[00:46.360 --> 00:51.400] And now the news, Pork Fest X is this week starting today and going through Sunday in [00:51.400 --> 00:53.280] Lancaster, New Hampshire. [00:53.280 --> 00:57.080] Pork Fest is short for the Porcupine Freedom Festival and is organized by the Free State [00:57.080 --> 01:01.760] Project in an effort to bring 20,000 Liberty activists to the state of New Hampshire. [01:01.760 --> 01:06.100] The event includes speakers, music, and one of the largest fully functional free markets [01:06.100 --> 01:07.100] in the country. [01:07.100 --> 01:12.080] Some of the speakers include Jeff Berwick, Dr. Robert Murphy, Antonio Beeler, David Friedman, [01:12.080 --> 01:13.080] and others. [01:13.080 --> 01:20.400] More information at porkfest.com. [01:20.400 --> 01:25.080] A new controversial phone app would allow people to snap a picture of a parking violation [01:25.080 --> 01:29.560] and send the photo to police, private parking operators, or city wardens. [01:29.560 --> 01:32.560] Police officer could then be dispatched to issue a ticket. [01:32.560 --> 01:34.160] The ticket resulted in a fine. [01:34.160 --> 01:38.040] Under the plan, informants would get a cut, deposit it into their bank accounts, or they [01:38.040 --> 01:40.400] could direct the cash to their favorite charities. [01:40.400 --> 01:44.880] The Spot Squad app co-founder Chris Johnson says he and his partners haven't yet signed [01:44.880 --> 01:48.880] any agreements to give informants a percentage of any ticket fines, but he adds that some [01:48.880 --> 01:57.120] private parking lot operators are in fact interested. [01:57.120 --> 02:02.740] In response to the recent revelations regarding spying by the NSA, a 28-year-old artist and [02:02.740 --> 02:06.940] developer from Brooklyn, New York has found a fun way of warning computer users about [02:06.940 --> 02:08.760] potential government surveillance. [02:08.760 --> 02:12.640] Justin Blinder released a plug-in for the web browser Firefox this week. [02:12.640 --> 02:17.240] His Dark Side of the Prism browser extension alerts web surfers of the possible surveillance [02:17.240 --> 02:21.480] by starting up a different song from Pink Floyd's 1973 classic, The Dark Side of the [02:21.480 --> 02:27.560] Moon, each time a questionable site is crossed. [02:27.560 --> 02:31.560] Support for the Liberty Beat comes from Brave New Books, free-thinking materials for free-thinking [02:31.560 --> 02:37.240] people since 2006 in Austin and 1904 Guadalupe Street. [02:37.240 --> 02:43.320] And from Central Texas Gunworks, self-defense training, CHL forces, and firearm sales in [02:43.320 --> 02:46.920] Austin at centraltexasgunworks.com. [02:46.920 --> 02:51.040] Jamin Shively, a former Microsoft Corporate Strategy Manager, plans to create the first [02:51.040 --> 02:53.000] U.S. national marijuana brand. [02:53.000 --> 02:56.960] Shively held a press conference with former president of Mexico Vicente Fox announcing [02:56.960 --> 03:19.120] that he hopes to eventually import legally from Mexico. [03:19.120 --> 03:49.040] U.K., we are back, Randy Kelton, David Stevens, ruler of our radio. [03:49.040 --> 04:00.520] And we're talking to, we're going to, North Carolina, I lost your name, is that Paul? [04:00.520 --> 04:01.520] I guess so. [04:01.520 --> 04:08.160] Oh good, okay, gotcha, it looks like you dropped off and came back and you came up on screen. [04:08.160 --> 04:13.240] I went there, so I had to call back from the cell phone. [04:13.240 --> 04:15.240] Okay, that's okay. [04:15.240 --> 04:18.960] Okay, you had the DUI issue. [04:18.960 --> 04:27.960] Okay, keep in mind, we have a suppressor on this thing, so if you're talking and I'm talking, [04:27.960 --> 04:33.800] the suppressor will push you down underneath me and I won't be able to hear you. [04:33.800 --> 04:41.120] So if we wind up both talking at the same time, just stop and I'll eventually shut up. [04:41.120 --> 04:45.440] And then tell me what you were saying. [04:45.440 --> 04:49.400] And also when you, if you hear the music, then we generally have about 30 seconds to [04:49.400 --> 04:50.400] go to break. [04:50.400 --> 04:51.400] Okay, go ahead. [04:51.400 --> 05:00.680] All right, well, back in March 3rd, around 4.30 a.m., I was, I was sleeping in my car [05:00.680 --> 05:07.320] and I was just after on the window and told me to get out of my car. [05:07.320 --> 05:13.880] I did, you know, everything he told me to do, he asked me if I'd been drinking, I said [05:13.880 --> 05:18.200] yeah, I've had quite a few drinks. [05:18.200 --> 05:24.520] Well the officer looked in my car and said, well, I see you've got a few drinks in there. [05:24.520 --> 05:29.440] I was like, yes, you know, I've had a few, I've had a few drinks and I've had a few [05:29.440 --> 05:31.120] drinks in there. [05:31.120 --> 05:39.840] And from, from there on, he said, he said, well, I need you to take a breathalyzer, a [05:39.840 --> 05:44.120] breathalyzer, and I've moved point to 1-8. [05:44.120 --> 05:50.560] Well after that, he proceeded to go through my pocket, started to search me, done the [05:50.560 --> 05:55.480] legal search, he didn't have a warrant or anything like that. [05:55.480 --> 06:00.680] He just started going through my pocket search, took out my wallet, took out all my information [06:00.680 --> 06:08.720] and he, after I blew the point 1-8, he said, all right, well, you're under arrest. [06:08.720 --> 06:14.960] And that's all he said, he put me in handcuffs and took me to the, to the Far City Police [06:14.960 --> 06:22.120] Station, Far City Police Station, I'm sorry, the Far City Police Station, and there they [06:22.120 --> 06:30.360] started questioning me a little more and gave me like a roadside sobriety test in the police [06:30.360 --> 06:31.360] station. [06:31.360 --> 06:39.800] I thought, you know, a little weird, but after that, they took me back into a little room [06:39.800 --> 06:47.200] and they had another, another machine back there, which is strange because I thought, [06:47.200 --> 06:52.280] you know, they, you know, you've done your actual, your second test at the Sheriff's [06:52.280 --> 06:53.280] Department. [06:53.280 --> 06:58.560] Well, the officers asked me to take a breathalyzer and I refused. [06:58.560 --> 07:04.240] I thought, no, I'm not taking the second breathalyzer, so I don't think it was right in the first [07:04.240 --> 07:09.800] place that I was asleep in my car, that I wasn't driving, I wasn't doing, you know, [07:09.800 --> 07:14.000] as far as I was concerned, I wasn't doing anything wrong. [07:14.000 --> 07:15.680] I was, I knew I was. [07:15.680 --> 07:18.680] Wait a minute, you had already taken a breathalyzer? [07:18.680 --> 07:21.960] I took the roadside breathalyzer, I never took the... [07:21.960 --> 07:24.200] Yeah, that's, okay, that's enough. [07:24.200 --> 07:28.880] Did they charge you for not doing the second breathalyzer? [07:28.880 --> 07:36.240] Well, the officer gave me a choice, he said, you can do the second breathalyzer, he said [07:36.240 --> 07:44.000] you can take a blood test, so I refused the second breathalyzer and from there, they, [07:44.000 --> 07:52.000] you know, the management office got a warrant to legally, I mean, you know, to legally search [07:52.000 --> 07:58.640] my blood and from there, after they got the warrant, they took me to the hospital and [07:58.640 --> 08:02.720] give me a blood test. [08:02.720 --> 08:11.840] Okay, I'm not familiar with the particulars of the law in North Carolina, I used to be [08:11.840 --> 08:18.920] when I was out there working, but it's been a while since I've looked it over, but there [08:18.920 --> 08:28.600] would need to be a specific law that calls sitting in your car DUI. [08:28.600 --> 08:29.600] Yeah. [08:29.600 --> 08:40.200] Well, under General Statutes 1, I think it's no General Statutes 20-138-1, it states that [08:40.200 --> 08:45.880] if you're driving your automotive, I mean, you're driving your motor vehicle on the highway [08:45.880 --> 08:51.840] or the street or a public vehicular area, then they can charge you with it. [08:51.840 --> 08:56.320] But I've looked all through the statute that the officer charged me with and there's nothing [08:56.320 --> 09:04.080] that says being parked in a car, being parked in a car, being stationary in a car asleep. [09:04.080 --> 09:09.000] Okay, so have you charged the officer? [09:09.000 --> 09:11.640] Have I charged the officer yet? [09:11.640 --> 09:12.640] Yes. [09:12.640 --> 09:21.240] What I did do was I filed a claim against him with the Administrative Hearing Office. [09:21.240 --> 09:25.520] Well, have you filed aggravated assault charges against him? [09:25.520 --> 09:27.520] No, I haven't. [09:27.520 --> 09:30.520] I need to do that. [09:30.520 --> 09:34.960] That was, that's one thing to look at. [09:34.960 --> 09:39.760] The officer was prominently displaying a deadly weapon. [09:39.760 --> 09:46.120] Always, when I get arrested, first thing I ask the officer, that pistol you're wearing, [09:46.120 --> 09:47.120] is it loaded? [09:47.120 --> 09:50.640] And they'll say, yes, it is. [09:50.640 --> 09:53.040] And then I ask them, are you prepared to use that pistol? [09:53.040 --> 09:54.480] They say, yes, I am. [09:54.480 --> 09:56.600] That's all I need. [09:56.600 --> 09:58.440] But you actually don't even need that. [09:58.440 --> 10:04.840] If he arrested you illegally while prominently displaying a deadly weapon, in Texas, that's [10:04.840 --> 10:08.200] a first degree felony. [10:08.200 --> 10:14.160] I'm not sure what it is in North Carolina, but it will at the very least be aggravated [10:14.160 --> 10:18.320] assault. [10:18.320 --> 10:23.600] He committed simple assault while prominently displaying a deadly weapon that goes to aggravated [10:23.600 --> 10:27.920] assault. [10:27.920 --> 10:32.680] So you file that and then run the routine on him. [10:32.680 --> 10:36.600] You're an 828 area code, so you're in Asheville. [10:36.600 --> 10:48.160] If you will talk to Art and get the complaints that I filed when I was there, they'll recognize [10:48.160 --> 10:49.160] it. [10:49.160 --> 10:50.160] Okay. [10:50.160 --> 10:51.160] Okay. [10:51.160 --> 11:00.160] I live in Hendersonville, but my family is from Rutherford County, North Carolina, and [11:00.160 --> 11:07.360] it's approximately about 45 minutes away from Asheville. [11:07.360 --> 11:09.360] Oh, okay. [11:09.360 --> 11:18.080] Then go down and schmooze the clerks and find out when the grand jury normally meets. [11:18.080 --> 11:24.120] Tell them one of your kids is doing a paper in high school on grand juries. [11:24.120 --> 11:25.960] And you want to know about the grand jury. [11:25.960 --> 11:26.960] Where do they meet? [11:26.960 --> 11:28.040] How many they've got? [11:28.040 --> 11:33.120] Ask them a whole bunch of questions and ask them to show you the grand jury room so you [11:33.120 --> 11:35.680] know where it's at. [11:35.680 --> 11:42.560] And then you can generally find out when they meet by calling a district judge. [11:42.560 --> 11:46.880] A district judge will impanel the grand jury. [11:46.880 --> 11:52.240] And if you have more than one district judge, they kind of rotate them out. [11:52.240 --> 12:00.360] And it will be the court coordinator for that judge that schedules, that will keep the schedule [12:00.360 --> 12:02.800] for the grand jury. [12:02.800 --> 12:09.000] So you find out which judge impaneled the grand jury and then find out who his court [12:09.000 --> 12:10.880] coordinator is. [12:10.880 --> 12:16.560] That's the person you'd call to set motions for hearings or get information to the judge. [12:16.560 --> 12:19.280] He's kind of like the judge's secretary. [12:19.280 --> 12:22.720] You get a hold of her and ask her when the grand jury next meets. [12:22.720 --> 12:26.200] They're generally real open with that kind of stuff. [12:26.200 --> 12:33.680] When the grand jury meets, you go down there with a set of complaints sealed in an envelope [12:33.680 --> 12:36.960] with the former of the grand jury's name on it. [12:36.960 --> 12:42.680] I generally go down with one for each grand juror. [12:42.680 --> 12:49.240] And you approach the bailiff who will be standing in front of the grand jury room, tell him [12:49.240 --> 12:56.440] your name and tell him to instruct the foreman that you have business with the grand jury. [12:56.440 --> 13:00.520] And he will either ask you the nature of the business or tell him that, tell you that you [13:00.520 --> 13:06.800] need to go to the, show whatever you have to the prosecuting attorney. [13:06.800 --> 13:12.080] And by the time you get to the grand jury, you need to have already filed with the prosecuting [13:12.080 --> 13:15.640] attorney and had him refuse. [13:15.640 --> 13:19.520] So when the bailiff tells you, you need to give this to the prosecuting attorney, you [13:19.520 --> 13:30.240] tell him, well, this is against the prosecuting attorney and that, that always gets an oops. [13:30.240 --> 13:33.040] And whatever you do, don't get in a fight with him. [13:33.040 --> 13:38.720] You know, if he refuses, you know, just get his name, say, okay, uh, you know, move away [13:38.720 --> 13:44.360] from him and call 9-1-1. [13:44.360 --> 13:51.400] There's nothing like calling the police on the police and explain to the police that [13:51.400 --> 13:57.600] he is shielding the grand jury, shielding for the grand jury from you and hiding complaints [13:57.600 --> 14:02.000] against the prosecuting attorney from the grand jury. [14:02.000 --> 14:09.040] And you want to charge him with obstruction of justice in Tamplin with a witness. [14:09.040 --> 14:12.480] And you'll get to see a chicken dance. [14:12.480 --> 14:17.560] You get to see this cop that you have called shifting from one foot to another, trying [14:17.560 --> 14:22.000] to figure out how to get out of this problem. [14:22.000 --> 14:26.000] Now he can't give you any crap, Ola, cause you called him. [14:26.000 --> 14:30.960] You're