[04:14.100 --> 04:17.700] I got an interesting email from a college student today, [04:17.700 --> 04:22.300] and though I'm not going to give his name, I do kind of want to discuss [04:22.300 --> 04:26.100] why he was writing and how I responded to him about it. [04:26.100 --> 04:32.100] So what I'd like to do first is I'm going to read you his email, and then I'm going to read you my response to it. [04:32.100 --> 04:38.600] Now, the reason I'm bringing this up is because this appears to be the way [04:38.600 --> 04:46.600] that the majority of the Patriot community thinks about things when it comes to being sovereign. [04:46.600 --> 04:52.300] Now, the thing about being sovereign is that's not really what we're wanting to be. [04:52.300 --> 04:55.500] What we're wanting to be is free. [04:55.500 --> 04:59.500] We don't want the authority to make law and rules that govern other people. [04:59.500 --> 05:06.100] We simply want to be free from laws and rules that don't have anything to do with us. [05:06.100 --> 05:11.300] We don't want to be under somebody else's thumb and somebody else's control. [05:11.300 --> 05:17.100] That's a free man. It's not a sovereign. It's a free man, okay? [05:17.100 --> 05:19.700] And that's what we're supposed to be. [05:19.700 --> 05:27.800] We're supposed to be able to use what we know to be right and wrong and to make choices. [05:27.800 --> 05:31.900] Even God didn't hand us down a book of codes and says, [05:31.900 --> 05:35.300] for everything you do, there's this, this, this, and this. [08:14.900 --> 08:20.400] When any aspect of living under the will of men becomes intolerable or unacceptable, [08:20.400 --> 08:25.900] then I have the right to make my own choice to no longer agree to it. [08:29.800 --> 08:36.000] The limits of what we may choose to do as individuals are biblical in their morality and principle. [08:36.000 --> 08:42.300] Do not harm the rights, person or property of another without an absolute necessity to do so, [08:42.300 --> 08:46.300] such as self-defense of oneself or others. [08:46.300 --> 08:52.700] Commonly referred to as the golden rule and recognized by a simpler assembling of words, [08:52.700 --> 08:56.800] do unto others as you would have them do unto you. [08:56.800 --> 09:04.000] Sovereignty from a strictly human perspective is nothing more than a choice to live as such. [09:04.000 --> 09:10.500] In order to be a sovereign, you must be willing to both live and act as a sovereign. [09:10.500 --> 09:19.300] This means being fully knowledgeable of the limits of the power and authority of your public servants and other people to affect your rights and property, [09:19.300 --> 09:25.500] and actively applying that knowledge whenever and wherever necessary. [09:25.500 --> 09:29.800] Being sovereign is not done by filing a piece of paper. [09:29.800 --> 09:33.200] It is an attitude and life choice. [09:33.200 --> 09:38.900] You are a sovereign the moment you decide to be and act upon that decision, [09:38.900 --> 09:44.600] and no document of any size or length is required to make that so. [09:44.600 --> 09:49.500] The UCC is not a solution to anything in this regard. [09:49.500 --> 09:59.000] It is a trap that draws the willfully ignorant silver bullet crowd like Flame does a moth and often with exactly the same result. [10:04.100 --> 10:14.200] How can a code of commercial law written by mere men possibly have any application to those things that are inherent in every human being? [10:14.200 --> 10:19.200] Nothing inherent comes from codes or constitutions. [10:19.200 --> 10:23.200] It is knowledge that is power, not paperwork. [10:23.200 --> 10:30.100] It is the will and fortitude to act on that knowledge and apply it to the betterment of yourself and mankind. [10:30.100 --> 10:35.300] That is what makes one sovereign, not declarations, not documents. [10:35.300 --> 10:38.900] The constitutions are not what made us sovereigns. [10:38.900 --> 10:43.900] Our choice to be free, to take action on that choice, [10:43.900 --> 10:50.700] and to live on our own terms and conditions is what made or makes us so. [10:50.700 --> 10:58.100] You don't need advice you need to choose, and then you need to simply act. [10:58.100 --> 11:00.100] You don't need to move elsewhere. [11:06.900 --> 11:16.600] No less can be said for a sovereign human being. Choice without action to implement and defend that choice is dead. [11:16.600 --> 11:23.000] That last quote is mine, but it is the one that I made when I decided to act on all that I had learned [11:23.000 --> 11:27.900] and started fighting the traffic code, the taxes, and pretty much anything and everything else [11:27.900 --> 11:36.900] that I come to recognize and understand as being dishonest, deceitful, and oppressive on me, my family, and my fellow man. [11:36.900 --> 11:39.500] The founding fathers stated, [11:39.500 --> 11:46.100] We mutually pledge to each other our lives, our fortunes, and our sacred