[01:35.000 --> 01:38.800] Also in New York news, New York City Mayor Michael Bloomberg announced a new marijuana [01:38.800 --> 01:41.840] policy for the city during his state of the city address. [01:41.840 --> 01:45.280] Mayor Bloomberg, who previously stood with New York Governor Andrew Okumo in his call [01:45.280 --> 01:49.640] for fixing New York's marijuana laws, reiterated that support but said the city won't wait [01:49.640 --> 01:51.560] for Albany on the issue. [01:51.560 --> 01:55.800] In a statement released by Mayor Bloomberg, he says that, effective next month, anyone [01:55.800 --> 01:59.800] presenting an ID and clearing a warrant check will be released directly from the precinct [01:59.800 --> 02:02.600] with the desk appearance ticket to return to court. [02:02.600 --> 02:06.280] It's consistent with the law, it's the right thing to do, and it will allow us to target [02:06.280 --> 02:09.960] police resources where they're needed most. [02:09.960 --> 02:14.640] A recent two-day protest in Northern California against genetically modified organisms led [02:14.640 --> 02:20.120] to the complete shutdown of Monsanto Corporate Office for an entire day according to reports. [02:20.120 --> 02:24.880] On Friday, March 16, 2012, activists affiliated with the Global Days of Action to shut down [02:24.880 --> 02:29.800] Monsanto began rallying in front of Davis, California Office of Monsanto where they held [02:29.800 --> 02:33.760] up banners, gave speeches, and set up tents in front of the building on Fifth Street which [02:33.760 --> 02:38.000] caused the biotech giant to shudder its operations. [04:46.600 --> 04:50.600] Alright, now for those of you that have been listening to the show [04:50.600 --> 04:54.600] You know of course that everything that I've been getting into [04:54.600 --> 04:57.600] Is trying to teach you the difference between the right to travel [04:57.600 --> 05:00.600] And the act of transportation [05:00.600 --> 05:04.600] One is an activity involving your rights [05:04.600 --> 05:07.600] In the form of liberty [05:07.600 --> 05:11.600] The other is an activity involving commerce [05:11.600 --> 05:15.600] Transportation in and of itself is an act of commerce [05:15.600 --> 05:20.600] No, it is not all commerce, it is not commerce itself [05:20.600 --> 05:24.600] It is simply an act of commerce [05:24.600 --> 05:32.600] Commerce is the overall subject matter that transportation is involved with [05:32.600 --> 05:38.600] You cannot perpetrate an act of transportation [05:38.600 --> 05:43.600] And it not be in a commercial act [05:43.600 --> 05:48.600] As a commercial act, it is a regular activity [05:48.600 --> 05:50.600] Why? [05:50.600 --> 05:54.600] Because you are using public property [05:54.600 --> 05:58.600] For the purpose of generating private gain [05:58.600 --> 06:03.600] And the public property in this case is the roads [06:03.600 --> 06:06.600] The public funds the roads [06:06.600 --> 06:14.600] The public has given the responsibility of maintaining their roads, our roads [06:14.600 --> 06:17.600] To our public servants [06:17.600 --> 06:25.600] Now, they are to maintain them and keep them in good repair for our particular private use [06:25.600 --> 06:30.600] It is when someone wishes to take the private use of that road [06:30.600 --> 06:38.600] And turn it into an activity by which they can generate a profit or gain [06:38.600 --> 06:46.600] That the issue becomes one involving the public that requires the government to possibly regulate it [06:46.600 --> 06:47.600] Why? [06:47.600 --> 06:55.600] Imagine an 80,000 pound plus missile traveling at 80 to 100 miles an hour down a crowded highway [06:55.600 --> 07:03.600] And nobody has bothered to maintain the brakes, the drivetrain, the framework of the truck or the trailer [07:03.600 --> 07:12.600] Or bothered to check the weight limits on that trailer if it is carrying a heavy load like an earth mover or something of that nature [07:12.600 --> 07:16.600] And they have an accident because of maintenance failure [07:16.600 --> 07:18.600] They blow a tire [07:18.600 --> 07:24.600] The trailer breaks in half, which I've seen happen on more than one occasion in all kinds of trailers [07:24.600 --> 07:29.600] My family used to have a small trucking company, we used to run three trucks [07:29.600 --> 07:33.600] And we did not want to own trailers, but we did own three rigs [07:33.600 --> 07:38.600] And those three rigs we would go out and we would haul somebody else's loaded trailers [07:38.600 --> 07:50.600] And on several occasions we had box trailers, flatbeds, you name it, actually break in half in the middle of the highway under load [07:50.600 --> 07:51.600] Why? [07:51.600 --> 07:59.600] Because there were cracks in the support frame that had never been repaired by the company that owned them [07:59.600 --> 08:07.600] Now can you imagine barreling down the highway 75, 80 miles an hour back in the day [08:07.600 --> 08:18.600] And a box trailer breaks in half carrying 60,000 cans of Schlitz beer [08:18.600 --> 08:22.600] Because that's exactly what happened to us one night, one day [08:22.600 --> 08:28.600] And that load went all over the road, caused all kinds of accidents [08:28.600 --> 08:31.600] But it wasn't our trailer [08:31.600 --> 08:36.600] So we had no idea that the trailer had not been maintained [08:36.600 --> 08:41.600] But the company that owned it knew, and they knew that they would have to spend money to keep it maintained [08:41.600 --> 08:45.600] And chose not to do it because it interfered with their profit margins [08:45.600 --> 08:54.600] That folks is exactly the type of reason why commercial use of the roads is a regular activity [08:54.600 --> 08:57.600] It's a perfect example of why [08:57.600 --> 09:06.600] Now given that, one of the things that I've been teaching you is how to protect yourself during a traffic stop [09:06.600 --> 09:16.600] Because they're assuming that everyone on the road is engaging in a regular activity that gives them the authority [09:16.600 --> 09:23.600] To pull you over, write you tickets, search your car, take your property, the whole nine yards [09:23.600 --> 09:33.600] Now there is absolutely no question, I don't care what some cross-dressing moron on a bench or dais has to say about it [09:33.600 --> 09:46.600] There is no way that you can tell me that the way that these laws are being enforced does not violate our fundamentally protected rights [09:46.600 --> 09:52.600] It absolutely violates them, and there is no excuse for it [09:52.600 --> 09:58.600] So until you learn how to protect yourself from this, you're going to remain a victim [09:58.600 --> 10:07.600] Now for those of you that have already got it, that's fine, but for those of you that haven't, I have a script, a transportation script [10:07.600 --> 10:14.600] That you need to get a copy of, you need to read it over, and you need to commit it to memory [10:14.600 --> 10:30.600] This script is designed specifically to tell you what to say, when to say it, in order to protect you and your rights in any type of encounter with a public official [10:30.600 --> 10:37.600] Especially in relation to some sort of investigative stop by some public official [10:37.600 --> 10:47.600] Doesn't matter whether it's a transportation stop or they just walk up to you on the street, these same things apply every time [10:47.600 --> 11:01.600] Everything in this script is intended to tell you what to say and how to say it so that you can act to invoke, protect, and demand that your rights be respected [11:01.600 --> 11:11.600] Now, that being said, I would like to talk about a case that happened just this past Wednesday or Thursday night, I forget exactly which one it is [11:11.600 --> 11:33.600] But my favorite European lady friend that has started coming to my class, once again, she's a ticket magnet and I love her to death, but she's got a lead foot and she knows it [11:33.600 --> 11:49.600] But the deal here