[00:00.000 --> 00:06.760] The U.S. military is planning to implant soldiers with microchips under the guise of keeping [00:06.760 --> 00:07.760] them healthy. [00:07.760 --> 00:12.600] And Dr. Catherine Albrecht, in a moment, will tell you why that bad idea is a dangerous [00:12.600 --> 00:16.220] step toward a total surveillance society. [00:16.220 --> 00:17.960] Privacy is under attack. [00:17.960 --> 00:21.560] When you give up data about yourself, you'll never get it back again. [00:21.560 --> 00:26.520] And once your privacy is gone, you'll find your freedoms will start to vanish too. [00:26.520 --> 00:31.600] So protect your rights, say no to surveillance, and keep your information to yourself. [00:31.600 --> 00:34.320] Privacy, it's worth hanging onto. [00:34.320 --> 00:39.840] This message is brought to you by StartPage.com, the private search engine alternative to Google, [00:39.840 --> 00:41.640] Yahoo, and Bing. [00:41.640 --> 00:43.640] Start over with StartPage. [00:43.640 --> 00:47.640] Ten Hut, you soldier, hold out that arm. [00:47.640 --> 00:49.840] It's time for your implant. [00:49.840 --> 00:52.040] Force microchipping of American soldiers? [00:52.040 --> 00:57.560] Shockingly, that's apparently on the military's to-do list, to implant all soldiers with microchips [00:57.560 --> 01:00.440] so their health on the battlefield can be remotely monitored. [01:00.440 --> 01:05.280] Never mind the fact that implanted microchips cause illnesses, like cancer. [01:05.280 --> 01:08.160] There are other reasons to oppose this awful plan. [01:08.160 --> 01:13.640] No American soldier, teacher, cop, or criminal should ever be forcibly chipped and tracked. [01:13.640 --> 01:16.040] No matter how good the government says it is for us. [01:16.040 --> 01:19.960] If we allow this to happen to our soldiers, it won't be long before they come for the [01:19.960 --> 01:20.960] rest of us. [01:20.960 --> 01:25.960] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine. [01:33.960 --> 01:38.360] Do you have trouble selling your ideas and winning people over to your point of view? [01:38.360 --> 01:42.960] I'm Dr. Catherine Albrecht and if you'd like to speak more influentially, I've got an easy [01:42.960 --> 01:46.960] tip that can make you look and sound more persuasive right after this. [01:46.960 --> 01:48.960] Privacy is under attack. [01:48.960 --> 01:52.960] When you give up data about yourself, you'll never get it back again. [01:52.960 --> 01:57.960] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:57.960 --> 01:58.960] So protect your rights. [01:58.960 --> 02:02.960] Say no to surveillance and keep your information to yourself. [02:02.960 --> 02:03.960] Privacy. [02:03.960 --> 02:05.960] It's worth hanging onto. [02:05.960 --> 02:10.960] This message is brought to you by StartPage.com, the private search engine alternative to [02:10.960 --> 02:12.960] Google, Yahoo, and Bing. [02:12.960 --> 02:14.960] Start over with StartPage. [02:14.960 --> 02:16.960] Negotiating. [02:16.960 --> 02:19.960] It's an art few of us ever master. [02:19.960 --> 02:22.960] If you have trouble convincing others to come around to your viewpoint, you may need to [02:22.960 --> 02:24.960] change the way you speak. [02:24.960 --> 02:29.960] Eric Barker, a blogger on human behavior, says one key to influencing others is consistency [02:29.960 --> 02:30.960] of tone. [02:30.960 --> 02:35.960] Stuttering, long pauses, and varying pitch in your voice do not inspire confidence. [02:35.960 --> 02:40.960] A consistently narrow total range, he says, conveys control and certainty. [02:40.960 --> 02:45.960] Whether giving a presentation or negotiating a salary increase with your boss, it can give [02:45.960 --> 02:46.960] you an edge. [02:46.960 --> 02:51.960] It signals focus and determination, qualities people associate with winners. [02:51.960 --> 03:14.960] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine. [03:14.960 --> 03:24.960] Okay, we're back. [03:24.960 --> 03:27.960] I do need to explain. [03:27.960 --> 03:33.960] I've been telling everybody that I had to migrate from the barley to the root, and somebody [03:33.960 --> 03:36.960] here didn't know what I was talking about, so I need to explain it. [03:36.960 --> 03:41.960] When you get old, you can't handle barley anymore, so you got to go with root beer. [03:41.960 --> 03:46.960] And when you're old and fat like I am, you got to go to a diet root beer. [03:46.960 --> 03:51.960] I ran out of that, so I had to doctor my throat at the end there, so I had to get some doctor [03:51.960 --> 03:52.960] pepper. [03:52.960 --> 03:55.960] Okay, enough said on that subject. [03:55.960 --> 04:00.960] Now we're going to Miss Leslie in Pennsylvania. [04:00.960 --> 04:02.960] Hello, Miss Leslie. [04:02.960 --> 04:04.960] Sorry to hold you up so long. [04:04.960 --> 04:06.960] Leslie was on when we started. [04:06.960 --> 04:08.960] Oh, that's fine. [04:08.960 --> 04:10.960] I'm so excited. [04:10.960 --> 04:17.960] Remember like a week and a half ago, I asked you to go over some list of undisputed facts [04:17.960 --> 04:19.960] for a summary judgment? [04:19.960 --> 04:21.960] Yes, I do. [04:21.960 --> 04:29.960] Because what happened with my son's case was they pulled a sentence, an affidavit, and [04:29.960 --> 04:32.960] immediately hit him with a summary judgment. [04:32.960 --> 04:34.960] And of course they lost. [04:34.960 --> 04:38.960] So instead of waiting for that to happen to me, I thought I'd turn the tables while I [04:38.960 --> 04:45.960] worked because I had put in a motion to amend the complaint. [04:45.960 --> 04:48.960] And when I did that, they never answered. [04:48.960 --> 04:54.960] But four days after I sent that notice of summary judgment, I got an answer to the [04:54.960 --> 04:58.960] motion for amending the complaint. [04:58.960 --> 05:01.960] But it was from a different attorney. [05:01.960 --> 05:04.960] Wait, it was from a who? [05:04.960 --> 05:06.960] It was from a different attorney. [05:06.960 --> 05:10.960] It was from the attorney that I had been sending all the documents to. [05:10.960 --> 05:12.960] It was written in my... [05:12.960 --> 05:15.960] Have you barged with these people? [05:15.960 --> 05:17.960] No, not yet. [05:17.960 --> 05:22.960] See, what happened is, I think what happened is they got chicken and passed it along to [05:22.960 --> 05:25.960] a high priced attorney in Silly. [05:25.960 --> 05:28.960] Good, good. [05:28.960 --> 05:30.960] See, what I think is I... [05:30.960 --> 05:34.960] Barged with this attorney, then they'll really be high priced. [05:34.960 --> 05:36.960] See, that's the thing. [05:36.960 --> 05:37.960] They say... [05:37.960 --> 05:38.960] I was right. [05:38.960 --> 05:44.960] They intended to stick an affidavit in and immediately go to summary judgment. [05:44.960 --> 05:46.960] But I beat them to it. [05:46.960 --> 05:51.960] Now they don't know what to do. [05:51.960 --> 05:54.960] So you got your affidavit in first? [05:54.960 --> 05:55.960] Yes. [05:55.960 --> 05:57.960] Oh, wonderful. [05:57.960 --> 06:03.960] So on top of that, what I wanted to tell you is that while I was going through to respond [06:03.960 --> 06:10.960] or reply to their response to my motion for an amended complaint, I came across something. [06:10.960 --> 06:14.960] You know that paragraph 16 about obeying the laws? [06:14.960 --> 06:21.960] I'm using that because they didn't file the assignments of mortgage in the county record [06:21.960 --> 06:25.960] like they're supposed to in Pennsylvania because we had that recent decision with Becker being [06:25.960 --> 06:33.960] MERS that it is against the law for them not to record the mortgage. [06:33.960 --> 06:37.960] They have to do it every single time the interest transfers. [06:37.960 --> 06:38.960] MERS or no MERS. [06:38.960 --> 06:40.960] They have to be recorded. [06:40.960 --> 06:41.960] Oh, wonderful. [06:41.960 --> 06:49.960] So you can claim a breach of contract by breaching the cover of the contract by not falling on [06:49.960 --> 06:50.960] law. [06:50.960 --> 06:53.960] And that goes to capacity. [06:53.960 --> 07:00.960] Yeah, but it goes further than that because it says applicable laws of federal, state, [07:00.960 --> 07:01.960] and local. [07:01.960 --> 07:06.960] But they're talking about in applicable laws, laws that apply to a mortgage, you know, [07:06.960 --> 07:08.960] to residential mortgage, right? [07:08.960 --> 07:09.960] Right. [07:09.960 --> 07:16.960] When they securitize it, it changes the governing law. [07:16.960 --> 07:17.960] Wait a minute. [07:17.960 --> 07:20.960] It changes the governing law? [07:20.960 --> 07:27.960] Yeah, because the law that would govern the note would be under the securities and exchange [07:27.960 --> 07:29.960] tradition, not under killing. [07:29.960 --> 07:33.960] Oh, that's a misunderstanding. [07:33.960 --> 07:37.960] It doesn't change the note. [07:37.960 --> 07:44.960] The note is not what's given to the pass-through trust. [07:44.960 --> 07:46.960] It's the security that's created. [07:46.960 --> 07:48.960] It's given to the pass-through trust. [07:48.960 --> 07:57.960] The note is in the hands of the document custodian, and the servicer always stands as the document [07:57.960 --> 07:58.960] custodian. [07:58.960 --> 08:04.960] Yeah, but doesn't it change the applicable law and the arrangement? [08:04.960 --> 08:12.960] No, the applicable law as concerns the note and deed of trust don't change. [08:12.960 --> 08:15.960] The note's being held by the servicer. [08:15.960 --> 08:24.960] The deed of trust should also be in the hands of either the servicer if the servicer claims [08:24.960 --> 08:26.960] to own the note. [08:26.960 --> 08:27.960] Okay. [08:27.960 --> 08:28.960] I'm sorry. [08:28.960 --> 08:35.960] If the servicer claims to hold the deed of trust, then he would have to also hold the note. [08:35.960 --> 08:44.960] If the servicer is a contractor for the holder of the note, he can't hold deed of trust. [08:44.960 --> 08:46.960] They both have to be together. [08:46.960 --> 08:50.960] That's the Covenant 20. [08:50.960 --> 08:51.960] Right. [08:51.960 --> 08:57.960] So if one's claiming to hold one, one's claiming to hold the other, now that's a breach contract. [08:57.960 --> 09:05.960] But the fact that they wrote a security, they created a security instrument and used the [09:05.960 --> 09:13.960] note as collateral for that security instrument doesn't change the law that governs the note. [09:13.960 --> 09:24.960] Now, when the security instrument is changed, it changes who has interest in the note. [09:24.960 --> 09:29.960] So the requirement to report that still stands. [09:29.960 --> 09:30.960] Right. [09:30.960 --> 09:31.960] Right. [09:31.960 --> 09:32.960] Okay. [09:32.960 --> 09:39.960] Which is a good thing because my friend also is going through a quiet title and we filed a very similar [09:39.960 --> 09:43.960] motion for summary judgment. [09:43.960 --> 09:49.960] And he got a letter today from the attorney threatening him with sanctions because there's been no [09:49.960 --> 09:50.960] discussion. [09:50.960 --> 09:53.960] Oh, goody, bar grievance. [09:53.960 --> 09:56.960] This is what I'm saying. [09:56.960 --> 09:58.960] We hit it right on the money. [09:58.960 --> 10:00.960] That is their tactic. [10:00.960 --> 10:04.960] You have to go to summary judgment immediately as soon as possible. [10:04.960 --> 10:05.960] Okay. [10:05.960 --> 10:09.960] Go to, I fixed bar grievance.net today. [10:09.960 --> 10:10.960] Okay. [10:10.960 --> 10:16.960] I had a couple errors in the questionnaire portion, but I got that part working. [10:16.960 --> 10:24.960] If you go to the bar grievance.net, you can pull up a generic form. [10:24.960 --> 10:25.960] That we're working on. [10:25.960 --> 10:26.960] Don't worry about that. [10:26.960 --> 10:30.960] Just go to the bottom of the form and there's a link says click here. [10:30.960 --> 10:38.960] I will take you to it, the American Bar Association model standards in questionnaire format. [10:38.960 --> 10:39.960] Good. [10:39.960 --> 10:44.960] And you will be surprised how much fun it is to go through that. [10:44.960 --> 10:46.960] Oh, I imagine. [10:46.960 --> 10:50.960] You'll say, did the lawyer do this? [10:50.960 --> 10:51.960] Did he do this? [10:51.960 --> 10:52.960] Did he do this? [10:52.960 --> 10:57.960] And you'll say, I didn't know I could grieve him for that. [10:57.960 --> 10:59.960] Well, can you believe? [10:59.960 --> 11:00.960] I couldn't believe it. [11:00.960 --> 11:01.960] I said, huh? [11:01.960 --> 11:02.960] I told my husband. [11:02.960 --> 11:09.960] I said, oh my gosh, they must really be scared if they drop the case into the lap of another [11:09.960 --> 11:10.960] attorney. [11:10.960 --> 11:12.960] They're probably getting concerned. [11:12.960 --> 11:17.960] You need to look at, tell you bar grievances are so powerful. [11:17.960 --> 11:18.960] Okay. [11:18.960 --> 11:28.960] And they're so sneaky because when you file a grievance against the lawyer, what the [11:28.960 --> 11:33.960] bar says is this is something we will handle. [11:33.960 --> 11:34.960] We will do the case. [11:34.960 --> 11:42.960] You are not to go to that other person because you're learning counsel and the person who's [11:42.960 --> 11:46.960] grieving you is not necessarily learning counsel. [11:46.960 --> 11:52.960] And for you to talk to them would be for you to take unfair advantage of them. [11:52.960 --> 11:57.960] So you are forbidden to talk to them about it. [11:57.960 --> 12:02.960] Well, I had Russell Mortland, a friend of mine called in and he had filed. [12:02.960 --> 12:06.960] He was in a bankruptcy and they changed lawyers halfway through. [12:06.960 --> 12:11.960] And at the end they brought back the first lawyer and he complained to the court that [12:11.960 --> 12:17.960] Mr. Mortland filed three bar grievances against me. [12:17.960 --> 12:22.960] And the next year our law firm almost couldn't get malpractice insurance. [12:22.960 --> 12:26.960] And when we did it nearly doubled. [12:26.960 --> 12:32.960] I said Russell, did you grieve him for that? [12:32.960 --> 12:34.960] He's not allowed to mention it. [12:34.960 --> 12:39.960] So you grieve him and it'll double the malpractice insurance. [12:39.960 --> 12:44.960] From what the lawyer is telling me, one bar grievance, your first year of practice, it [12:44.960 --> 12:46.960] canceled immediately. [12:46.960 --> 12:49.960] Two bar grievances, any one year they'll