honor. [11:46.100 --> 11:52.600] A sovereign is not a magical, omnipotent, bulletproof, untouchable entity. [11:52.600 --> 11:56.900] We are human beings that have made a choice and acted on it. [11:56.900 --> 12:02.600] For better or worse to ourselves, our fortunes, our very lives. [12:02.600 --> 12:08.000] To my knowledge, I have never met a materially wealthy sovereign. [12:08.000 --> 12:12.900] I believe that is because we do not live in strife for that purpose. [12:12.900 --> 12:19.900] And the choices we have to make are very often without material and or monetary reward. [12:19.900 --> 12:29.400] But we persist because we would rather do what is biblically moral, ethical, and just, no matter what the personal cause, [12:29.400 --> 12:35.900] than to live under the rule and yoke of men that have no sense of either. [12:35.900 --> 12:45.400] Now, that folks in summary is how I view what we're all hoping, praying, and seeking for. [12:45.400 --> 12:49.000] That's my motivation to do what I do. [12:49.000 --> 12:54.500] The people that I've talked to that are actually working for something better. [12:54.500 --> 12:59.200] In my heart, I feel this is the same thing that motivates many of them. [12:59.200 --> 13:09.300] I can't say all because I have met many that have said one thing and by the fruits of their labors proved to be deceptive in what they're after. [13:09.300 --> 13:11.700] So I can't say all. [13:11.700 --> 13:18.100] There are those, as the old saying goes, there are rotten apples in every barrel. [13:18.100 --> 13:29.100] The only thing that we can do with those rotten apples is try to prevent whatever is spoiling them from spreading to those adjacent to them or around them. [13:29.100 --> 13:37.100] So the way to do that is to seek the truth about what is and what can be. [13:37.100 --> 13:45.100] And I told a little thing in class yesterday, and by the way, yesterday's class at Brave New Books was absolutely excellent. [13:45.100 --> 13:52.100] It was by far the largest class we have had since I started going down there last October. [13:52.100 --> 13:58.600] It was an absolutely great class and I want to thank everyone that came. [13:58.600 --> 14:10.600] But one of the things I've told them down there was a story about there's this little 14 year old Chinese boy who has been living in a Shaolin monastery since he was four years old. [14:10.600 --> 14:16.600] He's been under the tutelage of the same Shaolin master his whole life since he was there. [14:16.600 --> 14:24.100] And one day he walks up to that Shaolin master and he asks them, how do I find truth? [14:24.100 --> 14:28.100] Well the Shaolin master just simply looks at him and says, follow me. [14:28.100 --> 14:34.600] And he takes him into the center of the temple and in the center of the temple there is this large water fountain. [14:34.600 --> 14:42.100] You know the kind where the water just bubbles up in it all the time, it's always level full and overflowing. [14:42.100 --> 14:48.600] And he tells the young boy, put your face beneath the surface and seek the truth. [14:48.600 --> 14:57.100] No sooner does the boy's face go under the water than he feels a hand on the back of his neck forcing his head completely under. [14:57.100 --> 15:07.100] And it takes him by surprise so he starts to struggle, but no matter how hard he struggles he cannot bring himself above the surface to breathe. [15:07.100 --> 15:13.100] And he is struggling and struggling and struggling to get his head out from under the water so he can draw breath. [15:13.100 --> 15:24.100] And finally right at the point when his struggle starts to grow weak and he starts to black out, the pressure on the back of his neck is released and he's allowed to rise. [15:24.100 --> 15:36.100] He pulls his head up and he's gasping for air and he turns around, he looks at the master and he's saying, I have trusted you with everything in my life and now you would try to drown me for asking a question. [15:36.100 --> 15:39.100] Why would you do that? [15:39.100 --> 15:51.100] The Shaolin master looks at the boy and he goes, when you are willing to seek the truth and fight for it as hard as you were for that breath of air, then you will find it. [15:51.100 --> 16:02.100] That people is what we need to be doing, knowledge is what's going to get us out of the mess we're in and taking action on that knowledge. [16:02.100 --> 16:12.100] We will get nowhere as long as we sit back and wait for it to come to us or for someone else to do it. [16:12.100 --> 16:24.100] We will not fix what's wrong with our country, we will not fix what these people that we have allowed to control us for so long are dragging us into. [20:17.100 --> 20:25.100] We've sort of been accustomed, gotten accustomed to using this term in the patriot movement and the freedom movement. [20:25.100 --> 20:33.100] After a long conversation with Harman, Harman Taylor who is our guest this past Friday and also