[00:56.600 --> 01:00.600] Obama accused Republicans of playing politics with national security during wartime and [01:00.600 --> 01:04.600] Democrats vowed to revive the nomination after Congress's week-long break. [01:04.600 --> 01:09.640] By 58-40, with one abstention, the Senate fell short of the 60-vote threshold required [01:09.640 --> 01:13.920] to advance Hagel's nomination to a final up-or-down vote on his confirmation. [01:13.920 --> 01:18.120] Four Republicans voted with Democrats to end debate and proceed to a final vote. [01:18.120 --> 01:21.920] A food fight quickly turned into a brawl involving hundreds of students at a Minneapolis high [01:21.920 --> 01:26.800] school on Thursday, forcing police to use chemical spray to break up the melee. [01:26.800 --> 01:30.240] Four people were taken to a hospital with minor injuries, including a staff member [01:30.240 --> 01:33.600] who was hidden ahead with a bottle according to the school and police. [01:56.040 --> 02:00.000] They will have 90 days to turn in their guns if the legislation is passed. [02:00.000 --> 02:03.640] According to the proposed law, in person who prior to the effective date of this law was [02:03.640 --> 02:08.280] legally in possession of an assault weapon or large capacity magazine shall have 90 days [02:08.280 --> 02:12.920] from such effective date to comply with the law without being subject to prosecution. [02:12.920 --> 02:18.720] Washington State Senator Ed Murray and James Cole Wells, as well as Adam Klein, all Democrats [02:18.720 --> 02:22.600] have introduced new gun control legislation that goes far above and beyond what anyone [02:22.600 --> 02:24.680] would consider a simple sales ban. [02:24.680 --> 02:30.760] The bill, SB 5737, proposes the banning the sale of assault weapons according to the legislation. [02:30.760 --> 02:35.600] An assault weapon is any semi-automatic pistol, pump-action rifle, or shotgun that can accept [02:35.600 --> 02:41.360] detachable magazines with the capacity to accept more than 10 rounds. [03:56.960 --> 04:05.240] Oh yeah, I filed on the January the 22nd, I filed a motion to remove fans for breach [04:05.240 --> 04:11.040] of fiduciary duty because of the money missing, and I put my inventory in and I had all supporting [04:11.040 --> 04:14.440] evidence with my inventory, I had all supporting evidence. [04:14.440 --> 04:17.840] Did you file criminally against him? [04:17.840 --> 04:24.600] No, what I did was I filed that in probate, why am I doing this because the judges have [04:24.600 --> 04:26.200] recused themselves, right? [04:26.200 --> 04:28.360] We've already talked about that. [04:28.360 --> 04:31.960] Now what I was getting ready to do was file a new motion, now that I've actually gotten [04:31.960 --> 04:39.200] his inventory, file a motion to remove him and ask for demand, demand a trial by a jury, [04:39.200 --> 04:43.960] and I'm putting in this that all the judges have recused themselves, I have no, that's [04:43.960 --> 04:44.960] what I was calling for. [04:44.960 --> 04:48.080] Do you also need to petition for counsel for your father? [04:48.080 --> 04:52.120] Yes, and that's not all I need to use, but that's one of them, yes. [04:52.120 --> 04:59.080] There's 120 days are up, he needs counsel, the money's missing, oh by the way I want [04:59.080 --> 05:04.240] to tell you something, in December the nursing home that they put him in, sending to right [05:04.240 --> 05:08.680] away when my brother was arrested in September, in December he's trying to kill himself, he's [05:08.680 --> 05:11.200] trying to hang himself in the nursing home. [05:11.200 --> 05:14.240] Wait, your brother or your father? [05:14.240 --> 05:21.160] My father is, and it's bad, it's really bad Randy, I mean my mother's death never got [05:21.160 --> 05:26.080] an investigation, they bought it to her investigations, so badly. [05:26.080 --> 05:32.960] Okay, well I suggest if you think money's been stolen especially in that amount, you [05:32.960 --> 05:34.800] start filing criminal charges. [05:34.800 --> 05:38.920] Well when I was going to ask you when I do this, now I'm going to file a criminal, I'm [05:38.920 --> 05:43.920] going to do an affidavit form, criminal charges to complain to the prosecutor, but now once [05:43.920 --> 05:50.080] I get, once he doesn't do anything, you just have to take it to magistrate, I mean, I can't [05:50.080 --> 05:51.080] take it to any account. [05:51.080 --> 06:00.200] Okay, magistrate, when I say magistrate, all judges are magistrates, but not all magistrates [06:00.200 --> 06:04.680] are judges, mayors are sometimes magistrates. [06:04.680 --> 06:12.280] So when I say magistrate, I'm really talking about a judge, but when you put a criminal [06:12.280 --> 06:20.440] complaint, a verified criminal affidavit in a judge's hand, his judge's hat comes off [06:20.440 --> 06:27.080] and his magistrate's hat goes on, and he has a duty to examine into the sufficiency of [06:27.080 --> 06:34.520] the accusation, generally they don't do that, they don't want to do their job, but you need [06:34.520 --> 06:42.160] to look in your code of criminal procedure for Ohio, and maybe we can get our call screener [06:42.160 --> 06:51.560] Chris to look that up while we're talking, and look for duties of magistrates. [06:51.560 --> 07:00.880] The magistrate, every state has it, this has been around since 1215, and the federal government [07:00.880 --> 07:07.680] induced the states to adopt a model penal code, model code of criminal procedure, most [07:07.680 --> 07:14.120] of them did, so that you can move from state to state and the laws would be essentially [07:14.120 --> 07:18.320] the same, with slight