[00:00.000 --> 00:04.880] This news brief brought to you by the International Newsnet. [00:04.880 --> 00:10.100] The Washington Post reported Thursday Defense Secretary Leon Panetta seized a strong likelihood [00:10.100 --> 00:13.080] Israel would strike Iran as early as April. [00:13.080 --> 00:17.720] Columnist David Ignatius wrote the report after a background briefing with Panetta. [00:17.720 --> 00:22.440] Meanwhile Deputy Prime Minister Moshe Yalon claimed this week Iran is getting ready to [00:22.440 --> 00:27.200] produce long-range missile aimed at the US. [00:27.200 --> 00:32.800] Deputy Watchdog Fairness and Accuracy in Reporting has criticized ABC World News. [00:32.800 --> 00:39.040] For broadcasting a, quote, blatantly propagandistic report on the supposed threat Iran poses to [00:39.040 --> 00:40.200] the US. [00:40.200 --> 00:45.600] Anchor Diane Sawyer, Echo Director of National Intelligence, Jane Clapper's claim, Iran [00:45.600 --> 00:50.240] is, quote, more determined than ever to launch an attack on US soil. [00:50.240 --> 00:56.600] Fair accused ABC News of passing along incendiary allegations from government officials without [00:56.600 --> 00:59.680] skeptical scrutiny. [00:59.680 --> 01:03.920] The American Civil Liberties Union Wednesday filed a lawsuit demanding the government release [01:03.920 --> 01:07.640] basic information about its targeted killing program. [01:07.640 --> 01:13.600] The ACLU suit overlaps one recently filed by the New York Times seeking the legal memos [01:13.600 --> 01:16.000] on which the targeted killing program is based. [01:16.000 --> 01:21.240] But the ACLU suit is broader, seeking the government's evidentiary basis for strikes [01:21.240 --> 01:27.040] to kill three Americans in Yemen last year. [01:27.040 --> 01:31.640] The New York Times reported Friday that Securities and Exchange Commission has repeatedly let [01:31.640 --> 01:35.480] Wall Street's biggest firms off the hook in fraud cases. [01:35.480 --> 01:42.400] A Times analysis of SEC investigations over the last decade found nearly 350 cases where [01:42.400 --> 01:46.480] the agency gave big Wall Street institutions a pass. [01:46.480 --> 01:51.720] JPMorgan Chase has settled six fraud cases in the last 13 years, but has obtained at [01:51.720 --> 01:57.160] least 22 waivers, partly by arguing and has, quote, a strong record of compliance with [01:57.160 --> 01:59.360] securities laws. [01:59.360 --> 02:05.440] Bank of America and Merrill Lynch, which merged in 2009, have settled 15 fraud cases and [02:05.440 --> 02:09.480] received at least 39 waivers. [02:09.480 --> 02:13.920] Inter Press Service reports Israel is counting on the influence of right-wing extremist views [02:13.920 --> 02:19.440] in U.S. politics to bring pressure to bear on Barack Obama to greenlight a possible Israeli [02:19.440 --> 02:22.720] attack during the election campaign this fall. [02:22.720 --> 02:26.720] The chairman of the Joint Chiefs of Staff, General Martin Dempsey, told Israeli leaders [02:26.720 --> 02:32.080] recently the U.S. would not participate in a war against Iran begun by Israel without [02:32.080 --> 02:34.160] prior agreement from Washington. [02:34.160 --> 02:38.760] Dempsey's warning conveyed to both Prime Minister Benjamin Netanyahu and Israeli Defense [02:38.760 --> 02:44.920] Minister Ahud Barak represents Obama's strongest move yet to deter an Israeli attack and ensure [02:44.920 --> 02:50.320] the U.S. is not caught up in a regional conflagration with Iran, but the Israeli government remains [02:50.320 --> 02:56.080] defiant about maintaining its freedom of action to make war on Iran despite receiving billions [02:56.080 --> 02:58.200] in U.S. military aid. [09:42.480 --> 09:47.480] And for all those that are out there doing the same thing and coming to the classes and [09:47.480 --> 09:52.480] reading and studying to fight these issues, God bless each and every one of you because [09:52.480 --> 09:56.480] as Randy says, the fact that you're out there and you're letting us know that we're having [09:56.480 --> 10:00.480] an effect on you motivates us to do what we're doing. [10:00.480 --> 10:07.480] If we didn't think we had a chance in us in hell of doing anything for anybody other than [10:07.480 --> 10:11.480] us, I doubt that we would make the effort. [10:11.480 --> 10:13.480] Well, you are making a difference. [10:13.480 --> 10:15.480] So keep it up. [10:15.480 --> 10:16.480] We appreciate it. [10:16.480 --> 10:19.480] I know, like I said, if I had a ticket, I'd be with you. [10:19.480 --> 10:22.480] I have had some other issues that Randy's helped us through. [10:22.480 --> 10:25.480] And I hope never to have to go there again. [10:25.480 --> 10:34.480] However, I have started sort of spreading the word and people around me have had issues [10:34.480 --> 10:38.480] that when I find out about them, of course, to be honest, that you've got some radio [10:38.480 --> 10:40.480] listening to do and you've got some work. [10:40.480 --> 10:45.480] And a couple of people have actually picked up the ball and a couple of others have said, [10:45.480 --> 10:48.480] don't worry that I'm paying the fine and walking away. [10:48.480 --> 10:49.480] Yeah. [10:49.480 --> 10:57.480] I am beginning to think that this traffic issue may be more important than we give [10:57.480 --> 10:58.480] it credit for. [10:58.480 --> 11:00.480] Oh, I think it's the tip of the iceberg. [11:00.480 --> 11:09.480] We could really make a cheek in the major system with very little threat to our cell. [11:09.480 --> 11:15.480] This is the least threatening thing out there that we can have a solid say in. [11:15.480 --> 11:24.480] And the whole nature of the way the police are developing is built on the traffic issue. [11:24.480 --> 11:33.480] The police are watching the courts abuse people horribly in the traffic arena. [11:33.480 --> 11:41.480] And the police are becoming emboldened and the municipalities are using this traffic [11:41.480 --> 11:46.480] issue to finance more police. [11:46.480 --> 11:52.480] I live in a very small town and we now have five policemen. [11:52.480 --> 11:55.480] What the heck is going on? [11:55.480 --> 12:00.480] Yeah, I bet nobody's been killed there in the years. [12:00.480 --> 12:06.480] We don't, these five policemen need something to do to show that they are earning their [12:06.480 --> 12:07.480] pay. [12:07.480 --> 12:14.480] Are they getting the cats out of the trees and the kids stuck on the curb? [12:14.480 --> 12:16.480] No, they're writing tickets. [12:16.480 --> 12:17.480] I know. [12:17.480 --> 12:24.480] Yeah, there's nothing quite so bad in public service as the individual that has to basically [12:24.480 --> 12:31.480] find a way to, I don't know exactly what the terminology is, justify their job. [12:31.480 --> 12:32.480] That's right. [12:32.480 --> 12:37.480] Look at Austin, Austin has police everywhere. [12:37.480 --> 12:43.480] When I was in Australia, I almost never saw a policeman. [12:43.480 --> 12:45.480] Yeah, I remember that growing up. [12:45.480 --> 12:52.480] When I was a kid, it would be months before I'd even lay eyes on a state trooper car or [12:52.480 --> 12:56.480] any other type of police car for that matter unless we just happened to be driving right [12:56.480 --> 12:58.480] by the Sheriff's Department. [12:58.480 --> 13:03.480] Now, you can't spend in any given direction and not have one drive through the mist. [13:03.480 --> 13:09.480] No, I've had him drive down my little residential street up and down just looking around. [13:09.480 --> 13:10.480] There's nothing they're doing. [13:10.480 --> 13:11.480] There's no lights on. [13:11.480 --> 13:12.480] There's nobody called them. [13:12.480 --> 13:14.480] He's driving by. [13:14.480 --> 13:19.480] So they would probably say, well, you know, I'm watching out for you, but I don't consider [13:19.480 --> 13:22.480] that to be a necessary item. [13:22.480 --> 13:26.480] I don't need to be checked on. [13:26.480 --> 13:28.480] Yeah, I don't need you to do that. [13:28.480 --> 13:30.480] I can call you to come pick the body up. [13:30.480 --> 13:32.480] I don't need you here. [13:32.480 --> 13:36.480] Unfortunately, we can no longer trust them to watch out for us. [13:36.480 --> 13:37.480] And that's the problem. [13:37.480 --> 13:40.480] No, I feel like they're surveilling. [13:40.480 --> 13:44.480] They're the guy casing the joint. [13:44.480 --> 13:51.480] Unfortunately, you know, I don't like to think that way, but it sure is the way it appears [13:51.480 --> 13:57.480] to be going, that the police are a worse threat to us than the criminal. [13:57.480 --> 14:00.480] In many cases, I agree. [14:00.480 --> 14:07.480] So I think we are doing the right thing to try and take it into the court. [14:07.480 --> 14:16.480] And as courageous as anyone can be, I encourage you to rise to your level of courage. [14:16.480 --> 14:18.480] Do what you can. [14:18.480 --> 14:20.480] I'm trying my best. [14:20.480 --> 14:22.480] I have a lot of courage. [14:22.480 --> 14:27.480] I haven't had a lot of experience to stand up there and put myself in front of something either. [14:27.480 --> 14:35.480] But I'm recognizing daily more of a need to do that, to stretch, to make an effort to go out there. [14:35.480 --> 14:41.480] And if I can encourage anyone at all in the sound of my voice, that's what I would encourage you to do. [14:41.480 --> 14:45.480] Just do one small thing above what you've done in the past. [14:45.480 --> 14:46.480] Step one step. [14:46.480 --> 14:51.480] That's the tiny step outside your comfort zone, and you will get more comfortable with it. [14:51.480 --> 14:54.480] And next year, maybe you can step another way out. [14:54.480 --> 14:58.480] But if we don't start to step out of our comfort zone, we will lose this. [14:58.480 --> 15:07.480] And we will go and commit right down the tubes the way all the other countries before us have gone, [15:07.480 --> 15:09.480] who's gone to military states. [15:09.480 --> 15:13.480] And I personally don't want to live in a military state. [15:13.480 --> 15:20.480] And if it means becoming the militia, then I need to do that because that's what my forefathers told me I should do. [15:20.480 --> 15:22.480] And so, you know... [15:22.480 --> 15:30.480] We are at the present living in the worst police state the world has ever seen. [15:30.480 --> 15:32.480] Yes, but we're still kind of... [15:32.480 --> 15:34.480] And most people have no tune. [15:34.480 --> 15:41.480] And the thing is, is the founding fathers instituted that right to keep and bear arms for a reason. [15:41.480 --> 15:43.480] And this, unfortunately, is it. [15:43.480 --> 15:50.480] The right to keep and bear arms is to prevent exactly what we're being subjected to. [15:50.480 --> 15:58.480] And unfortunately, that option is rapidly becoming the only one available. [15:58.480 --> 16:00.480] And they're ensuring that. [16:00.480 --> 16:06.480] Now, whatever their basis may be, wanting to declare martial law or not, [16:06.480 --> 16:17.480] even if they declare martial law, of what benefit will it do them to do so when they're still outnumbered 300 to 1? [16:17.480 --> 16:25.480] Well, the other thing is that we need to understand that that right to bear arms and defend ourselves is not necessarily just a right. [16:25.480 --> 16:27.480] It's a responsibility. [16:27.480 --> 16:28.480] We really... [16:28.480 --> 16:33.480] You don't have a right that doesn't connect to a responsibility. [16:33.480 --> 16:35.480] That's absolutely true. [16:35.480 --> 16:37.480] You're not passed the law. [16:37.480 --> 16:42.480] You cannot exercise a right without responsibility associated with it. [16:42.480 --> 16:43.480] You just can't. [16:43.480 --> 16:44.480] That's right. [16:44.480 --> 16:49.480] Well, I'll let y'all go and touch base these three dates that you have. [16:49.480 --> 16:50.480] Let us know. [16:50.480 --> 16:51.480] All right. [16:51.480 --> 16:52.480] Thank you, ma'am. [16:52.480 --> 16:53.480] All right, folks. [16:53.480 --> 16:54.480] This is Rural Law Radio. [16:54.480 --> 16:58.480] We'll be right back on the other side of this break. [16:58.480 --> 17:00.480] America is in trouble. [17:00.480 --> 17:02.480] Washington is a disgrace. [17:02.480 --> 17:05.480] Government has become too big. [17:05.480 --> 17:07.480] It's overtaxing, overspending. [17:07.480 --> 17:08.480] We need to change direction. [17:08.480 --> 17:09.480] We really need change. [17:09.480 --> 17:12.480] You can't afford to make the same mistakes we've made in the past. [17:12.480 --> 17:14.480] Mitt Romney's reputation is a flip-flopper. [17:14.480 --> 17:18.480] He went the other way when he got paid to go the other way. [17:18.480 --> 17:20.480] There is need for economic stimulus. [17:20.480 --> 17:21.480] It's about serial hypocrisy. [17:21.480 --> 17:23.480] This election is about trust. [17:23.480 --> 17:27.480] There's been one true, consistent candidate, and that's Dr. Ron Paul. [17:27.480 --> 17:30.480] Ron Paul has been so consistent from the very beginning. [17:30.480 --> 17:32.480] He seems like a more honest candidate. [17:32.480 --> 17:35.480] He tells the truth about what he believes, whether you like it or not. [17:35.480 --> 17:39.480] He's never once voted for a tax increase, never once voted for an unbalanced budget. [17:39.480 --> 17:41.480] Ron Paul's plan is bold. [17:41.480 --> 17:43.480] Cutting five departments is what we need. [17:43.480 --> 17:47.480] When he says he's going to cut a trillion dollars in the first year, I believe it. [17:47.480 --> 17:52.480] If you don't like how things are going and tired of politicians, he's something different. [17:52.480 --> 17:53.480] Ron Paul. [17:53.480 --> 17:54.480] Ron Paul. [17:54.480 --> 17:55.480] Ron Paul. [17:55.480 --> 17:56.480] Ron Paul. [17:56.480 --> 17:57.480] Is the one we've been looking for. [17:57.480 --> 18:00.480] I'm Ron Paul, and I approve this