is, is that she got stopped this past week again, and again, officers attempted to intimidate her into waiving her rights so that they could do what they wanted to do at this stop [11:49.600 --> 12:02.600] But she has become a shining example of what to do and how to do it when it comes to invoking, protecting, and demanding your rights [12:02.600 --> 12:14.600] She did not give one inch to these guys and there were four of them and one of her and it's approximately 10 o'clock at night [12:14.600 --> 12:22.600] And she did not budge in standing on her rights, two and a half hours, she was there [12:22.600 --> 12:33.600] But at the end of that two and a half hours, the only thing these officers chose to do was to write her the tickets and leave her to go home [12:33.600 --> 12:41.600] Now, when we get past the break here, which is only four and a half minutes away, I will go into some details about what she did and how she did it [12:41.600 --> 12:45.600] I don't want to interrupt that in the middle because of a break, so I'll start that then [12:45.600 --> 12:52.600] But in the meantime, I want to try to set the scenario up so we can get there promptly on the other side [12:52.600 --> 13:05.600] Now, she has a regular routine where she goes to the gym several nights a week and when she leaves the gym, she goes to her home [13:05.600 --> 13:16.600] Now, she lives out in a remote area, so it's pretty much wide open road once she gets past certain ones like that are here in Austin [13:16.600 --> 13:24.600] So when she's headed home and there's not a lot of traffic, yeah, she tends to go fast, which in and of itself is not a big deal [13:24.600 --> 13:27.600] She's not reckless or anything of that nature [13:27.600 --> 13:36.600] But at the same time, these officers need the revenue for whoever they work for, so they're out there doing enforcement [13:36.600 --> 13:42.600] Now, in this particular case, the agency in question is Travis County Sheriff's Department [13:42.600 --> 13:47.600] And these guys are notorious bullies [13:47.600 --> 14:01.600] We have Mike, the water bottle guy that went through all this with the Austin Municipal Airport and the TSA over his water bottle and his alleged intimidation of a TSA agent [14:01.600 --> 14:19.600] And that was bad enough, but here, Mike was also assaulted and falsely imprisoned by Travis County officers for simply trying to enter the Travis County Courthouse to court watch [14:19.600 --> 14:27.600] And instead of allowing him to enter, they chose to be bullies that day and wound up assaulting him [14:27.600 --> 14:32.600] And so he's got another case in the works trying to deal with all that [14:32.600 --> 14:43.600] But the fact remains that these guys are well known as bullies, they're well known as men that could care less about your rights [14:43.600 --> 14:48.600] But in this particular lady's case, she wasn't letting them get away with it [14:48.600 --> 14:56.600] And that's going to be a story to be told for quite a while because she is becoming my shining example, like I said [14:56.600 --> 15:03.600] Now, one officer pulled her over and it turns out that he was not running radar [15:03.600 --> 15:12.600] He was going in the opposite direction down a divided highway, so he was not in direct line of sight with her where radar would have actually worked anyway [15:12.600 --> 15:18.600] He was not running laser because he was not stationary and he has to be in order to use the laser [15:18.600 --> 15:22.600] And it was, like I said, 10 o'clock at night [15:22.600 --> 15:32.600] So the first question is, how did he even begin to gauge her alleged speed to determine she was speeding when they were going in opposite directions on a divided highway [15:32.600 --> 15:36.600] And he had no electronic information to tell him anything [15:36.600 --> 15:45.600] He couldn't see the white lines on her lane from where he was, he didn't have any light poles or anything else to use as a frame of reference [15:45.600 --> 15:51.600] So how did he make a visual determination of speed at 10 o'clock at night? [15:51.600 --> 15:58.600] Well, that's a question for later, but right now we can safely assume this was a bogus stop [15:58.600 --> 16:02.600] Now, what's the other reason we can assume it's a bogus stop? [16:02.600 --> 16:20.600] The citation itself, these morons from Travis County actually printed out on the ticket that the entire reason they were patrolling the highway was to perform selective enforcement [16:20.600 --> 16:27.600] Now what is the legal problem with selective enforcement? [20:03.600 --> 20:10.600] Okay, let's continue on with this little story here about the travesty of the Travis County Sheriff's Department [20:10.600 --> 20:18.600] Now, as I was saying, there was no way that he could have gotten an actual visual, accurate indication of her alleged speed [20:18.600 --> 20:21.600] But he gave chase and pulled her over anyway [20:21.600 --> 20:26.600] Even though he wrote on the ticket, he was not using radar, he couldn't use lidar [20:26.600 --> 20:31.600] So, you know, there was really no way for him to do that if he wasn't pacing her [20:31.600 --> 20:35.600] And since he was going the opposite direction, he couldn't have been pacing her either [20:35.600 --> 20:43.600] But in any case, she had been pulled over for about 45 minutes before she actually called me and got me on the phone [20:43.600 --> 20:47.600] And I remained on the phone with her for another hour and 48 minutes [20:47.600 --> 20:59.600] And in that time, I heard some of the most ludicrous, asinine commentary by badge wearing doofus I have ever heard [20:59.600 --> 21:06.600] And there were four of these doofuses, only three of which ever spoke to her and she was able to get identifying information on [21:06.600 --> 21:10.600] The fourth one never even talked to her [21:10.600 --> 21:14.600] One of these was a supervisor [21:14.600 --> 21:22.600] Now, while I was on the phone with her, she had already gone through the spiel that's in the transportation script [21:22.600 --> 21:26.600] And by the way, if you folks want a copy of that that don't have it or if you want an updated copy [21:26.600 --> 21:29.600] Because I'm about to make a couple of very minor but necessary changes [21:29.600 --> 21:42.600] Please send me an email with transportation script in the subject line to eddyedde at ruleoflawradio.com [21:42.600 --> 21:49.600] Send me an email with transportation script in the subject line and I will email you back a copy of it [21:49.600 --> 21:55.600] Now, she had already gone through everything that's required there. What's the emergency and how can I help? [21:55.600 --> 22:02.600] What is your name? Is there a recording being made of this encounter? Are you sure all your equipment is functioning properly? [22:02.600 --> 22:05.600] Am I under arrest? Am I free to go? [22:05.600 --> 22:13.600] Officer, I can't provide you with that information because I am now under the perception that I'm in a custodial arrest because I am not free to leave [22:13.600 --> 22:17.600] Therefore, I invoke my right to remain silent and my right to assistance of counsel [22:17.600 --> 22:20.600] She had already gone through all of that [22:20.600 --> 22:26.600] Now, they still insisted that she had to give them a driver's license [22:26.600 --> 22:38.600] Even though by that time she had already given them her passport and a copy of a signed court order because she was having a name change done on the passport [22:38.600 --> 22:48.600] And she had also given her or given the officers a copy of her actual student ID from the university she's attending [22:48.600 --> 22:59.600] And of course, one's got her married name on it and the other one's got her original name on it hence the reason for the court order showing the name change [22:59.600 --> 23:08.600] But in either case, these officers, even though these documents have her picture, are still insisting that they have to have her driver's