[37:02.300 --> 37:05.300] Well, I've called in a couple of times to your show about the little thing that's [37:06.300 --> 37:09.300] going on here in Colorado and Douglas County. We have a zoning violation on an [37:09.300 --> 37:15.300] agricultural piece of land that we've had since the early 60s. And these folks, [37:16.300 --> 37:21.300] I thought I had some sort of a basement agreement to clean up. We have a [37:22.300 --> 37:26.300] construction company on our property and the county decided that it was no longer [37:27.300 --> 37:31.300] a conforming use to the zoning that they put on our property, which they changed [37:32.300 --> 37:37.300] it from ag to rural residential. And so I thought I had a basement agreement [37:37.300 --> 37:42.300] worked out with these guys and they set up this board of adjustment, which is [37:43.300 --> 37:48.300] elected by your board of county commissioners here. And they were going to [37:49.300 --> 37:53.300] this board of adjustment hears all appeals to zoning determinations if you don't [37:54.300 --> 37:58.300] agree with their zoning determination. So we signed up for our appeal and they [37:59.300 --> 38:01.300] said, well, if you work out this abatement agreement, then the board of [38:01.300 --> 38:06.300] adjustment won't be necessary to hear your case. So I thought I had the [38:07.300 --> 38:12.300] agreement worked out. I hired a council to make sure the agreement was a legal [38:13.300 --> 38:17.300] binding agreement that they wouldn't try and pull some shenanigans on us and [38:18.300 --> 38:21.300] something that we could live with. Well, they told us, well, your board of [38:22.300 --> 38:27.300] adjustment hearing was going to be on June 8th at 6 o'clock PM, but they gave us [38:27.300 --> 38:32.300] an extension of time to get this abatement agreement signed until August 4th. [38:33.300 --> 38:37.300] And on June 8th, which was this last Tuesday, I noticed a lot of county folks [38:38.300 --> 38:42.300] driving past my property here. So I thought something was wrong. I tried to get [38:43.300 --> 38:46.300] ahold of my attorney. There was no answer there. So I drove up to the courthouse [38:47.300 --> 38:52.300] at seven o'clock on Tuesday evening and walked in the courtroom and all these [38:52.300 --> 38:57.300] folks from the county and the board of adjustment were up there hearing our case. [38:58.300 --> 39:02.300] My lawyer wasn't there. None of us were there. We thought we had an extension and [39:03.300 --> 39:07.300] they were playing a little bit of dirty pool to find us in violation of this [39:08.300 --> 39:13.300] zoning problem we have. So the only thing I can really get from anybody is an [39:13.300 --> 39:21.300] apology and it sent me to the hospital. And now what I'm trying to do is find out [39:22.300 --> 39:27.300] what I can do, what's my next step to try and stop these folks from doing this to [39:28.300 --> 39:35.300] us now. Well, we really don't have anywhere near enough information to make any [39:36.300 --> 39:41.300] kind of determination because we don't know what's really going on. You're saying [39:41.300 --> 39:47.300] that they had a hearing without notice to anyone? Well, what they had noticed, they [39:48.300 --> 39:51.300] put up a sign that said that there would be a board of adjustment hearing on June [39:52.300 --> 39:56.300] 8th. And then they gave us an extension till August 4th or a continuation till [39:57.300 --> 40:01.300] August 4th. And then they tried to hear your matter anyway? They heard it, yes. [40:02.300 --> 40:06.300] They didn't just try. They started the hearing without us. Charge them [40:06.300 --> 40:12.300] criminally. And how's a gentleman going to do that? You know, I've been studying, [40:13.300 --> 40:16.300] I've got jurisdiction area, I've been studying like crazy and talking to other [40:17.300 --> 40:21.300] organizations and, you know, they all tell you how to go down and file a federal [40:22.300 --> 40:26.300] court case on these folks. But, you know, the cross claim is something that I'm [40:27.300 --> 40:32.300] really leery because I don't have the experience to handle something in the [40:32.300 --> 40:38.300] federal court system. I'm not sure you're ready for a federal court. It may not be [40:39.300 --> 40:43.300] wiped for a federal court. Okay. If you have these officials illegally holding a [40:44.300 --> 40:50.300] hearing, you should go for them for official oppression in the state. Okay. Start [40:51.300 --> 40:58.300] making grand jury noises. Okay. I like to do this kind of subtle. If you jump up [40:58.300 --> 41:05.300] and shake your fist in their face, they tend to jump up and huff their chest out [41:06.300 --> 41:11.300] and bear up against you. But when you don't shake your fist directly in their [41:12.300 --> 41:17.300] face, like I suggested earlier that this woman write a letter to the president of [41:18.300 --> 41:24.300] the company, here you go down to the district attorney's office and ask them when [41:24.300 --> 41:29.300] and where the grand jury meets. All right. And they're going to ask you why. [41:30.300 --> 41:36.300] Well, I have some criminal accusations I need to bring to their attention so that [41:37.300 --> 41:42.300] they can get you to present those criminal accusations to them. You see, the [41:43.300 --> 41:46.300] prosecutor is going to say he's the only one that can present to a grand jury and [41:47.300 --> 41:51.300] you let him know that you know that and you just want to notify them of criminal [41:51.300 --> 41:55.300] acts so that the prosecutor can present them to the grand jury. And he's going to [41:56.300 --> 42:00.300] give you some song and dance and he's going to want to know more information and [42:01.300 --> 42:06.300] you just kind of let him dig the information out of you. And as soon as you [42:07.300 --> 42:12.300] leave, you can be sure that the phones are going to start lighting up. And he's [42:13.300 --> 42:16.300] going to be calling these folks saying, why is this guy down here trying to get [42:16.300 --> 42:22.300] me to let him give criminal charges to the grand jury against you? Something a [42:23.300 --> 42:29.300] lot more devastating about that when you don't go and jump up in their face and [42:30.300 --> 42:36.300] give them an opportunity to defend themselves. Right. Go to somebody else and [42:37.300 --> 42:42.300] try to get them to beat them up. Mostly when I go after grand juries, I don't [42:42.300 --> 42:48.300] really want to get somebody indicted because mostly I go to grand juries over [42:49.300 --> 42:53.300] public officials doing things that they do as a matter of policy and a matter of [42:54.300 --> 43:00.300] course. It's just that it's improper and illegal. So you have a public official [43:01.300 --> 43:05.300] pretty well doing what he thinks he's supposed to and what he thinks he's [43:05.300 --> 43:11.300] authorized to do. So I don't really want to get thrown out of office. I just want [43:12.300 --> 43:16.300] to get beat up a little bit. You're bruising a little and he's going to be more [43:17.300 --> 43:21.300] careful next time. More likely to get them to do the right thing if you don't [43:22.300 --> 43:30.300] challenge them directly. In the county I live in, the word is that if I come [43:30.300 --> 43:35.300] around to anybody's office to watch out, I'm looking for them to do something so [43:36.300 --> 43:41.300] I can call the police and try to get arrested. I don't argue with them. They're [43:42.300 --> 43:46.300] not going to know I'm angry until the police come talk to me. All right. That is [43:47.300 --> 43:51.300] a lot more common. If I'm going to nail you, I want to whack you in the behind and [46:27.300 --> 46:31.300] you have to look around a while to figure out who did it. It's much more powerful [46:32.300 --> 46:38.300] if somebody else comes to you and tells you what I'm doing to try to get you in [46:38.300 --> 46:46.300] trouble that you didn't know anything about. Especially if I'm going to somebody [46:47.300 --> 46:51.300] above you or somebody that would have authority over you that you're afraid of. [46:52.300 --> 46:57.300] Go down to the district court and tell Bailiff to tell the judge you have business [46:58.300 --> 47:02.300] with the court. He'll ask you the nature of the business and you tell him, [47:02.300 --> 47:08.300] yeah, I want you to arrest some public officials. Most likely the judge will [47:09.300 --> 47:13.300] talk to you and tell you how he can't do that. But the judge at that point has [47:14.300 --> 47:19.300] no authority over you. So you'll find him to be a lot more amenable, especially [47:20.300 --> 47:25.300] if you go to a high level judge. They're political, they're