message. [18:00.480 --> 18:05.480] Are you being harassed by debt collectors with phone calls, letters, or even lawsuits? [18:05.480 --> 18:09.480] Stop debt collectors now with the Michael Mearris Proven Method. [18:57.480 --> 19:19.480] To learn how to stop debt collectors next. [19:19.480 --> 19:37.480] Alright folks, we are back. This is ruleoflawradio. [19:37.480 --> 19:49.480] Call in number is 5126461984. If you've got any questions or issues, please go ahead and get in line. [19:49.480 --> 19:52.480] I do remember that in the third segment we will be bringing a guest on at which point, if you're on the caller board, [19:52.480 --> 19:57.480] we're going to put you on hold for a little while until Red starts taking questions on whatever he's discussing. [19:57.480 --> 20:02.480] Feel free, is the gentleman from Australia that Randy's had on a couple of times already. [20:02.480 --> 20:07.480] Now, in the meantime, until we do get some callers to talk to, [20:07.480 --> 20:13.480] I want to talk a little bit about the game plan for court this coming Wednesday. [20:13.480 --> 20:25.480] Basically, I am going to be doing something that I have specifically gone against teaching others to do. [20:25.480 --> 20:30.480] And that is, I am going to go directly to the merits of the case. [20:30.480 --> 20:37.480] Now, I am going to put my outstanding objections on the record beforehand about all the stuff they've done wrong. [20:37.480 --> 20:41.480] But in the meantime, I'm going directly to merits. [20:41.480 --> 20:53.480] Now, the reason I'm going to do this is because eventually we have to get the issue of transportation into the courts. [20:53.480 --> 21:02.480] If we cannot get that issue in and get it argued out, we're never going to make this system accountable for what it's doing. [21:02.480 --> 21:05.480] So this has to be done. [21:05.480 --> 21:16.480] So given that, there are a set of things that I'm going to directly in relation to this issue regarding transportation. [21:16.480 --> 21:23.480] Now, I'm fortunate in the fact that I have been in contact with a gentleman by the name of Scott Cunningham. [21:23.480 --> 21:27.480] Scott Cunningham works for the Texas Department of Transportation. [21:27.480 --> 21:41.480] He is the person that is responsible for conducting the highway safety examinations that are used to set the appropriate speed limits on the highway. [21:41.480 --> 21:49.480] He not only does those tests, but he is in charge of ensuring that the changes to the speeds are properly implemented and completed. [21:49.480 --> 21:57.480] So, he is going to be called and used as an expert witness. [21:57.480 --> 22:03.480] I got a little bit of a cough and it tickles sometimes, so I don't mean to cough and you're out there, folks. [22:03.480 --> 22:11.480] But in any case, he's going to be brought to the stand and he's going to be questioned as an expert witness. [22:11.480 --> 22:18.480] And we're going to use his testimony to show several things about this particular stretch of road. [22:18.480 --> 22:28.480] One, that the speed limit on it was set arbitrarily low in accordance with state requirements for that type of roadway. [22:28.480 --> 22:42.480] Number two, we're going to show that, you know, that section of highway has been undergoing revision for the speed limits since sometime last year. [22:42.480 --> 22:54.480] We're also going to use his testimony to show that the city of Austin was made aware of the fact that this particular section of road was mismarked. [22:54.480 --> 23:06.480] We're then going to show that while this process of marking was taking place, the people that were changing out the signs actually made a mistake. [23:06.480 --> 23:19.480] The signs mounted on the shoulder of the highway to show the correct speed limit were changed while the ones on the overhead were not. [23:19.480 --> 23:25.480] So you have an overhead that says 60 and you've got a shoulder sign that says 70. [23:25.480 --> 23:35.480] And you have the city of Austin Police Department issuing traffic citations based upon the speed limit on the overhead. [23:35.480 --> 23:48.480] Knowing the whole time that the speed limit on the shoulder was the new and correct speed limit, they're still issuing citations under the erroneous speed limit. [23:48.480 --> 23:59.480] So we're going to get him to testify that they were knowledgeable of all this, that they knew the speed limit was wrong and was in the process of being changed, [23:59.480 --> 24:05.480] and that certain errors had been introduced regarding the changing of the signs. [24:05.480 --> 24:12.480] Okay, now we're going to find out, well, how many other times have you been called regarding these types of issues? [24:12.480 --> 24:16.480] And I fully expect him to say, oh, we get these phone calls all the time. [24:16.480 --> 24:26.480] And I'm going to base that on the fact that the moment I asked him about a speed limit change on this specific section of highway, [24:26.480 --> 24:32.480] he immediately went into a spill about, okay, so they gave you a traffic citation. [24:32.480 --> 24:38.480] Here's the information you're going to want to get through an open records request and blah, blah, blah. [24:38.480 --> 24:47.480] Now, he already knew in advance everything that I was going to have to request in order to refute the citation, [24:47.480 --> 24:59.480] which tells me he was extremely knowledgeable and practiced at this procedure of having to inform callers and record seekers of what to do and how to do it. [24:59.480 --> 25:10.480] So he's very familiar with the fact that the city of Austin is issuing these tickets on a rapid basis for the purpose of supplementing city income. [25:10.480 --> 25:19.480] We're also going to ask him if he's ever been called to specifically testify how many times and so on and so forth. [25:19.480 --> 25:35.480] Now, once we get done with getting his testimony in that the section of highway in question was inappropriately marked and was being knowingly utilized by the city of Austin as a bogus speed trap. [25:35.480 --> 25:38.480] We're going to get that information into the record. [25:38.480 --> 25:43.480] Then we're going to have the officer's testimony to continue with when he's called up. [25:43.480 --> 26:00.480] Now, those of you that come to the class knows that there is a specific objection that is made every single time transportation code terminology is used in reference to what we're being accused of doing. [26:00.480 --> 26:20.480] For instance, someone, the prosecutor, the judge or the witness uses the term motor vehicle, you immediately state objection assumes facts not an evidence, not previously agreed to, and requires a legal conclusion by the fact witness. [26:20.480 --> 26:31.480] Now, that is a three part legal objection to the usage of that term, and you're going to use it every single time one of those terms pops out of somebody's mouth. [26:31.480 --> 26:48.480] And we will continue to do that until the judge says, look, I recognize your standing objection to these terms, in which case we don't have to worry about objecting to them anymore. [26:48.480 --> 27:03.480] But just in case, I'm going to clarify to the judge, okay, judge, just so you know, my outstanding objection is to all of these particular terms, and I'm going to give him the list. [27:03.480 --> 27:10.480] Does the court recognize an outstanding objection to all of these terms? [27:10.480 --> 27:20.480] Judge says, yes, we're good to go, we don't have to worry about objecting to them on the record anymore. There's a standing objection in place for them. [27:20.480 --> 27:32.480] Now, all we have to do is concentrate on listening to what questions are being asked, and whether or not they're ones that we need to address. [27:32.480 --> 27:38.480] Now, we are not going to need to address the majority of them once we get the objection established. [27:38.480 --> 27:47.480] Why? Because these particular facts in this particular case are irrelevant. They're irrelevant. [27:47.480 --> 27:59.480] They're irrelevant because you're not engaged in transportation. So the facts of a transportation offense are irrelevant. [27:59.480 --> 28:11.480] This is the issue of where the law does not apply. If the law does not apply, the facts alleged under that law cannot apply. [28:11.480 --> 28:21.480] They are bonded at the hip or chest or head or whatever body parts you want to pick, like a Siamese twin. You can't separate them. [28:21.480 --> 28:24.480] They are what they are. [28:24.480 --> 28:35.480] Now, when you get the officer on the stand, any time he testifies to one of these terms and we get that objection out there, [28:35.480 --> 28:48.480] the next thing we do on the heels of the objection is, I ask that the witness be tendered for the purpose of determining personal knowledge. [28:48.480 --> 28:55.480] Correction. I ask that the witness be tendered for the purpose of Wadiah to determine personal knowledge. [28:55.480 --> 28:57.480] You want to avoid that as a witness. [28:57.480 --> 29:15.480] Yeah. So they may or may not allow that. But if they do, then these are the questions we will ask to specifically determine personal knowledge on behalf of the officer regarding any of those objected to terms. [29:15.480 --> 29:21.480] Question one, did you ask me for a bill of lading? [29:21.480 --> 29:27.480] Question two, did you ask me for a passenger manifest? [29:27.480 --> 29:33.480] Question three, did you ask me for a logbook? [29:33.480 --> 29:46.480] Hi folks, we are going to go to break. This is rule of law radio. Calling number is 512-646-1984. Now at the end of the next segment, we will bring on our guest. [29:46.480 --> 29:59.480] So if you get on the board, please expect to sit for just a little bit or so. We'll be right back on the other side of this break. [29:59.480 --> 30:05.480] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11. [30:05.480 --> 30:12.480] The government says that fire brought it down. However, 1,500 architects and engineers have concluded it was a controlled demolition. [30:12.480 --> 30:15.480] Over 6,000 of my fellow service members have given their lives. [30:15.480 --> 30:17.480] And thousands of my fellow first responders have died. [30:17.480 --> 30:19.480] I'm not a conspiracy theorist. [30:19.480 --> 30:20.480] I'm a structural engineer. [30:20.480 --> 30:21.480] I'm a New York City correction officer. [30:21.480 --> 30:22.480] I'm an Air Force pilot. [30:22.480 --> 30:24.480] I'm a father who lost his son. [30:24.480 --> 30:26.480] We are Americans and we deserve the truth. [30:26.480 --> 30:30.480] Go to RememberBuilding7.org today. [30:34.480 --> 30:36.480] Mind reading vehicles? [30:36.480 --> 30:41.480] Imagine if your car decided when to apply the brakes based on your thoughts alone. [30:41.480 --> 30:47.480] I'm Dr. Catherine Albright and I'll be back to tell you about breaking at the speed of thought next. [30:47.480 --> 30:49.480] Privacy is under attack. [30:49.480 --> 30:53.480] When you give up data about yourself, you'll never get it back again. [30:53.480 --> 30:58.480] And once your privacy is gone, you'll find your freedoms will start to vanish too. [30:58.480 --> 31:00.480] So protect your rights. [31:00.480 --> 31:03.480] Say no to surveillance and keep your information to yourself. [31:03.480 --> 31:06.480] Privacy, it's worth hanging on to. [31:06.480 --> 31:09.480] This message is brought to you by StartPage.com. [31:09.480 --> 31:13.480] The private search engine alternative to Google, Yahoo and Bing. [31:13.480 --> 31:16.480] Start over with StartPage. [31:16.480 --> 31:20.480] I'm a big fan of German engineering when it comes to cars. [31:20.480 --> 31:25.480] After all, they did create the Mercedes and the BMW, plus they have no speed limit on the Autobahn. [31:25.480 --> 31:29.480] But when they start developing cars that read minds, they've gone too far. [31:29.480 --> 31:33.480] To test cars that apply the brakes when the driver thinks of stopping, [31:33.480 --> 31:39.480] German researchers attached electrodes to people's skulls and legs and then had them drive in a simulator. [31:39.480 --> 31:43.480] When certain brain activity and leg tension were detected, the brakes engaged. [31:43.480 --> 31:47.480] Milliseconds before the drivers actually hit the brake pedal. [31:47.480 --> 31:53.480] Doug is showing guys, but no thanks. If I'm going to drive, I don't need my car to second guess me. [31:53.480 --> 32:18.480] I'm Dr. Kaffir and Albrecht for StartPage.com, the world's most private search engine. [32:18.480 --> 32:26.480] Hi folks, we are back. This is Rule of Law Radio. Our guest, Michiel Frey, has joined us, but he's not going to be on air just yet. [32:26.480 --> 32:33.480] I'm going to go ahead and finish up with the things that we're talking about for trial this coming Wednesday. [32:33.480 --> 32:37.480] So let me get back to what we're dealing with with the officer here. [32:37.480 --> 32:43.480] And as I say, we've got the three questions asking about personal knowledge. [32:43.480 --> 32:49.480] Did you ask me for a bill of lading? Did you ask me for a passenger manifest? Did you ask me for a logbook? [32:49.480 --> 32:57.480] This is going to get the cop to thinking, why is he going to commerce on this? What is the commercial issue here? [32:57.480 --> 33:03.480] Well, we want him wondering now, maybe it will dawn on him like, uh-oh, this guy knows. [33:03.480 --> 33:07.480] I hope so, and I hope it puts him in a very flustered state. [33:07.480 --> 33:16.480] And even if he doesn't know, well, then that's just proof positive that this officer lacks proper training, [33:16.480 --> 33:27.480] which makes his higher ups even more accountable for his ignorance and his improper application of that ignorance. [33:27.480 --> 33:33.480] Okay, so we're going to make him pay for it in one form or sweat or another. [33:33.480 --> 33:41.480] Now, once we get each one of these terms defined