apparently Eddie's had this conversation with him too, [20:33.100 --> 20:43.100] we're not sovereigns. The word sovereign carries the implication that we have some sort of authority to make rule and law over other men [20:43.100 --> 20:49.100] and we don't do that. We don't want that kind of power. That would be like a monarchy. [20:49.100 --> 20:55.100] A king would be a sovereign like our Lord Jesus is king. He is the ultimate sovereign. [20:55.100 --> 21:03.100] Besides him, the only sovereigns that there really are are governments. The governments are sovereign. [21:03.100 --> 21:11.100] They carry rule and authority to make laws over other men. That's not really how we need to label ourselves. [21:11.100 --> 21:21.100] What people really are intending when they say that is that we are free. We are free men and yes, that's how we want to live our lives as free men. [21:21.100 --> 21:28.100] And as Kay Beach says on her show, how free do you want to be? That's the question she asks at the beginning of every show. [21:28.100 --> 21:33.100] How free do you want to be? And it all boils down to making choices in your life. [21:33.100 --> 21:45.100] And a very good friend of mine, his name is Sasan. He is a co-host on the Jeff Davis show, the television show that I used to co-host with a few years ago. [21:45.100 --> 21:52.100] On his MySpace page where they got the little thought bubble kind of like on Skype where you can have a thought bubble, [21:52.100 --> 22:03.100] his says, there are no rules. There are only people making decisions. And I think that that's a very good mantra that he's got there. [22:03.100 --> 22:11.100] And you can even carry this step further. Harmon would say there are no laws. There's only people making decisions and agreements. [22:11.100 --> 22:20.100] Because even Harmon says that even the law itself doesn't apply to unless you've agreed to it somehow through a commercial agreement. [22:20.100 --> 22:32.100] And so why would you go running to the UCC code to dig yourself even further by filing documents in the place called this state? [22:32.100 --> 22:43.100] Why would you run to a commercial code and just dig yourself deeper into the quagmire when the commercial agreement is exactly the thing that you want to avoid? [22:43.100 --> 22:54.100] And so, no, we don't believe in any of this commercial redemption stuff. I don't believe in it. I believe I've really seen now the light that the more people endeavor into that route, [22:54.100 --> 23:04.100] the more you're just digging yourself in deeper into the problem. And so I just wanted to make that comment there just to continue on Eddie's tirade. [23:04.100 --> 23:16.100] And as another brief announcement on another note, people, please understand that especially on Monday nights, I have to screen the calls. [26:15.100 --> 26:21.100] I said, just reference us back to the motor vehicles saying that they don't have to put a warrant out for you. [26:21.100 --> 26:23.100] They can just give you a ticket. [26:23.100 --> 26:28.100] They can judge you on that ticket. So it doesn't violate the Constitution too. [26:28.100 --> 26:33.100] So is that way supposed to be read? Am I correct on that? [26:33.100 --> 26:40.100] Well, without actually reading the statute you're referring to and your constitutional reference for it, I can't really answer that. [26:40.100 --> 26:52.100] But the question becomes, does the procedure that your state outlined in your Code of Criminal Procedure match up with what has always been considered [26:52.100 --> 27:07.100] the right of due process? If the procedures for certain types of alleged criminal offenses deny you the full gamut of the due process procedure, [27:07.100 --> 27:12.100] then yes, there is a problem with that criminal procedure. [27:12.100 --> 27:13.100] Oh, okay. [27:13.100 --> 27:18.100] Because to be my reading it does and my limited understanding it seems to be yes. [27:18.100 --> 27:25.100] Okay, well do yourself a favor and this is what I recommend to anybody that is learning how to do this the first time. [27:25.100 --> 27:34.100] Read it multiple times and do and put some time and space between the times you read it. [27:34.100 --> 27:42.100] Every time you read it, sit down and make notes about what you think you understood it to mean at that time. [27:42.100 --> 27:51.100] Then you come back and read it again and read your notes and see if you still think that's what it means or did you get something new and different. [27:51.100 --> 27:57.100] Eventually you will distill this down to what is actually correct. [27:57.100 --> 28:00.100] That's the hope anyway. [28:00.100 --> 28:02.100] I have one question. [28:24.100 --> 28:30.100] Now, are you responsible for that firmens if you don't sign it or can they bring that back upon you? [28:30.100 --> 28:34.100] Again, what does the law in relation to the citation say? [28:34.100 --> 28:40.100] Does it say that the ticket has to be signed