cancel. [12:49.960 --> 12:52.960] Three, they'll cancel your law firm's malpractice insurance. [12:52.960 --> 12:55.960] And that's what this lawyer was saying. [12:55.960 --> 13:00.960] So it's kind of like you both go into court and he gets behind his table and you get behind [13:00.960 --> 13:01.960] your table. [13:01.960 --> 13:06.960] While you're waiting for the judge, you walk over and kicking what's squaring his behind. [13:06.960 --> 13:15.960] And then go back to your table and he's got to stand there and act like you didn't do it. [13:15.960 --> 13:22.960] We had someone in California, they changed lawyers three times. [13:22.960 --> 13:28.960] Because he kept grieving them. [13:28.960 --> 13:31.960] They use their stinkin' rotten low down lawyer tricks. [13:31.960 --> 13:35.960] Well, we've got some stinkin' rotten low down pro se tricks. [13:35.960 --> 13:40.960] We'll give them a real good reason to hate pro se's. [13:40.960 --> 13:42.960] Yeah, except they're not pro se. [13:42.960 --> 13:43.960] I'm a suey jurist. [13:43.960 --> 13:44.960] I don't represent anyone. [13:44.960 --> 13:51.960] I am me. [13:51.960 --> 13:56.960] Anyway, I just thought I'd bounce that off you and let you know what was going on. [13:56.960 --> 14:01.960] I was really, what would you call it, faked. [14:01.960 --> 14:02.960] Good. [14:02.960 --> 14:08.960] And you know, if we're going to win these, got to take the fight back to them. [14:08.960 --> 14:14.960] We just had a case dismissed with prejudice in San Antonio. [14:14.960 --> 14:21.960] And they're going to file criminal charges against the judge. [14:21.960 --> 14:27.960] He dismissed with prejudice with the grand jury in San Antonio. [14:27.960 --> 14:28.960] It's time. [14:28.960 --> 14:30.960] It's time we took the fight back to him. [14:30.960 --> 14:34.960] Instead of complaining about the judge acting like a criminal, [14:34.960 --> 14:37.960] us treating him like the criminal he is. [14:37.960 --> 14:44.960] Instead of appealing to, you go to a, before a corrupt judge and he renders a bogus decision [14:44.960 --> 14:47.960] and everybody says, oh, that's okay. [14:47.960 --> 14:54.960] You can appeal to a whole panel of corrupt judges and they'll really screw your oil. [14:54.960 --> 14:59.960] I Bushwack the highest criminal district judge in Travis County. [14:59.960 --> 15:04.960] That's the seat of government in Texas with a set of criminal complaints. [15:04.960 --> 15:10.960] And that's what he suggested I do when he suggested that I file complaints with the Sheriff's [15:10.960 --> 15:11.960] Department. [15:11.960 --> 15:13.960] I told him I did that and they threw it in the trash. [15:13.960 --> 15:16.960] Well, you should appeal to the district court for rid of mandamus. [15:16.960 --> 15:18.960] Oh, judge, don't ask me to appeal. [15:18.960 --> 15:20.960] I went through that little routine with him. [15:20.960 --> 15:23.960] And he said, well, you're Mr. Carlson. [15:23.960 --> 15:25.960] I don't think it's quite that bad. [15:25.960 --> 15:28.960] That's because you're not pro se. [15:28.960 --> 15:31.960] I got a better idea, judge. [15:31.960 --> 15:33.960] I'll appeal to the grand jury. [15:33.960 --> 15:35.960] Well, Mr. Colton, you can appeal to the grand jury. [15:35.960 --> 15:36.960] Sure, I can. [15:36.960 --> 15:44.960] I can appeal to the grand jury to indict the sheriff for 3805 penal code felony shielding [15:44.960 --> 15:46.960] from prosecution. [15:46.960 --> 15:53.960] And he sat back in his chair and looked at me with this look on his face like he was clearly [15:53.960 --> 16:00.960] thinking, if I had the bailiff shoot this man, could I get away with it? [16:00.960 --> 16:01.960] Really? [16:01.960 --> 16:03.960] I have a question for you. [16:03.960 --> 16:04.960] Yes. [16:04.960 --> 16:13.960] In the response that I got for the Motion to Amendments, they said that I had no standing [16:13.960 --> 16:19.960] to question the assignment of mortgage. [16:19.960 --> 16:23.960] And I was wondering how to do with that. [16:23.960 --> 16:31.960] If the assignment of mortgage was filed in the county record, absolutely you have standing [16:31.960 --> 16:34.960] to address it. [16:34.960 --> 16:39.960] And the assignment of mortgage affected a claim against your property. [16:39.960 --> 16:44.960] I don't know where they come up with the fact that you don't have standing. [16:44.960 --> 16:45.960] OK, hang on. [16:45.960 --> 16:46.960] We're about to go to break. [16:46.960 --> 16:47.960] This is Randy Kelton. [16:47.960 --> 16:55.960] We'll be right back. [19:10.960 --> 19:13.960] I'm just saying something to get behind. [19:13.960 --> 19:14.960] Norman! [19:14.960 --> 19:15.960] My friend! [19:15.960 --> 19:17.960] Okay, we are back. [19:17.960 --> 19:22.960] Randy Kelton, David Stevens, Eddie Craig with our radio. [19:22.960 --> 19:27.960] And we're talking to Leslie in Pennsylvania. [19:27.960 --> 19:35.960] Okay, any document filed in the county record that affects the title to your property. [19:35.960 --> 19:37.960] That's your property. [19:37.960 --> 19:39.960] It belongs to you. [19:39.960 --> 19:40.960] Right. [19:40.960 --> 19:44.960] And they're changing who has a claim on the property. [19:44.960 --> 19:50.960] Did this guy give any kind of explanation of how he challenged your standing? [19:50.960 --> 19:54.960] Well, he brought up a couple of contract law decisions. [19:54.960 --> 19:59.960] And when I went and I looked them up, they were about construction and all this kind of stuff [19:59.960 --> 20:01.960] about between contractors. [20:01.960 --> 20:03.960] Had nothing to do with mortgages. [20:03.960 --> 20:06.960] Ooh, that gets a bark grievance. [20:06.960 --> 20:07.960] What's that? [20:07.960 --> 20:11.960] Ooh, that's absolutely a no-no. [20:11.960 --> 20:15.960] You quote bad law in the... [20:15.960 --> 20:21.960] Now, we don't live in the legal world, so we wouldn't recognize that. [20:21.960 --> 20:27.960] But in the law, in the world they live in, that is a no-no. [20:27.960 --> 20:31.960] That'll give the judge to thump you pretty quick. [20:31.960 --> 20:32.960] Yes. [20:32.960 --> 20:35.960] I'll give you an example of wine. [20:35.960 --> 20:38.960] We always check the law that they cite. [20:38.960 --> 20:42.960] More than once, I've taken the case that they cited and used it against them. [20:42.960 --> 20:48.960] I had a friend in an IRS issue, couldn't find anything on point. [20:48.960 --> 20:50.960] The other side quotes this case. [20:50.960 --> 20:52.960] He looks it up. [20:52.960 --> 21:01.960] And what they quoted was an example the judge gave of what they shouldn't do. [21:01.960 --> 21:04.960] And then he told what they should do. [21:04.960 --> 21:06.960] These guys didn't read the case. [21:06.960 --> 21:10.960] They just somehow hit on that example and said the judge said this. [21:10.960 --> 21:14.960] Yeah, he didn't say that, but he was saying, don't do it this way. [21:14.960 --> 21:18.960] He was able to use it against them. [21:18.960 --> 21:20.960] This is not uncommon. [21:20.960 --> 21:21.960] Eddie Craig. [21:21.960 --> 21:22.960] That's another thing they did. [21:22.960 --> 21:27.960] When they were talking about intensifying your law, they said it didn't have to be recorded [21:27.960 --> 21:32.960] and all that kind of stuff and they quoted this one case. [21:32.960 --> 21:40.960] And I happen to know that that particular foreclosure case, the man had just gotten the assignment of mortgage [21:40.960 --> 21:43.960] like a month before he filed for foreclosure. [21:43.960 --> 21:48.960] So it was within the 90 days required to record it. [21:48.960 --> 21:53.960] So he's quoting improperly quoting cases. [21:53.960 --> 21:54.960] Yeah. [21:54.960 --> 21:56.960] Here's the problem with that. [21:56.960 --> 22:11.960] Eddie Craig looked up this case and it was Gonzalez v. something and we'd come across it a lot in traffic issues. [22:11.960 --> 22:13.960] And I told him, look up everything. [22:13.960 --> 22:22.960] So he looked up the case and he said, this Gonzalez case, it doesn't have anything to do with traffic. [22:22.960 --> 22:25.960] And the quote they stated, it's not in there. [22:25.960 --> 22:30.960] This case was quoted by the Supreme Court. [22:30.960 --> 22:33.960] So we said, what in the world is going on? [22:33.960 --> 22:36.960] They're picking it from the pleadings of the other party. [22:36.960 --> 22:38.960] Exactly. [22:38.960 --> 22:46.960] This lawyer looked this stuff up, gave it to his paralegal and the paralegal got the wrong citation on the case. [22:46.960 --> 22:55.960] The judge gets the case from a highly respected lawyer, did not have reason to check his case law. [22:55.960 --> 22:57.960] He rules on it. [22:57.960 --> 22:59.960] Court of Appeals gets it. [22:59.960 --> 23:05.960] Nobody goes back in checks and it winds up going on with the Supreme and it's bogus law. [23:05.960 --> 23:13.960] What if it went to appeal and the appeal court caught the error and will come back to this judge? [23:13.960 --> 23:17.960] What are you doing sending us this trash? [23:17.960 --> 23:24.960] This judge is going to be embarrassed and he's going to be really, really unhappy. [23:24.960 --> 23:26.960] This is what they do. [23:26.960 --> 23:28.960] This is primarily what they do. [23:28.960 --> 23:30.960] They can't screw that up. [23:30.960 --> 23:32.960] This, you get a bar grievance. [23:32.960 --> 23:36.960] You should have filed a motion for sanctions. [23:36.960 --> 23:38.960] Okay. [23:38.960 --> 23:41.960] That'll insult him. [23:41.960 --> 23:44.960] That's a bad law, a misquoting law. [23:44.960 --> 23:49.960] You look in that bar grievance questionnaire, that's in there. [23:49.960 --> 23:51.960] Okay. [23:51.960 --> 23:59.960] Every time I see something, I look up some of the stuff that he did because I didn't have time to do a lot of it. [23:59.960 --> 24:08.960] It's been kind of hectic here and it's just that the ones that I did look up and the ones that I knew, they were wrong. [24:08.960 --> 24:10.960] They were wrong. [24:10.960 --> 24:13.960] Let me tell you why that's the case. [24:13.960 --> 24:17.960] Lawyers tend to only do one thing. [24:17.960 --> 24:18.960] They specialize. [24:18.960 --> 24:23.960] They do the same thing over and over so they don't have to do two case law research. [24:23.960 --> 24:29.960] They hate case law research because they're expected to be learned in counsel. [24:29.960 --> 24:38.960] And if they get a case and they don't jeopardize it well and it's been overturned and they don't find that it's been overturned [24:38.960 --> 24:46.960] and they quote it, that'll get them sanctioned, that'll get, that kind of thing is a thing that'll get them disbarred. [24:46.960 --> 24:50.960] So they're terrified of making these kind of mistakes. [24:50.960 --> 24:56.960] That's why it's hard to get when you go to a lawyer and you sound like you know what you're doing. [24:56.960 --> 24:58.960] He's terrified of you. [24:58.960 --> 25:04.960] You're going to ask him to do stuff he hasn't done on all the time. [25:04.960 --> 25:09.960] Now he runs the risk of doing something wrong and he don't want to touch it. [25:09.960 --> 25:13.960] But in this, in this case, that's what April says. [25:13.960 --> 25:17.960] Because we don't know what their playbook is and we don't follow their playbook. [25:17.960 --> 25:22.960] All these lawyers work together all the time and he files one motion. [25:22.960 --> 25:24.960] The other guy files a standard answer. [25:24.960 --> 25:27.960] The other guy files a standard reply. [25:27.960 --> 25:35.960] And they get in court and they argue like, fight like tigers and then they leave and go down the bar and have a beer together. [25:35.960 --> 25:37.960] And they do the same things over and over. [25:37.960 --> 25:42.960] When you force them to have to do this kind of work, they don't have time for one thing. [25:42.960 --> 25:53.960] They're too busy and then they run the risk of having to just come after them and you ought to raise that flag at every opportunity. [25:53.960 --> 25:57.960] They want to call you a pro se. [25:57.960 --> 25:59.960] Turn it back on them. [25:59.960 --> 26:05.960] You want to call them learned counsel and since they're learned counsel, he absolutely knew better. [26:05.960 --> 26:08.960] He did this on purpose. [26:08.960 --> 26:14.960] He thought the court was so ignorant that it wouldn't catch this trash he's putting out. [26:14.960 --> 26:24.960] Yeah, I'm going to have to go back and just reload all the sites and put them exactly and stick it to them right in the brief. [26:24.960 --> 26:29.960] Yeah, bar grievance is really bad news for court for lawyers. [26:29.960 --> 26:31.960] I'm going to have to do something. [26:31.960 --> 26:35.960] I think they do that because we're pro se's and think we can't find out the truth. [26:35.960 --> 26:40.960] Yeah, they don't expect us to really come after them. [26:40.960 --> 26:42.960] Yeah. [26:42.960 --> 26:44.960] Okay, we need to move along. [26:44.960 --> 26:46.960] We've got a bunch of callers. [26:46.960 --> 26:47.960] Okay. [26:47.960 --> 26:48.960] Thank you. [26:48.960 --> 26:50.960] Thank you, Leslie, and keep us posted. [26:50.960 --> 26:51.960] Okay, thanks. [26:51.960 --> 26:52.960] Bye-bye. [26:52.960 --> 26:55.960] Okay, now we're going to go to Stephen, Texas. [26:55.960 --> 26:59.960] I understand you have a question on point. [26:59.960 --> 27:00.960] Yes, sir. [27:00.960 --> 27:01.960] How are you doing, Randy? [27:01.960 --> 27:03.960] I'm doing good. [27:03.960 --> 27:13.960] I just get to hear you guys again. [27:13.960 --> 27:15.960] Yeah, this has been bugging me for several years. [27:15.960 --> 27:19.960] My dad passed away now, going on almost seven years. [27:19.960 --> 27:23.960] We're in about 10 or 11 house up in Harker Heights and clean. [27:23.960 --> 27:27.960] And I remember when he was lingering before, he had several strokes. [27:27.960 --> 27:31.960] He just kept getting, you know, kept getting, and finally he passed. [27:31.960 --> 27:33.960] And I didn't know what to do. [27:33.960 --> 27:36.960] I wasn't listening to you guys at the time. [27:36.960 --> 27:38.960] Didn't even know you guys existed at that time. [27:38.960 --> 27:42.960] And over the past several years, beginning knowledge, just listening because of feeling [27:42.960 --> 27:46.960] the loss of what I should have put, of what it did, and I'd never did. [27:46.960 --> 27:50.960] And when she did call me in