elected, and they [47:25.300 --> 47:31.300] know they have no authority over you. So they'll be a lot more congenial and [47:32.300 --> 47:37.300] they'll insist that they can't do anything. And you insist, oh, yeah, you can. [47:38.300 --> 47:44.300] I need you to go arrest them. But when you're finished, you go away. The judge [47:45.300 --> 47:49.300] is not going to be on the phone to you, but somebody else is going to be on the [47:49.300 --> 47:55.300] phone to you letting you know what this guy was just in here trying to do. And I [47:56.300 --> 48:01.300] guarantee you that will terrify them. So give that a try. And it's a lot easier. [48:02.300 --> 48:06.300] You don't have to do anything formal. You just go down there and make noises and [48:07.300 --> 48:11.300] ask questions. You want to find out how do I go about filing criminal charges [48:12.300 --> 48:16.300] against these people? Who do I file it with? How do I get to a grand jury? Can I [48:16.300 --> 48:21.300] file these with the district judge? And go see the district judge. It will make [48:22.300 --> 48:26.300] you more familiar with the courthouse and the procedures. And you talk to the [48:27.300 --> 48:31.300] district judge a time or two when he doesn't have a case over you, you'll get to [48:32.300 --> 48:37.300] where you're less afraid of them and less intimidated by them. You'll find out [48:38.300 --> 48:39.300] there are people, too. [48:39.300 --> 48:45.300] Now, you know, there's a couple of folks said to file a negative of vermin against [48:46.300 --> 48:47.300] these folks. [48:48.300 --> 48:50.300] Oh, that's terrifying. [48:51.300 --> 48:52.300] I don't like that. [48:53.300 --> 48:54.300] No? [48:55.300 --> 48:57.300] No, and I'll tell you why. Because you can't prove a negative. [48:58.300 --> 49:04.300] And you file a negative of vermin against them, now you've got a claim against them [49:04.300 --> 49:08.300] that they cannot get away from. The only way they can get away, get rid of that [49:09.300 --> 49:11.300] claim is to go right through you. [49:12.300 --> 49:16.300] I just, I don't agree with the philosophy and the logic behind it to begin with. [49:17.300 --> 49:23.300] Because the principle behind the negative of vermin is that the charge stands [49:24.300 --> 49:31.300] unless the accused manages to come up with some proof to defend him or herself [49:31.300 --> 49:39.300] against it. And I don't like that because the burden of proof is on the accuser. [49:40.300 --> 49:46.300] And that's why, ultimately, I feel in my heart, negative of vermin is improper [49:47.300 --> 49:53.300] logic and faulty system of tyranny. There are folks out there filing negative of vermin [50:15.300 --> 50:18.300] and they may get a lot of personal satisfaction from it. [50:28.300 --> 50:32.300] It doesn't cause the public officials to stop harassing you. [50:33.300 --> 50:39.300] It gives them a reason to have to neutralize you in order to get rid of these [50:40.300 --> 50:44.300] claims against them. I don't want to be that threatening to them. [50:45.300 --> 50:49.300] I want to get them afraid of somebody else, not me. [50:49.300 --> 50:53.300] I'm just the one that gets the other people mad at them. [50:54.300 --> 51:00.300] So I can't suggest a negative of vermin. They scare me. I would never follow them. [51:01.300 --> 51:04.300] Okay, interesting strategy, Randy, to pass off the blame to somebody else. [51:05.300 --> 51:12.300] Okay, and agree, you don't want to back a wild animal into a corner [51:13.300 --> 51:16.300] because they're going to come out screaming and crying and everything else. Yeah, do him the whole deal. [51:32.300 --> 51:35.300] Wait a minute, why are you going to tell him anything? [51:36.300 --> 51:43.300] I don't talk to these people. Wait a minute, this time you're using him. [51:43.300 --> 51:48.300] You're using him as a tool. Okay, well, if you're going to talk to him, record it. [51:49.300 --> 51:52.300] That should only be fair since he is a tool. Oh boy, here we go. [51:53.300 --> 51:57.300] Well, in this case, he'll be a tool. You use it. [51:58.300 --> 52:02.300] Because when you get done to it on him, he's going to call these people [52:03.300 --> 52:06.300] and say, what is going on? Why is this guy trying to get me to arrest you? [52:06.300 --> 52:12.300] That's going to get their attention because this