the victim here. [14:30.960 --> 14:32.240] It will really get there. [14:32.240 --> 14:36.240] You give, you know, you do enough of this, you'll give them reason to make this case [14:36.240 --> 14:39.240] want to go away. [14:39.240 --> 14:43.160] Okay, does that make sense? [14:43.160 --> 14:45.200] Yes or no? [14:45.200 --> 14:47.920] That's a lot of sense. [14:47.920 --> 14:48.920] Yeah. [14:48.920 --> 14:54.600] You start out all the, you know, most Carolina is similar to Texas. [14:54.600 --> 15:02.760] All complaints in North Carolina are directed to a magistrate and all the judges are magistrates. [15:02.760 --> 15:09.200] So what I would, before I went to the grand jury, I would, like I told Dave, I wouldn't [15:09.200 --> 15:13.720] want everybody engaged. [15:13.720 --> 15:19.440] So you take your complaints to the prosecuting attorney and when he refuses to act on them, [15:19.440 --> 15:27.760] then you forget about the cops and you take the next complaint to a magistrate. [15:27.760 --> 15:32.520] I prefer the highest level judge I could find. [15:32.520 --> 15:41.280] What you will find with higher level judges is they're more politically savvy and sensitive. [15:41.280 --> 15:42.920] They don't do the stupid stuff. [15:42.920 --> 15:47.560] The lower level judges who are ignorant and don't know what's going on. [15:47.560 --> 15:53.800] These higher level judges are a lot more careful and you get less junk from them. [15:53.800 --> 15:56.680] You get less attitude. [15:56.680 --> 15:59.280] They're a lot more professional. [15:59.280 --> 16:04.120] They will see you as dangerous, politically dangerous for them. [16:04.120 --> 16:10.840] So they'll try to handle you with kid gloves and you don't have all of this 72 hours for [16:10.840 --> 16:13.920] contempt of court and that kind of nonsense. [16:13.920 --> 16:21.240] So go to the highest level judge you can find and this works because nobody does it. [16:21.240 --> 16:28.920] You just take your complaints, get them all well written and, you know, look at complaints [16:28.920 --> 16:37.200] the complaint is filed against you and prepare your complaint in the same style. [16:37.200 --> 16:40.800] Give it to the district judge when he refuses to act on it. [16:40.800 --> 16:46.200] Go to the state attorney general with charges against the district judge. [16:46.200 --> 16:48.320] That'll send the district judge ballistic. [16:48.320 --> 16:50.480] I'll explain when I come back. [16:50.480 --> 16:53.280] This is Randy Kelton, Deborah Stevens, Rule of Law Radio. [16:53.280 --> 16:57.920] I call it number 512-646-1984. [16:57.920 --> 17:24.600] We'll be right back. [20:37.680 --> 20:41.680] Oh wait a minute, hold on, I unmuted the wrong one [20:41.680 --> 20:44.680] Okay, there we go [20:44.680 --> 20:45.680] Paul, you there? [20:45.680 --> 20:47.680] Yeah, I'm here Randall, I heard you [20:47.680 --> 20:51.680] Okay, have you listened to this show before? [20:51.680 --> 20:53.680] Actually, this is my first time [20:53.680 --> 20:58.680] I've called quite a few times to get on there but I've never been able to get through [20:58.680 --> 21:00.680] Because I work second time [21:00.680 --> 21:06.680] Oh man, are you telling me that everybody in North Carolina don't listen to my show? [21:06.680 --> 21:09.680] Well, that breaks my heart [21:09.680 --> 21:14.680] Well, if you've got somebody like me involved in listening to your show [21:14.680 --> 21:17.680] Please don't hold that again [21:17.680 --> 21:22.680] I won't get too depressed [21:22.680 --> 21:28.680] You need to listen some more because these things we're talking about [21:28.680 --> 21:32.680] It takes a while for it to seed in [21:32.680 --> 21:36.680] You know when we talk about filing criminal charges against public officials [21:36.680 --> 21:40.680] People generally get real excited and nervous about it [21:40.680 --> 21:45.680] But once you started doing it, you listened to Dave earlier [21:45.680 --> 21:47.680] He's done this [21:47.680 --> 21:54.680] You start doing it and you start seeing these guys getting really excited [21:54.680 --> 21:59.680] The problem you'll have with it is you'll have too much fun with it [21:59.680 --> 22:03.680] And in your case where they're charging you with a DUI [22:03.680 --> 22:09.680] This officer knows full well he can't get a conviction [22:09.680 --> 22:13.680] He doesn't have the evidence [22:13.680 --> 22:17.680] The prosecutor knows he couldn't get a conviction [22:17.680 --> 22:21.680] But the prosecutor is going to lie to you [22:21.680 --> 22:25.680] If you get a lawyer [22:25.680 --> 22:27.680] Do you have a lawyer? [22:27.680 --> 22:29.680] Yes, I have one [22:29.680 --> 22:31.680] He's a scumbag [22:31.680 --> 22:33.680] Is he court appointed? [22:33.680 --> 22:35.680] No, I hired him [22:35.680 --> 22:39.680] And he is a straight up bar agent [22:39.680 --> 22:41.680] Oh, wonderful [22:41.680 --> 22:43.680] He has a problem [22:43.680 --> 22:45.680] Yes, and we'll see [22:45.680 --> 22:50.680] Back a while back before I even went to my second court date [22:50.680 --> 22:54.680] I told him to file an objection by citation [22:54.680 --> 23:00.680] Under 15A-922C [23:00.680 --> 23:02.680] And he refused [23:02.680 --> 23:04.680] He said, no, I'm not going to do that [23:04.680 --> 23:07.680] Then just file a bar grievance against him [23:07.680 --> 23:08.680] Yes [23:08.680 --> 23:11.680] And when you file a bar grievance against him [23:11.680 --> 23:16.680] He's going to petition the court to be removed from your case [23:16.680 --> 23:18.680] Then you go to the court and tell the court [23:18.680 --> 23:24.680] Don't you dare remove him from this case [23:24.680 --> 23:27.680] He is under contract to me [23:27.680 --> 23:32.680] And you are not to interfere with my private contract [23:32.680 --> 23:34.680] And the judge will remove him from the case [23:34.680 --> 23:38.680] And immediately file a suit against the judge [23:38.680 --> 23:43.680] For interfering with a private contract [23:43.680 --> 23:46.680] They are not used to that [23:46.680 --> 23:48.680] And once you sued him [23:48.680 --> 23:51.680] Then he's disqualified [23:51.680 --> 23:54.680] Now they have to point another judge [23:54.680 --> 23:57.680] You know [23:57.680 --> 23:59.680] They're going to railroad you [23:59.680 --> 24:00.680] They're going to do what they're going to do [24:00.680 --> 24:03.680] And they do not care about constitution, law, anything [24:03.680 --> 24:07.680] They care about cranking you through the system [24:07.680 --> 24:12.680] And generating probation fees [24:12.680 --> 24:13.680] That's what they want [24:13.680 --> 24:14.680] They want probation fees [24:14.680 --> 24:18.680] They want you on probation for a long time [24:18.680 --> 24:21.680] Because generally probation fees stay in the county [24:21.680 --> 24:26.680] Fines and fees go to the general fund in the state [24:26.680 --> 24:31.680] Your lawyer, his primary purpose is [24:31.680 --> 24:36.680] To keep your case from being appealable [24:36.680 --> 24:41.680] You don't really think your lawyer is going to go before that court [24:41.680 --> 24:48.680] And risk his professional career in order to vigorously adjudicate your rights, do you? [24:48.680 --> 24:50.680] No, I do not [24:50.680 --> 24:55.680] Okay, if you did, I have a bridge that I want to sell to you [24:55.680 --> 24:59.680] And you can't really totally blame the lawyer [24:59.680 --> 25:02.680] This is a system he did not create [25:02.680 --> 25:05.680] And I suspect when he got out of law school [25:05.680 --> 25:08.680] He did not go to law school [25:08.680 --> 25:13.680] To incur a $150,000 student loan debt [25:13.680 --> 25:15.680] So that he could get out in the real world [25:15.680 --> 25:17.680] And spend the rest of his professional career [25:17.680 --> 25:21.680] Kissing some arrogant judges behind [25:21.680 --> 25:26.680] But that's what he found he had to do once he got out in the profession [25:26.680 --> 25:27.680] Yeah, because [25:27.680 --> 25:29.680] Okay [25:29.680 --> 25:33.680] Okay, so we understand the plight of the poor lawyer [25:33.680 --> 25:37.680] And we owe it to the lawyer to help him out [25:37.680 --> 25:42.680] You know, I think of these guys like I do my grandkids [25:42.680 --> 25:46.680] I have some grandkids and I love them dearly [25:46.680 --> 25:49.680] But if one of them gets out in the road [25:49.680 --> 25:53.680] I'm fixing to tan his hide [25:53.680 --> 25:56.680] It's not because I don't care for him [25:56.680 --> 26:00.680] This poor attorney, he's stuck in this horrible situation he didn't create [26:00.680 --> 26:05.680] He would rather be vigorously adjudicating your case, but he can't [26:05.680 --> 26:08.680] Because if he tries to, the judge is going to screw him [26:08.680 --> 26:16.680] So you owe it to the lawyer to give him plausible deniability [26:16.680 --> 26:19.680] You bar-grieve him every time he moves [26:19.680 --> 26:23.680] You send him a tort letter notifying you're going to sue him [26:23.680 --> 26:26.680] You file a judicial conduct complaint against the judge [26:26.680 --> 26:30.680] And any time the prosecutor does anything you don't like [26:30.680 --> 26:32.680] File a bar-agreement against him [26:32.680 --> 26:36.680] If your lawyer says one word to you about these bar grievances [26:36.680 --> 26:39.680] You file a grievance against him for that [26:39.680 --> 26:41.680] Never talk to him about it [26:41.680 --> 26:46.680] You want to put the lawyer in a position so that he goes to the court and says [26:46.680 --> 26:49.680] Judge, you got to do something [26:49.680 --> 26:52.680] This guy's going to put me out of business [26:52.680 --> 26:54.680] You got to help me out here [26:54.680 --> 26:57.680] I'm sorry I have to file these documents in his case [26:57.680 --> 27:01.680] But this guy's going to ruin my career [27:01.680 --> 27:05.680] Last case he had in Austin against me, they threw it out [27:05.680 --> 27:10.680] To protect my lawyer from me [27:10.680 --> 27:12.680] This works [27:12.680 --> 27:14.680] That guy's under contract [27:14.680 --> 27:17.680] You paid him to do a job [27:17.680 --> 27:22.680] If you hire me to rebuild your back porch [27:22.680 --> 27:24.680] And I get halfway through it [27:24.680 --> 27:26.680] I collect the money from you, you get halfway through it [27:26.680 --> 27:30.680] And say, I don't want to mess with it anymore, I quit [27:30.680 --> 27:35.680] You say, oh gee whiz, and go hire somebody else and pay somebody else to do it? [27:35.680 --> 27:36.680] Nope [27:36.680 --> 27:40.680] Heck no, you're going to come after me [27:40.680 --> 27:46.680] The lawyer is far more vulnerable than I would be [27:46.680 --> 27:51.680] You sue that lawyer, his malpractice insurance will double instantly [27:51.680 --> 27:54.680] You file a bar grievance against him first and then sue him [27:54.680 --> 27:57.680] He don't have any malpractice insurance [27:57.680 --> 27:59.680] And he's not going to be able to get it [27:59.680 --> 28:04.680] This year, next year he may be able to get it, but it's going to double the trouble [28:04.680 --> 28:08.680] You're going to sting him big time [28:08.680 --> 28:15.680] So what you might do is just bar grieve the prosecutor [28:15.680 --> 28:20.680] File a judicial conduct complaint against the judge just for yucks [28:20.680 --> 28:23.680] And if the lawyer tries to say anything to you about it [28:23.680 --> 28:28.680] You tell him, no, no, no, you can't talk to me, this is all private [28:28.680 --> 28:34.680] So don't go there, you file criminal complaints and do not let your prosecutor talk to you about it [28:34.680 --> 28:39.680] I mean your attorney, you tell him, that's a separate case [28:39.680 --> 28:45.680] You don't have anything to do with that case, not your business [28:45.680 --> 28:49.680] And if he tries to say anything, just cut him off [28:49.680 --> 28:56.680] In this culture, that's one of the worst things to do to somebody [28:56.680 --> 29:01.680] Is not talk to them, is not let them reason with you [29:01.680 --> 29:04.680] That's what lawyers are good at [29:04.680 --> 29:08.680] Is they reason with people and they negotiate, they get things done [29:08.680 --> 29:12.680] It gets a client that he can't negotiate with [29:12.680 --> 29:16.680] And then he goes to the court and says, I got a client here that I can't control [29:16.680 --> 29:18.680] You need to do something [29:18.680 --> 29:24.680] And they make the case go away to get rid of the unruly client [29:24.680 --> 29:27.680] That may not be right [29:27.680 --> 29:30.680] Probably shouldn't be that way [29:30.680 --> 29:33.680] But that's how it is [29:33.680 --> 29:38.680] Hang on, we'll be right back, this is Randy Kelton, Deborah Stevens, Wheel of Law Radio [29:38.680 --> 29:42.680] Our call in number, 512-646-1984 [29:42.680 --> 29:48.680] Chris, I see you there, we'll pick you up as soon as we're finished with Paul [29:48.680 --> 29:52.680] So if you have a question or comment, give us a call [29:52.680 --> 29:58.680] 512-646-1984, we'll be right back [30:02.680 --> 30:08.680] Freedom-loving Americans are finding creative ways to fight invasive airport body scanners [30:08.680 --> 30:12.680] And they're also educating the TSA about unreasonable search and seizure [30:12.680 --> 30:18.680] I'm Dr. Catherine Albrecht, I'll be back in a moment with the latest on scanner skivvies and Fourth Amendment apparel [30:18.680 --> 30:23.680] Privacy is under attack, when you give up data about yourself, you'll never get it back again [30:23.680 --> 30:28.680] And once your privacy is gone, you'll find your freedoms will start to vanish too [30:28.680 --> 30:33.680] So protect your rights, say no to surveillance and keep your information to yourself [30:33.680 --> 30:36.680] Privacy, it's worth hanging on to [30:36.680 --> 30:39.680] This public service announcement is brought to you by Startpage.com [30:39.680 --> 30:43.680] The private search