, so that would go to quiet title. [40:54.320 --> 41:13.320] But just do a search for Texas quiet title, you'll get. Just on Google or StarPage, you'll get examples of trespass and quiet title should be very simple. [41:13.320 --> 41:28.320] I emailed over my quiet title to you because I found one that's actually a Tarrant County template for it. [41:28.320 --> 41:43.320] Oh, okay. The court, the document. I don't know what it's called. I'm sorry. But anyway, it goes into the whole quiet title and how to type it up and everything. [41:43.320 --> 41:50.320] I actually got your email while I was on the air last night. [41:50.320 --> 41:51.320] Okay. [41:51.320 --> 41:57.320] Excuse me, I didn't want to sneeze and blow out my microphone. [41:57.320 --> 42:08.320] So I wasn't able to read it and I didn't get to it today. [42:44.320 --> 42:50.320] So this could be a serious problem for the house flipper. [42:50.320 --> 43:03.320] One question I have is because he is saying that the foundation company is foreclosing. Well, it's in foreclosure with the mortgage company. [43:03.320 --> 43:12.320] I didn't realize a foundation company could foreclose before the mortgage company. [43:12.320 --> 43:22.320] Well, the foundation claim would have had to have been approved by the mortgage company. [43:22.320 --> 43:42.320] Otherwise, the foundation company's claim, the mechanics lean or material lean would be subrogated to the deed of trust. The deed of trust would pay first. No, they can't. [43:42.320 --> 43:52.320] They can't sue in front of the deed of trust. And it's in the contract. They can't incur this claim without the lender's approval. [47:31.320 --> 47:39.320] I'll look that up to be exactly accurate, but there's a special case statute to sue these guys under. [47:39.320 --> 47:52.320] And they're not used to people standing up for their rights for the most part, especially if the property is in foreclosure because generally everybody just walks away. [47:52.320 --> 48:04.320] Once you sue for quiet title, that'll pretty well stop these guys. How far into foreclosure is the property? [48:04.320 --> 48:12.320] They said they just moved it over. The mortgage company just moved it over into foreclosure on Monday. [48:12.320 --> 48:18.320] So they said it would probably be auctioned off like November 4th. [48:18.320 --> 48:24.320] Okay. So they just made a filing of a notice of intent to foreclose. Okay. [48:24.320 --> 48:25.320] Yes. [48:25.320 --> 48:29.320] How old is the note? [48:29.320 --> 48:36.320] It's either 91 or 97. [48:36.320 --> 48:40.320] I'll assume 97. [48:40.320 --> 48:47.320] Then probably most of the note is paid off. [48:47.320 --> 48:48.320] Yes. [48:48.320 --> 49:03.320] So if you will get a, do you have a copy of the note and the settlement statement? Do you have the closing documents on that? [49:03.320 --> 49:07.320] Yeah, I do. [49:17.320 --> 49:33.320] So how to handle foreclosure now? You can sue the house flipper. He's going to have a problem because the courts are not going to be very patient with him. [49:33.320 --> 49:38.320] You know, you're the one that has the better claim to the property. [49:38.320 --> 49:46.320] If he claims he purchased it for 500 bucks, he's not going to have much of a claim against the property. [49:46.320 --> 49:55.320] And then he came in and damaged the property. So you can, you know, put in your claim amount of damage that he caused. [49:55.320 --> 50:01.320] Because you didn't hire it. Will you consult it before they hire the foundation guy? [50:01.320 --> 50:03.320] No, we were not. [50:03.320 --> 50:12.320] Okay. The foundation guy, you might sue the foundation guy for the damage because he had no right to come in there. [50:12.320 --> 50:18.320] The foundation guy should have looked at the public records before he came in. [50:18.320 --> 50:28.320] If you don't have the property, if he has a problem, he can't come in and damage property that I own half of without my permission. [50:28.320 --> 50:29.320] Right. [50:29.320 --> 50:42.320] So he's goofed up and definitely the lawyer who made up the mechanics lean, make sure you bar grieve the lawyer. That'll give him apoplexy. [50:42.320 --> 50:47.320] And that will tell the lawyer that you know how to beat him up. [50:47.320 --> 50:52.320] And then when you sue, sue the lawyer as well. [50:52.320 --> 50:58.320] And that will pretty well end his malpractice insurance. [50:58.320 --> 51:03.320] That'll cost the lawyer more than the value of this property. [51:03.320 --> 51:15.320] Okay. See, the attorney that we hired, when we brought that up to him about, you know, we were not in agreement. We weren't even, you know, it was never discussed with us or anything. [51:15.320 --> 51:24.320] They just done it before they even knew, you know, that my husband and his sister owned part of the house. They just started making their repairs. [51:24.320 --> 51:34.320] And he said, well, they were owners and that still makes you responsible for half of it because, you know, they were part owners. And so they agreed to it. [01:03:59.320 --> 01:04:09.320] So when it says the territorial limits of the entity levying the taxes, when you read that, I was wondering why they stated it that way. [01:04:09.320 --> 01:04:17.320] That's because each county is a separate political entity in its own right. [01:04:17.320 --> 01:04:23.320] And so your taxes will be subject to the county. [01:04:23.320 --> 01:04:26.320] Okay, and I know that this is a county issue. [01:04:26.320 --> 01:04:42.320] When I asked the county attorney earlier this week to define those territorial limits, she was not able to give me an answer. [01:04:42.320 --> 01:04:47.320] That's not surprising. She's probably never been asked that question before. [01:04:47.320 --> 01:04:57.320] But probably after she's thought about it a little while, she'll go get a map of the county and that will define the territorial limits. [01:04:57.320 --> 01:05:02.320] Now, territorial limits change under certain circumstances, but not this one. [01:05:02.320 --> 01:05:07.320] I mean, for a police officer, the boundary is not the boundary. [01:05:07.320 --> 01:05:14.320] You have to have a margin on either side. So that was when I was hearing the question. [01:05:14.320 --> 01:05:16.320] That's what I was thinking. [01:05:16.320 --> 01:05:20.320] If that was the issue, then the territorial limits would change somewhat. [01:05:20.320 --> 01:05:29.320] But as to the taxing authority, it's going to be wherever the line is drawn. [01:05:29.320 --> 01:05:33.320] So it goes to the physical boundary? [01:05:33.320 --> 01:05:40.320] The physical boundary of the county, yes. [01:05:40.320 --> 01:05:47.320] That will be the territorial limit of the county. [01:05:47.320 --> 01:05:49.320] Okay. [01:05:49.320 --> 01:05:54.320] It's odd that you ask this kind of question. This is an unusual question. [01:05:54.320 --> 01:06:00.320] Was there an issue about the boundaries of the county or the authority? [01:06:00.320 --> 01:06:06.320] No. The issue was, is my mother lives in a very rural area. [01:06:06.320 --> 01:06:12.320] And this past year, they raised her property taxes 62%. [01:06:12.320 --> 01:06:17.320] She lives in a mobile home that is almost 20 years old. [01:06:17.320 --> 01:06:28.320] And for the last, I don't know, maybe five years, the taxes have gone down a little bit each year as the mobile home depreciates. [01:06:28.320 --> 01:06:38.320] And this past year, instead of going down a little bit like everyone else's did, hers shot up 62%. [01:06:38.320 --> 01:06:44.320] Have you challenged it with the assessor? [01:06:44.320 --> 01:06:45.320] Yes. [01:06:45.320 --> 01:06:51.320] Did you get a copy of the assessment? [01:06:51.320 --> 01:07:06.320] No. This was the way that you challenged the decision in this county is you file an appeal, which I helped my mother do. [01:07:06.320 --> 01:07:20.320] And the assessor claims that my mother, the assessor thinks that my mother lives in what's called an exclusive area of the