in order for them to come after you for not appearing on it? [28:40.100 --> 28:45.100] What did the legislature try to say they were allowed to do? [28:45.100 --> 28:58.100] And then did what the legislature allowed violate anything in your state constitution and other law that says you can't do it that way? [28:58.100 --> 29:00.100] That's what you got to figure out. [29:00.100 --> 29:06.100] It is a giant jigsaw puzzle and you have to put it together without a picture of a box. [33:16.100 --> 33:24.100] Randy said that no one is above the law and that, for example, if a police officer falsely arrests you [33:24.100 --> 33:30.100] and maybe goes before a grand jury and purges himself in the grand jury, [33:30.100 --> 33:38.100] that there's a way to have that officer indicted himself if you have the actual proof. [33:38.100 --> 33:45.100] Whether or not he would be indicted for purger testimony before the grand jury would be up to the grand jury [33:45.100 --> 33:49.100] because they would be the ones present when he's giving that testimony, [33:49.100 --> 33:57.100] they would have to make the determination and investigate the facts of whether or not he made false statements under oath. [33:57.100 --> 34:05.100] How do you actually do that? Do you write the grand jury a letter and then ask to appear before the grand jury with that evidence? [34:05.100 --> 34:16.100] If you have knowledge and actual knowledge of evidence that would prove an individual falsely testified before a grand jury, [34:16.100 --> 34:23.100] then yeah, you can present that charge to the grand jury against that individual. [34:23.100 --> 34:30.100] But they still are the ones that have to investigate it and hand down the indictment for it. [34:30.100 --> 34:35.100] Right, so what I'm kind of figuring out is how do you actually do that? Because at our local courthouse, [34:35.100 --> 34:44.100] there's like an inbox for the grand jury, so do I write kind of like a legal pleading and then attach evidence? [34:44.100 --> 34:55.100] It's basically nothing more than a signed and sworn statement of facts accusing somebody of some wrongdoing against the laws of the state. [34:55.100 --> 35:01.100] Which means it has to be notarized. It has to be sworn to. [35:01.100 --> 35:07.100] You may also want to, with your statement of probable cause like what Eddie's talking about, [35:07.100 --> 35:14.100] you will most likely, depending on the laws of your state, also attach what's called a criminal complaint, [35:14.100 --> 35:19.100] which is usually a one-page document. A lot of times there's a form for it, [35:19.100 --> 35:27.100] and it basically just states that you have reasonable probable cause to believe that so-and-so committed such-and-such crime [35:27.100 --> 35:34.100] by violating such-and-such statute, and you put in the exact statute number on that piece of paper. [35:34.100 --> 35:41.100] And so by doing that, you are actually filing the criminal complaint directly with the grand jury, [35:41.100 --> 35:45.100] and that is a much different thing than filing a police report. [35:45.100 --> 35:51.100] Okay, that's not filing a criminal complaint. That's reporting or complaining to the police. [35:51.100 --> 35:57.100] And so you may want to look up what the grand jury laws and the criminal complaint laws are in your state. [35:57.100 --> 36:02.100] Now beware, the prosecutor's going to try to get in your way and stop you. [36:02.100 --> 36:07.100] And so she always tries to run interference between the public and the grand jury. [36:07.100 --> 36:14.100] In most states, there is nothing prohibiting a citizen from being able to access the grand jury directly, [36:14.100 --> 36:17.100] even though they say, oh, they're secret. They're secret. They're secret. [36:17.100 --> 36:20.100] No, no, no. That is all hokum, okay? [36:20.100 --> 36:25.100] The only thing secret about a grand jury is their deliberations. That's it. [36:25.100 --> 36:33.100] Their identities are not secret. Nothing else about a grand jury is secret other than when they go into deliberation [36:33.100 --> 36:36.100] behind closed doors, not even the prosecutor can be there. That's it. [36:36.100 --> 36:43.100] So a lot of times people will try to go down there, and then the prosecutor will get in your way. [36:43.100 --> 36:47.100] Randy has to call 911. It turns into a big scene. [36:47.100 --> 36:55.100] Then he ends up having to file criminal charges against the prosecutor himself or herself for interfering with the public's access to the grand jury. [36:55.100 --> 36:57.100] It can get real messy. [36:57.100 --> 37:07.100] Another technique is to send the criminal complaints which also have to be verified or notarized with your probable cause statement. [37:07.100 --> 37:15.100] Send those certified mail to the grand jury, to the address of the courthouse, and address them to the grand jury. [37:15.100 --> 37:19.100] You can find out who the members of the