variations. [07:18.320 --> 07:26.480] So everybody has magistrates, and a magistrate's duty is to hold an examining trial for someone [07:26.480 --> 07:33.400] who's been arrested with or without a warrant and examine into the sufficiency of the accusation. [07:33.400 --> 07:40.320] If it's with a warrant, the warrant was issued without the person being there, so even if [07:40.320 --> 07:44.720] he's arrested on a warrant, he's to be taken before the magistrate at a proper examining [07:44.720 --> 07:47.600] trial with both people there. [07:47.600 --> 07:52.680] So if you're ever arrested, you're required to be taken before a judge, they say judge, [07:52.680 --> 07:59.480] but when in this capacity he's a magistrate, so he's entertaining the magistrate, and every [07:59.480 --> 08:04.920] judge in the state is a magistrate, they all have that duty, so might as well send it [08:04.920 --> 08:08.080] to the high school, create some politics. [08:08.080 --> 08:18.600] The trick is, you don't want them to do what you're asking them to do. [08:18.600 --> 08:25.280] If you want them to do what you're asking them to do, you'll always be disappointed. [08:25.280 --> 08:31.640] So go in there with your little tar baby, I've got this invisible tar baby, they can [08:31.640 --> 08:37.560] see it, but I've got it, and I want them to touch it. [08:37.560 --> 08:45.720] I actually told a constable recently that I was trying to get the bailiff to arrest [08:45.720 --> 08:49.120] a judge, and he wouldn't do it. [08:49.120 --> 08:51.040] Judge wouldn't let me see some records. [08:51.040 --> 08:56.200] The judge would stand right in front of me, and the bailiff came over, and he asked me [08:56.200 --> 08:58.680] my name, and I told him, he said, is there a problem here? [08:58.680 --> 09:03.440] I said, yeah, there he is, the magistrate won't let me see these records, I want you [09:03.440 --> 09:05.720] to arrest her. [09:05.720 --> 09:10.000] He said, Mr. Councilman, you created a disturbance, I'll arrest you, I said, are you threatening [09:10.000 --> 09:11.000] me? [09:11.000 --> 09:14.400] Well, Mr. Councilman, are you threatening me? [09:14.400 --> 09:18.720] Well, no, Mr. Councilman, I just want to make sure we don't have a problem, we're [09:18.720 --> 09:25.240] not going to have a problem, arrest her, the magistrate standing about three feet away [09:25.240 --> 09:32.200] from me, she's not saying a word, so I couldn't get in his argument with the bailiff whether [09:32.200 --> 09:39.920] or not he's going to arrest the judge, he refuses, so he takes me down to the constables, [09:39.920 --> 09:45.640] constable refuses, so I go to the sheriff, ask for a deputy, I want to arrest the judge, [09:45.640 --> 09:49.760] and the constable came over while I'm talking to the sheriff, and he said, Mr. Cousin, if [09:49.760 --> 09:55.160] you want me to, I'll go talk to the prosecuting attorney about this, oh no, no, no, no, don't [09:55.160 --> 10:02.960] do that, I'll get to the prosecuting attorney, but everybody hasn't touched my tar baby yet, [10:02.960 --> 10:03.960] he said, why? [10:03.960 --> 10:10.680] I said, I got this little infant, so well, tar baby, you've already touched it, now I [10:10.680 --> 10:23.040] want the sheriff to touch it, then he realized what I was doing, and I had a lawyer realize [10:23.040 --> 10:28.680] this in Johnson County, Texas, when I gave her a criminal complaint with the grand jury, [10:28.680 --> 10:32.760] and she said, call me, they need to go to the sheriff, I said, no ma'am, they need to [10:32.760 --> 10:36.280] go to the grand jury, I'm going to present them to the grand jury, everything you need [10:36.280 --> 10:41.000] to do is decide if you're going to interfere with me in the process, because there were [10:41.000 --> 10:44.280] complaints against her boss, she called me a week later and said, Mr. Cousin, I sent [10:44.280 --> 10:48.920] you complaints to the sheriff, I said, you did, yes you did, but he sent them back to [10:48.920 --> 10:52.640] me, he said there were complaints against him in there, I said, well, yes, as a matter [10:52.640 --> 10:59.520] of fact, there were, she said, Mr. Cousin, I get the impression you planned this this [10:59.520 --> 11:10.320] way, well, miss, miss Wyatt, you're very astute, I hope you don't think this is my first rodeo, [11:10.320 --> 11:17.720] no Mr. Cousin, somehow I don't think it is, that's what you want them to think, and they [11:17.720 --> 11:22.520] just said, I mean, I've had five cases before the Ohio Supreme Court, when my father tried [11:22.520 --> 11:28.200] to hang himself in the nursing home, I found a habeas corpus to the Ohio Supreme Court, [11:28.200 --> 11:34.160] and I, well, I haven't reopened it, I just got it this week, they've dismissed it, and [11:34.160 --> 11:39.520] because, again, I can't take it to them, they have no jurisdiction, they've all recused [11:39.520 --> 11:44.520] themselves, they have no jurisdiction, and I told the Supreme Court, you've got to take [11:44.520 --> 11:45.520] this. [11:45.520 --> 11:53.680] Okay, you understand that if a judge attempts to act without jurisdiction, you can sue it. [11:53.680 --> 12:03.600] Under what, under what, impersonating a judicial officer, yeah, it's 3.07 in the Hong Kong [12:03.600 --> 12:07.960] Code, now it's misconduct in the office, not reasons, misseasons, new reasons, whatever [12:07.960 --> 12:17.960] reasons it's got, but that's what it is, and I know, if a judge lacks subject matter jurisdiction, [12:17.960 --> 12:24.440] when he attempts to exercise jurisdiction, he's impersonating a judicial officer. [12:24.440 --> 12:27.600] And that's what they were doing, I didn't know