is something, [52:13.300 --> 52:17.300] they can't negotiate with you on this. They can't argue and defend themselves. [52:18.300 --> 52:22.300] Now they have to defend themselves against the third party. [52:23.300 --> 52:30.300] Especially if you only go to the district attorney because you want to go to the grand jury. [52:31.300 --> 52:33.300] Or the district court judge, right? [52:33.300 --> 52:38.300] I like the district judge better because you go to the district judge [52:39.300 --> 52:42.300] and he's not going to want to have anything to do with this. [52:43.300 --> 52:46.300] So what he's going to do is refer you to the district attorney. [52:47.300 --> 52:52.300] You can go to the district attorney and say, the district judge said [52:53.300 --> 52:56.300] you were supposed to take these complaints. He sent me to you. [52:56.300 --> 53:05.300] Now you put him on the dot. You're going to have everybody in the courthouse discussing this. [53:06.300 --> 53:11.300] And the one thing that scumbags don't like is sunshine. [53:12.300 --> 53:20.300] They don't want what they're doing being exposed to someone who could have authority over them. [53:20.300 --> 53:29.300] So this frightens them. And the more corrupt they are, the more susceptible to this they become. [53:30.300 --> 53:33.300] And you'll find this is a lot easier than you think. [53:34.300 --> 53:42.300] I've filed some Colorado Open Records acts trying to get into their internal emails [53:42.300 --> 53:49.300] to prove up some of the facts that these guys have a little bit of collusion going on [53:50.300 --> 53:54.300] amongst the family members in the county up there. [53:55.300 --> 53:59.300] And every time I turn in a CORA, I always get turned over to the county attorney [54:00.300 --> 54:03.300] and they're giving me some run arounds why they can't answer it. [54:05.300 --> 54:09.300] What are the records procedures in Colorado? [54:09.300 --> 54:11.300] What's that? [54:12.300 --> 54:16.300] Okay, what is the Open Records law in Colorado? [54:17.300 --> 54:23.300] Yeah, the Colorado Open Records law is that the county has to have a custodian of records [54:24.300 --> 54:29.300] for every one of the departments. And so the Colorado Open Records Act tells them [54:30.300 --> 54:33.300] what they have to do within three days when you file your Open Records Act. [54:34.300 --> 54:36.300] And it goes right to the custodian of records. [54:36.300 --> 54:40.300] Well, in our county, when you turn it in, it goes right to the county attorney, [54:41.300 --> 54:42.300] not the custodian of records. [54:43.300 --> 54:46.300] And then the county attorney tells you what he's going to give you and what he wants. [54:47.300 --> 54:54.300] Okay, then if you don't get what you want, then file complaints against the custodian of the record. [54:55.300 --> 54:56.300] All right. [54:57.300 --> 54:58.300] You don't care what the attorney said. [54:59.300 --> 55:03.300] Let the attorney explain to them why they're getting charged you filed against them. [55:03.300 --> 55:05.300] All right. [55:06.300 --> 55:08.300] And who would want to be the attorney at every opportunity? [01:06:36.300 --> 01:06:46.300] They are adding to that problem all of the dispersants, the toxic dispersants that they are adding into the water, [01:06:47.300 --> 01:06:49.300] and they are refusing to release information on those, [01:06:50.300 --> 01:07:01.300] but they are looking at moving up to a hundred mile swath from the tip of Texas to the Florida Keys out of the Gulf region. [01:07:01.300 --> 01:07:11.300] That is 40 million people and contains 87% of the United States oil refining capability [01:07:12.300 --> 01:07:18.300] and all of the deep water oil tanker unloading facilities for the entire country. [01:07:18.300 --> 01:07:31.300] So maybe those FEMA camps that certain individuals on TV say don't exist will start being filled up. [01:24:32.300 --> 01:24:40.300] It's a good friend of mine who has spent over six months in jail now as retaliation against him [01:24:40.300 --> 01:24:50.300] by the Carilkin Police Department and Denton County District Attorney's Office. [01:24:50.300 --> 01:24:56.300] I have permission to mention his name since it's been out in national news previously. [01:24:56.300 --> 01:24:58.300] His name's Steve Benser. [01:24:58.300 --> 01:25:04.300] Made national news a