grand jury are by calling the clerk. [37:19.100 --> 37:25.100] If they ask you why you want to know, they actually don't have the authority to ask you why. [37:25.100 --> 37:32.100] But if you want to avoid a big fight with the clerk about it, because that's actually a crime in and of itself, they are not allowed to ask you why. [37:32.100 --> 37:44.100] Randy says, you just make up a story like you're doing research for your kids' school project or something, and then find out when the grand jury meets and what their names are and things like that. [37:44.100 --> 37:56.100] But if you can't get their names, you can just address, send 12 separate envelopes, 12 copies of everything, or however many grand jurors there are on the grand jury panel in your state, [37:56.100 --> 38:08.100] and address one to the grand jury foreman, and then the next one to grand juror number two, grand juror number three, grand juror number four, et cetera, et cetera. [38:08.100 --> 38:23.100] And then if the prosecutor intercepts those certified mail documents, then you can get the feds involved and go after the prosecutor for tampering with the mail and turn them into the postmaster, postmaster general. [38:23.100 --> 38:32.100] So there's a lot of techniques that are at our fingertips available to deal with these rogue prosecutors that try to interfere with our access to the grand jury. [38:32.100 --> 38:35.100] And we've done whole entire shows on this before. [38:35.100 --> 38:46.100] How, if like the police officer is indicted for these criminal charges, how do you prevent the prosecutor and the judge from dismissing the case? [38:46.100 --> 38:58.100] Well, you can't because it's a criminal case and once they get indicted, well, once they get indicted, depending on the laws of your state, the prosecutor is required to prosecute the case. [38:58.100 --> 39:00.100] He doesn't have a choice. [39:00.100 --> 39:04.100] It's not up to the prosecutor or the judge to dismiss the case. [39:04.100 --> 39:09.100] The defendant has to put on an adequate defense. [39:09.100 --> 39:10.100] Okay. [39:10.100 --> 39:13.100] They don't get to just blow it off. [39:13.100 --> 39:21.100] In the state of Arizona, I think the grand jury sessions are run by a grand jury judge. [39:21.100 --> 39:26.100] So would the grand jury judge try to... [39:26.100 --> 39:27.100] Well, now, wait a minute. [39:27.100 --> 39:29.100] A grand jury is assembled. [39:29.100 --> 39:37.100] Even in Texas, there is a district judge that's responsible for receiving and sending up the information to the grand jury. [39:37.100 --> 39:46.100] But he is not a part of the grand jury deliberations or process when they are going through a legal accusation. [39:46.100 --> 39:50.100] So make sure you're understanding what you're reading. [39:50.100 --> 39:56.100] There are normally no judges in a grand jury session in any state. [39:56.100 --> 39:57.100] And judges... [39:57.100 --> 40:08.100] The judge is only there to have the indictment returned to the judge from the grand jury so that he can hand it down to the proper court having jurisdiction. [40:08.100 --> 40:09.100] Yes. [40:09.100 --> 40:13.100] Keep in mind, the grand jury is a separate branch of government. [40:13.100 --> 40:16.100] This is what they don't want people to know. [40:16.100 --> 40:19.100] The grand jury is not part of the executive branch. [40:19.100 --> 40:22.100] It's not an arm of the prosecutor's office. [40:22.100 --> 40:27.100] The grand jury is also not part of the judicial branch either. [40:27.100 --> 40:30.100] It is a separate branch of government. [40:30.100 --> 40:34.100] Generally, judges impanel the grand jury. [40:34.100 --> 40:36.100] They swear them in and stuff like that. [40:36.100 --> 40:40.100] And they'll send out calls for jury duty notice and stuff like that. [40:40.100 --> 40:46.100] And like Eddie's saying, a judge will generally impanel and assemble a grand jury. [40:46.100 --> 40:49.100] But after that, they can't touch it. [40:49.100 --> 40:50.100] And neither can the prosecutor. [40:50.100 --> 40:53.100] It's a separate entity in and of itself. [40:53.100 --> 41:01.100] And then the grand jury returns the indictment or the no bill depending on whether they decide to indict somebody or not. [41:01.100 --> 41:05.100] Those get sent back to the judicial branch. [41:05.100 --> 41:13.100] Is it the same regardless of if it's like a county or a federal court? [41:13.100 --> 41:17.100] Well, the federal grand jury is different than a county grand jury. [41:17.100 --> 41:20.100] Completely different area of law. [41:20.100 --> 41:26.100] A federal grand jury only deals with violations of federal law, not state. [41:26.100 --> 41:30.100] Right, but I mean in terms of this process that you're talking about on how... [41:30.100 --> 41:37.100] Federal procedures are similar, but not the same in every respect. [41:37.100 --> 41:46.100] But the grand jury at the federal level is