he didn't have an oath when I first went [12:27.600 --> 12:30.160] before him, when this was started. [12:30.160 --> 12:32.040] That should get criminal charges. [12:32.040 --> 12:34.120] It is, it is, it should be. [12:34.120 --> 12:39.600] When you start running that criminal routine, you run it in the background, not in the [12:39.600 --> 12:48.720] forum, never ever say a word about it in the probate court, to run that in the background. [12:48.720 --> 12:55.160] And if anybody tries to say a word to you about the criminal complaints, oh no, no, no, [12:55.160 --> 13:00.400] we can't be talking about that, we wouldn't want anybody to think you were trying to tamper [13:00.400 --> 13:04.400] with a witness. [13:04.400 --> 13:12.440] Now they got somebody who's taking shots at them, and they can't negotiate with you. [13:12.440 --> 13:18.840] They can't weedle you and coerce you and get you to stop doing it. [13:18.840 --> 13:19.840] They don't dare. [13:19.840 --> 13:24.000] That's why when I was asking the bailiff to arrest the judge, she stood there and kept [13:24.000 --> 13:27.200] her mouth shut. [13:27.200 --> 13:34.480] One word out of her and what it got, Rick Sirius, 3605, 3606, penal code, tamper with [13:34.480 --> 13:39.080] a witness obstruction justice, and both the felons, so she stood there and kept her mouth [13:39.080 --> 13:41.320] shut. [13:41.320 --> 13:46.560] This will give you some really powerful back side politics. [13:46.560 --> 13:49.320] Do you want to file this complaint, this criminal complaint? [14:59.440 --> 15:04.920] Instruct the foreman that I have business with the grand jury. [15:04.920 --> 15:08.200] He said, may I tell him the nature of the business? [15:08.200 --> 15:09.200] Yes, you may. [15:09.200 --> 15:15.840] He said, I handed him 12 packages, one all about an inch thick, one for each grantor [15:15.840 --> 15:16.840] member. [15:16.840 --> 15:17.840] Uh-huh. [15:17.840 --> 15:23.800] I was kind of looking from side to side and I said, oh, I know what you're thinking. [15:23.800 --> 15:31.760] You're thinking I should call the prosecuting attorney, bad move ever. [15:31.760 --> 15:37.560] Those documents contain criminal charges against the grand district attorney. [15:37.560 --> 15:42.560] If you call the district attorney or one of his minions, I will consider that an act [15:42.560 --> 15:44.040] of obstruction of justice. [15:44.040 --> 15:45.040] Uh-huh. [15:45.040 --> 15:48.040] He said, Mr. Bailiff, are you threatening me? [15:48.040 --> 15:55.240] Mr. Bailiff, I promise you if you give those complaints against the prosecuting attorney [15:55.240 --> 16:02.160] to the prosecuting attorney, I will go to the Hyatt to judge in Texas and ask him to crucify [16:02.160 --> 16:03.160] you. [16:03.160 --> 16:04.160] Uh-huh. [16:04.160 --> 16:08.920] Well, let's see what the foreman has to say. [16:08.920 --> 16:09.920] Smart move. [16:09.920 --> 16:10.920] Uh-huh. [21:54.440 --> 22:01.440] And then the criminal complaint should, when I send it to the prosecutor, should I set it up like a true complaint? [22:01.440 --> 22:03.440] Yes, absolutely. [22:03.440 --> 22:10.440] Just look at the criminal complaint. You know, you can do a church online for criminal complaints. [22:10.440 --> 22:18.440] Just structure it in the same form that they use. Most of them use a written motion type heading. [22:18.440 --> 22:23.440] But just structure it in that form and send it to them. [22:23.440 --> 22:35.440] There is no real script requirements on criminal complaints because it's intended to be filed by private citizens. [22:35.440 --> 22:41.440] You'll see an information. If you can find an information, that's what a criminal complaint is supposed to look like. [22:41.440 --> 22:53.440] It's intended that a citizen file a complaint and then the prosecutor take that complaint and convert it to or produce an information based on the complaint. [37:51.440 --> 38:01.440] Also, you look at the deed of trust to make sure marriage is included in the deed of trust and have all staff arguments that you make on that one. [40:01.440 --> 40:05.440] And then I was going to represent myself in court, which is fine. [40:05.440 --> 40:09.440] He says, well, I said to myself, why risk it for $2,500? [40:09.440 --> 40:11.440] He's going to do it right. [40:11.440 --> 40:12.440] There's no guesswork. [40:12.440 --> 40:15.440] It's going to work because I know I can win. [40:15.440 --> 40:19.440] And I spoke to him and I told him, okay, you're the boss. [40:19.440 --> 40:21.440] You do whatever you think is best. [40:21.440 --> 40:26.440] You do whatever you think is best with my complaint. [40:26.440 --> 40:31.440] What he did, he threw all the federal questions out of there. [40:31.440 --> 40:40.440] He has filed a simple quiet title with the wrong parties in the document, which I had to fix [40:40.440 --> 40:42.440] because he had a nurse. [40:42.440 --> 40:43.440] I don't have a nurse. [40:43.440 --> 40:44.440] He had securitization. [40:44.440 --> 40:46.440] He had a Washington Mitchell in there. [40:46.440 --> 40:48.440] I never dealt with a Washington Mitchell. [40:48.440 --> 40:56.440] So he gave me a template partially filled and I called him and he says, you know what? [40:56.440 --> 40:57.440] I can do better than this. [40:57.440 --> 40:59.440] He says, well, and I said, I'm going to fix it. [40:59.440 --> 41:01.440] I'm going to file it. [41:01.440 --> 41:05.440] And he says, and I told him, are you sure this is going to work? [41:05.440 --> 41:07.440] He says, go ahead and do it. [41:07.440 --> 41:08.440] I'm 100%. [41:08.440 --> 41:11.440] To make a certain short, I don't want to make this too boring. [41:11.440 --> 41:14.440] The judge threw my case out. [41:14.440 --> 41:23.440] I went back to the attorney and I told him, I need you to fix this because the judge [41:23.440 --> 41:29.440] wants me to show a cause why he should not dismiss my case. [41:29.440 --> 41:35.440] And he says, well, he tried to do something, but he did the same mistake. [41:35.440 --> 41:40.440] He gave me a template with different elements in the template. [41:40.440 --> 41:42.440] So my case got dismissed. [41:42.440 --> 41:44.440] And he says, and I went back to him. [41:44.440 --> 41:48.440] He says, well, give me $3,500 and I'll appeal it. [41:48.440 --> 41:49.440] And I said, you know what? [41:49.440 --> 41:51.440] I don't think this is going to work. [41:51.440 --> 41:57.440] So I'm thinking about doing a bargain and send him for my $3,500. [41:57.440 --> 42:04.440] And I did take him to small claims, but the judge says, well, this is not the right jurisdiction. [42:04.440 --> 42:10.440] And now he says, go do whatever you want to do in the right jurisdiction. [42:10.440 --> 42:13.440] So I'm going to go to Orange County and file. [42:13.440 --> 42:19.440] My question is this, what would you do besides a bargain in which court would I file it? [42:19.440 --> 42:26.440] I'm thinking about filing a case in federal court. [53:50.440 --> 53:57.440] Now, when you signed the deed of trust, the notary was sitting right there in front of you. [53:57.440 --> 54:07.440] And we've been sending out to them and we originally had people send to them because we expected that notary to send us their sequential ledger. [54:07.440 --> 54:11.440] So far, we hadn't gotten any ledgers. [54:11.440 --> 54:17.440] If we don't get a ledger, then we file a complaint with Secretary of State against the lender. [54:17.440 --> 54:31.440] And we had a couple of people do that in Colorado and when they went into court with a complaint by the Secretary of State against the notary that really got the court's attention. [54:31.440 --> 54:35.440] These chump judges do not want to mess with the Secretary of State. [54:35.440 --> 54:40.440] He's far too political for them. [54:40.440 --> 54:50.440] So when you don't get the response from the notary, now you go to the court for a declaratory judgment. [54:50.440 --> 55:05.440] And you ask the court to declare that this document, because of this problem with the authentication, is insufficient for filing under the state rules for filing in these records. [55:05.440 --> 55:13.440] And ask the judge to rule that this document is sub void and of no force and effect. [55:13.440 --> 55:16.440] Now you go for quite a title. [55:16.440 --> 55:20.440] Okay, in which court would that be? Superior Court? [55:20.440 --> 55:26.440] Well, District Court, which you've got County Court, District Court, whatever's called in California. [55:26.440 --> 55:29.440] Federal Court or Superior Court? [55:29.440 --> 55:31.440] No state state. This is all state issues. [55:31.440 --> 55:33.440] Okay, Superior Court. [55:33.440 --> 55:40.440] This goes to the state's interest in accurate land records. [55:40.440 --> 55:41.440] Okay, very good. [55:41.440 --> 55:47.440] With no accurate land records, nobody in their right mind to buy property in this jurisdiction. [55:47.440 --> 55:50.440] This may have somebody coming by next week and take it away from them. [55:50.440 --> 56:00.440] So the county has invested interest and the state has invested interest in accurate property records. [56:00.440 --> 56:12.440] So the clerk, you go to the judge and say, the records in the county clerk's office are not accurate because they have these incomplete filings. [56:12.440 --> 56:17.440] That the filings fail to meet the requirements of law and ask the court to rule that. [56:17.440 --> 56:21.440] Don't ask the court to rule anything else. [56:21.440 --> 56:32.440] And specifically request that the court make no determination of any claim by the filer of this document. [56:32.440 --> 56:37.440] You only petition the court to rule whether this document meets the rules for filing. [56:37.440 --> 56:44.440] It makes a very focused, very tight question you're asking the court. [56:44.440 --> 56:51.440] If the court goes to anything else, object because that'll get your whole case thrown out. [56:51.440 --> 56:55.440] They'll often do that just to screw you around. [56:55.440 --> 57:02.440] So only sufficiency of the document. You get a ruling on the sufficiency of the document and they say it's void. [57:02.440 --> 57:07.440] Then if there's any foreclosure based on that document, that's history. [57:07.440 --> 57:09.440] Now you go for quiet title. [57:09.440 --> 57:10.440] Okay. [57:53.440 --> 58:00.440] Will you provide for me power evidence of power of attorney for this person? [58:00.440 --> 58:05.440] You will not get a response. Now you can go before the judge and say, your honor, this guy's a RoboSigner. [58:05.440 --> 58:07.440] His name's splattered all over the internet. [58:07.440 --> 58:14.440] So we send a letter to his company asking for evidence of power of attorney and we didn't get it. [01:04:53.440 --> 01:05:02.440] The only thing you can do in declaratory judgment is ask them to rule on the sufficiency of the document [01:05:02.440 --> 01:05:06.440] as compared to the filing requirements. [01:06:38.440 --> 01:06:45.440] So the argument I have is that if an agent for the lender, [01:06:45.440 --> 01:06:50.440] well, actually this argument won't stand very well unless Mars is in the document. [01:06:50.440 --> 01:06:54.440] There is another one, 14, Covenant 14. [01:06:54.440 --> 01:07:00.440] It's easier to argue a contractual violation. [01:07:00.440 --> 01:07:11.440] If you