little over a year ago whenever he had been complaining to the police department [01:25:04.300 --> 01:25:11.300] about a neighbor who was, well, it would be a compliment to call them trailer trash. [01:25:11.300 --> 01:25:21.300] Foodland kids violating all kinds of code ordinances, things like that, and he would photograph [01:25:21.300 --> 01:25:29.300] or videotape what they were doing and report it to code compliance or whoever. [01:25:29.300 --> 01:25:36.300] They got tired of it, and they had friends on the police department, and one of the dispatchers [01:25:36.300 --> 01:25:41.300] and one of the officers and a couple of other dispatchers decided one night to come over [01:25:41.300 --> 01:25:46.300] and egg his house, and the officers egged his house. [01:25:46.300 --> 01:25:53.300] They got caught and got fired, and that made national news because he first charged against them [01:25:53.300 --> 01:25:57.300] and said he wanted it handled. [01:25:57.300 --> 01:26:03.300] Well, the officers got fired, so that started the whole thing. [01:26:03.300 --> 01:26:10.300] They then charged him with stalking the neighbor, even though he'd never made contact with them, [01:26:10.300 --> 01:26:15.300] never threatened them, never did anything other than photograph and report. [01:26:15.300 --> 01:26:29.300] And one of the neighbor's kids made numerous violent threats against him, and he has that on audio tape. [01:26:29.300 --> 01:26:36.300] And one time the kid was approaching him in a very threatening manner and screaming threats at him. [01:26:36.300 --> 01:26:43.300] He pulls out a small knife and holds it in his hand and holds it, in fact, behind his back [01:26:43.300 --> 01:26:53.300] where it's not visible, and they report that and they charge him with assault with a deadly weapon. [01:26:53.300 --> 01:27:01.300] They've charged him with stalking. He was in jail for almost six months under $2 million bond [01:27:01.300 --> 01:27:05.300] for having done nothing to anyone. [01:27:05.300 --> 01:27:14.300] And for comparison, another guy walks up to a guy in a bar in Denton County, pulls out a knife, [01:27:14.300 --> 01:27:21.300] slits his throat and kills him, and he was under $75,000 bond from the same VA. [01:27:21.300 --> 01:27:30.300] So that's what's going on in his case, and we're trying to find some way to get him out. [01:27:30.300 --> 01:27:44.300] He was out briefly, went into a gas station the other day, and one of the other neighbor kids was there. [01:27:44.300 --> 01:27:47.300] There's a protective order that he's supposed to stay so many feet away. [01:27:47.300 --> 01:27:55.300] He sees them, turns around and leaves, and they then arrest him and charge him with another account of stalking. [01:27:55.300 --> 01:28:06.300] So it's massive retaliation that's going on, and nobody really knows how to deal with it. [01:28:06.300 --> 01:28:12.300] Well, there's a constitutional provision that says excessive bails and fines shall not be imposed. [01:28:12.300 --> 01:28:16.300] $2 million sounds awful excessive for what we've got going on here. [01:28:16.300 --> 01:28:19.300] Oh, absolutely. [01:28:19.300 --> 01:28:30.300] I mean, there's a clear Eighth Amendment violation, but he has a relatively ineffective lawyer. [01:28:30.300 --> 01:28:34.300] As opposed to one of the kind. [01:28:34.300 --> 01:28:36.300] Good point. [01:28:36.300 --> 01:28:43.300] But there's not a whole lot that we know what to do. [01:28:43.300 --> 01:28:49.300] The lawyer is just kind of screwing around and not doing anything all that effectively, [01:28:49.300 --> 01:28:59.300] and so trying to find if there's any other way that we can take action as individuals [01:28:59.300 --> 01:29:08.300] to bypass the lawyer and try to get something done to get some relief, at least get him out of jail. [01:29:08.300 --> 01:29:16.300] Well, you can do a habeas corpus to a judge of a higher court, [01:29:16.300 --> 01:29:26.300] as far as that goes, using the Eighth Amendment as grounds for one. [01:34:55.300 --> 01:34:58.300] He had a dog that was barking most of the night. [01:34:58.300 --> 01:35:02.300] He calls the neighbor, says, you know, [01:35:02.300 --> 01:35:06.300] the voicemail says, please, you know, do something about your barking dog, [01:35:06.300 --> 01:35:11.300] or else I will be forced to, you know, report you again. [01:35:11.300 --> 