[05:22.000 --> 05:32.000]  Okay, did you receive a private mortgage insurance policy?

[05:36.000 --> 05:44.000]  Check and make sure. Make sure you're not looking at another kind of policy. I've never seen a policy included at closing.

[05:46.000 --> 05:53.000]  I've looked at last closing documents, but if you don't have one, you want to request one.
[05:53.000 --> 06:04.000]  Because normally in a deed across a normal when it's in paragraph 10, that addresses private mortgage insurance.
[06:04.000 --> 06:17.000]  What it says is that if the lender is unable to, if you are as the borrower unable to secure private mortgage insurance or the lender, actually the lender is authorized to purchase it.
[06:17.000 --> 06:29.000]  If the lender is unable to secure private mortgage insurance, then the lender can keep the payments and indemnify himself.
[06:29.000 --> 06:41.000]  If the lender has in fact indemnified himself and you default, well, he can't be harmed.
[06:41.000 --> 06:45.000]  There's no option for subrogation.
[06:45.000 --> 06:54.000]  If there's private mortgage insurance and it's by a third party and the third party has to pay off on the default,
[06:54.000 --> 06:59.000]  the lender would have no claim against you.
[06:59.000 --> 07:04.000]  Whoever the insurance company is would have the claim.
[07:04.000 --> 07:08.000]  If the insurance company paid off, then the property would be sold.
[07:08.000 --> 07:14.000]  The amount of the sale would go to the insurance company.
[07:14.000 --> 07:25.000]  So for them to recover, recoup part of their loss and anything excess, they could come back and sue you under subrogation.
[07:25.000 --> 07:42.000]  However, if the lender indemnified himself and the lender receives the benefit of the insurance, the lender can't come then come back and claim subrogation.
[07:42.000 --> 07:47.000]  If he could, then what are you paying for?
[07:47.000 --> 07:56.000]  Covenant 3 on mine is the application of payments and it says all payments shall be applied by the lender as follows.
[07:56.000 --> 08:06.000]  First, to the mortgage insurance premium to be paid by lender to the secretary or to the monthly charge by the secretary instead of the monthly mortgage insurance premium.
[08:06.000 --> 08:13.000]  And then second is taxes and third is interest and fourth is amortization of the principle of the note and fifth is too late charges under the note.
[08:13.000 --> 08:20.000]  Under Covenant 3, they say that they're going to take the...
[08:20.000 --> 08:27.000]  Okay, look at 10. 10 is generally the one that goes to the private mortgage.
[08:27.000 --> 08:35.000]  It's a pretty good size paragraph, but it says that the lender can indemnify himself and if he's done that, he can't be harmed.
[08:35.000 --> 08:43.000]  You've paid him this extra premium and he can't be harmed.
[08:43.000 --> 08:51.000]  Anyway, that's one that I haven't briefed out yet. I've never heard anybody bring that argument.
[08:51.000 --> 09:02.000]  It's just one of the ones I've seen. There's one other that's really a big one and that one goes to fees they can charge.
[09:02.000 --> 09:19.000]  The fees they can charge are stipulated by the Real Estate Settlement Procedures Act and in every case I've ever seen.
[09:19.000 --> 09:23.000]  Okay, before I say that, let me back up and ask you a question.
[09:23.000 --> 09:36.000]  At closing, did the lender put charges on the HUD 1 settlement statement, page 2 of the HUD 1 settlement statement?
[09:36.000 --> 09:45.000]  What were your closing costs?
[09:45.000 --> 09:48.000]  Okay, probably don't have that in your head, not a problem.
[09:48.000 --> 09:51.000]  Well, I don't, but I can pull up the one.
[09:51.000 --> 10:11.000]  At closing, did the lender provide documentation to show that the fees charged were not otherwise prohibited from being charged as a matter of law, that the fees charged were for services actually rendered,
[10:11.000 --> 10:24.000]  that the services were necessary, that the amounts charged were reasonable, and that the lender did not take an undisclosed markup on the amounts charged.
[10:24.000 --> 10:32.000]  Did you receive any documentation to support the amounts charged on HUD 1 settlement statement?
[10:32.000 --> 10:34.000]  I'll have to look through.