have respitella violations, they generally always time-barred. [01:07:11.440 --> 01:07:20.440] But one thing that's not time-barred is the requirement that both parties abide by all law. [01:07:20.440 --> 01:07:28.440] At consummation and immediately thereafter, the lender breached Covenant's of the contract [01:07:28.440 --> 01:07:35.440] by breaching Truth and Lending Act and Reset Settlement Procedures Act. [01:07:35.440 --> 01:07:41.440] If we make a claim under Hopatee the Respite, the courts will throw it out. [01:07:41.440 --> 01:07:49.440] But we make the claim under breach of contract and claim defaults on the deed of trust. [01:07:49.440 --> 01:07:56.440] And maintain that the lender, while they still may have a claim concerning the note, [01:07:56.440 --> 01:08:06.440] they've defaulted on the deed of trust and may no longer enforce the privilege granted in the deed of trust. [01:08:06.440 --> 01:08:12.440] You should really read that deed of trust carefully. [01:08:12.440 --> 01:08:20.440] And read the deed of trust to look for breaches of Covenants. [01:08:20.440 --> 01:08:28.440] When they foreclose, they claim a breach of a Covenant of the deed of trust. [01:08:28.440 --> 01:08:32.440] So you come in and claim that they could not make these claims [01:08:32.440 --> 01:08:39.440] because they had already breached the Covenants and nullified the contract. [01:09:51.440 --> 01:09:52.440] No problem. [01:09:52.440 --> 01:09:57.440] I don't have any accusations that he's stealing from her or anything like that. [01:11:19.440 --> 01:11:28.440] My brother's attorneys went in and talked to the judge, they would not allow me to go in and be with him. [01:11:28.440 --> 01:11:32.440] They had an ex parte communication with the judge? [01:11:32.440 --> 01:11:34.440] Yes, sir. As the fact that his attorneys argue, the fact that this need to be done as soon as possible because it was a wasting asset and she needed the money and he destroyed, I don't know, $10,000 worth of assets. [01:21:37.440 --> 01:21:50.440] But the value of that and the contention it's going to bring between you and your family, did he act maliciously? Was it a psychiatrist or psychologist? [01:25:21.440 --> 01:25:38.440] No, not that I know of. I have no ideas for what her expertise are and the fact that, and the fact, I would like to know how she's being paid and how many, and when, and when, how many times and when she has seen her and who's paying her. [01:25:38.440 --> 01:25:44.440] Okay. What standing do you have to make these requests? [01:25:44.440 --> 01:25:52.440] I'm her son. And this, this, this financial thing's going to end up part of in my lap. [01:25:52.440 --> 01:25:57.440] Okay. You still don't have, just because you're the son doesn't give you standing. [01:33:46.440 --> 01:33:53.440] Well, Randy, I'm working on a nullification order for the judge that found out [01:33:53.440 --> 01:33:58.440] that got the payments from the county of Los Angeles. [01:33:58.440 --> 01:34:05.440] And I was reading something the other day, and I think I hit a snag. [01:34:05.440 --> 01:34:13.440] When I filed the court case in small claim, if I won, it was appealed. [01:34:13.440 --> 01:34:20.440] And according to the filing, the notice of appeal is removed from small claim. [01:34:20.440 --> 01:34:23.440] Now, it's supposed to be a trial de novo. [01:34:23.440 --> 01:34:28.440] And someone suggested that I recall legally, and that was the total waste of time, [01:34:28.440 --> 01:34:33.440] because they told me, well, if it's a trial de novo, there's no way you can appeal that. [01:34:33.440 --> 01:34:37.440] And I said, well, there has to be a way when it's brought upon the court. [01:34:37.440 --> 01:34:43.440] What? Wait a minute. No way you can appeal. [01:34:43.440 --> 01:34:46.440] Yeah, because it's a trial de novo. [01:34:46.440 --> 01:34:56.440] Now, trial de novo is trial de novo for the purpose of perfecting the appeal. [01:34:56.440 --> 01:35:04.440] And that just means that you don't have to claim error in order to appeal. [01:35:04.440 --> 01:35:09.440] So, okay, let me make sure I understand. [01:35:09.440 --> 01:35:18.440] Was this something, an issue like where they misrepresented the truth or did something improper? [01:35:18.440 --> 01:35:23.440] Or was this an issue where you felt like you got a wrongful ruling? [01:35:23.440 --> 01:35:29.440] Well, I got a wrongful ruling, and he did not tell the truth. [01:35:29.440 --> 01:35:34.440] He was paid $200,000 by the county of who the pleasure. [01:35:34.440 --> 01:35:42.440] Okay, if he didn't tell the truth, you can use that in the new trial to impeach him. [01:35:42.440 --> 01:35:48.440] They can't say that because it's trial de novo, I can lie, cheat, steal, [01:35:48.440 --> 01:35:53.440] do anything I want to in the original hearing, and an appeal wipes that out. [01:35:53.440 --> 01:35:55.440] No, it doesn't. [01:35:55.440 --> 01:36:00.440] And that's why I was saying trial de novo is trial de novo for the purpose of perfecting your appeal, [01:36:00.440 --> 01:36:07.440] meaning that you don't have to claim reversible error in order to win your appeal. [01:36:07.440 --> 01:36:13.440] You just appeal and it starts all over before a real judge instead of an inferior judge. [01:36:13.440 --> 01:36:21.440] But if they have committed improper acts, that does not go away. [01:36:21.440 --> 01:36:23.440] Does that make sense? [01:36:23.440 --> 01:36:31.440] Yes, it does, because I read the Supreme Court ruling that this action videates the case. [01:36:31.440 --> 01:36:40.440] Yeah, it videates the case only in that whatever the ruling was, whatever the ruling was, it's tossed. [01:36:40.440 --> 