[04:35.800 --> 04:39.800] It's similar to one we did have already, but I decided to dedicate my day to going through [04:39.800 --> 04:45.800] and making sure that this one specifically addressed the facets of what these courts [04:45.800 --> 04:49.800] are doing involving summoning you to court. [04:49.800 --> 04:55.800] Now, if you're not familiar with exactly how this works, when you get a traffic citation [04:55.800 --> 05:01.800] and blah, blah, blah, and you go down and you file documents in the court the first time, [05:01.800 --> 05:08.800] sometime down the road, they're going to send you what basically amounts to a form letter [05:08.800 --> 05:18.800] that purports to require you to show up for some proceeding or hearing of some type [05:18.800 --> 05:24.800] or be possibly arrested for failure to appear. [05:24.800 --> 05:31.800] Now, under Texas law, this would constitute a summons. [05:31.800 --> 05:40.800] A summons other than an arrest warrant or subpoena are the only instruments that can be issued [05:40.800 --> 05:47.800] by a court that create a duty upon an individual to appear before that court [05:47.800 --> 05:57.800] to address some particular issue the court allegedly is acting with jurisdiction over. [05:57.800 --> 06:07.800] Now, these form letters that they send out absolutely do not comply with the legal requirements [06:07.800 --> 06:10.800] of a summons in a misdemeanor case. [06:10.800 --> 06:18.800] In fact, they're so far removed from being proper summons, it's not even funny. [06:18.800 --> 06:25.800] And the reason it's not funny is because we, the people that are unskilled and unknowledgeable [06:25.800 --> 06:31.800] in this area are being compelled to make an appearance before a court [06:31.800 --> 06:36.800] via the process that's been given us through this document [06:36.800 --> 06:40.800] when it has absolutely no force and effect in law. [06:40.800 --> 06:48.800] And we're being threatened with arrest if we don't comply with that document. [06:48.800 --> 06:54.800] Now, this creates a separate problem of its own which I will address as I go through the parameters [06:54.800 --> 06:56.800] of the new document here. [06:56.800 --> 07:03.800] Now, the new document is, has been created using the form of the new styles we're putting together [07:03.800 --> 07:08.800] for these documents themselves including a table of contents and a table of authorities [07:08.800 --> 07:10.800] and so on and so forth. [07:10.800 --> 07:17.800] This particular document is titled Special Appearance and Notice of Declination to Appear on False Summons. [07:17.800 --> 07:22.800] Now, you can basically title a document anything you want. [07:22.800 --> 07:28.800] The title is just an informational string of text that tells the court [07:28.800 --> 07:32.800] what issue the document is meant to deal with. [07:32.800 --> 07:33.800] Okay? [07:33.800 --> 07:38.800] The title has nothing to do with the effect of law of the document itself. [07:38.800 --> 07:44.800] It's the arguments and the sites within it, whether it be case law or statute or whatever, [07:44.800 --> 07:48.800] that create the authority and power of the document. [07:48.800 --> 07:50.800] It is not the title. [07:50.800 --> 07:56.800] So when you have these idiotic courts that say, well, we don't recognize a document with this title, [07:56.800 --> 07:59.800] they're being idiots. [07:59.800 --> 08:08.800] The title has nothing to do with the legality or validity of the instrument you're putting into the court. [08:08.800 --> 08:13.800] An idiot that sits there and says that they won't recognize the document [08:13.800 --> 08:18.800] because it doesn't have a title with which they are personally familiar [08:18.800 --> 08:24.800] is begging to get sued for denial of access to the courts and deprivation of the right to do process. [08:24.800 --> 08:31.800] And I am the guy whose sole purpose in life at this point is to make you skilled enough [08:31.800 --> 08:37.800] and pissed off enough to ensure that that's exactly what they get sued. [08:37.800 --> 08:39.800] Okay? [08:39.800 --> 08:45.800] So here we go going into the details of exactly how this document is formed [08:45.800 --> 08:48.800] and the arguments we're going to make in it. [08:48.800 --> 08:53.800] In the notice that we put up there first, we simply put in a line that says [08:53.800 --> 09:00.800] whatever your last name is, declines, and I'll read my name into it for the purpose of what we're discussing here. [09:00.800 --> 09:03.800] Craig declines to appear before the court in this non-case. [09:03.800 --> 09:10.800] Instead of pretending this is a criminal case to which any requirement to appear before the court has been lawfully invoked [09:10.800 --> 09:15.800] by the issuance of a proper misdemeanor summons, Craig enters this special appearance [09:15.800 --> 09:18.800] and formal notice of declination to appear. [09:18.800 --> 09:23.800] We then go into the section titled discussion. [09:23.800 --> 09:27.800] We inform the court that we're aware of Rothgear versus Gillespie County [09:27.800 --> 09:32.800] and the due order of pleadings argument that all the documents will have from now on. [09:32.800 --> 09:41.800] We reiterate our previously stated reservation and objection to any non-judicial decision making in this case [09:41.800 --> 09:47.800] and we restate our special appearance and objection to those facts herein. [09:47.800 --> 09:54.800] Now, we then begin lest the attempt be made to continue the illusion that this is a criminal case [09:54.800 --> 09:59.800] for the purpose of clarification Craig would like to point out the following facts and law to the court. [09:59.800 --> 10:06.800] We then enter a section entitled the form letter pretending to be a pretrial notice summons. [10:06.800 --> 10:11.800] Craig is in receipt of some type of form letter titled pretrial notice [10:11.800 --> 10:17.800] and alleging to be issued by some competent authority within whatever court [10:17.800 --> 10:22.800] and in this particular case we're going with the Rockdale Municipal Court. [10:22.800 --> 10:29.800] Said pretrial notice appears to be dated July 26, 2012 and is postmarked on the same date. [10:29.800 --> 10:33.800] See attachments A and B, pretrial notice and mailing envelope [10:33.800 --> 10:39.800] and we're going to attach copies of the actual notice and the envelope that came in to this motion [10:39.800 --> 10:47.800] as attachments A and B. Craig believes that this pretrial notice is being utilized as a pretend summons [10:47.800 --> 10:52.800] for the purpose of fraudulently attempting to create a binding duty upon Craig [10:52.800 --> 11:00.800] and ordering him to appear in this court for an alleged criminal pretrial proceeding. [11:00.800 --> 11:13.800] This pretrial notice is signed only by one Renny Willis which in this case she is actually the clerk of the court in Rockdale. [11:13.800 --> 11:20.800] Anyway this pretrial notice is signed only by one Renny Willis, a person known to Craig to be merely a clerk of the court [11:20.800 --> 11:28.800] and not a proper judicial officer and magistrate having authority to issue a proper misdemeanor summons. [11:28.800 --> 11:35.800] See attached criminal complaint. Now this is where we're going to require a little explanation to you guys about what we're doing. [11:35.800 --> 11:43.800] Since this document contains only the signature of a clerk of the court and not a magistrate or judge [11:43.800 --> 11:54.800] and it pretends to have the authority to declare a duty upon us to appear in court under the alleged authority of this document [11:54.800 --> 12:02.800] then Renny Willis by placing her signature on this document is acting as a judicial officer. [12:02.800 --> 12:09.800] Something a clerk of the court absolutely is not and is not authorized to do. [12:09.800 --> 12:16.800] Now the fact that it has the city of Rockdale municipal court seal on it does not save her. [12:16.800 --> 12:23.800] She has no authority to act in a judicial capacity under the seal of the court. [12:23.800 --> 12:32.800] She can only act via agency of the judge and there's no signature by a judge or magistrate on here [12:32.800 --> 12:39.800] nor will they bring any document in the record that delegates authority to her to act in that capacity [12:39.800 --> 12:50.800] and the judge is not able to delegate nor can the legislature delegate to a clerk of the court the ability to act as a judicial officer. [12:50.800 --> 12:58.800] So we're going to write up a formal criminal complaint against the