license [23:08.600 --> 23:14.600] So they can make sure that she is who the people in the documents say she is [23:14.600 --> 23:17.600] Now that's idiocy right there [23:17.600 --> 23:20.600] Both provided documents have her picture [23:20.600 --> 23:28.600] There is an intermediary document that shows the relationship between the different names on the two pieces of picture identification [23:28.600 --> 23:34.600] And these idiots are still saying we have to have a license so we can verify who you are [23:34.600 --> 23:38.600] No, they don't [23:38.600 --> 23:57.600] There is no law anywhere nor can there be a law anywhere that requires anyone to acquire and use a state identification form or a federal one for that matter [23:57.600 --> 24:07.600] Now you may have to have them to engage in certain regulable activities but you don't have to have them just for the sake of having them [24:07.600 --> 24:15.600] And remember, traveling in your car on the road is not a regulable activity [24:15.600 --> 24:29.600] What regulates individuals in their travels is the knowledge that if they cause harm they can be held accountable under the penal code [24:29.600 --> 24:38.600] We do not need the transportation code to punish people for things they do that damage persons or property in a car [24:38.600 --> 24:40.600] We don't [24:40.600 --> 24:46.600] Because the penal code can handle that, that's what it's for [24:46.600 --> 25:04.600] The only thing a transportation code can do is regulate the activity itself and those that have knowingly and willingly chose to participate in it [25:04.600 --> 25:10.600] Those are the people that are bound by the transportation code, it's not you and I [25:10.600 --> 25:16.600] The fact that you have a license does not bind you to the transportation code [25:16.600 --> 25:36.600] Because you must be actively making use of that license under the auspices of the regulable activity to which the license applies before you are subject to the associated rules and regulations that go with it [25:36.600 --> 25:41.600] You can't get around that fact [25:41.600 --> 25:51.600] If that were not the case then everybody that goes fishing would still have to have a commercial fisherman's license whether they're selling the fish or not [25:51.600 --> 26:02.600] Whether they're fishing in a private pond or in a public place, they would still have to have the license because the state would simply say if you're going to fish you must get a license [26:02.600 --> 26:07.600] We don't care where you're fishing but they can't do that can they? license, registration, proof of finance, responsibility, none of that [34:33.600 --> 34:35.600] And with good cause [34:35.600 --> 34:37.600] Because the moment you produce those things [34:37.600 --> 34:41.600] You are admitting that transportation is involved [34:41.600 --> 34:45.600] The regulable commercial activity is involved [34:45.600 --> 34:49.600] That is exactly why we don't produce [34:49.600 --> 34:52.600] Plus the fact that it's a violation of your rights [34:52.600 --> 34:56.600] Not to provide information that can be used against you in a court of law [34:56.600 --> 34:59.600] For them to tell you you must do it [34:59.600 --> 35:01.600] Now, the reason I bring that up is because [35:01.600 --> 35:04.600] Every single one of these guys that talked to her [35:04.600 --> 35:08.600] Kept saying the same dumb thing [35:08.600 --> 35:14.600] Texas law requires you to produce the license on demand under 521.025 [35:14.600 --> 35:16.600] Now, she had me on the phone [35:16.600 --> 35:19.600] She had told them that she had her legal counsel on the phone [35:19.600 --> 35:22.600] They kept trying to refer to me as an attorney [35:22.600 --> 35:25.600] She kept referring to me as legal counsel [35:25.600 --> 35:28.600] And when they would say stuff like that [35:28.600 --> 35:30.600] My first response back to her [35:30.600 --> 35:32.600] And thank God she did listen to me [35:32.600 --> 35:35.600] And she repeated almost verbatim what I told her [35:35.600 --> 35:39.600] But the response to that statement is always this [35:39.600 --> 35:49.600] No law can require me to waive a protected right to exercise another or a privilege [35:49.600 --> 35:54.600] 521.025 notwithstanding [35:54.600 --> 35:56.600] I cannot [35:56.600 --> 35:58.600] That's just a simple explanation [35:58.600 --> 36:02.600] You cannot be compelled to waive a right to exercise a right [36:02.600 --> 36:04.600] Or to exercise a privilege [36:04.600 --> 36:08.600] And for them to insist that the statute could compel you to give them information [36:08.600 --> 36:12.600] That they can use to further charge you [36:12.600 --> 36:15.600] Or use against you in a court of law [36:15.600 --> 36:16.600] Is asinine [36:16.600 --> 36:18.600] It's idiocy [36:18.600 --> 36:26.600] It shows a complete lack of understanding of what a fundamentally protected right is [36:26.600 --> 36:32.600] And any judge that says otherwise is a moron [36:32.600 --> 36:34.600] That's simple [36:34.600 --> 36:37.600] Now, they kept repeating this over and over [36:37.600 --> 36:42.600] She kept repeating exactly that back to them [36:42.600 --> 36:45.600] They were threatening her with all kinds of things [36:45.600 --> 36:50.600] Finally, they decided they were going to just have her sign the ticket and let her go [36:50.600 --> 36:54.600] So they gave her the electronic pad and she handed it right back to them [36:54.600 --> 36:56.600] And said, I cannot sign the pad [36:56.600 --> 37:01.600] If you print out the ticket where I can read the paper copy, I will sign the paper copy [37:01.600 --> 37:05.600] But I cannot and will not sign your electronic pad [37:05.600 --> 37:07.600] Well, they kept insisting she had to sign the pad [37:07.600 --> 37:10.600] And she says, no, I will not sign the pad [37:10.600 --> 37:15.600] I will sign the paper ticket after I read it, but I cannot and will not sign your pad [37:15.600 --> 37:19.600] And to my knowledge, she did not [37:19.600 --> 37:25.600] However, this is where they tried to get tricky-dicky [37:25.600 --> 37:29.600] When they handed her the electronic pad, she only rolled her window down far enough [37:29.600 --> 37:33.600] In all cases for them to get that pad through there [37:33.600 --> 37:35.600] Don't ever roll your window all the way down [37:35.600 --> 37:40.600] No matter what they tell you, don't do it, that is stupid, don't do it [37:40.600 --> 37:44.600] They will then use that as the excuse to stick their whole face in your car [37:44.600 --> 37:50.600] And suddenly say they smell marijuana or alcohol, even though it's a complete fabrication [37:50.600 --> 37:54.600] Don't give them the opportunity [37:54.600 --> 37:59.600] And again, I bring that up because guess what they did [37:59.600 --> 38:05.600] When she turned around to hand them back the electronic pad through the slot of her window [38:05.600 --> 38:09.600] One of the officers stuck his face up to the crack [38:09.600 --> 38:16.600] And then tried to insinuate with this statement that he had smelled alcohol on her breath [38:16.600 --> 38:21.600] Ma'am, when you leaned over here to hand me back that pad and spoke, I smelled alcohol on your breath [38:21.600 --> 38:24.600] So I'm about to ask you to step out of the car [38:24.600 --> 38:30.600] This caught her completely by surprise because this was an obvious fabrication on the part of the officer [38:30.600 --> 38:34.600] It was a complete and total lie [38:34.600 --> 38:39.600] And if you're not prepared and expecting it, it will fluster you [38:39.600 --> 38:41.600] Because let's look at what that does [38:41.600 --> 38:44.600] He makes a false statement [38:44.600 --> 38:46.600] He says it out loud [38:46.600 --> 38:49.600] His video and audio pick it up [38:49.600 --> 38:57.600] If this gets shown to a jury, the jury's mindset is because the officer uttered it, it is true [38:57.600 --> 39:03.600] The person must have been drinking before