01:36:50.440] Right, which would revert the case back to her having to return my dogs to the original ruling from the small claims court? [01:36:50.440 --> 01:36:56.440] Well, okay. [01:36:56.440 --> 01:37:01.440] Okay, you're saying in the case your dog was given to someone else? [01:37:01.440 --> 01:37:07.440] She defrauded me of ownership to get possession of the dog. [01:37:07.440 --> 01:37:11.440] She signed a contract saying that she wouldn't steal the dog. [01:37:11.440 --> 01:37:14.440] I won the small claims court case. [01:37:14.440 --> 01:37:17.440] She said, give it to him, I'll get him on an appeal. [01:37:17.440 --> 01:37:25.440] She went and got a lawyer and the judge, he told me on the 11th of September about a hearing on the 26th, [01:37:25.440 --> 01:37:32.440] I didn't have enough time to get a witness from the next county into the courtroom because the Sheriff's Department said [01:37:32.440 --> 01:37:36.440] I didn't have enough time when I presented that evidence to him, he didn't care. [01:37:36.440 --> 01:37:47.440] But I now realize that the reason that he didn't care was because the defendant said that she worked for the county in the city, [01:37:47.440 --> 01:37:54.440] which was not true, I had a letter from the city's animal control, but not the county. [01:37:54.440 --> 01:38:08.440] And then he had the payments, over $600,000 in payments that he received from 2000 to 2009 when I appeared before. [01:38:08.440 --> 01:38:12.440] And he's had more payments now because they're going on now. [01:38:12.440 --> 01:38:16.440] Wait a minute, wait a minute, I don't know what you're talking about, payments. [01:38:16.440 --> 01:38:28.440] There's something in LA County that was discovered by Dr. Richard Fine where there's a cafeteria-style benefit that's given for judge retention. [01:38:28.440 --> 01:38:37.440] And these payments are given to all the judges to sit on the bench in LA County. [01:38:37.440 --> 01:38:47.440] And so the payments have been deemed illegal by the Third Appellate Court of California and the Supreme Court of the United States has also held [01:38:47.440 --> 01:38:53.440] that if there's payments made to the judge that he must reveal it. [01:38:53.440 --> 01:39:02.440] So I have the guiding law because I looked at Dr. Fine's example on how to avoid the judgment. [01:39:02.440 --> 01:39:08.440] But because of the filing, I'm kind of befuddled because I don't know where to file it. [01:39:08.440 --> 01:39:15.440] Do I go back to the same court that heard it to file there, or do I now move to the appellate court? [01:39:15.440 --> 01:39:18.440] That is a good issue. [01:39:18.440 --> 01:39:23.440] If it's in the appellate court, the trial court has no jurisdiction. [01:39:23.440 --> 01:39:34.440] Sometimes they want things filed in the original court and then the original court would have to move them to the appeals court. [01:39:34.440 --> 01:39:37.440] But that seems kind of redundant. [01:39:37.440 --> 01:39:48.440] If you file it in the appeals court and they feel like it should be filed in the original court, you can go ahead and take it and refile it at where it should have been. [01:39:48.440 --> 01:39:52.440] But I would try the appeals court first. [01:39:52.440 --> 01:39:53.440] Okay. [01:39:53.440 --> 01:39:56.440] Does that's where it has to go in the end anyway? [01:40:00.440 --> 01:40:08.440] I'm still working on the judicial appeal to go with this and also the bar grievance for him. [01:40:08.440 --> 01:40:19.440] I talked to the judicial performance and they were saying that I had to start a new complaint, even though I complained on this judge before. [01:40:19.440 --> 01:40:23.440] They said I have to bring them a new complaint with the evidence. [01:40:23.440 --> 01:40:28.440] And that could add more complaints, more marks on his record. [01:40:28.440 --> 01:40:29.440] Okay. [01:40:29.440 --> 01:40:44.440] So then the other thing is I finally realized something about my New Jersey situation through what you were telling the last caller when you were talking about the relevancy. [01:40:44.440 --> 01:40:59.440] And I kind of saw myself in his situation, but listening to it, I finally got it, which you were talking about relevancy because I saw the furniture and the issue there was the house sale. [01:40:59.440 --> 01:41:05.440] So the issue of the house sale has nothing to do with the furniture because it's a personal item. [01:41:05.440 --> 01:41:09.440] So you have to argue separately if I got you correctly. [01:41:09.440 --> 01:41:10.440] Yes. [01:41:10.440 --> 01:41:11.440] Yes. [01:41:11.440 --> 01:41:30.440] The thing is that I wanted to say to him, if I could, when you go through something like that for your mother and they start talking about competency and they start appointing a lawyer for your mother, that burning the funds, this court is burning the funds from your mother's estate. [01:41:30.440 --> 01:41:35.440] That's where the money's coming from and it's meant to break all involved. [01:41:35.440 --> 01:41:38.440] That's what I found in my situation. [01:41:38.440 --> 01:41:47.440] That's what probates about how do you swallow the entire estate so the lawyers come away with everything. [01:41:47.440 --> 01:41:48.440] Exactly. [01:41:48.440 --> 01:41:56.440] So it's a very slippery slope and it's very hard because I just went through it with my mother. [01:41:56.440 --> 01:42:10.440] Even though in October we're still fighting with the judge because he just didn't have proper hearing, wouldn't let me be heard and I'm my mother's executive for her will. [01:42:10.440 --> 01:42:14.440] So the very fact that I was not heard, he violated my civil rights. [01:42:14.440 --> 01:42:41.440] The