to sign some papers, I didn't do that either. [27:50.960 --> 27:51.960] I just did nothing. [27:51.960 --> 27:56.960] And so all these houses, she just got rid of while he was lingering. [27:56.960 --> 28:01.960] And then some she let go and some she traded off after he died. [28:01.960 --> 28:06.960] So I do understand from listening to your show that once one of the parents [28:06.960 --> 28:09.960] do pass away, the siblings must sign off on it. [28:09.960 --> 28:13.960] And if they don't contest it, then they can just keep on proceeding, do whatever [28:13.960 --> 28:15.960] it has it lands into, and that's what happened. [28:15.960 --> 28:19.960] And I was just wondering, is there any recourse for someone like me, [28:19.960 --> 28:21.960] or maybe you can help others that may land in my position. [28:21.960 --> 28:25.960] No, I don't think you didn't have any claim on that property anyway. [28:25.960 --> 28:26.960] Oh, wait a minute. [28:26.960 --> 28:27.960] I didn't. [28:27.960 --> 28:32.960] Were they married long enough that they accrued the property together, [28:32.960 --> 28:36.960] or did he have this property before they were married? [28:36.960 --> 28:38.960] Well, yes and no. [28:38.960 --> 28:41.960] They were together 28, 29 years. [28:41.960 --> 28:44.960] And then there was a little static from his second marriage. [28:44.960 --> 28:47.960] I'm the first son, second son of the first marriage, [28:47.960 --> 28:51.960] and then his first daughter from his second marriage. [28:51.960 --> 28:56.960] It was kind of a static in my ear about what to put on a headstone [28:56.960 --> 28:59.960] and all that, and I just backed away from it all, [28:59.960 --> 29:04.960] and I believe most of that property was acquired during his third marriage, [29:04.960 --> 29:06.960] which is my stepmother, who I love dearly. [29:06.960 --> 29:07.960] Wait a minute. [29:07.960 --> 29:09.960] You're confusing me. [29:09.960 --> 29:11.960] You're running back and forth and up and down. [29:11.960 --> 29:13.960] I don't know who does what. [29:13.960 --> 29:18.960] If all of the property they accrued together, you'll have no claim on it. [29:18.960 --> 29:20.960] That's their property. [29:20.960 --> 29:23.960] So, you know, when the father dies, [29:23.960 --> 29:26.960] you don't necessarily have any claim, [29:26.960 --> 29:29.960] unless the property was accrued before they, [29:29.960 --> 29:33.960] that it wouldn't be part of community property. [29:33.960 --> 29:36.960] Hang on, we'll pick this up on the other side. [29:36.960 --> 29:39.960] This is Randy Kelton, David Stevens, Eddie Craig, [29:39.960 --> 29:45.960] Rue de la Radio, our call-in number, 512-646-1984. [29:45.960 --> 29:47.960] Julius, I see you there. [29:47.960 --> 29:50.960] We're getting down toward an hour and a half, [29:50.960 --> 29:52.960] so it starts to build up toward the end, [29:52.960 --> 29:54.960] so give us a call, get in line. [29:54.960 --> 29:56.960] We'll be right back. [29:59.960 --> 30:02.960] This is Building 7, a 47-story skyscraper [30:02.960 --> 30:04.960] that fell on the afternoon of September 11. [30:04.960 --> 30:06.960] The government says that fire brought it down. [30:06.960 --> 30:09.960] However, 1,500 architects and engineers have concluded [30:09.960 --> 30:11.960] it was a controlled demolition. [30:11.960 --> 30:14.960] Over 6,000 of my fellow service members have given their lives. [30:14.960 --> 30:17.960] 5,000 of my fellow first responders have died. [30:17.960 --> 30:19.960] I'm not a conspiracy theorist. [30:19.960 --> 30:20.960] I'm a structural engineer. [30:20.960 --> 30:21.960] I'm a New York City correction officer. [30:21.960 --> 30:22.960] I'm an Air Force pilot. [30:22.960 --> 30:23.960] I'm the father. [30:23.960 --> 30:24.960] We lost his son. [30:24.960 --> 30:26.960] We're Americans, and we deserve the truth. [30:26.960 --> 30:29.960] Go to RememberBuilding7.org today. [30:29.960 --> 30:33.960] MPUSA.org has moved and expanded its operations [30:33.960 --> 30:35.960] for faster worldwide shipping. [30:59.960 --> 31:02.960] It is so enlightening to listen to 90.1 FM, [31:02.960 --> 31:05.960] but finding things on the Internet isn't so easy, [31:05.960 --> 31:08.960] and neither is finding like-minded people to share it with. [31:08.960 --> 31:11.960] Oh, well, I guess you haven't heard of Brave New Books then. [31:11.960 --> 31:12.960] Brave New Books? [31:12.960 --> 31:15.960] Yes, Brave New Books has all the books and DVDs [31:15.960 --> 31:18.960] you're looking for by authors like Alex Jones, Ron Paul, [31:18.960 --> 31:19.960] and G. Albert Griffin. [31:19.960 --> 31:23.960] They even stock inner food, Berkey products, and Calvin Soaps. [31:23.960 --> 31:26.960] There's no way a place like that exists. [31:26.960 --> 31:27.960] Go check it out for yourself. [31:27.960 --> 31:31.960] It's downtown at 1904 Guadalupe Street, just south of UT. [31:31.960 --> 31:32.960] Oh, by UT? [31:32.960 --> 31:35.960] There's never anywhere to park down there. [31:35.960 --> 31:37.960] Actually, they now offer a free hour of parking [31:37.960 --> 31:41.960] for paying customers at the 500 MLK parking facility [31:41.960 --> 31:43.960] just behind the bookstore. [31:43.960 --> 31:46.960] It does exist, but when are they open? [31:46.960 --> 31:49.960] Monday through Saturday, 11 a.m. to 9 p.m. [31:49.960 --> 31:51.960] and 1 to 6 p.m. on Sundays. [31:51.960 --> 31:55.960] So give them a call at 512-480-2503 [31:55.960 --> 32:17.960] or check out their events page at bravenewbookstore.com. [32:17.960 --> 32:19.960] Okay, we are back. [32:19.960 --> 32:21.960] Randy Kelton, Debbie Stephens, Eddie Craig, [32:21.960 --> 32:27.960] Lula Radio, and we're talking to Steve in Texas. [32:27.960 --> 32:31.960] Okay, Steve, let's get this down. [32:31.960 --> 32:34.960] Did your father have a will? [32:34.960 --> 32:35.960] No. [32:35.960 --> 32:36.960] No, he didn't have a will. [32:36.960 --> 32:39.960] When I found the will, it was blank. [32:39.960 --> 32:40.960] Oh, okay. [32:40.960 --> 32:46.960] So I'm not that up on probate, [32:46.960 --> 32:51.960] but if something happened to me, [32:51.960 --> 32:56.960] I would expect everything I own to go to the wife [32:56.960 --> 33:01.960] and not have the courts come in and interfere. [33:01.960 --> 33:05.960] But better if what we really suggest [33:05.960 --> 33:07.960] is to put everything into trust. [33:07.960 --> 33:11.960] If you've got things in a trust, then there's no probate. [33:11.960 --> 33:13.960] There's no interference. [33:13.960 --> 33:15.960] There's none of that nonsense. [33:15.960 --> 33:19.960] But I doubt that you would have any claim, [33:19.960 --> 33:25.960] especially if it's already passed. [33:25.960 --> 33:27.960] But frankly, I really don't know. [33:27.960 --> 33:28.960] I don't know probate. [33:28.960 --> 33:30.960] I've never looked into probate. [33:30.960 --> 33:32.960] We need Eddie on. [33:32.960 --> 33:36.960] Eddie's researching probate right now. [33:36.960 --> 33:41.960] So maybe he should be back next week. [33:41.960 --> 33:43.960] A friend of ours passed away [33:43.960 --> 33:46.960] and Eddie was named the executor, [33:46.960 --> 33:49.960] so he had to do a lot of research to come up to speed. [33:49.960 --> 33:52.960] That's why he's not here at night. [33:52.960 --> 33:55.960] So maybe next week if he's on, [33:55.960 --> 33:57.960] that'd be a good question to ask him. [33:57.960 --> 34:00.960] Yeah, I'm probably seeing him at the seminar on Sunday [34:00.960 --> 34:02.960] down at Bradney Book. [34:02.960 --> 34:03.960] Oh, good. [34:03.960 --> 34:04.960] Ask him down there. [34:04.960 --> 34:06.960] He's been doing a lot of work in that area. [34:06.960 --> 34:07.960] Uh-huh. [34:07.960 --> 34:09.960] My stepmother, you guys have been very helpful in that [34:09.960 --> 34:11.960] and the transportation code and criminal code, [34:11.960 --> 34:13.960] by the way, and that didn't go a long way [34:13.960 --> 34:15.960] with me following my own motions [34:15.960 --> 34:17.960] and doing some of the homework to get what I want [34:17.960 --> 34:20.960] in court and getting my results. [34:20.960 --> 34:25.960] But I remember when my stepmother called me [34:25.960 --> 34:27.960] if she wanted me to sign some papers [34:27.960 --> 34:29.960] and had I would have signed them, [34:29.960 --> 34:32.960] I probably would have not agreed to [34:32.960 --> 34:35.960] what she probably wanted me to sign. [34:35.960 --> 34:37.960] I just didn't do anything. [34:37.960 --> 34:40.960] I just stepped away from it, really, [34:40.960 --> 34:43.960] and I kept getting so much static from other family members. [34:43.960 --> 34:45.960] I didn't do anything. [34:45.960 --> 34:47.960] Well, there's probably little you can do. [34:47.960 --> 34:51.960] You probably had an opportunity that has passed. [34:51.960 --> 34:53.960] Is there a statute of limitations [34:53.960 --> 34:55.960] or anything that goes along with any of that? [34:55.960 --> 34:56.960] No, no. [34:56.960 --> 34:58.960] I don't think that'll go into statute of limitations at all. [34:58.960 --> 35:01.960] There would be two years anyway. [35:01.960 --> 35:03.960] If you had a civil action, [35:03.960 --> 35:06.960] normally you have two years on a civil action, [35:06.960 --> 35:09.960] but I don't even think you'd have a claim here. [35:09.960 --> 35:10.960] Although I don't know. [35:10.960 --> 35:12.960] We'd have to ask any of that one. [35:12.960 --> 35:14.960] Some were mortgaged out [35:14.960 --> 35:18.960] and some were probably they were already paid for. [35:18.960 --> 35:19.960] Okay, okay. [35:19.960 --> 35:21.960] We need to move ahead. [35:21.960 --> 35:22.960] Okay, thank you. [35:22.960 --> 35:24.960] Okay, thank you, Steve. [35:24.960 --> 35:30.960] Okay, we are going to Julius in Texas. [35:30.960 --> 35:32.960] Hello, Mr. Julius. [35:32.960 --> 35:33.960] Hi, Randy. [35:33.960 --> 35:34.960] How are you doing? [35:34.960 --> 35:36.960] I am doing good. [35:36.960 --> 35:37.960] You sound good. [35:37.960 --> 35:41.960] You did a good little seminar on us with mortgage. [35:41.960 --> 35:44.960] I find that very interesting. [35:44.960 --> 35:47.960] Very good research that you've done in death. [35:47.960 --> 35:50.960] And keep up the good work. [35:50.960 --> 35:56.960] Well, I've stayed busy with it. [35:56.960 --> 35:57.960] Excellent. [35:57.960 --> 36:00.960] I had a question about, [36:00.960 --> 36:04.960] I'm following along those lines that you put me on with sedition. [36:04.960 --> 36:09.960] And what I was thinking of doing, see what you think of this is the, [36:09.960 --> 36:16.960] I was wanting to write the head judge of the City of Austin Municipal Court [36:16.960 --> 36:20.960] and ask her, I think it's a little in the key or something, [36:20.960 --> 36:24.960] and ask her in a letter, [36:24.960 --> 36:35.960] to what authority do your judges have for violating and ignoring the laws of our land [36:35.960 --> 36:42.960] meant to govern your behavior and to protect the people? [36:42.960 --> 36:47.960] Something simple, you know, a letter off to the judge. [36:47.960 --> 36:49.960] Okay, okay, wait a minute. [36:49.960 --> 36:54.960] The question lacks referential index. [36:54.960 --> 36:55.960] Okay. [36:55.960 --> 36:57.960] What the heck are you talking about? [36:57.960 --> 37:01.960] Okay, I'm talking about the City of Austin, the Municipal Court, [37:01.960 --> 37:07.960] which is always, you know, prosecuting traffic tickets, et cetera, et cetera, [37:07.960 --> 37:14.960] and they have these judges that go really nearly making up their own rules or laws [37:14.960 --> 37:20.960] that don't abide by the Code of Criminal Procedure, for instance. [37:20.960 --> 37:25.960] And, you know, they just make up their own ruling, their own laws, [37:25.960 --> 37:32.960] and it's not conforming to even the rules of the City of Austin Municipal Court. [37:32.960 --> 37:37.960] So they violate their own rules as well as the Code of Criminal Procedure, [37:37.960 --> 37:44.960] and, you know, there's certain procedural guidelines that protect the people [37:44.960 --> 37:47.960] and they violate with impunity. [37:47.960 --> 37:49.960] Oh, absolutely. [37:49.960 --> 37:52.960] So you're going to send a letter to the judge, [37:52.960 --> 37:56.960] asking what authority they have to violate law? [37:56.960 --> 37:58.960] You know, I was... [37:58.960 --> 38:00.960] I don't know, I mean... [38:00.960 --> 38:06.960] But wait, hold on, Julius, can you move the mic a little away from your mouth? [38:06.960 --> 38:08.960] It's kind of booming in the mic. [38:08.960 --> 38:09.960] How's this? [38:09.960 --> 38:11.960] Much better. [38:11.960 --> 38:12.960] Okay. [38:12.960 --> 38:15.960] So, yeah, just something because... [38:15.960 --> 38:17.960] Here's the point I'm getting at. [38:17.960 --> 38:21.960] I looked at sedition in the Texas Penal Code. [38:21.960 --> 38:28.960] Below that is a seditious institution. [38:28.960 --> 38:34.960] So I'm wondering, now, I couldn't probably do this on my own, [38:34.960 --> 38:43.960] but is there a way to get a group of people to file these charges against an organization [38:43.960 --> 38:49.960] that is run amok by not following law or making up their own laws? [38:49.960 --> 38:53.960] And what gives them the authority to do that? [38:53.960 --> 38:57.960] Okay, you kind of already know the answer to that last question. [38:57.960 --> 39:00.960] Nothing gives them authority to do that. [39:00.960 --> 39:01.960] Exactly. [39:01.960 --> 39:06.960] Now, they can do that because nobody's doing anything to stop them. [39:06.960 --> 39:10.960] Now, that goes to remedies. [39:10.960 --> 39:14.960] There are remedies for it, but we have to exercise them. [39:14.960 --> 39:25.960] And one thing to do is petition the district court to institute a court of inquiry. [39:25.960 --> 39:36.960] Look in Chapter 52, Code of Criminal Procedure, Court of Inquiry. [39:36.960 --> 39:43.960] Now, that court of inquiry is similar to an examining trial. [39:43.960 --> 39:44.960] Okay. [39:44.960 --> 39:57.960] Except a court of inquiry, that statute was put in specifically for this kind of issue [39:57.960 --> 40:09.960] where a governmental entity or agency is violating laws or rules governing their office. [40:09.960 --> 40:14.960] Now, I have petitioned for a number of them, and a judge has never done it. [40:14.960 --> 40:18.960] But then we can hammer the judge and give them grief. [40:18.960 --> 