county, [01:07:20.320 --> 01:07:27.320] even though she'd be assessor as well aware of that where my mother lives, you have to haul water. [01:07:27.320 --> 01:07:36.320] The roads are not maintained, not even by the county, they are dirt roads. [01:07:36.320 --> 01:07:46.320] And every time I go and ask what the justification is, I either get they compared her home to other properties [01:07:46.320 --> 01:07:57.320] and the latest rationale I've heard is, will they switch methods on how they tax mobile homes? [01:07:57.320 --> 01:08:02.320] Did you check the tax rate for other mobile homes? [01:08:02.320 --> 01:08:08.320] Okay, hold on, wrong question, wrong question. [01:08:08.320 --> 01:08:15.320] How did they change the taxing method under what authority? [01:08:15.320 --> 01:08:26.320] Well, that's interesting because I didn't find out that they did this until I was at the board of supervisors meeting the other day. [01:08:26.320 --> 01:08:46.320] And it was disclosed by one of the county assessor lead assessors that back in 2011, an in-house, the assessor called it an in-house decision by the county assessor, [01:08:46.320 --> 01:09:06.320] was made to change the method using one table which shows a depreciation for the life of a mobile home to another method using square footage. [01:09:06.320 --> 01:09:16.320] There were no notices that I recall being said. What authority does the assessor have to make that determination? [01:09:16.320 --> 01:09:18.320] I have no idea. [01:09:18.320 --> 01:09:34.320] That would be the first thing I would want to see because when it comes to public officials, you understand that the Constitution wasn't written for you. [01:09:34.320 --> 01:09:44.320] It doesn't exactly protect you. What it does is restricts public officials in what they can do. [01:09:44.320 --> 01:09:47.320] So it's a restricted document. [01:09:47.320 --> 01:09:59.320] And in that vein, you as a citizen, you can do anything you want to do. [01:09:59.320 --> 01:10:17.320] So long as the law does not specifically forbid you to do it, a public official, on the other hand, may only do what the law specifically authorizes him to do. [01:10:17.320 --> 01:10:44.320] So always the first question. By what authority? Not vague general implied authority. What specific authority does the tax assessor have to change the taxing methods in a way that will dramatically change the amount of tax applied to a given property? [01:10:44.320 --> 01:10:55.320] If he doesn't have it, then he just arbitrarily decided to make this change in every state that's a crime. [01:10:55.320 --> 01:11:01.320] Public official exerts or purports to exert an authority he does not expressly have. [01:11:01.320 --> 01:11:19.320] And in the process denies a citizen in the full and free access to her enjoyment of right. That's a crime in every state. It is a reflection of the Ku Klux Klan Act passed in 1865, which is codified into federal code as 18 U.S. Code 242. [01:11:19.320 --> 01:11:38.320] Every state has a statute that reflects that particular code. In Texas is 39.03 Pina code. And you're going to have one in Arizona. So first thing I would want to know from that assessor just exactly where did you get that authority? [01:11:38.320 --> 01:11:46.320] So then would I write, would I direct my letter to the county assessor? [01:11:46.320 --> 01:11:48.320] Absolutely. [01:11:48.320 --> 01:11:50.320] Okay. [01:11:50.320 --> 01:12:02.320] Or they may call him county cop told or where they call him requested under open records. [01:12:02.320 --> 01:12:03.320] Okay. [01:12:03.320 --> 01:12:18.320] This open records request is not really a request. It's a demand. And every open records law that I've looked at is not a civil statute. It's criminal statute. [01:12:18.320 --> 01:12:32.320] Meaning that if the agency or individual does not comply with the act, it's not a tort. It's a crime. [01:12:32.320 --> 01:12:38.320] I've had lots of public officials say, well, if you don't like it, just sue me. No, I got a better