01:35:16.300] And that was what they arrested him on, was threatening the neighbor. [01:35:16.300 --> 01:35:22.300] A $2 million bond for threatening the neighbor with a knife? [01:35:22.300 --> 01:35:28.300] No, it was, there were four charges, a quarter million dollars on each one. [01:35:28.300 --> 01:35:30.300] I mean, a half million on each one. [01:35:30.300 --> 01:35:32.300] What were the three charges? [01:35:32.300 --> 01:35:39.300] Two counts of stalking, one of threatening, that was the phone call, [01:35:39.300 --> 01:35:43.300] and one of assault, where he was backing away from the kid [01:35:43.300 --> 01:35:48.300] and just had the knife in his hand behind his back where he wasn't threatening it, [01:35:48.300 --> 01:35:51.300] him brandishing it or anything like that. [01:35:51.300 --> 01:35:55.300] So I suppose the kids told a totally different story. [01:35:55.300 --> 01:36:02.300] Oh, of course, yes, the kid who has a rap sheet as long as your arm. [01:36:02.300 --> 01:36:07.300] This is the same kid that said, that got him thrown back in jail the other day [01:36:07.300 --> 01:36:11.300] because he said, oh, he was following me, he followed me to the store, [01:36:11.300 --> 01:36:15.300] and, you know, whenever he pulls into the 7-Eleven and sees him there [01:36:15.300 --> 01:36:19.300] and turns around and drives off. [01:36:19.300 --> 01:36:26.300] Any petition for a show-cause hearing or a bond reduction hearing? [01:36:26.300 --> 01:36:34.300] The lawyer has been trying to do that, and they keep getting postponed. [01:36:34.300 --> 01:36:39.300] Okay, is the lawyer hired or court-appointed? [01:36:39.300 --> 01:36:49.300] He is hired and has received a fairly substantial payment. [01:36:49.300 --> 01:36:51.300] I'm not surprised. [01:36:51.300 --> 01:36:53.300] Yeah. [01:36:53.300 --> 01:37:01.300] She's going to do her job and maneuver him into taking a deal. [01:37:01.300 --> 01:37:02.300] That's what they do. [01:37:02.300 --> 01:37:06.300] Which he won't. [01:37:06.300 --> 01:37:10.300] That's the only way he's going to beat it. [01:37:10.300 --> 01:37:14.300] But if he's got it counseled, there's little we can do. [01:37:14.300 --> 01:37:15.300] Right. [01:37:15.300 --> 01:37:21.300] He needs a show-cause hearing or a bond reduction hearing. [01:37:21.300 --> 01:37:29.300] And if he has evidence, ah, who issued the warrants? [01:37:29.300 --> 01:37:37.300] There was evidence on one of the cases where he had supposedly violated [01:37:37.300 --> 01:37:45.300] the protective border, which a neighbor had on his own surveillance video [01:37:45.300 --> 01:37:52.300] that he did not come anywhere close to them and attempted to show that [01:37:52.300 --> 01:37:57.300] to the DA, and he wouldn't look at it. [01:37:57.300 --> 01:38:00.300] Then file against the DA. [01:38:00.300 --> 01:38:05.300] American Bar Association standards for the prosecutorial function, [01:38:05.300 --> 01:38:12.300] standard 3-3.11, says that it is unethical conduct for a prosecuting [01:38:12.300 --> 01:38:17.300] attorney to refrain from pursuing evidence solely because the evidence [01:38:17.300 --> 01:38:22.300] will show the innocence of the accused or mitigate the guilt of the accused. [01:38:22.300 --> 01:38:27.300] I believe the district attorney for that issue. [01:38:27.300 --> 01:38:28.300] Right. [01:38:28.300 --> 01:38:32.300] If he refuses to consider it sculptural evidence. [01:38:32.300 --> 01:38:34.300] Here's the thing. [01:38:34.300 --> 01:38:39.300] Whenever he finally got a copy of the videotape and saw that, [01:38:39.300 --> 01:38:42.300] that's when he changed one of the charges. [01:38:42.300 --> 01:38:45.300] Because one of the charges had been violating the protective order, [01:38:45.300 --> 01:38:49.300] and he changed that one to making the phone call of, [01:38:49.300 --> 01:38:52.300] your dog the charge of... What do you mean he changed? [01:38:52.300 --> 01:38:53.300] Who was he? [01:38:53.300 --> 01:38:56.300] The DA. [01:38:56.300 --> 01:38:59.300] So the DA finally saw the video? [01:38:59.300 --> 01:39:05.300] Yeah, saw he was sunk, and so he changed the charges. [01:39:05.300 --> 01:39:09.300] One of the charges that he had originally been arrested on was [01:39:09.300 --> 01:39:13.300] violating the protective order, which he didn't do. [01:39:13.300 --> 01:39:16.300] And the neighbor had it on