they got pulled over [39:03.600 --> 39:11.600] That is the scenario he is attempting to create by verbalizing this lie [39:11.600 --> 39:16.600] Now had I not been on the phone, I don't know how she would have handled that [39:16.600 --> 39:24.600] But since I was, my immediate response to her and again, she listened to me and repeated this perfectly [39:24.600 --> 39:28.600] Officer, and she used his name [39:28.600 --> 39:37.600] Are you attempting to fabricate probable cause at this time with that lie? [39:37.600 --> 39:48.600] See what we just did? We destroyed his illusion of truth by countering it with an equal truth [39:48.600 --> 39:54.600] And now his insinuation is dead where it stands [39:54.600 --> 40:01.600] We axed it right between the eyes before it ever got forward momentum [40:01.600 --> 40:03.600] He tried to salvage it [40:03.600 --> 40:14.600] Ma'am, I told you I smelled alcohol. Officer, are you attempting to fabricate probable cause at this time? [40:14.600 --> 40:17.600] He didn't know what the hell to do with that [40:17.600 --> 40:22.600] He tried this two or three times, she said the same thing back to him every time [40:22.600 --> 40:25.600] Finally he goes, ma'am, I'll be right back [40:25.600 --> 40:28.600] Because he didn't know what the hell to do at this point [40:28.600 --> 40:39.600] His ruse didn't work, his attempt to make her stumble and give him probable cause didn't work [40:39.600 --> 40:48.600] And she saved herself by listening and by doing [40:48.600 --> 40:55.600] And what she did was she protected her rights [40:55.600 --> 41:04.600] Now this officer then went over and tried to get the other officers including the supervisor to support him in this allegation [41:04.600 --> 41:13.600] At one point the supervisor even came back to the window and said, ma'am, the officer said that he smelled alcohol on your breath [41:13.600 --> 41:18.600] So he has a reasonable suspicion that you're impaired [41:18.600 --> 41:28.600] And she responded, the officer fabricated a lie in order to get probable cause to escalate this to a DUI stop [41:28.600 --> 41:31.600] That's what I told her to say and that's what she said [41:31.600 --> 41:37.600] He is attempting to fabricate probable cause so he can try and make this into a DUI stop [41:37.600 --> 41:45.600] And folks, you need to understand, every single traffic stop is aimed at doing one of two things and one of two things only [41:45.600 --> 41:53.600] Every cop out there is attempting to escalate every single traffic stop to a DUI or drug enforcement stop [41:53.600 --> 41:58.600] Every last one of them, do not kid yourself otherwise [41:58.600 --> 42:05.600] Why do you think they ask you, do you have any drugs, alcohol or weapons in the car? [42:05.600 --> 42:09.600] Why do you think they're asking these questions? [42:09.600 --> 42:22.600] They're attempting to get you to answer in a way that will allow them to establish probable cause on their little recording so that whatever they do next is justified [42:22.600 --> 42:27.600] Stop answering their questions [42:27.600 --> 42:33.600] You have the right to remain silent, use it [42:33.600 --> 42:38.600] That's what it's there for [42:38.600 --> 42:48.600] When you open your mouth and engage in conversation and answer these questions, you are putting a noose around your own neck [42:48.600 --> 42:56.600] All that's left for you to do is to hop up and down on the trap door till it drops out from under you or take a fly and leap over the railing [42:56.600 --> 43:01.600] But it doesn't matter if the rope is around your neck when you do it [43:01.600 --> 43:04.600] Stop helping them put it there [43:04.600 --> 43:10.600] For a love of God, stop helping them put it there [43:10.600 --> 43:13.600] She did perfect [43:13.600 --> 43:20.600] Every time they made this idiotic assertion, she countered it with that negative assertion [43:20.600 --> 43:24.600] Then they came back and tried to redirect it [43:24.600 --> 43:33.600] Ma'am, I can't let you go until you give me your license. They kept trying to redirect this down some other path, and the one they chose next was [46:42.600 --> 46:55.600] We need to make sure that you're not impaired, so I need you to give me your license and step out of the car so that we can make the determination that you're not impaired [46:55.600 --> 47:02.600] And again, her response, are you attempting to fabricate probable cause at this time? [47:02.600 --> 47:11.600] He says, well I suspect that you've been drinking, so my response to her was what to say is [47:11.600 --> 47:17.600] Your suspicion does not equate to probable cause [47:17.600 --> 47:24.600] Are you attempting to fabricate probable cause at this time? [47:24.600 --> 47:33.600] If you have no evidence supporting your suspicion, you don't have probable cause [47:33.600 --> 47:41.600] Are you attempting to fabricate probable cause at this time? [47:41.600 --> 47:50.600] Again, this guy didn't know how to deal with this. So again, I hear, ma'am, I'll be right back [47:50.600 --> 47:56.600] Well, they try to do this again, just like they did with the alcohol comment. They tried to do this several times [47:56.600 --> 48:01.600] And out of these several times, she maintained everything [48:01.600 --> 48:15.600] Now, be aware that these four officers had laid down tire strips in front of her car so that she couldn't leave as if she would even try with four armed police officers there [48:15.600 --> 48:23.600] She's not going to try to take off, but they put puncture strips down in front of her car anyway and blocked her in from the rear [48:23.600 --> 48:31.600] Now get this, when they handed her the citation pad and asked her to sign it and she did so [48:31.600 --> 48:36.600] The stop was over, it was done [48:36.600 --> 48:46.600] And they refused to give her a copy of the signed citation and her IDs back [48:46.600 --> 48:53.600] Because this officer had then attempted to fabricate the DUI [48:53.600 --> 49:01.600] At this point, they are absolutely in violation of her rights [49:01.600 --> 49:14.600] They had no more probable cause to detain her, the traffic stop itself had concluded, and they held her for another 40 plus minutes anyway [49:14.600 --> 49:20.600] Trying to escalate this from a simple traffic stop to a DUI [49:20.600 --> 49:28.600] That was a mistake, you uniformed retarded morons [49:28.600 --> 49:32.600] That was a mistake [49:32.600 --> 49:42.600] Now she's got you for false imprisonment, no question, there is a mile high stack of Texas case law on that fact [49:42.600 --> 49:46.600] You're done [49:46.600 --> 49:56.600] She didn't surrender her rights, she invoked them, she protected them, she demanded that they be respected [49:56.600 --> 50:00.600] Will this work in every case? There's no way to know that [50:00.600 --> 50:08.600] How well this works depends entirely on the attitude and demeanor of the officer you encounter and every one of them is different [50:08.600 --> 50:14.600] Some are bigger egotistical morons than others, some are more control freaks than others [50:14.600 --> 50:19.600] Some have testosterone levels higher than the hair on their head count [50:19.600 --> 50:26.600] Okay, there's no telling whether this will work in every given case or not [50:26.600 --> 50:32.600] There's no way to know that, but I can tell you one thing [50:32.600 --> 50:43.600] In every single case where you waive your right, you've lost it permanently, you will never get it back again [50:43.600 --> 50:49.600] You cannot reinvoke it later if you waived it right now [50:49.600 --> 50:58.600] And if you don't understand that, then you're going to be in a much worse position when you start dealing with these people face to face [50:58.600 --> 51:01.600] So keep that in mind [51:01.600 --> 51:05.600] She did an excellent, wonderful job [51:05.600 --> 51:18.600] You know what the irony of this whole situation is? It took a young woman from a communist country to come to America [51:18.600 --> 51:24.600] Where we call this the land of the free and the home of the brave [51:24.600 --> 51:31.600] To learn how to have rights and use those rights to protect herself [51:31.600 --> 51:37.600] Now all the Americans that I know with the very few exceptions [51:37.600 --> 51:47.600] Willingly give them up to avoid the potential discomfort and inconvenience of going to jail for a short time [51:47.600 --> 51:50.600] And this is not the first time that this has happened to her [51:50.600 --> 51:56.600] Last time the DPS trooper fabricated a DUI and took her to jail [51:56.600 --> 52:03.600] Then when she got there she demanded a breathalyzer test and blew 000 [52:03.600 --> 52:15.600] Now the DPS officer has to go find some other charge after the fact and had to go conspire with the judge in the jail to find one [52:15.600 --> 52:25.600] But that's not going to save him from the false imprisonment and everything else that he did when he arrested her [52:25.600 --> 52:30.600] There's no question he committed a crime by what he did [52:30.600 --> 52:37.600] There's no question that she has done everything right to protect herself and prevent them from doing what they did [52:37.600 --> 52:40.600] And they chose to violate her rights anyway [52:40.600 --> 52:44.600] But remember, she's not even an American [52:44.600 --> 52:47.600] I mean she's a US citizen now, she got her citizenship [52:47.600 --> 52:50.600] She wasn't born under the beliefs that we have [52:50.600 --> 52:57.600] She's from a place where to do what she did here would never fly [52:57.600 --> 53:07.600] And yet she's here doing it better than most of you out there are because she's sick and tired of them getting away with what they're getting away with [53:07.600 --> 53:11.600] Why aren't we? Why aren't you? [54:39.600 --> 54:43.600] Correct, you don't give them any of the accouterments associated with that [54:43.600 --> 54:48.600] License, registration, proof of financial responsibility, you give them any of those things [54:48.600 --> 54:53.600] You're admitting that the rules and regulations governing that apply [54:53.600 --> 54:56.600] Therefore, it's transportation [54:56.600 --> 54:59.600] Real quick question [54:59.600 --> 55:05.600] Officer says you don't show your license in a ticket to jail, what's your proper response to that? [55:05.600 --> 55:10.600] Well, we've already set them up for that in the transportation script where we say officer [55:10.600 --> 55:18.600] Since I am, it is my opinion of this situation that I am not free to leave and therefore I'm in a custodial arrest [55:18.600 --> 55:24.600] Therefore, I am invoking my right to remain silent and my right to assistance of counsel [55:24.600 --> 55:29.600] Now at that point, they're required to stop what they're doing and they don't [55:29.600 --> 55:37.600] They try to force you to wave your right so that their butt is covered for demanding that you give them this information [55:37.600 --> 55:42.600] The moment you give it to them, you've waived that protection, period [55:42.600 --> 55:43.600] Okay [55:43.600 --> 55:53.600] Now, they cannot force you to give them information that can be used against you or can be used to further charge you [55:53.600 --> 55:58.600] And there's no question they can do that with any of these pieces of information [55:58.600 --> 56:02.600] No question whatsoever [56:02.600 --> 56:04.600] Okay [56:04.600 --> 56:08.600] So why would you waive your right and give them that chance? [56:08.600 --> 56:11.600] Oh, I agree, 100% [56:11.600 --> 56:17.600] Also, I was talking with Steve Hemsley for Enterprise Society, he's a good guy out there in California [56:17.600 --> 56:21.600] He deals with different rights to travel issues and different things [56:21.600 --> 56:26.600] He was saying the case law, and I think he may be talking more about California [56:26.600 --> 56:36.600] But he said in all the case law that he researched, not one of the cases ever talked about the need for a state, for a government [56:36.600 --> 56:46.600] I think the government issued ID, it just said ID, it could be issued privately or from any ID would work [56:46.600 --> 56:51.600] But never did it demand that it was supposed to be a government issued ID [56:51.600 --> 56:54.600] Which goes along with what you're saying [56:54.600 --> 57:02.600] Well, the thing is, is that you only have to have that ID to access certain privileged activities [57:02.600 --> 57:07.600] There's nothing that would require you to have it for day to day life [57:07.600 --> 57:13.600] And they certainly cannot create a law that requires you to get state branded [57:13.600 --> 57:16.600] Doesn't matter what form it is [57:16.600 --> 57:21.600] Now, I answered you are required, you do at least have to give them your data, is that correct? [57:21.600 --> 57:26.600] The law does require that you provide them with three pieces of information [57:26.600 --> 57:29.600] Name, address, and date of birth [57:29.600 --> 57:37.600] But there is absolutely nothing in that law that says it has to be anything other than verbally delivered [57:37.600 --> 57:43.600] Nothing says it has to be given via a physical form of ID [57:43.600 --> 57:45.600] So it can be verbal? Tyler, let's continue, please [01:03:43.600 --> 01:03:47.600] Alright, Eddie, I'll try to make this quick, I know you've got other callers [01:03:47.600 --> 01:03:54.600] I was issued a traffic citation for, I guess it was called, not having the right way clear [01:03:54.600 --> 01:04:00.600] that it stopped time and it caused an accident. I was in a moon van, a first-home private moon van [01:04:00.600 --> 01:04:07.600] and the lady had come and hit me, she went to signal when she hit me, it was actually her fault, but the officer said I had the [01:04:07.600 --> 01:04:12.600] toll sign stuck, I went to court, I went to three or four different hearings [01:04:12.600 --> 01:04:21.600] and I just kind of extended it, continued it, just said, well, I need to talk to the council, I'm not going to make a plea, I don't understand my rights, you know, just kind of [01:04:21.600 --> 01:04:25.600] that's what I knew to do the first couple, three times, just to buy some time [01:04:25.600 --> 01:04:36.600] and then on the last hearing, the fourth one, I filed an affidavit, special appearance, never signed my rights away or any kind of statement [01:04:36.600 --> 01:04:45.600] except in the first hearing, the judge got a trip, he said you need to sign just, that just shows you're here, so that just shows I'm here, yes [01:04:45.600 --> 01:04:53.600] and I got a trip there, but I had four different hearings so I think that might apply to four different circumstances, I'm not sure [01:04:53.600 --> 01:05:00.600] but anyway, I presented a special appearance to affidavit, the right to travel, basically [01:05:00.600 --> 01:05:05.600] invoking that they did not have jurisdiction to write the ticket and it needed answered [01:05:05.600 --> 01:05:13.600] and the judge had just handed me the affidavit back because he noticed a couple of mistakes on it, I think I titled it more wrong, I said [01:05:13.600 --> 01:05:21.600] it was the court that he municipal and the reason he did that I think now is because he didn't want in his possession so he could put a warrant out [01:05:21.600 --> 01:05:29.600] when I didn't pay the bond, I wasn't going to pay the appearance bond because I, as I told him, it's against the Fifth Amendment [01:05:29.600 --> 01:05:40.600] so I'm deprived of that property which is my money before due process and then I also said that you need to answer my affidavit before I could do that [01:05:40.600 --> 01:05:47.600] and he said, well I'm telling you, you need to put the bond down, well he issued the warrant, so my thing is what should I do? [01:05:47.600 --> 01:05:53.600] Did you look into what a surety bond requires in Wyoming? [01:05:53.600 --> 01:06:03.600] I'm looking at that now, I just ordered the rules of