[10:36.000 --> 10:49.000]  I'll have to look through that documentation related to HUD, what I got at closing was a HUD appraised value disclosure, a HUD settlement statement, and addendum to HUD 1 settlement statement.

[11:08.000 --> 11:30.000]  You'll generally find that in line 1400, I think, and run an amortization on the note and then subtract the amount from the HUD 1 settlement statement from the note and reamortize it at the same payment amounts
[11:30.000 --> 11:36.000]  and see how much you would overpay the note over the full term.
[11:36.000 --> 11:37.000]  Okay.
[11:37.000 --> 11:43.000]  And then claim that against the lender as fraud.
[11:43.000 --> 11:57.000]  In fraud, you don't claim the amount you were actually defrauded of, so you don't claim how much they collected extra from you to the point of that you stop paying.
[11:57.000 --> 12:04.000]  You claim how much they would have stolen from you had their plan ran to fruition.
[12:04.000 --> 12:05.000]  I see.
[12:05.000 --> 12:08.000]  But you don't sue for that amount.
[12:08.000 --> 12:10.000]  You sue for triple.

[12:13.000 --> 12:22.000]  So this gives you a relative, you'll probably give you a claim against the lender in excess of the amount of the original principal.

[12:26.000 --> 12:38.000]  If you claim recision, you have to tender back to the bar or what the lender, what the lender gave to you and all the money he gave to you.

[12:46.000 --> 12:51.000]  Well, yeah, fraud doesn't go away because they supposedly sold the property.

[12:52.000 --> 12:59.000]  What you'll go back and do is maintain that first you need to look at the public record.
[12:59.000 --> 13:12.000]  You've got MERS in the deed of trust, but no signature by the borrower or by the lender authorizing the concessions that would have to be granted by the lender.
[13:12.000 --> 13:17.000]  So that would render MERS section void.
[13:17.000 --> 13:23.000]  Even if that weren't the case, there's another problem with that.
[13:23.000 --> 13:45.000]  Under the paragraph titled transfer of property rights, and it may not have that title on it in a FHA loan, but it's down there just before there's a section that shows the property description, a paragraph above it, will assign the property to the trustee.
[13:45.000 --> 13:55.000]  And what it assigns to the trustee is legal title because the lender holds equitable title, makes him the beneficiary.
[13:55.000 --> 13:58.000]  He gets the benefit from the payments.
[13:58.000 --> 14:07.000]  The trustee gets legal title so that if there's a default, it is the trustee who transfers legal title.
[14:07.000 --> 14:18.000]  But hold on, there's another paragraph right after that one that starts with together with.
[14:18.000 --> 14:34.000]  In a non-MERS document, that'll say together with that from the previous paragraph that assigns the property to the lender, it assigns the property together with all improvements.
[14:34.000 --> 14:42.000]  So that any improvements you make on the property become part of this security.
[14:42.000 --> 14:47.000]  If MERS is in the document, they add something in there.
[14:47.000 --> 14:49.000]  Yeah, the MERS title.
[14:49.000 --> 14:51.000]  Go ahead.
[14:51.000 --> 14:52.000]  Go ahead.
[14:52.000 --> 15:00.000]  It says borrower understands and agrees that MERS holds only legal title to the interest granted by borrower in the security instrument.

[15:11.000 --> 15:20.000]  Okay, now let's go to I think it's 2202 of the business commerce code.
[15:20.000 --> 15:28.000]  I think I'm not sure it was 2202 of the, I think it's 2202 or 2302 of the dog, but I have to look it up again.
[15:28.000 --> 15:46.000]  But there's a section in the commerce code that forbids the lender from requiring the borrower to transfer the property held as collateral to the lender.
[15:46.000 --> 15:50.000]  Now, in a mortgage state, that's exactly what they do.
[15:50.000 --> 15:54.000]  But in Texas, that is forbidden.
[15:54.000 --> 16:04.000]  So the deed of trust calls MERS the beneficiary that grants them equitable title.
[16:04.000 --> 16:14.000]  And then in this next paragraph, it says, oh, they don't really have equitable title, they have legal title, but it granted legal title to the trustee.
[16:14.000 --> 16:16.000]  And that was the idea.
[16:16.000 --> 16:34.000]  But in this one, it's the clear intent of the language of the document that legal title and equitable title be bestowed in the lender in its own right and through MERS as its nominee.
[16:34.000 --> 16:39.000]  That is a specific violation of Texas business commerce code.