and we want to hire him on personal knowledge, [33:41.480 --> 33:47.480] when it's our turn to examine the cop, we are going to keep it short, sweet, and to the point. [33:47.480 --> 33:56.480] We are not going to stray from the specific purpose of determining whether or not transportation is the issue. [33:56.480 --> 34:02.480] Okay, so our list of questions is very short and very specific. [34:02.480 --> 34:09.480] Question one, under direct examination, at the time of the stop, did I present you? [34:09.480 --> 34:15.480] Now, this is going to the affidavit and judicial notice paperwork. [34:15.480 --> 34:21.480] At the time of the stop, did I present you with any form of paper document? [34:21.480 --> 34:24.480] He may say yes, no, or I don't remember. [34:24.480 --> 34:29.480] Do you recall what information was being provided in the document? [34:29.480 --> 34:33.480] Again, yes, no, don't remember. [34:33.480 --> 34:38.480] Do you recall what I said to you about the purpose of the document? [34:38.480 --> 34:40.480] Yes, no, don't remember. [34:40.480 --> 34:46.480] Now, at each of these responses, you need to be considering where you're going. [34:46.480 --> 34:49.480] Okay, if it's yes, move on to the next one. [34:49.480 --> 34:55.480] If it's no, then simply re-ask the question in a different way. [34:55.480 --> 35:02.480] Okay, did I tell you that this document was for the purpose of? [35:02.480 --> 35:05.480] Again, yes, no, don't remember. [35:05.480 --> 35:14.480] If it's don't remember or anything of that nature, then eventually what's going to happen is you're going to have to take the stand to get that document introduced. [35:14.480 --> 35:21.480] Once you get it introduced, however, then he's got a whole other problem. [35:21.480 --> 35:31.480] The other thing is, if he doesn't remember, you move to strike all his testimony. [35:31.480 --> 35:33.480] Well, he's remembered everything else up to this point. [35:33.480 --> 35:35.480] No, he's not a credible witness. [35:35.480 --> 35:50.480] His testimony cannot be trusted because the only thing he claims to remember are those things that go to the prosecution and he somehow can't remember anything other than what goes to the prosecution. [35:50.480 --> 35:51.480] He's not a credible witness. [35:51.480 --> 35:53.480] Move to strike all his testimony. [35:53.480 --> 35:54.480] Right. [35:54.480 --> 35:55.480] And you can do that. [35:55.480 --> 35:56.480] Okay. [35:56.480 --> 36:01.480] But let's just say that we don't get to that and he does remember some of this off and on. [36:01.480 --> 36:10.480] And plus the fact we can always remind him, and officer, you do recall that at the time of this stop, I was recording the conversation. [36:10.480 --> 36:12.480] Are you not? [36:12.480 --> 36:20.480] Oh, yeah, I remember you, you had that recorder and your cell phone both going like you were paranoid or something. [36:20.480 --> 36:23.480] And you can disarm that comment very easily. [36:23.480 --> 36:34.480] Well, considering that you were screaming like a madman with a gun on your hip and asking for help, I kind of had reason to be paranoid. [36:34.480 --> 36:37.480] But in any case, that's not a here and there. [36:37.480 --> 36:39.480] Just play it by ear as necessary. [36:39.480 --> 36:45.480] But try in your questioning to stick specifically to these given issues regarding transportation. [36:45.480 --> 36:55.480] Now, let's say because it doesn't happen very often, you would think that someone attempts to present these officers with these written documents. [36:55.480 --> 36:58.480] That event should stand out in his memory. [36:58.480 --> 37:04.480] And as Randy said, if he's got selective memory, he can't be trusted anyway. [37:04.480 --> 37:09.480] Keep that up as an all open consideration the whole time. [37:09.480 --> 37:21.480] But if he is being cooperative and he is agreeing that yes, you did, yes, you did, yes, you did, then we're going to continue down this road and we're going to bring up the following. [37:21.480 --> 37:30.480] Do you recall me stating that the document was an affidavit that I was not engaging in transportation? [37:30.480 --> 37:34.480] What did you do with this document? [37:34.480 --> 37:36.480] Now, in my case, they threw it back in the car. [37:36.480 --> 37:38.480] They refused to take it. [37:38.480 --> 37:46.480] Why did you refuse to accept it as evidence and keep it with the copy of the citation? [37:46.480 --> 37:48.480] Okay. [37:48.480 --> 37:59.480] Or better yet, rather than ask why, just ask what is the reason? [37:59.480 --> 38:06.480] Okay, that you refuse to accept it as evidence and keep it with a copy of the citation. [38:06.480 --> 38:14.480] Follow that up with was your refusal to accept the document based upon any departmental policy? [38:14.480 --> 38:32.480] In other words, is your department intentionally acting in a manner to prevent specific knowledge from coming up so that they can later refute such knowledge at trial? [38:32.480 --> 38:43.480] Is there an outstanding policy for you not to accept any documentation that would destroy the illusion of transportation? [38:43.480 --> 38:55.480] And then, last but not least, do you recall my verbal assertion that I was not engaging in any acts of transportation at the time you stopped me? [38:55.480 --> 38:56.480] That's it. [38:56.480 --> 39:08.480] Short, simple, to the point, all directed at transportation and the officer's knowledge of the difference between transportation and travel. [39:08.480 --> 39:15.480] And we did it without ever having to bring up the issue of right to travel. [39:15.480 --> 39:23.480] We got the officer to get up there and testify that it was not transportation. [39:23.480 --> 39:31.480] No, I didn't ask for this, which is an admission that since I didn't ask for it, I had no reason to believe you were engaging in it. [39:31.480 --> 39:34.480] That's when you move for directed verdict. [39:34.480 --> 39:36.480] Yeah, that comes up next. [39:36.480 --> 39:43.480] So, when we get down to the end of this, we've got our opening statement, for instance, now. [39:43.480 --> 39:45.480] This is what's going on at trial. [39:45.480 --> 39:49.480] Let's cover what we're going to do in opening statement with the jury real quick. [39:49.480 --> 39:59.480] The evidence will show that the speed limit on the particular section of highway in question was set too low according to state law. [39:59.480 --> 40:06.480] The evidence will show that the city of Austin exploited this speed limit in order to establish a speed trap and increase revenue. [40:06.480 --> 40:17.480] The evidence will show that on the date and time in question, the officer was engaged in this revenue, this act of revenue generation. [40:17.480 --> 40:27.480] The evidence will show that the officer was informed that I was not engaging in transportation. [40:27.480 --> 40:35.480] The evidence will show that I was at no time acting as a carrier for the purposes of transportation. [40:35.480 --> 40:52.480] And the evidence will show, finally, that the officer himself knowingly issued this citation to someone he knew was not engaging in transportation. [40:52.480 --> 40:57.480] Now, closing statement, we pretty much have come to the end of this trial. [40:57.480 --> 41:05.480] And as I stated earlier, the evidence has not been introduced by the state to prove transportation. [41:05.480 --> 41:10.480] There is no evidence that has been introduced that I was acting as a carrier. [41:10.480 --> 41:20.480] There is no evidence that has been introduced to prove that I was in any way engaging in a commercial activity on the road. [41:20.480 --> 41:28.480] Furthermore, I have introduced evidence that proves that the officer knows I was not in commerce. [41:28.480 --> 41:38.480] I have introduced evidence that proves that the speed limit was knowingly and intentionally used for the purpose of revenue generation [41:38.480 --> 41:42.480] because the city of Austin knew the speed limit was incorrect. [41:42.480 --> 41:46.480] And they wrote citations anyway. [41:46.480 --> 42:01.480] I've introduced evidence that attempted to show that the city of Austin knows of multiple locations within the city limits that are used for exactly this purpose that are also incorrectly marked. [42:01.480 --> 42:12.480] And finally, I have introduced evidence that shows I was not acting in any way as a carrier for the purpose of transportation on the highways. [42:12.480 --> 42:13.480] That's it. [42:13.480 --> 42:19.480] Now, when the state rests its case, there's two things we can do at this point. [42:19.480 --> 42:29.480] Motion to dismiss, okay, simply because there's still, you know, the issue of notice is still at play here. [42:29.480 --> 42:31.480] None of that was done. [42:31.480 --> 42:36.480] This entire trial is a farce because the court lacked the jurisdiction to hold it in the first place. [42:36.480 --> 42:40.480] So I still want my dismissal with prejudice. [42:40.480 --> 42:46.480] And then when they deny that, then I move the court for a directed verdict in favor of the defense. [42:46.480 --> 42:49.480] The state has failed to prove its case on the record. [42:49.480 --> 42:53.480] Now, we fully expect both of these to be denied. [42:53.480 --> 42:55.480] No question they're going to be denied. [42:55.480 --> 43:09.480] But at this point, we have fully documented the not in transportation, not acting as a carrier issue for the appeals record. [43:09.480 --> 43:24.480] And somebody up that chain may have two living brain cells to rub together to form a coherent thought to understand exactly what the problem with this entire case is on behalf of the state. [43:24.480 --> 43:34.480] And if they don't, well, then we'll move it further up the chain to the court of criminal appeals and let them show us if they're actually functioning at a Congress level. [43:34.480 --> 43:36.480] All right. [43:36.480 --> 43:39.480] Okay, folks, we are coming up on another break. [43:39.480 --> 43:43.480] When we get back on the other side, we will pick up with our guest if he is available. [43:43.480 --> 43:45.480] This is ruling law radio. [43:45.480 --> 43:49.480] Carlin number is 512-646-1984. [43:49.480 --> 43:52.480] This is Eddie Craig, Randy Kelton, Debra Stevens. [43:52.480 --> 43:54.480] We'll be right back after the break. [44:01.480 --> 44:03.480] The Oakland City bombing. [44:03.480 --> 44:05.480] Top 10 reasons to question the official story. [44:05.480 --> 44:09.480] Reason number two, why was the ATF AWOL? [44:09.480 --> 44:19.480] Paramedic Tiffany Bible, who was on the scene within five minutes, has stated in an affidavit that agents of the Bureau of Alcohol, Tobacco and Firearms told her that they were not in the office that morning. [44:19.480 --> 44:23.480] D&T Catherine Mallet also overheard one agent say to another, close. [44:23.480 --> 44:26.480] Is that why we got the page to not come in today? [44:26.480 --> 44:35.480] Through Shaw's interview on KSOL or TV, it was also told by ATF agents that they had been paid to not come in to work. [44:35.480 --> 44:46.480] The ATF initially denied these claims, and now variously claim that one of their agents was in a free falling elevator which has been disproven, or that they had been in an all night stick out, or that they had been in a golf tournament. [44:46.480 --> 44:51.480] As they try to sort out their lies, all we want to know is, did the ATF receive a warning? [44:51.480 --> 44:56.480] And if so, why did they not pass it on to others in the world of alcohol? [44:56.480 --> 45:22.480] For more information, go to LKCFalminTruth.com. [45:26.480 --> 45:28.480] And now you can too. [45:28.480 --> 45:34.480] Jurisdictionary was created by a licensed attorney with 22 years of case winning experience. This is rule of law radio. [46:46.480 --> 46:56.480] Calling number is 512-646-1984. This is our Friday night four hour info marathon, and we are just getting rolling here. [46:56.480 --> 47:03.480] Right now, we've got three callers up on the board. We're going to go ahead and go to our first caller, David in Illinois. [47:03.480 --> 47:05.480] David, what can we do for you? [47:05.480 --> 47:16.480] Hey guys, I've just got a bunch of rapid questions. You can get your guess if you can. What does the word athian mean? Can you describe it to me? [47:16.480 --> 47:18.480] What does athian mean? [47:18.480 --> 47:21.480] Yeah, what's the definition of the word athian? [47:21.480 --> 47:24.480] You want a definition or a legal definition? [47:24.480 --> 47:29.480] I got the legal definition if you're going to use it on a piece of paperwork. [47:29.480 --> 47:40.480] Okay, well, athian. Hang on, I'll get you the specific one. Let's see. [47:40.480 --> 47:42.480] Is it statutory or is it? [47:42.480 --> 47:53.480] No, well, no, an athian just designates the person that is swearing to a certain set of facts under oath. [47:53.480 --> 48:05.480] A person who signs an affidavit and swears to its truth before a notary public or some person authorized to take oaths like a county clerk. [48:05.480 --> 48:13.480] Synonyms, test at the test door, deponent, signer, subscriber, swearer, test fire voucher. [48:13.480 --> 48:20.480] Okay, excellent. Okay, next one. Can you file a motion in limony in a criminal trial if you're the defendant? [48:20.480 --> 48:21.480] Of course. [48:21.480 --> 48:29.480] Okay, next one. Do you ask a judge why he ruled the way he did on a motion? [48:29.480 --> 48:31.480] Hold on. [48:31.480 --> 48:36.480] Hold on. Before we get to that, let's explain to those who don't know what a motion in limony is. [48:36.480 --> 48:38.480] Okay, okay. [48:38.480 --> 48:48.480] A motion in limony is a motion that lists all of the questions that the other side can't ask. [48:48.480 --> 48:58.480] They are great fun. I have a, on the Jewish Imprudence site, I have about a 20-page motion in limony. [48:58.480 --> 49:03.480] And it is great fun. I was in