40:23.960] If we don't force them to do their jobs, they're not going to do the job. [40:23.960 --> 40:24.960] Exactly. [40:24.960 --> 40:27.960] So far, we haven't been forcing them. [40:27.960 --> 40:36.960] But we as pro-say individuals, we have powers and abilities far beyond those of two-bit [40:36.960 --> 40:39.960] municipal judges. [40:39.960 --> 40:45.960] And judicial conduct complaint is one way we start hammering them with judicial conduct complaints. [40:45.960 --> 40:48.960] That's likely to get them sapped. [40:48.960 --> 40:51.960] These judges are afraid of the judicial conduct commission. [40:51.960 --> 41:01.960] They're afraid that the state commission on judicial conduct never punishes higher-level [41:01.960 --> 41:09.960] elected judges, that they sacrifice municipal judges and JPs to make it look like they're [41:09.960 --> 41:10.960] doing something. [41:10.960 --> 41:12.960] And they're right. [41:12.960 --> 41:17.960] That's exactly what the state commission does. [41:17.960 --> 41:23.960] So these municipal judges and justices of the peace should be afraid of judicial conduct [41:23.960 --> 41:28.960] commission because they need some lambs to lead to the slaughter. [41:28.960 --> 41:29.960] Right. [41:29.960 --> 41:32.960] So let's have them out. [41:32.960 --> 41:34.960] I agree. [41:34.960 --> 41:39.960] If you're after them, have fun with it. [41:39.960 --> 41:44.960] Go find something to ask them to do that they're required to do and get them not to do it. [41:44.960 --> 41:46.960] Just so you can beat them up. [41:46.960 --> 41:49.960] I do that with open records all the time. [41:49.960 --> 41:50.960] Right. [41:50.960 --> 42:00.960] I go in there and ask them questions in a way that will make them want to ask me why I want [42:00.960 --> 42:03.960] to see these records. [42:03.960 --> 42:05.960] I can see them. [42:05.960 --> 42:07.960] I'm always thinking, go ahead. [42:07.960 --> 42:08.960] Go ahead. [42:08.960 --> 42:09.960] Ask me. [42:09.960 --> 42:10.960] Ask me. [42:10.960 --> 42:13.960] Because as soon as they ask me, that's class A misdemeanor. [42:13.960 --> 42:16.960] Gotcha, Bubba. [42:16.960 --> 42:20.960] One of my favorites is Randall County. [42:20.960 --> 42:25.960] If you can get them to step across the line, I demanded to see some records and she didn't [42:25.960 --> 42:28.960] want to get me the physical records. [42:28.960 --> 42:32.960] She wanted me to look at the computer and I told her that's not good enough. [42:32.960 --> 42:38.960] I need to know not only what is in the record, but what's not in the record. [42:38.960 --> 42:44.960] And if I look on your computer and I don't find it and then I raise an issue about it, [42:44.960 --> 42:50.960] all of a sudden it'll appear there and somebody will say, oh, well, it was in the record. [42:50.960 --> 42:52.960] It just didn't get scanned. [42:52.960 --> 42:56.960] So we're not going to go there. [42:56.960 --> 43:00.960] When I don't find the record that I'm looking for, I'm going to give you an information [43:00.960 --> 43:01.960] request for it. [43:01.960 --> 43:04.960] She said, well, if I don't have it, I can't provide it for you. [43:04.960 --> 43:05.960] I said, that's true. [43:05.960 --> 43:10.960] But you can provide an answer that says we have no records responsive to your request [43:10.960 --> 43:13.960] and I can prove it wasn't here at this day at this time. [43:13.960 --> 43:16.960] Well, I don't have the personnel and I don't have time to mess with you. [43:16.960 --> 43:21.960] You'll just have to look at me on the computer. [43:21.960 --> 43:22.960] Don't go anywhere. [43:22.960 --> 43:24.960] I said, wait right there. [43:24.960 --> 43:26.960] Don't go anywhere. [43:26.960 --> 43:30.960] Somebody's going to want to talk to you and I went and pushed the door open pointing at [43:30.960 --> 43:31.960] this sergeant. [43:31.960 --> 43:33.960] You come here. [43:33.960 --> 43:35.960] They hate being something. [43:35.960 --> 43:38.960] That got really interesting. [43:38.960 --> 43:40.960] And this is what I suggest. [44:59.960 --> 45:04.960] The Oklahoma City bombing, top 10 reasons to question the official story, [45:04.960 --> 45:08.960] reason number one, John Doe number two and other accomplices. [45:08.960 --> 45:12.960] On the day of the bombing, nearly all of the witnesses that saw Tim McVeigh and the [45:12.960 --> 45:16.960] Ryder truck report that he was accompanied by other perpetrators. [45:16.960 --> 45:21.960] The FBI and federal prosecutors insist that Tim McVeigh alone delivered the Ryder truck [45:21.960 --> 45:24.960] bomb to the Murrah building and detonated it. [45:24.960 --> 45:28.960] The only witness the government produced to place McVeigh at the building that morning, [45:28.960 --> 45:32.960] Dana Bradley, who lost her children and one of her legs in the bombing, [45:32.960 --> 45:36.960] testified that she saw McVeigh with another man, the fateful John Doe number two, [45:36.960 --> 45:38.960] exiting the Ryder truck. [45:38.960 --> 45:42.960] While at least 15 other witnesses claim to have seen McVeigh with other perpetrators [45:42.960 --> 45:48.960] the day of the bombing, no less than 226 witnesses placed him with other men in the [45:48.960 --> 45:52.960] days before the bombing, including when he rented the Ryder truck, [45:52.960 --> 45:56.960] and in some cases have positively identified the other perpetrators. [47:11.960 --> 47:15.960] I sent everybody an email [47:15.960 --> 47:20.960] asking for their mailing address so I can mail off this soap [47:20.960 --> 47:23.960] I've only got one back so far, so [47:23.960 --> 47:26.960] give me a good address so I can get this to you [47:26.960 --> 47:31.960] We want really, really squeaky clean listeners [47:31.960 --> 47:33.960] Okay, right [47:33.960 --> 47:38.960] Anyway, we sure can use any donations [47:38.960 --> 47:40.960] We greatly appreciate them [47:40.960 --> 47:44.960] and everybody who donates until I run out of soap [47:44.960 --> 47:49.960] I will send some samples of the soaps that I'm making [47:49.960 --> 47:53.960] and I hope you find them useful [47:53.960 --> 48:00.960] and so, you know, if you got five or ten bucks laying around [48:00.960 --> 48:04.960] if you didn't go out to dinner today and you cooked at home [48:04.960 --> 48:06.960] or you would have spent on dinner, send it to us [48:06.960 --> 48:09.960] it'll help us get this equipment upgraded [48:09.960 --> 48:12.960] and get us up to the next level [48:12.960 --> 48:16.960] and we'll try to keep producing high quality shows [48:16.960 --> 48:21.960] I have a couple of really good guests lined up here [48:21.960 --> 48:26.960] for the near future that will be well worth your time listening to [48:26.960 --> 48:30.960] So, to quote a preacher I heard once [48:30.960 --> 48:33.960] I don't want to hear that change, Jean Lynn [48:33.960 --> 48:36.960] I want to hear that paper rustling [48:36.960 --> 48:40.960] Okay, Julius [48:40.960 --> 48:41.960] Yes [48:41.960 --> 48:43.960] Where were we? [48:43.960 --> 48:47.960] I think... [48:47.960 --> 48:52.960] We were talking about how to hammer judges [48:52.960 --> 48:55.960] I'm really working on that right now [48:55.960 --> 49:01.960] I have a set of complaints against or a single complaint [49:01.960 --> 49:07.960] against the district, I mean the Chief Justice of the Supreme [49:07.960 --> 49:11.960] and here, like I was talking about, I set him up [49:11.960 --> 49:15.960] I always like it best when you go in and set him up for something [49:15.960 --> 49:20.960] Oh, I'm sorry, when we went out we were talking about the clerk [49:20.960 --> 49:21.960] Right [49:21.960 --> 49:26.960] It's about setting him up, I go in and ask him to see records [49:26.960 --> 49:31.960] and if I'm actually setting up a jurisdiction [49:31.960 --> 49:38.960] I'll ask to see something that not only will they not want to show it to me [49:38.960 --> 49:43.960] but they're going to be wondering, why does he want to see that [49:43.960 --> 49:46.960] when I ask the probation department in Wise County [49:46.960 --> 49:50.960] to see all of their financial records [49:50.960 --> 49:52.960] They got real excited, who are you? [49:52.960 --> 49:55.960] I'm Randall Kelton, who are you with? [49:55.960 --> 49:58.960] Now look behind me, look back, nobody back there [49:58.960 --> 50:01.960] and they're not sure if I'm joking or not [50:01.960 --> 50:04.960] but they're real concerned because I want to see their financial records [50:04.960 --> 50:08.960] and I got the director to ask me why I wanted to see them [50:08.960 --> 50:10.960] and I told him, don't ask me that [50:10.960 --> 50:11.960] and he said, I'm asking you that [50:11.960 --> 50:13.960] and I told him not to ask me that [50:13.960 --> 50:15.960] he said, if you don't tell me why you want to see them [50:15.960 --> 50:18.960] I'm not going to show them to you [50:18.960 --> 50:20.960] That was an oops [50:20.960 --> 50:24.960] I flipped my phone open to 911 immediately [50:24.960 --> 50:26.960] That is great fun [50:26.960 --> 50:29.960] Now if we're setting up a, if we really want to, you know [50:29.960 --> 50:32.960] there I was just trying to get them to give me what I needed [50:32.960 --> 50:35.960] If I'm after them, go in there [50:35.960 --> 50:39.960] or send them letters, better if you do this by mail [50:39.960 --> 50:41.960] sharp shooting [50:41.960 --> 50:44.960] If they can look at you [50:44.960 --> 50:46.960] they're going to hallucinate [50:46.960 --> 50:53.960] and decide that they can take a measure of you [50:53.960 --> 50:55.960] and decide that they can handle you [50:55.960 --> 51:00.960] if they never see you, you're an unknown quality [51:00.960 --> 51:04.960] and it got somebody out there sharp shooting them [51:04.960 --> 51:07.960] sharp shooting them [51:07.960 --> 51:10.960] my tang got toggled [51:10.960 --> 51:14.960] Send them a request for something [51:14.960 --> 51:20.960] The one I like to send is a Scoping Content request [51:20.960 --> 51:22.960] It's about four pages [51:22.960 --> 51:25.960] we'll hold a bunch of stuff in there [51:25.960 --> 51:34.960] and I invariably get a request from the custodium [51:34.960 --> 51:36.960] to narrow my request [51:36.960 --> 51:40.960] and that gets a criminal complaint immediately [51:40.960 --> 51:45.960] They're seeing three pages of stuff I'm asking them for [51:45.960 --> 51:51.960] but they're not smart enough to realize I'm not asking them for any content [51:51.960 --> 51:55.960] the scope and substantive content [51:55.960 --> 51:58.960] and I ask them what kind of records do you keep [51:58.960 --> 51:59.960] where do you keep it [51:59.960 --> 52:01.960] what do you keep in it [52:01.960 --> 52:02.960] what do you call them [52:02.960 --> 52:04.960] what format do you keep in it [52:04.960 --> 52:07.960] just a whole bunch of stuff [52:07.960 --> 52:10.960] and the other answer [52:10.960 --> 52:12.960] the other request I get from it [52:12.960 --> 52:15.960] is they will say they're not sure what I'm asking for [52:15.960 --> 52:18.960] can I explain [52:18.960 --> 52:20.960] and I say no [52:20.960 --> 52:24.960] I'll give them a criminal complaint for that [52:24.960 --> 52:27.960] don't ask me to explain [52:27.960 --> 52:29.960] ask the legislature to explain [52:29.960 --> 52:32.960] because I took this right out of the Open Records Act [52:32.960 --> 52:35.960] this is the section of the act that says [52:35.960 --> 52:39.960] these records are open for inspection [52:39.960 --> 52:44.960] and it's a section that talks about [52:44.960 --> 52:47.960] what kinds of records they keep [52:47.960 --> 52:49.960] how they keep them, where they keep them [52:49.960 --> 52:51.960] how they name them [52:51.960 --> 52:53.960] there's a whole list of stuff [52:53.960 --> 52:57.960] that is declared open for public inspection [52:57.960 --> 52:59.960] so when they ask me a question about it [52:59.960 --> 53:00.960] I tell them [53:00.960 --> 53:02.960] go ask the legislature [53:02.960 --> 53:03.960] they passed it [53:03.960 --> 53:04.960] I didn't write it [53:04.960 --> 53:06.960] I just dropped it in the document [53:06.960 --> 53:08.960] and then I file against them [53:08.960 --> 53:11.960] wow it's really nitpicking [53:11.960 --> 53:16.960] and I don't care what prosecutor does [53:16.960 --> 53:20.960] matter of fact I hope he doesn't do what I ask him to do [53:20.960 --> 53:25.960] and I know this is a different paradigm [53:25.960 --> 53:27.960] for most people [53:27.960 --> 53:31.960] but if we're going to work the politics [53:31.960 --> 53:33.960] of the system [53:33.960 --> 53:36.960] we're going to have to get comfortable with this part [53:36.960 --> 53:39.960] and it takes doing your homework [53:39.960 --> 53:43.960] you can't play chess until you learn the rules [53:43.960 --> 53:46.960] and the strategies [53:46.960 --> 53:48.960] so first we have to learn the rules [53:48.960 --> 53:51.960] and I'm hoping people read the codes [53:51.960 --> 53:55.960] and then we talk about the strategies [53:55.960 --> 53:57.960] and the strategies [53:57.960 --> 54:00.960] the primary strategies to use on public officials [54:00.960 --> 54:05.960] is never ever get in a confrontation with them [54:07.960 --> 54:10.960] if they try to initiate a confrontation [54:10.960 --> 54:14.960] go to the next level, go to somebody else [54:14.960 --> 54:19.960] and get the other person to go after the first person [54:19.960 --> 54:22.960] they hate that [54:22.960 --> 54:25.960] the district clerk [54:25.960 --> 54:27.960] she was an elected official [54:27.960 --> 54:31.960] and she felt like she was kind of immune from [54:31.960 --> 54:33.960] I know in Randall County the district attorney [54:33.960 --> 54:36.960] thought he was bad as God in the building [54:36.960 --> 54:40.960] until I told him I need security [54:40.960 --> 54:43.960] and the prosecutor said [54:43.960 --> 54:47.960] well Mr. Kelton, you're very secure here [54:47.960 --> 54:49.960] well you're not [54:49.960 --> 54:53.960] I want security to arrest you [54:53.960 --> 54:55.960] don't go anywhere [54:55.960 --> 54:57.960] and I go down the hall and Eddie was with me that day [54:57.960 --> 54:59.960] that's the first time he had ever been with me [54:59.960 --> 55:02.960] when I did something like that [55:02.960 --> 55:05.960] and that's how you tell when somebody's made of [55:05.960 --> 55:07.960] he was standing behind me [55:07.960 --> 55:09.960] when I told the prosecutor