engine alternative to Google, Yahoo and Bing [30:43.680 --> 30:47.680] Start over with Startpage [30:47.680 --> 30:53.680] Airport body scanners let TSA officials peep at your privates, and Americans are fed up with it [30:53.680 --> 30:58.680] A Kentucky man is fighting back with privacy-friendly underwear for men, women and children [30:58.680 --> 31:05.680] The patriotic-themed skivvies sport metallic ink shields in strategic places to blur images of sensitive areas [31:05.680 --> 31:10.680] Other freedom-loving entrepreneurs are selling shirts with the Fourth Amendment printed in metallic ink [31:10.680 --> 31:17.680] The resulting body scan image is emblazoned with a reminder about constitutional protections against unreasonable search and seizure [31:17.680 --> 31:21.680] While these are valiant efforts, the best defense is to refuse to be scanned at all [31:21.680 --> 31:25.680] Join me in saying no to airport naked-icing machines [31:25.680 --> 31:31.680] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com [31:31.680 --> 31:37.680] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11 [31:37.680 --> 31:44.680] The government says that fire brought it down, however, 1,500 architects and engineers concluded it was a controlled demolition [31:44.680 --> 31:47.680] Over 6,000 of my fellow service members have given their lives [31:47.680 --> 31:50.680] And thousands of my fellow first responders are dying [31:50.680 --> 31:51.680] I'm not a conspiracy theorist [31:51.680 --> 31:52.680] I'm a structural engineer [31:52.680 --> 31:53.680] I'm a New York City correction officer [31:53.680 --> 31:54.680] I'm an Air Force pilot [31:54.680 --> 31:56.680] I'm a father who lost his son [31:56.680 --> 31:59.680] We're Americans, and we deserve the truth [31:59.680 --> 32:02.680] Go to RememberBuilding7.org today [32:02.680 --> 32:06.680] You feel tired when talking about important topics like money and politics? [32:06.680 --> 32:07.680] Sorry! [32:07.680 --> 32:09.680] Are you confused by words like the Constitution or the Federal Reserve? [32:09.680 --> 32:10.680] What? [32:10.680 --> 32:15.680] If so, you may be diagnosed with the deadliest disease known today, stupidity [32:15.680 --> 32:21.680] Hi, my name is Steve Holt, and like millions of other Americans, I was diagnosed with stupidity at an early age [32:21.680 --> 32:27.680] I had no idea that the number one cause of the disease is found in almost every home in America, the television [32:27.680 --> 32:32.680] Unfortunately, that puts most Americans at risk of catching stupidity, but there is hope [32:32.680 --> 32:38.680] The staff at Brave New Books have helped me and thousands of other Foxaholics suffering from sports-zombie-ism recover [32:38.680 --> 32:45.680] And because of Brave New Books, I now enjoy reading and watching educational documentaries without feeling tired or uninterested [32:45.680 --> 32:56.680] So if you or anybody you know suffers from stupidity, then you need to call 512-480-2503 or visit them at 1904Guadalupe or bravenewbookstore.com [32:56.680 --> 33:02.680] Side effects from using Brave New Books products may include discernment and enlarged vocabulary and an overall increase in mental functioning [33:02.680 --> 33:30.680] Live, free speech radio, logosradionetwork.com [33:30.680 --> 33:32.680] Live, free speech radio, logosradionetwork.com [34:00.680 --> 34:14.680] Live, free speech radio, logosradionetwork.com [34:14.680 --> 34:25.680] Okay, we are back, Randy Kelton, Deborah Stevens, we're on our radio, and we're talking to Paul in North Carolina [34:25.680 --> 34:29.680] Where were we, Paul? [34:29.680 --> 34:32.680] We were on the bar agent [34:32.680 --> 34:34.680] Oh, the bar agent, oh yeah [34:34.680 --> 34:38.680] You need to listen a little more to hear how this works [34:38.680 --> 34:42.680] Let me explain about bar grievances [34:42.680 --> 34:52.680] If you file a bar grievance against your lawyer, the state bar is going to get that grievance and they're going to throw it in the trash [34:52.680 --> 35:00.680] And they're going to send you this letter back saying we examined into your accusation and find it does not rise to the level of misconduct [35:00.680 --> 35:12.680] If you accused him of pushing a truckload of babies over a cliff, they're going to send you back this letter saying we examined into your complaint and find it does not rise to the level of misconduct [35:12.680 --> 35:15.680] And that's a good thing [35:15.680 --> 35:23.680] The reason it's a good thing is their insurance carrier knows that they're going to throw it in the trash [35:23.680 --> 35:27.680] So how do they gauge their level of risk? [35:27.680 --> 35:31.680] By valid bar grievances? Heck, they toss all of them [35:31.680 --> 35:33.680] By the numbers [35:33.680 --> 35:46.680] There are, as I understand, there are nine underwriters for malpractice insurance in the country. There's a lot of companies that write malpractice insurance, but only nine that underwrite [35:46.680 --> 35:52.680] And all of those are underwritten by Lloyds of London, they all have basically the same requirements [35:52.680 --> 35:59.680] One bar grievance, your first year of practice, they'll cancel your malpractice insurance immediately [35:59.680 --> 36:03.680] Two bar grievances, any one year of practice, they'll cancel [36:03.680 --> 36:08.680] Three, they'll cancel your law firms' malpractice insurance [36:08.680 --> 36:17.680] I had a lawyer tell me this, and he said, that is patently unfair, and I am grinning from ear to ear, yeah it is, it ain't [36:17.680 --> 36:24.680] And he said, oh boy, I shouldn't have told you that, he was right, he shouldn't have [36:24.680 --> 36:30.680] This is how you handle lawyers, even a prosecutor [36:30.680 --> 36:40.680] Prosecutors won't get their malpractice insurance canceled because he is indemnified by the county [36:40.680 --> 36:47.680] However, when he gets out of this office, those bar grievances stay on his record [36:47.680 --> 36:54.680] We had a guy in Austin, he's got a lawyer on the stand, and the lawyer won't tell him his name [36:54.680 --> 37:01.680] For a year he'd been saying that every time Mike asked him his name, he said, my mother didn't give me one [37:01.680 --> 37:05.680] He's got him on the stand, and that's what he said [37:05.680 --> 37:09.680] And Mike turned to the judge and said, your honor, I need to know his name [37:09.680 --> 37:14.680] And the judge turned to the lawyer and said, counselor, tell him your name [37:14.680 --> 37:20.680] Oh, your honor, if I could tell him my name, he'll start filing bar grievances against me [37:20.680 --> 37:26.680] And I'm leaving the prosecutor's office next month, I won't be able to get malpractice insurance [37:26.680 --> 37:32.680] And the judge turned to Mike and told him the lawyer's name, oh, your honor [37:32.680 --> 37:40.680] So this really is a very weak spot for these lawyers [37:40.680 --> 37:49.680] And they very much want you to think that it's not a big deal, they want you to not even know about it [37:49.680 --> 37:53.680] So you sting him, never say a word about it [37:53.680 --> 37:57.680] You don't say a word about it, he is forbidden to say a word about it [37:57.680 --> 38:02.680] If he says a word about it, you're grieving for that [38:02.680 --> 38:10.680] Like if you grieve the prosecutor, he comes into court and says a word about that grievance [38:10.680 --> 38:16.680] You move for mistrial, you move to disqualify the judge immediately [38:16.680 --> 38:26.680] The prosecutor deliberately compromised this court by revealing to him a bar grievance [38:26.680 --> 38:30.680] that he's forbidden to do by the Bar Association standards [38:30.680 --> 38:34.680] And that'll get these guys hopping and jumping [38:34.680 --> 38:42.680] And then if the judge is rude to you, file a bar grievance against him [38:42.680 --> 38:49.680] If he says anything that you can take as in any way threatening [38:49.680 --> 38:55.680] I'm sorry, not a bar grievance, a judicial conduct complaint, file a judicial conduct complaint against him [38:55.680 --> 38:58.680] There's nothing he can do about it [38:58.680 --> 39:03.680] And you have to understand, this judge is not going to be your buddy [39:03.680 --> 39:09.680] And it's not so much because they're low down rascals [39:09.680 --> 39:14.680] But they go through case after case after case after case after case [39:14.680 --> 39:21.680] And you know, after a while it gets old and everybody comes in making the same arguments [39:21.680 --> 39:25.680] and whining and complaining, they get tired of hearing it [39:25.680 --> 39:29.680] They want your case properly adjudicated [39:29.680 --> 39:33.680] First thing you got to do is get their attention [39:33.680 --> 39:36.680] Like one of my father's mules [39:36.680 --> 39:41.680] Every once in a while he'd just have to hit it upside the head with a tube before [39:41.680 --> 39:44.680] He said it didn't hurt it, just kind of hard headed [39:44.680 --> 39:47.680] You got to give his attention every once in a while [39:47.680 --> 39:52.680] So, does that make sense? [39:52.680 --> 39:54.680] Oh yeah [39:54.680 --> 39:57.680] Okay, well if you have any questions about bar grievances [39:57.680 --> 40:01.680] My bar grievance page is down at the moment [40:01.680 --> 40:03.680] I sort of crashed it [40:03.680 --> 40:06.680] I'll try to have it up by the weekend [40:06.680 --> 40:10.680] I deleted some files off a server that shouldn't have affected the server it was on [40:10.680 --> 40:12.680] But apparently it did [40:12.680 --> 40:18.680] So I'll get that fixed and you can go to bargrievance.net and fill one out from there [40:18.680 --> 40:22.680] And that way our bargrievance.net will keep a copy of it [40:22.680 --> 40:25.680] Okay, well thank you for calling in [40:25.680 --> 40:28.680] And keep in touch, let us know what happens [40:28.680 --> 40:30.680] If you have any questions, give us a call [40:30.680 --> 40:32.680] Randall, Randall [40:32.680 --> 40:33.680] Yes [40:33.680 --> 40:35.680] Yes, I got a question for you [40:35.680 --> 40:41.680] What do you think about the administrative hearing officer? [40:41.680 --> 40:43.680] Hello? [40:43.680 --> 40:48.680] I don't know, what about the administrative hearing officer? [40:48.680 --> 40:51.680] You have filed a claim against them? [40:51.680 --> 40:56.680] Yeah, I filed a claim against the officer and the agency with the administrative hearing officer [40:56.680 --> 41:01.680] Okay, okay, I'm not familiar with the administrative procedures in North Carolina [41:01.680 --> 41:10.680] But most likely they will deny whatever you have and then that will open the door for you to file suit against it [41:10.680 --> 41:11.680] Okay [41:11.680 --> 41:17.680] Initiating an administrative procedure is kind of like filing a tort letter [41:17.680 --> 41:23.680] You're notifying them that you've been harmed and demand that they make you hold or be sued [41:23.680 --> 41:33.680] And so you can expect the administrative hearing officer to always rule on the side of his buddies [41:33.680 --> 41:34.680] Okay [41:34.680 --> 41:39.680] There is nothing fair about our system [41:39.680 --> 41:47.680] But then again, for the last 6,000 years of recorded history, there never has been anything fair about legal systems [41:47.680 --> 41:49.680] So that shouldn't surprise us [41:49.680 --> 41:53.680] But yeah, the administrative process will open the door for your lawsuit [41:53.680 --> 42:04.680] And that essentially tells them that not only do you know how to come at them, you intend to come at them [42:04.680 --> 42:09.680] So I think that's a great thing to create politics [42:09.680 --> 42:12.680] Political pressure is how you're going to win your case [42:12.680 --> 42:14.680] You're not going to win it on the facts [42:14.680 --> 42:22.680] And bar grievances, judicial conduct complaints, lawsuits, that gives you political pressure [42:22.680 --> 42:26.680] Okay, any other questions? [42:26.680 --> 42:29.680] Randall, thanks for having me tonight, I appreciate it [42:29.680 --> 42:35.680] You are most welcome, and like I said, I won't hold it against you since you know Art Patton [42:35.680 --> 42:37.680] Yes, there's no other way [42:37.680 --> 42:38.680] Okay, thank you, Paul [42:38.680 --> 42:43.680] Now we're going to go to Chris in Nevada [42:43.680 --> 42:45.680] Hello, Chris [42:45.680 --> 42:48.680] Hello there, Randall Kelton [42:48.680 --> 42:52.680] Hello, we've got about a minute before break [42:52.680 --> 43:02.680] Well, in a minute let me extol your virtues and tell you what a profound pleasure it is to listen to someone who has common sense, a quality voice [43:02.680 --> 43:14.680] And is patient enough to deal with people, explain to them things in depth that others won't tolerate in the internet law information providing community [43:14.680 --> 43:19.680] Well, I appreciate that, we work at that [43:19.680 --> 43:26.680] I actually have you in my email list and occasionally send something your way that I think you might find of interest [43:26.680 --> 43:29.680] And hopefully we can share a couple of things tonight [43:29.680 --> 43:37.680] I do try to provide some law information, truth, facts, law and evidence based [43:37.680 --> 43:41.680] And I do appreciate that [43:41.680 --> 43:43.680] Hang on, we're about to go to break [43:43.680 --> 43:52.680] We'll pick this back up on the other side and as long as you're telling me how great I am, you can take all the time you want [43:52.680 --> 44:03.680] This is Randy Kelton, Denver Stevens, Rule of Law Radio, or call it number 512-646-1984 [44:03.680 --> 44:06.680] Mr. President, members of Congress [44:06.680 --> 44:10.680] You've been making a lot of noise about taking our guns away [44:10.680 --> 44:12.680] But you might want to review history [44:12.680 --> 44:16.680] 1835, Gonzales, Texas Territory [44:16.680 --> 44:21.680] The authorities wanted to confiscate the big gun that protected that colony [44:21.680 --> 