court with it, and the judge is annoyed. [49:03.480 --> 49:05.480] In your seminar material? [49:05.480 --> 49:10.480] No, no, not in the seminar material. On my website, jurisimprudence.com. [49:10.480 --> 49:12.480] With all your frogs? [49:12.480 --> 49:14.480] Yeah, frog farm conspiracy. [49:14.480 --> 49:15.480] Okay. [49:15.480 --> 49:19.480] The judge is going through all of these questions, and he's annoyed at having to go through all of them. [49:19.480 --> 49:26.480] And one of them was, I objected to any questions concerning a hypnotic interview. [49:26.480 --> 49:31.480] And the judge said, Mr. Kelton, will you hypnotize? I don't know, judge. [49:31.480 --> 49:35.480] You know how they make you forget that kind of stuff? Ask him. [49:35.480 --> 49:37.480] Deny, deny. [49:37.480 --> 49:40.480] Okay, motion in limony is all the questions that you can't ask. [49:40.480 --> 49:42.480] Okay, go ahead with your next question. [49:42.480 --> 49:49.480] Do you ask a judge why he ruled the way he did on a motion, and is that a necessity to do for appeal? [49:49.480 --> 49:56.480] Yes, that's called findings of fact and conclusions at law. [49:56.480 --> 49:59.480] And you always do that in writing, or do you do it at law? [49:59.480 --> 50:01.480] This is how I suggest you do it. [50:01.480 --> 50:11.480] If you prepare a finding of fact and conclusions at law, understand that a trial judge has two primary duties. [50:11.480 --> 50:16.480] He must determine the facts in accordance with the rules of evidence. [50:16.480 --> 50:20.480] Then he must apply the law as it comes to him to the facts in the case. [50:20.480 --> 50:25.480] So you prepare a findings of facts and conclusions at law. [50:25.480 --> 50:28.480] These are the facts developed in the case. [50:28.480 --> 50:32.480] This is the law that applies to those facts. [50:32.480 --> 50:40.480] These are the decisions you were required to come to as a ministerial duty in applying the law to the facts. [50:40.480 --> 50:50.480] Now, you ask that the court either accept your findings of fact and conclusions at law, or prepare and present his own to the court. [50:50.480 --> 50:54.480] When you file that, that becomes a part of the court record. [50:54.480 --> 51:00.480] On appeal, the only thing the court can look to is what's in the court record. [51:00.480 --> 51:08.480] If the judge doesn't give a findings of fact and these lower courts they never do, it uses in the record. [51:08.480 --> 51:16.480] Okay, and it's best to go to all these authorities that would be directly above the particular court that you're in. [51:16.480 --> 51:28.480] Yes, it's best to go to the final authority if you can, and never make a proactive statement of law out of your own mouth. [51:28.480 --> 51:30.480] Wait, meaning what? [51:30.480 --> 51:39.480] Must make it out of the mouth of the court. If you look at a brief, you'll find they'll make a statement and then they'll show a citation. [51:39.480 --> 51:45.480] This is where we paraphrase this statement from. They make the next statement and they show where they got it from. [51:45.480 --> 51:51.480] That's where they're not making a proactive statement of law out of their mouth and making it out of the mouth of the court. [51:51.480 --> 51:57.480] Okay, next one. Should you ever waive your right to a speedy trial? [51:57.480 --> 52:03.480] Never, ever, never, never, never, unless there's some really important reason to do so. [52:03.480 --> 52:13.480] One of the first things you should always do is file a motion for speedy trial, or a speedy trial's demand, [52:13.480 --> 52:18.480] because the courts will say if you don't demand a speedy trial, you waive your right to it. [52:18.480 --> 52:21.480] So you do that as a matter of course. [52:21.480 --> 52:39.480] Even, well, okay, what about, is a speedy trial something that could be construed in the demand for rights that is in Eddie's material that you do not waive any of your right? [52:39.480 --> 52:42.480] No, you need to address that specifically. [52:42.480 --> 52:57.480] Okay, all right. Address it specifically, and if you ask for a continuance that does not waive your demand, it merely stops the clock for the period of delay caused by you. [52:57.480 --> 52:58.480] Okay. [52:58.480 --> 53:03.480] And any delay caused by you doesn't count for speedy trial. [53:03.480 --> 53:05.480] Okay, so like a motion hearing or something along those lines? [53:05.480 --> 53:07.480] Well, if you ask for a continuance. [53:07.480 --> 53:14.480] Oh, sorry, yeah. And that's the only time it counts on you. This is a prosecution job to get this done. [53:14.480 --> 53:15.480] Okay. [53:15.480 --> 53:16.480] Okay. [53:16.480 --> 53:18.480] Okay, next one. [53:18.480 --> 53:27.480] What specifically would you object to at arraignment as to why you cannot enter a plea? [53:27.480 --> 53:29.480] Lack of jurisdiction. [53:29.480 --> 53:32.480] Okay, in my case, I still haven't received a charging instrument. [53:32.480 --> 53:38.480] Okay, you can't enter a plea because you have not received proper notice of any allegations and charges against you. [53:38.480 --> 53:45.480] There's nothing in the record that shows on any offense has been made against or charged against you, so on and so forth. [53:45.480 --> 53:48.480] No, I don't know that yet because I haven't checked the court record, but I will do. [53:48.480 --> 53:51.480] Wait, wait, wait, wait, wait, wait. Not the point. [53:51.480 --> 53:52.480] Okay. [53:52.480 --> 53:58.480] Whether it's in the court record or not is absolutely irrelevant if they haven't served you with a copy of it. [53:58.480 --> 53:59.480] Okay, okay. [53:59.480 --> 54:04.480] Putting it in the court record does not constitute notice. Never has, never will. [54:04.480 --> 54:06.480] Okay, right. [54:06.480 --> 54:09.480] Okay, is there anything else on those two? [54:09.480 --> 54:12.480] You know, very poignant. [54:12.480 --> 54:17.480] Yeah, I object on general principle. You're ugly, smelly, and need a shower. [54:17.480 --> 54:21.480] I'll remember to do that. I'm sure I'll love it. [54:21.480 --> 54:25.480] Make sure the first thing you do is a plea. [54:25.480 --> 54:32.480] Object, motion, a challenge to subject matter jurisdiction. [54:32.480 --> 54:35.480] Yeah, I've got that. I've got that in. [54:35.480 --> 54:46.480] Once there are at least, once that's in, it's covered, then you can go ahead and address other issues and you won't be waiving the objection to subject matter jurisdiction. [54:46.480 --> 54:57.480] If you have that in before any appearance at all, does that automatically protect your special appearance? [54:57.480 --> 55:06.480] Yes, once it's made, then you can go ahead and address the other issues without waiving it. [55:06.480 --> 55:10.480] And you're always considered in special appearance the entire time that you're in the court? [55:10.480 --> 55:11.480] Absolutely. [55:11.480 --> 55:19.480] Yes, you do that. It has to be first if it goes to in personum. [55:19.480 --> 55:25.480] The challenge to subject matter can be put in at any time. [55:25.480 --> 55:32.480] If you do a general appearance, then you waive a challenge to in personum jurisdiction. [55:32.480 --> 55:34.480] Okay, I have that. [55:34.480 --> 55:43.480] Yeah, you have jurisdiction over the specific allegation, but you don't have jurisdiction over my person. [55:43.480 --> 55:54.480] Now, if he has jurisdiction over the accusation and he has venue, then you can waive in personum. [55:54.480 --> 55:58.480] That's why you have to get in personum in first. [55:58.480 --> 56:05.480] Okay, so it does have to be an absolute separate motion. In personum and subject matter cannot be... [56:05.480 --> 56:08.480] None of it has to be separate. It can all be done in one motion. [56:08.480 --> 56:12.480] Okay, well, that's how I had it worded, so I think I can... [56:12.480 --> 56:17.480] If in personum is the last issue in the motion, it makes no difference. [56:17.480 --> 56:24.480] They're all considered to be made at the same time, so the in personum is finally made that way. [56:24.480 --> 56:31.480] And there are at least five ways to plea as well. [56:31.480 --> 56:39.480] Guys, this is Feel Free Australia, in case you thought he was just talking funny. [56:39.480 --> 56:43.480] He really knows how to speak English. We don't. [56:43.480 --> 56:46.480] Okay, five ways to plea? [56:46.480 --> 56:51.480] Yeah, well, most people will believe that there's just, you know, what do you plea, innocent or guilty. [56:51.480 --> 56:59.480] But they are actually completely innocent, guilty, guilty to the facts, no case to answer, or I reserve my plea. [56:59.480 --> 57:06.480] So there are at least five ways you can address that pleading matter as well. [57:06.480 --> 57:12.480] That's essentially what we're going through. You can plea subject matter jurisdiction. [57:12.480 --> 57:19.480] You can plea in personum jurisdiction. You can plead double jeopardy. These are pleads. [57:19.480 --> 57:23.480] Pleadings as opposed to motions. [57:23.480 --> 57:26.480] The original complaint is a pleading. [57:26.480 --> 57:33.480] And then you can respond to the original complaint with pleadings, which are objections subject matter jurisdiction. [57:33.480 --> 57:39.480] And pleading, in this case, we're not talking about entering a plea. [57:39.480 --> 57:45.480] We're talking about a filing that's defined as a pleading. [57:45.480 --> 57:52.480] And in taxes, the pleadings are subject matter jurisdiction and personum jurisdiction. [57:52.480 --> 57:57.480] Double jeopardy is one other eddy. What is that? [57:57.480 --> 58:02.480] It almost never comes up and I keep forgetting what it is. [58:02.480 --> 58:08.480] So happens when you get old, you go to sleep. [58:08.480 --> 58:11.480] Yeah, well, you forget. [58:11.480 --> 58:15.480] We are going to the top of the hour here. [58:15.480 --> 58:21.480] We have a couple more callers that we will take to callers before we go to the field. [58:21.480 --> 58:23.480] He's got some things he wants to address. [58:23.480 --> 58:28.480] He's been sending me some documents and I didn't get them posted on the web today. [58:28.480 --> 58:33.480] I was supposed to have them posted before the show started. I'm pretty naughty. [58:33.480 --> 58:38.480] Too much work, but I will have them posted by morning. [58:38.480 --> 58:44.480] You can go to awesomelaw.net and find the documents. [58:44.480 --> 58:52.480] And it's a four-hour show, so give us a call. 512-646-1984. [58:52.480 --> 59:00.480] We'll be right back on the other side. [01:00:05.480 --> 01:00:15.480] A report by the New York State Division of Criminal Justice shows New York City police made more than 50,000 arrests for the lowest level marijuana possession offense in 2011. [01:00:15.480 --> 01:00:20.480] The possession is a non-arrestable offense unless it's burning or in plain sight. [01:00:20.480 --> 01:00:26.480] The NYPD stops and frisks more than half a million mostly young black and Latino men a year. [01:00:26.480 --> 01:00:31.480] The report found many were falsely charged with possession in public view. [01:00:31.480 --> 01:00:39.480] Iraq is seeking a waiver from U.S. sanctions on Iran because of its close economic ties with the Islamic Republic. [01:00:39.480 --> 01:00:50.480] The U.S., the E.U. and others have ramped up sanctions to target Iran's oil industry and central bank in an effort to pressure to run over a suspected nuclear weapons program. [01:00:50.480 --> 01:00:53.480] Spokesman Ali A. Debagh said, quote, [01:00:53.480 --> 01:00:58.480] Iran is the main supplier for many foodstuffs and other commodities. [01:00:58.480 --> 01:01:08.480] Republican leaders in Congress Thursday moved to avert potential cuts in the military budget that were part of an agreed on bipartisan budget agreement last year. [01:01:08.480 --> 01:01:18.480] Instead, the GOP introduced a bill that would reduce the federal workforce by 5% and extend a freeze on federal pay through June 2014. [01:01:18.480 --> 01:01:31.480] A secret police document obtained by the Associated Press shows the New York Police Department recommended increasing surveillance of thousands of Muslims based solely on their religion. [01:01:31.480 --> 01:01:44.480] A 2006 NYPD Intelligence Report on Iran says police should expand clandestine operations at Shiite Mosques because Iran, a Shia-ruled country, is a threat to the U.S. [01:01:44.480 --> 01:01:53.480] Police Commissioner Raymond Kelly has said police only go where investigative leads take them, yet the document justifies spying on Shiite Mosques. [01:01:53.480 --> 01:01:59.480] The AP's disclosure is the latest revelation the NYPD has been profiling Muslims. [01:01:59.480 --> 01:02:08.480] Last year AP revealed the NYPD and the CIA were spying on Muslim businesses, student groups, and religious organizations. [01:02:08.480 --> 01:02:17.480] The House of Representatives is considering a Senate passed bill that would ban insider trading by lawmakers and thousands of executive branch officials. [01:02:17.480 --> 01:02:20.480] Stock trades would have to be posted online within 30 days. [01:02:20.480 --> 01:02:30.480] The Senate showed a rare display of bipartisanship Thursday to pass the bill in 96-3, and House Majority Leader Eric Cantor said it would be before the House next week. [01:02:30.480 --> 01:02:40.480] Senator Scott Brown, a chief sponsor of the bill, said, with approval ratings of Congress at an all-time low, this bill represents an opportunity to build some trust with the American people, [01:02:40.480 --> 01:02:51.480] adding members of Congress of access to all kinds of sensitive information, and it has to be clear that the information is being used to serve our country, not to make a personal profit. [01:03:10.480 --> 01:03:21.480] It's all according to the will of the Almighty. [01:03:21.480 --> 01:03:29.480] I read His book and it says He cares for the unsightly. [01:03:29.480 --> 01:03:50.480] These warm-hearted come by that term rightly. [01:03:50.480 --> 01:04:00.480] All right folks, we are back. This is already your phone number. [01:04:00.480 --> 01:04:03.480] David, please continue. [01:04:03.480 --> 01:04:07.480] Okay, I've got four more random questions. [01:04:07.480 --> 01:04:09.480] There are four more quick questions for you. [01:04:09.480 --> 01:04:17.480] But to continue on what we were talking about before the break, as far as when you get to your arraignment, [01:04:17.480 --> 01:04:31.480] can you not also say, when He asks you for a plea, say, Your Honor, I stand on my paperwork regarding entering a plea, as long as you have put your paperwork in stating that, [01:04:31.480 --> 01:04:40.480] you know, I'm not going to enter a plea because there's a motion in for, to move for subsequent jurisdiction and or imprecise jurisdiction, so on and so forth. [01:04:40.480 --> 01:04:55.480] Okay, one thing I would suggest at this point, if you might want to find out where you are, ask the judge, do you have subject matter jurisdiction over the accusation? [01:04:55.480 --> 01:05:03.480] Okay, bring me back up a little bit. Is this your first appearance on the issue? [01:05:03.480 --> 01:05:13.480] Well, there's an odd question about that. Okay, the first time was at this strange, they do something odd in Illinois. [01:05:13.480 --> 01:05:21.480] They'll throw you in jail and then you'll have this video court thing. Now, everybody calls it a bond hearing. [01:05:21.480 --> 01:05:28.480] Now, I'm not sure one way or the other if that would have been... [01:05:28.480 --> 01:05:44.480] Examining trial is where we're going. Did the, okay, then at that hearing, did the judge make a determination of probable cause or was it already made? [01:05:44.480 --> 01:05:52.480] It was seemingly already made. He just told me what I was charged with and what the bond was, so I think they must have had an ex parte some important time, so... [01:05:52.480 --> 01:06:02.480] Okay, then that wasn't a problem. That wasn't a hearing. That wasn't an examining trial. You have the right to an examining trial. [01:06:02.480 --> 01:06:13.480] So when you go before a judge, you need to ask the judge, are you the judge of original jurisdiction or your magistrate? [01:06:13.480 --> 01:06:14.480] Okay. [01:06:14.480 --> 01:06:26.480] And if he says he's the trial judge, then you demand an examining trial. Looking at Illinois law, you're going to have law demanding, giving you a right to an examining trial. [01:06:26.480 --> 01:06:29.480] This goes back to the Magna Carta in 2016. [01:06:29.480 --> 01:06:35.480] And it needed to be done the same way in Texas that needed to be done the moment on arrest, so... [01:06:35.480 --> 01:06:41.480] Absolutely. First thing, you're required to be taken to the magistrate, not to jail. [01:06:41.480 --> 01:06:45.480] Check Illinois law and find the statute that requires this. [01:06:45.480 --> 01:06:47.480] I don't want to make any difference, but... [01:06:47.480 --> 01:06:50.480] All right. But to answer your question... [01:06:50.480 --> 01:06:51.480] Yeah. [01:06:51.480 --> 01:07:04.480] So I got out on bond and then went to a hearing, but it wasn't... Nothing was really done at the hearing per se other than I spoke to a public defender and I said... [01:07:04.480 --> 01:07:09.480] I asked him and watched the questions and based on his answers to those questions, I said, [01:07:09.480 --> 01:07:19.480] I'd rather just do this myself and he wrote up a motion for me dismissing him. [01:07:19.480 --> 01:07:24.480] The judge asked me, do you wish to represent yourself? [01:07:24.480 --> 01:07:29.480] Yes, fine. And then that was it. And then the next trial date was said. [01:07:29.480 --> 01:07:31.480] Nothing else was said other than that. [01:07:31.480 --> 01:07:35.480] Now, is that considered to be a general appearance? [01:07:35.480 --> 01:07:38.480] Yes, that was a general appearance. [01:07:38.480 --> 01:07:41.480] Illinois handbasket. [01:07:41.480 --> 01:07:51.480] But actually, I'm not sure if that would be considered a hearing. That wasn't a hearing. [01:07:51.480 --> 01:07:54.480] That's questionable what that was. [01:07:54.480 --> 01:07:57.480] Nothing was really done. But here's the other thing. Here's my other question. [01:07:57.480 --> 01:08:05.480] If I had paperwork in, if I had my motion in before that hearing... [01:08:05.480 --> 01:08:11.480] You would object to anything before the hearing of the motion. [01:08:11.480 --> 01:08:19.480] One of the things you need to look at is the authority of the judge to command your appearance. [01:08:19.480 --> 01:08:21.480] Okay. [01:08:21.480 --> 01:08:30.480] So here it's under Code of Criminal Procedure 2801 that lists all of the things that the judge can order you to court for. [01:08:30.480 --> 01:08:35.480] And they go to motions and actions before the court. [01:08:35.480 --> 01:08:40.480] In Travis County, they always summon you to court to find out if you have an attorney. [01:08:40.480 --> 01:08:48.480] They did that to me and they called me up and I said, Your Honor, I have this summons to be here today, [01:08:48.480 --> 01:08:51.480] but it doesn't tell me why. You want to tell me what I'm doing here? [01:08:51.480 --> 01:08:54.480] Oh, we'll discuss and we need to find out if you had an attorney. [01:08:54.480 --> 01:08:59.480] I said, well, that's interesting, Your Honor. I have a 28.01 Code of Criminal Procedure. [01:08:59.480 --> 01:09:05.480] And it lists all those things you can order me to come to court for to see if I have an attorney. [01:09:05.480 --> 01:09:07.480] It's not one of them. [01:09:07.480 --> 01:09:09.480] Right. [01:09:09.480 --> 01:09:12.480] Okay. That you need to look at. [01:09:12.480 --> 01:09:22.480] So the only thing I technically would have had then to come to this next appearance was what was written on the bail bond. [01:09:22.480 --> 01:09:30.480] I was debating, this is the next time for you to come to court. Didn't give a reason to say this is your next time to come to court. [01:09:30.480 --> 01:09:34.480] Okay. Insufficient notice. [01:09:34.480 --> 01:09:35.480] Okay. [01:09:35.480 --> 01:09:39.480] You should object to the hearing altogether if it doesn't tell you why you're there. [01:09:39.480 --> 01:09:45.480] Okay. So technically I still haven't given them general jurisdiction as far as you can tell? [01:09:45.480 --> 01:09:47.480] I would not think so. [01:09:47.480 --> 01:09:48.480] Okay. [01:09:48.480 --> 01:09:53.480] You can't give them subject matter. The only thing you can't give them is... [01:09:53.480 --> 01:09:56.480] I know I can't waive in person. I'm going to give them general if I... [01:09:56.480 --> 01:10:04.480] If you haven't had reasonable opportunity to raise the issue, if that's a bit of a motion hearing, then you haven't had opportunity to raise the issue. [01:10:04.480 --> 01:10:05.480] Okay. [01:10:05.480 --> 01:10:06.480] Right. [01:10:06.480 --> 01:10:08.480] Okay. I'll get off. [01:10:08.480 --> 01:10:14.480] All right. I think I'm okay as far as that goes. I'll just get to the next couple of questions here real fast. [01:10:14.480 --> 01:10:21.480] You mentioned the term last time. Actually, I think it was last Friday with my favorite guest you got tonight. [01:10:21.480 --> 01:10:24.480] You mentioned the term when we were talking about common law. [01:10:24.480 --> 01:10:30.480] You said the word story disguises. Can you explain to me what that means, Randy? [01:10:30.480 --> 01:10:31.480] Case law. [01:10:31.480 --> 01:10:34.480] That's just basic. That's just what it means. [01:10:34.480 --> 01:10:37.480] Free prior decisions of the court. [01:10:37.480 --> 01:10:38.480] Okay. [01:10:38.480 --> 01:10:39.480] Okay. Next one. [01:10:39.480 --> 01:10:41.480] For some court of higher authority. [01:10:41.480 --> 01:10:49.480] Okay. Next one then. When you object in court and the judge overrules you, do you say exceptions? [01:10:49.480 --> 01:10:50.480] Yeah. [01:10:50.480 --> 01:10:53.480] Let the rest of us reflect defendant's exception to rule. [01:10:53.480 --> 01:10:56.480] Yeah. Or you can just say defense exception. [01:10:56.480 --> 01:11:10.480] You can always ask the judge, will it be necessary for me to indicate my exception to each ruling, or will you accept a general exception to all rulings that are against me? [01:11:10.480 --> 01:11:11.480] Okay. [01:11:11.480 --> 01:11:13.480] Can I say that is a success? [01:11:13.480 --> 01:11:20.480] I'll say objection and he'll say your objection is noted with exceptions and they'll just move right on. [01:11:20.480 --> 01:11:25.480] Some other ones will be and make a big deal out of it, but okay. All right. [01:11:25.480 --> 01:11:33.480] Next one. Where would you go to find an example of good wording for a criminal complaint in your state? [01:11:33.480 --> 01:11:42.480] Jurisimprudence.com. Oh, in your state. In Texas, I meant in Illinois. [01:11:42.480 --> 01:11:44.480] There might be in their state. [01:11:44.480 --> 01:11:51.480] Okay. Just go to Illinois criminal complaint. Just do an internet search for it. You'll find a number of them. [01:11:51.480 --> 01:11:52.480] Okay. [01:11:52.480 --> 01:12:06.480] It's always good practice to write the verbiage of the complaint in the verbiage of the statute that you're accusing the person of violating. [01:12:06.480 --> 01:12:18.480] That's required for a federal complaint. I have never seen any specific instructions in state law, but that is always a good policy. [01:12:18.480 --> 01:12:24.480] If you do it that way, you will always have a real structured complaint. [01:12:24.480 --> 01:12:27.480] A well structured complaint. Okay. I didn't hear what you said this first. [01:12:27.480 --> 01:12:34.480] Go online and do a search and you will find the form that it's required to be in. [01:12:34.480 --> 01:12:43.480] And sometimes you have to pay attention to, like in Texas, the statute says a complaint must run in the name of the state. [01:12:43.480 --> 01:12:48.480] And it always starts out within the name and under the authority of the state detections. [01:12:48.480 --> 01:12:52.480] That's how a criminal complaint is always prefaced. [01:12:52.480 --> 01:13:00.480] In some states, like Colorado, they use a regular motion heading. [01:13:00.480 --> 01:13:07.480] It's like a heading on a business letter and then they have a court heading for motions. [01:13:07.480 --> 01:13:13.480] In some states, they use that same heading. So you need to see what they actually use. [01:13:13.480 --> 01:13:29.480] And in taxes and in the Fed and probably in Illinois, in a criminal complaint, you must testify that you have reason to believe and do believe. [01:13:29.480 --> 01:13:34.480] The and do believe is critical, must be in there. [01:13:34.480 --> 01:13:38.480] Yeah, I saw that in at least the paperwork. [01:13:38.480 --> 01:13:42.480] Yeah, that's kind of a standard wording. [01:13:42.480 --> 01:13:43.480] Okay. [01:13:43.480 --> 01:13:49.480] So if you do that, I have reason to believe and do believe based on the following. [01:13:49.480 --> 01:14:00.480] Generally, in the complaint, you state very brief facts just enough to establish the elements of the criminal act. [01:14:00.480 --> 01:14:08.480] And you state and therefore I charge sex on honor before this part is important. [01:14:08.480 --> 01:14:15.480] The date, the date you put doesn't have to be the date of offense. [01:14:15.480 --> 01:14:20.480] But it must be anterior to the date of offense. [01:14:20.480 --> 01:14:26.480] That was the one thing I could find that would be a fatal error. [01:14:26.480 --> 01:14:35.480] If you file a motion on April the first saying I have reason to believe and do believe that this person committed a crime on April the second. [01:14:35.480 --> 01:14:40.480] That's fatal cannot be repaired, even if it is an error. [01:14:40.480 --> 01:14:50.480] So you can say on or before and generally you say on or before and you put the date that you are filing the complaint. [01:14:50.480 --> 01:14:55.480] And that will keep you from making that particular error. [01:14:55.480 --> 01:14:59.480] You don't have to go back and state the exact date and time if it's occurred. [01:14:59.480 --> 01:15:00.480] Okay. [01:15:00.480 --> 01:15:04.480] At least not in the closing of the complaint. [01:15:04.480 --> 01:15:10.480] You may need it in the body if it's critical, but generally not. [01:15:10.480 --> 01:15:23.480] And then if you use a short statement in the complaint, then you might want to attach an affidavit, a statement of facts. [01:15:23.480 --> 01:15:38.480] You want sufficient evidence to give a reasonable person of argument to prove his reason to believe that a crime has been committed and that the person accused committed that crime. [01:15:38.480 --> 01:15:42.480] That's the criteria the magistrate goes by to find probable cause. [01:15:42.480 --> 01:15:43.480] Right. [01:15:43.480 --> 01:15:48.480] And as I recall, you said an affidavit write them out as though you were speaking to a five-year-old. [01:15:48.480 --> 01:15:49.480] Exactly. [01:15:49.480 --> 01:15:50.480] Yeah. [01:15:50.480 --> 01:15:52.480] And that's not because people are dumb. [01:15:52.480 --> 01:15:53.480] I know. [01:15:53.480 --> 01:15:54.480] Yeah. [01:15:54.480 --> 01:15:56.480] For that is the reason she said before. [01:15:56.480 --> 01:15:57.480] Okay. [01:15:57.480 --> 01:15:59.480] Let me repeat that for those who didn't hear it. [01:15:59.480 --> 01:16:06.480] You know all the facts and you know precisely how all those facts put together or attached together. [01:16:06.480 --> 01:16:17.480] You know them so well that sometimes you forget to include them and your reader is reading it and you don't connect two dots together. [01:16:17.480 --> 01:16:21.480] And the first time you do that, you've lost your reader. [01:16:21.480 --> 01:16:22.480] Yep. [01:16:22.480 --> 01:16:23.480] He is