that [55:09.960 --> 55:12.960] and I stormed down to the end of the hall [55:12.960 --> 55:14.960] all the securities [55:14.960 --> 55:16.960] they're down there but they're keeping clear [55:16.960 --> 55:18.960] and I went out there getting amongst them [55:18.960 --> 55:21.960] I need you to go out here and arrest the prosecutor and attorney [55:21.960 --> 55:23.960] well who can arrest the attorney [55:23.960 --> 55:25.960] then give me a real policeman [55:25.960 --> 55:29.960] and I'm just being as obnoxious as I can be [55:29.960 --> 55:33.960] and Eddie didn't back up one inch [55:33.960 --> 55:35.960] yes [55:35.960 --> 55:37.960] so I was really pleased with that [55:37.960 --> 55:41.960] it's better if you do it from a distance [55:41.960 --> 55:43.960] ask him to do something that you don't want him to do [55:43.960 --> 55:46.960] I asked the prosecutor [55:46.960 --> 55:49.960] to take my really nitpicking complaint [55:49.960 --> 55:52.960] against a local judge [55:52.960 --> 55:54.960] that wouldn't let me see some record [55:54.960 --> 55:56.960] I don't even know what it was [55:56.960 --> 55:59.960] wouldn't let me see the hearings in the jail [55:59.960 --> 56:04.960] and he did exactly what I wanted him to [56:04.960 --> 56:07.960] he refused to give it to the grand jury [56:07.960 --> 56:09.960] refused to even take the complaint [56:09.960 --> 56:11.960] so wonderful [56:11.960 --> 56:14.960] now I get to be really obnoxious [56:14.960 --> 56:18.960] go get to go ask these guys to arrest you [56:18.960 --> 56:20.960] and when they don't want to arrest you [56:20.960 --> 56:22.960] then I file complaints against them [56:22.960 --> 56:25.960] and just making nuisance of myself [56:25.960 --> 56:27.960] but you know [56:27.960 --> 56:29.960] and I enjoy doing that too much [56:29.960 --> 56:31.960] so I've gotten to where I try to stay away from it [56:31.960 --> 56:35.960] but if you do that by mail [56:35.960 --> 56:38.960] it makes them nuts [56:38.960 --> 56:40.960] they have no idea what to do [56:40.960 --> 56:42.960] no idea how to handle you [56:42.960 --> 56:44.960] they can't see you [56:44.960 --> 56:46.960] they can't talk to you [56:46.960 --> 56:50.960] there's a couple of things to know [56:50.960 --> 56:52.960] if you file against them [56:52.960 --> 56:54.960] if you're working in the lower court [56:54.960 --> 56:58.960] and they do stupid things [56:58.960 --> 57:00.960] as you go up higher [57:00.960 --> 57:02.960] they're a lot more cautious [57:02.960 --> 57:05.960] but if you file a complaint against the [57:05.960 --> 57:09.960] head judge of the municipal courts [57:09.960 --> 57:13.960] expect a call from the police department [57:13.960 --> 57:17.960] and whatever you do [57:17.960 --> 57:20.960] do not agree to go down there and talk to them [57:20.960 --> 57:23.960] I tell them not going to happen [57:23.960 --> 57:25.960] you want to talk to me [57:25.960 --> 57:27.960] you need me somewhere neutral [57:27.960 --> 57:30.960] I had my local chief of police [57:30.960 --> 57:32.960] who was a personal friend of mine [57:32.960 --> 57:37.960] and two sheriff's deputies come to my house one day [57:37.960 --> 57:39.960] wanted to talk to me [57:39.960 --> 57:41.960] and Tom stepped in the door [57:41.960 --> 57:43.960] and I'm sorry a sheriff [57:43.960 --> 57:45.960] the elected sheriff and a deputy [57:45.960 --> 57:48.960] I never did know what it was about [57:48.960 --> 57:51.960] the chief stepped in [57:51.960 --> 57:54.960] and the [01:01:36.960 --> 01:01:39.960] if you answered Americans you just came up short [01:01:39.960 --> 01:01:41.960] I'm Dr. Catherine Albrecht [01:01:41.960 --> 01:01:43.960] in a moment I'll tell you which country [01:01:43.960 --> 01:01:46.960] has the tallest population in the world [01:01:46.960 --> 01:01:48.960] privacy is under attack [01:01:48.960 --> 01:01:50.960] when you give up data about yourself [01:01:50.960 --> 01:01:52.960] you'll never get it back again [01:01:52.960 --> 01:01:54.960] and once your privacy is gone [01:01:54.960 --> 01:01:57.960] you'll find your freedoms will start to vanish too [01:01:57.960 --> 01:01:58.960] so protect your rights [01:01:58.960 --> 01:02:00.960] say no to surveillance [01:02:00.960 --> 01:02:02.960] and keep your information to yourself [01:02:02.960 --> 01:02:03.960] privacy [01:02:03.960 --> 01:02:05.960] it's worth hanging on to [01:02:05.960 --> 01:02:08.960] this message is brought to you by startpage.com [01:02:08.960 --> 01:02:10.960] this is a private search engine alternative [01:02:10.960 --> 01:02:12.960] to Google, Yahoo and Bing [01:02:12.960 --> 01:02:15.960] start over with start page [01:02:15.960 --> 01:02:18.960] when you think tall you probably think America [01:02:18.960 --> 01:02:22.960] tall buildings, tall athletes, tall reputation right? [01:02:22.960 --> 01:02:24.960] but to find the world's tallest people [01:02:24.960 --> 01:02:26.960] you actually have to look to tiny Holland [01:02:26.960 --> 01:02:27.960] that's right [01:02:27.960 --> 01:02:29.960] the Dutch aren't just taller than Americans [01:02:29.960 --> 01:02:31.960] they tower over us [01:02:31.960 --> 01:02:33.960] the average Dutch man is six foot one [01:02:33.960 --> 01:02:35.960] followed by the Danish at six feet [01:02:35.960 --> 01:02:37.960] Americans measure up at just five foot ten [01:02:37.960 --> 01:02:39.960] so what is Holland doing right? [01:02:39.960 --> 01:02:42.960] well first the Netherlands has one of the world's healthiest diets [01:02:42.960 --> 01:02:45.960] particularly at the stages of life that matter most [01:02:45.960 --> 01:02:47.960] prenatal and early childhood [01:02:47.960 --> 01:02:49.960] equally important people of all income groups [01:02:49.960 --> 01:02:51.960] practice healthy habits [01:02:51.960 --> 01:02:53.960] isn't it time we did the same here? [01:02:53.960 --> 01:02:55.960] I'm Dr. Catherine Albrecht for startpage.com [01:02:55.960 --> 01:03:08.960] the world's most private search engine [01:03:25.960 --> 01:03:36.960] okay we are back [01:03:36.960 --> 01:03:38.960] Randy Kelton, David Stevens, Eddie Craig [01:03:38.960 --> 01:03:40.960] the rule of law radio [01:03:40.960 --> 01:03:43.960] and we're talking to Julius in Texas [01:03:43.960 --> 01:03:46.960] and this is my favorite subject [01:03:46.960 --> 01:03:48.960] and I'm glad you brought it up [01:03:48.960 --> 01:03:51.960] because in what I've been doing [01:03:51.960 --> 01:03:53.960] that's been a long time [01:03:53.960 --> 01:03:55.960] searching out the law [01:03:55.960 --> 01:03:57.960] and then it became clear that [01:03:57.960 --> 01:03:59.960] the law just was not enough [01:03:59.960 --> 01:04:02.960] and have been the last two or three years [01:04:02.960 --> 01:04:05.960] working out the politics [01:04:05.960 --> 01:04:09.960] because you absolutely will [01:04:09.960 --> 01:04:11.960] not win your case because you have the law [01:04:11.960 --> 01:04:13.960] and the facts on your side [01:04:13.960 --> 01:04:16.960] we have to have the politics on our side [01:04:16.960 --> 01:04:18.960] and all politics is local [01:04:18.960 --> 01:04:25.960] and lost the word [01:04:25.960 --> 01:04:30.960] I hate when I do that [01:04:30.960 --> 01:04:32.960] let's see all politics [01:04:32.960 --> 01:04:34.960] everything's political [01:04:34.960 --> 01:04:36.960] oh perception, perception [01:04:36.960 --> 01:04:38.960] perception is everything [01:04:38.960 --> 01:04:43.960] so we want to create a perception [01:04:43.960 --> 01:04:46.960] we want to create the perception [01:04:46.960 --> 01:04:48.960] that whatever we do [01:04:48.960 --> 01:04:50.960] we're setting them up [01:04:50.960 --> 01:04:54.960] and whatever they feel like doing [01:04:54.960 --> 01:04:56.960] that's what we want them to do [01:04:56.960 --> 01:05:00.960] so that we can sting them [01:05:00.960 --> 01:05:02.960] great [01:05:02.960 --> 01:05:04.960] if we're going to get control [01:05:04.960 --> 01:05:06.960] over our public officials [01:05:06.960 --> 01:05:08.960] this is what we're going to have to start doing [01:05:08.960 --> 01:05:10.960] we're going to have to find a way [01:05:10.960 --> 01:05:12.960] to get their attention [01:05:12.960 --> 01:05:17.960] my favorite response was from a lawyer [01:05:17.960 --> 01:05:19.960] in Randall County [01:05:19.960 --> 01:05:21.960] in Johnson County [01:05:21.960 --> 01:05:24.960] her name was Lisa Wyatt [01:05:24.960 --> 01:05:26.960] she was assistant district attorney [01:05:26.960 --> 01:05:28.960] and I'd file criminal complaints against her boss [01:05:28.960 --> 01:05:31.960] with her office addressed to the grand jury [01:05:31.960 --> 01:05:34.960] and she called me and said that she got my complaints [01:05:34.960 --> 01:05:36.960] and I really should file them with the sheriff [01:05:36.960 --> 01:05:38.960] I said no ma'am I'll be filing with the grand jury [01:05:38.960 --> 01:05:40.960] the only thing you get to do is decide [01:05:40.960 --> 01:05:42.960] what to mean the process or not [01:05:42.960 --> 01:05:44.960] a week later she called me and said [01:05:44.960 --> 01:05:46.960] I sent your complaints to the sheriff [01:05:46.960 --> 01:05:48.960] and he said he couldn't do anything with them [01:05:48.960 --> 01:05:51.960] and I said there were accusations against him in there [01:05:51.960 --> 01:05:54.960] I said well yeah, matter of fact there were [01:05:54.960 --> 01:05:56.960] she said Mr. Kelton [01:05:56.960 --> 01:05:59.960] I get the impression you planned this this way [01:05:59.960 --> 01:06:01.960] well miss Wyatt, I am impressed [01:06:01.960 --> 01:06:04.960] you are very astute [01:06:04.960 --> 01:06:08.960] I hope you don't think this is my first rodeo [01:06:08.960 --> 01:06:10.960] and she said no Mr. Kelton [01:06:10.960 --> 01:06:13.960] somehow I don't think this is your first rodeo [01:06:13.960 --> 01:06:16.960] that's what I wanted her to think [01:06:16.960 --> 01:06:19.960] this guy set me up [01:06:19.960 --> 01:06:22.960] yes I did [01:06:22.960 --> 01:06:25.960] and now every time I go walk in the building [01:06:25.960 --> 01:06:29.960] what's he setting us up for this time [01:06:29.960 --> 01:06:30.960] good [01:06:30.960 --> 01:06:34.960] if we can get that impression in their mind [01:06:34.960 --> 01:06:39.960] they are going to be very very careful [01:06:39.960 --> 01:06:43.960] oh and I did have some good news over the election [01:06:43.960 --> 01:06:46.960] this was a wonderful election [01:06:46.960 --> 01:06:51.960] the two prosecutors in Cherokee County [01:06:51.960 --> 01:06:54.960] the district and the county attorney [01:06:54.960 --> 01:06:57.960] both lost their elections [01:06:57.960 --> 01:07:01.960] ha ha ha ha ha ha ha [01:07:01.960 --> 01:07:04.960] oh this is good news [01:07:04.960 --> 01:07:05.960] excellent [01:07:05.960 --> 01:07:09.960] these guys have more problem than they know [01:07:09.960 --> 01:07:13.960] be careful the enemies you make [01:07:13.960 --> 01:07:18.960] I can hardly wait for these two guys to show up [01:07:18.960 --> 01:07:22.960] in private practice [01:07:22.960 --> 01:07:28.960] I think they might want to get their wrists limbered up [01:07:28.960 --> 01:07:32.960] so they can flip burgers [01:07:32.960 --> 01:07:36.960] because I think I can put them there [01:07:36.960 --> 01:07:41.960] so that was good news to hear that these guys lost out [01:07:41.960 --> 01:07:45.960] and I suspect that the next election will be [01:07:45.960 --> 01:07:49.960] County judge will be out as well [01:07:49.960 --> 01:07:52.960] the guys are real scoundrels so that was good news [01:07:52.960 --> 01:07:55.960] and then we'll start working on those guys [01:07:55.960 --> 01:07:59.960] but if you're going to take on public officials [01:07:59.960 --> 01:08:03.960] resist the urge to get in their face [01:08:03.960 --> 01:08:06.960] and tell them how the cow ate the cabbage [01:08:06.960 --> 01:08:11.960] resist the urge to send them a letter [01:08:11.960 --> 01:08:17.960] that will give them opportunity to ignore you [01:08:17.960 --> 01:08:21.960] now I don't mind them ignoring me [01:08:21.960 --> 01:08:26.960] but I don't want them to be able to do it with opportunity [01:08:26.960 --> 01:08:32.960] I want them to do it with responsibility and liability [01:08:32.960 --> 01:08:37.960] so we only send them, don't send them anything [01:08:37.960 --> 01:08:42.960] that they do not have to respond to [01:08:42.960 --> 01:08:47.960] and then hope that they don't so you can sting them for not responding [01:08:47.960 --> 01:08:49.960] it's always been my experience [01:08:49.960 --> 01:08:52.960] the lower level they are, the dumber they are [01:08:52.960 --> 01:08:54.960] the more cautious they are [01:08:54.960 --> 01:08:57.960] as you go up the ladder [01:08:57.960 --> 01:09:00.960] they get a whole lot more careful [01:09:00.960 --> 01:09:03.960] I filed a criminal complaint against the Chief Justice [01:09:03.960 --> 01:09:08.960] and I have not heard one peep from anyone [01:09:08.960 --> 01:09:10.960] they know better [01:09:10.960 --> 01:09:13.960] they're smarter [01:09:13.960 --> 01:09:17.960] so we need to start doing this [01:09:17.960 --> 01:09:21.960] more people get doing it, it won't take too many [01:09:21.960 --> 01:09:26.960] if they see the public becoming more knowledgeable [01:09:26.960 --> 01:09:29.960] they're going to get more careful [01:09:29.960 --> 01:09:33.960] okay, do you have anything else for us Julius? [01:09:33.960 --> 01:09:35.960] just a quick one, I think you're going to like it [01:09:35.960 --> 01:09:38.960] I had a jury trial, a traffic situation [01:09:38.960 --> 01:09:42.960] and I said to the judge, I think you're going to like it [01:09:42.960 --> 01:09:44.960] set her up real good [01:09:44.960 --> 01:09:48.960] and I said, I think I know what she's going to try to do to me [01:09:48.960 --> 01:09:53.960] anyway, the judge goes, Mr. Mano, are you ready? [01:09:53.960 --> 01:09:56.960] and I said, no I'm not, Your Honor [01:09:56.960 --> 01:10:00.960] I move that all proceedings be on the record [01:10:00.960 --> 01:10:05.960] she goes, I won't have that in my court [01:10:05.960 --> 01:10:08.960] this is my court, I decide what's on the record [01:10:08.960 --> 01:10:12.960] and then I went and said, I object [01:10:12.960 --> 01:10:15.960] I object to all proceedings of this court [01:10:15.960 --> 01:10:18.960] I have objections from the pre-trial [01:10:18.960 --> 01:10:20.960] I want them to be on the record [01:10:20.960 --> 01:10:23.960] Mr. Mano, you shut up when I'm talking to you [01:10:23.960 --> 01:10:27.960] you don't talk over to me because I'll have these officers [01:10:27.960 --> 01:10:30.960] I forget what quote she said [01:10:30.960 --> 01:10:33.960] but she said the officers over eventually [01:10:33.960 --> 01:10:35.960] I kept objecting [01:10:35.960 --> 01:10:38.960] I said, I move that all proceedings be on the record [01:10:38.960 --> 01:10:41.960] and you're denying me a right to make an objection [01:10:41.960 --> 01:10:44.960] and to have it on the record [01:10:44.960 --> 01:10:47.960] and so I just started by calling [01:10:47.960 --> 01:10:50.960] with my little voice recorder on [01:10:50.960 --> 01:10:53.960] so I recorded everything [01:10:53.960 --> 01:10:57.960] now they railroaded me through the trial [01:10:57.960 --> 01:11:00.960] and expect me to pay to fine [01:11:00.960 --> 01:11:03.960] so I have a court date appearance [01:11:03.960 --> 01:11:05.960] about 10 days [01:11:05.960 --> 01:11:08.960] and what I was thinking of doing was [01:11:08.960 --> 01:11:11.960] adding up a criminal complaint against that judge [01:11:11.960 --> 01:11:15.960] when I go before that magistrate who expects to get paid on the fine [01:11:15.960 --> 01:11:18.960] is I want to handle the criminal complaint [01:11:21.960 --> 01:11:24.960] you know what he's going to do [01:11:24.960 --> 01:11:27.960] oh I know what he's going to do [01:11:27.960 --> 01:11:32.960] have a complaint against him already made up [01:11:32.960 --> 01:11:35.960] that's what I was asking you [01:11:35.960 --> 01:11:38.960] I want to send you off [01:11:38.960 --> 01:11:41.960] I don't have a complete set up [01:11:41.960 --> 01:11:44.960] Mr. Bailiff I need you [01:11:44.960 --> 01:11:47.960] I was down at the Austin court [01:11:47.960 --> 01:11:50.960] and a judge [01:11:50.960 --> 01:11:53.960] I gave him criminal complaints and he refused to take them [01:11:53.960 --> 01:11:55.960] threw me out of his courtroom [01:11:55.960 --> 01:11:58.960] ordered me to leave the courtroom [01:11:58.960 --> 01:12:01.960] and I had asked for a city marshal [01:12:01.960 --> 01:12:03.960] so he was there [01:12:03.960 --> 01:12:05.960] and the judge ordered me to leave the courtroom [01:12:05.960 --> 01:12:07.960] I pointed at the marshal [01:12:07.960 --> 01:12:09.960] you come with me I need you [01:12:09.960 --> 01:12:12.960] I turned and stormed out of the courtroom [01:12:12.960 --> 01:12:15.960] and the marshal come over [01:12:15.960 --> 01:12:17.960] and I'm trying to get the marshal to go in there [01:12:17.960 --> 01:12:19.960] and arrest the judge [01:12:19.960 --> 01:12:21.960] why can't arrest the judge [01:12:21.960 --> 01:12:23.960] she can just go in there and throw him in the castle [01:12:23.960 --> 01:12:26.960] and drag him behind off the jail [01:12:29.960 --> 01:12:32.960] and the judge knew that I was out there [01:12:32.960 --> 01:12:34.960] trying to get him arrested [01:12:34.960 --> 01:12:36.960] oh that was a hoot [01:12:36.960 --> 01:12:38.960] that's great [01:12:38.960 --> 01:12:40.960] but have your complaint ready [01:12:40.960 --> 01:12:44.960] Ken Magnuson taught me this one [01:12:44.960 --> 01:12:46.960] I went to court with him [01:12:46.960 --> 01:12:49.960] and he filed a motion [01:12:49.960 --> 01:12:51.960] it was there to hear the motion [01:12:51.960 --> 01:12:53.960] the judge denied the motion [01:12:53.960 --> 01:12:55.960] and he takes out this piece of paper and said [01:12:55.960 --> 01:12:58.960] Your Honor I'd like to present this to the court [01:12:58.960 --> 01:13:01.960] and the prosecutor said may I see it [01:13:01.960 --> 01:13:03.960] to the prosecutor [01:13:03.960 --> 01:13:05.960] and the prosecutor looks at it [01:13:05.960 --> 01:13:07.960] and he just kind of shrugs his shoulder [01:13:07.960 --> 01:13:09.960] I'm sorry the judge asked the prosecutor [01:13:09.960 --> 01:13:11.960] if he had any objections [01:13:11.960 --> 01:13:13.960] Ken showed it to the prosecutor [01:13:13.960 --> 01:13:15.960] and he looked at it kind of smile [01:13:15.960 --> 01:13:17.960] and shrugged his shoulders [01:13:17.960 --> 01:13:19.960] I don't have any objections Your Honor [01:13:19.960 --> 01:13:21.960] he gets it to the judge [01:13:21.960 --> 01:13:23.960] and it's a motion for reconsideration [01:13:23.960 --> 01:13:25.960] on the ruling he just made [01:13:25.960 --> 01:13:27.960] the judge looked at it [01:13:27.960 --> 01:13:29.960] and said well [01:13:29.960 --> 01:13:32.960] it seems Mr. Magnuson [01:13:32.960 --> 01:13:34.960] that you are a step ahead of the court [01:13:34.960 --> 01:13:37.960] and Ken held up three fingers [01:13:37.960 --> 01:13:41.960] thought the prosecutor [01:13:41.960 --> 01:13:43.960] was going to fall out in the floor [01:13:43.960 --> 01:13:48.960] and even the judge thought that was kind of funny [01:13:48.960 --> 01:13:53.960] but that's exactly what we want him to think [01:13:53.960 --> 01:13:55.960] good [01:13:55.960 --> 01:13:58.960] and if you're going to go before this magistrate [01:13:58.960 --> 01:14:03.960] what's your strategy? [01:14:03.960 --> 01:14:06.960] Why are you going before the magistrate? [01:14:06.960 --> 01:14:10.960] Well I got a notice to appear [01:14:10.960 --> 01:14:12.960] to pay this fine [01:14:12.960 --> 01:14:15.960] now this fine [01:14:15.960 --> 01:14:18.960] is subject to all the judicial [01:14:18.960 --> 01:14:21.960] conduct complaints that I filed against [01:14:21.960 --> 01:14:24.960] let's say judge A [01:14:24.960 --> 01:14:28.960] who I have four judicial complaints [01:14:28.960 --> 01:14:30.960] against along with criminal complaints [01:14:30.960 --> 01:14:33.960] and then I want to file a judicial complaint [01:14:33.960 --> 01:14:36.960] criminal complaint against judge B [01:14:36.960 --> 01:14:40.960] who was the judge at the trial on the merits [01:14:40.960 --> 01:14:43.960] Okay wait have you already filed [01:14:43.960 --> 01:14:46.960] judicial conduct complaints? [01:14:46.960 --> 01:14:49.960] I filed judicial conduct complaints [01:14:49.960 --> 01:14:51.960] against the first judge who violated [01:14:51.960 --> 01:14:54.960] pre-trial before and after [01:14:54.960 --> 01:14:57.960] and in those judicial conduct complaints [01:14:57.960 --> 01:15:00.960] or I filed criminal complaints [01:15:00.960 --> 01:15:03.960] Where did you file the criminal complaints? [01:15:03.960 --> 01:15:10.960] With the state commission [01:15:10.960 --> 01:15:13.960] for judicial conduct [01:15:13.960 --> 01:15:15.960] Oh my goodness [01:15:15.960 --> 01:15:17.960] Okay hold on [01:15:17.960 --> 01:15:23.960] you're aware that there are two judges on that panel [01:15:23.960 --> 01:15:25.960] I think you said that one time [01:15:25.960 --> 01:15:27.960] Yeah you need to find out who they are [01:15:27.960 --> 01:15:30.960] and go to the district attorney and file against them [01:15:30.960 --> 01:15:33.960] Okay because I put those criminal complaints [01:15:33.960 --> 01:15:36.960] inside my judicial conduct complaint [01:15:36.960 --> 01:15:40.960] Were they notarized? [01:15:40.960 --> 01:15:43.960] Yes they were notarized [01:15:43.960 --> 01:15:46.960] Good go to the prosecutor's attorney [01:15:46.960 --> 01:15:49.960] and file criminal charges against these two judges [01:15:49.960 --> 01:15:51.960] Okay [01:15:51.960 --> 01:15:54.960] For Ms. Thiesensen office [01:15:54.960 --> 01:15:57.960] violation 39.03 penal code [01:15:57.960 --> 01:15:59.960] Failing to perform a duty [01:15:59.960 --> 01:16:02.960] they are required to perform [01:16:02.960 --> 01:16:04.960] The prosecutor will recognize it [01:16:04.960 --> 01:16:06.960] because he's already got one [01:16:06.960 --> 01:16:08.960] against chief justice [01:16:08.960 --> 01:16:10.960] Excellent [01:16:10.960 --> 01:16:13.960] And we have my candles just [01:16:13.960 --> 01:16:17.960] filed a bunch of complaints with the chief justice as well [01:16:17.960 --> 01:16:21.960] against some municipal court individuals [01:16:21.960 --> 01:16:23.960] He's still going after him [01:16:23.960 --> 01:16:24.960] he's not done yet [01:16:24.960 --> 01:16:26.960] Good [01:16:26.960 --> 01:16:28.960] Now which prosecutor will go after [01:16:28.960 --> 01:16:30.960] getting touched before? [01:23:35.960 --> 01:23:36.960] Something kind of trivial [01:23:36.960 --> 01:23:39.960] I got an expired registration [01:23:39.960 --> 01:23:44.960] and I'm reading the website that tells me that [01:23:44.960 --> 01:23:49.960] I have to renew it down at the local office [01:23:49.960 --> 01:23:53.960] and it says that I will be required to disclose [01:23:53.960 --> 01:23:57.960] if I had driven the vehicle [01:23:57.960 --> 01:24:01.960] I'm assuming that means if I had driven it on the expired registration [01:24:01.960 --> 01:24:05.960] It says depending on the facts [01:24:05.960 --> 01:24:09.960] I may be in for a 20% penalty [01:24:09.960 --> 01:24:12.960] Only if you got a ticket [01:24:12.960 --> 01:24:13.960] Okay [01:24:13.960 --> 01:24:19.960] I just got registration on mine that was two months out [01:24:19.960 --> 01:24:23.960] I think it's three months to do it [01:24:23.960 --> 01:24:27.960] What she said was do you have any citations? [01:24:27.960 --> 01:24:29.960] I said no I don't [01:24:29.960 --> 01:24:33.960] So if they ask you was the vehicle driven [01:24:33.960 --> 01:24:36.960] you say I have no citations [01:24:36.960 --> 01:24:38.960] Okay [01:24:38.960 --> 01:24:40.960] If they say again was the vehicle driven [01:24:40.960 --> 01:24:42.960] don't ask me that [01:24:42.960 --> 01:24:43.960] Right [01:24:43.960 --> 01:24:51.960] Isn't that like forcing you to incriminate yourself? [01:26:00.960 --> 01:26:01.960] Oh no no no [01:26:01.960 --> 01:26:03.960] I'm going to go back to writing [01:26:03.960 --> 01:26:05.960] Sir sir I said yes [01:26:05.960 --> 01:26:07.960] Do you have a civil case here? [01:26:07.960 --> 01:26:09.960] Oh no no no nothing like that [01:26:09.960 --> 01:26:11.960] I go back to writing [01:26:11.960 --> 01:26:13.960] He said stood there a minute [01:26:13.960 --> 01:26:16.960] And he said sir sir and I looked up at him [01:26:16.960 --> 01:26:18.960] No more questions [01:26:18.960 --> 01:26:21.960] And it looked like I slapped him [01:26:21.960 --> 01:26:26.960] He was stunned he couldn't believe I said that to him [01:26:26.960 --> 01:26:30.960] And I just looked back down at what I was doing and ignored him [01:26:30.960 --> 01:26:32.960] And then I see him out of the corner of my eye [01:26:32.960 --> 01:26:34.960] And he just kind of shuffled around for a minute [01:26:34.960 --> 01:26:36.960] And then he ambled off [01:26:36.960 --> 01:26:38.960] Oh that's great [01:26:38.960 --> 01:26:41.960] So they're not going to make you sign some kind of affidavit or something [01:26:41.960 --> 01:26:45.960] They're not going to make you do anything [01:26:45.960 --> 01:26:48.960] You're going to do what you choose to do [01:26:48.960 --> 01:26:49.960] Okay [01:26:49.960 --> 01:26:53.960] And you're down there to purchase license [01:26:53.960 --> 01:26:56.960] Then they will probably say nothing about it [01:26:56.960 --> 01:27:00.960] They ask you if you have been [01:27:00.960 --> 01:27:03.960] If the vehicle's been used on no [01:27:03.960 --> 01:27:06.960] Then you have no citations [01:27:06.960 --> 01:27:10.960] That's the only thing you don't even need to tell them that [01:27:10.960 --> 01:27:13.960] If they asked me specifically [01:27:13.960 --> 01:27:15.960] I'd lie like a dog to them [01:27:15.960 --> 01:27:20.960] Now it's been in Timbuktu upside down in a river [01:27:20.960 --> 01:27:22.960] I dug it out and cleaned it up [01:27:22.960 --> 01:27:25.960] Now I want to get a license again [01:27:25.960 --> 01:27:27.960] And they ask me are you telling the truth? [01:27:27.960 --> 01:27:29.960] Of course I'm not telling the truth [01:27:29.960 --> 01:27:32.960] Give me a break here [01:27:32.960 --> 01:27:35.960] I don't think you're going to have any problem with that [01:27:35.960 --> 01:27:38.960] I thought you were going to ask about registration [01:27:38.960 --> 01:27:45.960] It's an odd thing about registration and inspection [01:27:45.960 --> 01:27:54.960] It is against the law to display an expired registration [01:27:54.960 --> 01:28:00.960] I'm sorry expired safety sticker [01:28:00.960 --> 01:28:06.960] It's not against the law to display an expired registration [01:28:06.960 --> 01:28:11.960] It's against the law to operate a motor vehicle with an expired registration [01:28:11.960 --> 01:28:16.960] But it's not against the law to display one [01:28:16.960 --> 01:28:23.960] The statute on inspection sticker is written so [01:28:23.960 --> 01:28:29.960] That it's not exactly against the law not to have one [01:28:29.960 --> 01:28:37.960] The law really says that it's against the law to display an expired registration [01:28:37.960 --> 01:28:39.960] The inspection sticker [01:28:39.960 --> 01:28:45.960] Displaying the sticker is the crime [01:28:45.960 --> 01:28:49.960] So if you have one that's expired this is a great payoff [01:28:49.960 --> 01:28:52.960] So even if it's in your driveway is that considered displaying it? [01:28:52.960 --> 01:28:54.960] No [01:28:54.960 --> 01:29:00.960] If it's in your driveway it's not on the public door fair [01:29:00.960 --> 01:29:07.960] I was driving through a shopping center parking lot [01:29:07.960 --> 01:29:12.960] And I have a problem with the soft signs in shopping center parking lots [01:29:12.960 --> 01:29:16.960] They're defective [01:29:16.960 --> 01:29:23.960] I just go right by them my car never stops [01:29:23.960 --> 01:29:28.960] They're on private property [01:29:28.960 --> 01:29:32.960] We maintain the transportation code doesn't apply to us [01:29:32.960 --> 01:29:38.960] But it certainly doesn't apply if I'm not on a public door fair [01:29:38.960 --> 01:29:39.960] Thank you Randy [01:29:39.960 --> 01:29:42.960] You are most welcome, thank you for calling [01:29:42.960 --> 01:29:45.960] This is Randy Kelton, Deborah Stevens, Eddie Craig [01:29:45.960 --> 01:29:48.960] We're the law radio, we've got two more segments [01:29:48.960 --> 01:29:51.960] And we are actually out of callers I guess [01:29:51.960 --> 01:29:53.960] But I'm all off tonight [01:29:53.960 --> 01:29:57.960] So give us a call 512-646-1984 [01:29:57.960 --> 01:29:59.960] We'll be right back [01:29:59.960 --> 01:30:03.960] A noble lie, Oklahoma City 1995 will change