idea. [01:12:38.320 --> 01:12:44.320] I call 911 get a cop out here to arrest you. I like that a lot better. [01:12:44.320 --> 01:12:54.320] So since you have a request, there has to be more. Are you the only one that's raising this issue? [01:12:54.320 --> 01:12:57.320] As far as I know, yes. [01:12:57.320 --> 01:13:03.320] Have you looked at the tax records for other homes in that area? [01:13:03.320 --> 01:13:23.320] I have. And interestingly, there are no others that have been raised to the tune of 62%. And also, there are several properties that still are not being taxed. [01:13:23.320 --> 01:13:27.320] Well, not being taxed at all. [01:13:27.320 --> 01:13:46.320] That is, they are being taxed as vacant, as nearly vacant, unimproved land, when in fact there are mobiles and other outbuildings that have been erected on those properties. [01:13:46.320 --> 01:13:53.320] Just like your tax assessor is not doing an assessment, you might want to look at the assessments that he's doing. [01:13:53.320 --> 01:14:07.320] How often is the assessor in Arizona required to do an actual assessment as opposed to an estimate? [01:14:07.320 --> 01:14:14.320] I think it's every three years. [01:14:14.320 --> 01:14:25.320] Okay, so do you need to check to see when the last actual assessment was made? [01:14:25.320 --> 01:14:37.320] It sounds like you're in between actual assessments and they change the way they do their calculations. [01:14:37.320 --> 01:14:47.320] None of that sounds right. If your property changed dramatically and other people's didn't, something else is wrong here. [01:14:47.320 --> 01:14:50.320] Most likely it's an error. [01:14:50.320 --> 01:14:57.320] Go to a, ask a real estate agent to give you a comp on the property. [01:14:57.320 --> 01:15:12.320] We've actually written about this issue about, because like I said, this is a rural area and we inquired a few years ago as to why certain properties were being taxed [01:15:12.320 --> 01:15:33.320] and what seemed to be reviewed on a very regular basis and others' word. The person who is responsible for that area actually put it in writing that they don't have time to get all of the properties out there. [01:15:33.320 --> 01:15:42.320] So that's not necessarily a problem so long as they are consistent in how they address the taxation. [01:15:42.320 --> 01:15:58.320] But if they can't get to your property to do a proper assessment, then don't change the amount you're charging. [01:15:58.320 --> 01:16:05.320] Does this in any way violate the constitution when it comes to direct? [01:16:05.320 --> 01:16:14.320] No, no, this is an authorized taxation. It's not like the taxation is illegal. [01:16:14.320 --> 01:16:25.320] They are likely to be implementing it in a way that doesn't comport with state law, but I don't see this as a constitutional issue. [01:16:25.320 --> 01:16:34.320] You have a right to assess property taxes and that's pretty well what would go to the constitution. [01:16:34.320 --> 01:16:47.320] The fact that the tax is being levied unevenly, that's a local issue. It's not going to be a constitutional issue. [01:16:47.320 --> 01:16:59.320] If the state levied the tax generally over the whole state, oh hang on, go to work, be right back. [01:20:15.320 --> 01:20:24.320] That's not likely to go to a constitutional issue, but often constitutional issues are the hardest place to go to anyway. [01:20:24.320 --> 01:20:28.320] What you want to look is rules, regulations and statutes. [01:20:28.320 --> 01:20:33.320] Statutes first, regulations second, then rules. [01:20:33.320 --> 01:20:42.320] And this sounds like a rule that the assessor implemented. [01:20:42.320 --> 01:20:47.320] And I would want to be sure that that rule was not arbitrary or capricious, [01:20:47.320 --> 01:20:55.320] or even if it wasn't that the rule was being applied appropriately. [01:20:55.320 --> 01:20:57.320] Okay. [01:20:57.320 --> 01:21:03.320] Okay, and in saying that, no, I started to say if they didn't apply it appropriately, [01:21:03.320 --> 01:21:07.320] I still don't think this would go to a constitutional issue. [01:21:07.320 --> 01:21:19.320] But even if it did, constitutional issues are about the hardest thing to try to adjudicate. [01:21:19.320 --> 01:21:26.320] They're extremely difficult because you're asking to adjudicate something that affects the whole state. [01:21:26.320 --> 01:21:45.320] It's much easier to claim a violation of a local rule and bring that to the assessor will realize that if you show that the assessor is not properly applying the rules [01:21:45.320 --> 01:21:51.320] or he's not doing the assessments correctly, that's going to look bad on him. [01:21:51.320 --> 01:21:56.320] So he's more likely to respond without you having to go to court. [01:21:56.320 --> 01:22:00.320] And if there's any way you can avoid that, that's certainly what you want to do. [01:22:00.320 --> 01:22:07.320] But first thing to do is go down there and get all the rules, regulations, and go through them. [01:22:07.320 --> 01:22:09.320] Okay. [01:22:09.320 --> 01:22:14.320] And it sounds like a big job, but I assure you it's not new as big as you think. [01:22:14.320 --> 01:22:20.320] The amount of rules and regulations they have that govern what they do, they're just not going to be that many. [01:22:20.320 --> 01:22:30.320] And especially that with the Tax Assessor, because he's going to have this huge book, but only a small portion of it's going to go to what you're interested in. [01:22:30.320 --> 01:22:39.320] You're not going to be concerned about how he assesses old folks homes or hospitals or schools. [01:22:39.320 --> 01:22:44.320] You're only going to want to know how he assesses private properties. [01:22:44.320 --> 01:22:46.320] It just won't be that much. [01:22:46.320 --> 01:22:53.320] And once you know his code better than he does, then you can get him to change things. [01:22:53.320 --> 01:22:55.320] Okay. [01:23:51.320 --> 01:23:57.320] Because I think that card back that you suggested to me, you know, and they said that they were going [01:23:57.320 --> 01:24:03.320] to investigate, and I never got the no, and that guy seemingly just disappeared. [01:24:03.320 --> 01:24:10.320] And I have this other Shinara who is really, who has been so abrasive, he tried to attempt [01:24:10.320 --> 01:24:16.320] it to file a pre-motion conference for, you know, because he wanted to deny dismiss the [01:24:16.320 --> 01:24:17.320] claims. [01:24:17.320 --> 01:24:24.320] And then he, the judge, and that was, the judge doesn't allow that individual in his [01:24:24.320 --> 01:24:26.320] individual rules of practice for pro se. [01:24:26.320 --> 01:24:29.320] And I said that I wasn't going to consent. [01:24:29.320 --> 01:24:31.320] So therefore I had to write a letter. [01:24:31.320 --> 01:24:34.320] So he wrote his letter, and I wrote my letter of non-consent. [01:24:34.320 --> 01:24:39.320] And in his letter to the judge, which I knew he was doing something chaotic anyway, because [01:24:39.320 --> 01:24:44.320] it said in the individual rules of practice of this judge that no, the no circumstances, [01:24:44.320 --> 01:24:47.320] you know, a pre-motion conference with a pro se is not even necessary. [01:24:47.320 --> 01:24:51.320] It wouldn't be, it wouldn't be fair, first of all, for me, because I'm not so, I'm legal, [01:24:51.320 --> 01:24:53.320] but I'm not so legally inept. [01:24:53.320 --> 01:24:56.320] They could just throw something out and I wouldn't be able to grasp it. [01:24:56.320 --> 01:24:57.320] So it wouldn't be fair. [01:24:57.320 --> 01:25:02.320] And the judges know that, so they don't even take a chance, but they try to pull a fast [01:25:02.320 --> 01:25:05.320] one anyway by asking for a pre-motion conference. [01:25:30.320 --> 01:25:35.320] It was complicated because what happened was is that my, my original work that I made [01:25:35.320 --> 01:25:37.320] was in 2001. [01:25:37.320 --> 01:25:42.320] They decided to, which is automatically copyright protected because it's a work of [01:25:42.320 --> 01:25:44.320] recognized statutes in museum. [01:25:44.320 --> 01:25:48.320] And these guys created a piece and an article. [01:25:48.320 --> 01:25:53.320] I'm not going to mention the name of the magazine, but it showed up like five years [01:25:53.320 --> 01:25:54.320] later. [01:25:54.320 --> 01:26:00.320] It's sort of with a funny date on it that seemed to predate mine, but it still wasn't [01:26:00.320 --> 01:26:05.320] even the final product that they ended up using for their big camp aim. [01:26:05.320 --> 01:26:10.320] Anyway, the long story short is that it's fraudulent. [01:26:10.320 --> 01:26:12.320] I did an investigation. [01:26:12.320 --> 01:26:15.320] There's no way this photographer was in this place at the time. [01:26:15.320 --> 01:26:20.320] They already stated that it was, that they had a license for it, but they never said [01:26:20.320 --> 01:26:21.320] they had a copyright for it. [01:26:21.320 --> 01:26:25.320] And this was, this was supposed to be another, a foreign photographer. [01:26:25.320 --> 01:26:26.320] Okay. [01:26:26.320 --> 01:26:28.320] So they don't have a copyright for it. [01:26:28.320 --> 01:26:30.320] And they would have submitted that. [01:26:30.320 --> 01:26:35.320] So they're trying to sneak in the date to add doubt upon the situation. [01:26:35.320 --> 01:26:37.320] So I knew this already going into it. [01:26:37.320 --> 01:26:39.320] I already preempted this whole situation. [01:26:39.320 --> 01:26:43.320] The only thing is right now, this is where it gets kind of tricky. [01:26:43.320 --> 01:26:49.320] So I, after I filed this motion to suppress, so I spoke to Eddie and he said, oh, you shouldn't [01:26:49.320 --> 01:26:50.320] have, but it's fine. [01:26:50.320 --> 01:26:55.320] In your letter to the judge, tell him that, you know, you'd be happy to win the case. [01:26:55.320 --> 01:26:58.320] You know, they could win your case for you if he wants to submit the evidence. [01:26:58.320 --> 01:27:02.320] You know, if you want to accept the evidence and go ahead and submit that fraudulent piece [01:27:02.320 --> 01:27:03.320] of evidence. [01:27:03.320 --> 01:27:08.320] So today, you know, I said, well, you know, I believe that this evidence was fraudulent, [01:27:08.320 --> 01:27:11.320] you know, and then this is what's going to happen if it does get accepted. [01:27:11.320 --> 01:27:16.320] Well, the judge, judge wrote back today, the defendants have not filed a motion to dismiss [01:27:16.320 --> 01:27:18.320] because they were trying to do a pre-motion. [01:27:18.320 --> 01:27:23.320] And therefore it is premature to dismiss the termination, whether the extrinsic evidence [01:27:23.320 --> 01:27:28.320] such as this article may be properly considered by the court in deciding that motion. [01:27:28.320 --> 01:27:32.320] Therefore, the evidence is in theory, I guess, admitted. [01:27:32.320 --> 01:27:38.320] So I need to now file motion for sanction, correct? [01:27:38.320 --> 01:27:40.320] He didn't say it was admitted. [01:27:40.320 --> 01:27:44.320] It hasn't even been considered yet. [01:27:44.320 --> 01:27:50.320] But what you've done is already thrown it into doubt. [01:27:50.320 --> 01:28:03.320] So when an issue comes up before the court to where that particular piece of evidence [01:28:03.320 --> 01:28:08.320] is relevant, then the lawyer will introduce that as evidence. [01:28:08.320 --> 01:28:13.320] Just including it with a document does not get it before the court. [01:28:13.320 --> 01:28:15.320] He has to present it. [01:28:15.320 --> 01:28:20.320] He has to establish foundation for it and then offer it to the court. [01:28:20.320 --> 01:28:23.320] And the court has to accept it. [01:46:45.320 --> 01:47:04.320] First thing to do is go down to the county registrar and if you don't have a name of an owner, you can look on their plot maps and find the property and check the documents in the public record. [01:47:04.320 --> 01:47:09.320] That is the reason for the county registrar's office. [01:47:09.320 --> 01:47:30.320] And 13.001 Texas property code says that any claim against real property, not properly acknowledged or proven, acknowledged, notarized, proven to witnesses and filed in the public record is void as to the holder. [01:47:30.320 --> 01:47:38.320] So if you're looking to purchase this property and you're concerned that there may be some problems with it. [01:47:38.320 --> 01:47:44.320] If the claim is not filed in the public record, it is void. [01:47:44.320 --> 01:47:47.320] So that is the first place to look. [01:47:47.320 --> 01:48:00.320] And then if you have other issues like flood or anything affecting the legality of the property, I kind of stepped in before you finished and you apologize for that. [01:48:03.320 --> 01:48:13.320] Yeah, basically as far as securing a land patent, I mean just any precautions I should take upfront and dealing with. [01:48:13.320 --> 01:48:23.320] I'm not sure about the property as far as whether I'll be dealing with a private sale or a real property sale. [01:48:23.320 --> 01:48:32.320] Yeah, anything, any claim against the property is going to, it will either be in the record or it will be void. [01:48:38.320 --> 01:48:47.320] It is not a requirement that you have the property in the title records. [01:48:47.320 --> 01:48:51.320] You can actually have it removed from those records. [01:48:51.320 --> 01:48:59.320] So if you're bringing the land patent forward, you might consider that depending on why you want to do it. [01:48:59.320 --> 01:49:08.320] If you want to get it off the tax rolls, that may be a way to add more leverage to get it off the tax rolls. [01:49:10.320 --> 01:49:21.320] I was looking at the property and then before I purchased it outright, I was going to do all the research and then have everything ready to go after I purchased the property. [01:51:33.320 --> 01:51:44.320] I'm calling on behalf of a friend of mine who's been in jail for almost two years and he's basically in a bind where he's got a lot of the attorney who's like friends with the judge. [01:51:44.320 --> 01:51:51.320] They don't want to let him out. [01:51:51.320 --> 01:51:54.320] He's been a witness to lots of crimes within the court, you know, the judge just doing things. [01:51:54.320 --> 01:51:59.320] And he tried to represent himself for a while, but now they won't let him do that. [01:51:59.320 --> 01:52:03.320] They're trying to get him declared mentally incompetent and there's nothing wrong with him. [01:52:03.320 --> 01:52:07.320] And I don't really know what to tell him to do. [01:52:07.320 --> 01:52:15.320] But he's been asking me to call the DA and ask the DA to drop the charges against him. [01:52:15.320 --> 01:52:25.320] Oh, well, he was arrested and then before he was released from jail, the case was dismissed. [01:52:25.320 --> 01:52:27.320] They refiled it before he left jail. [01:52:27.320 --> 01:52:30.320] It was dismissed again and then refiled again. [01:52:30.320 --> 01:52:37.320] They really don't have a case and they won't go to, they don't want to really go to trial on it and he doesn't want to take a plea. [01:52:37.320 --> 01:52:42.320] They say, if you don't please do the felony, you're going to spend the rest of your, you know, they're going to let him go. [01:52:42.320 --> 01:52:44.320] It's basically what they're threatening him with. [01:52:44.320 --> 01:52:48.320] And hello? [01:52:48.320 --> 01:52:50.320] Yeah, you're right. [01:52:50.320 --> 01:52:54.320] We don't have enough time to really get into all of it. [01:52:54.320 --> 01:53:03.320] I take it he's charged, if they're trying to get him to a plea to a felony, they must have some pretty serious charges against him. [01:53:03.320 --> 01:53:16.320] Well, he was charged with assault with a deadly weapon and it was, and something to do with somebody who was following him around and the guy drove past him. [01:53:16.320 --> 01:53:20.320] The guy in his car started to come towards him and he just drove around him and went home. [01:53:20.320 --> 