gone. [01:16:23.480 --> 01:16:26.480] He's, you've lost his, you don't have rapport. [01:16:26.480 --> 01:16:30.480] And he said, and I wondered what the heck is going on and you're moving along. [01:16:30.480 --> 01:16:34.480] If you've ever read a computer manual, these geeks do that all the time. [01:16:34.480 --> 01:16:36.480] They make, they're raindrops. [01:16:36.480 --> 01:16:37.480] Yeah. [01:16:37.480 --> 01:16:42.480] As I recall, you said write all the facts and give it to somebody else that's never read it and has no idea what, you know, what they want. [01:16:42.480 --> 01:16:46.480] Don't know anything about it and then tell them to tell you what they got out of it. [01:16:46.480 --> 01:16:47.480] Exactly. [01:16:47.480 --> 01:16:49.480] Then you'll have a good document. [01:16:49.480 --> 01:16:55.480] We're going to dump this job from Illinois and we're going to go to Joe when we come back. [01:16:55.480 --> 01:16:56.480] Thank you, David. [01:16:56.480 --> 01:16:57.480] Yep. [01:16:57.480 --> 01:17:26.480] We'll be right back. [01:17:27.480 --> 01:17:53.480] Thank you. [01:17:53.480 --> 01:18:00.480] We'll be right back. [01:18:23.480 --> 01:18:49.480] We'll be right back. [01:18:49.480 --> 01:18:56.480] We'll be right back. [01:19:20.480 --> 01:19:23.480] Hi, folks. [01:19:23.480 --> 01:19:24.480] We are back. [01:19:24.480 --> 01:19:28.480] This is Little Law Radio. [01:19:28.480 --> 01:19:30.480] And we're still beeping here. [01:19:30.480 --> 01:19:31.480] Okay. [01:19:31.480 --> 01:19:34.480] Now, we're going to go ahead and continue with our callers. [01:19:34.480 --> 01:19:36.480] We have Joe in Texas. [01:19:36.480 --> 01:19:39.480] Joe, what can we do for you? [01:19:39.480 --> 01:19:42.480] Hey, I love your show, Famous Information. [01:19:42.480 --> 01:19:46.480] I'm a Christian Patriot right here out of Austin, Texas and I got a little problem. [01:19:46.480 --> 01:19:53.480] I crashed and burned on my Harley-Davidson on the east side of Austin, south. [01:19:53.480 --> 01:19:56.480] And what happened was they had new road construction. [01:19:56.480 --> 01:20:04.480] They left a loose asphalt, but they failed to have proper signage a mile and a half back before this curve, if I crashed on. [01:20:04.480 --> 01:20:07.480] It said 45 miles an hour and there was nothing else. [01:20:07.480 --> 01:20:16.480] And then they had an improper warning sign for the curve that did not match the curve. [01:20:16.480 --> 01:20:19.480] Of course, when I hit it, it was a hairpin turn. [01:20:19.480 --> 01:20:22.480] I talked to the owners on the corner. [01:20:22.480 --> 01:20:24.480] They said there's crashes there every month. [01:20:24.480 --> 01:20:26.480] And I went out and took videos. [01:20:26.480 --> 01:20:31.480] And the cars that were going down that road actually went on to the incoming lanes several times. [01:20:31.480 --> 01:20:35.480] But none of the attorneys I've ever talked to will help. [01:20:35.480 --> 01:20:37.480] They only go after other drivers. [01:20:37.480 --> 01:20:39.480] Nobody wants to go after the county. [01:20:39.480 --> 01:20:44.480] My question is, could you guide me in the right direction? [01:20:44.480 --> 01:20:48.480] Well, I guess that really depends on what you mean by guide you. [01:20:48.480 --> 01:20:51.480] You're going to have to sue them. [01:20:51.480 --> 01:20:55.480] Whether the county wants to admit it or not, they can be sued. [01:20:55.480 --> 01:20:57.480] They don't have sovereign immunity. [01:20:57.480 --> 01:20:59.480] They're not a state entity. [01:20:59.480 --> 01:21:00.480] Right. [01:21:00.480 --> 01:21:05.480] However, the state courts do their best to give it to them anyway. [01:21:05.480 --> 01:21:12.480] Well, when it comes to this particular issue, the highway signage and warning signs and such, [01:21:12.480 --> 01:21:17.480] for this, the state does waive its sovereign immunity. [01:21:17.480 --> 01:21:24.480] But the best one to sue is not the state, is the contractor who's doing the job. [01:21:24.480 --> 01:21:27.480] Or the DOT. [01:21:27.480 --> 01:21:32.480] If the DOT is the one that's actually doing the maintenance on that part of the road and is the one responsible [01:21:32.480 --> 01:21:36.480] for the putting up of that sign instead of some third-party contractor, [01:21:36.480 --> 01:21:39.480] then that's who you're going after, not the county. [01:21:39.480 --> 01:21:44.480] Okay, if you're not on a federal highway, it's going to be a state. [01:21:44.480 --> 01:21:50.480] And these are common suits where people sue for signage. [01:21:50.480 --> 01:21:55.480] My wife was on a jury and that's exactly what this was about. [01:21:55.480 --> 01:21:57.480] They didn't put up proper signage. [01:21:57.480 --> 01:22:04.480] And the person didn't know that there was a one-foot drop-off in the highway. [01:22:04.480 --> 01:22:11.480] There was supposed to be barriers to shunt them off onto the access road and they didn't. [01:22:11.480 --> 01:22:14.480] And this guy got hurt real bad. [01:22:14.480 --> 01:22:17.480] But there was no immunity for that. [01:22:17.480 --> 01:22:24.480] They've told me that I have to hire what's called a accident reconstruction forensics investigator. [01:22:24.480 --> 01:22:27.480] And the minimum was about $15,000? [01:22:27.480 --> 01:22:30.480] That's nonsense. You don't have to do this thing. [01:22:30.480 --> 01:22:32.480] So all you have to do is convince the jury. [01:22:32.480 --> 01:22:36.480] You get out there with a video camera and video people sliding around, [01:22:36.480 --> 01:22:45.480] interview a few people that have witnessed accidents [01:22:45.480 --> 01:22:48.480] who will testify that there are accidents common in this location [01:22:48.480 --> 01:22:55.480] and show that there is no proper signage giving adequate warning of a known hazard that's sufficient. [01:22:55.480 --> 01:22:57.480] Well, I've done all the work. [01:22:57.480 --> 01:22:58.480] I've got witnesses. [01:22:58.480 --> 01:23:02.480] I've also got the Harley-Davidson crew out there that have taken that and also agreed [01:23:02.480 --> 01:23:06.480] plus the owner that lives on the corner plus the camera work. [01:23:06.480 --> 01:23:07.480] I've done that. [01:23:07.480 --> 01:23:12.480] My question is, is there anybody that you know of that would take that kind of a case like Pro Bono? [01:23:12.480 --> 01:23:13.480] Have you ever heard of anyone? [01:23:13.480 --> 01:23:15.480] No, absolutely not. [01:23:15.480 --> 01:23:17.480] Yeah, that's my problem. [01:23:17.480 --> 01:23:24.480] And nobody but an lawyer can address this one because it's a personal injury suit. [01:23:24.480 --> 01:23:27.480] So you'd either have to do it yourself or have an attorney. [01:23:27.480 --> 01:23:28.480] I just can't do any. [01:23:28.480 --> 01:23:33.480] So I guess I'm going to have to try to go pro se and just shoot from the hip in the courtroom, huh? [01:23:33.480 --> 01:23:36.480] Yeah, well, you might get them to come to the table and make a deal. [01:23:36.480 --> 01:23:39.480] You know, pro se's have an advantage. [01:23:39.480 --> 01:23:43.480] You can bar grieve the attorney every time he spits. [01:23:43.480 --> 01:23:48.480] And judicial conduct, complaint to judge, just make a nuisance of yourself. [01:23:48.480 --> 01:23:58.480] And then later, you can probably get an attorney to come in for special purposes just for a hearing or something. [01:23:58.480 --> 01:24:08.480] Once you have the pleadings in, an attorney who would never file those pleas because they don't want to judge the PO and add him, [01:24:08.480 --> 01:24:17.480] once they're in, you can bring him in to argue the pleadings and not incur the wrath of the court. [01:24:17.480 --> 01:24:19.480] Gives him plausible deniability. [01:24:19.480 --> 01:24:20.480] I didn't file these. [01:24:20.480 --> 01:24:23.480] I was just hired to represent the client. [01:24:23.480 --> 01:24:25.480] And this is what I found when I got here. [01:24:25.480 --> 01:24:26.480] Sorry, judge. [01:24:26.480 --> 01:24:27.480] I have to do this. [01:24:27.480 --> 01:24:29.480] Don't be mad at me. [01:24:29.480 --> 01:24:32.480] And you can generally get them to come in for limited purposes, [01:24:32.480 --> 01:24:36.480] especially when you have the court has the issue structured. [01:24:36.480 --> 01:24:45.480] I suggest before you do this, you go down to the court and pull records of similar cases. [01:24:45.480 --> 01:24:52.480] Yes, especially if you can find a suit based on this intersection. [01:24:52.480 --> 01:24:54.480] Okay, I think I can. [01:24:54.480 --> 01:24:59.480] From what the owner of the property says. [01:24:59.480 --> 01:25:06.480] And go to the city and request the accident reports for all accidents at this location. [01:25:06.480 --> 01:25:08.480] Okay. [01:25:08.480 --> 01:25:11.480] And that may be enough to get into one hour. [01:25:11.480 --> 01:25:13.480] So, okay, okay. [01:25:13.480 --> 01:25:20.480] You see when you file the suit, if you have a list of accidents at this location, then pretty well got him dead bang. [01:25:20.480 --> 01:25:22.480] Well, let me go from there. [01:25:22.480 --> 01:25:24.480] Caster God bless y'all. [01:25:24.480 --> 01:25:25.480] And thank you for your time. [01:25:25.480 --> 01:25:26.480] You're welcome. [01:25:26.480 --> 01:25:32.480] Bye. [01:25:32.480 --> 01:25:34.480] Okay. [01:25:34.480 --> 01:25:35.480] Did I miss that one? [01:25:35.480 --> 01:25:37.480] I think I hit the wrong button. [01:25:37.480 --> 01:25:38.480] Well, we got that one. [01:25:38.480 --> 01:25:39.480] Next one. [01:25:39.480 --> 01:25:40.480] Yeah, okay. [01:25:40.480 --> 01:25:41.480] Got Mark in Texas. [01:25:41.480 --> 01:25:44.480] Somebody snuck in and hit my hang up button. [01:25:44.480 --> 01:25:45.480] I don't know how that happened. [01:25:45.480 --> 01:25:46.480] Hang up. [01:25:46.480 --> 01:25:48.480] You've always got to hang up. [01:25:48.480 --> 01:25:50.480] Okay, Mark, are you there? [01:25:50.480 --> 01:25:51.480] I am here. [01:25:51.480 --> 01:25:52.480] Can you hear me? [01:25:52.480 --> 01:25:53.480] Nope. [01:25:53.480 --> 01:25:55.480] Can't hear a word you're saying. [01:25:55.480 --> 01:25:56.480] Okay. [01:25:56.480 --> 01:25:57.480] I lied. [01:25:57.480 --> 01:25:58.480] Okay. [01:25:58.480 --> 01:26:00.480] What do you got for us, Mark? [01:26:00.480 --> 01:26:02.480] Is Phil still out there? [01:26:02.480 --> 01:26:03.480] Yes, he is. [01:26:03.480 --> 01:26:04.480] Okay. [01:26:04.480 --> 01:26:05.480] Good. [01:26:05.480 --> 01:26:13.480] He adds a necessary realm of sanity that's missing once Deborah's gone. [01:26:13.480 --> 01:26:14.480] So. [01:26:14.480 --> 01:26:15.480] Out. [01:26:15.480 --> 01:26:16.480] Yeah. [01:26:16.480 --> 01:26:21.480] Well, you know, he balances you out there. [01:26:21.480 --> 01:26:24.480] You should make him a regular here. [01:26:24.480 --> 01:26:28.480] If he'll agree to it, we'll bring him up pretty regularly. [01:26:28.480 --> 01:26:29.480] Yeah. [01:26:29.480 --> 01:26:30.480] All right. [01:26:30.480 --> 01:26:37.480] Well, and then regarding Eddie, I want to say that he's starting out neutral tonight [01:26:37.480 --> 01:26:45.480] because I was glad to hear last night he was reading some Lysander Spooner, which is always [01:26:45.480 --> 01:26:51.480] good stuff, but he gets a negative point for insulting of snakes. [01:26:51.480 --> 01:26:55.480] Oh, you mean equating snakes with lawyers? [01:26:55.480 --> 01:26:56.480] Yeah. [01:26:56.480 --> 01:26:59.480] Well, I would think that the snakes would take Umbridge to that. [01:26:59.480 --> 01:27:01.480] I would think so. [01:27:01.480 --> 01:27:04.480] Well, they just have to take it as they get it. [01:27:04.480 --> 01:27:07.480] That's all it is to it. [01:27:07.480 --> 01:27:08.480] Okay. [01:27:08.480 --> 01:27:14.480] So I've got a rhetorical question for you guys. [01:27:14.480 --> 01:27:24.480] And that's like if I find you, each of you feel included $250 for the insult to snakes [01:27:24.480 --> 01:27:30.480] and told you that I wanted you to show up in Waco to discuss it, would you come? [01:27:30.480 --> 01:27:31.480] No. [01:27:31.480 --> 01:27:32.480] Yeah. [01:27:32.480 --> 01:27:36.480] I don't think anyone has to think about that. [01:27:36.480 --> 01:27:37.480] Maybe Randy does. [01:27:37.480 --> 01:27:38.480] I don't know. [01:27:38.480 --> 01:27:46.480] But that's what that's essentially the foundation that I have for my question is they sent, [01:27:46.480 --> 01:28:00.480] as is out of Parker County, Kelton, they sent me a notice of a hearing on the 17th for this [01:28:00.480 --> 01:28:03.480] license plate light out. [01:28:03.480 --> 01:28:05.480] Oh, wait a minute. [01:28:05.480 --> 01:28:07.480] I know who this is. [01:28:07.480 --> 01:28:08.480] Yeah. [01:28:08.480 --> 01:28:09.480] There you go. [01:28:09.480 --> 01:28:10.480] No, I am not coming to Waco. [01:28:10.480 --> 01:28:13.480] You get me arrested, you chump. [01:28:13.480 --> 01:28:20.480] Well, this is regarding the second time I got arrested in 24 hours right next to you. [01:28:20.480 --> 01:28:21.480] Okay. [01:28:21.480 --> 01:28:33.480] Oh, we went to, this is Mark in Waco and we went to Weatherford and I gave the county [01:28:33.480 --> 01:28:40.480] attorneys a couple of information requests and I've never heard any response from him. [01:28:40.480 --> 01:28:41.480] Yeah. [01:28:41.480 --> 01:28:44.480] Did you get, you got nothing on that full scope thing yet? [01:28:44.480 --> 01:28:48.480] I got absolutely nothing in response. [01:28:48.480 --> 01:28:54.480] So I'm going to go next to file criminal charges with the district attorney against it. [01:28:54.480 --> 01:28:55.480] Well, wait a minute. [01:28:55.480 --> 01:29:00.480] I mean, we don't want to, we don't want to push them into acting when they're, you know, [01:29:00.480 --> 01:29:05.480] if they might just let it go, I don't know what they're going to do, but