his own surveillance video. [01:39:16.300 --> 01:39:21.300] He was nowhere near it and also had the fact that one of the kids came out [01:39:21.300 --> 01:39:26.300] and said here's where he was standing whenever that person wasn't even there. [01:39:26.300 --> 01:39:32.300] Okay, did he file aggravated perjury against whoever made the statement? [01:39:32.300 --> 01:39:35.300] Okay. [01:39:35.300 --> 01:39:39.300] File it with the DA, get the DA to refuse to take it, [01:39:39.300 --> 01:39:45.300] and you want to try Judge Shipman. [01:39:45.300 --> 01:39:46.300] Okay. [01:40:33.300 --> 01:40:40.300] But take criminal charges to him to his court while he's having motion hearings. [01:40:40.300 --> 01:40:41.300] Okay. [01:40:41.300 --> 01:40:44.300] Because there's lots of breaks, and you can check with the clerk [01:40:44.300 --> 01:40:47.300] and find out when each judge has motion hearings. [01:40:47.300 --> 01:40:48.300] Okay. [01:40:48.300 --> 01:40:52.300] And just go in the court and walk up to the bar and point at the bailiff. [01:40:52.300 --> 01:40:54.300] You, come here. [01:40:54.300 --> 01:40:56.300] And he's not going to like that. [01:40:56.300 --> 01:41:01.300] And you tell him your name, then tell him, [01:41:01.300 --> 01:41:04.300] instruct the judge that I have business with the court. [01:41:04.300 --> 01:41:05.300] Okay. [01:41:05.300 --> 01:41:09.300] And he will say, may I tell the judge the nature of the business? [01:41:09.300 --> 01:41:11.300] And you tell him, no, you may not. [01:41:11.300 --> 01:41:13.300] I have business with the court, and it's none of yours. [01:41:13.300 --> 01:41:14.300] You're dismissed. [01:41:14.300 --> 01:41:15.300] Go sit down. [01:41:15.300 --> 01:41:16.300] Yeah. [01:41:16.300 --> 01:41:17.300] Don't say go sit down. [01:41:30.300 --> 01:41:35.300] I've got a case coming up in front of the Fifth Court of Appeals [01:41:35.300 --> 01:41:39.300] from my little seat belt thing, [01:41:39.300 --> 01:41:43.300] and it was challenging jurisdiction all the way up [01:41:43.300 --> 01:41:46.300] because nobody had any oath of office. [01:41:46.300 --> 01:41:53.300] I was in the court talking to the clerk yesterday, [01:41:53.300 --> 01:41:59.300] wanting to get some more information about the fact that the state has failed to respond, [01:41:59.300 --> 01:42:03.300] and it comes up next week. [01:42:03.300 --> 01:42:15.300] And I was asking about, you know, if the state doesn't respond, you know, what happens, [01:42:15.300 --> 01:42:19.300] and they said, well, they may still decide the case without it. [01:42:19.300 --> 01:42:24.300] Well, okay, excuse me, if the state doesn't appear, you know, there is no case. [01:42:24.300 --> 01:42:30.300] And I mentioned something about objecting or something like that, [01:42:30.300 --> 01:42:33.300] and they said, oh, no, you're not allowed in the courtroom. [01:42:33.300 --> 01:42:35.300] Excuse me, I'm the one on trial. [01:42:35.300 --> 01:42:37.300] Oh, well, this is not open to the public. [01:42:37.300 --> 01:42:42.300] Oh, the Court of Appeals is a star chamber. [01:42:42.300 --> 01:42:43.300] No, no, no. [01:42:43.300 --> 01:42:45.300] This is just the way we do it. [01:42:45.300 --> 01:42:46.300] I'm the accused. [01:42:46.300 --> 01:42:47.300] I'm on trial. [01:42:47.300 --> 01:42:49.300] I'm going to be there in court. [01:42:58.300 --> 01:43:03.300] Yeah, I would go down there and remind the court that the Constitution says [01:43:03.300 --> 01:43:09.300] and Article 1.24, Texas Code of Criminal Procedure says, [01:43:09.300 --> 01:43:15.300] the Constitution says that you have a right to a fair and public trial. [01:43:15.300 --> 01:43:16.300] Yes. [01:43:16.300 --> 01:43:20.300] Article 1.24 is a little more specific. [01:43:20.300 --> 01:43:26.300] All courts shall be public. [01:43:26.300 --> 01:43:29.300] Part of that's hard to understand. [01:43:29.300 --> 01:43:30.300] Yeah. [01:48:43.300 --> 01:48:50.300] I hear a lot of these folks doing pro se work, and when the court finds out that they're going to give them a spanking, [01:48:50.300 --> 01:48:58.300] they make them sit down and wait until everybody else has gone out of the room before they hear the trial or whatever it is, the action. [01:48:58.300 --> 01:49:06.300] And so nobody else gets the benefit of the procedure, but then the person has to wait hours and hours