clerk for impersonating a judicial officer [12:58.800 --> 13:06.800] and we're going to attach it pre-certified the whole nine yards to this motion [13:06.800 --> 13:13.800] and we're going to send a copy both to specifically registered male return receipt requested to the city attorney [13:13.800 --> 13:20.800] who pretends to act on behalf of the state and to the judge of the particular court. [13:20.800 --> 13:32.800] Both of these people have a duty under the code of criminal procedure to act upon any verified criminal complaint put in front of them. [13:32.800 --> 13:40.800] Now we will have proof positive in the form of the return receipt that the city attorney has signed for this document [13:40.800 --> 13:46.800] provided of course we have an actual mailing address for the city attorney. [13:46.800 --> 13:55.800] If not we're going to send it to the court but we're going to specifically address it to the city attorney. [13:55.800 --> 14:07.800] Second problem is that the magistrate has a requirement to act as a magistrate when that duty is invoked by the presentation of a sworn criminal complaint. [14:07.800 --> 14:20.800] So by the return receipt signature on the card addressing the motion to him or her then that judge now is duty bound to act upon that complaint. [14:20.800 --> 14:30.800] In both cases between the judge magistrate city attorney the complaint has to be taken and submitted to the grand jury. [14:30.800 --> 14:38.800] When that does not happen we now can move against both of these individuals for failing to do their duty. [14:38.800 --> 14:51.800] The city attorney if they're going to pretend that they are allowed to act as an attorney for the state then becomes duty bound by article 2.03 of the code of criminal procedure [14:51.800 --> 15:00.800] to report this criminal activity by the clerk or any other officer to the grand jury. [15:00.800 --> 15:08.800] When the city attorney fails to do that they stepped up aided, abetted and colluded and conspired and criminally organized, [15:08.800 --> 15:17.800] acted with these individuals to commit these crimes and we're going to go after them for it from the get go. [15:17.800 --> 15:30.800] Now it's also important that the way that I'm going to handle this in the future for myself is is the entire purpose of this document as I said is to decline to appear. [15:30.800 --> 15:45.800] So despite this notice we're going to notify the court they're acting illegally and that we will react appropriately to the issuance of a warrant for failure to appear which we'll get to later in this motion. [15:45.800 --> 15:58.800] But the fact is that if the clerk has acted outside of her authority and the court has not created a duty through a proper misdemeanor summons for the accused individual to appear, [15:58.800 --> 16:04.800] they have no authority to declare a criminal act of failure to appear. [16:04.800 --> 16:13.800] You can't fail to appear in compliance with a non summons that has no force and effect under law. [16:13.800 --> 16:32.800] And when we bait the court into creating such a warrant they're going to suffer miserably when we sue them in federal court because they are absolutely acting without jurisdiction when they attempt to issue that warrant. [16:32.800 --> 16:37.800] Alright folks we'll continue on with this little document when we get to the other side of the break. [19:45.800 --> 19:47.800] If not, great. [19:47.800 --> 19:55.800] Okay, now, the next section we'll go into in the document is the statutory requirements for a lawful misdemeanor summons. [19:55.800 --> 20:09.800] Now, for there to be an actual lawful duty for Craig to appear in a court for the purpose of answering to an alleged misdemeanor criminal allegation, [20:09.800 --> 20:17.800] there must first be not only proper sufficient and timely notice to Craig via a valid and sworn criminal complaint, [20:17.800 --> 20:27.800] there must also be notice via proper misdemeanor summons that complies with the provisions of Chapter 23 of the Code of Criminal Procedure. [20:27.800 --> 20:33.800] And then we go in and we pull up Chapter 23.04 of the Code of Criminal Procedure. [20:33.800 --> 20:37.800] If you don't have that, go to it and look at it, but this is how it reads. [20:37.800 --> 20:50.800] In a misdemeanor case, in misdemeanor cases, the KPS or summons shall issue from a court having jurisdiction of the case on the filing of an information or complaint. [20:50.800 --> 21:01.800] Okay, so right there we have the requisite that they cannot issue until there has been an information or complaint filed. [21:01.800 --> 21:13.800] The summons shall be issued only upon request of the attorney representing the state and on the determination of probable cause by the judge [21:13.800 --> 21:20.800] and shall follow the same form and procedure as in a felony case. [21:20.800 --> 21:34.800] There we have the other requisite, so we'll go on down a little bit. The provisions of Article 23.04 of the Code of Criminal Procedure contain five specific mandatory requirements for any valid misdemeanor summons. [21:34.800 --> 21:41.800] One, the summons shall issue from a court having jurisdiction of the case. [21:41.800 --> 21:48.800] Since this is a civil and not a criminal case, the Rockville Municipal Court has no jurisdiction. [21:48.800 --> 22:07.800] The summons shall issue only upon the filing of an information or complaint, neither of which exist to the knowledge of Craig and neither of which can be signed and filed by a city attorney who can only pretend to represent the state. [22:07.800 --> 22:31.800] There we have the 45.201 Code of Criminal Procedure notwithstanding. Three, the summons shall be issued only upon the request of the attorney representing the state, which request also does not exist to the knowledge of Craig and which cannot be lawfully requested by a city attorney pretending to represent the state as previously mentioned. [22:31.800 --> 22:36.800] And believe me when I tell you folks they are pretending. The legislature can't give them that authority. [22:36.800 --> 22:49.800] Four, the summons shall be issued only on a determination of probable cause order by the judge, which once again no order of probable cause exist to the knowledge of Craig. [22:49.800 --> 23:05.800] And five, the summons shall follow the same form and procedure as in a felony case, and this form letter absolutely does not comply with those requirements. [23:05.800 --> 23:15.800] It is obvious from the above statute that the requirements for an alleged misdemeanor summons are the same as the requirements for a summons in a felony case. [23:15.800 --> 23:22.800] The requirements for a felony summons are found in Article 23.03 Code of Criminal Procedure and read thusly. [23:22.800 --> 23:37.800] Article 23.03 KPS or summons in felony. Subsection A, a KPS shall be issued by the district clerk upon each indictment for felony presented after bail has been set or denied by the judge of the court. [23:37.800 --> 23:50.800] Upon the request of the attorney representing the state, a summons shall be issued by the district clerk. The KPS or summons shall be delivered by the clerk or mailed to the sheriff of the county where the defendant resides or is to be found. [23:50.800 --> 23:56.800] A KPS or summons need not issue for a defendant in custody or under bond. [23:56.800 --> 24:13.800] Subsection B, upon the request of the attorney representing the state, a summons instead of a KPS shall issue if a defendant fails to appear in response to the summons, a KPS shall issue. [24:13.800 --> 24:28.800] Subsection C, summons. The summons shall be in the same form as the KPS except that it shall summon the defendant to appear before the proper court at a stated time and place. [24:28.800 --> 24:47.800] The summons shall be served upon a defendant by delivering a copy to him personally or by leaving it at his dwelling house or usual place of abode with some person of suitable age and discretion then residing therein or by mailing it to the defendant's last known address. [24:47.800 --> 24:59.800] Subsection D, a summons issued to any person must clearly and prominently state in English and in Spanish the following. [24:59.800 --> 25:27.800] It is an offense for a person to intentionally influence or coerce a witness to testify falsely or to elude legal process. It is also a felony offense to harm or threaten to harm a witness or prospective witness in retaliation for or on account of the service of the person as a witness or to prevent or delay the person's service as a witness to a crime. [25:27.800 --> 25:40.800] Now, we go further down. The provisions of Article 2.03 Code of Criminal Procedure mandate an additional 10 specific mandatory requirements for a valid misdemeanor summons. [25:40.800 --> 25:58.800] The summons, number one, the summons shall be in the same form as the capious except that it shall summon the defendant rather than being made out to a peace officer to appear before the proper court at a stated place in time. [25:58.800 --> 26:12.800] And subsection A of our argument, the required form of the capious under Article 23.02 Code of Criminal Procedure is, one, that it run in the name of the state of Texas, which this form letter does not. [26:12.800 --> 26:25.800] Two, that it name the person whose arrest is ordered or as required by Article 23.03 C, the person whose appearance before the court is requested or if unknown it has to describe him. [26:25.800 --> 26:39.800] Three, that it specify the offense of which the defendant is accused and it appears that thereby that she or he is accused of some offense against the penal laws of the state, which this form letter also does not. [26:39.800 --> 26:55.800] Four, that it name the court to which and the time when it is returnable and five, that it be dated and attested officially by the authority issuing the same, which the form letter absolutely does not. [26:55.800 --> 27:14.800] And back up out of subsection A, number two at the top level is the summons shall be served by delivering a copy personally or the summons shall be served by leaving it at the accused dwelling house or usual place of abode with some person [27:14.800 --> 27:35.800] and the suitable aids and discretion did residing therein or four, the summons shall be served by mailing it to the defendant's last known address and five, the summons must clearly state in both English and Spanish the statement contained in Article 23.03 D, which the form letter also does not. [27:35.800 --> 27:54.800] Pre-trial notice mailed to Craig by Rene Willis does not comply with the mandatory requisites required by these provisions of the code of criminal procedure, specifically stating what constitutes an actual and lawful misdemeanor, i.e. criminal summons. [27:54.800 --> 28:02.800] Okay, so we go to the next section. Citation is not valid to serve as a pre-trial summons. [28:02.800 --> 28:16.800] Craig maintains that the transportation citation issued to him does not constitute a valid summons for the purpose of binding him over for continued appearances at all future proceedings. [28:16.800 --> 28:27.800] Craig has already fully complied with the alleged duty to appear before the court when he filed his special appearance and other pleadings with the court on July 17, 2012. [28:27.800 --> 28:39.800] Even at the time of its issue, the transportation citation did not comply with the statutory requisites previously cited and declaring what constitutes a valid misdemeanor summons. [28:39.800 --> 28:46.800] How could it? A summons issued under those statutory provisions can only be a judicial process instrument. [28:46.800 --> 28:59.800] And as such, no executive officer, i.e. a peace officer or police officer, could or would have any authority to create an issue such a process. [28:59.800 --> 29:09.800] Without running afoul of the separation of powers doctrine and committing the crime of impersonating a public servant, i.e. a judicial officer. [29:09.800 --> 29:28.800] Since such violations are specifically prohibited in an Article II, Section 1, Texas Constitution and Section 37.11A1 Penal Code, it only stands to reason that the legislature is powerless to create legislation that would attempt to abrogate or derogate these prohibitions, [29:28.800 --> 29:43.800] which is precisely what the legislature attempted to do with Section 543.003-009 of the Transportation Code in relation to transportation citations and their included promise notice to appear clause. [32:34.800 --> 32:39.800] And we are going through that piece by piece right now. [32:39.800 --> 32:44.800] So, let's continue on with this, and we should be able to wrap it up here pretty quickly. [32:44.800 --> 32:50.800] I am on page 9 of 14, and the last couple of pages are just verification stuff, so we should be almost done with this. [32:50.800 --> 33:00.800] The affirmation articles of Chapter 543 Transportation Code pretend to authorize executive functionaries, i.e. peace officers and police officers, [33:00.800 --> 33:07.800] to issue what can only logically be seen as a judicial process. [33:07.800 --> 33:11.800] I'm sorry, we got a little bit of extra music there. [33:11.800 --> 33:19.800] What can only be logically be seen as a judicial process if the instrument is designed and intended to act as a lawful and proper misdemeanor summons, [33:19.800 --> 33:26.800] thus creating a duty and compelling the appearance of an accused individual to appear before some judicial court proceeding. [33:26.800 --> 33:36.800] That is, of course, providing that the issuance of a transportation citation actually facilitates a judicial proceeding rather than an administrative one. [33:36.800 --> 33:45.800] The totality of the statutes appears to absolutely confirm that it is an administrative proceeding, not judicial, that is the correct venue of such cases. [33:45.800 --> 33:55.800] That fact alone negating any and all jurisdiction of the Rockdale Municipal Court and all applicability of the transportation citation to Craig, [33:55.800 --> 34:11.800] as he is not subject to any administrative proceedings of the state unless it can be shown that he is voluntarily engaging in some regular activity over which the state has regulatory authority. [34:11.800 --> 34:26.800] Therefore, Craig maintains that the transportation citation is nothing more than a one-trick pony, serving only to obtain and establish an agreement between the officer and the accused that the accused will voluntarily appear before the [34:26.800 --> 34:41.800] allegedly judicial court specified in the associated paperwork rather than the officer being required to immediately escort the accused before a magistrate having jurisdiction of the alleged defense. [34:41.800 --> 34:50.800] Now, we know folks that these people are absolutely not abiding by the immediate appearance before a magistrate clause. [34:50.800 --> 35:03.800] When they haul you to jail instead of before the magistrate, these people are acting outside of their authority because they are failing to act with due diligence to locate and deliver you to a proper magistrate. [35:03.800 --> 35:16.800] That results in a proper charge of false imprisonment against the arresting officer and everyone at the jail, no matter where and when it is. [35:16.800 --> 35:30.800] If you have not seen the magistrate and the officer did not attempt to add in any way to take you before a magistrate, then he falsely imprisoned you according to Texas law. [35:30.800 --> 35:38.800] And anyone that aided and abetted him in that imprisonment is guilty also of the same act. [35:38.800 --> 35:49.800] If three or more of them are associated with this activity, then it becomes criminal activity under 71 of the penal code. [35:49.800 --> 35:53.800] It's also RICO at the federal level. [35:53.800 --> 35:57.800] We can really wreck some havoc on these people with this. [35:57.800 --> 36:04.800] Next section, failure to follow code of criminal procedure proves that this is not a criminal case. [36:04.800 --> 36:15.800] Craig maintains that if this were actually a criminal matter, then this alleged pretrial notice would necessarily have to comply with the aforementioned articles of the code of criminal procedure. [36:15.800 --> 36:22.800] And thus it would contain the information and formatting that are mandatory according to those statutory provisions. [36:22.800 --> 36:42.800] The statutory failings of the pretrial notice mailed to Craig are numerous and are therefore absolutely fatal and are therefore absolutely fatal to any attempt to maintain the assertion that the document constitutes a valid misdemeanor summons placing a duty upon Craig to appear before any court whatsoever. [36:42.800 --> 36:56.800] To wit, one, it is not even remotely close to the form of a capious in that, a, it does not run in the name of the state of Texas, b, it does not state the alleged offense of which Craig is being accused, [36:56.800 --> 37:15.800] c, it does not contain a valid signature attesting to its issuance by any valid and proper official authority authorized to issue a misdemeanor summons, and Craig maintains that the clerk of the court is not