criminal procedure and all that and I'm starting to read about bonds [01:06:03.600 --> 01:06:10.600] the surety bond is how you make it where they cannot take your property before you've been convicted [01:06:10.600 --> 01:06:21.600] normally they cannot, in Texas for sure they can't, they cannot deny you the ability to get a surety bond in lieu of giving them actual money [01:06:21.600 --> 01:06:28.600] because to deprive you of cash is to make you pay before you've been convicted [01:06:28.600 --> 01:06:33.600] Right, Dan could you explain the surety bond a little bit? [01:06:33.600 --> 01:06:42.600] A surety bond here in Texas is nothing more than a promise to pay signed by two people capable of meeting the bond amount [01:06:42.600 --> 01:06:49.600] they basically promise to stand in your place and pay the bond if you fail to appear [01:06:49.600 --> 01:06:51.600] Okay [01:06:51.600 --> 01:06:59.600] and all that really is, is a promise to pay signed by two people in front of a notary [01:06:59.600 --> 01:07:10.600] that they have the means to pay the bond and that they are willing to do so if you fail to appear or settle yourself [01:07:10.600 --> 01:07:13.600] That is something that I would send the judge [01:07:13.600 --> 01:07:18.600] Yeah, you'd file it in the court just like you would any other document [01:07:18.600 --> 01:07:22.600] Is it called, would it be like a notice of surety bonds? Is that what you would title it or? [01:07:22.600 --> 01:07:26.600] No, it would be titled surety bond [01:07:26.600 --> 01:07:27.600] Okay [01:07:27.600 --> 01:07:30.600] And basically it's an affidavit [01:07:30.600 --> 01:07:34.600] Okay, saying that these two witnesses, whoever they are will pay the money [01:07:34.600 --> 01:07:38.600] No, these two sureties, not witnesses, surety [01:07:38.600 --> 01:07:40.600] Sureties, okay [01:07:40.600 --> 01:07:45.600] But you need to look and see what the rules in Wyoming are governing surety bonds [01:07:45.600 --> 01:07:47.600] Surety bonds, okay [01:07:47.600 --> 01:07:56.600] Good idea, but doesn't he have a judicial responsibility to answer that affidavit before he even sets it? [01:07:56.600 --> 01:08:01.600] No, he, the court has no responsibility to answer anything [01:08:01.600 --> 01:08:06.600] That's the prosecution's responsibility, not the court's [01:08:06.600 --> 01:08:12.600] The court cannot be the prosecutor and the trier of fact [01:08:12.600 --> 01:08:15.600] That's a conflict, huh? [01:08:15.600 --> 01:08:19.600] There is no prosecutor in these traffic courts in Wyoming [01:08:19.600 --> 01:08:22.600] Then it's an administrative proceeding and you shouldn't be there to begin with [01:08:22.600 --> 01:08:27.600] Because they can't conduct a criminal proceeding absent a prosecutor [01:08:27.600 --> 01:08:29.600] And that's true [01:08:29.600 --> 01:08:34.600] I'm trying to find the rule that talks about that in the court rules [01:08:34.600 --> 01:08:38.600] If that's the case where only the judge is there and you didn't ask for a bench trial [01:08:38.600 --> 01:08:42.600] and there's still not a prosecutor, even in a bench trial there has to be [01:08:42.600 --> 01:08:46.600] Then the court is acting both as the trier of fact and the prosecution [01:08:46.600 --> 01:08:48.600] That's a direct conflict of interest [01:08:48.600 --> 01:08:53.600] They can do that in an administrative hearing because you agreed to participate [01:08:53.600 --> 01:08:56.600] But they can't do it in a criminal case [01:08:56.600 --> 01:09:00.600] And if in Wyoming you need to find out, if this is being handled as a criminal case [01:09:00.600 --> 01:09:04.600] Then that's absolutely a deprivation of the right of due process [01:09:04.600 --> 01:09:10.600] Right, you said there are the trier of facts and prosecution [01:09:10.600 --> 01:09:12.600] Correct [01:09:12.600 --> 01:09:15.600] The trier of fact is the court [01:09:15.600 --> 01:09:20.600] Right, right, then it can't be both the prior of fact and the prosecutor [01:09:20.600 --> 01:09:25.600] That's correct, it's a conflict of interest because you have the prosecution presenting evidence [01:09:25.600 --> 01:09:29.600] and the court ruling on whether or not the evidence is valid and applicable [01:09:29.600 --> 01:09:31.600] It's a conflict of interest [01:09:31.600 --> 01:09:38.600] The judge presents the evidence as he sees it, then he makes the ruling that his evidence is all he needs [01:09:38.600 --> 01:09:40.600] You don't see a problem with that? [01:09:40.600 --> 01:09:41.600] Oh, I do, yes [01:09:41.600 --> 01:09:45.600] Yeah, well, so should anybody work their salt as a judge [01:09:45.600 --> 01:09:51.600] Do I file a notice of fixed misconduct because of this? [01:09:51.600 --> 01:09:56.600] You can file, well again, you have to look at the rules for Wyoming [01:09:56.600 --> 01:10:00.600] But you can demand that he be disqualified or recused [01:10:00.600 --> 01:10:05.600] Or you can demand that he not be allowed to proceed without a proper prosecutor [01:10:05.600 --> 01:10:08.600] In this case because he can't be both [01:10:08.600 --> 01:10:11.600] Yeah, yeah [01:10:11.600 --> 01:10:13.600] Alright, now what would that [01:10:13.600 --> 01:10:19.600] And if they're going to insist, then file a motion to dismiss, lack of jurisdiction, the court can't be both [01:10:19.600 --> 01:10:22.600] What would the first motion be titled when you're talking about it? [01:10:22.600 --> 01:10:27.600] Again, that all depends on what the rules of the courts are in Wyoming [01:10:27.600 --> 01:10:30.600] So I don't have a pet answer for that [01:10:30.600 --> 01:10:32.600] Yeah, I have trouble finding all that stuff [01:10:32.600 --> 01:10:36.600] Here you have what we would call a motion to disqualify or recuse [01:10:36.600 --> 01:10:42.600] Which is specifically aimed at the judge because of violations of rights, law, and judicial canons [01:10:42.600 --> 01:10:51.600] And then you have the motion to dismiss because a judge that's disqualified or acting in violation of your rights has already lost jurisdiction [01:10:51.600 --> 01:10:56.600] And if he's lost jurisdiction, the only thing he can do is dismiss [01:10:56.600 --> 01:10:59.600] Hmm, when he violates the rights [01:10:59.600 --> 01:11:06.600] Yes, that's why we never have to go to marriage because there's too many due process violations to argue against [01:11:06.600 --> 01:11:15.600] Okay, yeah, and I understand that would lose jurisdiction, but how do you prove that? [01:11:15.600 --> 01:11:17.600] That they lose jurisdiction [01:11:17.600 --> 01:11:21.600] You prove they violated rights and their duty under the law [01:11:21.600 --> 01:11:22.600] That's not hard to do [01:11:22.600 --> 01:11:29.600] If the law says they have to do A, B, and C and they didn't do A, B, or C, then they violated the law [01:11:29.600 --> 01:11:36.600] And if the impact of that violation is to deprive you of a protected right, they lost jurisdiction [01:11:36.600 --> 01:11:38.600] And the only thing to... [01:11:38.600 --> 01:11:43.600] The only way around that is if they tricked you into waving their error [01:11:43.600 --> 01:11:46.600] Okay, great [01:11:46.600 --> 01:11:48.600] All right, I'll start with that [01:11:48.600 --> 01:11:54.600] One of their last real quick question, I have an affidavit here, I had another situation [01:11:54.600 --> 01:12:00.600] It was a self-fence issue turned to the battery, the officer arrested me, he wrote up an affidavit [01:12:00.600 --> 01:12:03.600] But it was not notarized [01:12:03.600 --> 01:12:05.600] Then it's not an affidavit [01:12:05.600 --> 01:12:12.600] If it's not sworn to in front of somebody capable of administering oaths under the laws of the state, it's not an affidavit [01:12:12.600 --> 01:12:15.600] Can I use that in my motion to dismiss? [01:12:15.600 --> 01:12:21.600] Absolutely, it's an unverified, unsworn affidavit, therefore it has no force and effect in law [01:12:21.600 --> 01:12:26.600] I don't know