for all the other stuff. [01:49:06.300 --> 01:49:13.300] Is there any way to compel a judge to, you know, when they address you and find out what's going on, [01:49:13.300 --> 01:49:19.300] that they can't make you sit down and wait until the end of the day so that nobody else hears what happens? [01:49:19.300 --> 01:49:23.300] No, there's no way to compel them. [01:49:23.300 --> 01:49:33.300] They can pretty much do what they want to as far as the administration of their court. [01:49:33.300 --> 01:49:38.300] Do they need any kind of grounds, or is there a judicial canon that can be used against them for it? [01:49:38.300 --> 01:49:47.300] No, that goes to the administration of the court, and that's pretty much left to the judge. [01:49:47.300 --> 01:49:57.300] The judges aren't bound so tightly because it's expected that they are just and righteous and all that other stuff. [01:49:57.300 --> 01:50:03.300] So it gives them leeway to be unjust and unrighteous, and it's hard. [01:50:03.300 --> 01:50:07.300] Some things are hard for us to change, and that's one of them. [01:50:07.300 --> 01:50:11.300] Do notice, though, he said just and righteous, okay? [01:50:11.300 --> 01:50:17.300] He didn't say competent, he didn't say learned, he didn't say above average IQ. [01:50:17.300 --> 01:50:20.300] Right, right. [01:50:20.300 --> 01:50:26.300] Okay, well, it just would help a lot of people if they could hear these kinds of pro se actions that succeed against the judges, [01:50:26.300 --> 01:50:29.300] but I guess there's nothing to do about it. [01:50:29.300 --> 01:50:36.300] Well, not unless some of these legislative enactments, Randy and I are going to be tasked with writing, [01:50:36.300 --> 01:50:38.300] we address that issue specifically. [01:50:38.300 --> 01:50:45.300] If you give somebody a set date and set time to appear for trial, you should be hearing the trial at the set date and set time, [01:50:45.300 --> 01:50:49.300] so it is a matter of convenience to the accused. [01:50:50.300 --> 01:50:57.300] That's exactly right because these people are having to be, they're being told to sit down and wait until everybody else is done. [01:50:57.300 --> 01:51:01.300] It's 4.30 in the afternoon and trying to hide the procedure. [01:51:01.300 --> 01:51:04.300] Yeah, and that's what they do. [01:51:04.300 --> 01:51:08.300] Yeah. [01:54:22.300 --> 01:54:29.300] Well, I'm happy to say I feel good because I got that information [01:54:29.300 --> 01:54:33.300] and took care of a couple of judges, hopefully. [01:54:33.300 --> 01:54:34.300] Good. [01:54:34.300 --> 01:54:46.300] And it does feel good when you get involved in the process [01:54:46.300 --> 01:54:47.300] and defending your rights. [01:54:47.300 --> 01:54:52.300] And in this case I was a little bit, I didn't know exactly what to do [01:54:52.300 --> 01:54:56.300] with these two judges. [01:54:56.300 --> 01:54:59.300] But hopefully, as you said last week, Randy, [01:54:59.300 --> 01:55:04.300] hopefully this will get their attention. [01:55:41.300 --> 01:55:44.300] I can tell you from experience that really works. [01:55:44.300 --> 01:55:47.300] You want to see a chicken dance? [01:55:47.300 --> 01:55:51.300] You make that accusation and you get to see the chicken dance. [01:55:51.300 --> 01:55:54.300] They start stepping from one foot to the other [01:55:54.300 --> 01:55:57.300] and they start trying to come up with this excuse [01:55:57.300 --> 01:56:00.300] and this assurance that the judge didn't send them. [01:56:00.300 --> 01:56:03.300] Because the last thing they're going to want you to do [01:56:03.300 --> 01:56:09.300] is file another complaint against the judge for retaliation. [01:56:09.300 --> 01:56:12.300] Because when you do that and the judge sees it, [01:56:12.300 --> 01:56:16.300] he's going to want to talk to this bailiff. [01:56:16.300 --> 01:56:20.300] The bailiff can be perfectly innocent. [01:56:20.300 --> 01:56:25.300] Sorry, Bubba, life is tough. [01:56:25.300 --> 01:56:29.300] You're going to enjoy this, win, lose, or draw. [01:56:29.300 --> 01:56:33.300] No, I'm not finished with these guys. [01:56:33.300 --> 01:56:42.300] I've already filed a partial appeal on a couple of matters on my case. [01:56:42.300 --> 01:56:49.300] Now the magistrate has made a recommendation to the federal judge. [01:56:49.300 --> 01:56:52.300] I'm already familiar with Sam Spark.