[28:09.000 --> 28:19.000]  And the thing that got me to pay more attention to this was I had a friend that I knew for years and she got a job in child protective services.
[28:19.000 --> 28:25.000]  And I saw her a couple years later and asked her how her job was going and she said she had to quit.
[28:25.000 --> 28:32.000]  She tried to get these a two-year-old and a three-year-old away from this drug addict family.
[28:32.000 --> 28:40.000]  And she could not get the judge to remove them and it was in the winter and cold and the two-year-old got out on the porch.
[28:40.000 --> 28:42.000]  The three-year-old went out to get her.
[28:42.000 --> 28:44.000]  They both got locked out on the porch.
[28:44.000 --> 28:53.000]  And while their parents were passed out in a drug induced stupor, those two babies rose to death on the porch.
[28:53.000 --> 28:56.000]  It just broke her heart.
[28:56.000 --> 29:01.000]  She said she absolutely could not do this.
[29:01.000 --> 29:09.000]  So there, and I had someone come to me claiming a preacher had come to him, who ministers in and does.
[29:09.000 --> 29:17.000]  They told me they wanted to do something about child protective services, trying to take these people's kids away from them.
[29:17.000 --> 29:29.000]  And I said, Kim, have that preacher go back and talk to child protective services before he comes out here and starts turning them into demons.
[29:29.000 --> 29:31.000]  Because she may not have the whole story.
[29:31.000 --> 29:33.000]  And he went back.
[29:33.000 --> 29:42.000]  He'd come back later and he said, you're not as dumb as everybody says you are that he talked to child protective services and got a whole different attitude.
[29:42.000 --> 29:48.000]  So before we start going after, you might want to talk to them.
[29:48.000 --> 29:53.000]  And they may have information you're not aware of.