forever [01:30:03.960 --> 01:30:06.960] The way you look at the true nature of terrorism [01:30:06.960 --> 01:30:08.960] Based on the damage pattern to the building [01:30:08.960 --> 01:30:10.960] But the government seems impossible [01:30:10.960 --> 01:30:13.960] The grand jury did not want to hear anything I had to say [01:30:13.960 --> 01:30:17.960] The decision was made not to pursue any more of those individuals [01:30:17.960 --> 01:30:21.960] All of these columns were ripped up, shredded, tossed around [01:30:21.960 --> 01:30:23.960] The people that did the things they did [01:30:23.960 --> 01:30:25.960] They've gone on well with what they were doing [01:30:25.960 --> 01:30:30.960] Expose the cover up now at anoblelie.com [01:30:30.960 --> 01:30:34.960] The rule of law radio network is proud to present a due process of law seminar [01:30:34.960 --> 01:30:36.960] Hosted by our own Eddie Craig [01:30:36.960 --> 01:30:38.960] Eddie is a former Nakadocha sheriff's deputy [01:30:38.960 --> 01:30:41.960] And for the past 21 years he's been studying the due process of law [01:30:41.960 --> 01:30:44.960] And now offers his knowledge to you at a seminar every Sunday [01:30:44.960 --> 01:30:47.960] From 2 o'clock to 5 o'clock at Brave New Books [01:30:47.960 --> 01:30:49.960] Located at 1904 Guadalupe Street [01:30:49.960 --> 01:30:53.960] Admission is $20 so please make plans to come by and sit with Eddie [01:30:53.960 --> 01:31:15.960] And learn for yourself what the true intent of law really is [01:31:24.960 --> 01:31:28.960] We urge our listeners to please visit us at hempusa.org [01:31:28.960 --> 01:31:32.960] And remember all of our products are chemical free and healthy to eat [01:31:32.960 --> 01:31:35.960] We constantly strive to give you the best service [01:31:35.960 --> 01:31:37.960] Highest quality and rapid shipping anywhere [01:31:37.960 --> 01:31:41.960] And we offer free shipping on orders over $95 in the US [01:31:41.960 --> 01:31:51.960] Please visit us at hempusa.org or call 908-691-2608 [01:31:51.960 --> 01:31:59.960] See what our powders, seeds and oil can do for you at hempusa.org [01:32:21.960 --> 01:32:28.960] We urge our listeners to please visit us at hempusa.org [01:32:28.960 --> 01:32:33.960] And remember all of our products are chemical free and healthy to eat [01:32:33.960 --> 01:32:37.960] We constantly strive to give you the best service [01:32:37.960 --> 01:32:39.960] Highest quality and rapid shipping anywhere [01:32:39.960 --> 01:32:43.960] And we offer free shipping on orders over $95 in the US [01:32:43.960 --> 01:32:47.960] And remember all of our products are chemical free and healthy to eat [01:32:47.960 --> 01:32:52.960] And though it's a daunting task at least I got the disease [01:32:52.960 --> 01:32:57.960] I sent them all to just take off the silly mask [01:32:57.960 --> 01:33:00.960] And in the light of day we are well-passed [01:33:00.960 --> 01:33:02.960] We choose an ingenuity [01:33:02.960 --> 01:33:05.960] Against the workers of the new way [01:33:05.960 --> 01:33:08.960] We choose an ingenuity [01:33:08.960 --> 01:33:10.960] Against the workers of the new way [01:33:10.960 --> 01:33:12.960] Okay, we are back [01:33:12.960 --> 01:33:16.960] Randy Kelton, Debra Stevens, Eddie Craig and Will LaRadeo [01:33:16.960 --> 01:33:22.960] And we have a call, have a question from Chris, Texas [01:33:22.960 --> 01:33:26.960] Chris, what do you have for us tonight? [01:33:26.960 --> 01:33:32.960] Well, I've got to go to court next week on a child support hearing [01:33:32.960 --> 01:33:40.960] And I have a response supposedly coming from the Attorney General [01:33:40.960 --> 01:33:43.960] But they never sent it to me [01:33:43.960 --> 01:33:50.960] What is it that I need to file on that? [01:33:50.960 --> 01:33:53.960] Do you have a copy of the response? [01:33:53.960 --> 01:33:56.960] No, they did not send it to me [01:33:56.960 --> 01:34:01.960] So when you go to the hearing you can object to the hearing because [01:34:01.960 --> 01:34:04.960] Oh, wait a minute, a response? [01:34:04.960 --> 01:34:05.960] Yes [01:34:05.960 --> 01:34:08.960] Okay, back up, what is going on here? [01:34:08.960 --> 01:34:10.960] Is this an action you filed? [01:34:10.960 --> 01:34:13.960] Yes, I filed a bill of review [01:34:13.960 --> 01:34:16.960] And they never answered it [01:34:16.960 --> 01:34:19.960] They required to answer a bill of review [01:34:19.960 --> 01:34:23.960] Yes, both parties were required to answer [01:34:23.960 --> 01:34:26.960] Okay [01:34:26.960 --> 01:34:34.960] Then when you go to the hearing you should ask for sanctions against the Attorney General [01:34:34.960 --> 01:34:36.960] For not responding [01:34:36.960 --> 01:34:39.960] Okay, what is the purpose of the bill of review? [01:34:39.960 --> 01:34:45.960] Because they failed to serve me back in, oh, it's been eight years ago [01:34:45.960 --> 01:34:50.960] They failed to serve me and I didn't know about this whole family matter [01:34:50.960 --> 01:34:55.960] Claiming that I have a kid that I didn't know about [01:34:55.960 --> 01:35:01.960] Okay, and what is the bill of review for? [01:35:01.960 --> 01:35:06.960] For lack of service back when they did this eight years ago [01:35:06.960 --> 01:35:10.960] That's odd, why in the form of a bill of review [01:35:10.960 --> 01:35:15.960] You're essentially asking for a declaratory judgment from the court? [01:35:15.960 --> 01:35:22.960] That as a matter of law without the process they had no right to proceed [01:35:22.960 --> 01:35:31.960] I understand, but maybe I don't understand enough about precisely what a bill of review is for [01:35:31.960 --> 01:35:36.960] I mean, why a bill of review? [01:35:36.960 --> 01:35:46.960] Because every other remedy, the statute of limitations had told as far as I understood it [01:35:46.960 --> 01:35:55.960] Well, you could just follow a motion to dismiss any action for lack of proper service [01:35:55.960 --> 01:36:02.960] Has the Attorney General filed an action to collect? [01:36:02.960 --> 01:36:08.960] Yes, they filed a thing against me which was a motion to enforce [01:36:08.960 --> 01:36:15.960] Okay, file a motion to quash for lack of proper notice [01:36:15.960 --> 01:36:20.960] Okay, would I file that in? [01:36:20.960 --> 01:36:22.960] Because now I have two different case numbers [01:36:22.960 --> 01:36:26.960] I have one for their original case that they did [01:36:26.960 --> 01:36:32.960] And then my bill of review put me in the plaintiff position [01:36:32.960 --> 01:36:39.960] Okay, a bill of review, a proceeding brought to obtain an explanation or an alteration [01:36:39.960 --> 01:36:46.960] Or a reversal of a decree by the court that rendered it [01:36:46.960 --> 01:36:53.960] And that's why I was confused because I thought that's what a bill of review went to, but it wasn't sure [01:36:53.960 --> 01:37:01.960] A bill of review is to review a decision of the court [01:37:01.960 --> 01:37:07.960] And you don't have one [01:37:07.960 --> 01:37:16.960] So the Attorney General is probably right, there's nothing for them to answer [01:37:16.960 --> 01:37:20.960] Oh wait a minute, no, no, no, this should be [01:37:20.960 --> 01:37:31.960] What was the content of the bill of review? [01:37:31.960 --> 01:37:35.960] The lack of service back when they got a default judgment [01:37:35.960 --> 01:37:38.960] This should not be treated as a bill of review [01:37:38.960 --> 01:37:42.960] Oh wait a minute, oh I'm sorry, hold on, that's a new piece of information [01:37:42.960 --> 01:37:45.960] They got a default judgment against you [01:37:45.960 --> 01:37:46.960] Yes [01:37:46.960 --> 01:37:50.960] Okay, then bill of review is correct [01:37:50.960 --> 01:38:02.960] Then what you do is you go into court and you object to anything that the Secretary of State, I mean the Attorney General tries to say [01:38:02.960 --> 01:38:07.960] You object because they failed to file an answer, you move for summary judgment [01:38:07.960 --> 01:38:14.960] Move for a summary judgment on the pleading [01:38:14.960 --> 01:38:19.960] There's no fact in contention [01:38:19.960 --> 01:38:25.960] The Attorney General by failing to timely respond [01:38:25.960 --> 01:38:29.960] Stipulated to all your assertions and accusations [01:38:29.960 --> 01:38:31.960] And move for summary judgment [01:38:31.960 --> 01:38:43.960] Okay, even though the coordinator claims that there is a response from the Attorney General that has been filed now [01:38:43.960 --> 01:38:45.960] But they did not serve me [01:38:45.960 --> 01:38:49.960] It's not properly filed if they did not [01:38:49.960 --> 01:38:51.960] Have you looked at it? [01:38:51.960 --> 01:38:52.960] No [01:38:52.960 --> 01:38:58.960] Okay, then you want to look at it and see if it has a certificate of service [01:38:58.960 --> 01:39:03.960] If it does, then move for sanctions against counsel [01:39:03.960 --> 01:39:04.960] Okay [01:39:04.960 --> 01:39:08.960] I take it they have a workable address on you [01:39:08.960 --> 01:39:09.960] Yes they do [01:39:09.960 --> 01:39:17.960] So they were able to send documents to you in the interim, at least at some time they got one to you [01:39:17.960 --> 01:39:20.960] So take something they've sent to you with you [01:39:20.960 --> 01:39:29.960] Actually I have something in my delivery view as an evidence that they had my address all along [01:39:29.960 --> 01:39:31.960] Perfect, perfect [01:39:31.960 --> 01:39:38.960] So you can claim this as a deliberate act and you might counter sue the Attorney General [01:39:38.960 --> 01:39:44.960] Okay, what would I counter sue them for? [01:39:44.960 --> 01:39:49.960] Counter sue for sanctions [01:39:49.960 --> 01:39:55.960] I'd have to look at it as a circumstance and we can come up with something to counter sue them for [01:39:55.960 --> 01:39:56.960] Okay [01:39:56.960 --> 01:40:02.960] Because here the Attorney General is not really acting as a public official [01:40:02.960 --> 01:40:10.960] He's acting as a lawyer for the whoever they're trying to collect the money for [01:40:10.960 --> 01:40:12.960] Correct [01:40:12.960 --> 01:40:15.960] So he should have no immunity here [01:40:15.960 --> 01:40:33.960] Ah, yeah and I even found today in the family code where it states that the opposing party's signature has to be on a motion to enforce and her signature is not on it [01:40:33.960 --> 01:40:38.960] Okay, is this what you're going, this what the bill of review is about? [01:40:38.960 --> 01:40:46.960] Yes, this bill of review is to basically like a motion to quash this motion to enforce [01:40:46.960 --> 01:40:52.960] So the motion to enforce, is that the one that doesn't have her signature on it? [01:40:52.960 --> 01:40:54.960] Correct [01:40:54.960 --> 01:40:59.960] Oh then you can move to quash, is that in your motion? [01:40:59.960 --> 01:41:10.960] No, it's not on there because I couldn't address the motion to enforce because I cannot make a general appearance or my bill of review goes to waste [01:41:10.960 --> 01:41:14.960] Oh okay, so you're still at arms length to the court? [01:41:14.960 --> 01:41:15.960] Yes [01:41:15.960 --> 01:41:19.960] So this bill of review is essentially a challenge of subject matter jurisdiction [01:41:19.960 --> 01:41:22.960] A challenge of personal jurisdiction? [01:41:22.960 --> 01:41:24.960] Because it'll have a service, right? [01:41:24.960 --> 01:41:27.960] Okay, right [01:41:27.960 --> 01:41:29.960] No, subject matter jurisdiction [01:41:29.960 --> 01:41:30.960] Okay [01:41:30.960 --> 01:41:43.960] Because the Attorney General was unable to invoke the subject matter jurisdiction of the court because the filing was incomplete, did not meet the filing requirements [01:41:43.960 --> 01:41:45.960] Okay [01:41:45.960 --> 01:41:49.960] So this is subject matter [01:41:49.960 --> 01:41:51.960] That ought to be interesting [01:41:51.960 --> 01:41:56.960] Yeah, that should be interesting because this goes in on the 15th [01:41:56.960 --> 01:42:01.960] Okay, looks like we've got three callers, we need to move along [01:42:01.960 --> 01:42:02.960] Alrighty [01:42:02.960 --> 01:42:05.960] Okay, have fun with that, that should be interesting [01:42:05.960 --> 01:42:07.960] Alright, thank you Randy [01:42:07.960 --> 01:42:13.960] Okay, we're going to go to Karen in Texas [01:42:13.960 --> 01:42:26.960] Okay, I have in front of me a piece of paper that says it's an indemnitor, co-signer's information and agreement [01:42:26.960 --> 01:42:36.960] And to make a long story short, I had a boy that had been working for me for about two and a half years [01:42:36.960 --> 01:42:47.960] He got picked up in Luling for a DWI, they called it a misdemeanor, he called me in the morning [01:42:47.960 --> 01:42:52.960] And he wanted me to help him post bail [01:42:52.960 --> 01:43:03.960] And he said I'll pay it, he said that he would pay it out of the $1,000 or $1,200 he had in his pocket [01:43:03.960 --> 01:43:06.960] And they needed me to sign for it [01:43:06.960 --> 01:43:22.960] So now here's my question, I want to know if it can fall back on me to pay this $2,500 bond if something happens to this boy or this gentleman [01:43:22.960 --> 01:43:26.960] You bet it can, that's why they wanted you to sign [01:43:26.960 --> 01:43:30.960] Okay, I couldn't give you a question [01:43:30.960 --> 01:43:40.960] Here is a remedy, if you have reason to believe the boy is not going to show up, you can revoke your signature and they'll revoke his bond [01:43:40.960 --> 01:43:48.960] Hang on, we'll pick this back up on the other side, this is Randy Kelton, Debra Steven, Teddy Craig, Wood Law Radio [01:43:48.960 --> 01:43:59.960] We're about to go to our last segment and we have three calls on the boy so I'll try to go quickly when we get back, we'll be right back [01:43:59.960 --> 01:44:08.960] It is so enlightening to listen to 90.1 FM, but finding things on the internet isn't so easy and neither is finding like-minded people to share it with [01:44:08.960 --> 01:44:11.960] Oh well I guess you haven't heard of Brave New Books then [01:44:11.960 --> 01:44:12.960] Brave New Books? [01:44:12.960 --> 01:44:19.960] Yes, Brave New Books has all the books and DVDs you're looking for by authors like Alex Jones, Ron Paul and G. Edward Griffin [01:44:19.960 --> 01:44:23.960] They even stock Interfood, Verky Products and Calvin Soaps [01:44:23.960 --> 01:44:25.960] There's no way a place like that exists [01:44:25.960 --> 01:44:31.960] Go check it out for yourself, it's downtown at 1904 Guadalupe Street just south of UT [01:44:31.960 --> 01:44:34.960] Oh by UT, there's never anywhere to park down there [01:44:34.960 --> 01:44:42.960] Actually they now offer a free hour of parking for paying customers at the 500 MLK parking facility just behind the bookstore [01:44:42.960 --> 01:44:46.960] It does exist, but when are they open? [01:44:46.960 --> 01:44:55.960] Monday through Saturday, 11 a.m. to 9 p.m. and 1 to 6 p.m. on Sundays, so get them a call at 512-480-2503 [01:44:55.960 --> 01:45:18.960] Check out their events page at bravenewbookstore.com [01:45:25.960 --> 01:45:27.960] And now you can too! [01:46:41.960 --> 01:46:51.960] He's worked just fine for two and a half years, but now I'm finding out that he really does have a problem with alcohol [01:46:51.960 --> 01:46:59.960] And this says that I agree to pay the bond company a nonrefundable fee, which he posted that fee [01:46:59.960 --> 01:47:02.960] Oh, hold on, hold on, you... [01:47:02.960 --> 01:47:14.960] But then it goes on and on to say I'll pay other stuff if he's arrested or incarcerated in another jurisdiction or county [01:47:14.960 --> 01:47:22.960] And what I was going to ask you, I was going to ask you about the wording on this and can they really hold me to this? [01:47:22.960 --> 01:47:28.960] Let me give you a number to call. This is a personal friend of mine [01:47:28.960 --> 01:47:34.960] And I helped them get into the bond business about 25 years ago [01:47:34.960 --> 01:47:38.960] And she would be the perfect one to talk to [01:47:38.960 --> 01:47:49.960] It's Mama Joyce, the number is 940-433-8860 [01:47:49.960 --> 01:47:51.960] Okay [01:47:51.960 --> 01:48:00.960] And Kay will probably answer the phone and her voice is so loud it'll probably rattle your drums, just tell her you want to talk to Joyce [01:48:00.960 --> 01:48:02.960] Okay [01:48:02.960 --> 01:48:07.960] And Joyce is rough and gruff, but she's actually a sweetheart [01:48:07.960 --> 01:48:14.960] And she'll explain exactly what your position is and what you can do and how to protect yourself [01:48:14.960 --> 01:48:16.960] Alright [01:48:16.960 --> 01:48:23.960] One of the things I was really wondering about, and I want to take up too much time, but this sounds like it's very badly worded [01:48:23.960 --> 01:48:34.960] And it sounds like maybe the guy that is running this bond company had worked for another bond company, copied this agreement from another bond company [01:48:34.960 --> 01:48:45.960] And it's not even written correctly, I mean there's spelling errors, there's grammatical errors and things like that [01:48:45.960 --> 01:48:49.960] I'm wondering if they can really hold me to this [01:48:49.960 --> 01:48:53.960] It's hard to say unless I actually read it [01:48:53.960 --> 01:48:58.960] The grammatical errors and spelling errors won't have any effect [01:48:58.960 --> 01:49:03.960] But it depends on if it's not worded right then they may not be [01:49:03.960 --> 01:49:09.960] But you can always revoke your signature [01:49:09.960 --> 01:49:11.960] Trustworthy [01:49:11.960 --> 01:49:17.960] And they may, I don't know if they revoke this bond [01:49:17.960 --> 01:49:21.960] You talk to Joyce, she'll be able to tell you what your options are [01:49:21.960 --> 01:49:23.960] Alright [01:49:23.960 --> 01:49:32.960] Okay, I just don't know enough about the details of bonding to be able to give you good advice [01:49:32.960 --> 01:49:34.960] Okay [01:49:34.960 --> 01:49:36.960] Okay, thank you very much [01:49:36.960 --> 01:49:38.960] Okay, bye bye [01:49:38.960 --> 01:49:45.960] Now we're going to go to Walt in New York [01:49:45.960 --> 01:49:47.960] Hello Mr. Walt [01:49:47.960 --> 01:49:53.960] Hi Randy, I'll do this real quick, I heard you earlier speaking about the judges being magistrates [01:49:53.960 --> 01:49:54.960] Yes [01:49:54.960 --> 01:49:58.960] Every type of judge, like how about the US Court of Federal Claims, are they also magistrates? [01:49:58.960 --> 01:50:06.960] Okay, as far as I know, everyone who is a judge is also a magistrate [01:50:06.960 --> 01:50:12.960] Okay, what about in towns and villages like mayors, town supervisors [01:50:12.960 --> 01:50:17.960] Okay, now I can't speak to every state [01:50:17.960 --> 01:50:22.960] But as a rule, mayors are magistrates [01:50:22.960 --> 01:50:26.960] Justices of the peace, all judges are magistrates [01:50:26.960 --> 01:50:30.960] As a rule, in a particular state it might be something different [01:50:30.960 --> 01:50:35.960] But in Pennsylvania it is different [01:50:35.960 --> 01:50:38.960] Okay, last question Randy, real quick [01:50:38.960 --> 01:50:48.960] I sent a certified letter to the town here about getting a copy of the police report and any information regarding an incident that was in last February [01:50:48.960 --> 01:50:53.960] It comes about in so far the records officer in a month has not responded even though they have it [01:50:53.960 --> 01:50:58.960] And they told me they did today and they said they turned it over to the police chief [01:50:58.960 --> 01:51:03.960] Right, okay, read the open records law for New York [01:51:03.960 --> 01:51:10.960] And make sure this falls under open records and not court records [01:51:10.960 --> 01:51:13.960] I'm sure it's going to fall under open records [01:51:13.960 --> 01:51:16.960] And what do I do? [01:51:16.960 --> 01:51:22.960] See how much time they have, generally the open records laws are criminal statutes, not civil [01:51:22.960 --> 01:51:28.960] And to check, get your open records act for New York and go to the bottom [01:51:28.960 --> 01:51:36.960] If it's penal and they have punishment for violations, it'll generally be at the bottom of the dock of the statute [01:51:36.960 --> 01:51:38.960] Alright, thank you [01:51:38.960 --> 01:51:48.960] See what their time to respond is and if they've exceeded it to send a criminal complaint to the prosecute attorney [01:51:48.960 --> 01:51:56.960] And he'll get the complaint and he'll dance over to the police department and say this guy's trying to get me to arrest you [01:51:56.960 --> 01:52:00.960] And they'll probably get you your documents really quick [01:52:00.960 --> 01:52:02.960] Thank you, Randy [01:52:02.960 --> 01:52:06.960] You are most welcome [01:52:06.960 --> 01:52:12.960] Okay, now we're going to go to Tyler in Wyoming [01:52:12.960 --> 01:52:15.960] Hello, Mr. Tyler, what do you have for us today? [01:52:15.960 --> 01:52:23.960] Well, first of all, I wanted to say I wanted to contribute a little bit of funds to your program there [01:52:23.960 --> 01:52:27.960] I just wanted to thank you and Eddie and Deborah for all that you do [01:52:27.960 --> 01:52:38.960] And I wanted to also tell the listeners that your knowledge is very valuable and given that freely over the radio [01:52:38.960 --> 01:52:49.960] And I just wanted to remind people of the cost of attorneys and I think it would be noble for people to contribute to all the good things that you're doing [01:52:49.960 --> 01:52:57.960] And I just wondered if I could get an address in and who I'd make that out to for a contribution and then I had a quick comment for you [01:52:57.960 --> 01:53:01.960] Okay, you make it out to Randy's beer fun [01:53:01.960 --> 01:53:13.960] Okay, make it out to Deb Stevens [01:53:13.960 --> 01:53:19.960] Okay, make it out to Deborah Stevens [01:53:19.960 --> 01:53:21.960] Okay [01:53:21.960 --> 01:53:27.960] 1516 South Lamar, number 12 [01:53:27.960 --> 01:53:31.960] Is that LAM or? [01:53:31.960 --> 01:53:35.960] Yeah, LAMAR [01:53:35.960 --> 01:53:39.960] Okay, 1516 South Lamar [01:53:39.960 --> 01:53:45.960] That's LAMAR, number a pound 112 [01:53:45.960 --> 01:53:47.960] 12 [01:53:47.960 --> 01:53:51.960] Austin, Texas, 787-04 [01:53:51.960 --> 01:53:55.960] 787-04? [01:53:55.960 --> 01:53:57.960] Yeah [01:53:57.960 --> 01:53:58.960] Okay [01:53:58.960 --> 01:54:01.960] And just put in parentheses for Randy's beer fun [01:54:01.960 --> 01:54:03.960] There you go [01:54:03.960 --> 01:54:04.960] I'll put that down [01:54:04.960 --> 01:54:08.960] Yeah, I had to migrate to the root beer but what the heck? [01:54:08.960 --> 01:54:13.960] Real quick here, I know we're short of time [01:54:13.960 --> 01:54:20.960] I went through three hearings on a bogus ticket at an officer road of an accident where I was actually convicted but he said I had the control sign [01:54:20.960 --> 01:54:27.960] I refused all three times at the arraignment to sign the statement of right sheet in the defendants box [01:54:27.960 --> 01:54:42.960] I claimed that I didn't have to waive any rights when an attorney or to enter the jurisdiction and the third time I just happened the other day I basically told the judge that no I'm not going to sign the deal and he got mad and was yelling at me [01:54:42.960 --> 01:54:50.960] And it kind of ended interestingly he just said well and I also appeared specially the third time I said this is a special appearance by the way [01:54:50.960 --> 01:55:01.960] And he goes you know I'm just getting tired of all these games special parents and saying you don't understand your rights and all this kind of stuff he's making me act like I was playing games [01:55:01.960 --> 01:55:05.960] In fact I actually commented that I was just playing games and I said no you're not [01:55:05.960 --> 01:55:11.960] And then he moved to DeNovo he said I'm just going to give this to the next judge and he said just move this to DeNovo [01:55:11.960 --> 01:55:17.960] And I wonder what your thoughts were there so I just go through the same process for the next judge or [01:55:17.960 --> 01:55:18.960] What? [01:55:18.960 --> 01:55:20.960] DeNovo [01:55:20.960 --> 01:55:23.960] Yeah he said I'm just going to DeNovo this to the next judge [01:55:23.960 --> 01:55:26.960] I don't know what that means [01:55:26.960 --> 01:55:31.960] I didn't either that usually means you get a new trial and I didn't even have it [01:55:31.960 --> 01:55:39.960] Well that really means that he found against you and you appealed DeNovo [01:55:39.960 --> 01:55:46.960] That's what DeNovo means unless you have a different meaning for DeNovo in Wyoming [01:55:46.960 --> 01:55:52.960] I didn't understand it either because I hadn't even gone through I hadn't even made my plea yet and all three of those were aint it [01:55:52.960 --> 01:55:58.960] So he just said he's going to send it to the next judge but he didn't even turn DeNovo [01:55:58.960 --> 01:56:04.960] Is it going to a higher court or is it another judge within the same? [01:56:04.960 --> 01:56:08.960] Is this a municipal court or a JP or what is it? [01:56:08.960 --> 01:56:12.960] It's a municipal court, both the traffic ticket [01:56:12.960 --> 01:56:20.960] So is it going to another judge in the same municipality or same court? [01:56:20.960 --> 01:56:26.960] I would imagine but he did not say he did not testify and of course I haven't received any paperwork yet [01:56:26.960 --> 01:56:34.960] That is an interesting issue that they're trying to require you to waive a right [01:56:34.960 --> 01:56:40.960] It is he was trying to tell me that you could sign it without prejudice or reservation or however you want to do it [01:56:40.960 --> 01:56:45.960] But he was trying to say that that just lets us know that you're not going to use an attorney [01:56:45.960 --> 01:56:48.960] You're going to go it on your own but you're not waiving anything and I corrected him [01:56:48.960 --> 01:56:51.960] I said your honor it says waive right to an attorney right here [01:56:51.960 --> 01:56:58.960] And he got mad at me again and he said I'm just tired of these games and he just moved it to the next judge [01:56:58.960 --> 01:57:05.960] You might file a judicial complaint against the judge [01:57:05.960 --> 01:57:10.960] And I'm thinking how you can make it even uglier I like official oppression [01:57:10.960 --> 01:57:12.960] Official oppression? [01:57:12.960 --> 01:57:15.960] Yeah official oppression [01:57:15.960 --> 01:57:20.960] It might just be an official misconduct in Wyoming [01:57:20.960 --> 01:57:30.960] But if a judge exerts, if a public official exerts or purports to exert an authority they don't expressly have [01:57:30.960 --> 01:57:37.960] Or fails to perform duties required to perform and denies you in full free access to enjoyment of right [01:57:37.960 --> 01:57:43.960] That's a class A misdemeanor in Texas and it's a crime in most every state [01:57:43.960 --> 01:57:51.960] Because it reflects 18 U.S. Code 242 the Ku Klux Klan Act which is worded almost exactly the same [01:57:51.960 --> 01:57:55.960] So hammer the judge a little bit [01:57:55.960 --> 01:58:00.960] Okay he's not as tired as he thinks he is, do a judicial conduct complaint against him [01:58:00.960 --> 01:58:08.960] And look at it filing a criminal complaint against him for denying him your right to a fair and honest jurist in the first instance [01:58:08.960 --> 01:58:12.960] Okay we are out of time, thank you Tyler [01:58:12.960 --> 01:58:17.960] This is Randy Kelton, Deborah Stevens, Eddie Craig, groove law radio [01:58:17.960 --> 01:58:21.960] Our Friday night info marathon [01:58:21.960 --> 01:58:26.960] Deborah and Eddie will be back Monday on our Monday night traffic show [01:58:26.960 --> 01:58:33.960] Deborah, Eddie and I will be back Thursday and then I'll be back next Friday [01:58:33.960 --> 01:58:38.960] So contribute, send us all your money, lots of money, we love money [01:58:38.960 --> 01:58:44.960] I'll send you soap, listen to us, I hope you gain wimity [01:58:44.960 --> 01:58:48.960] Thank you for listening and goodnight [01:58:48.960 --> 01:58:56.960] Bibles for America is offering absolutely free a unique study Bible called the New Testament Recovery Version [01:58:56.960 --> 01:59:03.960] The New Testament Recovery Version has over 9000 footnotes that explain what the Bible says verse by verse [01:59:03.960 --> 01:59:07.960] Helping you to know God and to know the meaning of life [01:59:07.960 --> 01:59:10.960] Order your free copy today from Bibles for America [01:59:10.960 --> 01:59:19.960] Call us toll free at 888-551-0102 or visit us online at bfa.org [01:59:19.960 --> 01:59:29.960] This translation is highly accurate and it comes with over 13000 cross references plus charts and maps and an outline for every book of the Bible [01:59:29.960 --> 01:59:31.960] This is truly a Bible you can understand [01:59:31.960 --> 01:59:39.960] To get your free copy of the New Testament Recovery Version call us toll free at 888-551-0102 [01:59:39.960 --> 01:59:48.960] That's 888-551-0102 or visit us online at bfa.org