such an authority for such purpose. [37:15.800 --> 37:31.800] Two, there is no evidence that a summons was requested by a constitutionally and statutorily authorized attorney representing the state, which is specifically required under article 23.03a and 23.04 code of criminal procedure. [37:31.800 --> 37:39.800] There is no statement of any kind on the document that complies with the provisions of article 23.03d code of criminal procedure. [37:39.800 --> 37:55.800] In short, the document is not and cannot be even remotely construed as a valid and proper misdemeanor summons, and therefore does not constitute proper service of a misdemeanor summons upon Craig by any of the statutorily allowable and proper methods. [37:55.800 --> 38:16.800] Further, Craig maintains that it is impossible for him to be lawfully charged with failure to appear in relation to a document that in no way complies with the requisites of a proper and lawful misdemeanor summons, which is the only instrument by which the court can lawfully create and impart a duty upon Craig to appear in the first place. [38:16.800 --> 38:28.800] Therefore, Craig maintains that he has yet to be served with any proper misdemeanor summons that will require his appearance before this or any other court. [38:28.800 --> 38:34.800] Next section, even further proof that this is still not a criminal case. [38:34.800 --> 38:46.800] Considering that none of the proper and mandatory procedures in the code of criminal procedure being followed in this case, it only stands to reason that by no stretch of the imagination could this even be considered a criminal case. [38:46.800 --> 39:01.800] Especially if proper criminal procedure may be ignored on a whim or is not being complied with at all in deprivation of Craig's right of due process in an alleged criminal proceeding. [39:01.800 --> 39:17.800] Therefore, there again being no evidence upon the record supporting the existence of a criminal case, and this court's continued declination or refusal to adhere to and properly apply the rules and procedures of the code of criminal procedure. [39:17.800 --> 39:26.800] Craig is left with no choice but to believe that this is a non-case, i.e., it is civil. [39:26.800 --> 39:38.800] We can really go after him on this in the fact that there's no question when you go through this piece by piece that they're not abiding by the code of criminal procedure. [39:38.800 --> 39:43.800] And that's what this document is laying out in space. [39:43.800 --> 40:01.800] Therefore, having absolutely no, I'm sorry, yeah, that this is a non-case, i.e., it is civil, therefore having absolutely no civil jurisdiction in relation to any proceeding involving state law, the Rockdown Municipal Court is deprived of all jurisdiction in this case. [40:01.800 --> 40:13.800] Craig objects to any pretend criminal proceeding due to not only lack of proper sufficient and timely notice, but also to a complete lack of jurisdiction in this court. [40:13.800 --> 40:38.800] Therefore, Craig formally declines to appear and participate in any pretend criminal proceeding in this case until such time as jurisdiction has been proven upon the record, and Craig has been properly noticed, summonsed, and informed as to what rules and procedures are actually being applied and followed by the court in relation to said proceeding, and this case as a whole. [40:38.800 --> 40:50.800] And then only if the court is willing to wholly comply and abide by those rules and procedures at all times so that Craig is actually able to put on a vigorous and informed defense. [40:50.800 --> 41:02.800] And that, folks, is one of the things they are definitely acting to do is deprive you of your right of due process and your ability to vigorously defend yourself against the accusations. [41:02.800 --> 41:09.800] We now come to the last section, the conclusion, and we end it with two statements, one in the form of the court. [41:09.800 --> 41:14.800] The court's asking, why did you fail to appear in this court in response to our form letter? [41:14.800 --> 41:27.800] And in reply, we are stating, what duty was lawfully imparted to me that could or would require that I appear in compliance with a document that has no force and effective law? [41:27.800 --> 41:35.800] I have received no notice of any charge alleged against me or any proper summons to appear on account of same. [41:35.800 --> 41:48.800] In as much as there can be no lawful pretrial proceeding in a case where the court record reflects that no order even exists that is based on a finding of probable cause for proceeding to trial, [41:48.800 --> 42:05.800] and since the statutory procedures for determining probable cause require the conducting of a proper examining trial, and I have been unlawfully denied an examining trial, how can there be a lawful pretrial proceeding? [42:05.800 --> 42:18.800] Therefore, it is obvious even to me that the court is acting outside of the purview of the requirements of the code of criminal procedure, and from that I can only conclude that this is not and cannot be a criminal case, [42:18.800 --> 42:24.800] and therefore, there is no jurisdiction of any kind in this court, either criminal or civil. [42:24.800 --> 42:35.800] It is for these reasons that this criminal case only forum not only has no personal jurisdiction over me, but also no subject matter jurisdiction. [42:35.800 --> 42:47.800] It is a well adjudicated fact that it is acting without the necessary and proper jurisdiction that gets overzealous prosecutors and enabling judges sued. [42:47.800 --> 42:50.800] And that's it. [42:50.800 --> 43:06.800] That, folks, is one of the new documents that's going to be in the seminar material, and it is about time that we start addressing these presumptive false summonses issued by these pretend courts. [43:06.800 --> 43:18.800] If they're not going to follow the rules of the code of criminal procedure, then we can only presume and act upon that presumption that this is not a criminal case. [43:18.800 --> 43:27.800] If it were a criminal case, then by obvious necessity, the code of criminal procedure would have to apply. [43:27.800 --> 43:43.800] When the court is knowingly and willingly denying everything that is in the code of criminal procedure as being applicable, then all we can assert is that obviously this is not a criminal case. [49:45.800 --> 49:52.800] And I had checked down there like two months after that into the court record and they hadn't done anything with it. [49:52.800 --> 50:07.800] Well, it just so happened that I checked today and it says in the court record that on the 5th that they had issued a warrant. [50:07.800 --> 50:13.800] So I'm at a place where I've got to figure out how I'm actually going to go about depending on the issue of the warrant. [50:13.800 --> 50:26.800] So I guess the other thing worth mentioning was that they had allegedly sent in one of the form letters for notice to appear that went to an address that claim was undeliverable. [50:26.800 --> 50:39.800] And that would make sense. The ticket that they issued to me, I never provided them with my driver's license, so he just pulled up whatever he could find associated with me. [50:39.800 --> 50:49.800] But in that affidavit that I had turned in, I had specified clearly in there that my correct address was what it is. [50:49.800 --> 50:53.800] And they sent it to a different address anyway. [50:53.800 --> 50:54.800] What's that? [50:54.800 --> 50:56.800] And they sent it to a different address anyway. [50:56.800 --> 51:01.800] Right. So what that tells me is that it's clear that he didn't even bother to read the affidavit. [51:01.800 --> 51:12.800] No, actually, there is the possibility they read it and they still intentionally sent it to the wrong address to give them a reason for having the warrant issued. [51:12.800 --> 51:17.800] Uh-huh. Okay, well, either way. [51:17.800 --> 51:27.800] Because remember, if they arrest you, you have to post a bond, something you don't have to do before trial unless you fail to appear for some reason. [51:27.800 --> 51:32.800] And so they want that money in circulation in their system, not in yours. [51:32.800 --> 51:33.800] Right. [51:33.800 --> 51:41.800] So they'll do anything they can to get that warrant issued in the hopes that they will get you before they can actually get you to trial. [51:41.800 --> 51:45.800] Right. So what do I do at this point in time? [51:45.800 --> 51:54.800] Because that summons allegedly would have been, you know, in their view, it would have been my date of trial, right? [51:54.800 --> 52:11.800] Okay, well, what you would do is, one, you would file the document that I just talked about tonight and you would state that the notice was intentionally sent to the wrong address because you had provided the court with your correct address. [52:11.800 --> 52:36.800] So the only way that that notice could have been sent to the other location was one of two possibilities. Either the court has failed to read anything filed by the respondent or the court knowingly and intentionally sent it to the wrong address in order to falsely facilitate an arrest warrant. [52:36.800 --> 52:38.800] Okay. [52:38.800 --> 52:43.800] And so just file that document and then... [52:43.800 --> 52:48.800] Well, this document and the other one you're going to file is a motion to withdraw a warrant. [52:48.800 --> 52:49.800] Okay. [52:49.800 --> 53:16.800] And I would hand deliver that, both of them. In fact, I would go to the court but make sure I take witnesses and a recording device on everyone's person and I would go into the court and say, look, my understanding is you issued a warrant and you issued a warrant because I didn't come in on a notice that you intentionally mailed to an invalid address because the court is already aware in my filings what my proper address is. [53:16.800 --> 53:22.800] So when you say go to the court, are you mean like go and demand to see a magistrate? [53:22.800 --> 53:31.800] Well, you can go down there and just tell the clerk, I'm here to file these and I understand you folks have a warrant for me and I want to see whoever issued it right now. [53:31.800 --> 53:33.800] Okay. [53:33.800 --> 53:35.800] All right. [53:35.800 --> 53:38.800] I'll do that. [53:38.800 --> 53:47.800] Now, also just in case, take enough money to pay a bond or take two people that will have already signed a surety agreement for you. [01:04:10.800 --> 01:04:22.800] We deal with the statutes, we deal with the case law, we deal with the lack of ability of attorneys and judges to actually comprehend what they're reading, [01:04:22.800 --> 01:04:30.800] and we can prove that based upon what they're doing in relation to what the statute says they have to do. I guess what I was calling about is it's very frustrating as an attorney who wants to represent individuals against the institutions in the country, [01:04:43.800 --> 01:04:58.800] but oftentimes what I find is that libertarians particularly in the past anyway, because I dealt with this during the tort reform showdown here in Texas about 10 years ago, [01:04:58.800 --> 01:05:03.800] I called the libertarian party and I asked them, why are you not speaking up? [01:05:03.800 --> 01:05:09.800] And they said, well, we've got a Republican operative here that comes to all our meetings and that's where we get our money. [01:05:09.800 --> 01:05:20.800] And so, you know, it was difficult to deal with because, you know, I want to represent individuals against the government and against corporations, [01:05:20.800 --> 01:05:31.800] but the way the laws have been changed under Bush and under Perry, you can't really do that anymore because it was like they used medical malpractice as a battering ram [01:05:31.800 --> 01:05:41.800] and they barely won the election. They set it on a weird date and it was like 50.1% against 49.9%, [01:05:41.800 --> 01:05:49.800] and they passed all these laws that make it more difficult for us to be able to access the courthouse. [01:05:49.800 --> 01:05:53.800] And now, you know, judges are sitting over there, they don't have that much to do. [01:05:53.800 --> 01:06:02.800] I mean, it's about family and criminal law, but you can't bring court law cases anymore because it's so darn expensive because of the way they changed the law. [01:06:02.800 --> 01:06:10.800] They didn't change the law just because of facts, but they changed procedure, they changed evidence, they changed everything so that it's now, [01:06:10.800 --> 01:06:15.800] unless you've got a case worth $100,000, you can't challenge these guys. [01:06:15.800 --> 01:06:18.800] And so that's why you need to realize is that... [01:06:18.800 --> 01:06:25.800] Well, we agree with you. I mean, we absolutely agree with you that all of these people you're discussing as far as Bush and all the rest of them, [01:06:25.800 --> 01:06:32.800] they're bought and paid for by the very companies that are trying to protect their profits from these lawsuits. [01:06:32.800 --> 01:06:45.800] And the entire purpose of a tort lawsuit is to make the company feel the burn for the acts that they committed that cause the injuries that they're being sued for. [01:06:45.800 --> 01:06:48.800] Why? And this whole thing about criminal lawsuits is just bullshit. [01:06:48.800 --> 01:06:51.800] I'm excusing. It's just BS. [01:06:51.800 --> 01:06:56.800] It's, you know, the woman that spilled coffee on herself, she was getting money. [01:06:56.800 --> 01:07:00.800] That never happened. That's just total PR, okay? [01:07:00.800 --> 01:07:02.800] And we could talk about that some other time. [01:07:02.800 --> 01:07:06.800] Yeah, I've actually read the suit, so I'm familiar with what you're talking about. I've read it. [01:07:06.800 --> 01:07:18.800] I can go to the poorest person at the end of the trailer park with a, you know, the poorest person in the block and they asked me about the woman that got all that money. [01:07:18.800 --> 01:07:21.800] And I have to explain to them that that didn't really happen. [01:07:21.800 --> 01:07:32.800] So people just need to be aware that if you want to challenge the government, you want to challenge the corporations, don't support this stuff, this tort reform stuff. [01:07:32.800 --> 01:07:38.800] It's not real. It's not true. And we need to be able to challenge these people, okay? [01:07:38.800 --> 01:07:42.800] So just, that's all I'm saying. It's just so difficult. [01:07:42.800 --> 01:07:47.800] And most criminal lawyers, most criminal lawyers are really committed to what they're doing. [01:07:47.800 --> 01:07:52.800] They're good people. They're trying to challenge the system. And they're just like me. [01:07:52.800 --> 01:07:54.800] Are you talking about the defense lawyers? [01:07:54.800 --> 01:08:13.800] I'm talking about criminal defense lawyers. There are a lot of good people that are trying to, you know, challenge and make things right under the Constitution to keep the Fourth Amendment, the search and seizure laws to not be so self-serving for the government. [01:08:13.800 --> 01:08:20.800] So, you know, you can trust your lawyer. I'm sorry, but you're just not, it's just not true. [01:08:20.800 --> 01:08:26.800] Lawyers, criminal defense lawyers and personal injury lawyers, they want to represent people. [01:08:26.800 --> 01:08:32.800] They can only make money if they do that. But this corporate state that we've got now is shutting us down, man. [01:08:32.800 --> 01:08:39.800] It's shutting us down. And you need to realize that. So I'm just telling you, lawyers are not bad people. [01:08:39.800 --> 01:08:46.800] They're trying to do their job and we can't do it because the government is shutting us down. [01:08:46.800 --> 01:08:54.800] Well, I appreciate your perspective and I can attest to the fact that, yes, there are some good attorneys. There are. [01:08:54.800 --> 01:08:55.800] There's a lot of good attorneys. [01:08:55.800 --> 01:09:06.800] And I know them. But my experience in general with those that come to the criminal defense side of things, they're not there to defend you. [01:09:06.800 --> 01:09:20.800] They're not there in any way to help you win your case. They're there to help negotiate the deal that the system wants you to accept so that it gets its money and the attorney gets his. [01:09:20.800 --> 01:09:32.800] Well, you know, there's a certain amount of truth to that. I admit that. I mean, you want to make money and the government, the way it's set up, it doesn't allow you, and there's a lot of lazy lawyers. [01:09:32.800 --> 01:09:40.800] We've got to watch that. But I'm just telling you, there's a lot of good attorneys out there that want to defend you and want to be able to represent you. [01:09:40.800 --> 01:09:50.800] But it's very difficult because people are allowing the politicians that are listening to the lies of the corporations. [01:09:50.800 --> 01:10:01.800] And it's just very difficult, especially with the Citizens United thing. You know, it's just almost impossible. It's difficult for good attorneys. [01:10:01.800 --> 01:10:13.800] You need to understand that. I mean, it's, I don't know. I'm just telling you guys that it's