[33:05.000 --> 33:09.000]  He questioned me about why I was doing what I was doing.
[33:09.000 --> 33:11.000]  This is a foreclosure issue.
[33:11.000 --> 33:14.000]  And I'd taken a warranty deed to the property.
[33:14.000 --> 33:16.000]  And the judge was sharp.
[33:16.000 --> 33:18.000]  He figured out something else was going on.
[33:18.000 --> 33:22.000]  And I finally told him that I did a show on legal reform
[33:22.000 --> 33:25.000]  and showed people how to go after public officials.
[33:25.000 --> 33:33.000]  He said, does anyone ever call into your show and talk nice about us?
[33:33.000 --> 33:36.000]  He said, no.
[33:36.000 --> 33:38.000]  But I do sometimes.
[33:38.000 --> 33:43.000]  And my whole point is, is I don't consider all of them bad guys.
[33:43.000 --> 33:47.000]  I knew this woman in Child Protective Services.
[33:47.000 --> 33:51.000]  And while she was doing this, we would talk about it.
[33:51.000 --> 33:55.000]  And it was extremely difficult.
[33:55.000 --> 34:00.000]  They're in a position to where they're trying to protect these children.
[34:00.000 --> 34:04.000]  And you have to understand while they're trying to protect the children,
[34:04.000 --> 34:06.000]  they don't care if you get upset.
[34:06.000 --> 34:08.000]  They don't care if the parents get upset.
[34:08.000 --> 34:10.000]  They don't care about any of that stuff.
[34:10.000 --> 34:12.000]  They don't care about the children.
[34:12.000 --> 34:21.000]  And I thought about what it would be like to be a judge, a family law judge.
[34:21.000 --> 34:31.000]  And a good family law judge is likely to come out of the courtroom with both sides upset at him.
[34:31.000 --> 34:33.000]  Exactly.
[34:33.000 --> 34:38.000]  If he's done his job right, so it is a thankless, difficult job.
[34:38.000 --> 34:48.000]  So, you know, if they have clearly lied, then they belong in prison.
[34:48.000 --> 34:58.000]  Are you sure what you believe they've lied about were things they knew not to be true?
[34:58.000 --> 35:01.000]  That's the critical part.
[35:01.000 --> 35:07.000]  If somebody else has lied to them and they believe what somebody else has told them,
[35:07.000 --> 35:11.000]  and they come and repeat that, that's not perjury.
[35:11.000 --> 35:17.000]  That may be negligence, but it's not perjury.
[35:17.000 --> 35:23.000]  So, are you sure they acted deliberately and maliciously?
[35:23.000 --> 35:29.000]  I'm not saying it was malicious in the case that the fact that they did, they could not.
[35:29.000 --> 35:35.000]  After we disclosed all the documented problems in the psychological barracks,
[35:35.000 --> 35:40.000]  we had to go in just to put them in a home in which the home couldn't keep them.
[35:40.000 --> 35:47.000]  He was the only reason any of this ever came up because he came up with some scratches on his arm
[35:47.000 --> 35:50.000]  at the school counselor when he went in.
[35:50.000 --> 35:52.000]  Oh, yeah, well, I got scratched by my brother long ago.
[35:52.000 --> 35:55.000]  Well, nobody intentionally scratched the kid or anything.
[35:55.000 --> 35:58.000]  But of course, oh my goodness, in the day and age that we lived in,
[35:58.000 --> 36:05.000]  we're even spanking as a common some people's minds that started off this whole investigation.
[36:05.000 --> 36:10.000]  And by the time that they found out why everything was going on,
[36:10.000 --> 36:15.000]  they completely reversed the position and they said, we're sorry.
[36:15.000 --> 36:17.000]  They said, we understand.
[36:17.000 --> 36:20.000]  It was our children in the house that were little.
[36:20.000 --> 36:22.000]  We wouldn't have them in there either.
[36:22.000 --> 36:26.000]  They caught their children in a position they couldn't get out of.
[36:26.000 --> 36:28.000]  They could not find a place for them to go to.
[36:28.000 --> 36:32.000]  They did not have girls in the home or anything else.
[36:32.000 --> 36:34.000]  They couldn't find a place for them.
[36:34.000 --> 36:38.000]  In fact, they were saying, isn't there some home y'all found that can hold them?
[36:38.000 --> 36:39.000]  I said, no.
[36:39.000 --> 36:43.000]  Every home in the state, all the way from the boys' home to the Baptist homes,
[36:43.000 --> 36:50.000]  will not take kids with the problems we would have to disclose to which the point we were in.
[36:50.000 --> 36:56.000]  So with all the things that we had, they chose to put them in a home with another sibling
[36:56.000 --> 36:58.000]  that has multiple other little children,
[36:58.000 --> 37:01.000]  of which he's been specifically regarded that he should never be around,
[37:01.000 --> 37:05.000]  other children, supervised.
[37:05.000 --> 37:07.000]  Hey, that's just one hand.
[37:07.000 --> 37:08.000]  Yeah, okay.
[37:08.000 --> 37:11.000]  This is really a hard thing.
[37:11.000 --> 37:16.000]  And in these situations, you'll, you have,
[37:16.000 --> 37:21.000]  these are situations where you've probably got everybody involved
[37:21.000 --> 37:27.000]  trying to do the best things for these children.
[37:27.000 --> 37:30.000]  You probably have no bad guys here.
[37:30.000 --> 37:32.000]  Everybody trying to do the right thing,
[37:32.000 --> 37:41.000]  but everybody with different positions, perspectives, and agendas.
[37:41.000 --> 37:43.000]  It's hard to say how to fix this,
[37:43.000 --> 37:50.000]  but if someone has clearly and knowingly misrepresented the truth,
[37:50.000 --> 37:56.000]  then absolutely they should be followed.
[37:56.000 --> 38:02.000]  That's all I want, all I haven't done anything except for the fact I want the records.
[38:02.000 --> 38:07.000]  I want to go through it and I'll find any exact instance based off the transcript.

[38:09.000 --> 38:12.000]  They take me off enough when they interviewed my little daughter.

[38:13.000 --> 38:16.000]  That really gets under my skin.