interesting thing about that is that over the next week I get a chance to go to Washington D.C. for another matter, but while I'm there I'm going to be walking the halls of Congress with the files of the court and turning them over to the Judiciary Committee so that they can see the fraud and the denial of civil rights. [01:42:41.440 --> 01:42:48.440] And I have official records because I have official transcripts that I paid for so I'm looking forward to the trip. [01:42:48.440 --> 01:42:59.440] It's my first trip back east since this whole fiasco with the service dogs occurred in 2007. [01:42:59.440 --> 01:43:02.440] So I'm kind of excited about it. [01:46:50.440 --> 01:46:58.440] So, the end of the show. Back in 2011, went to court on a traffic ticket in Real Vista, Texas. [01:46:58.440 --> 01:47:04.440] Corrupt Real Vista, Texas, my little town just to the west of the Metroplex. [01:47:04.440 --> 01:47:08.440] I had a jury trial on a speeding ticket, 68-55. [01:47:08.440 --> 01:47:13.440] The jury convicted me at the end of the trial. [01:47:13.440 --> 01:47:18.440] The juror stood up and said, we find the defendant guilty. [01:47:18.440 --> 01:47:24.440] We assess a fine of $100 plus court fee. [01:47:24.440 --> 01:47:27.440] I had a big argument with the judge there that day. [01:47:27.440 --> 01:47:30.440] I hadn't heard nothing about it. [01:47:30.440 --> 01:47:40.440] For all of 2012, about three weeks ago, I get a letter in the mail saying that I owe $197.10 in court fees. [01:47:40.440 --> 01:47:51.440] I sent them a letter, a total amount of the Texas Code of Criminal Procedure that they had to send me an itemized bill. [01:47:51.440 --> 01:48:00.440] In response, they sent me back an itemized, or what they claimed to be an itemized bill, where the judge signs off, [01:48:00.440 --> 01:48:05.440] which is funny, the judge signs off and says that I was convicted. [01:48:05.440 --> 01:48:10.440] I was guilty of the offense of 68-55. [01:48:10.440 --> 01:48:13.440] I assessed the fine of $197.10. [01:48:13.440 --> 01:48:16.440] This is what they claim the bill is. [01:48:16.440 --> 01:48:24.440] Then she signs off on it, says I have to pay by February 18th, or there will be a warrant for my arrest. [01:48:24.440 --> 01:48:29.440] I take one of Randy's from Juris and Prudence. [01:48:29.440 --> 01:48:37.440] My brother helped me with this, but I did an open information request to the court, went down there, [01:48:37.440 --> 01:48:39.440] and it's the court clerk. [01:48:39.440 --> 01:48:42.440] She immediately said, okay, what do you need? [01:48:42.440 --> 01:48:44.440] She pulled out all the files. [01:48:44.440 --> 01:48:52.440] I got the copy from back in November 2011, the jury verdict. [01:48:52.440 --> 01:49:01.440] On the jury verdict, it's split in two. The top is the guilty, the guilty, and the bottom is the not guilty. [01:49:01.440 --> 01:49:08.440] The top is signed by the jury foreman, the foreperson, puts a checks guilty, [01:49:08.440 --> 01:49:16.440] and then somebody else down in the not guilty section wrote $100 in court fees, [01:49:16.440 --> 01:49:23.440] and then somebody else came along because the reason I know these are different people is because the handwriting is different on each one, [01:49:23.440 --> 01:49:27.440] but then somebody else wrote $97.10. [01:49:27.440 --> 01:49:37.440] Under the Texas Code of Criminal Procedure, they can only charge $19.10 in court fees. [01:49:37.440 --> 01:49:44.440] Well, I've asked them to, you know, in that bill, I asked them to show me what the fees are. [01:49:44.440 --> 01:49:46.440] They didn't give me that. [01:49:46.440 --> 01:49:53.440] Well, in the copies of stuff I got from the court, this is what the judge signed off. [01:49:53.440 --> 01:50:01.440] She basically certified, and at the bottom it says she certified this to be true and correct. [01:50:01.440 --> 01:50:06.440] This is what the court, you know, their final order, the day that I had the jury trial. [01:50:06.440 --> 01:50:15.440] It says on the 18th day of November 2011, in the above style, the number of criminal cases was tried in the State Court before a judge, [01:50:15.440 --> 01:50:21.440] Ruth Brown and defendant Larry Wiest, was convicted of the defense of speeding 68 and 55, [01:50:21.440 --> 01:50:32.440] and a judge to pay a fine of, nothing's written there, and court costs, nothing is written there, for which judgment defendant has appealed. [01:50:32.440 --> 01:50:39.440] So there's nothing written there, there's no fine on here, and they're threatening a warrant for my arrest. [01:50:39.440 --> 01:50:45.440] If I don't pay, what they were, there's nothing, no fine has been written on here. [01:50:45.440 --> 01:50:48.440] It was signed off and certified by the judge. [01:50:48.440 --> 01:50:53.440] She actually certified that this was a true and correct. [01:50:53.440 --> 01:51:02.440] It says, she hereby certifies that the above and foregoing proceeding documents are complete and correct transcript of all the proceedings [01:51:02.440 --> 01:51:04.440] at the fore said court. [01:51:04.440 --> 01:51:15.440] In this case, of the State of Texas versus Larry Wiest, witness my signature this 18th day of November 2011, judge Ruth Brown. [01:51:15.440 --> 01:51:16.440] Okay. [01:51:16.440 --> 01:51:19.440] Did you appeal this? [01:51:19.440 --> 01:51:21.440] I did not appeal it. [01:51:21.440 --> 01:51:25.440] No, because that's what that last document sounded like. [01:51:25.440 --> 01:51:34.440] This would seem like a, this is the kind of thing I'd want them to arrest me over. [01:51:34.440 --> 01:51:40.440] Why would I want, you tell me why I want arrest, why I would want them to arrest