44:23.680] You know what the people said? [47:06.680 --> 47:10.680] Okay, we are back. Randy Kelton, Debra Stevens, Rule of Law Radio [47:10.680 --> 47:17.680] And we're going to spend the rest of the show with Chris extolling my virtues [47:17.680 --> 47:20.680] Oh, this is great, but I think you hurt me [47:20.680 --> 47:26.680] Because on the break, I think I sprained my wrist, patting myself on the back [47:26.680 --> 47:29.680] Well, I hope it's recoverable [47:29.680 --> 47:34.680] And I don't need to do more injury or a toy plane [47:34.680 --> 47:39.680] You know, I was listening to your previous caller and you were being so on point to him [47:39.680 --> 47:45.680] I've been reading a little tome put out by the Aspen Institute in Colorado [47:45.680 --> 47:49.680] Of course, that's the throwback to the Tavistock Institute [47:49.680 --> 47:57.680] Which is a throwback to the Madame Helena Blabotsky's Theosophical Society [47:57.680 --> 48:02.680] And in this particular little tome called Essential Lawyering Skills [48:02.680 --> 48:09.680] It cites particularly the law of rhetoric that they teach these twisted thinking attorneys [48:09.680 --> 48:16.680] And it states specifically under the law of rhetoric that one must lie in order to speak the truth [48:16.680 --> 48:21.680] And that's the most insane, it's by John Paul Sartre [48:21.680 --> 48:26.680] Who was the promoter, the quoted stator of that comment [48:26.680 --> 48:33.680] But these twisted, demented individuals, the black robes and the pro se executioners [48:33.680 --> 48:36.680] Absolutely have no moral, scruples, ethics [48:36.680 --> 48:38.680] They think that anything they can do with is legal [48:38.680 --> 48:41.680] Although it is decidedly not lawful [48:41.680 --> 48:47.680] And you are being precisely on point [48:47.680 --> 48:52.680] Okay, this is, I'm trying to, I'm an engineer [48:52.680 --> 49:00.680] So I don't get to have all of these high minded ideals [49:00.680 --> 49:07.680] An engineer just figures out or tries to figure out how things actually work [49:07.680 --> 49:16.680] When I talk about lawyers the way I do, it's not that I have sympathy for lawyers [49:16.680 --> 49:23.680] But if I can understand where they live, I understand the pressures on them [49:23.680 --> 49:28.680] Then I better understand how to increase that pressure [49:28.680 --> 49:33.680] Same with judges, if we know what judges are afraid of [49:33.680 --> 49:39.680] Now lawyers, I can tell you what they're primarily afraid of [49:39.680 --> 49:46.680] Well they're afraid of judges and prosecutors because they can damage your career [49:46.680 --> 49:49.680] They're afraid of prosecutors if they do criminal [49:49.680 --> 49:54.680] Otherwise they're afraid of judges because a judge can ruin a lawyer's career [49:54.680 --> 49:59.680] But their primary fear is missing something [49:59.680 --> 50:05.680] They go to law school and they learn all of this stuff about law [50:05.680 --> 50:09.680] They learn all the different types of law and all kinds of stuff about law [50:09.680 --> 50:14.680] But they don't teach them anything about how to actually practice law [50:14.680 --> 50:20.680] They don't teach them how to extract the information they need from your client [50:20.680 --> 50:25.680] Your client always, never tells you everything [50:25.680 --> 50:28.680] Never ever tells you everything [50:28.680 --> 50:31.680] It's not because the client doesn't mean to [50:31.680 --> 50:36.680] The client is trying to sell you as a representative for him [50:36.680 --> 50:41.680] So things that would keep you from representing him [50:41.680 --> 50:45.680] The inner mind doesn't bring up to his consciousness [50:45.680 --> 50:48.680] The inner mind is feeding him up information [50:48.680 --> 50:52.680] I mean when we talk, we don't have to figure out each word [50:52.680 --> 50:59.680] We use our inner mind, knows where we're trying to go and it feeds this stuff to us [50:59.680 --> 51:01.680] If I'm trying to sell a lawyer and represent me [51:01.680 --> 51:06.680] I'm not going to explain to him in detail how guilty I am [51:06.680 --> 51:09.680] So your client never tells you everything [51:09.680 --> 51:12.680] Even when they want to [51:12.680 --> 51:16.680] And the problem the lawyer has [51:16.680 --> 51:26.680] Unlike a machinist or a carpenter, in the trades you start out as an apprentice [51:26.680 --> 51:33.680] And then you go to journeyman and then you go to whatever other steps up to a master [51:33.680 --> 51:39.680] When you're a lawyer, when you get out of law school, you go past that bar [51:39.680 --> 51:45.680] And when you get that bar card, you become learned counsel [51:45.680 --> 51:49.680] Now I have a, Ken Magnuson has a book [51:49.680 --> 51:54.680] By a guy who was a lawyer and became a psychiatrist [51:54.680 --> 51:57.680] And he only treats lawyers [51:57.680 --> 52:01.680] And primarily, go ahead [52:01.680 --> 52:03.680] I was just laughing at that [52:03.680 --> 52:06.680] I find that a very amusing concept [52:06.680 --> 52:12.680] In that the dog bear analysis speaks to Kumho Tire Company versus Carmichael [52:12.680 --> 52:19.680] And says that psychiatrists are mere pseudo-scientific witch doctors [52:19.680 --> 52:22.680] And that they don't meet tests of empirical evidence [52:22.680 --> 52:25.680] And can't testify to anything, not a word to be heard [52:25.680 --> 52:27.680] Yeah, I'm well familiar with that [52:27.680 --> 52:30.680] And they call them witch doctors in Texas case law [52:30.680 --> 52:34.680] But he was on point here [52:34.680 --> 52:39.680] In that what lawyers are afraid of [52:39.680 --> 52:42.680] He treats the imposter syndrome [52:42.680 --> 52:46.680] And he said he treats lawyers because lawyers never get better [52:46.680 --> 52:48.680] To the great clients that keep paying him money [52:48.680 --> 52:52.680] But they know they're an imposter [52:52.680 --> 52:55.680] But they can't let you know they're an imposter [52:55.680 --> 52:59.680] I'm putting together an electronic lawyer [52:59.680 --> 53:02.680] And I kind of hope when I say this the lawyers aren't listening [53:02.680 --> 53:09.680] Because I'm putting together a tool that will eliminate the profession of lawyer [53:09.680 --> 53:13.680] And get lawyers to pay us to do it with [53:13.680 --> 53:20.680] And the way I do that is I create this dynamic interactive questionnaire [53:20.680 --> 53:27.680] I have a technology where I can capture an entire expertise [53:27.680 --> 53:30.680] Give me someone who's an expert in a given subject [53:30.680 --> 53:39.680] And using this tool I can capture his entire expertise in a single questionnaire [53:39.680 --> 53:44.680] And then I make the questionnaire available to the client [53:44.680 --> 53:51.680] So that it extracts all of the elements of the case for the lawyer [53:51.680 --> 53:54.680] And when I'm explaining to a lawyer I always tell them that [53:54.680 --> 53:57.680] I do this radio show on legal reform [53:57.680 --> 54:00.680] I had somebody call in to my show one day [54:00.680 --> 54:03.680] And ask me if I knew what a Frank's hearing was [54:03.680 --> 54:08.680] And I said yeah I've heard of it but I don't remember what it was [54:08.680 --> 54:11.680] So after the show I looked it up [54:11.680 --> 54:14.680] And when I looked it up I said holy mackerel [54:14.680 --> 54:19.680] How on earth could I ever have forgotten that [54:19.680 --> 54:22.680] And every time I do this I look over at the lawyer [54:22.680 --> 54:26.680] And I know exactly what he's thinking [54:26.680 --> 54:29.680] What the heck's a Frank's hearing? [54:29.680 --> 54:32.680] So I have just terrified the lawyer [54:32.680 --> 54:36.680] I've indicated that a Frank's hearing is something really important [54:36.680 --> 54:41.680] And he has always missed it because he didn't know what it was [54:41.680 --> 54:44.680] This really gets their attention more than anything [54:44.680 --> 54:48.680] We have a, Johnny calls in regularly [54:48.680 --> 54:51.680] He has a friend who is a lawyer [54:51.680 --> 54:53.680] And the last time he talked to him [54:53.680 --> 54:56.680] He was handling a mortgage issue [54:56.680 --> 55:03.680] And had missed some minor point in a pleading [55:03.680 --> 55:05.680] And the judge was all over him about it [55:05.680 --> 55:10.680] He said he was afraid either the judge was going to end his practice [55:10.680 --> 55:15.680] Or his client was going to end his practice [55:15.680 --> 55:17.680] And he was terrified [55:17.680 --> 55:20.680] And he said it was a minor point [55:20.680 --> 55:24.680] This is what they're afraid of because they're learning counsel [55:24.680 --> 55:27.680] They don't get to say oops [55:27.680 --> 55:30.680] They don't get to miss anything [55:30.680 --> 55:33.680] So if we understand that [55:33.680 --> 55:36.680] That's how we can hammer on [55:36.680 --> 55:42.680] The tool that I'm building is I bring it to the lawyer [55:42.680 --> 55:48.680] Because what I want from the lawyer is I want him to look at this questionnaire [55:48.680 --> 55:51.680] Build this questionnaire in a map format [55:51.680 --> 55:52.680] Like a mind map [55:52.680 --> 55:57.680] So you can open it up and see all of the different trees [55:57.680 --> 55:59.680] The different lines a client can take [55:59.680 --> 56:01.680] You start down at the first question [56:01.680 --> 56:03.680] You answer yes or no [56:03.680 --> 56:05.680] If you click yes [56:05.680 --> 56:08.680] You've cut off half the questionnaire [56:08.680 --> 56:10.680] The next question to cut off another half [56:10.680 --> 56:17.680] So one person doesn't see but one small section of the questionnaire [56:17.680 --> 56:19.680] But the lawyer needs to see the whole thing [56:19.680 --> 56:21.680] And I want the lawyer to look at it and say [56:21.680 --> 56:25.680] Is there any place in there [56:25.680 --> 56:29.680] Where you would ask a question that I haven't asked [56:29.680 --> 56:35.680] Or where you would address an issue that this questionnaire doesn't address [56:35.680 --> 56:40.680] And using this tool he can click on that location and add the question we need [56:40.680 --> 56:44.680] And then based on the answers he'll develop whatever that issue is [56:44.680 --> 56:45.680] Like Frank's hearing [56:45.680 --> 56:50.680] Frank's hearing is a hearing for the purpose of determining the veracity of a police officer [56:50.680 --> 56:55.680] Who testified before a magistrate to secure a warrant [56:55.680 --> 56:58.680] So we say were you arrested yes [56:58.680 --> 57:02.680] Were you arrested on an existing warrant yes [57:02.680 --> 57:09.680] Do you have reason to believe that the officer who testified before the magistrate to secure the warrant [57:09.680 --> 57:13.680] Misrepresented the truth to the magistrate [57:13.680 --> 57:16.680] If the client says yes [57:16.680 --> 57:23.680] Then it shifts off and asks all the questions it needs to develop a Frank's hearing motion [57:23.680 --> 57:26.680] And then it comes back where it was and continues [57:26.680 --> 57:33.680] And the main thing is it never ever forgets to ask that question [57:33.680 --> 57:35.680] Lawyers will always forget [57:35.680 --> 57:40.680] But we get the lawyers to add in all of their expertise [57:40.680 --> 57:48.680] And we capture the expertise of all of these lawyers and make it available with pro se [57:48.680 --> 57:52.680] They'll pay us to eliminate their jobs [57:52.680 --> 57:55.680] Okay [57:55.680 --> 57:57.680] Wait hang on Chris we're about to go to break [57:57.680 --> 58:01.680] We're going to our top of the hour break so this will take a little bit longer [58:01.680 --> 58:07.680] And Chris I'm having a little trouble understanding you and I'm not sure what it is [58:07.680 --> 58:16.680] When we come back I'm going to get Deborah on and see if she can get your mic adjusted out so I can hear you better [58:16.680 --> 58:20.680] Okay hang on this is Randy Kelton, Deborah Stevens, Rule of Law Radio [58:20.680 --> 58:22.680] We're going to our top of the hour break [58:22.680 --> 58:25.680] We've got one more hour left [58:25.680 --> 58:28.680] We've got Tommy and Ed [58:28.680 --> 58:32.680] So if you have a question or comment now's a good time to call in [58:32.680 --> 58:35.680] So we'll get to you before the end of the show [58:35.680 --> 58:40.680] So give us a call 512-646-1984 [58:40.680 --> 58:43.680] We'll be right back [58:50.680 --> 58:54.680] Would you like to make more definite progress in your walk with God? And now the news [01:00:49.680 --> 01:00:54.680] On Tuesday morning a group of around 50 Houstonians protested outside the office [01:00:54.680 --> 01:00:56.680] Representative Sheila Jackson Lee [01:00:56.680 --> 01:00:59.680] The group was rallying in support of the Second Amendment [01:00:59.680 --> 01:01:01.680] As well as the Armed Citizens Project [01:01:01.680 --> 01:01:04.680] The Armed Citizens Project gained attention last week [01:01:04.680 --> 01:01:07.680] When Oak Forest neighborhood of Houston became the first in the country [01:01:07.680 --> 01:01:10.680] To experience a free gun giveaway for single mothers [01:01:10.680 --> 01:01:14.680] Sheila Jackson Lee spoke in opposition to the ACP's gun sharing program [01:01:14.680 --> 01:01:18.680] And in favor of universal background checks for gun purchases [01:01:18.680 --> 01:01:20.680] Kyle Copeland, founder of the Armed Citizens Project [01:01:20.680 --> 01:01:25.680] Says he believes in educated and armed citizenry is key to reducing crime [01:01:30.680 --> 01:01:33.680] Tuesday Google filed a legal challenge against gag orders [01:01:33.680 --> 01:01:37.680] That came with the FISA court orders it receives from the FBI and NSA [01:01:37.680 --> 01:01:42.680] Google is arguing that the silence orders infringe upon the company's First Amendment rights [01:01:42.680 --> 01:01:45.680] To speak freely about the data requests from the government [01:01:45.680 --> 01:01:47.680] According to