become almost impossible to make a living doing tort law, for example, in Texas. [01:10:13.800 --> 01:10:17.800] We've all gone out of business and the corporations rule everything. [01:10:17.800 --> 01:10:24.800] Well, that part will absolutely agree with you on Kerry. No doubt about it. And that's part of why we're here. [01:10:24.800 --> 01:10:32.800] That's all I was calling in to tell you. There's a lot of good lawyers out there that want to do their job. I tell my clients all the time when they call in, I say, well, you know, I just can't do that much for you because, you know, you've got what they call a frivolous lawsuit because you've got to sort back. And I can't represent people that have, you know, back problems that last for 40 years, but everybody thinks it's a joke, you know? [01:11:00.800 --> 01:11:11.800] And because the system is set up so I can't get anybody on a jury that's ever had a back problem before, for example. And so they don't have any sympathy for people. [01:11:11.800 --> 01:11:19.800] It's just, it's not fair. And I'm just telling you, there's a lot of good lawyers out there that want to do the right thing. I think most lawyers are that way. [01:11:19.800 --> 01:11:34.800] And, you know, but libertarians need to, you know, they need to meet with progressives where we agree and try to get this thing done, you know, so we can turn back this tide of corporatism in this country. [01:21:10.800 --> 01:21:17.800] So what I did was I bought in a seatbelt exemption letter that I have used for years from a guy who used to be known as Doc Buckeloff. [01:21:17.800 --> 01:21:19.800] Have you ever heard of him? [01:21:19.800 --> 01:21:20.800] No, sir. [01:21:20.800 --> 01:21:29.800] He used to have a website called Buckeloff.com and you would get online and you would answer questions and he would give you a, if you passed or failed, [01:21:29.800 --> 01:21:34.800] you would get an exemption letter from him. [01:21:34.800 --> 01:21:44.800] And then the registration I renewed and the only reason it was expired was because a pickup that I normally drove caught on fire and this car was out of service so to speak. [01:21:44.800 --> 01:21:49.800] You know, that's the reason the sticker wasn't found but I renewed it. [01:21:49.800 --> 01:22:00.800] Well, I go in there during that time for him and I tell the clerk, I said, I'm here to see the magistrate, here to see the judge and of course they tell you, you can't see him, you got to come back, you know, waste your time. [01:22:00.800 --> 01:22:01.800] And I said, well, no, I really don't. [01:22:01.800 --> 01:22:05.800] I said, the ticket says to appear on her before and I'm here and I'd like to see him right now. [01:22:05.800 --> 01:22:15.800] We went round and round and finally I said, look, you know, just file these exemption letters and this proof that I renewed the registration, if you would, give me copies of file stamp copies. [01:22:15.800 --> 01:22:17.800] And then I left. [01:22:17.800 --> 01:22:26.800] Well, you'll find this amusing but ultimately they sent me a letter, you know, threatening for failure to appear and wanted me to sign a promise to appear and go get it notarized. [01:22:26.800 --> 01:22:27.800] Isn't that funny? [01:22:27.800 --> 01:22:28.800] It's extremely funny. [01:22:28.800 --> 01:22:32.800] That in fact is normally what's on these notice letters. [01:22:32.800 --> 01:22:46.800] In fact, the one that I'm sitting here holding has a signature line for the defendant where presumably you're supposed to go get this thing signed as if you're agreeing that this pretrial notice somehow has authority. [01:22:46.800 --> 01:22:56.800] And so I typed them up a little bit here and said, look, I've made one promise to appear and I fulfilled my promise to appear and you didn't appear and I don't really have any interest in this anymore. [01:22:56.800 --> 01:23:05.800] And so what I found out was the judge actually entered a place of not guilty for me without even a sworn complaint filed against me. [01:23:05.800 --> 01:23:06.800] Well, of course. [01:23:06.800 --> 01:23:08.800] Which I found kind of amusing and interesting. [01:23:08.800 --> 01:23:11.800] A sworn complaint kind of prohibits their ability to proceed without one. [01:23:11.800 --> 01:23:16.800] Yeah, you know, technically they have any jurisdiction whatsoever and you can argue they don't have it without an information. [01:23:16.800 --> 01:23:18.800] I know you make that argument and I agree with you Eddie. [01:23:18.800 --> 01:23:20.800] I'm warned and done. [01:23:20.800 --> 01:23:24.800] But anyway, let's pretend they can't have a jurisdiction with a sworn complaint. [01:23:24.800 --> 01:23:25.800] They didn't even have a sworn complaint. [01:23:25.800 --> 01:23:30.800] What he did was they're not guilty then instructed his clerks to swear out a complaint. [01:23:30.800 --> 01:23:34.800] The clerks swore out a complaint based on what I would call CSA. [01:23:34.800 --> 01:23:40.800] They see a ticket cross their desk and they believe it says that they have enough evidence to swear out a complaint. [01:23:40.800 --> 01:23:41.800] Okay. [01:23:41.800 --> 01:23:43.800] And then they're ultimately issued a warrant. [01:23:43.800 --> 01:23:45.800] But, you know, I was aware of the situation. [01:23:45.800 --> 01:23:48.800] So I went ahead and went in like he talked to the other caller about. [01:23:48.800 --> 01:23:49.800] Okay. [01:23:49.800 --> 01:23:58.800] And I found some paperwork ahead of time saying that I'm a popper because I've been declared by the court of Winston County in a family law situation and had appointed counsel and a whole bunch of stuff. [01:23:58.800 --> 01:23:59.800] Two different occasions. [01:23:59.800 --> 01:24:02.800] And I pointed that out and gave them the name of the attorneys and all that stuff. [01:24:02.800 --> 01:24:04.800] So they let me out on a PR bond. [01:24:04.800 --> 01:24:05.800] Okay. [01:24:05.800 --> 01:24:10.800] And then sent it for pre-trial and sent me a notice and want me to sign and notarize that. [01:24:10.800 --> 01:24:14.800] I didn't, but I went ahead and showed up at the pre-trial, which was a waste of time. [01:24:14.800 --> 01:24:16.800] And now they've sent it for a jury trial. [01:24:16.800 --> 01:24:18.800] Get this, Eddie. [01:24:18.800 --> 01:24:22.800] They say that they don't have that many, but they don't do them that often. [01:24:22.800 --> 01:24:28.800] So they can't give me a jury trial, not that I requested one, until February 2013. [01:24:28.800 --> 01:24:32.800] And as I say, this thing's already been going on for three or four months. [01:24:32.800 --> 01:24:33.800] Okay. [01:24:33.800 --> 01:24:38.800] Anyway, what I really kind of plan on doing, I think you'll find this kind of cute is filing a motion [01:24:38.800 --> 01:24:42.800] to recuse the judge within the 10-day timeframe before the jury trial. [01:24:42.800 --> 01:24:43.800] Okay. [01:24:43.800 --> 01:24:46.800] Which ought to knock me into maybe 2014 or 2015. [01:24:46.800 --> 01:24:48.800] Well, you really don't need to do that. [01:24:48.800 --> 01:24:52.800] You can file a motion to dismiss for failure to provide a speedy trial. [01:24:52.800 --> 01:24:58.800] That length of time far exceeds the necessary requirement to prosecute such a case. [01:24:58.800 --> 01:25:02.800] Well, I may do that, but I kind of like the idea of recusing them a couple of times. [01:25:02.800 --> 01:25:06.800] Well, the problem is, is the way that you have to do recusals now, Dan. [01:25:06.800 --> 01:25:11.800] You need to read the new rules under Chapter 29 of the government code. [01:25:11.800 --> 01:25:20.800] Under those new rules, if you make a motion to disqualify or recuse, they must, by law, stop all proceedings. [01:25:20.800 --> 01:25:28.800] And they must forward that motion to the head administrative judge who must conduct a hearing on the motion. [01:25:28.800 --> 01:25:36.800] However, if he decides against you, they have the ability to do two things. [01:25:36.800 --> 01:25:45.800] Assess a charge of contempt of court if they determine that it was frivolous or intended to delay. [01:25:45.800 --> 01:25:49.800] And they can assess you a penalty fine for it. [01:25:49.800 --> 01:25:55.800] So be real careful when you start using those motions to recuse or disqualify. [01:25:55.800 --> 01:26:01.800] Well, I'll have to read that, Eddie. I'll take your word for it because you're very knowledgeable, but I've done it many times over the last year. [01:26:01.800 --> 01:26:05.800] Yeah, this law went into effect last year. [01:26:05.800 --> 01:26:11.800] Okay, I'm surprised because I did it in the Round Rock Court about a month ago, a month and a half ago. [01:26:11.800 --> 01:26:17.800] Well, don't expect them to always know what the changes in the law are either because they don't. [01:26:17.800 --> 01:26:20.800] But you need to be aware of it. [01:26:20.800 --> 01:26:25.800] Well, I'm going to look into what you're talking about in the motion to dismiss for speedy trial. [01:26:25.800 --> 01:26:31.800] But the point was, I knew you'd find it cute that they want you to repromise to appear and go get it notarized. [01:26:31.800 --> 01:26:39.800] And I also thought you might find it interesting and hopefully your other listeners will realize that these people are so vulnerable to any kind of fight whatsoever. [01:26:39.800 --> 01:26:46.800] Okay? I mean, imagine what would happen if 10% of the people that got thick had actually just fought it conventionally. [01:26:46.800 --> 01:26:52.800] You know, didn't even know, but just took it to trial and demanded a jury trial. I mean, they'd be out into the next century. [01:26:52.800 --> 01:27:00.800] Yeah, and on top of that, they would drive the cost of prosecutions of how the system would self-destruct under the weight of its expenses versus its profits. [01:37:49.800 --> 01:37:56.800] But since it has no force and effect of law, I decline your invitation to this little railroading [01:37:56.800 --> 01:37:57.800] party. [01:37:57.800 --> 01:38:04.800] I forgot my coveralls and hammerpick, so I won't be attending this job that you've got. [01:38:04.800 --> 01:38:09.800] And we go through and we assert exactly why the little form letter does not comply with [01:38:09.800 --> 01:38:10.800] law. [01:38:10.800 --> 01:38:17.800] And we set the stage for the court to do exactly what we want them to do, which is file an [01:38:17.800 --> 01:38:20.800] illegal warrant for failure to appear. [01:38:20.800 --> 01:38:28.800] And believe me, when the court has no jurisdiction and is maliciously filing warrants, knowing [01:38:28.800 --> 01:38:34.800] full well it has not filed a proper summons that would vest them with jurisdiction to issue [01:38:34.800 --> 01:38:40.800] that warrant, then they can and should be sued. [01:38:40.800 --> 01:38:45.800] And we are setting the stage to make that happen with this document. [01:38:45.800 --> 01:38:52.800] So hopefully as the updates become closer and closer to being ready to be sent out, folks, [01:38:52.800 --> 01:38:57.800] I know there are many of you listening that are just chomping at the bit to get the updates. [01:40:26.800 --> 01:40:32.800] One with the old style that was in effect when somebody's case at the time was ongoing [01:40:32.800 --> 01:40:38.800] and one for the future under the new law for somebody that gets a new citation. [01:40:38.800 --> 01:40:42.800] So as you can see, it's kind of a pain in the butt that we have to maintain multiple copies [01:40:42.800 --> 01:40:46.800] of the documents for these situations, but we do. [01:40:46.800 --> 01:40:51.800] If we don't, then we're not going to be able to help those that got a ticket prior to the [01:40:51.800 --> 01:40:53.800] change in the statute. [01:40:53.800 --> 01:40:56.800] So we can only help those that are moving forward. [01:40:56.800 --> 01:41:02.800] And my objective here is to help as many people as possible be armed and ready to fight. [01:41:02.800 --> 01:41:07.800] And that is the delays that come about because of these changes. [01:41:07.800 --> 01:41:12.800] But this document has pretty much taken me all day to write it because of the amount of [01:41:12.800 --> 01:41:17.800] reading and research I had to do to formulate the arguments the way we needed them. [01:41:17.800 --> 01:41:24.800] But, I mean, even a lawyer should be able to understand this document. [01:41:24.800 --> 01:41:29.800] I tried to write it to such a reading level that they could, but who knows. [01:41:29.800 --> 01:41:34.800] We never have yet to see one, especially on the prosecutor side, that was capable of [01:41:34.800 --> 01:41:42.800] comprehending anything above their own argument, which is almost always without basis in law. [01:41:42.800 --> 01:41:46.800] It's simply their argument of osmosis, as I call it. [01:41:46.800 --> 01:41:49.800] It is that way because of conventional wisdom. [01:41:49.800 --> 01:41:53.800] I've learned it, I've absorbed it, and conventional wisdom is what matters here. [01:41:53.800 --> 01:41:56.800] These laws apply to everybody. [01:41:56.800 --> 01:41:59.800] Well, that, folks, is a false conventional wisdom. [01:41:59.800 --> 01:42:05.800] Pretty much like the old wise tale that moss only grows on the north side of trees. [01:42:05.800 --> 01:42:09.800] It simply is not true. [01:42:09.800 --> 01:42:10.800] Okay? [01:42:10.800 --> 01:42:20.800] I don't care how many people know a false fact, the number of people that are aware and [01:42:20.800 --> 01:42:30.800] repeat a false fact does not add one atom of truth to the false fact. [01:42:30.800 --> 01:42:33.800] That's just the way it is. [01:42:33.800 --> 01:42:38.800] And that is what we're dealing with in a lot of what's going on with the transportation [01:42:38.800 --> 01:42:42.800] and criminal cases in general in Texas and a lot of other states. [01:42:42.800 --> 01:42:51.800] The attorneys, the judges, they're all acting on presumptions of law that are not based on the actual law. [01:42:51.800 --> 01:42:59.800] Like I say, the one regarding the commencement of a proceeding in a municipal court on complaint alone. [01:42:59.800 --> 01:43:01.800] One, the statute never said that. [01:43:01.800 --> 01:43:08.800] The case law that brought that opinion forward and made it the doctrine of the day was in 1958. [01:43:08.800 --> 01:43:10.800] Okay? [01:43:10.800 --> 01:43:22.800] That case died the moment 45.01 of the Code of Criminal Procedure was repealed back in 1996 by the legislature. [01:43:22.800 --> 01:43:32.800] Any case law that appealed that section of statute to be valid in a particular way died when that section of statute was repealed. [01:43:32.800 --> 01:43:38.800] So there's no longer any precedent for these courts to claim that a complaint alone is what's required. [01:43:38.800 --> 01:43:49.800] In fact, a reading of the statute shows that they are utterly clueless that it is absolutely no longer viable to start a case on a complaint alone. [01:48:39.800 --> 01:48:46.800] Well, I just wanted to comment on some of the things that were said by the attorney that called in earlier, [01:48:46.800 --> 01:48:52.800] and see if I could get you to elaborate on some of the things that you were saying in the very beginning of the show. [01:48:52.800 --> 01:48:54.800] Well, I'll do what I can see. [01:48:54.800 --> 01:49:01.800] Okay, well, I just wanted to read something that was published in May of 2007 [01:49:01.800 --> 01:49:07.800] from Attorney David Geislinger in the Colorado Law Review, [01:49:07.800 --> 01:49:09.800] which says, [01:49:09.800 --> 01:49:16.800] I wish the reality of our profession, at least as viewed by the people we purports to serve, could be seen as a glass half full. [01:49:16.800 --> 01:49:23.800] I am afraid, however, that because lawyers view justice differently than non-lawyers, we are drinking from different cups. [01:49:23.800 --> 01:49:30.800] For too long, we who are in the system of justice have insisted that those outside defer to our point of view. [01:49:30.800 --> 01:49:33.800] I think it's time we look at ourselves through their eyes. [01:49:33.800 --> 01:49:40.800] If the non-lawyers in our society truly expect that we are interested in justice as the majority of people understand it to be, [01:49:40.800 --> 01:49:47.800] we first must accept the fact that we are not now and quite possibly have never been viewed by our community as the professionals we claim to be. [01:49:47.800 --> 01:49:53.800] Instead, we are viewed in many ways, rightly so, as the educated and wealthy elites making our living, [01:49:53.800 --> 01:49:59.800] helping the legally illiterate maneuver through the procedural waters of the law that we have created, [01:49:59.800 --> 01:50:02.800] and that cannot be navigated without us. [01:50:02.800 --> 01:50:11.800] It is an unfortunate reality that those who are not educated in the law are required to navigate these waters as a condition of their membership in the society. [01:50:11.800 --> 01:50:15.800] I think that sums up a lot. [01:50:15.800 --> 01:50:23.800] And let me say, I have friends that are attorneys, but I think this sums