me over this? [01:51:40.440 --> 01:51:48.440] Because that's one of the things the city has no immunity for. [01:51:48.440 --> 01:51:51.440] False imprisonment. [01:51:51.440 --> 01:51:57.440] The city does not maintain sovereign immunity for false imprisonment. [01:51:57.440 --> 01:52:00.440] You could sue the city. [01:52:00.440 --> 01:52:08.440] So with no fine stated in what the judge certified to be a true transcript. [01:52:08.440 --> 01:52:16.440] No fine amounts to an odd guilty verdict. [01:52:16.440 --> 01:52:20.440] The jury found you guilty and assessed a fine. [01:52:20.440 --> 01:52:27.440] The judge nullified the jury verdict and gave you no fine. [01:52:27.440 --> 01:52:31.440] It was nice of the judge. [01:52:31.440 --> 01:52:32.440] I would say so. [01:52:32.440 --> 01:52:35.440] It was very nice of her that she didn't write. [01:52:35.440 --> 01:52:40.440] And that's, that's what I'm looking at with this paperwork that she signed off on. [01:52:40.440 --> 01:52:44.440] There's no fine written in there at all. [01:52:44.440 --> 01:52:49.440] So I would assume that would mean zero. [01:52:49.440 --> 01:53:02.440] That's the way I would read it and either you don't owe any money or the judge tampered with the document and committed aggravated perjury. [01:53:02.440 --> 01:53:10.440] And I would sure like to know which one it was. [01:53:10.440 --> 01:53:15.440] Well, looking at what she done here, she signed off. [01:53:15.440 --> 01:53:19.440] Yeah, she can say that that was a mistake. [01:53:19.440 --> 01:53:23.440] But it's verified. [01:53:23.440 --> 01:53:25.440] You don't get to verify mistakes. [01:53:25.440 --> 01:53:29.440] That's the whole point of verification. [01:53:29.440 --> 01:53:32.440] You swear under oath that this is true and correct. [01:53:32.440 --> 01:53:38.440] You don't, you don't get to claim later that, oh, oh, I made a mistake. [01:53:38.440 --> 01:53:40.440] Yeah. [01:53:40.440 --> 01:53:43.440] Well, you know, I, I made a, I pretended. [01:53:43.440 --> 01:53:46.440] I called the court clerk before I went down there. [01:53:46.440 --> 01:53:58.440] I pretended like I was a law student and said I was doing a report on court fees and I asked her, could you tell me what statute you rely on to set court costs in a case? [01:53:58.440 --> 01:54:04.440] Once the case is, if there, whatever, if there's a guilty verdict, what statute do you rely on? [01:54:04.440 --> 01:54:07.440] And she said she couldn't remember. [01:54:07.440 --> 01:54:08.440] She didn't know. [01:54:08.440 --> 01:54:19.440] She said that she, that they, they, they take what the Texas, Texas municipal education center gives them. [01:54:19.440 --> 01:54:36.440] Well, I've often had issues about these training programs that are, are funded by the state where the training program trains public officials to act in ways [01:54:36.440 --> 01:54:40.440] that are in violation of state law. [01:54:40.440 --> 01:54:43.440] What do you call that? [01:54:43.440 --> 01:54:49.440] Sounds to me like conspiracy to commit. [01:54:49.440 --> 01:54:58.440] The actor cannot claim that they were somehow ignorant of the law that applies to their particular position. [01:54:58.440 --> 01:55:01.440] So even if they were ignorant, they can't claim it. [01:55:01.440 --> 01:55:18.440] That's to have imputed knowledge and for the last 30 years that I know of, these companies have been training judges and clerks all to do things that are horrendously illegal. [01:55:18.440 --> 01:55:29.440] And it seems like it would be their responsibility to go train, get trained to verify what they're getting trained is correct, right? [01:55:29.440 --> 01:55:38.440] I would think so. Well, they don't, you know, if it's not right, they can't claim ignorance. [01:55:38.440 --> 01:55:46.440] It's already in a well adjudicated in law. You can't commit crimes and then say, oh, well, he told me I could do it this way. [01:55:46.440 --> 01:55:49.440] Well, sorry, Bubba. [01:55:49.440 --> 01:55:56.440] Just because he told you that you could take this car and drive it off a cliff over here. [01:55:56.440 --> 01:55:59.440] That don't mean you can. [01:55:59.440 --> 01:56:20.440] And I have a case, a whole V state that states that a practice over time made may develop the appearance of authority, but it never accrues actual authority. [01:56:20.440 --> 01:56:38.440] And that was going to crack policy and practice. If Paulian policy and practice is improper and illegal, it will always be improper and illegal, no matter how long it's perpetrated. [01:56:38.440 --> 01:56:49.440] But the course of action here is to let them to go ahead and, you know, and issue the capious warrant, do a walkthrough. [01:56:49.440 --> 01:56:54.440] You go down to the court and say, hey, you guys got a warrant for my arrest. [01:56:54.440 --> 01:57:01.440] And what they're likely to do is arrest you at that point. Now you have two claims against them. [01:57:01.440 --> 01:57:22.440] The first claim is, is that the warrant must have necessity state that either a certain person or any police officer shall arrest this person and bring him before me. [01:57:22.440 --> 01:57:36.440] Once you step up in front of the magistrate who issued the warrant, the warrants moot because they have to come in there and arrest you and bring you before the magistrate, which are already before the magistrate. [01:57:36.440 --> 01:57:39.440] So it eliminates the need for the warrant. [01:57:39.440 --> 01:57:58.440] The second one is the warrants valid in the first instance because you didn't know anything. And that makes the imprisonment false imprisonment, even if they simply restrain you of your liberty, even for a short time.