still an independent body from any of the other branches of government. [41:46.100 --> 41:55.100] You need to look up your state, go to your state code, your state criminal, your code of criminal procedure, [41:55.100 --> 42:03.100] and look up what the state laws are regarding the setup of the grand jury and what they're supposed to do. [42:03.100 --> 42:05.100] It's going to be slightly different in every state. [42:05.100 --> 42:12.100] But the first things first, start with the state of Arizona and just go online and look up your state code, [42:12.100 --> 42:20.100] your code of criminal procedure, and do a search for grand jury and you'll see what the setup is in your state. [42:20.100 --> 42:28.100] That's the first thing you need to do and then you'll know where to go and who to contact to send your criminal complaints to. [42:28.100 --> 42:35.100] Okay, so in summary you're saying I need a signed and sworn affidavit effect, a statement of probable cause, [42:35.100 --> 42:43.100] a criminal complaint, I need to cite the statutes and then attach exhibits of evidence. [42:43.100 --> 42:50.100] And then I need to send that directly to a grand jury and ask them if I can appear before a grand jury session. [42:50.100 --> 42:52.100] That's basically it, yes. [42:52.100 --> 42:59.100] And they'll call you if they want to or they may feel from whatever you send them or give to them in person [42:59.100 --> 43:03.100] that that's enough and they may not need to talk to you. [43:03.100 --> 43:11.100] And then I just need to figure out how do you get around the quirk of the court and the prosecutor from preventing me from doing any of this. [43:11.100 --> 43:12.100] Basically, yes. [43:12.100 --> 43:17.100] If all else fails you just send it certified mail to the courthouse. [43:17.100 --> 43:20.100] Generally the grand jury will meet at the courthouse. [43:20.100 --> 43:28.100] That's what I'm saying, you need to look in your law to find out where they meet and then send it certified mail to grand jury number one, [43:28.100 --> 43:36.100] number two, number three, separate packets and if they don't get to those grand jurors and the way to find out whether they get to them or not [43:36.100 --> 43:45.100] is that you'll see the minutes of the grand jury go back a month or two later and ask for the minutes of the grand jury from the court [43:45.100 --> 43:53.100] where it has a list of the charges that were presented to them against a certain person and whether that person was indicted or not. [43:53.100 --> 43:59.100] And if you never see anything about your charges, you know it didn't get to them. Stay right there, John. Usually it's three to six months, sometimes it's four, sometimes it's six, [46:42.100 --> 46:47.100] sometimes it's three, it's generally either a quarter or a third of the year or half of the year, [46:47.100 --> 46:56.100] and basically the no-bills and the indictments are not due until the end of their seating, [46:56.100 --> 47:03.100] of that session of the grand jury, and so you go at the end of the session, [47:03.100 --> 47:10.100] or if their minutes are due, you know, if the no-bills or the indictments are due within 30 days of being presented to them, [47:10.100 --> 47:15.100] then that's another issue. You need to go back 30 days later and look at the minutes. [47:15.100 --> 47:22.100] It all depends on what it is in your state. In our state, the no-bills and the indictments are not due until the end of the session, [47:22.100 --> 47:28.100] and so you present your complaints through mail or trying to go down there or whatever, [47:28.100 --> 47:33.100] and then you go back at the end of the session, you ask the court court for the minutes of the grand jury, [47:33.100 --> 47:41.100] and then you look down the list to see who all got charges presented against them at what time [47:41.100 --> 47:47.100] and when they were either no-billed or indicted. No-billed means they didn't indict. [47:47.100 --> 47:55.100] Okay, there's got to be a record there somewhere, and if you don't see any record of your charges being presented, [47:55.100 --> 48:04.100] there's no no-bill, there's no indictment, no nothing, then you know those charges, those documents never got to the grand jury. [48:04.100 --> 48:13.100] That's when you call the postmaster general of the United States. You get the feds involved and cry out and say, [48:13.100 --> 48:18.100] look, there's some mail fraud going on here, there's some tampering with the mail because I sent certified documents [48:18.100 --> 48:26.100] and they were signed for and they never got to the jurors, and so then you trace back who actually did the signing. [48:26.100 --> 48:33.100] Was it the clerk of the court? Was it the prosecutor? And then you let the postmaster unravel it from there. [48:33.100 --> 48:40.100] And at that point you could even file federal criminal charges as well with the U.S. attorney or try to get to a federal grand