a court motion filed by Google [01:01:47.680 --> 01:01:50.680] They are seeking to release information on the amount of data requests [01:01:50.680 --> 01:01:52.680] And specific user information [01:01:52.680 --> 01:01:54.680] Currently under the FISA Act [01:01:54.680 --> 01:01:58.680] Google is not allowed to disclose publicly the number of requests it gets for data [01:01:58.680 --> 01:02:02.680] The public requests have only come about in light of recently leaked information [01:02:02.680 --> 01:02:04.680] Regarding the PRISM software [01:02:04.680 --> 01:02:07.680] And after the Director of National Intelligence acknowledged that the service providers [01:02:07.680 --> 01:02:11.680] Have received Foreign Intelligence Surveillance Act requests [01:02:11.680 --> 01:02:16.680] South Paulo Brazil continues to be the scene of another night of protests [01:02:16.680 --> 01:02:19.680] Demonstrators are calling for a more responsive government [01:02:19.680 --> 01:02:22.680] And have expressed a general anger towards the government financial priorities [01:02:22.680 --> 01:02:27.680] Protests have been organized by university students and a group called the Free Fair Movement [01:02:27.680 --> 01:02:30.680] Which is called for free public transportation [01:02:30.680 --> 01:02:33.680] Pictures of the scene show protestors clashing with riot police [01:02:33.680 --> 01:02:38.680] These latest clashes come after accusations last week of police brutality [01:02:38.680 --> 01:02:41.680] And the targeting of journalists [01:03:08.680 --> 01:03:11.680] We're not going to give it to the police [01:03:22.680 --> 01:03:26.680] I will lie if my brothers are with me [01:03:26.680 --> 01:03:28.680] Till he returns [01:03:28.680 --> 01:03:32.680] I will laugh if my brothers are with me [01:03:32.680 --> 01:03:36.680] He has nothing with the strength and wisdom [01:03:36.680 --> 01:03:39.680] I will cry if I reason [01:03:39.680 --> 01:03:43.680] I will laugh if my brothers are with me [01:03:43.680 --> 01:03:47.680] Yeah, I will laugh if my brothers are with me [01:03:47.680 --> 01:03:50.680] Till I teach them [01:03:50.680 --> 01:03:54.680] I will laugh if my brothers are with me [01:03:54.680 --> 01:03:57.680] I will guard these walls [01:03:57.680 --> 01:04:08.920] Okay, we are back, Randy Kelton, Deborah Stevens, Root of Law Radio, and we're talking to Chris [01:04:08.920 --> 01:04:10.400] in Nevada. [01:04:10.400 --> 01:04:19.320] Okay, Chris, did you have an issue you wanted to address or a question? [01:04:19.320 --> 01:04:23.960] Well, I have been paying particular note to your conversations earlier, and I've been [01:04:23.960 --> 01:04:29.840] in a couple of hearings lately where I have seen some of the most egregious, abusive violations [01:04:29.840 --> 01:04:37.200] of civil rights by these black-robed terrorists, berating, lambasting, and acting with an extreme [01:04:37.200 --> 01:04:43.280] class-based retaliatory animus against the poor victims they had for them. [01:04:43.280 --> 01:04:46.520] And I saw- Well, okay, hold on, hold on. [01:04:46.520 --> 01:04:50.280] Have you filed any criminal complaints against these judges? [01:04:50.280 --> 01:04:56.720] Well, not yet, because they have six of their children taken hostage, and they recently [01:04:56.720 --> 01:05:02.280] contacted an attorney to present their interest, a pretty good one, in fact, they had a big [01:05:02.280 --> 01:05:07.680] case called Roska, R-O-S-K-A, it's a Child Protective Services case. [01:05:07.680 --> 01:05:10.520] Okay, there's a problem, there's a concern here. [01:05:10.520 --> 01:05:18.680] Anytime you're in family law, from what I've seen of family cases, there's kind of an unwritten [01:05:18.680 --> 01:05:22.000] thing that the lawyers do. [01:05:22.000 --> 01:05:30.560] Both lawyers look at the estate of both parties, and they try to estimate how much of the estate [01:05:30.560 --> 01:05:38.960] they can swallow in the process of this family law issue, and they turn the case until they've [01:05:38.960 --> 01:05:47.880] extracted all they can out of both sides, and then they move toward a resolution. [01:05:47.880 --> 01:05:53.640] Family law may be the most corrupt of all. [01:05:53.640 --> 01:06:01.760] The courts in the world, when I got to Australia, when I went down there, we were going to the [01:06:01.760 --> 01:06:05.760] high court and we crossed the Sydney Bay Bridge, and there's a guy up on the bridge with a [01:06:05.760 --> 01:06:13.320] big banner griping about the family law and how corrupt they were. [01:06:13.320 --> 01:06:19.080] So with that said, if you're a good family law judge, both sides are going to be PO'd [01:06:19.080 --> 01:06:22.120] at you when you're done. [01:06:22.120 --> 01:06:29.160] But from what I've seen, family law is, they just absolutely, totally ignore law. [01:06:29.160 --> 01:06:35.680] Oh, the law that they whatsoever of law prevails in those courts whatsoever, they're all about [01:06:35.680 --> 01:06:41.000] the Title IV monies provided in the Social Security Act that they extort from the federal [01:06:41.000 --> 01:06:45.280] government by stealing the children from the families. [01:06:45.280 --> 01:06:51.040] And this crazy judge herself, I saw her argue with this person, and the judge was arguing [01:06:51.040 --> 01:06:57.480] against herself and got mad arguing with herself and contempted the girl and had her locked [01:06:57.480 --> 01:06:59.520] up and hauled her out of the court. [01:06:59.520 --> 01:07:05.080] And part of it was they had called the psychologist, the president, the schizo- [01:07:05.080 --> 01:07:07.160] Okay, wait a minute, wait a minute. [01:07:07.160 --> 01:07:09.640] Are you familiar with the Dalbert's hearing? [01:07:09.640 --> 01:07:10.640] Yes. [01:07:10.640 --> 01:07:12.720] I am familiar with Dalbert. [01:07:12.720 --> 01:07:24.720] Okay, have you considered petitioning the court to have the court have a psychological [01:07:24.720 --> 01:07:25.720] evaluation? [01:07:25.720 --> 01:07:30.080] Well, I think they did well on the judge, precisely. [01:07:30.080 --> 01:07:35.320] That's who I'm talking about, the judge, the court. [01:07:35.320 --> 01:07:36.560] That was one of my contemplations. [01:07:36.560 --> 01:07:43.000] We're supposed to be back in there on about the 10th or the 15th of July, so we'll see [01:07:43.000 --> 01:07:44.000] how it goes then. [01:07:44.000 --> 01:07:47.000] I'm there as a federal witness, private federal witness. [01:07:47.000 --> 01:07:53.520] Here's the thing, if the judge is going to screw you, he's going to screw you. [01:07:53.520 --> 01:07:58.160] So who cares if he makes the judge mad at you? [01:07:58.160 --> 01:08:05.480] You petition to have a psychological evaluation on the judge, the judge is going to go ballistic. [01:08:05.480 --> 01:08:13.000] And now if the judge does anything that looks the slightest bit off color, he moved to disqualify [01:08:13.000 --> 01:08:14.000] for incompetence. [01:08:14.000 --> 01:08:15.000] Absolutely. [01:08:15.000 --> 01:08:21.880] What we try to be are the process from hell. [01:08:21.880 --> 01:08:25.200] We figure they're going to rule against us no matter what. [01:08:25.200 --> 01:08:32.600] So the only way we're going to get a ruling in our favor is to hammer them at every opportunity. [01:08:32.600 --> 01:08:39.600] What judge needs to think that you're just laying in wait for her to render a ruling [01:08:39.600 --> 01:08:43.120] that you can hammer her with? [01:08:43.120 --> 01:08:44.120] We are. [01:08:44.120 --> 01:08:49.800] We want to be pro-Soviet terrorists. [01:08:49.800 --> 01:08:52.080] We need to do that. [01:08:52.080 --> 01:08:59.360] If we do it right, we take their rules and take their rules and cram their rules down [01:08:59.360 --> 01:09:00.360] their throats. [01:09:00.360 --> 01:09:07.920] You know, I've been doing this kind of thing for a long time, and I am very well known [01:09:07.920 --> 01:09:16.240] in Texas by all the prosecutors, but nobody has ever come after me except that thing in [01:09:16.240 --> 01:09:17.240] Cherokee County. [01:09:17.240 --> 01:09:19.000] That was Robert Fox got them on me. [01:09:19.000 --> 01:09:24.760] Those guys were still after them, but they don't want anything to do with me because [01:09:24.760 --> 01:09:29.720] I'm not coming in there with something they haven't seen before. [01:09:29.720 --> 01:09:36.240] I'm coming in there with their law exactly the way they use their law, and it makes these [01:09:36.240 --> 01:09:37.520] guys crazy. [01:09:37.520 --> 01:09:42.800] I have my local prosecutor talk to him recently, and he said, you know, Mr. Kelton, you're [01:09:42.800 --> 01:09:44.280] getting rather well known in Texas. [01:09:44.280 --> 01:09:45.280] I said, I am. [01:09:45.280 --> 01:09:46.280] I said, yeah. [01:09:46.280 --> 01:09:51.520] He said, I go around to training seminars all over the state, and every time they find [01:09:51.520 --> 01:09:56.160] out I'm from Wise County, Texas, they all want to know if I know you. [01:09:56.160 --> 01:10:02.400] You know, I haven't really messed with anybody in quite a while, and, you know, there haven't [01:10:02.400 --> 01:10:12.360] been that many, maybe a dozen or so that I've actually hammered, but this really gets around. [01:10:12.360 --> 01:10:17.000] So it won't take many of us really hammering these guys. [01:10:17.000 --> 01:10:20.920] Chris, did you hear Dave earlier? [01:10:20.920 --> 01:10:21.920] I did not. [01:10:21.920 --> 01:10:24.680] I just had dialed on about halfway through your show. [01:10:24.680 --> 01:10:26.400] I apologize for not getting there. [01:10:26.400 --> 01:10:30.200] I will be checking your show. [01:10:30.200 --> 01:10:31.200] That's okay. [01:10:31.200 --> 01:10:35.160] Dave is up here in the Dallas Fort Worth area near where I'm at, but I didn't know Dave [01:10:35.160 --> 01:10:43.400] at all, but he had been listening to the show, and man, he is hammering these guys. [01:10:43.400 --> 01:10:48.560] We're getting more and more people who are finding out, and what Dave said is the one [01:10:48.560 --> 01:10:50.720] thing I keep warning people about. [01:10:50.720 --> 01:10:58.440] He said, you know, this is really getting to be fun, and it does. [01:10:58.440 --> 01:11:07.480] If we get people to understand that, you know, we stop being victims, primarily we want to [01:11:07.480 --> 01:11:10.720] stop being defendants. [01:11:10.720 --> 01:11:12.880] We want to start being the plaintiffs. [01:11:12.880 --> 01:11:13.880] Yes. [01:11:13.880 --> 01:11:21.000] The best defense is a good, effective offense. [01:11:21.000 --> 01:11:27.840] I had a friend hired at our local tax assessor, and they showed him all around all the different [01:11:27.840 --> 01:11:28.840] stuff. [01:11:28.840 --> 01:11:32.120] They got to the front counter, and they said, when they got to the front counter, they showed [01:11:32.120 --> 01:11:36.040] him what to do, and then they said, there's this one guy that comes in here, Randy Kelton. [01:11:36.040 --> 01:11:43.120] He's always joking and laughing, but watch that SOB, that he's just trying to get you [01:11:43.120 --> 01:11:47.120] to do something so he can call 911 and try to get you arrested. [01:11:47.120 --> 01:11:49.520] Oh, Charlie knew me. [01:11:49.520 --> 01:11:50.520] They didn't know he knew me. [01:11:50.520 --> 01:11:56.680] He said, I was standing there chuckling, thinking, they're right, he is, so don't screw with [01:11:56.680 --> 01:11:58.640] him. [01:11:58.640 --> 01:12:05.560] If we can get these public officials thinking that way, Larry Wiest went down to Johnson [01:12:05.560 --> 01:12:13.040] County and tried to file some documents with the clerk, and the clerk refused to take them. [01:12:13.040 --> 01:12:17.120] He called me, go to the sheriff, file criminal charges against her. [01:12:17.120 --> 01:12:22.600] So he came home, got all these statutes and codes in order, went to the sheriff's department, [01:12:22.600 --> 01:12:25.080] filed criminal charges against her. [01:12:25.080 --> 01:12:30.520] We didn't go to the DA because we really didn't want to have a fight with the clerk, but wanted [01:12:30.520 --> 01:12:34.640] the clerk to file these documents because he needed it to stop a foreclosure. [01:12:34.640 --> 01:12:38.560] So he went to the sheriff, gave the complaints to the sheriff, and then he wrote up a tort [01:12:38.560 --> 01:12:46.360] letter and sent it to the judge of the commissioner's court. [01:12:46.360 --> 01:12:51.760] The next morning, he was getting calls from the clerk asking him to come back down there [01:12:51.760 --> 01:12:55.880] and she would file those documents for him. [01:12:55.880 --> 01:13:05.720] It doesn't take many hammerings like this where the pro se turns into the aggressor, [01:13:05.720 --> 01:13:15.480] but not in a way that they can say that you are agitated or you are, like you said, a [01:13:15.480 --> 01:13:20.960] terrorist using paper terrorism. [01:13:20.960 --> 01:13:28.320] I have never had them accuse me of paper terrorism when I'm stuffing one criminal complaint on [01:13:28.320 --> 01:13:32.040] them after another. [01:13:32.040 --> 01:13:35.440] How are they going to gripe about that? [01:13:35.440 --> 01:13:40.840] I tell them, gee whiz guys, shoot the messenger. [01:13:40.840 --> 01:13:45.080] I didn't write the law, I just read it. [01:13:45.080 --> 01:13:51.080] Randy, it's an absolute pleasure coming across you. [01:13:51.080 --> 01:13:55.680] I know you've got other callers backed up, but thank you for letting me participate with [01:13:55.680 --> 01:13:59.000] you tonight and you have a listener. [01:13:59.000 --> 01:14:00.360] Okay. [01:14:00.360 --> 01:14:07.400] Thank you very much, Chris, and call in regular. [01:14:07.400 --> 01:14:08.400] Don't be a stranger. [01:14:08.400 --> 01:14:09.400] I will not. [01:14:09.400 --> 01:14:11.960] Thank you so much and bless you. [01:14:11.960 --> 01:14:12.960] Okay. [01:14:12.960 --> 01:14:13.960] Bye bye. [01:14:13.960 --> 