[38:21.000 --> 38:26.000]  One thing, if you're going to be really effective,

[38:37.000 --> 38:39.000]  The police use that against us.
[38:39.000 --> 38:40.000]  They get us angry.
[38:40.000 --> 38:42.000]  They taunt us.
[38:42.000 --> 38:48.000]  And then when you react in any way, you're agitated.
[38:48.000 --> 38:53.000]  And once they accuse you of being agitated, you become totally discredited.
[38:53.000 --> 38:56.000]  They can say anything you want to.
[38:56.000 --> 39:00.000]  And the courts will believe them and pay no attention to you.
[39:00.000 --> 39:05.000]  So the first thing I do is try to get the officer agitated.
[39:05.000 --> 39:07.000]  I'm going to ask him why he's agitated.
[39:07.000 --> 39:09.000]  Are you taking steroids?
[39:09.000 --> 39:17.000]  I told one recently that I thought he was on steroids and he got really defensive.
[39:17.000 --> 39:19.000]  Why do you think I want steroids?
[39:19.000 --> 39:26.000]  Well, your skin is so tight, it looks like if I poked you with a pen, you'd pop like a tick.
[39:26.000 --> 39:29.000]  And he got really agitated.
[39:29.000 --> 39:33.000]  And then I told him that you're getting very agitated.
[39:33.000 --> 39:35.000]  Do you always get agitated as easy?
[39:35.000 --> 39:39.000]  And the guy went back to the car and had his partner come talk to me.
[39:39.000 --> 39:42.000]  So that was wonderful.
[39:42.000 --> 39:48.000]  But don't let him get you angry and don't act from anger.
[39:48.000 --> 39:52.000]  This lady told me when she interviewed me, she thought I was being condescending.
[39:52.000 --> 39:57.000]  When I told her she didn't understand what the laws were that she was predicting.

[39:58.000 --> 40:02.000]  I had a good time when I was interviewing.
[40:02.000 --> 40:05.000]  It actually made my day when she told me I was best.
[40:05.000 --> 40:10.000]  She thought I would appreciate it if I wouldn't be so condescending.
[40:10.000 --> 40:15.000]  I took that as a compliment because she didn't know what she was talking about.
[40:15.000 --> 40:18.000]  She had to bring out what the letter of the law was.

[40:20.000 --> 40:26.000]  And that's when the tables changed from having me under a microscope to the fact that we couldn't put the boy anywhere.

[40:32.000 --> 40:35.000]  All I was trying to do was have him in good faith.

[01:50:05.000 --> 01:50:07.000]  and then when they prosecute people

[01:50:13.000 --> 01:50:15.000]  and some months I'd get

[01:50:33.000 --> 01:50:35.000]  they just weren't collecting at all
[01:50:35.000 --> 01:50:37.000]  not their most
[01:50:37.000 --> 01:50:39.000]  I don't know what happened
[01:50:39.000 --> 01:50:41.000]  but anyway they quit collecting
[01:50:41.000 --> 01:50:43.000]  so I went to the county judge
[01:50:43.000 --> 01:50:45.000]  and I said your honor you know
[01:50:45.000 --> 01:50:47.000]  your prosecutors
[01:50:47.000 --> 01:50:49.000]  aren't doing their job
[01:50:49.000 --> 01:50:51.000]  because they've got
[01:50:51.000 --> 01:50:53.000]  more than $10,000 worth of
[01:50:53.000 --> 01:50:55.000]  checks that I filed on and they're not
[01:50:55.000 --> 01:50:57.000]  collecting them because they're not sending me
[01:50:57.000 --> 01:50:59.000]  any monies if they are collecting them
[01:50:59.000 --> 01:51:01.000]  somebody's keeping the money
[01:51:01.000 --> 01:51:03.000]  and I said I'd like to request to have
[01:51:03.000 --> 01:51:05.000]  all my items
[01:51:05.000 --> 01:51:07.000]  sent back to me with no charge to me
[01:51:07.000 --> 01:51:09.000]  that way I can go to civil court
[01:51:09.000 --> 01:51:11.000]  and file on these people civilly
[01:51:11.000 --> 01:51:13.000]  as criminal with the DA
[01:51:13.000 --> 01:51:15.000]  and the county attorney
[01:51:15.000 --> 01:51:17.000]  but it's civil I can go to
[01:51:17.000 --> 01:51:19.000]  civil court and file
[01:51:19.000 --> 01:51:21.000]  a tort you know they've taken
[01:51:21.000 --> 01:51:23.000]  advantage of me as a merchant
[01:51:25.000 --> 01:51:27.000]  and is that what the judge do
[01:51:27.000 --> 01:51:29.000]  they send me my checks back
[01:51:29.000 --> 01:51:31.000]  yes sir