01:53:25.320] And they're trying to say that he's trying to get him with the car and I don't believe that's what really happened. [01:53:25.320 --> 01:53:34.320] But they came in and arrested him at his home at about midnight, left his two children alone in the apartment when they took him to jail. [01:53:34.320 --> 01:53:44.320] And then he's done it on a child with engagement because they left the kids behind and they're doing a lot of dumb things. [01:53:44.320 --> 01:53:51.320] And he doesn't really know enough, he's done enough experience to really represent himself easily. [01:53:51.320 --> 01:54:00.320] And I talked to his attorney a couple of times and I can tell what a surprise, you know, he's a slime ball. [01:54:00.320 --> 01:54:04.320] Yeah, well, you might have him barge with the attorney a time or two. [01:54:04.320 --> 01:54:08.320] But if he's in jail, that makes things a whole lot. [01:54:08.320 --> 01:54:11.320] He's been in jail for two years, you say? [01:54:11.320 --> 01:54:15.320] Almost two years, it was May of 2003 when he was arrested. [01:54:15.320 --> 01:54:17.320] I mean, 2013. [01:54:17.320 --> 01:54:21.320] And he hasn't been to trial yet? [01:54:21.320 --> 01:54:23.320] He's been to court several times. [01:54:23.320 --> 01:54:26.320] They've been moving him all around, but no, he hasn't gone to trial. [01:54:26.320 --> 01:54:32.320] They want him to just take a plea and I guess I guess they know they don't have any evidence. [01:54:32.320 --> 01:54:33.320] The judge just wants to... [01:54:33.320 --> 01:54:36.320] Okay, wait, you might want to look at California law. [01:54:36.320 --> 01:54:44.320] In Texas law, they can only hold you for, I think, 180 days, even for a felony. [01:54:44.320 --> 01:54:49.320] And then they have to release you if they haven't gotten you to trial yet. [01:54:49.320 --> 01:54:51.320] They have to let you out on your... [01:54:51.320 --> 01:54:54.320] If you can't bail out, they let you out on your own recognizance. [01:54:54.320 --> 01:54:58.320] They can only hold you for 180 days. [01:56:10.320 --> 01:56:23.320] You know, here in Texas, the average conviction rate for all crimes across the board is 99.6. [01:56:23.320 --> 01:56:33.320] And the reason it's 99.6 is because every step is presently practiced in the criminal justice system is not only wrong. [01:56:33.320 --> 01:56:38.320] It is very specifically against particular law. [01:56:38.320 --> 01:56:41.320] And it's not just against particular law. [01:56:41.320 --> 01:56:45.320] It's against a particular law for very specific purpose. [01:56:45.320 --> 01:56:52.320] Everything is designed to force every person who's accused of crime into taking a deal. [01:56:52.320 --> 01:56:58.320] And you have to understand that California is going to be exactly the same. [01:56:58.320 --> 01:57:02.320] These guys are used to everybody taking a deal. [01:57:02.320 --> 01:57:08.320] And when they get somebody in there who doesn't take a deal, they don't know what to do with them. [01:57:08.320 --> 01:57:13.320] Especially someone who doesn't have a competent counsel. [01:57:13.320 --> 01:57:22.320] So they figure they'll let him languish there until he finally gives up and takes the deal. [01:57:22.320 --> 01:57:23.320] Yeah. [01:57:23.320 --> 01:57:35.320] Well, he's been on the Alex Jones show as a whistleblower guest talking about things that he experienced overseas in Afghanistan doing things. [01:57:35.320 --> 01:57:47.320] And so when he comes, but he's here and he sees some things going on with the police department, he said he was aware of these things with phony fake IDs and then involved police and gangs and stuff. [01:57:47.320 --> 01:57:48.320] And he knew about it. [01:57:48.320 --> 01:57:54.320] And now he thinks we're trying to disappear and try to get rid of them because he knows about what they're up to. [01:57:54.320 --> 01:57:58.320] And so, yeah, they got a hot potato in their court and they just wanted to go away. [01:57:58.320 --> 01:57:59.320] Okay, hold on.