from what I [01:29:05.480 --> 01:29:10.480] hear, they're in a, like a budget crisis and anything that they're taking a trial, [01:29:10.480 --> 01:29:13.480] they're just kind of letting go. [01:29:13.480 --> 01:29:20.480] I'm not, you know, not terribly worried other than the system itself is so corrupt that [01:29:20.480 --> 01:29:21.480] they, that they... [01:29:21.480 --> 01:29:22.480] Okay. [01:29:22.480 --> 01:29:24.480] This doesn't have anything to do with you. [01:29:24.480 --> 01:29:29.480] Well, I know that and technically they know that, but they probably also know that it [01:29:29.480 --> 01:29:30.480] does have something to do with me. [01:29:30.480 --> 01:29:35.480] Well, what they're going to know is the best way they can get me to go away with them alone [01:29:35.480 --> 01:29:38.480] is to go with you alone. [01:29:38.480 --> 01:29:39.480] Yeah. [01:29:39.480 --> 01:29:43.480] This, this might be the right strategy. [01:29:43.480 --> 01:29:44.480] I don't know. [01:29:44.480 --> 01:29:49.480] I'm just looking for a, I'll get more information. [01:29:49.480 --> 01:29:50.480] Okay. [01:29:50.480 --> 01:29:51.480] Hang on. [01:29:51.480 --> 01:29:52.480] Hang on. [01:29:52.480 --> 01:29:53.480] We're about to go to break. [01:29:53.480 --> 01:29:54.480] Randy Kelton, David Stevens, David Craig. [01:29:54.480 --> 01:30:01.480] I'm going to go to the radio, give us a call, 512-646-1984. [01:30:01.480 --> 01:30:02.480] Right. [01:30:02.480 --> 01:30:03.480] A noble lie. [01:30:03.480 --> 01:30:07.480] Oklahoma City, 1995 will change forever the way you look at the true nature of terrorism. [01:30:07.480 --> 01:30:11.480] Based on the damage patting to the building, but the government says it's impossible. [01:30:11.480 --> 01:30:15.480] The grand jury did not want to hear anything I had to say. [01:30:15.480 --> 01:30:18.480] The decision was made not to pursue any more of those individuals. [01:30:18.480 --> 01:30:23.480] Some of these columns were ripped up, shredded, tossed around. [01:30:23.480 --> 01:30:27.480] People that did the things they did knew doggone well what they were doing. [01:30:27.480 --> 01:30:31.480] Expose the cover up now at elobolive.com. [01:30:31.480 --> 01:30:34.480] Hey, what's not smell? [01:30:34.480 --> 01:30:39.480] In a not too distant future, you might actually reply, that's my perfume pill. [01:30:39.480 --> 01:30:44.480] Yes, pills, not spray bottles may soon be the way we apply scent in the future. [01:30:44.480 --> 01:30:47.480] I'm Dr. Catherine Albrecht and I'll have details in a moment. [01:30:47.480 --> 01:30:49.480] Privacy is under attack. [01:30:49.480 --> 01:30:53.480] When you give up data about yourself, you'll never get it back again. [01:30:53.480 --> 01:30:57.480] And once your privacy is gone, you'll find your freedoms will start to vanish too. [01:30:57.480 --> 01:30:59.480] So protect your rights. [01:30:59.480 --> 01:31:03.480] Say no to surveillance and keep your information to yourself. [01:31:03.480 --> 01:31:05.480] Privacy, it's worth hanging on to. [01:31:05.480 --> 01:31:12.480] This message is brought to you by startpage.com, the private search engine alternative to Google, Yahoo, and Bing. [01:31:12.480 --> 01:31:15.480] Start over with Start Page. [01:31:15.480 --> 01:31:20.480] When I see someone covered in sweat, I do my nose a favor and steer clear. [01:31:20.480 --> 01:31:25.480] But someday sniffing someone's sweat might be as sweet as a spritz of cologne. [01:31:25.480 --> 01:31:28.480] That is, if Lucy McRae's invention pans out, [01:31:28.480 --> 01:31:36.480] McRae, a 31-year-old artist, is working with Dutch chemists on a pill you could swallow to turn your perspiration into cologne. [01:31:36.480 --> 01:31:39.480] Packing beauty products into pills isn't new. [01:31:39.480 --> 01:31:45.480] Some pills provide sun protection and Lori Al is working on a supplement to keep your hair from turning gray. [01:31:45.480 --> 01:31:50.480] McRae says her perfume pill will smell unique on each individual who uses it. [01:31:50.480 --> 01:31:52.480] But internal perfume? Hmm. [01:31:52.480 --> 01:31:55.480] I'm not sure that idea passes my sniff test. [01:31:55.480 --> 01:32:10.480] I'm Dr. Catherine Albrecht for startpage.com, the world's most private search engine. [01:32:25.480 --> 01:32:43.480] All right, we are back. This is rule of law radio. All in number is 512-646-1984. [01:32:43.480 --> 01:32:49.480] We are now taking the calls and speaking of calls, we're going to go back to this unbalanced individual named Mark. [01:32:49.480 --> 01:32:51.480] Mark, go ahead. [01:32:51.480 --> 01:32:58.480] Okay, wait a minute, Mark. Phil had a comment he wanted to make on this issue. [01:32:58.480 --> 01:33:03.480] Phil, you want to straighten Mark out. Mark needs a little straightening out. [01:33:03.480 --> 01:33:10.480] Yeah, well, some people just love to argue. [01:33:10.480 --> 01:33:21.480] When you think of these, there's a lot of issues that people have in legal and law. [01:33:21.480 --> 01:33:28.480] I relate it a lot to like a game of soccer or a game of chess. [01:33:28.480 --> 01:33:33.480] Like, you're playing offense or you're playing defense, right? [01:33:33.480 --> 01:33:34.480] Right. [01:33:34.480 --> 01:33:38.480] When you're playing defense, do you ever get to kick a goal? [01:33:38.480 --> 01:33:41.480] No, always offense. [01:33:41.480 --> 01:33:53.480] Exactly. So if you're going into court or into approaching any issue as a defense or as a defendant, what can you hope to ever achieve? [01:33:53.480 --> 01:33:58.480] Yeah, you could be the greatest defender in the world and you'll never win anything. [01:33:58.480 --> 01:34:16.480] Exactly. So this is the point. If you're playing, if you're going into court and you're going into as a defense or as a defendant, the only outcome that you're ever going to achieve is to have what you had before you went in there, [01:34:16.480 --> 01:34:20.480] minus a lot of your time, energy and money. [01:34:20.480 --> 01:34:33.480] So if you're going in to fight an issue, always put yourself in the position of the creditor or offense or the plaintiff, okay? [01:34:33.480 --> 01:34:52.480] So, you know, every time, I mean, there has never been an issue someone's been able to present to me so far that every time I could not find a position where I could turn that issue around to put it into the position of offense, right? [01:34:52.480 --> 01:34:59.480] If they point their finger at you and they say, hey, you've done this, this and this and we're going to come after you and this, this and this. [01:34:59.480 --> 01:35:16.480] No, really. Well, how are you going to come after me without forcing my unpaid involuntary performance, causing me to enter into debt bondage, exercising ownership direction or control over me by the way which are all high jurisdictional laws and criminal offences, [01:35:16.480 --> 01:35:23.480] that now you would be committing which would make your claim invalid and void and me holding the higher claim against you. [01:35:23.480 --> 01:35:31.480] So, instead of trying to find out, oh my God, how am I going to defend myself, try and put your foot into the position of offense. [01:35:31.480 --> 01:35:40.480] Now, for them to come after me, they're going to have to do X, Y and Z. For them to come after me, they're going to have to commit these offenses that I can go after them for. [01:35:40.480 --> 01:35:51.480] Now all of a sudden, you've put yourself into a position where you've become the plaintiff and now they're having to answer questions themselves. [01:35:51.480 --> 01:36:01.480] So, always try and do the rhetorical thing where you just say, well, if you're going to, you will not make me answer some questions, I'm going to make you answer a hell of a lot of questions. [01:36:01.480 --> 01:36:19.480] Right, right. Because equality under the law is paramount and mandatory. So, that's what I'm trying to do is not, you know, save a trip to Parker County which is about 130 miles from here and I don't see any reason. [01:36:19.480 --> 01:36:32.480] I mean, this is the first notice that I've gotten other than the cop actually telling me when he arrested me that, you know, my license plate was out but I was never given a ticket or anything. [01:36:32.480 --> 01:36:38.480] So, this is the first notice that I have of the incident. [01:36:38.480 --> 01:36:43.480] Well, you can do what's called a conditional acceptance. Do you know what that is? [01:36:43.480 --> 01:36:52.480] Yeah, yeah. I mean, go ahead. I usually conditionally accept it, you know, about you and return it. [01:36:52.480 --> 01:37:06.480] Well, yeah, but I can say I conditionally accept your offer on the basis that you can prove it to me in law and evidence that you're not committing offenses and that you're not forcing my performance. [01:37:06.480 --> 01:37:26.480] I can conditionally accept your offer as long as you pay for my costs involved in travelling there, my accommodation, my food, my travelling costs and all those other expenses that I'm going to incur or provide me the law that you can impose these costs upon me without being able to be reimbursed. [01:37:26.480 --> 01:37:40.480] I'm not double jeopardy. You're telling me that you're going to punish me by going up there, incurring all these fees, costs and charges and then to be imposed with a penalty on top of that, come on. [01:37:40.480 --> 01:37:46.480] Yeah. Yeah, yeah. I usually write them and ask for taxi fare but... [01:37:46.480 --> 01:38:02.480] No, you don't ask. You invoice. You send your invoice and until that is rebutted, until that can show you the law that you can't charge for your time and services, you can and you should. [01:38:02.480 --> 01:38:10.480] And so should everyone because this is where they're working. It's really easy. I want people to understand this. [01:38:10.480 --> 01:38:19.480] Whoever you're dealing with ask one question. Are they getting paid for their time and services to correspond with you? [01:38:19.480 --> 01:38:23.480] When the policeman pulls you over, is he getting paid? [01:38:23.480 --> 01:38:33.480] Yeah. When the tax office rings you up or any county or anyone sending you a letter, just ask yourself one question. [01:38:33.480 --> 01:38:43.480] Is this correspondence coming from someone that's getting paid to do that? Right. So they're getting paid to do, to correspond with you or to ask for your performance. [01:38:43.480 --> 01:38:49.480] And in most cases they're hoping, then praying, say, oh jeez, please let this guy volunteer his services. [01:38:49.480 --> 01:38:57.480] I'm getting paid for mine but we really need him to volunteer because if he demands to get paid, jeez, we're in a bit of a predicament here. [01:38:57.480 --> 01:39:07.480] We're only going to have to say to him, oh well, you're basically a slave and we can force you to do what you like or what we want you to do, unpaid and involuntarily, [01:39:07.480 --> 01:39:15.480] or jeez, we're going to have to pay his invoice. Which is it? It can only be one or the other. [01:39:15.480 --> 01:39:34.480] You'll probably recognize this term, Mark, P and H. It's in our Constitution. P and H is forbidden by our Constitution. P and H is forced labor. [01:39:34.480 --> 01:39:48.480] That is a really good point. I don't think, I've never heard anybody here talk to that point except Frank Kowalski out of Colorado. [01:39:48.480 --> 01:39:55.480] Matter of fact, we haven't had Frank on a while. I need to get a hold of him and get him back on. He talks a lot about P and H. [01:39:55.480 --> 01:40:01.480] He's got some good case law on the issue. P and H take those directly to forced labor. [01:40:01.480 --> 01:40:04.480] Yeah, involuntary servitude. [01:40:04.480 --> 01:40:10.480] Well, just ask yourself this. If you go to an accountant, right? [01:40:10.480 --> 01:40:11.480] Yeah. [01:40:11.480 --> 01:40:16.480] You go to any accountant and say, can you do my accounting for me for free? What will he say to you? [01:40:16.480 --> 01:40:23.480] I'm surmising he will not like to deal. [01:40:23.480 --> 01:40:25.480] Take you straight to the front door. [01:40:25.480 --> 01:40:36.480] If you go to a lawyer and say, excuse me, can you represent me for free? Can you talk on my behalf for free? Can you do all my paperwork for free? [01:40:36.480 --> 01:40:39.480] What would they say to you? [01:40:39.480 --> 01:40:41.480] Yeah. [01:40:41.480 --> 01:40:50.480] So why is everyone doing all this paperwork and all this talking and all this action for free to a corporation who's getting paid to do that? [01:40:50.480 --> 01:41:00.480] Yeah. This is my goal in dealing with these guys, each and every time I deal with them. [01:41:00.480 --> 01:41:14.480] It's kind of the Mark Stevens approach that says that every minute that you spend working on papers or going to their public relations scheme encounters [01:41:14.480 --> 01:41:21.480] or thinking about it is just one minute less that you're going to spend doing the things that you really want to do in life. [01:41:21.480 --> 01:41:32.480] I'm a minimalist and I try to take the quickest road to solve the problem. [01:41:32.480 --> 01:41:49.480] So just curiously, Phil, I can go back and listen to the archive of this show, but do you already have something on your site with your conditional acceptance? [01:41:49.480 --> 01:42:03.480] Well, conditional acceptance can come in many forms. I guess it depends on what you're responding to. You can conditionally accept someone sending you an infringement notice. [01:42:03.480 --> 01:42:22.480] I mean, the conditional acceptance can be so vague and diverse to respond to whatever it is. So it's just basically what we're talking about is using principles and expanding them so you can use yourself. [01:42:22.480 --> 01:42:33.480] And really what the goal is here is the old saying, give a man a fish, he'll eat for a day, teach a man to fish, he'll eat for a lifetime. [01:42:33.480 --> 01:42:44.480] And what we're trying to do here is teach everyone here how to fish and teach people like yourself and others how to fix their own problems and then also help other people fix theirs. [01:42:44.480 --> 01:42:49.480] So expanding the consciousness here. [01:42:49.480 --> 01:43:03.480] So do we have anything on how to think about conditional acceptance? So we kind of have an idea of how to look at and offer. [01:43:03.480 --> 01:43:22.480] The conditional acceptance, this is what we would go back to a couple of shows prior to what we've already talked about is I said know who you are first and foremost, and we might need to go over some of the things that we talked about in prior shows and segments. [01:43:22.480 --> 01:43:35.480] And I said, this is the key and I think people are just starting to get it of knowing who you are. We talked previously about the four key principles. Remember, free, slave, voluntary and involuntary. [01:43:35.480 --> 01:43:49.480] And if people have written down that graph that we talked about and did what I said last time, that's a really, really good way of identifying that. But I think we've got to go to a break so we'll touch on that when we get back. [01:43:49.480 --> 01:44:00.480] Okay, this is Randy Kelsen, W. C. D. Craig from Uniball Radio. We'll be right back to go on the other side. [01:44:19.480 --> 01:44:29.480] Thank you so much for joining us today. [01:44:49.480 --> 01:45:01.480] That's 908-6912608. That's 908-6912608. I think I might have to resend it to you again. [01:46:51.480 --> 01:46:58.480] It's not 14, it's 4. We've got five fingers who've got one spare on each hand. [01:46:58.480 --> 01:47:06.480] If you can just look at your fingers and just say free, slave, involuntary, I mean voluntary and forced. [01:47:06.480 --> 01:47:12.480] With those four key things, you can decipher so many things that's happening. [01:47:12.480 --> 01:47:24.480] Sometimes you receive something that you don't exactly know how to deal with, and you sit there holding your hair, pulling your hair out, and your guts are all tied up in knots, and you go, what am I going to do? [01:47:24.480 --> 01:47:29.480] How am I going to fix this? Well, these four things can really free that up. [01:47:29.480 --> 01:47:41.480] Go over it once more again, okay, and if people need to grab a pencil and paper, write it down, and it's so simple that I just don't think you can get any more simpler than this. [01:47:41.480 --> 01:47:48.480] Four things, right? Four columns, and on top of them, the headings write these words. Free in one column, right? [01:47:48.480 --> 01:47:57.480] The word free, F-R-E-E. Second word right next to that is slave, S-L-A-B-E, very simple. [01:47:57.480 --> 01:48:01.480] The column after that, we write the word voluntary, okay? [01:48:01.480 --> 01:48:07.480] And then the next column after that, we write the word involuntary and or forced. [01:48:07.480 --> 01:48:20.480] Now, once you've got those written down and you can identify with these words, everything that you can think of associated with the word and terminology free, right down in that column, you know? [01:48:20.480 --> 01:48:30.480] You even look up in dictionaries what look up the thing, and everything that you can think of for slave, voluntary and involuntary or forced, write them all down in that column. [01:48:30.480 --> 01:48:36.480] And now you've got a really good picture that you can see of what's happening to you. [01:48:36.480 --> 01:48:52.480] Hey, if somebody forcing my performance, if somebody, you know, enslaving me, for example, you know, and there's a very famous quote that was said by a man long ago. [01:48:52.480 --> 01:49:03.480] His name is Johann Wolfgang von Goth, and he said, none are more hopelessly enslaved than those who falsely believe that they are free. [01:49:03.480 --> 01:49:07.480] And that is so true. [01:49:07.480 --> 01:49:15.480] And the more research that you do into it, the more you will see that because most people don't really even know who they are anymore. [01:49:15.480 --> 01:49:24.480] You go into the public full system, aka school system, and you come out as this product at the other end and you don't know if you're Arthur or Martha after time or what's going on. [01:49:24.480 --> 01:49:27.480] So, but most people do feel it. [01:49:27.480 --> 01:49:31.480] When you get an infringement notice or something happens to you, you go, geez, this is wrong. [01:49:31.480 --> 01:49:33.480] I feel it in my bones. [01:49:33.480 --> 01:49:34.480] I feel it in my guts. [01:49:34.480 --> 01:49:35.480] This is wrong. [01:49:35.480 --> 01:49:36.480] What's going on? [01:49:36.480 --> 01:49:38.480] But they can't identify with it, you know? [01:49:38.480 --> 01:49:45.480] So everything that 99% of things that you feel is wrong will equate to two things. [01:49:45.480 --> 01:49:50.480] And after you take apart these high-rising building blocks, you'll come down to two things. [01:49:50.480 --> 01:50:07.480] Those two things in 99% of cases are slavery and debt bondage, which is forced involuntary payment, which again equates back to your performance or energy that you have to exert for nothing for the benefit of somebody else. [01:50:07.480 --> 01:50:10.480] So basically that is the key things. [01:50:10.480 --> 01:50:15.480] And people say, oh, you talk about this slavery and free things a lot. [01:50:15.480 --> 01:50:21.480] But if people try to overcomplicate it in a lot of times, it can be very, very simple. [01:50:21.480 --> 01:50:39.480] Once you break it all down, in 99% of cases, and I haven't had anyone else prove me wrong yet, that anything that happens, especially with more counties, councils, governments are fantastic at doing this to people, [01:50:39.480 --> 01:50:48.480] it will boil down to two things, spinach, slavery, and debt bondage, which is also associated with that or forced involuntary payment. [01:50:48.480 --> 01:51:03.480] And we'll talk about more of that and also what payment is and what it means to institutions, especially corporations and government institutions down the track if people are interested in like to do that. [01:51:03.480 --> 01:51:07.480] Yeah, alright. [01:51:07.480 --> 01:51:12.480] So Mark, are you free? [01:51:12.480 --> 01:51:15.480] Or are you in debt bondage? [01:51:15.480 --> 01:51:22.480] Hey, I'm free even when I'm locked up. They can't lock up my mind. [01:51:22.480 --> 01:51:29.480] But I'm sure I could go on all night, but I'm sure you're calm. [01:51:29.480 --> 01:51:34.480] That's what I was telling them on the break. [01:51:34.480 --> 01:51:39.480] Dr, I did want to ask a question about Robert Fox. [01:51:39.480 --> 01:51:40.480] Yes. [01:51:40.480 --> 01:51:49.480] Are you familiar with his current condition? The last I heard he was in the hospital on a life threatening condition. [01:51:49.480 --> 01:52:04.480] Well, now that I did not hear about, I talked to him yesterday and if it's after yesterday, I don't know. No, it was before that. So he must be over it. [01:52:04.480 --> 01:52:08.480] Yeah, he's in Dallas at the moment. [01:52:08.480 --> 01:52:25.480] Okay, so it could be that the reports of his death were exaggerated. I think Mark Twain said something that affected him. Okay, good. Well, then I was afraid that he may have been having an ice cream diabetic issue. [01:52:25.480 --> 01:52:39.480] Yeah, well, that can often happen with box dietary habits, but he did have a staff infection that got pretty serious, you know, pretty bad. But I think he's over that now. [01:52:39.480 --> 01:52:44.480] Oh, good. Yeah, he thought that came from a spider bite and he could well have. [01:52:44.480 --> 01:52:45.480] Yeah. [01:52:45.480 --> 01:52:52.480] Often the infection from the bite is far worse than the bite itself. [01:52:52.480 --> 01:52:53.480] Yeah, yeah. [01:52:53.480 --> 01:52:55.480] Okay, good. [01:52:55.480 --> 01:53:02.480] Eddie, let me ask you a question. Am I supposed to get a hold of Deborah or something? I'm not getting any updates on the course. [01:53:02.480 --> 01:53:09.480] Well, whether or not you're getting any updates depends on whether or not you sent me an email so I can add you to the update list when I get them done. [01:53:09.480 --> 01:53:21.480] I had a computer crash. Both of my computers went down this past week and a half ago and I have spent money I do not have having to get them rebuilt and up and running again. [01:53:21.480 --> 01:53:26.480] So it's delayed the output of updates for the time being. [01:53:26.480 --> 01:53:34.480] But if you want to send me an email, I'll add you to the list and as soon as I get the fundamental changes I've got on the ones I'm working on done, I'll send them out. [01:53:34.480 --> 01:53:40.480] Okay, and I can offer one word that might help you in the future. [01:53:40.480 --> 01:53:42.480] Mac. [01:53:42.480 --> 01:53:45.480] No, Mac would solve this problem. [01:53:45.480 --> 01:53:48.480] It's called lightning. [01:53:48.480 --> 01:53:52.480] If you didn't have a PC, which is for a play computer. [01:53:52.480 --> 01:53:56.480] Dude, I've done this too long. Don't even go there. [01:53:56.480 --> 01:54:03.480] When I was in Australia, my notebook went down and they bought me an iMac. [01:54:03.480 --> 01:54:07.480] I have not been pleased with that iMac. [01:54:07.480 --> 01:54:10.480] It crashes more often than my PC. [01:54:10.480 --> 01:54:14.480] Yeah, Mac actually stands for money and cursing. [01:54:14.480 --> 01:54:23.480] I wound up with more issues with the Mac and most of the software I need to run, I can't run it on the Mac. [01:54:23.480 --> 01:54:27.480] Well, that sounds like an operator problem there. [01:54:27.480 --> 01:54:31.480] It's important that I be able to use my software. [01:54:31.480 --> 01:54:35.480] Hey, it's called Mac and Sucks for a reason. [01:54:35.480 --> 01:54:45.480] If I was using Mac for sound, then it's apparently a lot better than Windows or the PC platform. [01:54:45.480 --> 01:54:48.480] But I'm not using it for that and I am not happy with it. [01:54:48.480 --> 01:54:53.480] There is absolutely nothing wrong with Macs. I wished every attorney would own one. [01:54:53.480 --> 01:54:58.480] Yeah, you're making it sound like a PC now. [01:54:58.480 --> 01:55:04.480] I've had this one running up for almost three years now, not one crash and it's never been turned off. [01:55:04.480 --> 01:55:08.480] Yeah, but like I said, crash versus lightning. [01:55:08.480 --> 01:55:16.480] When you have lightning come close to putting you down, it ain't going to matter what you're running. [01:55:16.480 --> 01:55:22.480] Well, lightning might be the fatal to anybody. [01:55:22.480 --> 01:55:33.480] Well, get Steve, Steve 6'8", give him some steel gloves and have him stand up on the roof and he'll take care of that problem. [01:55:33.480 --> 01:55:37.480] Okay, let's move on. [01:55:37.480 --> 01:55:45.480] Speaking of sound though, compared to all the other internet radio, you guys got the best sound out there. [01:55:45.480 --> 01:55:51.480] I'll get off the phone here and let you move on to somebody else. I appreciate you guys being out there. [01:55:51.480 --> 01:55:56.480] Okay, thank you and you just made some real points with Deborah. [01:55:56.480 --> 01:55:59.480] Yeah, only she's not here to hear. [01:55:59.480 --> 01:56:04.480] Deborah does an incredible amount of work on this. [01:56:04.480 --> 01:56:12.480] You know, sometimes she kind of grinds on me, but then it annoys me, but she's right. [01:56:12.480 --> 01:56:16.480] She is a real stickler for good sound. [01:56:16.480 --> 01:56:22.480] Yeah, she does produce a really good program and thank you for noticing. [01:56:22.480 --> 01:56:24.480] All right, guys, y'all have a good one. [01:56:24.480 --> 01:56:31.480] Take care, Mark. Now we're going to go to Douglas in Texas. Douglas, where do you got for us? [01:56:31.480 --> 01:56:37.480] I like your radio program very, very much. I've been listening to it for a while, several years. [01:56:37.480 --> 01:56:42.480] You mentioned a lifetime situation. I don't have any personal knowledge of this, [01:56:42.480 --> 01:56:54.480] but what is reported to be a lifetime situation was given on Jerry Johnson's Sunday program Live and Let Live that you carry on the Logos Network. [01:56:54.480 --> 01:57:03.480] And I forget the name of the guest, but what he outlined there was that there is a [01:57:03.480 --> 01:57:17.480] citizen now of California, state resident of California named Chris Diaz, who was formerly in Austin from 1997 to 2004. [01:57:17.480 --> 01:57:23.480] He's been in frail health since, well, since he was born. [01:57:23.480 --> 01:57:35.480] He suffers from caravansma. In California, they have medical marijuana and medical hashish. [01:57:35.480 --> 01:57:45.480] And in fact, it was his doctor here in Austin who told him that he had to get out of the pollen belt and go to California for his health. [01:57:45.480 --> 01:57:57.480] He had to come back to check on his grandmother a year ago and she's, I think, about 90 or 91 and in frail health. [01:57:57.480 --> 01:58:09.480] And of course, he brought here marijuana and hashish, which he finds are the only effective medications. [01:58:09.480 --> 01:58:16.480] Okay, hold on, hold on, we're about to go to break. This sounds like it's going to be an interesting conundrum. [01:58:16.480 --> 01:58:18.480] Yeah. [01:58:18.480 --> 01:58:25.480] Can, does a full safe and credit apply to medical marijuana? [01:58:25.480 --> 01:58:29.480] Okay, this is Randy Clark and Deborah Stevens and Greg with the radio. [01:58:29.480 --> 01:58:33.480] Our call in number 646-1984. [01:58:33.480 --> 01:58:42.480] I'm sorry, 512-646-1984. Hold on, Douglas. We will pick you back up on the other side. [01:58:42.480 --> 01:58:51.480] So give us a call. We've got two more caller, one more caller, then we're going to go to frail from Austin. [01:58:51.480 --> 01:59:00.480] We'll be right back.