up a lot of how people view attorneys. [01:50:23.800 --> 01:50:32.800] And for anyone of a religious faith, those words are echoed in the book of Luke 11, 46 through 52. [01:50:32.800 --> 01:50:43.800] And I have been told by public defenders, point blank, my job is, and this was some years ago when I actually still needed public defenders, [01:50:43.800 --> 01:50:47.800] but I've been told point blank, my job is not to help you win your case. [01:50:47.800 --> 01:50:56.800] My job is to make sure that your rights are protected at every step in the process so that you cannot possibly have any issues upon which to appeal. [01:50:56.800 --> 01:51:00.800] And if you look at what they do, that's pretty much what they do. [01:51:00.800 --> 01:51:11.800] And if you look in corporate stewardship condom and look at the definition of a client, I pretty much spells out that when you become a client of an attorney, [01:51:11.800 --> 01:51:20.800] you have declared yourself to be noncomplimentous, mentally incompetent, and a ward of the court, and you wave your rights into the lap of the attorney to manage for you. [01:51:20.800 --> 01:51:29.800] And an attorney's duties in importance of highest to lowest are first to the record and then to the court and then to the client. [01:51:29.800 --> 01:51:37.800] So you are his last priority. His first and primary function is to, you know, as an officer of the record and an officer of the court. [01:51:37.800 --> 01:51:45.800] So I just wanted to comment on that as to what you were saying at the beginning of the show. [01:51:45.800 --> 01:51:49.800] I mean, you're dead on with this new document that you're working on. [01:51:49.800 --> 01:51:57.800] But you and I both know, well, at least around here, if you go into the court and you show them how they have screwed up and part of their process, [01:51:57.800 --> 01:52:04.800] you know, how they've gotten the cart ahead of the horse, they will always try to say, oh, well, we'll continue the math. [01:52:04.800 --> 01:52:10.800] For example, if you say, I haven't seen a prompt, I just want to verify, explain our information, you know, prior to this proceeding. [01:52:10.800 --> 01:52:17.800] They'll say, oh, well, we'll, we'll continue this matter for, you know, 30 days or whatever, and we'll get you whatever it is that you're complaining about. [01:52:17.800 --> 01:52:21.800] Now, we both know they're not supposed to do that, but they do it all the time. [01:52:21.800 --> 01:52:24.800] So yeah, well, here in Austin, they do exactly the opposite. [01:52:24.800 --> 01:52:29.800] But we're going to go ahead and proceed and we'll let the court of appeals tell me whether or not I'm doing it right. [01:52:29.800 --> 01:52:36.800] Well, actually, Judge, we're going to let the lawsuit you're landing on your own head tell you if you're doing it right. [01:52:36.800 --> 01:52:38.800] Wow, that's pretty blatant on their part. [01:52:38.800 --> 01:52:41.800] Absolutely blatant. [01:52:41.800 --> 01:52:43.800] Well, you know, and I'll drop off. [01:52:43.800 --> 01:52:50.800] I just want to see if I could get you to elaborate for people in areas, you know, all of the courts here and around this area, [01:52:50.800 --> 01:52:57.800] they always try to, as you say, you know, that's a bill that they can't unring, they always try to unring the bill by saying, well, we'll continue the matter, [01:52:57.800 --> 01:53:00.800] you know, and fix whatever we've done to screw up. [01:53:00.800 --> 01:53:08.800] So I'd like to hear you elaborate a little bit more if you can on, you know, how to bind them and say, no, you're not doing that. [01:53:08.800 --> 01:53:11.800] You can't do it, you know, so on and so forth. [01:53:11.800 --> 01:53:24.800] Yeah, well, one of the ways is that they always, always screw up is by failing to comply with 45.018b and 45.019f. [01:53:24.800 --> 01:53:30.800] In regards to providing you with a copy of the complaint prior to any proceeding. [01:53:30.800 --> 01:53:32.800] Yeah, and they, I'm aware of that. [01:53:32.800 --> 01:53:40.800] And they, they always try to say, well, the citation is the, you know, the complaint, which I, you know, I know how to deal with that as well. [01:53:40.800 --> 01:53:46.800] Yeah, but for those that don't, they're attempting to use 27.14d to make that assertion. [01:53:46.800 --> 01:53:59.800] And 27.14d can only be applicable if the accused has a signed waiver that has both their signature and the prosecuting attorneys of the state on it, [01:53:59.800 --> 01:54:02.800] waving the complaint. [01:54:02.800 --> 01:54:09.800] The problem is, is that they can't do anything without a sworn complaint. [01:54:09.800 --> 01:54:17.800] Without a sworn complaint, they can't get an information, without an information or, or sworn complaint, they can't get an indictment. [01:54:17.800 --> 01:54:25.800] Without one of those two documents, there's no jurisdiction ever vested in the court to hold a hearing of any kind. [01:54:25.800 --> 01:54:27.800] Yep, that's exactly right. [01:54:27.800 --> 01:54:30.800] And, you know, as, as we've talked about before, they do work on the acquiescence. [01:54:30.800 --> 01:54:39.800] So if there's something that they are supposed to be doing and you don't raise the issue, you acquiesce that it's okay for them to just go ahead and proceed without it. [01:54:39.800 --> 01:54:41.800] So it's very important to raise those issues. [01:54:41.800 --> 01:54:47.800] However, when you do, you know, as I said in a lot of courts, they try to clean it up by saying, oh, well, we'll just, we'll give you some more time. [01:54:47.800 --> 01:54:55.800] We'll continue this matter and we'll get you whatever it is that you're asking for that we were supposed to have already done. [01:54:55.800 --> 01:55:00.800] Yeah, and then you, of course, need to object to that and say, you can't go back and fix this problem. [01:55:00.800 --> 01:55:02.800] The proceeding has occurred. [01:55:02.800 --> 01:55:07.800] The proceeding will not magically disappear just because you want to do it again. [01:55:07.800 --> 01:55:13.800] You are required to have this in place before that proceeding ever started and you didn't. [01:55:13.800 --> 01:55:15.800] That can't be fixed. [01:55:15.800 --> 01:55:16.800] Yeah. [01:55:16.800 --> 01:55:20.800] Yeah, it's very important to get it on the record. [01:55:20.800 --> 01:55:23.800] Yeah, whether they have one or not. [01:55:23.800 --> 01:55:25.800] Yeah. [01:55:25.800 --> 01:55:26.800] Yep, absolutely. [01:55:26.800 --> 01:55:27.800] Okay. [01:55:27.800 --> 01:55:33.800] Well, you know, I just, that's a rampant problem around here and I'm sure it is another area. [01:55:42.800 --> 01:55:51.800] Now, also, I was talking to you offline before this, I gave you a document on the O's of office and you said you discovered something in it that you didn't know. [01:56:36.800 --> 01:56:48.800] I wasn't aware, for example, that the anti-bribery statements had to be sworn prior to the O's of office. [01:56:48.800 --> 01:56:55.800] It's got to be both sworn and filed with the records keeper of the office before they can take the O's of office. [01:56:55.800 --> 01:56:56.800] Right. [01:56:56.800 --> 01:57:00.800] I did not know that there was any chronological importance to that. [01:57:00.800 --> 01:57:05.800] I thought that they just had to do both and it really didn't matter what order it was in. [01:57:05.800 --> 01:57:13.800] That whole section there, one, two, three and four, that before the O's of office is taken, the anti-bribery statement must be sworn. [01:57:13.800 --> 01:57:20.800] Before the duties of officer are assumed, the anti-bribery statement, well, actually, I knew that part of it. [01:57:20.800 --> 01:57:26.800] Section one, be complying with the previous statements required must be filed with the appropriate office. [01:57:26.800 --> 01:57:28.800] Yeah, I was not aware of that. [01:57:28.800 --> 01:57:38.800] I've actually experienced situations, well, I've told you before that every time we ask for an O's of office, those judges just disappear and another judge will step in. [01:57:38.800 --> 01:57:48.800] There was one case where we fought and fought and fought because the judge's O's of office and when we finally got it, it was signed the day before we got it, [01:57:48.800 --> 01:57:52.800] which was about a few months after the trial where we got railroad. [01:57:52.800 --> 01:57:57.800] Yeah, which completely invalidated the trial because he had no authority to sit. [01:57:57.800 --> 01:57:59.800] So we're going to go back after that.