01:14:14.960] Okay. [01:14:14.960 --> 01:14:17.160] We're going to Tommy in Texas. [01:14:17.160 --> 01:14:18.160] Hello, Tommy. [01:14:18.160 --> 01:14:21.400] What do you have for us today? [01:14:21.400 --> 01:14:24.800] Hey, can you hear me okay? [01:14:24.800 --> 01:14:25.800] Yes I can. [01:14:25.800 --> 01:14:26.800] Okay. [01:14:26.800 --> 01:14:27.800] Thank you. [01:14:27.800 --> 01:14:29.240] You sound a little hollow. [01:14:29.240 --> 01:14:33.560] Are you on a hands-free? [01:14:33.560 --> 01:14:37.080] I'm on a Bluetooth. [01:14:37.080 --> 01:14:43.240] Can you get on the handset Bluetooth 10 not to work well? [01:14:43.240 --> 01:14:47.240] You sound kind of like you have your head in a toilet. [01:14:47.240 --> 01:14:49.760] How is this? [01:14:49.760 --> 01:14:50.920] That's a little better. [01:14:50.920 --> 01:14:54.080] You still got a ringy quality there, but that'll be okay. [01:14:54.080 --> 01:14:55.080] Go ahead. [01:14:55.080 --> 01:15:01.720] Okay, my subject is building permits in Montgomery County, Texas. [01:15:01.720 --> 01:15:08.760] I'm preparing to build a house in the near future and get my plans together. [01:15:08.760 --> 01:15:15.760] One of the check marks was building permits, which is, it sounded good, but I don't believe [01:15:15.760 --> 01:15:19.840] in the building permits because I'm not in the flood plain, so I went to the building [01:15:19.840 --> 01:15:24.680] permit office and asked them who's required to have a building permit, and they said everyone [01:15:24.680 --> 01:15:29.640] if you're building a house, everyone, and I said, well, show me that regulation, and [01:15:29.640 --> 01:15:37.320] they gave me a piece of paper that just said, you know, if it has four enclosed walls and [01:15:37.320 --> 01:15:40.320] you need a building permit, and then I said, well, this is... [01:15:40.320 --> 01:15:42.200] Okay, okay, hold on, back up. [01:15:42.200 --> 01:15:44.720] Is this county or municipal? [01:15:44.720 --> 01:15:49.600] This is Montgomery County, unincorporated county. [01:15:49.600 --> 01:15:51.840] Oh, okay. [01:15:51.840 --> 01:16:02.240] First thing is to go to the county and ask the county to show you how you entered into [01:16:02.240 --> 01:16:05.680] a contract with the county. [01:16:05.680 --> 01:16:07.640] Okay. [01:16:07.640 --> 01:16:11.200] Okay, understand. [01:16:11.200 --> 01:16:21.440] The Texas Constitution authorizes the legislature to pass law, and the Texas Constitution does [01:16:21.440 --> 01:16:27.800] not authorize the legislature to delegate that power. [01:16:27.800 --> 01:16:35.760] So whatever it is the county's trying to get you to follow is not law. [01:16:35.760 --> 01:16:36.760] It's something else. [01:16:36.760 --> 01:16:41.880] They tend to call it ordinance, but what it actually is is contract. [01:16:41.880 --> 01:16:43.800] Hang on, we're about to go to break. [01:16:43.800 --> 01:16:47.520] This is Randy Kelton, Deborah Stevens, Rule of Law Radio. [01:16:47.520 --> 01:16:52.140] Our call in number is 512-646-1984. [01:16:52.140 --> 01:16:53.920] We'll be right back on the other side. [01:16:53.920 --> 01:16:56.540] If you want to get on, give us a call. [01:16:56.540 --> 01:16:53.540] We're getting close to the end. [01:16:53.540 --> 01:16:54.540] Okay. [01:16:54.540 --> 01:16:57.540] We'll be right back. [01:17:06.240 --> 01:17:15.240] See what you've done to me, I'm losing weight and I'm not half the man I used to be [01:17:15.240 --> 01:17:23.240] Hey Tangy Tangerine, you make me feel so good, I don't need so much food [01:17:23.240 --> 01:17:29.240] Ain't I a sight compared to what I used to be [01:17:29.240 --> 01:17:38.240] Calcium, magnesium, selenium and zinc, take a moment now and think [01:17:38.240 --> 01:17:47.240] If you have a little strength, every day will bring the life that you've been looking for [01:17:47.240 --> 01:17:54.240] Beyond Tangy Tangerine is available at Brave New Books, located at 1904 Guadalupe Street [01:17:54.240 --> 01:18:02.240] The bookstore also carries the works of Dr. Joel Wallach, founder of Young Jeopardy and creator of Beyond Tangy Tangerine [01:18:02.240 --> 01:18:11.240] At Capital Coin and Bullion, our mission is to be your preferred shopping destination by delivering excellent customer service and outstanding value at an affordable price [01:18:11.240 --> 01:18:15.240] Capital Coin features a great selection of high quality coins and precious metals [01:18:15.240 --> 01:18:22.240] In addition to providing the best prices in the nation, we want to bring you the best shopping experience both in store and online [01:18:22.240 --> 01:18:29.240] In addition to coins and bullion, we carry popular Young Jeopardy products such as Beyond Tangy Tangerine and Pollen Burst [01:18:29.240 --> 01:18:36.240] We offer freeze-dried, storable foods by Augustan Farms, Bergey Water Products, ammunition at 10% above wholesale and more [01:18:36.240 --> 01:18:41.240] You can lock in a spot price with our Silver Pool and we set up metals IRA accounts [01:18:41.240 --> 01:18:45.240] Call us at 512-646-6440 for more details [01:18:45.240 --> 01:18:50.240] We're located at 7304 Burnett Road Suite A, about a half a mile south of Anderson [01:18:50.240 --> 01:18:54.240] We're open Monday through Friday 10 to 6, Saturdays 10 to 2 [01:18:54.240 --> 01:19:21.240] Visit us at capitalcoinandbullion.com or call 512-646-6440 [01:19:24.240 --> 01:19:30.240] Okay, we are back. Randy Kelton, Debra Stevens, Rule of Law Radio [01:19:30.240 --> 01:19:34.240] And we're talking to Tommy in Texas [01:19:34.240 --> 01:19:37.240] Okay, Tommy, where were we? [01:19:37.240 --> 01:19:43.240] Well, these regulations are put out by the Commissioner's Court [01:19:43.240 --> 01:19:48.240] Which, you're right, they don't have the authority to make a law [01:19:48.240 --> 01:19:59.240] The first thing you should do is send them a letter asking them how you are entered into a contract with them [01:19:59.240 --> 01:20:06.240] So, but before I do that, you know, I used to have a construction company [01:20:06.240 --> 01:20:09.240] It was a small construction company [01:20:09.240 --> 01:20:16.240] And I wound up working on buildings that other people had worked on [01:20:16.240 --> 01:20:22.240] And I really came to appreciate the building codes [01:20:22.240 --> 01:20:32.240] I don't particularly like the permit process, but the building codes are really good [01:20:32.240 --> 01:20:37.240] They will keep you from having problems that you won't expect [01:20:37.240 --> 01:20:45.240] And one of the things you had to do on electrical is if you have a piece of flexible conduit [01:20:45.240 --> 01:20:48.240] You could use up to six feet [01:20:48.240 --> 01:20:52.240] Where the electrical conduit comes into the box [01:20:52.240 --> 01:20:58.240] They have this little plastic piece that inserts in there [01:20:58.240 --> 01:21:02.240] And they would fail your job if you didn't have that in there [01:21:02.240 --> 01:21:08.240] And the reason that was in there is once the wall was in place [01:21:08.240 --> 01:21:14.240] Where critters would get in the wall and move past this flexible conduit and the conduit moves [01:21:14.240 --> 01:21:18.240] It would chafe the wires and start a fire [01:21:18.240 --> 01:21:21.240] Not something you'd ever expect [01:21:21.240 --> 01:21:31.240] I was in Chicago years ago and just noticed one time this commercial came on from the city of Chicago [01:21:31.240 --> 01:21:35.240] And they said they were changing the building code requirements [01:21:35.240 --> 01:21:40.240] You used to be able to use flexible conduit everywhere and they said now you can only use six feet [01:21:40.240 --> 01:21:44.240] And the reason is in this building we lost six people [01:21:44.240 --> 01:21:52.240] In this building we lost five people from fires caused by animals moving past this flexible cable [01:21:52.240 --> 01:21:57.240] Flexing it and chafing the wire inside and starting a fire [01:21:57.240 --> 01:22:00.240] Something you would never consider [01:22:00.240 --> 01:22:06.240] The building codes are an accumulation of requirements that were put in [01:22:06.240 --> 01:22:12.240] To keep from having problems that builders actually had [01:22:12.240 --> 01:22:16.240] So whether you get the permit or not I would suggest you get the universal building code [01:22:16.240 --> 01:22:22.240] The universal plumbing code and electrical code and just kind of read through them [01:22:22.240 --> 01:22:27.240] It's not hard to build up the code [01:22:27.240 --> 01:22:31.240] I agree with that and I'm going to do all of that because I agree with the building codes [01:22:31.240 --> 01:22:37.240] If I understand correctly here's what's going to happen whenever I submit a request for utilities [01:22:37.240 --> 01:22:44.240] The utility company sends the permit office my request also [01:22:44.240 --> 01:22:49.240] So it's now flagged and they cross reference it to whether or not I file for a permit [01:22:49.240 --> 01:22:56.240] And then they send me a notice of default or a failure to apply for a permit [01:22:56.240 --> 01:23:02.240] So at that point when I receive that letter that I ask them what contract did I enter into [01:23:02.240 --> 01:23:05.240] That requires me to file a permit, right? [01:23:05.240 --> 01:23:10.240] Let me, okay, one of the things we need to do is pick our battles [01:23:10.240 --> 01:23:12.240] And let me make a suggestion [01:23:12.240 --> 01:23:16.240] I came to appreciate the building inspectors [01:23:16.240 --> 01:23:19.240] I had to kind of kick them around a little bit [01:23:19.240 --> 01:23:25.240] But once I got their attention they were great [01:23:25.240 --> 01:23:34.240] They would come in and show me things that my contractors were screwing up that I didn't know about [01:23:34.240 --> 01:23:39.240] So I paid them like 50, 75 bucks to come out and do an inspection [01:23:39.240 --> 01:23:42.240] They saved me a lot of money [01:23:42.240 --> 01:23:47.240] Because it's their job, they did some stupid stuff [01:23:47.240 --> 01:23:51.240] I put up a half a wall [01:23:51.240 --> 01:23:59.240] And you had to have double 5H plasterboard because they needed a one hour wall [01:23:59.240 --> 01:24:03.240] Plasterboard is about a fire break [01:24:03.240 --> 01:24:10.240] And a 5H plasterboard is a 30 minute wall [01:24:10.240 --> 01:24:13.240] A two 5H is a one hour wall [01:24:13.240 --> 01:24:17.240] It'll contain a fire for one hour, that's the idea [01:24:17.240 --> 01:24:26.240] Well, this was a 16 foot tall building, I stood in my metal studs and put the plasterboard on the studs to keep the studs in place [01:24:26.240 --> 01:24:29.240] And this moron come in there and looked at that and said [01:24:29.240 --> 01:24:34.240] Well, we haven't inspected the wiring, you'll have to take that plasterboard down [01:24:34.240 --> 01:24:37.240] I said, you see that hole I left in the wall? [01:24:37.240 --> 01:24:40.240] You step through that hole and you can see all the wiring [01:24:40.240 --> 01:24:42.240] He said, no, I need to see it from this side [01:24:42.240 --> 01:24:45.240] I said, no, you need to get the heck out of here [01:24:45.240 --> 01:24:47.240] If you can't do that, get out [01:24:47.240 --> 01:24:51.240] I screamed out and went to the mayor's office [01:24:51.240 --> 01:24:56.240] And just jumped up and down and railed in righteous indignation [01:24:56.240 --> 01:24:59.240] Who hired these morons? [01:24:59.240 --> 01:25:01.240] I just railed on them [01:25:01.240 --> 01:25:07.240] The guy come back and this time he was really, really nice and I told him [01:25:07.240 --> 01:25:10.240] You inspect this place [01:25:10.240 --> 01:25:15.240] You tell me everything that is wrong here [01:25:15.240 --> 01:25:22.240] Because if you come back and I've done everything you said and you come up with something else [01:25:22.240 --> 01:25:25.240] I'm going to build a mayor for it [01:25:25.240 --> 01:25:32.240] I paid you to come here and do this inspection so that I would make sure I get everything done right [01:25:32.240 --> 01:25:37.240] If you can't do your job, then the city can pay the cost [01:25:37.240 --> 01:25:39.240] Oh, you can't do that [01:25:39.240 --> 01:25:41.240] I said, we won't have this argument with me and you [01:25:41.240 --> 01:25:46.240] We'll have this argument with the judge and your city attorney in court [01:25:46.240 --> 01:25:47.240] You just do your job [01:25:47.240 --> 01:25:49.240] So he does the inspection [01:25:49.240 --> 01:25:50.240] He leaves [01:25:50.240 --> 01:25:51.240] I fix everything [01:25:51.240 --> 01:25:54.240] He comes back and he checks it all [01:25:54.240 --> 01:26:03.240] And then he points up at the vents on my drain lines that go up through the ceiling [01:26:03.240 --> 01:26:07.240] He points up at it and I said, don't even think about it [01:26:07.240 --> 01:26:09.240] Okay, okay, he left [01:26:09.240 --> 01:26:13.240] So they're not that terribly hard to deal with [01:26:13.240 --> 01:26:18.240] They are used to people just bending over for them [01:26:18.240 --> 01:26:25.240] But as far as I'm concerned, they're my contractors [01:26:25.240 --> 01:26:31.240] They are to come in there and show me everything that I have screwed up [01:26:31.240 --> 01:26:41.240] And don't give me this crapola of picking part of it and coming back and telling me I've got to undo part of this and redo it because something else was missed [01:26:41.240 --> 01:26:44.240] No, no, no, you don't get to do that [01:26:44.240 --> 01:26:51.240] You come back a second time and tell me something you didn't tell me the first time [01:26:51.240 --> 01:26:56.240] I paid you the first time to tell me everything so we sue the city [01:26:56.240 --> 01:26:58.240] That's one way of handling it [01:26:58.240 --> 01:27:00.240] So what are you trying to do? [01:27:00.240 --> 01:27:04.240] You're trying to just avoid the permit process altogether? [01:27:04.240 --> 01:27:11.240] Well, I highly believe in inspectors and I will hire