where that rule would be, though, would that be into the rules of evidence? [01:12:26.600 --> 01:12:30.600] No, it's not sworn to [01:12:30.600 --> 01:12:37.600] The court cannot take anything into consideration that isn't properly introduced as evidence [01:12:37.600 --> 01:12:42.600] And an unsworn affidavit is never evidence of anything [01:12:42.600 --> 01:12:45.600] But yeah, I understand it, but what I'm asking is, is there a rule? [01:14:23.600 --> 01:14:30.600] No, and that's 1406, I don't know whether you read it correctly to my call screener or he mistyped it to me [01:14:30.600 --> 01:14:35.600] I wrote down the wrong number because I've been looking up for the last few days and I'm really tired [01:14:35.600 --> 01:14:49.600] Yeah, it's 1406A, the 48 hours that that speaks to does not grant an automatic amount of time to officers to just throw you in jail [01:14:49.600 --> 01:14:59.600] The requirement of that 48 hour period ties hand in hand with the necessity of a proper magistrate making a determination of probable cause [01:14:59.600 --> 01:15:12.600] The requirement of due process is that an officer making an arrest without a warrant barring any good reason for not delivering you before a magistrate [01:15:12.600 --> 01:15:25.600] And good reason is something such as a natural disaster, a public hazard, invasion, declaration of war, or anything of that nature [01:15:25.600 --> 01:15:39.600] Those are the reasons why they have up to 48 hours, just because they're lazy or stupid is not a reason to avoid taking you before a magistrate within that 48 hours [01:15:39.600 --> 01:15:48.600] The rules in Texas are that 48 hour period is the time that the magistrate has to write an order of probable cause [01:15:48.600 --> 01:15:56.600] If they don't do that within 48 hours, the statute is very clear that they are to release the accused from custody [01:15:56.600 --> 01:16:00.600] Absent that probable cause determination order [01:16:00.600 --> 01:16:09.600] That's why the officer has no authority to throw you in jail on his own volition, absent those prerequisites I mentioned [01:16:09.600 --> 01:16:21.600] He has to take you to a magistrate immediately so the magistrate can get a determination of probable cause and issue a proper commitment order to hold you in jail [01:16:21.600 --> 01:16:31.600] Otherwise, the officer is imprisoning you based entirely on his own authority, which he doesn't have [01:16:31.600 --> 01:16:33.600] That's the problem [01:16:33.600 --> 01:16:38.600] So hang on Raymond and I'll see if I can't finish up any other part of your question on the other side, okay? [01:23:19.600 --> 01:23:21.600] Okay, did [01:23:21.600 --> 01:23:25.600] So obviously they didn't seize it for evidence, did they? [01:23:25.600 --> 01:23:27.600] Not that I'm aware of [01:23:27.600 --> 01:23:30.600] Okay, then on what grounds did they take the property? [01:23:30.600 --> 01:23:44.600] Well, they took it because they had stopped it for speeding and then she gave them permission to start the car and they found some illegal weed [01:23:44.600 --> 01:23:46.600] Contraband? [01:23:46.600 --> 01:23:47.600] Huh? [01:23:47.600 --> 01:23:49.600] Contraband? [01:23:49.600 --> 01:23:53.600] No, they are arrested with control substance [01:23:53.600 --> 01:23:55.600] Okay [01:23:55.600 --> 01:24:05.600] And so one of the police and they were, they were detectives took the car, got him through the car and I'm not gonna say drive, but he drove it over to the police station [01:24:05.600 --> 01:24:09.600] And they kept it there because she invoked her right there, she wanted a lawyer [01:24:09.600 --> 01:24:12.600] Okay, well the problem is she already screwed up [01:24:12.600 --> 01:24:17.600] The moment she gave them permission to search the car, she was done [01:24:17.600 --> 01:24:20.600] This is exactly what I was talking about earlier [01:24:20.600 --> 01:24:24.600] Stop giving these people permission to screw you over [01:24:24.600 --> 01:24:27.600] Yes, I understand that, okay [01:24:27.600 --> 01:24:28.600] Okay [01:24:28.600 --> 01:24:33.600] I told her that anyway, and I told her we had no legal records against the car being taken, right? She says you want to get an attorney [01:25:50.600 --> 01:25:54.600] The attorney's not going to do it, he's never going to do it for her [01:25:54.600 --> 01:25:55.600] Okay, so [01:25:55.600 --> 01:25:58.600] He's going to take your money and do nothing [01:25:58.600 --> 01:26:00.600] Okay, so she has to do it, right? It just has a vehicle description, so I figured I'd jump in here because I'm a lot more fed on the stuff that my brother is [01:41:13.600 --> 01:41:27.600] So it says administrative civil parking violation notice. It says that failure to appear is an admission of liability, so it's absolutely administrative here [01:41:27.600 --> 01:41:32.600] Oh yeah, no question. All parking tickets in Texas are [01:41:32.600 --> 01:41:42.600] Right, right. So I was going to go down there because it does have, you know, it's about a foot long and about 11 inches of it is how you can pay the fine in different ways [01:41:42.600 --> 01:41:47.600] And even though we're in South Texas, the fee is to be remitted to California [01:41:47.600 --> 01:41:54.600] But it does have an address here for appearing in person [01:41:54.600 --> 01:42:05.600] Okay, well I can help you with this real quick. I've got one of the students in my class that is fighting parking tickets on a regular basis here in Austin and seems to be doing pretty well with it [01:42:05.600 --> 01:42:17.600] He has paperwork that he's given to me to review. Right there in the beginning, I think it's 12.3, it specifically states that all traffic regulations apply to government-owned and operated vehicles [01:43:38.600 --> 01:43:42.600] That's all they apply to. It's the only thing listed there [01:43:42.600 --> 01:43:51.600] So you might want to check the city ordinance to see who is subject to traffic regulations in the particular city where this was issued as well, because I know that's part of his paperwork [01:43:51.600 --> 01:43:59.600] But hang on, Jason, and we'll finish this up on the other side. Just another one of these little concepts of law, these uniform morons fell to understand [01:47:22.600 --> 01:47:32.600] Yeah, there's two elements to that. The defendant was actually notified of the provisions of the ordinance and two, after the defendant received notice of the ordinance, the defendant committed action violation [01:47:32.600 --> 01:47:41.600] They're going to say that notice was the fact that they published the ordinance, and you had the opportunity to read it. That's how they're going to say you were noticed [01:47:41.600 --> 01:47:43.600] Yeah, let's see [01:47:43.600 --> 01:47:54.600] But again, in that particular case, a defendant can only be someone that's associated with real property that is subject to the ordinance [01:47:54.600 --> 01:47:56.600] Right [01:47:56.600 --> 01:47:57.600] You follow? [01:47:57.600 --> 01:47:59.600] Sure, sure, I got you [01:47:59.600 --> 01:48:09.600] And being that this is an administrative hearing, when I say that your perspective on a traffic ticket is an administrative hearing [01:48:09.600 --> 01:48:18.600] Well, of course it's an administrative hearing. A traffic ticket, whether they like it or not, Texas law makes it very clear that tickets are administrative [01:48:18.600 --> 01:48:30.600] They can't be criminal because in the case of a transportation citation, those are issued under the authority of the DPS who has their own title, Title 37 in the administrative code [01:48:30.600 --> 01:48:38.600] The only agencies in the administrative code are state administrative agencies. Therefore, everything they do by default is administrative [01:48:38.600 --> 01:48:51.600] Right, so that being the case, then notice the special appearance, the objection to a non-judicial proceeding, a motion to dismiss for lack of subject matter jurisdiction, all that