jury, [48:40.100 --> 48:45.100] which is almost impossible. My question is fundamental, because I get to listen to you guys sporadically, and I've been at this a long time, but my question is, when I get pulled over by said cop or sheriff or state trooper or whatever, [01:22:03.100 --> 01:22:18.100] what are the fundamental steps I want to go through with the officer when he pulls me over and asks me what the hell I thought I was doing when I did X, Y, or Z? [01:22:18.100 --> 01:22:28.100] There are three basic questions, four basic actions. We've added a fourth one, but that's simply because it's simple enough to do without opening your mouth. [01:22:28.100 --> 01:22:39.100] The three basic are questions. What is the emergency and how can I help? Repeat that till you get an answer. Am I under arrest? Repeat that till you get an answer. So there's no requirement for them to apply the complaint a day before my parents, correct? [01:24:40.100 --> 01:24:48.100] Correct. Now, if they say you violated a particular ordinance, now this is where? [01:24:48.100 --> 01:24:52.100] In Sunrise Beach, it's up on Lake LBJ in Austin area. Well, now the one problem you do have is the fact that you were in a company car. And then I got something in the mail about a week later where the judge said it's for a jury trial. [01:37:58.100 --> 01:38:10.100] So anyway, didn't they have a pre-trial hearing? Good. But whatever you do, do not lose that letter that you received that said the judge set it for trial, and there was no issue before the court at that time. [01:38:10.100 --> 01:38:18.100] Okay. Don't lose that. But eventually make sure you get your hands on a copy of the complaint showing the file stamp date on it. [01:38:18.100 --> 01:38:35.100] Okay. Okay. Yeah, it was after the fact. So anyway, then when we had the pre-trial, I had a motion to dismiss in hand to dismiss the case for violating the article which says the complaint shall be one day prior to any proceeding. And so the judge said, so this is what you believe, and if there's no, your honor, it's not what I believe, it's what I know. And he kept asking me these questions. [01:41:37.100 --> 01:41:50.100] Yeah, when the judge makes a ruling and you know for a fact that ruling is not based on any law, it's just what the judge wants to do. You have the right to demand by what legal authority he made that decision. [01:41:50.100 --> 01:41:51.100] Okay. [01:41:51.100 --> 01:42:13.100] So what we have here is when you ask for a finding a fact and conclusion of law, this is what that means. Finding a fact. What does the actual statute say? Conclusions of law. What are the court opinions and decisions relating to that statute? [01:42:13.100 --> 01:42:14.100] Okay. [01:42:14.100 --> 01:42:29.100] They can only rely on those things to make their decisions. When they fail to do that, they are acting on their own without any lawful basis for their actions. [01:42:33.100 --> 01:42:54.100] He is supposed to have to answer that, but remember, these people don't think they have to do anything the law requires as you notice by his denial of the motion for 45.018. [01:42:59.100 --> 01:43:08.100] Now, two quick questions before I go. The citation where it says that the defendant is entitled to a copy of the complaint no less than one day before proceeding. [01:43:16.100 --> 01:43:26.100] No, they're required to serve you with it. Anytime somebody files something in a case, they're required to notice the other party. These idiots never, ever do that. [01:50:21.100 --> 01:50:28.100] And actually, I just noticed one in the mail where I first found it and it's going to a collection agency. [01:50:28.100 --> 01:50:34.100] But all the time on the radio, they threaten you with wall suits and the audio that they're so powerful. [01:50:34.100 --> 01:50:37.100] Well, that's what a collection agency has to do to collect. [01:50:37.100 --> 01:50:40.100] If you don't pay willingly, they have to sue you. [01:50:40.100 --> 01:50:55.100] So if it's just to some meanly, and this is the N-T-T-A, if it goes to a collection agency, I don't look at it as anything bigger than if somebody thinks I took too long to pay on a bill or something, it's pathetic and almost meaningless. [01:50:55.100 --> 01:51:00.100] Well, that would be true. But with one possible result, it is possible. [01:51:00.100 --> 01:51:16.100] I haven't looked into the statutes on that particular area far enough to see whether or not they're allowed to do what they're currently doing, which is notify the DPS to place a stop on your ability to register or renew your license if you actually think you have to have one. [01:51:16.100 --> 01:51:27.100] So that being the case, you know, you just need to do a little bit of reading and research to find out whether or not that's a possible end result of not paying it. [01:51:27.100 --> 01:51:37.100] But as far as the collection agency goes, the collection agency has the same problem any other