inspectors to inspect every single aspect of my house [01:27:11.240 --> 01:27:17.240] However, I don't feel I need to get permission from the county to build a house [01:27:17.240 --> 01:27:23.240] Okay, my suggestion here is, pick your fight [01:27:23.240 --> 01:27:29.240] Is this something that you want to change? [01:27:29.240 --> 01:27:45.240] Yes, because I feel that they are ripping everybody off because the regulations plainly state that these regulations apply to all areas of special flood hazard within the jurisdiction of the unincorporated limits of Montgomery County [01:27:45.240 --> 01:27:52.240] And that's how no one builds a structure in a special flood hazard which diverts the water and someone else [01:27:52.240 --> 01:27:59.240] So they're exerting or purporting to exert an authority they don't have? [01:27:59.240 --> 01:28:09.240] That's correct because I don't plainly state on my plate that I am not in a flood zone [01:28:09.240 --> 01:28:18.240] Then you might look at what would give you the best suit [01:28:18.240 --> 01:28:29.240] What would you need the city to do to give you the best claim against them and then set them up to do that? [01:28:29.240 --> 01:28:33.240] If you're expecting a fight with them, you might [01:28:33.240 --> 01:28:36.240] Well, I'm expecting a fight [01:28:36.240 --> 01:28:40.240] Then prepare for the fight. Don't wait till they bring it to you [01:28:40.240 --> 01:28:50.240] I was a combat veteran. I was. I still am a combat veteran. In combat, you got to pick your fights real careful [01:28:50.240 --> 01:28:58.240] And before you get into a fight, you need to make sure you got everything in place so everything's to your advantage [01:28:58.240 --> 01:29:05.240] So if you're going to take this issue on, do not wait for them to come to you [01:29:05.240 --> 01:29:13.240] Read their law, know their law better than they do and walk them right in to every claim you need to have against them [01:29:13.240 --> 01:29:18.240] If you've listened to our program, we talk about the routine we run on them [01:29:18.240 --> 01:29:21.240] That's exactly what that's about [01:29:21.240 --> 01:29:30.240] We use the routine to get them set up so that when we get them up against the wall, they're pinned there and they don't have any way out [01:29:30.240 --> 01:29:40.240] The question is, how do you set up the city to bring them directly to this legal point or their county [01:29:40.240 --> 01:29:48.240] That they're attempting to exert an authority not only against you, but against everyone else similarly situated [01:29:48.240 --> 01:29:55.240] Hang on, this is Randy Kelton, Deborah Stevens, Wheel of Law Radio, or call in number 512-646-1984 [01:29:55.240 --> 01:30:00.240] We'll be right back [01:30:25.240 --> 01:30:27.240] But it doesn't have to be that way [01:30:47.240 --> 01:30:49.240] There are lots of theories about why we yawn [01:30:49.240 --> 01:30:52.240] Some say it's caused by boredom or lack of sleep [01:30:52.240 --> 01:30:54.240] Others blame it on the need for more oxygen [01:30:54.240 --> 01:30:59.240] Whatever the cause, it's clear that most people react to yawns by yawning themselves [01:30:59.240 --> 01:31:05.240] Researchers say the so-called contagious yawning is a way to synchronize with those around us biologically and socially [01:31:05.240 --> 01:31:09.240] Scientists have found that contagious yawning is learned behavior [01:31:09.240 --> 01:31:12.240] It starts around age 4 in children with normal development [01:31:12.240 --> 01:31:19.240] Interestingly, children who have difficulty picking up social cues like those with autism aren't as susceptible to catching yawns [01:31:19.240 --> 01:31:25.240] They yawn contagiously only half as often, and those who are severely autistic don't respond to yawns at all [01:31:25.240 --> 01:31:30.240] I'm Dr. Katherine Albrecht. Randy Kelton, W. Stevens, Root of Law Radio, and we're talking to Tommy in Texas [01:34:04.240 --> 01:34:09.240] And, yeah, I would look at setting them up [01:34:09.240 --> 01:34:17.240] Once they figure out what you're doing, you will probably stop having problems with them [01:34:17.240 --> 01:34:25.240] But you realize, you know, the utility companies and all that, you're going to have a problem with all of them [01:34:25.240 --> 01:34:27.240] Because they're going to want a certificate of occupancy [01:34:27.240 --> 01:34:34.240] You may not be able to get the electric company to hook up your electric without a certificate of occupancy [01:34:34.240 --> 01:34:40.240] And if you don't get the permits, they won't give you the certificate of occupancy [01:34:40.240 --> 01:34:44.240] Well, there's really no permits required in the unincorporated Montgomery County [01:34:44.240 --> 01:34:47.240] There's really no permits required [01:34:47.240 --> 01:34:53.240] I mean, as far as electrical and plumbing [01:34:53.240 --> 01:35:00.240] Then you might, I'm trying to think of how to get a claim [01:35:00.240 --> 01:35:05.240] You don't want to have this fight once you're in construction [01:35:05.240 --> 01:35:16.240] Yeah, because they say that they will stop construction and remove all the structures and then charge me for the removal [01:35:16.240 --> 01:35:23.240] Okay, well, I'm thinking how do you get a claim against them? [01:35:23.240 --> 01:35:28.240] One thing you can do is start digging in the dirt [01:35:28.240 --> 01:35:38.240] Get you, if you want to set them up, get you a sign that says new house coming soon and maybe put a photograph of a house on it [01:35:38.240 --> 01:35:50.240] And then get out there with a tractor with a landscaping blade on it and start smoothing out the spot where you're going to put the slab [01:35:50.240 --> 01:35:56.240] And get them to show up before you actually get into construction [01:35:56.240 --> 01:36:03.240] And once they come out there and tell you to stop, now you've got harm [01:36:03.240 --> 01:36:08.240] You can't sue them for what might come to harm [01:36:08.240 --> 01:36:12.240] You can only sue them for actual harm [01:36:12.240 --> 01:36:15.240] Okay, I understand [01:36:15.240 --> 01:36:24.240] So they'd have to come out there and, okay, if you're out in unincorporated you have septics [01:36:24.240 --> 01:36:28.240] That's correct [01:36:28.240 --> 01:36:33.240] You might, that might be a way to get it started [01:36:33.240 --> 01:36:42.240] Look at getting someone to come out and do a PERC test for a septic [01:36:42.240 --> 01:36:52.240] And then go down to the city and find a reason to talk to them about it or go to the county [01:36:52.240 --> 01:37:05.240] And may ask them what their performance is with septics in this area or do the aerobic abovegrounds work better [01:37:05.240 --> 01:37:16.240] And then they'll say, they'll start asking you questions and get them to tell you that you can't put your, put a septic in without getting a permit [01:37:16.240 --> 01:37:22.240] Now you've got harm [01:37:22.240 --> 01:37:27.240] You're going to do what? [01:37:27.240 --> 01:37:31.240] Oh, dangle the carrot, yeah, so you go in there and start asking them questions about it [01:37:31.240 --> 01:37:35.240] And they'll ask you if you have a permit and you say, oh, no, I don't need a permit [01:37:35.240 --> 01:37:39.240] And they're going to say, yeah, you need a permit, you can't build that without a permit [01:37:39.240 --> 01:37:42.240] Now you've been harmed [01:37:42.240 --> 01:37:46.240] You need them to do something to stop you [01:37:46.240 --> 01:37:52.240] But before you do that, you need to have financing in place [01:37:52.240 --> 01:37:59.240] You need someone to agree to finance the project [01:37:59.240 --> 01:38:02.240] Even if you don't need financing [01:38:02.240 --> 01:38:09.240] You need someone to tell you, yeah, if you're going to build this project, I'll finance it [01:38:09.240 --> 01:38:15.240] Because now, if you go down there and they tell you you can't put a septic in without a permit [01:38:15.240 --> 01:38:24.240] Well, without a septic, you can't build a project, you can't get the funding, you've been harmed for the amount of the funding [01:38:24.240 --> 01:38:26.240] Does that make sense? [01:38:26.240 --> 01:38:29.240] I like where this is going, yeah [01:38:29.240 --> 01:38:37.240] Now you have a claim, but you haven't actually been put in a position where they can get leverage against you [01:38:37.240 --> 01:38:43.240] Like you're halfway through a project, now they want to come in and tell you to tear it down [01:38:43.240 --> 01:38:49.240] So now you've got them to stop you before you actually get started [01:38:49.240 --> 01:38:55.240] And now, because you can't get this started, now you can't get your funding [01:38:55.240 --> 01:38:59.240] And you've lost the benefit of the bargain [01:38:59.240 --> 01:39:04.240] Now you've got your claim, then go after them [01:39:04.240 --> 01:39:09.240] And, are you familiar with the private attorney general suit? [01:39:09.240 --> 01:39:11.240] No [01:39:11.240 --> 01:39:20.240] Okay, the reason I ask that question is a lot of people in legal reform have heard about attorney generals' suits [01:39:20.240 --> 01:39:23.240] And have misconceptions about it [01:39:23.240 --> 01:39:25.240] So good, you don't have a misconception [01:39:25.240 --> 01:39:34.240] What a private attorney general suit is, that's just a name they use for a certain kind of lawsuit [01:39:34.240 --> 01:39:43.240] There are issues that occur that cost people money or deny them rights [01:39:43.240 --> 01:39:53.240] But the issue's not so large that it's worth the cost and effort of taking action to seek remedy [01:39:53.240 --> 01:40:06.240] A ticket for your grass too tall is not worth mounting a major campaign to force the jurisdiction to change their laws [01:40:06.240 --> 01:40:19.240] So, one person who's willing to pick up the gauntlet can sue for himself and all others similarly situated [01:40:19.240 --> 01:40:28.240] So, then you get to go back and look at all of the permits they've required for places that were not in a flood zone [01:40:28.240 --> 01:40:35.240] Okay, flood zone, how does the county define flood zone? [01:40:35.240 --> 01:40:40.240] Five year, ten year, a hundred year, two hundred year? [01:40:40.240 --> 01:40:47.240] A hundred year, five hundred year, and it's depicted on the map as such [01:40:47.240 --> 01:40:50.240] Okay, so it is specific [01:40:50.240 --> 01:40:52.240] It is specific [01:40:52.240 --> 01:40:55.240] Good, good, so that's how I'd look at it, go ahead [01:40:55.240 --> 01:40:59.240] I really need to move ahead, we've got two more callers [01:40:59.240 --> 01:41:04.240] Keep us in touch, think about it, maybe call in next week and we'll talk about it again [01:41:04.240 --> 01:41:05.240] Thank you so much [01:41:05.240 --> 01:41:12.240] We'll figure out how to set them up and pluck them good [01:41:12.240 --> 01:41:14.240] Thank you kindly [01:41:14.240 --> 01:41:19.240] Alrighty, okay, now we're going to go to Ed in Texas [01:41:19.240 --> 01:41:23.240] Hello Ed, what do you have for us today? [01:41:23.240 --> 01:41:28.240] Hey, that guy, what he needs to do is set up a contract with a time limit [01:41:28.240 --> 01:41:30.240] That would really hammer him [01:41:30.240 --> 01:41:33.240] A contract with a time limit? [01:41:33.240 --> 01:41:37.240] Yeah, where he has to have the thing built by a certain date [01:41:37.240 --> 01:41:40.240] Oh, oh yeah, on the financing [01:41:40.240 --> 01:41:42.240] Yeah, to get penalized [01:41:42.240 --> 01:41:52.240] Yeah, he needs to find somebody, maybe somebody he knows who has, who could show that he could provide the funding [01:41:52.240 --> 01:41:55.240] Who will write the contract with him [01:41:55.240 --> 01:42:02.240] And then they can write a backside private contract, a bailout contract [01:42:02.240 --> 01:42:08.240] So that they have a contract that's in the public side [01:42:08.240 --> 01:42:13.240] Yeah, that's a good idea with a specific time limit [01:42:13.240 --> 01:42:21.240] Once he's gone past the time limit, now he has documentable harm of loss of benefit of the bargain [01:42:21.240 --> 01:42:23.240] That's right, that's right [01:42:23.240 --> 01:42:27.240] I know that because I've been in construction all my life [01:42:27.240 --> 01:42:29.240] Oh, okay [01:42:29.240 --> 01:42:34.240] The reason I was calling, Randy, was I want to do this real quick because I don't want to take too much of your time [01:42:34.240 --> 01:42:36.240] Because I know you've got somebody else [01:42:36.240 --> 01:42:43.240] That fellow, Chris, that's having a problem with CPS, I had a friend of mine that lost his kid [01:42:43.240 --> 01:42:52.240] His girlfriend was not able to deal with his child properly, didn't have the right setup for him [01:42:52.240 --> 01:42:55.240] And so CPS took the child away from her [01:42:55.240 --> 01:43:03.240] And my friend filed a suit in Corsicana for custody of the child [01:43:03.240 --> 01:43:08.240] And he was trying to get him away from child protection service for a long time but couldn't do it [01:43:08.240 --> 01:43:15.240] So what he did was, he didn't really know how to do completely a Title 42 suit [01:43:15.240 --> 01:43:24.240] But all he did was he made it look real good, he took another attorney's Title 42 suit or another one that had been done [01:43:24.240 --> 01:43:31.240] Wait a minute, are you telling me that he plagiarized? [01:43:31.240 --> 01:43:34.240] Yeah, I think he did [01:43:34.240 --> 01:43:38.240] I thought I was the pro-plagiarizer around here [01:43:38.240 --> 01:43:41.240] I've done it too [01:43:41.240 --> 01:43:46.240] Okay, hang on, we're going to break it out, I'm sorry I interrupted you there [01:43:46.240 --> 01:43:53.240] But I wanted to make the point that plagiarizing is an absolute best way to produce good documents [01:43:53.240 --> 01:43:56.240] Hang on, we'll be right back on the other side [01:43:56.240 --> 01:44:01.240] We're going into our last segment, we'll be right back [01:44:01.240 --> 01:44:05.240] You