applies to this scenario, right? [01:50:48.600 --> 01:50:51.600] And he said, I can't give you a ride, but I can call a tow truck [01:50:51.600 --> 01:50:54.600] And she said, no, don't call a tow truck, he's going to take care of that [01:50:54.600 --> 01:50:59.600] And he said, you know, I can't really help you, so... [01:50:59.600 --> 01:51:02.600] I went there, I picked her up [01:51:02.600 --> 01:51:09.600] The car was parked on the side of the road, there was no signs or anything that indicated the park there or anything like that [01:51:09.600 --> 01:51:18.600] So the next day, maybe 18 hours later, I went to pick the car up and the car wasn't there [01:51:18.600 --> 01:51:26.600] So I went to the police station and asked if they took my car, and they indicated that they took the car [01:51:26.600 --> 01:51:35.600] The same police officer that was there the night before came the next day and decided that he should tow the car [01:51:35.600 --> 01:51:37.600] Based on what? [01:51:37.600 --> 01:51:41.600] That it was a menace to traffic [01:51:41.600 --> 01:51:46.600] So I guess it was a menace to traffic 18 hours later in the same place, it was a menace to traffic 18... [01:51:46.600 --> 01:51:52.600] What do the statutes say about cars left parked on the side of the roadways in Connecticut? [01:51:52.600 --> 01:51:58.600] Dan, if you're out there listening, you send me an email too, and Mike, you send me one, and I'll hook you up with Dan in Connecticut [01:51:58.600 --> 01:52:07.600] I know Dan, but it's not very specific, it says that if the police officer determines that the car is in the menace to traffic [01:52:07.600 --> 01:52:13.600] Then they're authorized to tow it and put it in a storage facility, you know, whichever [01:52:13.600 --> 01:52:17.600] This is back in October, by the way [01:52:17.600 --> 01:52:22.600] And I noticed that the officer was intoxicated, but that's a separate issue [01:52:22.600 --> 01:52:28.600] But, you know, I indicated the car was stolen because they took it without a warrant [01:52:28.600 --> 01:52:37.600] And that the lieutenant or sergeant actually threatened me and said, well, you can make out a sworn statement and I'll have you arrested for perjury [01:52:37.600 --> 01:52:43.600] So I basically got thrown out of the police station because I was bringing up the fact that the officer was intoxicated [01:52:43.600 --> 01:52:46.600] Which I thought might impair his judgment [01:52:46.600 --> 01:52:56.600] But anyway, they're required to give you notice and an opportunity to be heard within 48 hours by certified mail, the police department did [01:52:56.600 --> 01:53:05.600] Well, I didn't get any notice, but I found out where the car was, so I went to the towing place and I asked to retrieve items out of the car and they denied me [01:53:05.600 --> 01:53:08.600] Which is against the law as well [01:53:08.600 --> 01:53:16.600] So I sent them a letter threatening letters stating that they're in possession of stolen property and, you know, this and that [01:53:16.600 --> 01:53:24.600] So I got a call from a police lieutenant who told me not to call the towing facility anymore [01:53:24.600 --> 01:53:29.600] And that the police were now in possession of the vehicle [01:53:29.600 --> 01:53:36.600] And if I wanted the vehicle back, I have to forward to them $182 [01:53:36.600 --> 01:53:43.600] They said that they assumed the charges from the towing facility [01:53:43.600 --> 01:53:48.600] Wait, wait, wait, repeat that part after the police are now in possession of the car [01:53:48.600 --> 01:54:00.600] The police are now in possession of the car and they assumed the towing charges for my vehicle and I am to pay the police department directly [01:54:00.600 --> 01:54:04.600] Is this a police impound yard that's holding it? [01:54:04.600 --> 01:54:12.600] It's, you know, it's the evidence lot because the police don't, they don't have a, like, they don't, they're not supposed to even have a car [01:54:12.600 --> 01:54:15.600] Like, they didn't ever do that, they put them in the towing facility [01:54:15.600 --> 01:54:22.600] Like, every time I went there, they were like, your car can't be here, we never take impounded cars to the police department [01:54:22.600 --> 01:54:27.600] But it's there, and I actually got items out of the car [01:54:27.600 --> 01:54:36.600] You know, so I got, you know, a letter stating that I had to pay them, but I never got, well, I shouldn't say never [01:54:36.600 --> 01:54:42.600] You know, two months later, it's supposed to be 40 hours, two months later I got my form to sell out to get a hearing [01:54:42.600 --> 01:54:49.600] Administrative hearing with somebody at the point by the marketing department [01:54:49.600 --> 01:54:55.600] So I sold it out and I sent it in, I had 10 days to send it in, and this was in the beginning of January [01:54:55.600 --> 01:55:02.600] And the statute says that they shall promptly hold a hearing after they receive this form [01:55:02.600 --> 01:55:11.600] So now it's, we're at the end of February, so it's almost two months and I haven't gotten this prompt hearing yet [01:55:11.600 --> 01:55:13.600] So I'm kind of like in a state of limbo [01:55:13.600 --> 01:55:20.600] There's no more, like, storage charges because the police have the car, they're not trying to charge me storage [01:55:20.600 --> 01:55:25.600] But, and I went there and the guy was, you know, the police officer asked me, when are you going to get this car out of here [01:55:25.600 --> 01:55:28.600] And I said, well, soon as you give me my hearing [01:55:28.600 --> 01:55:32.600] And he said, oh, I'm going to make sure that we expedite this hearing [01:55:32.600 --> 01:55:36.600] And this was like three weeks ago, and I haven't heard anything, so [01:55:36.600 --> 01:55:43.600] Okay, so they're attempting to run your cost up so that they can get money by delaying your hearing [01:55:43.600 --> 01:55:44.600] Basically, I mean [01:55:44.600 --> 01:55:48.600] Okay, then you need to file suit against them one for taking the car [01:55:48.600 --> 01:55:57.600] Two for holding it with the intentional point of delay in order to increase the amount of money they can get for it [01:55:57.600 --> 01:55:58.600] Okay [01:55:58.600 --> 01:56:02.600] Okay, they have no authority to take and hold the car [01:56:02.600 --> 01:56:09.600] They actually had no authority to pay the towing company either, that's not in the staff [01:56:09.600 --> 01:56:14.600] Not in order to take the car so they could ensure to increase the fees themselves, no [01:56:14.600 --> 01:56:18.600] It's a direct conflict of interest for them to even try to do that [01:56:18.600 --> 01:56:24.600] But then again, police agencies are nothing more than legal [01:56:24.600 --> 01:56:28.600] What do you want to call it, legalized highwaymen [01:56:28.600 --> 01:56:30.600] That's all they are [01:56:30.600 --> 01:56:31.600] Yeah [01:56:31.600 --> 01:56:38.600] Okay, they have by the wearing of that badge and that peace officer's license [01:56:38.600 --> 01:56:43.600] In every sense of the word being given letters of mark [01:56:43.600 --> 01:56:48.600] According to the information I have, only the Congress can grant letters of mark [01:56:48.600 --> 01:56:54.600] Not the state legislature, not the municipality or the county [01:56:54.600 --> 01:57:01.600] But that's what these guys have basically, letters of mark to operate on the highways as fricking pirates [01:57:01.600 --> 01:57:06.600] The city also gets a $35 fee for every impound, so [01:57:06.600 --> 01:57:11.600] Oh yeah, it's about revenue, there's no question of that [01:57:11.600 --> 01:57:16.600] It's funny because it's the same police officer that in the turn, you know, he was there the night before [01:57:16.600 --> 01:57:22.600] But, you know, 18 hours later, now it's the menace of traffic [01:57:22.600 --> 01:57:25.600] I thought that was funny [01:57:25.600 --> 01:57:30.600] So, do I sue in the state court, like we do?