collection agency has in how they collect the debt. [01:51:37.100 --> 01:51:45.100] By the time it's all said and done, you could probably go after them with Michael Mears' method and make them regret ever sending her the bill in the first place. [01:51:45.100 --> 01:51:58.100] That's, yeah, for $250, that was going to be more of my approach. They even put the little note on there. Well, if you think that the debt is not legitimate, well, please notify us in 30 days and we'll... [01:51:58.100 --> 01:52:09.100] Now, I don't know if I reply, but I accuse myself. If I got myself into something by a plier, I just let the stupid little things keep piling up for us. The $1.50 is probably the original choice. [01:52:09.100 --> 01:52:16.100] Now, what they do is they take a picture of the license plate when you go through the toll booth. [01:52:16.100 --> 01:52:25.100] Now, what they have to actually prove is that you didn't put any money in when you went through the toll booth. [01:52:25.100 --> 01:52:33.100] Now, they try to use a synchronized record system. Well, the camera only goes off if money doesn't hit the till and the car passes through. [01:52:33.100 --> 01:52:43.100] Can you prove it wasn't malfunctioning that day? Well, no, we're in Arizona. Oh, well, too damn bad for you. So sorry. The toll booth's in Texas. [01:52:43.100 --> 01:52:52.100] You know, simple kind of stuff like that. There's a reasonable argument to this if you take it. [01:52:52.100 --> 01:53:00.100] In that case, I'll probably just let it see if they really give that much of a crap to pursuit for $250 because I sure as hell don't care. [01:53:00.100 --> 01:53:07.100] If you want to dispute, be able to set up the Michael Myers method, you need to send a dispute letter disputing the debt. [01:53:07.100 --> 01:53:15.100] And I was going to add something and you need to do it within the 30-day time period, too, because if you don't dispute within the 30 days, then you're basically consenting. [01:53:15.100 --> 01:53:29.100] Now, the other thing I wanted to mention, depending on what agency this is, how they interact with the DOT, the way that it works with the Fair Debt Collections Practices Act [01:53:29.100 --> 01:53:37.100] and the Fair Credit Reporting Act and all that, government entities are immune from that, including state agencies. [01:53:37.100 --> 01:53:50.100] And so what happens is if, according to state code, if this is a specific private entity that is working in contract directly with the government agency, [01:53:50.100 --> 01:53:55.100] they're going to be immune from the Michael Myers method as well. [01:53:55.100 --> 01:54:08.100] However, if they let it go and then you get yet another sucker third-party debt collector to pick it up, then you can go after that entity with the Michael Myers method. [01:54:08.100 --> 01:54:11.100] So you have to be careful regarding the Michael Myers method. [01:54:11.100 --> 01:54:17.100] It won't work against governmental entities or entities that are directly contracted with the state. [01:54:17.100 --> 01:54:25.100] There's only, what, two or three or more of that, but there's not that many of them in the state of Texas. We don't have that many toll roads, [01:54:25.100 --> 01:54:30.100] but the NTTA is probably pretty in bed with it. [01:56:19.100 --> 01:56:33.100] There is tons of case law through the history of the use of the streets that talks about how the roads may not be used by the general public for the purpose of parking cars. [01:56:33.100 --> 01:56:38.100] Now, as far as the actual thoroughfare, I absolutely agree with that. [01:56:38.100 --> 01:56:44.100] You park a car in the middle of a lane that's designed for moving traffic. You're impeding traffic. [01:56:44.100 --> 01:56:47.100] You're depriving other people of the proper use of the road. [01:56:47.100 --> 01:56:58.100] But here we're talking about a situation where the road has been extended for the specific purpose of supplying public parking. [01:56:58.100 --> 01:57:09.100] Now, if that's a public street and the city or the people of the city have said we wish to have space reserved for the purpose of parking, [01:57:09.100 --> 01:57:22.100] then because those are managed by city ordinance, once again, we get the issue of laws being directory versus required. [01:57:22.100 --> 01:57:31.100] So who has to pay for the parking in these spaces if they've been specifically supplied for that purpose? [01:57:31.100 --> 01:57:40.100] The courts can't argue that it impedes traffic to park there because that's what that was designed for, what to park there. [01:57:40.100 --> 01:57:52.100] So how is the city getting off charging the inhabitants of the city for the private use of the parking spot when they're not in a commercial business using the parking spot? [01:57:52.100 --> 01:57:57.100] It's still their street. [01:57:57.100 --> 01:58:02.100] Of course, we have the Texas constitutional issue of the city can't make law.