feel tired when talking about important topics like money and politics? [01:44:05.240 --> 01:44:06.240] Sorry! [01:44:06.240 --> 01:44:09.240] Are you confused by words like the Constitution or the Federal Reserve? [01:44:09.240 --> 01:44:10.240] What? Randy Kelton, Deborah Stevens, Rule of Law Radio, and we're talking to Ed in Texas [01:46:44.240 --> 01:46:47.240] Okay, Ed, you had a question or comment? [01:46:47.240 --> 01:46:52.240] Yeah, let me finish what I was saying on that deal for Chris [01:46:52.240 --> 01:47:00.240] What my buddy did was he filed for custody, and prior to going to the custody hearing [01:47:00.240 --> 01:47:10.240] He filed Title 42 suit against everybody involved, even the judge, and served them all [01:47:10.240 --> 01:47:16.240] And he said, he told me, I watched this with my own two eyes, Randy, I saw this with my own two eyes, I witnessed it [01:47:16.240 --> 01:47:23.240] So he went in, and to the hearing, he told me, he said, watch what happened [01:47:23.240 --> 01:47:32.240] So what they did was, you know how they do usually, they usually find, as many times as they can, they'll find in favor of the woman [01:47:32.240 --> 01:47:39.240] Rather than the man in most cases, but in this case, I have never seen in my entire life [01:47:39.240 --> 01:47:50.240] The absolute unbelievable attack that the whole system, everybody there, the attorneys, the judge even [01:47:50.240 --> 01:47:56.240] Was attacking that woman, I mean, I felt sorry for her, they were attacking her so hard [01:47:56.240 --> 01:48:03.240] And he ended up getting custody, but the thing that's funny about it, he told me, he says [01:48:03.240 --> 01:48:08.240] He said, I don't really know how to do a Title 42 suit, he said, so he just dropped it [01:48:08.240 --> 01:48:14.240] But he got his kid, so there's something he can do [01:48:14.240 --> 01:48:23.240] That's what we're after, you know, if you can't process or adjudicate the whole Title 42 suit [01:48:23.240 --> 01:48:31.240] This guy did exactly right, and this is what I tell people, don't figure all this stuff out yourself [01:48:31.240 --> 01:48:35.240] Whatever kind of case you have, somebody's already done one [01:48:35.240 --> 01:48:43.240] And, you know, I quit using Lexus and Westlaw, heck, I don't need them [01:48:43.240 --> 01:48:53.240] I can just go online, do a search and find, I find stuff better just with an internet search that I did with Lexus [01:48:53.240 --> 01:49:03.240] Lexus is a pain, I want to find somebody's pleading, and then I want to find a point in authorities [01:49:03.240 --> 01:49:09.240] Or I want to find an opinion on the issue, and I got all my stuff [01:49:09.240 --> 01:49:13.240] I am the all-time pro-plagiarist [01:49:13.240 --> 01:49:16.240] Me too, I've done it many times, many times [01:49:16.240 --> 01:49:19.240] But I asked the guy, I said, well, why did that work? [01:49:19.240 --> 01:49:23.240] He said, because, he says, these are state agents [01:49:23.240 --> 01:49:27.240] He said, they know nothing about federal jurisdiction and they're afraid of it [01:49:27.240 --> 01:49:32.240] He said, they freak out when a suit like that is filed in federal districts for it [01:49:32.240 --> 01:49:38.240] He said, because they don't know anything about the process and the procedure, it's all foreign to them and it freaks them out [01:49:38.240 --> 01:49:43.240] Well, it may be that they do know about it [01:49:43.240 --> 01:49:49.240] And, you know, the rule is, take the state to the Fed and the Fed to the state [01:49:49.240 --> 01:49:53.240] The two tend not to like each other very much [01:49:53.240 --> 01:50:01.240] And the federal court is not going to have any real political connection to the state [01:50:01.240 --> 01:50:03.240] It's all about politics [01:50:03.240 --> 01:50:04.240] That's right [01:50:04.240 --> 01:50:09.240] Anyway, the other thing that I wanted to bring up, and you may have heard of this before [01:50:09.240 --> 01:50:14.240] But this is for people who have gone, they're already out in the 30 foot deep end [01:50:14.240 --> 01:50:20.240] And they don't know how to get out of it, maybe it's real hard to get them out of it in any of the ways that you are suggesting and stuff [01:50:20.240 --> 01:50:26.240] But if a person, this is really good, there's a guy that actually did this, and you may have heard of it [01:50:26.240 --> 01:50:38.240] But if you are stuck with an attorney, for example, let's say you got found incompetent by some psychiatric evaluation or whatever [01:50:38.240 --> 01:50:42.240] And you're stuck with an attorney and you can't get rid of him [01:50:42.240 --> 01:50:49.240] Or if you want to do this just for the fun of it and you go get you an attorney to do it [01:50:49.240 --> 01:50:54.240] What you do is you can actually win your case at sentencing [01:50:54.240 --> 01:50:57.240] You can go all the way through the whole thing, go to sentencing [01:50:57.240 --> 01:51:08.240] And when you get to sentencing, this guy, what he did was he, when the judge asked, he says, will the defendant rise to accept the sentencing [01:51:08.240 --> 01:51:15.240] Well, the defendant said, hold on a minute, Judge, I want to ask my attorney a question on the record [01:51:15.240 --> 01:51:18.240] And then we can move forward [01:51:18.240 --> 01:51:22.240] So the judge allowed him to do it and the attorney didn't know what he was doing [01:51:22.240 --> 01:51:29.240] And so he said, Mr. Attorney, for the record, are you still representing me at this point right now? [01:51:29.240 --> 01:51:32.240] And the attorney said, well, yes, I am [01:51:32.240 --> 01:51:42.240] He said, okay, well, Judge, at this point in time, then my attorney will accept the sentence in this case [01:51:42.240 --> 01:51:44.240] And he sat down [01:51:44.240 --> 01:51:48.240] And that attorney, he said, went ballistic, went crazy [01:51:48.240 --> 01:51:52.240] And he starts saying, oh, my God, I can't accept that, I can't do that [01:51:52.240 --> 01:51:54.240] And so they finally dismissed the case [01:51:54.240 --> 01:51:59.240] Because actually it's lawfully sound to do that [01:51:59.240 --> 01:52:04.240] Where? I've heard of this before, but I've never found law to support it [01:52:04.240 --> 01:52:06.240] No, but you know [01:52:06.240 --> 01:52:12.240] Robert Fox used to talk about not accepting the sentence and walking out of the court [01:52:12.240 --> 01:52:15.240] But I've never found any law to support it [01:52:15.240 --> 01:52:18.240] No, it's probably not any, but if you give [01:52:18.240 --> 01:52:27.240] But the lawful part of it is that the attorney is representing you, he is you [01:52:27.240 --> 01:52:37.240] And so whenever you go to accept sentence, he always steps aside and allows you to step up to the bench [01:52:37.240 --> 01:52:41.240] You know, and you not knowing that you could actually [01:52:41.240 --> 01:52:46.240] I've never seen any law on this issue [01:52:46.240 --> 01:52:51.240] Do you have any case law to support this position? [01:52:51.240 --> 01:52:53.240] No, no, I doubt if there is any [01:52:53.240 --> 01:52:55.240] All I know is that [01:52:55.240 --> 01:52:59.240] This sounds like Winston Shroud [01:52:59.240 --> 01:53:09.240] I did a show with Winston Shroud and he's talking about the bankruptcy and the birth certificate and all this [01:53:09.240 --> 01:53:15.240] And I said, well, you know, that's all interesting, Winston, but where did you get this? [01:53:15.240 --> 01:53:21.240] Where's the case laws? I'm an engineer and all I can do is connect the dots [01:53:21.240 --> 01:53:23.240] And there's a lot of dots missing here [01:53:23.240 --> 01:53:27.240] I said, where's the law to support this? He said, well, there's not any [01:53:27.240 --> 01:53:32.240] I said, well, where did you come up with this? He said, I figured it out [01:53:32.240 --> 01:53:37.240] And this was on Winston's show that Pastor Manson set me up for that [01:53:37.240 --> 01:53:48.240] And when he said he figured it out, I said, so you're saying you made it up and long pause into Winston's credit [01:53:48.240 --> 01:53:51.240] He said, yes, I did [01:53:51.240 --> 01:53:57.240] I said, Winston, I can't go into court without made it up [01:53:57.240 --> 01:54:04.240] I mean, you can understand that the position of this is there's not going to be any law that's going to support this, obviously [01:54:04.240 --> 01:54:08.240] And if there's no law to support it, I can't use it [01:54:08.240 --> 01:54:17.240] Well, except for the fact that when an attorney is representing you, you don't even need to be there [01:54:17.240 --> 01:54:21.240] I mean, that's true because have you ever had an attorney say, well, I'm going to [01:54:21.240 --> 01:54:31.240] But I don't, but still, this kind of stuff makes me uncomfortable telling people to do things that we can't support [01:54:31.240 --> 01:54:40.240] I'm going to be real careful about telling anybody to do anything that I can't bring them chapter and verse to show them how to do it [01:54:40.240 --> 01:54:47.240] This is why I've never had them come after me over the things that I'm doing except the one time [01:54:47.240 --> 01:54:52.240] Is because I come in with their law the way they use it [01:54:52.240 --> 01:54:58.240] If I come in with a theory about law, they're going to hammer me [01:54:58.240 --> 01:55:01.240] I don't come in with theories about law [01:55:01.240 --> 01:55:09.240] This is for people who are in dire straits and they're in the 30 foot deep end and you can't reach out to help them [01:55:09.240 --> 01:55:14.240] If they go that far and they're stuck, I had a friend of mine that that happened to [01:55:14.240 --> 01:55:20.240] He went in for a psych evaluation and they found him incompetent [01:55:20.240 --> 01:55:24.240] And when he did, the judge wouldn't let him fire his attorney and do his own thing [01:55:24.240 --> 01:55:31.240] And so for people like that where you've stuck with the attorney and they won't let you get rid of him [01:55:31.240 --> 01:55:34.240] Well then you have no real choice [01:55:34.240 --> 01:55:41.240] Okay, I can see where this might be valuable in an extreme case like that [01:55:41.240 --> 01:55:45.240] But I've got one more caller, Ed, and I've got about three minutes [01:55:45.240 --> 01:55:54.240] I'd like to go there to him and maybe we can get him in in this last three minutes [01:55:54.240 --> 01:55:59.240] You there, Ed? [01:55:59.240 --> 01:56:00.240] I think I lost him [01:56:00.240 --> 01:56:07.240] Okay, John in Texas, John, we have about two and a half minutes left [01:56:07.240 --> 01:56:09.240] What do you have for us? [01:56:09.240 --> 01:56:16.240] I made a loan and I signed a note in the deed of trust [01:56:16.240 --> 01:56:23.240] Well, the escrow agent who's a notary public as well as a public servant [01:56:23.240 --> 01:56:29.240] Went back on the note and forged my name, my wife's name, and my mother's name [01:56:29.240 --> 01:56:33.240] And she certified that to the title company [01:56:33.240 --> 01:56:38.240] Now she did not notarize it because you didn't notarize this note [01:56:38.240 --> 01:56:45.240] Now then, because she's a public servant and she's certified that's only for the title company [01:56:45.240 --> 01:56:49.240] That would be void, wouldn't it, void abanicio? [01:56:49.240 --> 01:56:54.240] Was that the document that was filed in the county record? [01:56:54.240 --> 01:56:58.240] No, on the note you don't file it in the county records, but the deed of trust [01:56:58.240 --> 01:57:01.240] Oh, I'm sorry, you said note, not deed of trust, you mentioned deed of trust before [01:57:01.240 --> 01:57:05.240] So he forged the name on the note and certified that he did? [01:57:05.240 --> 01:57:09.240] Yes, but not as a notary public [01:57:09.240 --> 01:57:18.240] Did he have permission to do that from those for whom he signed? [01:57:18.240 --> 01:57:22.240] No, my wife was not even there [01:57:22.240 --> 01:57:28.240] Is there a note that was signed by all of the parties? [01:57:28.240 --> 01:57:36.240] Only my mother and I, this was the second note that escrow agent forged [01:57:36.240 --> 01:57:41.240] Okay, this is a bit unclear [01:57:41.240 --> 01:57:49.240] Okay, so the second note that he, this doesn't make sense, I've never heard of an escrow agent [01:57:49.240 --> 01:57:55.240] Closing agent forging a signature [01:57:55.240 --> 01:58:01.240] Why would he forge all three of these signatures, was nobody present? [01:58:01.240 --> 01:58:07.240] The second note was forged, the first note my mother and I signed, only the two of us [01:58:07.240 --> 01:58:15.240] On the third one, the escrow agent forged my name, wife's name, mother's name [01:58:15.240 --> 01:58:18.240] Okay, we're out of time to talk about this [01:58:18.240 --> 01:58:27.240] You might want to send me an email on this with kind of a brief synopsis of what went on [01:58:27.240 --> 01:58:32.240] And I'll give you a reply back to that, but we're out of time for this show [01:58:32.240 --> 01:58:36.240] Thank you for calling and get that through with me, I will look it over [01:58:36.240 --> 01:58:40.240] This is Randy Kelton, Deborah Stevens, Rue Le Blanc radio [01:58:40.240 --> 01:58:46.240] We'll be back, Deborah and Eddie will be back Monday, I'll be back Thursday with Deb and then back Friday [01:58:46.240 --> 01:58:50.240] Thank you for listening and good night [01:59:17.240 --> 01:59:21.240] Or visit us online at bfa.org [01:59:21.240 --> 01:59:26.240] This translation is highly accurate and it comes with over 13,000 cross references [01:59:26.240 --> 01:59:30.240] Plus charts and maps and an outline for every book of the Bible [01:59:30.240 --> 01:59:33.240] This is truly a Bible you can understand [01:59:33.240 --> 01:59:41.240] To get your free copy of the New Testament Recovery Version, call us toll free at 888-551-0102 [01:59:41.240 --> 01:59:50.240] That's 888-551-0102 or visit us online at bfa.org [01:59:50.240 --> 02:00:12.240] Looking for some truth?
